L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY युवा काययक्रम और खेल मंत्रालय (खेल जवभाग) अजधसूचना नई दिल्ली, 10 िनवरी, 2026 सा.का.जन. 18(अ).- केन्द्रीय सरकार, राष्ट्रीय खेल िासन अजधजनयम, 2025 ( वर्य 2025 का 25) की धारा 31 की उपधारा (1) तथा उपधारा (2) के खंड (क), (ख), (ग), (ट), (ड), (ढ़) और (न) द्वारा प्रित्त िजियों का प्रयोग करते हुए, जनम्नजलजखत जनयम बनाती है, अथायत्:- अध्याय 1 प्रारंजभक 1. संजिप्त नाम और प्रारंभ—(1) इन जनयमों का संजिप्त नाम राष्ट्रीय खेल िासन (राष्ट्रीय खेल जनकाय) जनयम, 2026 है। सं. 18] नई दिल्ली, सोमवार, िनवरी 12, 2026/पौर् 22, 1947 No. 18] NEW DELHI, MONDAY, JANUARY 12, 2026/PAUSHA 22, 1947 सी.जी.-डी.एल.-अ.-12012026-269296 CG-DL-E-12012026-269296 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ये जनयम रािपत्र में प्रकािन की तारीख से प्रभावी होंगे। 2. पररभार्ाएँ - (1) इन जनयमों में , िब तक दक संिभय से अन्द्यथा अपेजित न हो - (क) "अजधजनयम" से राष्ट्रीय खेल िासन अजधजनयम, 2025 (वर्य 2025 का 25) अजभप्रेत है; (ख) "केन्द्रीय सरकार" से केन्द्रीय सरकार का वह जवभाग अजभप्रेत है जिसे भारत सरकार (कायय आबंटन) जनयम, 1961 के अन्द्तगयत खेल जवर्य आवंरटत दकया गया है; (ग) "जनवायजचत पि" से काययकारी सजमजत के सभी पि अजभप्रेत है, जसवाय, - (i) अजधजनयम की धारा 4 की उपधारा (1) के अधीन खंड (ख) के उपखंड (ii) के अधीनखेल सजमजत के प्रजतजनजधयों के जलए आरजित पि; और (ii) अजधजनयम की धारा 4 की उपधारा (1) के अन्द्तगयत खण्ड (ख) के उपखण्ड (iii) के अन्द्तगयत पिेन सिस्ट्यों द्वारा धाररत दकए िाने वाले पि ; (घ) "जनवायचन जनयमों" से अनुसूची II में जवजनर्ियष्ट काययकारी सजमजतयों के चुनावों पर लागू जनयम अजभप्रेत है; (ङ) "जनवायचन अजधकारी" से अजधजनयम की धारा 16 की उपधारा (1) के अन्द्तगयत अजधसूजचत व्यजि अजभप्रेत है; (च) ''काययकारी सजमजत'' से अजधजनयम की धारा 4 की उपधारा (1) के खंड (ख) के अनुसरण में प्रत्येक राष्ट्रीय खेल जनकाय में गरित सजमजत से अजभप्रेत है; (छ) "सामान्द्य जनकाय" से अजधजनयम की धारा 4 की उपधारा (1) के खंड (क) के अनुसरण में प्रत्येक राष्ट्रीय खेल जनकाय में गरित जनकाय अजभप्रेत है; (ि) "राष्ट्रीय खेल जनकाय" से अजधजनयम की धारा 5 के अन्द्तगयत स्ट्थाजपत जनकाय अजभप्रेत है; (झ) “अनुसूची” से इन जनयमों के साथ संलग्न अनुसूची अजभप्रेत है; और (ञ) "उत्कृष्ट योग्यता वाले जखलाज़ियों के जलए पात्रता जनयम" में अनुसूची I में जवजनर्ियष्ट उत्कृष्ट योग्यता वाले जखलाज़ियों के जलए पात्रता जनयमों अजभप्रेत है। (2) इन जनयमों में प्रयुि िब्िों और पि, िो इसमें पररभाजर्त नहीं है, दकन्द्तु अजधजनयम में पररभाजर्त है, के वही अथय होंगे, िो उनके अजधजनयम में हैं। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अध्याय 2 उत्कृष्ट योग्यता वाले जखला़िी 3. महासभा में उत्कृष्ट योग्यता वाले जखलाज़ियों का प्रजतजनजधत्व — (1) प्रत्येक राष्ट्रीय खेल जनकाय की महासभा में, मतिान सिस्ट्य के रूप में, कम से कम चार अथवा कोई अन्द्य उच्चतर सम संख्या में उत्कृष्ट योग्यता वाले जखलाज़ियों को सजममजलत दकया िाएगा, जिनमें से पचास प्रजतित उत्कृष्ट योग्यता वाले पुरुर् जखला़िी होंगे और पचास प्रजतित उत्कृष्ट योग्यता वाली मजहला जखला़िी होंगी। (2) उप-जनयम (1) के अधीनउत्कृष्ट योग्यता वाले जखलाज़ियों को जनवायचन या नामांकन की जवजध संबंजधत राष्ट्रीय खेल संस्ट्था के उपजनयमों में जवजनर्ियष्ट की िा सकती है। 4. काययकारी सजमजत में उत्कृष्ट योग्यता वाले जखलाज़ियों का प्रजतजनजधत्व —अजधजनयम की धारा 4 की उपधारा (1) के खंड (ख) के उपखंड (i) के अनुसरण में, उत्कृष्ट योग्यता वाले जखलाज़ियों को काययकारी सजमजत में सजममजलत दकया िाएगा और जनयम 9 के अनुसार काययकारी सजमजत में उनका जनवायचन दकया िाएगा। 5. पात्रता मानिंड और आवेिन — (1) राष्ट्रीय खेल जनकाय उन व्यजियों से आवेिन आमंजत्रत करेगी जिन्द्हें उत्कृष्ट योग्यता वाले जखला़िी के रूप में जवचार दकया िाना है और ऐसे आवेिन आमंत्रण में सामान्द्य पात्रता मानिंड तथा स्ट्तरीकृत पात्रता मानिंड, िैसा दक अनुसूची-I में जवजनर्ियष्ट है, का उल्लेख दकया िाएगा, जिसके आधार पर उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची तैयार की िाएगी। (2) उत्कृष्ट योग्यता वाले जखला़िी के रूप में आवेिन प्रस्ट्तुत करने वाले दकसी भी व्यजि को अनुसूची-I के अधीनउत्कृष्ट योग्यता वाले जखलाज़ियों की पात्रता जनयमावली में जवजनर्ियष्ट सामान्द्य पात्रता मानिंडों को पूरा करना होगा और आवेिन आमंजत्रत दकए िाने की तारीख से साि दिनों की अवजध के भीतर संबंजधत राष्ट्रीय खेल जनकाय को आवेिन प्रस्ट्तुत करना होगा, िो उस संस्ट्था की काययकारी सजमजत द्वारा या उसके उपजनयमों में जवजनर्ियष्ट प्ररूप और िानकारी के अनुसार हो। 6. उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची— (1) जनयम 5 के उप-जनयम (2) के अधीनप्रस्ट्तुत आवेिनों पर जवचार करने के पश्चात्, प्रत्येक राष्ट्रीय खेल जनकाय अपने संबंजधत खेल के संबंध में उत्कृष्ट योग्यता वाले पुरुर् जखलाज़ियों की एक सूची तथा उत्कृष्ट योग्यता वाली मजहला जखलाज़ियों की एक सूची तैयार करेगा और यह सूची उस राष्ट्रीय खेल संस्ट्था की वतयमान काययकारी सजमजत के काययकाल की समाजप्त से कम से कम नब्बे दिन पूवय तैयार करेगा। (2) यथाजस्ट्थजत उत्कृष्ट योग्यता वाले पुरुर् जखलाज़ियों की सूची तथा उत्कृष्ट योग्यता वाली मजहला जखलाज़ियों की सूची, िोनों में उतने जखलाज़ियों की संख्या सजममजलत की िाए िो संबंजधत राष्ट्रीय खेल जनकाय की महासभा में उत्कृष्ट योग्यता वाले पुरुर् जखलाज़ियों अथवा उत्कृष्ट योग्यता वाली मजहला जखलाज़ियों की संख्या, से िस गुना होगी। (3) राष्ट्रीय खेल जनकाय, उत्कृष्ट योग्यता वाले जखलाज़ियों की संबंजधत सूची तैयार करते समय, उत्कृष्ट योग्यता वाले पुरुर् जखलाज़ियों तथा उत्कृष्ट योग्यता वाली मजहला जखलाज़ियों पर िो भी लागू हो, जनम्नजलजखत प्रदक्रया का पालन करेगी, यथा:— 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) पहली बार, वे सभी आवेिक िो अनुसूची-I में जवजनर्ियष्ट सामान्द्य पात्रता मानिंड तथा स्ट्तरीकृत पात्रता मानिंड के प्रथम स्ट्तर (रटयर 1) की आवश्यकता को पूरा करते हैं, उन्द्हें संबंजधत उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची में सजममजलत दकया िाएगा। (ख) यदि उपखंड (क) के अनुसार उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची उप-जनयम (2) में जवजनर्ियष्ट सीमा तक तैयार नहीं की िा सकती है, तो राष्ट्रीय खेल जनकाय उन आवेिकों को सजममजलत करेगी िो सामान्द्य पात्रता मानिंड तथा स्ट्तरीकृत पात्रता मानिंड को पूरा करते हों और उन्द्हें क्रजमक रूप से उस स्ट्तर के तुरंत पश्चात वाले स्ट्तर में सजममजलत दकया िाएगा जिसे अंजतम बार जवचार दकया गया था, िब तक दक संबंजधत उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची में सजममजलत आवेिकों की संख्या उि सीमा को पूरा न कर ले। (ग) यदि दकसी जविेर् स्ट्तर (रटयर) के उपयोग के पररणामस्ट्वरूप उत्कृष्ट योग्यता वाले जखलाज़ियों की संख्या उप-जनयम (2) में जवजनर्ियष्ट सीमा से अजधक हो िाती है, तो उस स्ट्तर के अधीनयोग्य अभ्यर्थयों के समूह में आयु के आधार पर सबसे वररष्ठ आवेिक को चयन में प्राथजमकता और वरीयता िी िाएगी; और (घ) यदि राष्ट्रीय खेल जनकाय उप-जनयम (2) में जवजनर्ियष्ट सीमा तक संबंजधत उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची को उपखंड (क) से (ग) के अधीनदिए गए चरणों के आधार पर तैयार करने में असमथय होती है, तो वह जनयम 5 के उप-जनयम (1) के अनुसार पुनः आवेिन आमंजत्रत कर सकती है अथवा ऐसी उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची के जलए अजतररि स्ट्तरीकृत मानिंड तैयार और स्ट्वीकृत कर सकती है, िो अनुसूची-I में प्रयुि जसद्ांतों पर आधाररत होंगे। (4) उत्कृष्ट योग्यता वाले जखलाज़ियों की सूजचयाँ, जिन्द्हें इस जनयम के अनुसार अंजतम रूप दिया गया है, संबंजधत राष्ट्रीय खेल जनकाय की आजधकाररक वेबसाइट पर प्रकाजित की िाएंगी और राष्ट्रीय खेल बोडय को प्रस्ट्तुत की िाएंगी। (5) दकसी भी व्यजि का नाम यदि उत्कृष्ट योग्यता वाले जखलाज़ियों की सूची में सजममजलत है, तो उसे उस राष्ट्रीय खेल जनकाय के संबंध में अजधजनयम और उसके अधीनबनाए गए जनयमों के प्रयोिनों के जलए उत्कृष्ट योग्यता वाला जखला़िी माना िाएगा। अध्याय 3 महासभा और काययकारी सजमजत 7. महासभा की संरचना।— (1) प्रत्येक राष्ट्रीय खेल जनकाय की महासभा में जनम्नजलजखत श्रेजणयों के सिस्ट्य होंगे:— (क) कम से कम चार उत्कृष्ट योग्यता वाले जखला़िी; (ख) राष्ट्रीय ओलंजपक सजमजत के मामले में, राष्ट्रीय ओलंजपक सजमजत की उपजनयमों में जवजनर्ियष्ट पिेन सिस्ट्य; (ग) राष्ट्रीय ओलंजपक सजमजत के मामले में, प्रत्येक राष्ट्रीय खेल पररसंघ के प्रजतजनजध िो राष्ट्रीय खेल बोडय के साथ संबद् इकाई के रूप में रजिस्ट्रीकृत हैं; (घ) राष्ट्रीय ओलंजपक सजमजत के अजतररि दकसी अन्द्य राष्ट्रीय खेल जनकाय के मामले में, प्रत्येक राज्य स्ट्तरीय संबद् इकाई के प्रजतजनजध, िो राष्ट्रीय खेल बोडय के साथ रजिस्ट्रीकृत हैं; और [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ङ) राष्ट्रीय खेल जनकाय के उपजनयमों द्वारा प्रित्त अन्द्य दकसी श्रेणी के व्यजि, िो अंतरायष्ट्रीय ओलंजपक सजमजत द्वारा िारी सुसंगत अंतरायष्ट्रीय चाटयर और जवजधयों के अनुरूप हों, अथवा संबंजधत अंतरायष्ट्रीय खेल जनकाय द्वारा आवश्यक हों। (2) उप-जनयम (1) के उपखंड (क) में जवजनर्ियष्ट उत्कृष्ट योग्यता वाले जखलाज़ियों का महासभा में जनवायचन या नामांकन, संबंजधत राष्ट्रीय खेल जनकाय की वतयमान काययकारी सजमजत के काययकाल की समाजप्त से कम से कम पचहत्तर दिन पूवय दकया िाएगा। 8. काययकारी सजमजत का काययकाल और संरचना— (1) प्रत्येक राष्ट्रीय खेल जनकाय की काययकारी सजमजत का काययकाल, संबंजधत जनकाय की उपजनयमों द्वारा जनधायररत दकया िाएगा, परंतु वह चार वर्य से अजधक नहीं होगा। (2) दकसी राष्ट्रीय खेल जनकाय के उपजनयमों में उसकी संरचना जवजनर्ियष्ट करते समय यह सुजनजश्चत दकया िाएगा दक काययकारी सजमजत में उत्कृष्ट योग्यता वाले जखलाज़ियों में से कम से कम एक मजहला हो तथा एथलीट सजमजत के प्रजतजनजधयों में से भी कम से कम एक मजहला हो। 9. काययकारी सजमजत के जनवायचन की प्रदक्रया— (1) काययकारी सजमजत के सभी जनवायजचत पिों का जनवायचन प्रत्येक चार वर्य में कम से कम एक बार जनष्पि और पारििी तरीके से तथा अनुसूची-II में जवजनर्ियष्ट जनवायचन जनयमों के अनुसार दकया िाएगा। (2) िब तक अंतरायष्ट्रीय चाटयर और जवजधयों में अन्द्यथा जवजनर्ियष्ट न हो, काययकारी सजमजत अपने काययकाल की समाजप्त से कम से कम साि दिन पूवय एक प्रस्ट्ताव द्वारा राष्ट्रीय खेल जनवायचन पैनल से एक जनवायचन अजधकारी की जनयुजि करेगी, िो जनवायचन सूची तैयार करने और काययकारी सजमजत तथा एथलीट सजमजत के जनवायचन का संचालन करेगा। (3) काययकारी सजमजत, उप-जनयम (2) के अधीनजनयुि जनवायचन अजधकारी से परामिय करके, अपने काययकाल की समाजप्त से कम से कम पचास दिन पूवय जनवायचन की तारीख अजधसूजचत करेगी। (4) जनवायचन अजधकारी, अनुसूची-II में जनजहत जनवायचन जनयमों के अनुसरण में, राष्ट्रीय खेल जनकाय की काययकारी सजमजत के जनवायचन को सुचारु रूप से संपन्न कराने के जलए उत्तरिायी होगा। (5) राष्ट्रीय खेल जनकाय, जनवायचन अजधकारी द्वारा जवजनर्ियष्ट आवश्यक संख्या में प्रिासजनक कमयचाररयों को उपलब्ध कराएगी तादक वह अजधकारी काययकारी सजमजत के जनवायचन का संचालन कर सके। (6) राष्ट्रीय खेल जनकाय अपनी काययकारी सजमजत के जनवायचन के जलए इन जनयमों में जवजनर्ियष्ट समय-सीमाओं का पालन करेगी और उन्द्हें नीचे दिए गए समय-सारणी अनुसार संिेप में प्रस्ट्तुत दकया िाएगा। जनयम/खंड जवर्य समय-सारणी जनयम 5(2) उत्कृष्ट योग्यता वाले जखला़िी बनने के जलए आवेिन िमा करना जनयम 5 के उप-जनयम (1) के अधीन आवेिन आमंजत्रत दकए िाने के साि दिनों के भीतर जनयम 6(1) उत्कृष्ट योग्यता वाले पुरुर् जखलाज़ियों की सूची और उत्कृष्ट योग्यता वाली मजहला जखलाज़ियों की सूची तैयार करना जवद्यमान काययकारी सजमजत का काययकाल खत्म होने से कम से कम नब्बे दिन पूवय जनयम 7(2) महासभा के जलए उत्कृष्ट योग्यता वाले जखलाज़ियों का जनवायचन या नामांकन जवद्यमान काययकारी सजमजत का काययकाल खत्म होने से कम से कम पचहत्तर