का.आ. 3267(अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 25 की उप-धारा (3)
और धारा 17 के साथ परित धारा 16 की उप-धाराओं (1) और (2) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केंद्र सरकार
का भारतीय मानक ब्यूरो के साथ परामिध करने के बाद यह म त है दक यह िनजहत में आवश्यक अथवा जहतकर है, अत:
एतद्द्वारा जनम्नजलजखत आदेि करती है, नामत:-
1. संजिप्त िीर्धक और प्रारंभ - (1) इस आदेि को बोल््स, न्स और फास्ट्टेनेसध (गुणवत्ता जनयंत्रण) आदेि, 2023 कहा
िाएगा।
(2) यह आदेि इस अजधसूचना के प्रकािन की तारीख से छ: माह की अवजध के बाद प्रभावी होगा:
बिते दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत यथा पररभाजर्त