दिन पूवय जनयम 9(2) एक जनवायचन अजधकारी की जनयुजि जवद्यमान काययकारी सजमजत का काययकाल खत्म होने 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] से कम से कम साि दिन पूवय जनयम 9(3) जनवायचन की तारीख की सूचना जवद्यमान काययकारी सजमजत का काययकाल खत्म होने से कम से कम पचास दिन पूवय जनयम 10(5) प्रारूप जनवायचन सूची तैयार करना और िारी करना जवद्यमान काययकारी सजमजत का काययकाल खत्म होने से कम से कम पैंतालीस दिन पूवय अनुसूची II का खंड 5(i) जनवायचन की घोर्णा, अंजतम जनवायचन सूची िारी करना और नामांकन के जलए आमंत्रण जवद्यमान काययकारी सजमजत का काययकाल खत्म होने से कम से कम तीस दिन पूवय 10. काययकारी सजमजत का जनवायचन— (1) िब तक दक अंतरायष्ट्रीय चाटयर और जवजधयों में अन्द्यथा जवजनर्ियष्ट न हो, कोई भी व्यजि िो अजधजनयम की धारा 4 की उपधारा (2) के अधीनपात्रता मानिंडों को पूरा करता है और जनयम 11 के अधीन जनहयता का पात्र नहीं है, वह राष्ट्रीय खेल जनकाय की काययकारी सजमजत के जनवायचन का प्रत्यािी हो सकता है। (2) जनयम 7 के उप-जनयम (1) में जवजनर्ियष्ट अनुसार राष्ट्रीय ओलंजपक सजमजत की महासभा के सिस्ट्य, अपनी काययकारी सजमजत के जनवायचन में मतिान करने के जलए पात्र होंगे, िो जनम्नानुसार है, अथायत्:— (क) उत्कृष्ट योग्यता वाले प्रत्येक जखला़िी को एक मत होगा; (ख) प्रत्येक पिेन सिस्ट्य को एक मत होगा; (ग) प्रत्येक राष्ट्रीय खेल पररसंघ, िो राष्ट्रीय खेल बोडय के साथ राष्ट्रीय ओलंजपक सजमजत की संबद् इकाई के रूप में रजिस्ट्रीकृत है, को अजधकतम िो मत प्राप्त होंगे, जिन्द्हें उस संबद् इकाई के अलग-अलग व्यजिगत प्रजतजनजधयों द्वारा प्रयोग दकया िाएगा; और (घ) जनयम 7 के उप-जनयम (1) के उपखंड (ङ) में जवजनर्ियष्ट व्यजियों की प्रत्येक श्रेणी के जलए, प्रत्येक ऐसे व्यजि का एक मत होगा। (3) राष्ट्रीय ओलंजपक सजमजत के अजतररि दकसी अन्द्य राष्ट्रीय खेल जनकाय की महासभा के सिस्ट्य, जनयम 7 के उप-जनयम (1) में जवजनर्ियष्ट अनुसार अपनी काययकारी सजमजत के जनवायचन में मतिान करने के जलए पात्र होंगे, िैसा दक नीचे जवजनर्ियष्ट है:— (क) प्रत्येक उत्कृष्ट योग्यता वाले जखला़िी का एक मत होगा; (ख) राष्ट्रीय खेल बोडय के साथ रजिस्ट्रीकृत राष्ट्रीय खेल जनकाय की प्रत्येक राज्य स्ट्तरीय संबद् इकाई को अजधकतम िो मत प्राप्त होंगे, जिन्द्हें उस संबद् इकाई के अलग-अलग व्यजिगत प्रजतजनजधयों द्वारा प्रयोग दकया िाएगा; और (ग) जनयम 7 के उप-जनयम (1) के उप-जनयम (ङ) में जवजनर्ियष्ट व्यजियों की प्रत्येक श्रेणी के जलए, प्रजत व्यजि एक मत होगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (4) काययकारी सजमजत के जनवायचन के जलए जनवायचन सूची में केवल वही सिस्ट्य अथवा उनके प्रजतजनजध सजममजलत होंगे िो संबंजधत राष्ट्रीय खेल जनकाय की महासभा में उप-जनयम (2) या उप-जनयम (3), िो भी जस्ट्थजत हो, के अनुसार मतिान का अजधकार रखते हैं और िो अजधजनयम या इन जनयमों के उपबंधों के अधीन अन्द्यथा जनहयररत नहीं हैं। (5) जनवायचन अजधकारी, संबंजधत राष्ट्रीय खेल जनकाय की तत्कालीन काययकारी सजमजत से परामिय करके, काययकारी सजमजत के काययकाल की समाजप्त से कम से कम पैंतालीस दिन पूवय जनवायचन हेतु प्रारूप जनवायचन सूची तैयार करेगा और िारी करेगा: परंतु यह दक, जनवायचन सूची में दकसी व्यजि को सजममजलत करने अथवा न करने के संबंध में जनवायचन अजधकारी का जवजनश्चय अंजतम और बाध्यकारी होगा। (6) जनवायचन अजधकारी, प्रारूप जनवायचन सूची िारी होने की तारीख से कम से कम सात दिन का समय प्रिान करेगा, तादक अंजतम जनवायचन सूची की संरचना के संबंध में प्राप्त दकसी भी आपजत्त को स्ट्वीकार दकया िा सके और उसका समाधान दकया िा सके। 11. जनहयता— (1) कोई भी व्यजि महासभा का सिस्ट्य या दकसी राष्ट्रीय खेल जनकाय की दकसी सजमजत का सिस्ट्य बनने से जनहयररत होगा और काययकारी सजमजत या जखला़िी सजमजत के जनवायचन में प्रत्यािी बनने के जलए पात्र नहीं होगा, यदि ऐसा व्यजि — (क) लागू जवजध के अधीनदिवाजलया घोजर्त दकया गया हो; या (ख) भारत में सिम अजधकाररता वाले दकसी न्द्यायालय द्वारा दकसी अपराध के जलए िोर्जसद् हो और उसे कारावास का िण्डािेि हो; या (ग) ऐसे राष्ट्रीय खेल जनकाय की आचार सजमजत के आिेि द्वारा दकसी पि को धारण करने से प्रजतबंजधत दकया गया हो: परंतु यह दक जनहयता के संबंध में— (i) खंड (ख) ऐसे िंडािेि के पूरा होने के पश्चात् काययपाजलका सजमजत के एक पूरे कालावजध के जलए होगा; और (ii) खंड (ग) ऐसे प्रजतबंध की अवजध के जलए होगा। ) 2 ( राष्ट्रीय खेल जनकाय के उपजनयमों में यह उपबंध हो सकेगा दक उपजनयम ( 1 ( ) के अधीन जवजनर्ियष्ट मानिंडों के अजतररि दकसी व्यजि को जनम्नजलजखत से भी अयोग्य घोजर्त दकया िाएगा- (क) ऐसे राष्ट्रीय खेल जनकाय की साधारण जनकाय या दकसी सजमजत का सिस्ट्य होने पर, या यदि ऐसा व्यजि राष्ट्रीय ओलंजपक सजमजत के अजतररि दकसी िूसरी राष्ट्रीय खेल जनकाय का सिस्ट्य है, तो वह काययपाजलका सजमजत या एथलीट सजमजत का जनवायचन ल़िने के जलए अर्हयत नहीं होगा; और (ख) ऐसे राष्ट्रीय खेल जनकाय के साधारण जनकाय या दकसी सजमजत का सिस्ट्य होने के कारण, ऐसे व्यजि ने दकसी अन्द्य राष्ट्रीय खेल जनकाय में अध्यि, महासजचव या कोर्ाध्यि का पि धारण करने के पश्चात् एक काययकाल की जवराम अवजध पूरी नहीं की है। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अध्याय 4 राष्ट्रीय खेल जनवायचन पैनल 12. राष्ट्रीय खेल जनवायचन पैनल का रोस्ट्टर -( (1राष्ट्रीय खेल बोडय, अजधजनयम की धारा 16की उपधारा ( (1के अधीन अजधसूजचत राष्ट्रीय खेल जनवायचन पैनल का रोस्ट्टर बनाए रखेगा। (2)राष्ट्रीय खेल जनवायचन पैनल के रोस्ट्टर में हर समय कम से कम बीस सिस्ट्य होंगे िो अजधजनयम की धारा 16की उपधारा (1) के अधीन जवजनर्ियष्ट अहयताएं पूरी करते हों। (3)राष्ट्रीय खेल जनवायचन पैनल का रोस्ट्टर भारतीय साक्ष्य अजधजनयम, 2023) 2023का (47की धारा 74के अथय में एक सावयिजनक िस्ट्तावेि होगा। 13. जनवायचन अजधकाररयों को िेय फीस- प्रत्येक जनवायचन के संबंध में, राष्ट्रीय खेल जनकाय, जनवायचन अजधकारी के साथ आपसी सहमजत के आधार पर, फीरा के रूप में अजधकतम पाँच लाख रुपए का भुगतान करेगा, साथ ही ऐसे अजधकारी के सहायक के जलए पारस्ट्पररक रूप से सहमत रकम की फीस, यदि कोई हो, का भी भुगतान करेगा। अध्याय 5 एथलीट सजमजतयां, नैजतकता सजमजतयां और जववाि समाधान सजमजतयां 14. राष्ट्रीय ओलंजपक सजमजत के उपजनयमों में सजमजतयों से संबंजधत उपबंध- राष्ट्रीय ओलंजपक सजमजत के उपजनयमों में एथलीट सजमजत, नैजतकता सजमजत और जववाि समाधान सजमजत के गिन, संचालन और प्रदक्रयाओं से संबंजधत उपबंध सजममजलत होंगे, िो िो- (क) अंतरायष्ट्रीय चाटयर और कानूनों में बनाए गए दििाजनिेिों का पालन करना; और (ख) राष्ट्रीय खेल बोडय द्वारा समय-समय पर जवजनर्ियष्ट मॉडल दििाजनिेिों या जवजनयमों द्वारा जनिेजित दकया िाएगा। 15. राष्ट्रीय खेल जनकाय के उपजनयम में सजमजतयों से िु़िे उपबंध- राष्ट्रीय खेल जनकाय के अजतररि, प्रत्येक राष्ट्रीय खेल जनकायं के उपजनयम में एथलीट सजमजत, आचार िास्त्र सजमजत और जववाि समाधान सजमजत के गिन, प्रचालन और प्रदक्रया से संबंजधत उपबंध सजममजलत होंगे, िो िो- - (क) ऐसे दििा-जनिेिों का अनुपालन करेंगे िैसा दक अन्द्तरायष्ट्रीय चाटयर एवं जवजधयों में जवजनर्ियष्ट दकया िा सके; (ख) राष्ट्रीय ओलंजपक सजमजत से अन्द्यथा राष्ट्रीय खेल जनकायों के मामले में, दििाजनिेि िो राष्ट्रीय ओलंजपक सजमजत द्वारा जवजनर्ियष्ट की िा सकेगी, और (ग) यदि खंड (क) और खंड (ख) के अधीन दििाजनिेि उपलब्ध न हो, तो समय समय पर राष्ट्रीय खेल बोडय द्वारा जवजनर्ियष्ट यथाजस्ट्थजत, माडल दििाजनिेि या जवजनयमों द्वारा संचाजलत होंगे। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 अध्याय 6 िेत्रीय खेल संघ 16. िेत्रीय खेल महासंघों द्वारा संबद्ता बनाए रखी िाएगी- ( (1प्रत्येक िेत्रीय खेल महासंघ को संबंजधत अंतरायष्ट्रीय खेल जनकाय से अंतरायष्ट्रीय मान्द्यता और संबद्ता प्राप्त होगी, िब तक दक दकसी नामजनर्ियष्ट खेल का कोई अंतरायष्ट्रीय खेल जनकाय न हो। (2)िहाँ एक ही खेल के जलए एक से अजधक अंतरायष्ट्रीय खेल जनकाय हैं या िहाँ एक से अजधक िेत्रीय खेल महासंघ मान्द्यता के जलए आवेिन करते हैं, राष्ट्रीय खेल बोडय जलजखत रूप में ररकाडय दकए िाने वाले कारणों के आधार पर संबद्ता और मान्द्यता के मामले पर जनणय ले सकेगा| अध्याय 7 संबद् इकाइयाँ 17. संबद् इकाइयों का पंिीकरण- ( (1प्रत्येक राष्ट्रीय खेल जनकाय, अपनी संबद् इकाइयों में से प्रत्येक का राष्ट्रीय खेल बोडय के साथ पंिीकरण सुगम बनाएगा और नींचे िी गई सूचना तथा िस्ट्तावेज़ राष्ट्रीय खेल बोडय द्वारा समय-समय पर जवजनर्ियष्ट प्ररूप और रीजत से प्रस्ट्तुत दकए िाएं:- (क) ऐसी संबद् इकाई के संबंध में राष्ट्रीय खेल जनकाय द्वारा िारी संबद्ता प्रमाणपत्र की प्रजत; (ख) लागू जवजधयों के अधीन, िैसा भी मामला हो, एक सोसायटी, गैर-लाभकारी कंपनी या रस्ट्ट के रूप में पंिीकरण प्रमाणपत्र की प्रजत; (ग) संबद् इकाई के िासी जनकाय के सभी सिस्ट्यों के नाम और पिनाम, चाहे उन्द्हें दकसी भी नाम से पुकारा िाए; और (घ) कोई अन्द्य िानकारी, िैसा दक राष्ट्रीय खेल बोडय द्वारा अजधजनयम के अधीन अपने कायों का जनवयहन करने के प्रयोिनों के जलए जवजनर्ियष्ट दकया िाए। (2)राष्ट्रीय खेल जनकाय की प्रत्येकं संबद् इकाई उप-जनयम ( (1का अनुपालन सुजनजश्चत करेगी और इसके अजतररि अपनी प्रत्येक संबद् इकाई का राष्ट्रीय खेल बोडय के साथ पंिीकरण सुजनजश्चत करेगी तथा उप-जनयम ( (1के उपबंध प्रत्येक ऐसी इकाई पर यथावश्यक पररवतयनों सजहत लागू होंगे। (3)राष्ट्रीय खेल बोडय में रजिस्ट्रीकृत प्रत्येक समबद् इकाई को उपलब्ध कराई गई सूचना में दकसी भी पररवतयन की सूचना तीस दिन के भीतर बोडय को िेनी होगी। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अध्याय 8 प्रकीणय 18. प्रकीणय (1)प्रत्येक राष्ट्रीय खेल जनकाय छह माह की अवजध के भीतर, अजधजनयम के उपबंधों के अनुरूप अपने उपजनयमों में संिोधन करेगा। (2)केन्द्रीय सरकार, दकसी राष्ट्रीय खेल जनकाय से आवेिन प्राप्त होने पर, इन जनयमों के प्रारमभ से बारह महीने की अवजध के जलए इन जनयमों के उपबंधों में छूट िे सकेगी और ऐसी छूट के कारण जलजखत में ररकाडय दकए िाएंगे। अनुसूची । जनयम 5और 6िेखें) उत्कृष्ट योग्यता वाले जखलाज़ियों के जलए पात्रता जनयम 1. सामान्द्य योग्यता मानिंड -कोई भी व्यजि िो असाधारण योग्यता वाला जखला़िी बनना चाहता है, वह- (क) भारतीय नागररक होगा; (ख) स्ट्वस्ट्थ मजस्ट्तष्क का होगा; (ग) पच्चीस वर्य से कम आयु का नहीं होगा; और (घ) सदक्रय खेल से सेवाजनवृत्त हो गया हो और जनयम 5के उप-जनयम ( (2के अधीन आवेिन की तारीख से कम से कम एक वर्य पहले दकसी भी प्रजतस्ट्पधी खेल काययक्रम में भाग न जलया हो, िो जिला, राज्य या भारत का प्रजतजनजधत्व करने के जलए चयन दकया िाता हो। 2. श्रेणी पात्रता मानिंड-( (1राष्ट्रीय ओलजमपक सजमजत के उत्कृष्ट योग्यता सूचकांक वाले जखलाज़ियों में सजममजलत होने के इच्छुक आवेिकों के मामले में, ऐसे आवेिक ने भारत का प्रजतजनजधत्व करते हुए केवल ओलजमपक अनुिासन में सुसंगत श्रेणी में उपलजब्ध हाजसल की हो। (2)राष्ट्रीय पैरालजमपक सजमजत की उत्कृष्ट योग्यता वाले जखलाज़ियों में सजममजलत होने के इच्छुक आवेिकों के मामले में, ऐसे आवेिक ने भारत का प्रजतजनजधत्व करते हुए केवल पैरा-ओलजमपक अनुिासन में सुसंगत श्रेणी में उपलजब्ध हाजसल की हो। (3)राष्ट्रीय ओलजमपक सजमजत या राष्ट्रीय पैरालजमपक सजमजत के अजतररि दकसी अन्द्य राष्ट्रीय खेल जनकाय के उत्कृष्ट योग्यता सूची वाले जखलाज़ियों में समावेिन चाहने वाले आवेिकों के मामले में, श्रेणी 10के मामले को छो़िकर, ऐसे [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 आवेिक ने राष्ट्रीय खेल जनकाय से संबंजधत नामजनर्ियष्ट खेल में संबंजधत श्रेणी में भारत का प्रजतजनजधत्व करते हुए उपलजब्ध हाजसल की हो, िहां ऐसे आवेिक ने दकसी जविेर् राज्य का प्रजतजनजधत्व दकया हो। (4)इस अनुसूची के प्रयोिनों के जलए,- (क) नीचे दिए गए दकसी भी स्ट्तर में "ग्रीष्मकालीन ओलंजपक खेल", "िीतकालीन ओलंजपक खेल", "राष्ट्रमंडल खेल", "एजियाई खेल" और "एजियाई िीतकालीन खेल" के संबंध में "ग्रीष्मकालीन पैराललंजपक खेल", "िीतकालीन पैराललंजपक खेल", "पैरा इवेंट िो राष्ट्रमंडल खेलों का जहस्ट्सा हैं"," पैरा-एजियाई खेल" और "पैरा-एजियाई खेलों का िीतकालीन संस्ट्करण (यदि कोई हो)" पर आवश्यक पररवतयनों के साथ लागू होगा; (ख) "स्ट्वीकृत" के संबंध में दकसी सुसंगत अंतरायष्ट्रीय खेल जनकाय के तत्वाधान में, अनुमोिन और मंिूरी िजि के अधीन आयोजित दकसी भी प्रजतस्ट्पधी अंतरायष्ट्रीय काययक्रम या मैच को जवजनर्ियष्ट करता है। श्रेणी 1 जिन आवेिकों ने ग्रीष्मकालीन ओलंजपक खेल या िीतकालीन ओलंजपक खेल में कम से कम एक स्ट्वणय, रित या कांस्ट्य पिक िीता है, लेदकन यदि कोई पिक जनरस्ट्त हो िाता है, तो उन्द्हें इस श्रेणी के अधीन जवजिष्ट योग्यता प्राप्त करने की अहयता के जलए नहीं माना िाएगा। श्रेणी 2 ऐसे आवेिक जिन्द्होंने ग्रीष्मकालीन ओलंजपक खेल या िीतकालीन ओलंजपक खेल के िो या उससे अधीन संस्ट्करण में भाग जलया हो। श्रेणी 3 ऐसे आवेिक जिन्द्होंने ग्रीष्मकालीन ओलंजपक खेल या िीतकालीन ओलंजपक खेल के कम से कम एक संस्ट्करण में भाग जलया हो। श्रेणी 4 जिन आवेिकों को केन्द्रीय सरकार द्वारा मेिर ध्यानचंि खेल रत्न पुरस्ट्कार या अिुयन पुरस्ट्कार से सममाजनत दकया गया है, लेदकन यदि कोई पुरस्ट्कार रद्द कर दिया िाता है या वापस कर दिया िाता है, तो उसे इस श्रेणी के अधीन बहुत अच्छी योग्यता प्राप्त करने की अहयता के जलए नहीं माना िाएगा। श्रेणी 5 वे आवेिक जिन्द्होंने जवश्व चैजमपयनजिप या समकि प्रजतयोजगता में कम-से-कम एक स्ट्वणय, रित या कांस्ट्य पिक या समकि स्ट्थान प्राप्त दकया हो; परंतु यदि कोई पिक वापस ले जलया गया हो, तो उसे इस स्ट्तर के अधीनउत्कृष्ट योग्यता प्राप्त करने की पात्रता के जलए नहीं माना िाएगा। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] श्रेणी 6 वे आवेिक जिन्द्होंने राष्ट्रमंडल खेलों, एजियाई खेलों या एजियाई िीतकालीन खेलों में कम-से-कम एक स्ट्वणय, रित या कांस्ट्य पिक या समकि स्ट्थान प्राप्त दकया हो; परंतु यदि कोई पिक वापस ले जलया गया हो, तो उसे इस स्ट्तर के अधीनउत्कृष्ट योग्यता प्राप्त करने की पात्रता के जलए नहीं माना िाएगा। श्रेणी 7 वे आवेिक जिन्द्होंने एजियाई चैजमपयनजिप या समकि प्रजतयोजगता में कम-से-कम एक स्ट्वणय, रित या कांस्ट्य पिक या समकि स्ट्थान प्राप्त दकया हो; परंतु यदि कोई पिक वापस ले जलया गया हो, तो उसे इस स्ट्तर के अधीनउत्कृष्ट योग्यता प्राप्त करने की पात्रता के जलए नहीं माना िाएगा। श्रेणी 8 वे आवेिक जिन्द्होंने कम-से-कम पाँच स्ट्वीकृत अंतरायष्ट्रीय स्ट्पधायओं (यदि व्यजिगत खेल हो) या पाँच स्ट्वीकृत अंतरायष्ट्रीय मैचों (यदि टीम खेल हो) में भाग जलया हो। श्रेणी 9 वे आवेिक जिन्द्होंने कम-से-कम एक स्ट्वीकृत अंतरायष्ट्रीय स्ट्पधायओं (यदि व्यजिगत खेल हो) या एक स्ट्वीकृत अंतरायष्ट्रीय मैच (यदि टीम खेल हो) में भाग जलया हो। श्रेणी 10 वे आवेिक जिन्द्होंने राष्ट्रीय खेलों या राष्ट्रीय चैजमपयनजिप या समकि प्रजतयोजगता में कम-से-कम एक स्ट्वणय, रित या कांस्ट्य पिक या समकि स्ट्थान प्राप्त दकया हो। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 अनुसूची 2 (जनयम 9 िेखें) जनवायचन जनयम 1. पररभार्ाएँ और जनवयचन (i) इन जनवायचन जनयमों में, िब तक संिभय अन्द्यथा अपेजित न हो,— (क) “अभ्यथी” से कोई भी अभ्यथी िो दकसी जनवायजचत पि के जलए जनवायचन में भाग ले रहा हो, अजभप्रेत है; (ख) “जनवायचन” से दकसी जनवायजचत पि के जलए इन जनवायचन जनयमों के अनुसार आयोजित दकया गया जनवायचन अजभप्रेत है; (ग) “साधारण अजधवेिन” से दकसी राष्ट्रीय खेल संस्ट्था की महासभा के सभी सिस्ट्यों की बैिक, जिसे उस राष्ट्रीय खेल जनकाय के उपजनयमों के अनुसार बुलाया और आयोजित दकया गया हो अजभप्रेत है; और (घ) “नामांकन” से वह प्रदक्रया जिसके माध्यम से कोई अभ्यथी इन जनवायचन जनयमों के अनुसार दकसी जनवायजचत पि के जलए जनवायचन में भाग लेने की अपनी रुजच औपचाररक रूप से प्रस्ट्तुत करता है अजभप्रेत है । (ii) इन जनवायचन जनयमों में प्रयुि कोई भी िब्ि, जिसकी पररभार्ा यहाँ नहीं िी गई है, उसका वही अथय होगा िो अजधजनयम और जनयमों में जवजनर्ियष्ट दकया गया हो। 2. िेत्र और लागू होना (i) ये जनवायचन जनयम राष्ट्रीय खेल जनकाय के सभी जनवायचनों पर लागू होंगे। (ii) कोई भी अभ्यथी, मतिान सिस्ट्य या जनवायचन में अन्द्य प्रजतभागी अजधजनयम तथा राष्ट्रीय खेल संस्ट्था की आचार संजहता के अधीन होगा, यदि वह अन्द्यथा पहले से ही उसके अधीन बाध्य और अधीन न हो। 3. जनवायचन का संचालन (i) जनवायचन सामान्द्यतः राष्ट्रीय खेल जनकाय की वार्र्यक सामान्द्य बैिक में होंगे और िहाँ आवश्यक हो, जविेर् रूप से बुलाई गई साधारण अजधवेिन में भी हो सकते हैं। (ii) जनवायचन सिैव गुप्त मतिान द्वारा दकए िाएँगे। 4. जनवायचन अजधकारी 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) जनवायचन अजधकारी जनवायचन से संबंजधत प्रिासजनक प्रदक्रया की िेखरेख के जलए उत्तरिायी होगा, जिसमें जनम्नजलजखत सजममजलत हैं,— (क) अजधजनयम और इन जनयमों का सही अनुप्रयोग सुजनजश्चत करना; (ख) इस अनुसूची के खंड 5 में प्रित्त मॉडल कैलेंडर के अनुसार जनवायचन के प्रत्येक चरण के जलए यथोजचत समय-सीमा जनधायररत करना और उन समय-सीमाओं का किोरता से पालन कराना; (ग) प्रत्येक चरण के जलए उपयुि िस्ट्तावेज़ और प्ररूप, जिनमें नामांकन प्ररूप और मतपत्र सजममजलत हैं, जनधायररत करना और जवतररत करना, तथा उनके उजचत उपयोग को लागू एवं सत्याजपत करना; (घ) मतिान सिस्ट्यों, अन्द्य सिस्ट्यों, मीजडया और िनता को सूचना प्रिान करना; (ङ) सरकारी जनकायों या राष्ट्रीय खेल बोडय तथा राष्ट्रीय खेल बोडय द्वारा जनयुि दकसी भी पययवेिक के साथ संपकय बनाए रखना; (च) जनवायचन से संबंजधत सभी अजधसूचनाओं और प्ररूपों को राष्ट्रीय खेल जनकाय, राष्ट्रीय खेल बोडय और युवा काययक्रम और खेल मंत्रालय की आजधकाररक वेबसाइटों पर प्रकाजित कराना; और (छ) जनवायचन प्रदक्रया का सुचारू संचालन सुजनजश्चत करने हेतु आवश्यक अन्द्य सभी कायय करना। (ii) जनवायचन अजधकारी केवल व्यावहाररक आवश्यकता के कारण ही इस अनुसूची से संलग्न प्ररूपों में उपांतररत कर सकेगा, परंतु इस अनुसूची के जसद्ांतों का पालन सुजनजश्चत दकया िाए। 5. जनवायचन की घोर्णा और जनवायचन सूची (i) राष्ट्रीय खेल जनकाय की काययकारी सजमजत, जनवायचन अजधकारी के परामिय से, अपनी काययकारी सजमजत के काययकाल की समाजप्त से कम-से-कम तीस दिन पूवय जनवायचन की घोर्णा करेगी। यह घोर्णा राष्ट्रीय खेल जनकाय के संवैधाजनक िस्ट्तावेिों के सुसंगत उपबंधों के अनुसार होगा और संबंजधत सामान्द्य बैिक की काययसूची में सजममजलत दकया िाएगा। (ii) जनवायचन की घोर्णा में कम से कम जनम्नजलजखत सजममजलत होगा:— (क) जनवायचन अजधकारी का नाम; (ख) जनवायचन अजधकारी द्वारा जनयम 10 के उप-जनयम (6) के अनुसार तैयार और िारी की गई अंजतम जनवायचन सूची, िो इन जनवायचन जनयमों में संलग्न प्ररूप 1 के अनुसार हो; (ग) वे जनवायजचत पि जिन पर जनवायचन होना है तथा उन पिों के जलए अभ्यर्थयों को प्रजतस्ट्पधाय करने हेतु आवश्यक पूवय- ितें या योग्यताएँ; (घ) इच्छुक अभ्यर्थयों द्वारा जनवायजचत पिों के जलए नामांकन िाजखल करने का आमंत्रण; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (ङ) इच्छुक अभ्यर्थयों द्वारा प्रस्ट्तुत दकया िाने वाला नामांकन प्ररूप, िो इन जनवायचन जनयमों में संलग्न प्ररूप 2 के अनुसार होगा; और (च) जनवायचन कैलेंडर, िो नीचे उप-खंड (iii) में जवजनर्ियष्ट मॉडल कैलेंडर के अनुसार होगा। (iii) जनवायचन अजधकारी जनम्नजलजखत मॉडल कैलेंडर के अनुसार जनवायचन का संचालन करेगा: जवर्य दिवस जनवायचन की घोर्णा, नामांकन के जलए आमंत्रण और अंजतम मतिाता सूची िारी करना दिवस 1 नामांकन िाजखल करना दिवस 8 से दिवस 10 प्राप्त नामांकनों की प्रारूप सूची की घोर्णा दिवस 10 नामांदकत अभ्यर्थयों की प्रारूप सूची पर आपजत्तयां दिवस 11 से दिवस 14 नामांदकत अभ्यर्थयों की प्रारूप सूची पर आपजत्तयों की िांच और जनपटान दिवस 15 से दिवस 16 नामांदकत अभ्यर्थयों की अंजतम सूची दिवस 17 नामांकन वापस लेना दिवस 18 जनवायचन में जहस्ट्सा लेने वाले अभ्यर्थयों की अंजतम सूची दिवस 19 मतिान और पररणामों की घोर्णा दिवस 21 (i) जनवायचन अजधकारी, केवल व्यावहाररक आवश्यकता के कारण, उपखंड (iii) में जवजनर्ियष्ट मॉडल कैलेंडर में संिोधन कर सकेगा, परंतु जनवायचन अजधकतम इक्कीस दिनों की अवजध के भीतर पूणय कर जलया िाए। 6. नामांकन (i) दकसी अभ्यथी का जनवायचन हेतु नामांकन, जनवायचन सूची में सजममजलत व्यजियों द्वारा प्रस्ट्ताजवत और अनुमोदित दकया िाएगा। (ii) प्रत्येक नामांकन पत्र, जवजनर्ियष्ट समयसीमा के भीतर, अभ्यथी स्ट्वयं व्यजिगत रूप से जनवायचन अजधकारी को प्रस्ट्तुत करेगा| (iii) कोई भी सिस्ट्य, एक ही जनवायजचत पि के जलए, प्रस्ट्तावक अथवा अनुमोिक के रूप में, एक से अजधक अभ्यथी का नामांकन नहीं करेगा और यदि वह ऐसा करता है तो केवल प्रथम वैध नामांकन स्ट्वीकार दकया िाएगा तथा ऐसे सिस्ट्य के अन्द्य सभी नामांकन िून्द्य एवं अप्रभावी माने िाएंगे। (iv) दकसी व्यजि को, एक बार उसके द्वारा अनुमोदित नामांकन पत्र जनवायचन अजधकारी को प्रस्ट्तुत कर दिए िाने के पश्चात, प्रस्ट्तावक अथवा अनुमोिक के रूप में अपना नाम वापस लेने की अनुमजत नहीं होगी। (v) जनवायचन अजधकारी, उसके द्वारा प्राप्त सभी नामांकनों की जनवायजचत पिवार सूची, इन जनवायचन जनयमों के साथ संलग्न प्ररूप–3 के अनुसार तैयार करेगा| 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 7. नामांकन की संवीिा और अंजतम रूप (i) जनवायचन अजधकारी, प्राप्त प्रत्येक नामांकन पत्र की संवीिा करेगा तथा अजधजनयम, उसके अधीन बनाए गए जनयमों और राष्ट्रीय खेल जनकाय की उप-जवजधयों के अनुसार उसकी वैधता अथवा अन्द्यथा का जनधायरण करेगा। (ii) उपखंड (i) के अधीन नामांकन की संवीिा के िौरान, प्रत्येक अभ्यर्थयों अथवा उसके दकसी प्राजधकृत प्रजतजनजध को उपजस्ट्थत रहने और उसी जनवायजचत पि के जलए अन्द्य अभ्यर्थयों के नामांकन के संबंध में आपजत्त उिाने का अजधकार होगा, जिसके जलए उसने अपना नामांकन प्रस्ट्तुत दकया है। (iii) नामांकन पत्रों की संवीिा के पश्चात, जनवायचन अजधकारी वैध रूप से नामांदकत अभ्यर्थयों की सूची इन जनवायचन जनयमों के साथ संलग्न प्ररूप–4 के अनुसार तैयार करेगा। (iv) प्रत्येक अभ्यर्थयों, जिसका नामांकन िांच में वैध पाया गया है, जनवायचन प्रारंभ होने से पूवय अपनी उममीिवारी वापस लेने का अजधकार रखेगा, परंतु दक वह जनवायचन अजधकारी को इन जनवायचन जनयमों के साथ संलग्न प्ररूप–5 के अनुसार सूचना प्रिान करे, और यदि जनवायचन अजधकारी ऐसी सूचना की वास्ट्तजवकता से संतुष्ट है तो वह वापसी की सूचना स्ट्वीकार करेगा। (v) उममीिवारी वापस लेने की कोई भी सूचना अंजतम होगी और उसे जनरस्ट्त करने की अनुमजत नहीं होगी। (vi) जनवायचन अजधकारी, इन जनवायचन जनयमों के प्ररूप–6 के अनुसार, अंजतम रूप से जनवायचन ल़िने वाले अभ्यर्थयों की सूची तैयार करेगा। (vii) राष्ट्रीय खेल जनकाय, जनवायचन अजधकारी के पययवेिण और प्रभार में, इन जनवायचन जनयमों के साथ संलग्न प्ररूप–7 के अनुसार मतपत्र तैयार करेगा। (viii) मतपत्र स्ट्पष्ट और सुपाठ्य रूप से मुदरत दकए िाएंगे तथा प्रत्येक जनवायजचत पि के जलए जनवायचन ल़िने वाले अभ्यर्थयों के नाम अंग्रेज़ी वणयमाला के क्रम में व्यवजस्ट्थत दकए िाएंगे। 8. प्रचार संबंधी आचरण (i) जनवायचन संबंधी प्रचार अभ्यर्थयों द्वारा जनष्पि रूप से तथा मौजलक नैजतक जसद्ांतों के प्रजत सममान की भावना में दकया िाएगा। (ii) अभ्यथी सभी प्रचार कायय गररमा एवं संयम के साथ करेंगे तथा अन्द्य अभ्यर्थयों, राष्ट्रीय खेल जनकाय और उसके सिस्ट्यों के प्रजत सममान बनाए रखेंगे। (iii) कोई भी अभ्यथी ऐसा मौजखक कथन, जलजखत पाि या दकसी प्रकार का प्रस्ट्तुजतकरण नहीं करेगा िो दकसी अन्द्य अभ्यथी की छजव को िजत पहुँचाने वाला हो अथवा उसे हाजन पहुँचाने वाला हो; और यदि अन्द्य अभ्यर्थयों की आलोचना की िाती है तो वह केवल उनकी नीजतयों, काययक्रमों, पूवयवृत्त और कायय तक सीजमत होगी। (iv) कोई भी अभ्यथी अन्द्य अभ्यथी के जवरुद् अप्रमाजणत आरोपों या जवकृजतयों के आधार पर आलोचना नहीं करेगा और मत प्राप्त करने हेतु िाजत या सामप्रिाजयक भावनाओं का इस्ट्तेमाल नहीं दकया िाएगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 (v) प्रत्येक अभ्यथी जनवायचन सूची में सजममजलत सिस्ट्यों के समि जनवायजचत पि हेतु अपनी योिनाएँ और जवचार जलजखत िस्ट्तावेज़ के रूप में प्रस्ट्तुत कर सकेगा, जिसे जनवायचन अजधकारी इन जनवायचन जनयमों के उपखंड 4 (i) (छ) के अनुसार प्रकाजित करेगा। (vi) अभ्यथी जनवायचन प्रचार में अत्यजधक व्यय से बचेंगे, यह मानते हुए दक ऐसा व्यय अभ्यर्थयों के बीच असमानता का कारक बन सकता है। (vii) दकसी अभ्यथी का संप्रवतयन दकसी भी प्रकार के प्रचार से रजहत होगा, जिसमें नवीन मीजडया या सामाजिक नेटवकय का उपयोग भी सजममजलत है; प्रचार की प्रदक्रया में दकसी प्रकार की सावयिजनक बैिक या सभा आयोजित नहीं की िाएगी; और दकसी दकसी अभ्यथी को लाभ या हाजन पहुंचाने के जलए दकसी पत्रकार अथवा मीजडया की सेवाओं का, चाहे जनःिुल्क अथवा भुगतान के आधार पर, उपयोग नहीं दकया िाएगा। (viii) सभी अभ्यथी “भ्रष्ट आचरण” की सभी गजतजवजधयों, जिनमें मतिाताओं को ररश्वत िेना, मतिाताओं को डराना-धमकाना, अथवा मतिाताओं का प्रजतरूपण करना सजममजलत है, से सावधानीपूवयक बचेंगे । (ix) अभ्यथी दकसी भी जस्ट्थजत में और दकसी भी बहाने से, मतिाता सिस्ट्यों को प्रत्यि या अप्रत्यि रूप से उपहार, िान, भेंट अथवा दकसी भी प्रकार का लाभ नहीं िेंगे। (x) वतयमान काययकारी सजमजत का सिस्ट्य यह सुजनजश्चत करेगा दक उसके जवरुद् कोई जिकायत का कारण उत्पन्न न हो दक उसने अपने आजधकाररक पि का उपयोग अपने जनवायचन संबंधी प्रचार के जलए दकया हो, और जविेर् रूप से वह— (क) अपने प्रचार की प्रगजत हेतु आजधकाररक पररवहन, जिसमें वाहन, मिीनरी और कार्मयक सजममजलत हैं, का उपयोग नहीं करेगा; (ख) समाचारपत्रों और अन्द्य मीजडया में राष्ट्रीय खेल जनकाय अथवा उसके सिस्ट्यों के व्यय पर कोई जवज्ञापन िारी नहीं करेगा या जनवायचनों के िौरान राष्ट्रीय खेल जनकाय के आजधकाररक मीजडया चैनलों का िुरुपयोग नहीं करेगा; (ग) जनवायचनों की घोर्णा के समय से जववेकाधीन जनजधयों से कोई अनुिान या भुगतान स्ट्वीकृत नहीं करेगा; तथा (घ) राष्ट्रीय खेल जनकाय के दकसी भी सिस्ट्य या उसके साझेिारों के प्रत्यि या अप्रत्यि लाभ हेतु दकसी भी प्रकार का वचन या प्रजतज्ञा नहीं करेगा, चाहे उसका पालन दकसी भी समय दकया िाना हो। 9. जनष्पिता और स्ट्वतंत्रता (i) चूँदक मतिान गुप्त है, मतिान करने वाले सिस्ट्य व्यजिगत रूप से अथवा सामूजहक रूप से, दकसी भी रूप में सावयिजनक रूप से यह घोर्णा करने से प्रजतबंजधत होंगे दक वे दकसी अभ्यर्थयों को मतिान करेंगे या नहीं करेंगे। (ii) वतयमान काययकारी सजमजत के सिस्ट्य दकसी भी प्रकार की सावयिजनक घोर्णा करने से जवरत रहेंगे और दकसी भी प्रकार से दकसी अभ्यर्थयों का समथयन नहीं करेंगे। 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) अभ्यर्थयों— (क) दकसी भी व्यजि से अनुिेि स्ट्वीकार नहीं करेगा; (ख) दकसी तृतीय पिकार से प्रत्यि या अप्रत्यि सहायता, चाहे वह जवत्तीय, भौजतक अथवा वस्ट्तुरूप में हो, स्ट्वीकार नहीं करेगा; तथा (ग) दकसी भी व्यजि को ऐसा कोई भी वचन नहीं िेगा िो जनवायजचत पि के जनणय या दक्रयाओं की स्ट्वतंत्रता को प्रभाजवत कर सकता हो। (iv) राष्ट्रीय खेल जनकाय की काययकारी टीम और प्रिासन प्रत्येक समय जनष्पिता का क़िाई से पालन करेंगे, और दकसी भी उममीिवारी के संबंध में राष्ट्रीय खेल जनकाय के प्रिासन या कमयचाररयों से दकसी प्रकार का समथयन या सेवा नहीं माँगी िाएगी| 10. मतिान (i) िहाँ दकसी जनवायजचत पि अथवा जनवायजचत पिों की श्रेणी के जलए जनवायचन ल़िने वाले अभ्यर्थयों की संख्या, भरे िाने वाले जनवायजचत पिों की संख्या के बराबर होगी, वहाँ ऐसे सभी अभ्यर्थयों उन जनवायजचत पिों पर जबना जवरोध के समयक रूप से जनवायजचत माने िाएंगे और ऐसे जनवायजचत पि के जलए मतिान कराना आवश्यक नहीं होगा। (ii) िहाँ दकसी जनवायजचत पि अथवा जनवायजचत पिों की श्रेणी के जलए जनवायचन ल़िने वाले अभ्यर्थयों की संख्या, भरे िाने वाले जनवायजचत पिों की संख्या से अजधक होगी, वहाँ िेर् जनवायजचत पिों के जलए गुप्त मतिान द्वारा जनवायचन कराया िाएगा। (iii) मतिान में, जनवायचन सूची में सजममजलत सिस्ट्य— (क) प्रत्येक िेर् जनवायजचत पि के जलए, िहाँ केवल एक पि भरा िाना है, एक मत िेने के अजधकारी होंगे; और (ख) िहाँ दकसी जनवायजचत पि के जलए एक से अजधक पि भरे िाने हैं, वहाँ उतने ही मत िेने के अजधकारी होंगे जितने पि भरे िाने हैं। (iv) मतपत्रों में अभ्यर्थयों के नाम सजममजलत होंगे और मतिाता केवल एक अभ्यर्थयों को जचजन्द्हत करेगा। (v) प्रत्येक मतिाता को, मतिान हेतु मतपत्र प्राप्त करने से पूवय, जनवायचन सूची की प्रमाणीकृत प्रजत पर अपना हस्ट्तािर करना आवश्यक होगा। (vi) उपखंड (i) की पररजस्ट्थजत को छो़िकर, सिैव गुप्त मतिान कराया िाएगा, चाहे अभ्यर्थयों की संख्या दकतनी भी हो, और मत की गोपनीयता उस प्रदक्रया द्वारा सुजनजश्चत की िाएगी िो मतिाता की जनिता की गारंटी िेती है; और जनवायचन अजधकारी मतपत्रों का जवतरण और गणना करेगा तथा यह सुजनजश्चत करने के जलए उत्तरिायी होगा दक प्रदक्रया उजचत रूप से अजभलेजखत की गई है। (vii) मतिान सिस्ट्य, िहाँ अपेजित हो, व्यजिगत रूप से मतिान करेंगे। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 (viii) मतिाता, मतिान केंर पर जविेर् रूप से उपलब्ध कराए गए मतिान कि में, गुप्त रूप से मतपत्र पर अपना मत ििय करेगा। (ix) मतिाता, अपने पसंिीिा अभ्यर्थयों के नाम के सामने रटक-जचह्न लगाकर मतपत्र पर अपना मत ििय करेगा, और यह रटक-जचह्न केवल उसी साधन (िैसे दक मुहर) द्वारा लगाया िाएगा जिसे जनवायचन अजधकारी द्वारा जविेर् रूप से इस प्रयोिन हेतु उपलब्ध कराया गया है। (x) मतिाता द्वारा अंदकत मतपत्र, जनवायचन अजधकारी द्वारा जविेर् रूप से तैयार और सीलबंि मतपेटी में डाला िाएगा, जिसे मतिान केंर पर ऐसे प्रमुख स्ट्थान पर रखा िाएगा दक वह मतिान केंर में उपजस्ट्थत सभी व्यजियों को जनरंतर िृजष्टगोचर हो। (xi) जनवायचन अजधकारी, जनधायररत समय पर मतिान को बंि करेगा, और यदि कोई मतिाता जनयत समापन समय पर मतिान केंर पर उपजस्ट्थत है तो उसे मतिान करने का अजधकार होगा, भले ही मतिान की काययवाही को उत्कृष्ट योग्यता वाले जखलाज़ियों के जलए कुछ समय तक बढ़ाना प़िे। (xii) मतिान प्रारंभ होने से पूवय जनवायचन अजधकारी द्वारा जवतररत दकए गए मतपत्रों की संख्या घोजर्त की िाएगी, और यदि मतिान में लौटाए गए मतपत्रों की संख्या जवतररत दकए गए मतपत्रों की संख्या के बराबर या उससे कम है तो जनवायचन वैध घोजर्त दकया िाएगा; दकन्द्तु यदि मतिान में जमले मतपत्रों की संख्या जवतररत दकए गए मतपत्रों की संख्या से अजधक है तो मतिान अकृत और िून्द्य घोजर्त दकया िाएगा तथा तुरंत पुनः मतिान कराया िाएगा। 11. मतगणना (i) जनवायचन अजधकारी, मतिान प्रदक्रया पूणय होने के पश्चात यथािीघ्र, पिवार और प्रवगयवार मतगणना प्रारंभ करेगा। (ii) प्रत्येक जनवायचन ल़िने वाला अभ्यर्थयों एक प्राजधकृत प्रजतजनजध नाजमत कर सकता है, जिसे मतगणना स्ट्थल पर उपजस्ट्थत रहने का अजधकार होगा; और ऐसे प्राजधकृत प्रजतजनजध के अजतररि केवल जनवायचन अजधकारी तथा राष्ट्रीय खेल जनकाय की काययकारी अथवा प्रिासजनक टीम के वे सिस्ट्य, जिन्द्हें जनवायचन अजधकारी द्वारा जविेर् रूप से अनुमोदित दकया गया हो, मतगणना में भाग ले सकेंगे। (iii) प्रत्येक मतपत्र, जिस पर मत अंदकत दकया गया है, उस अभ्यर्थयों के जलए एक मत माना िाएगा जिसके पि में वह वैध रूप से अंदकत दकया गया है। (iv) जनम्नजलजखत मतपत्र अमान्द्य माने िाएंगे और जनवायचन अजधकारी द्वारा अस्ट्वीकृत दकए िाएंगे, अथायत्— (क) वे मतपत्र जिन पर जनवायचन अजधकारी द्वारा पररभाजर्त आजधकाररक जवजिष्ट जचह्न अंदकत नहीं हैं; (ख) वे मतपत्र जिन पर अभ्यर्थयों के नामों के अजतररि कोई अन्द्य िब्ि अंदकत हैं; (ग) वे मतपत्र िो अपिनीय हैं या जवकृत कर दिए गए हैं; (घ) वे मतपत्र जिन पर पहचान संबंधी जचह्न अंदकत हैं; तथा (ङ) वे मतपत्र जिनमें दकसी जविेर् मतिान में अनुमत संख्या से अजधक अभ्यर्थयों के जलए मत अंदकत दकए गए हैं। 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (v) जनवायचन अजधकारी प्रत्येक अमान्द्य मतपत्र के पीछे लाल स्ट्याही से उसकी अमान्द्यता के कारण जलखेगा और हस्ट्तािर द्वारा पुजष्ट करेगा। (vi) प्रत्येक अभ्यर्थयों के जलए वैध रूप से डाले गए मतों की पिवार और िहाँ लागू हो प्रवगयवार गणना की िाएगी तथा प्रत्येक अभ्यर्थयों के जलए डाले गए मतों को अवरोही क्रम में इन जनवायचन जनयमों के साथ संलग्न प्ररूप – 8 के अनुसार अजभलेजखत दकया िाएगा। (vii) इसके पश्चात जनवायचन अजधकारी मतगणना का पररणाम जनधायररत करेगा और जिन अभ्यर्थयों ने उि अवरोही क्रम में, पिवार और िहाँ लागू हो प्रवगयवार, अजधकतम संख्या में मत प्राप्त दकए हैं, उतने अभ्यर्थयों को, जितने पि भरे िाने हैं, उन जनवायजचत पिों पर समयक रूप से जनवायजचत समझा िाएगा। (viii) मतगणना पूणय और सत्याजपत करने के पश्चात जनवायचन अजधकारी, संकजलत और जगने गए मतपत्रों को इस प्रयोिन हेतु जनधायररत जलफाफों में रखकर तत्काल सीलबंि करेगा, और राष्ट्रीय खेल जनकाय इन जलफाफों को सुरजित रखेगा तथा उन्द्हें कम से कम काययकारी सजमजत के तत्िण आगामी जनवायचन के पररणाम की घोर्णा तक, अथवा ऐसे जनवायचन से संबंजधत दकसी भी न्द्याजयक काययवाही की लंजबत अवजध तक, िो भी पश्चातवती हो, संरजित रखेगा। 12. पररणामों की घोर्णा (i) िब मतगणना पूणय और सत्याजपत हो िाएगी, तब जनवायचन अजधकारी साधारण सभा में उन जनवायचन ल़िने वाले अभ्यर्थयों के नाम घोजर्त करेगा जिन्द्हें जनवायचन में जनवायजचत समझा िाएगा। (ii) जनवायचन के पररणाम इन जनवायचन जनयमों के साथ संलग्न प्ररूप – 9 के अनुसार घोजर्त दकए िाएंगे तथा उनकी पूणयता के चौबीस घंटे के भीतर राष्ट्रीय खेल जनकाय की आजधकाररक वेबसाइट पर प्रकाजित दकए िाएंगे। (iii) यदि मतगणना के पश्चात दकसी भी अभ्यर्थयों के बीच मतों की समानता पाई िाती है और एक मत की वृजद् से उनमें से दकसी अभ्यर्थयों को जनवायजचत घोजर्त दकया िा सकता है, तो जनवायचन अजधकारी तत्काल उन अभ्यर्थयों के बीच जचट्ठी डालकर जनणय करेगा और ऐसा माना िाएगा दक जिस अभयथी के नाम जचट्ठी जनकली है, उसे एक अजतररि वोट जमला हो। 13. प्रजतबंध एवं जिकायतें (i) अजधजनयम, इन जनयमों अथवा राष्ट्रीय खेल जनकाय की उप-जवजधयों में आच्छादित न दकए गए दकसी भी जनवायचन संबंधी प्रिासजनक जवर्य पर जनणय जनवायचन अजधकारी द्वारा दकया िाएगा। (ii) यदि इन जनवायचन जनयमों का उल्लंघन होता है, तो जनवायचन अजधकारी उसे राष्ट्रीय खेल जनकाय की आचार सजमजत को संिर्भयत कर सकेगा, िो संबंजधत अभ्यर्थयों को— (क) रटप्पजणयाँ कर सकती है, जिन्द्हें सावयिजनक दकया िा सकता है; Short title and commencement. — (1) These rules may be called the National Sports Governance (National Sports Bodies) Rules, 2026. (2) These rules shall come into force on the date of their publication in the Official Gazette. 2. Definitions. — (1) In these rules, unless the context otherwise requires, — (a) “Act” means the National Sports Governance Act, 2025 (25 of 2025); (b) “Central Government” shall mean the Department of the Central Government which has been allocated the subject matter of sports under the Government of India (Allocation of Business) Rules, 1961; (c) “Elected Post” means all posts on the Executive Committee, other than, — (i) the posts reserved for representatives of the Athletes Committee under sub-clause (ii) of clause (b) under sub-section (1) of section 4 of the Act; and (ii) the posts to be occupied by ex officio members under sub-clause (iii) of clause (b) under sub- section (1) of section 4 of the Act; (d) “Election Rules” means the rules applicable to Elections to the Executive Committees as specified in Schedule II; (e) “Electoral Officer” means the person notified under sub-section (1) of section 16 of the Act; (f) “Executive Committee” means the committee constituted in every National Sports Body pursuant to clause (b) of sub-section (1) of section 4 of the Act; (g) “General Body” means the body constituted in every National Sports Body pursuant to clause (a) of sub-section (1) of section 4 of the Act; (h) “National Sports Board” means the Board established pursuant to section 5 of the Act; (i) “Schedule” means the schedule annexed to these rules; and (j) “Sportspersons of outstanding merit Eligibility Rules” means the eligibility rules for sportspersons of outstanding merit as specified in Schedule I. (2) Words and expressions used in these rules and not defined herein but defined in the Act, shall have the meanings respectively assigned to them in the Act. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31 CHAPTER 2 SPORTSPERSONS OF OUTSTANDING MERIT 3. Representation of sportspersons of outstanding merit in the General Body. — (1) The General Body of each National Sports Body shall include, as voting members, at least four, or any other higher even number, of sportspersons of outstanding merit, of which fifty per cent. shall be male sportspersons of outstanding merit and fifty per cent. shall be female sportspersons of outstanding merit. (2) The manner of election or nomination of sportspersons of outstanding merit under sub-rule (1) may be specified in the bye-laws of the relevant National Sports Body. 4. Representation of sportspersons of outstanding merit in the Executive Committee. — The sportspersons of outstanding merit to be included in the Executive Committee pursuant to sub-clause (i) of clause (b) to sub-section (1) of section 4 of the Act, shall be elected to the Executive Committee in accordance with rule 9. 5. Eligibility criteria and application. — (1) The National Sports Body shall call for applications for persons to be considered as sportspersons of outstanding merit and such call for applications shall specify the General Eligibility Criteria and Tiered Eligibility Criteria as specified in Schedule I, pursuant to which the sportspersons of outstanding merit rosters shall be populated. (2) Any person seeking to submit an application to be a sportsperson of outstanding merit shall satisfy the General Eligibility Criteria as specified in the Sportspersons of outstanding merit Eligibility Rules under Schedule I, and submit an application within a period of sixty days from the issuance of the call for applications, to the relevant National Sports Body, in such form and containing such information as may be specified by the relevant Executive Committee or in the bye-laws of such National Sports Body. 6. Roster of sportspersons of outstanding merit. — (1) On consideration of applications made under sub- rule (2) of rule 5, every National Sports Body shall prepare a roster of male sportspersons of outstanding merit and a roster of female sportspersons of outstanding merit, in respect of the designated sport concerning such body at least ninety days prior to the expiry of the term of such National Sports Body’s incumbent Executive Committee. (2) The roster of male sportspersons of outstanding merit and roster of female sportspersons of outstanding merit shall each include ten times the number of male sportspersons of outstanding merit or female sportspersons of outstanding merit, as the case may be, in the General Body of such National Sports Body. (3) The National Sports Body shall adhere to the following procedure while populating the relevant sportspersons of outstanding merit roster, as applicable for male sportspersons of outstanding merit and female sportspersons of outstanding merit, namely :- (a) in the first instance, all applicants who satisfy the General Eligibility Criteria and Tier 1 of the Tiered Eligibility Criteria set forth in Schedule I, shall be included in the relevant sportspersons of outstanding merit roster; (b) in the event that the sportspersons of outstanding merit roster, pursuant to clause (a), cannot be populated to meet the threshold specified in sub-rule (2), the National Sports Body shall include such applicants who satisfy the General Eligibility Criteria and the Tiered Eligibility Criteria in the Tier level immediately following the level last considered, in a sequential manner, until the number of applicants included in the relevant sportspersons of outstanding merit roster satisfies such threshold; 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (c) where the number of sportspersons of outstanding merit, pursuant to the use of a particular Tier, exceeds the threshold specified in sub-rule (2), then the eldest applicant by age shall receive preference and priority in selection from among the group of candidates qualifying under such Tier; and (d) where the National Sports Body is unable to populate the relevant sportspersons of outstanding merit roster to meet the threshold specified under sub-rule (2) based on the steps under clauses (a) to (c), it may issue another call for applications in accordance with sub-rule (1) of rule 5 or frame and adopt additional tiered criteria for such sportspersons of outstanding merit roster, which shall be based on the principles used in Schedule I. (4) The sportspersons of outstanding merit rosters, as finalised in accordance with this rule, shall be published on the official website of the relevant National Sports Body and submitted to the National Sports Board. (5) Any person appearing on a sportspersons of outstanding merit roster shall be considered a sportsperson of outstanding merit in respect of such National Sports Body for the purposes of the Act and the rules thereunder. CHAPTER 3 GENERAL BODY AND EXECUTIVE COMMITTEE 7. Composition of the General Body. — (1) The General Body of every National Sports Body shall have the following categories of members, namely:- (a) at least four sportspersons of outstanding merit; (b) ex officio members as specified in the bye-laws of the National Olympic Committee in the case of the National Olympic Committee; (c) in the case of the National Olympic Committee, representatives of each National Sports Federation registered as an affiliate unit with the National Sports Board; (d) in case of a National Sports Body other than the National Olympic Committee, representatives of each State level affiliate unit registered with the National Sports Board; and (e) any other category of persons as may be provided by the bye-laws of a National Sports Body, in accordance with the relevant International Charters and Statutes as issued by the International Olympic Committee, or as required by the relevant International Sports Body. (2) The election or nomination of sportspersons of outstanding merit to the General Body, as specified under clause (a) of sub-rule (1), shall be undertaken at least seventy-five days prior to the expiry of the term of the incumbent Executive Committee of the relevant National Sports Body. 8. Term of office and composition of the Executive Committee. — (1) The term of office of an Executive Committee of each National Sports Body as determined by the bye-laws of the relevant body, shall not exceed four years. (2) The bye-laws of a National Sports Body specifying its composition shall ensure that at least one of the sportspersons of outstanding merit on the Executive Committee and one of the representatives from the Athletes Committee on the Executive Committee, shall be a woman. (3) Every National Sports Body may, through its bye-laws, reserve specific posts for women in the Executive Committee, to ensure compliance with the first proviso to clause (b) of sub-section (1) of section 4 of the Act. 9. Procedure governing election to Executive Committee. — (1) The election to all Elected Posts in the Executive Committee shall be conducted at least once every four years, in a fair and transparent manner and in accordance with the Election Rules in Schedule II. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 33 (2) Unless otherwise specified in the International Charters and Statutes, the Executive Committee shall, by resolution, appoint an Electoral Officer from the National Sports Election Panel, at least sixty days prior to the expiry of such Executive Committee’s term, for the preparation of the electoral roll and conduct of elections to the Executive Committee and to the Athletes Committee. (3) The Executive Committee shall, in consultation with the Electoral Officer appointed under sub-rule (2), notify the date for elections, at least fifty days prior to the expiry of such Executive Committee’s term. (4) The Electoral Officer shall be responsible for ensuring smooth conduct of the elections to the Executive Committee of the National Sports Body in compliance with the Election Rules under Schedule II. (5) The National Sports Body shall provide the requisite number of administrative staff as specified by the Electoral Officer to assist such officer to conduct the elections to the Executive Committee. (6) The National Sports Body shall adhere to the timelines specified in these rules and as summarised below in order to conduct an election for its Executive Committee: Rule/Clause Event Timeline Rule 5(2) Submission of application to be a sportsperson of outstanding merit Within sixty days of the call for applications under sub-rule (1) of rule 5. Rule 9(3) Notification of election date At least fifty days prior to the expiry of the term of the incumbent Executive Committee. Rule 10(5) Preparation and release of draft electoral roll At least forty-five days prior to the expiry of the term of the incumbent Executive Committee. Clause 5(i) of Schedule II Call for elections, release of final electoral roll and invitation for nominations At least thirty days prior to the expiry of the term of the incumbent Executive Committee. 10. Election to the Executive Committee. — (1) Unless otherwise specified in the International Charters and Statutes, any person who meets the eligibility criteria under sub-section (2) of section 4 of the Act and is not subject to disqualification under rule 11 may contest for election to the Executive Committee of a National Sports Body. (2) Members of the General Body of the National Olympic Committee as specified under sub-rule (1) of rule 7, shall be eligible to vote for the election to its Executive Committee as specified below, namely:- (a) every individual sportsperson of outstanding merit shall have one vote; (b) every individual ex officio member shall have one vote; (c) every National Sports Federation that is registered with the National Sports Board as an affiliate unit of the National Olympic Committee, shall have a maximum of two votes, to be exercised by separate individual representatives of such affiliate unit; and (d) for any category of persons specified under clause (e) of sub-rule (1) of rule 7, one vote for each such person. 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) Members of the General Body of a National Sports Body other than the National Olympic Committee, as specified under sub-rule (1) of rule 7, shall be eligible to vote for the election to its Executive Committee as specified below, namely:- (a) every individual sportsperson of outstanding merit shall have one vote; (b) every State level affiliate unit of the National Sports Body that is registered with the National Sports Board, shall have a maximum of two votes, to be exercised by separate individual representatives of such affiliate unit; and (c) for any category of persons specified under clause (e) of sub-rule (1) of rule 7, one vote for each such person. (4) The electoral roll for an election to the Executive Committee shall consist of only such members or their representatives in the General Body of the relevant National Sports Body that have voting rights as per sub- rule (2) or sub-rule (3), as the case may be, and are not otherwise disqualified under the provisions of the Act or these rules. (5) The draft electoral roll for the election shall be prepared and released by the Electoral Officer in consultation with the then current Executive Committee of the National Sports Body, at least forty-five days prior to the expiry of the term of such Executive Committee: Provided that the Electoral Officer’s decision shall be final and binding in respect of the inclusion or non-inclusion, as the case may be, of any person on the electoral roll. (6) The Electoral Officer shall provide for at least seven days from the release of the draft electoral roll, to receive and respond to any objections regarding the composition of the final electoral roll. 11. Disqualifications. — (1) A person shall be disqualified from being a member of the General Body, or of any committee of a National Sports Body, and shall not be eligible for contesting for election to the Executive Committee or the Athletes Committee, if such person is- (a) declared insolvent under applicable law; or (b) subject to a conviction by a court of competent jurisdiction in India for an offence, followed by a sentence of imprisonment; or (c) subject to a ban from holding any such position by an order of the Ethics Committee of such National Sports Body: Provided that the disqualification in respect of - (i) clause (a) shall be for the period of insolvency as applicable; (ii) clause (b) shall be for a period of one full term of the Executive Committee after the completion of such sentence; and (iii) clause (c) shall be for the duration of such ban. (2) The bye-laws of a National Sports Body may provide that, in addition to the criteria specified under sub-rule (1), a person shall be disqualified from - (a) being a member of the General Body or of any committee of such National Sports Body, or shall not be eligible for contesting elections to the Executive Committee or the Athletes Committee, if such person is a member of any other National Sports Body other than the National Olympic Committee; and (b) being a member of the General Body or of any committee of such National Sports Body, where such person has not completed the cooling off period of one term after having held the position of President, Secretary General or Treasurer in any other National Sports Body. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 35 CHAPTER 4 NATIONAL SPORTS ELECTION PANEL 12. Roster of the National Sports Election Panel. — (1)The National Sports Board shall maintain a roster of the National Sports Election Panel as notified under sub-section (1) of section 16 of the Act. (2) The roster of the National Sports Election Panel shall at all times contain at least twenty members who satisfy the qualifications specified under sub-section (1) of Section 16 of the Act. (3) The roster of the National Sports Election Panel shall be a public document within the meaning of section 74 of the Bharatiya Sakshya Adhiniyam, 2023 (47 of 2023). 13. Fees payable to Electoral Officers. — In respect of each election, the National Sports Body shall, on the basis of mutual agreement with the Electoral Officer, pay a maximum amount of rupees five lakhs as fees, along with fees of a mutually agreed amount for an assistant to such officer, if any. CHAPTER 5 ATHLETES COMMITTEES, ETHICS COMMITTEES AND DISPUTE RESOLUTION COMMITTEES 14. Provisions concerning Committees in bye-laws of National Olympic Committee. —The bye-laws of the National Olympic Committee shall include provisions concerning the constitution, operation and procedures of an Athletes Committee, an Ethics Committee and a Dispute Resolution Committee, which shall - (a) be in compliance with such guidelines as may be specified in the International Charters and Statutes; and (b) in the absence of guidelines under clause (a), be guided by the model guidelines or regulations that may be specified by the National Sports Board from time to time. 15. Provisions concerning Committees in bye-laws of National Sports Bodies. — The bye-laws of each National Sports Body, other than the National Olympic Committee, shall include provisions concerning the constitution, operation and procedures of an Athletes Committee, Ethics Committee, and Dispute Resolution Committee, which shall - (a) be in compliance with such guidelines as may be specified in the International Charters and Statutes; (b) in the case of National Sports Bodies other than the National Olympic Committee, such guidelines as may be specified by the National Olympic Committee; and (c) in the absence of guidelines under clauses (a) and (b), be guided by the model guidelines or regulations that may be specified by the National Sports Board from time to time. CHAPTER 6 REGIONAL SPORTS FEDERATIONS 36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 16. Affiliation to be maintained by Regional Sports Federations. — (1) Every Regional Sports Federation shall have an international recognition and affiliation of the concerned International Sports Body, unless a designated sport does not have an International Sports Body. (2) Where there is more than one International Sports Body for the same sport, or where more than one Regional Sports Federation applies for recognition, the National Sports Board may take a decision on the matter of affiliation and recognition, based on reasons to be recorded in writing. CHAPTER 7 AFFILIATE UNITS 17. Registration of affiliate units. — (1) Every National Sports Body shall facilitate the registration of each of its affiliate units with the National Sports Board subject to submission of the information and documents as set forth below, and in such form and manner as be specified by the National Sports Board from time to time:- (a) copy of the certificate of affiliation issued by the National Sports Body in respect of such affiliate unit; (b) copy of certificate of registration as a society, not-for-profit company or trust, as the case may be, under applicable laws; (c) names and designations of all members of the governing body of the affiliate unit, by whatever name called; and (d) any other information, as may be specified by the National Sports Board for the purposes of discharging its functions under the Act. (2) Every affiliate unit of a National Sports Body shall ensure compliance with sub-rule (1) and further ensure registration of each of its affiliate units, with the National Sports Board, and the provisions of sub- rule (1) shall apply mutatis mutandis to each such unit. (3) Every affiliate unit registered with the National Sports Board shall communicate any change in the information provided to such Board within a period of thirty days of such change. CHAPTER 8 MISCELLANEOUS 18. Miscellaneous (1) Every National Sports Body shall, within a period of six months, amend its bye-laws in conformity with the provisions of the Act. (2) The Central Government may, on receipt of the application from a National Sports Body, relax the provisions of these rules for a period of twelve months from the commencement of these rules and reasons for such relaxation to be recorded in writing. SCHEDULE I (See rules 5 and 6) SPORTSPERSONS OF OUTSTANDING MERIT ELIGIBILITY RULES [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 37 1. General Eligibility Criteria. — Any person seeking to be designated as a sportsperson of outstanding merit shall be - (a) an Indian citizen; (b) of sound mind; (c) not less than twenty-five years of age; and (d) retired from active sports and should have not participated in any competitive sport event which leads to selection to represent a district, State or India for at least one year prior to date of application under sub-rule (2) of rule 5. 2. Tier Eligibility Criteria. — (1) In case of applicants seeking inclusion to the sportspersons of outstanding merit roster of the National Olympic Committee, such applicant shall have achieved the milestone in the relevant Tier in an Olympic discipline only, while representing India. (2) In case of applicants seeking inclusion to the sportspersons of outstanding merit roster of the National Paralympic Committee, such applicant shall have achieved the milestone in the relevant Tier in a Para- Olympic discipline only, while representing India. (3) In case of applicants seeking inclusion to the sportspersons of outstanding merit rosters of any National Sports Body other than the National Olympic Committee or the National Paralympic Committee, such applicant shall have achieved the milestone in the relevant Tier in the designated sport concerning the National Sports Body only, while representing India, except in the case of Tier 10, where such applicant shall have represented a particular State. (4) For the purposes of this Schedule, — (a) References to “Summer Olympic Games”, “Winter Olympic Games”, “Commonwealth Games”, “Asian Games” and “Asian Winter Games” in any of the Tiers below shall apply mutatis mutandis to “Summer Paralympic Games”, “Winter Paralympic Games”, “Para events that form a part of the Commonwealth Games”, “Para-Asian Games” and “Winter edition of the Para-Asian Games (if any)”; (b) References to “sanctioned” refers to any competitive international event or match organised under the auspices, approval and sanctioning power of a relevant International Sports Body. Tier 1 Applicants who have won at least one of any gold, silver or bronze medal in the Summer Olympic Games or Winter Olympic Games, provided that any medal if rescinded, shall not be considered for the qualification of having achieved outstanding merit, under this Tier. Tier 2 Applicants who have participated in two or more editions of the Summer Olympic Games or Winter Olympic Games. 38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Tier 3 Applicants who have participated in at least one edition of the Summer Olympic Games or Winter Olympic Games. Tier 4 Applicants who have been awarded a Major Dhyan Chand Khel Ratna Award or an Arjuna Award by the Central Government, provided that any award if rescinded or returned, shall not be considered for the qualification of having achieved outstanding merit, under this Tier. Tier 5 Applicants who have won at least one of any gold, silver or bronze medal or equivalent placing, in a World Championship or equivalent competition, provided that any medal if rescinded, shall not be considered for the qualification of having achieved outstanding merit, under this Tier. Tier 6 Applicants who have won at least one of any gold, silver or bronze medal or equivalent placing, in the Commonwealth Games or Asian Games or Asian Winter Games, provided that any medal if rescinded, shall not be considered for the qualification of having achieved outstanding merit, under this Tier. Tier 7 Applicants who have won at least one of any gold, silver or bronze medal or equivalent placing, in an Asian Championship or equivalent competition, provided that any medal if rescinded, shall not be considered for the qualification of having achieved outstanding merit, under this Tier. Tier 8 Applicants who have participated in at least five sanctioned international events (if individual sport) or five sanctioned international matches (if team sport). Tier 9 Applicants who have participated in at least one sanctioned international event (if individual sport) or one sanctioned international match (if team sport). Tier 10 Applicants who have who have won at least one of any gold, silver or bronze medal or equivalent placing in the National Games or a National Championship or equivalent competition. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 39 SCHEDULE II (See rule 9) ELECTION RULES 1. Definitions and Interpretation (i) In these Election Rules, unless the context otherwise requires,- (a) “candidate” shall mean any candidate contesting for Election to an Elected Post; (b) “election” shall mean an election conducted in accordance with these Election Rules for an Elected Post; (c) “general meeting” shall mean a meeting of all members of the General Body of a National Sports Body, that is called and conducted in accordance with such National Sports Body’s bye-laws; and (d) “nomination” shall mean the process through which a candidate formally submits such candidate’s interest to contest for an Election to an Elected Post in accordance with these Election Rules. (ii) Any terms used in these Election Rules but not defined herein, shall have the meaning ascribed to them in the Act and the Rules. 2. Scope and Applicability (i) These Election Rules apply to all Elections in the National Sports Body. (ii) Any candidate, voting member or other participant in the election shall also be subject to the Act, and the National Sports Body’s Code of Ethics if he is not otherwise already bound and covered by the same. 3. Conduct of Elections (i) Elections shall generally take place at the Annual General Meeting of the National Sports Body and, where so required may also take place at a specially convened general meeting. (ii) Elections shall always be by secret ballot. 4. Electoral Officer (i) The Electoral Officer shall be responsible for supervising the administrative process relating to the elections, including,- (a) ensuring the correct application of the Act, and these rules; (b) setting reasonable deadlines for each stage of the elections in accordance with the model calendar provided under clause 5 of this Schedule, and enforcing such deadlines strictly; (c) determining and distributing the appropriate documentation and forms, including nomination forms and ballot papers, for each stage of the elections and enforcing and verifying their proper use; (d) distributing information to voting members, other members, the media and public; (e) managing relations with government bodies or the National Sports Board and any observers as deputed by the National Sports Board; (f) causing the publication of all notifications and forms concerning the elections on the official websites of the National Sports Body, the National Sports Board and the Ministry of Youth Affairs and Sports; and (g) all other tasks necessary to ensure the smooth running of the electoral process. 40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) The Electoral Officer may, only for reasons of practical necessity, modify the forms appended to this Schedule, while ensuring that the principles of this Schedule are adhered to. 5. Calling elections and the electoral roll (i) Elections shall be called by the National Sports Body’s Executive Committee in consultation with the Electoral Officer, at least thirty days prior to the expiry of such Executive Committee’s term, in accordance with the relevant provisions of the National Sports Body’s constitutional documents and shall be included in the agenda of the applicable general meeting. (ii) The call for elections shall contain, at a minimum, the following: (a) the name of the Electoral Officer; (b) the final electoral roll prepared and released by the Electoral Officer pursuant to sub-rule (6) of rule 10 and in accordance with Form 1 appended to these Election Rules. (c) the Elected Posts that are the subject of such Elections and any pre-requisites or qualifications for Candidates to contest such Elected Posts; (d) an invitation to file for nominations for Elected Posts by interested Candidates; (e) the nomination form to be submitted by interested Candidates which shall be in accordance with Form 2 appended to these Election Rules; and (f) the electoral calendar which shall be in accordance with the model calendar specified in sub-clause (iii) below: (iii) The Electoral Officer shall conduct the Elections in accordance with the following model calendar: Event Day Call for Elections, invitation for nominations and release of final electoral roll Day 1 Filing of nominations Day 8 to Day10 Announcement of draft list of nominations received Day 10 Objections to draft list of nominated candidates Day 11 to Day 14 Scrutiny and disposal of objections to Draft list of nominated candidates Day 15 to Day 16 Final list of nominated candidates Day 17 Withdrawal of nominations Day 18 Final list of contesting candidates Day 19 Polling and announcement of results Day 21 (iv) The Electoral Officer may, only for reasons of practical necessity, modify the model calendar specified in sub-clause (iii), while ensuring that the elections are completed within a maximum period of twenty- one days. 6. Nominations (i) The nomination of a candidate for election shall be proposed and seconded by persons on the electoral roll. (ii) Every nomination form shall be delivered to the Electoral Officer in person by the candidate himself within the deadline specified. (iii) No member shall nominate more than one candidate for the same Elected Post, either as proposer or seconder and, if he so does, only the first valid nomination shall be accepted, and all other nominations of such member, shall be deemed to be void and inoperative. (iv) No person shall be permitted to withdraw his name as proposer or seconder, once the nomination form endorsed by him has been delivered to the Electoral Officer. (v) The Electoral Officer shall prepare a list of all nominations received by him, Elected Post-wise in accordance with Form 3 appended to these Election Rules. 7. Scrutiny and Finalisation of Nominations [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 41 (i) The Electoral Officer shall scrutinise each nomination form received by him and determine its validity or otherwise as per the Act, rules made thereunder, the National Sports Body’s bye-laws. (ii) During the scrutiny of nominations under sub-clause (i), each Candidate or one of his authorised representatives shall have the right to be present and raise any objection in relation to nomination of another Candidate for the Elected Post for which he has filed his nomination. (iii) Pursuant to the scrutiny of nomination forms, the Electoral Officer shall prepare a list of validly nominated candidates in accordance with Form 4 appended to these Election Rules. (iv) Every candidate whose nomination has been found valid on scrutiny shall be entitled to withdraw his candidature prior to the commencement of the Election by providing notice to the Electoral Officer in accordance with Form 5 appended to these Election Rules, and the Electoral Officer shall accept the notice of withdrawal if he is satisfied as to the genuineness of such notice. (v) Any notice of withdrawal of candidature shall be final and shall not be allowed to be cancelled. (vi) The Electoral Officer shall prepare the final list of contesting candidates in accordance with Form 6 of these Election Rules. (vii) The National Sports Body shall produce the ballot papers in accordance with Form 7 appended to these Election Rules under the supervision and charge of the Electoral Officer. (viii) The ballot papers shall be printed clearly and legibly, and the names of the contesting candidates shall be arranged, for each Elected Post, in alphabetical order according to the english alphabet. 8. Campaign Practices (i) Electoral campaigns shall be carried out by the candidates in a fair manner and, in a spirit of respect for fundamental ethical principles. (ii) Candidates shall conduct all campaigns with dignity and moderation and with respect for any other candidates, the National Sports Body and its members. (iii) A Candidate shall not produce any spoken word, written text or representation of any nature likely to harm the image of another candidate or cause him prejudice, and criticism of other candidates, if made, shall be confined to their policies and programme, past record and work. (iv) No Candidate shall engage in criticism based on unverified allegations or distortion against any other Candidate, and there shall be no appeal to caste or communal feelings for securing votes. (v) Every Candidate may present to the members in the electoral roll, his plans and views for the Elected Post, in the form of a written document, which shall be published by the Electoral Officer in accordance with clause 4 (i) (g) of these Election Rules. (vi) Candidates shall avoid excessive expenditure in campaigning, recognising that it could become a factor of inequality amongst the candidates. (vii) The promotion of a candidate shall exclude any form of publicity, including the use of new media or social networks, and no public meeting or gathering of any kind may be organised in the process of promoting a candidature, and no use, free of charge or in return for payment, of the services of a journalist or the media may be made in order to place a candidate at an advantage or a disadvantage. (viii) All candidates shall scrupulously avoid all activities that are “corrupt practices”, including bribing of voters, intimidation of voters, impersonation of voters. (ix) Candidates may, in no case and under no pretext, give presents, offer donations, gifts or grant advantages of whatever nature, directly or indirectly, to voting members. (x) The incumbent Executive Committee member, shall ensure that no cause is given for any complaint that they have used their official position for the purposes of their election campaign and in particular shall not - (a) use official transport including, vehicles, machinery and personnel for furtherance of their campaign; (b) issue any advertisement at the cost of the National Sports Body or its members in the newspapers and other media or misuse the National Sports Body’s official media channels during the elections; (c) sanction grants or payments out of discretionary funds from the time elections are announced; and 42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (d) enter into any promise or undertaking to be performed, whatever the timing of such performance, for the direct or indirect benefit of any of the National Sports Body’s members or its partners. 9. Neutrality and Independence (i) As the voting is secret, voting members are prohibited individually or collectively, from announcing publicly, in any form whatsoever, their intention to vote or not vote for a candidate. (ii) Incumbent Executive Committee members shall refrain from making any public declaration and may in no way support a candidate. (iii) Candidates shall not - (a) accept instructions from any person; (b) accept direct or indirect assistance, be it financial, material or in kind, by any third party, or (c) enter into any form of undertaking with any person likely to affect the freedom of decision or action of the Elected Post. (iv) The National Sports Body’s executive team and administration shall maintain a strict duty of neutrality at all times, and no support or service in relation to a candidature may be requested from any member of the National Sports Body’s administration or staff. 10. Polling (i) Where the number of contesting candidates for any Elected Post or category of Elected Post is equal to the number of Elected Posts to be filled, all such contesting candidates shall be deemed to be duly elected unopposed to those Elected Posts, and it shall not be necessary to take a poll for election to such Elected Post. (ii) Where the number of contesting candidates for any Elected Post or category of Elected Post is more than the number of Elected Posts to be filled, a poll shall be taken by secret ballot for those Elected Posts remaining unfilled. (iii) At the poll, members who are in the electoral roll, shall be entitled to,- (a) cast one vote for each of the Elected Posts remaining unfilled, where only one such seat is to be filled; and (b) cast as many votes as are the number of seats to be filled for an Elected Post, where more than one seat is to be filled. (iv) The ballot papers shall contain the name(s) of the Candidate(s), and the voters must mark one candidate only. (v) Every voter shall be required, before he is supplied with a ballot paper, to give his signature on the authenticated copy of the electoral roll for taking the poll. (vi) Except for the circumstance under sub-clause (i), a secret ballot shall always be conducted, regardless of how many candidates there are, and the secrecy of the ballot shall be guaranteed by the provision of a procedure ensuring privacy for the voter, and the Electoral Officer shall conduct the distribution and counting of the ballot papers and be responsible for ensuring that the process is properly documented. (vii) Voting members must vote in person where required. (viii) The voter shall record his vote on the ballot paper in secrecy in a voting compartment specially provided for the purpose at the polling station. (ix) The voter shall record his vote on the ballot paper by placing a tick mark against the name of the candidate of his choice, and the tick mark to indicate the vote shall be placed by the voter only by means of an article (such as a stamp) specifically provided for the purpose by the Electoral Officer. (x) The ballot paper marked by a voter shall be deposited by him in a ballot box specially prepared and sealed by the Electoral Officer and placed at such a conspicuous place in the polling station that it shall be constantly visible to all present in the polling station. (xi) The Electoral Officer shall close the poll at the designated time of closure, and such voters who are present at the polling station at the appointed closing hour, if any, shall be entitled to vote even if the poll proceedings have to be extended for sportspersons of outstanding merit more time. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 43 (xii) The number of ballot papers that have been distributed shall be announced by the Electoral Officer before the commencement of the voting, and if the number of ballot papers returned in the poll is equal to or less than the number of ballot papers distributed, the Election shall be declared valid, but if the number returned in the poll exceeds that of the ballot papers distributed, the vote shall be declared null and void and another poll shall be taken immediately. 11. Counting of Votes (i) The Electoral Officer shall take up the counting of votes, post-wise and category-wise, as soon as may be, after the polling process is complete. (ii) Every contesting candidate can nominate one authorised representative who shall be entitled to be present at the place of counting of votes, and other than such authorised representative, only the Electoral Officer and members of the National Sports Body’s executive or administrative team, as specifically approved by the Electoral Officer, may take part in the count. (iii) Every ballot paper on which a vote has been recorded shall be treated as one vote for the candidate for whom it has been validly marked. (iv) The following ballot papers shall be considered invalid and shall be rejected by the Electoral Officer, namely:- (a) those that do not bear the official distinctive marks defined by the Electoral Officer; (b) those that bear any words other than the names of the candidates; (c) those that are illegible or have been defaced; (d) those that bear identifying marks; and (e) those that include votes for more candidates than permitted in a particular poll. (v) The Electoral Officer shall write on the back of any invalid ballot paper, in red, the reasons for its invalidity and confirm with a signature. (vi) The votes validly cast for each of the contesting candidates shall be counted post-wise, and category- wise where applicable, and recorded in the descending order of the votes so cast for each candidate in accordance with Form 8 appended to these Election Rules. (vii) The Electoral Officer shall thereafter ascertain the result of counting and the candidates who have secured the maximum number of votes in the said descending order, post-wise and category wise, where applicable, equal to the number of seats to be filled for each Elected Post or category of Elected Posts, where applicable, shall be deemed to have been duly elected to those Elected Posts. (viii) After completing and verifying the count, the Electoral Officer shall put the ballot papers that have been collected and counted into envelopes intended for this purpose and seal them immediately, and the National Sports Body shall keep these envelopes and shall retain them atleast until the declaration of results of the immediately subsequent Election of the Executive Committee, or till the pendency of any legal proceedings relating to such Elections, whichever is later. 12. Declaration of Results (i) Once the count has been completed and verified, the names of contesting candidates who shall be deemed to have been elected at the Elections shall be declared by the Electoral Officer at the general meeting. (ii) The results of the election shall be declared in accordance with Form 9 appended to these Election Rules, and published on the National Sports Body’s official website within twenty-four hours of completion thereof. (iii)If, after the counting of the votes, an equality of votes is found to exist between any candidates, and the addition of one vote will entitle any of those candidates to be declared elected, the Electoral Officer shall forthwith decide between those candidates by lot, and proceed as if the candidate on whom the lot falls had received an additional vote. 13. Sanctions and Complaints 44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) All administrative matters relating to any election not covered by the Act, these rules or the National Sports Body’s bye-laws shall be ruled upon by the Electoral Officer. (ii) In the event of a breach of these Election Rules, the Electoral Officer may refer the same to the National Sports Body’s Ethics Committee, who may make to the candidate in question: (a) observations, which may be made public; or (b) issue a warning, which will be automatically made public on the National Sports Body’s official website. (iii)If a candidate or a voting member has any specific complaint or problem regarding the conduct of elections he may bring the same to the notice of the Electoral Officer. (iv) Any decision by the Electoral Officer under these rules shall be final and binding, and any petition to the National Sports Tribunal relating to conduct or outcome of election shall be limited to only any violation of the provisions relating to the process of conduct of election under this Schedule: Provided that no such petition may be filed after a period of thirty days from the declaration of results of any election.
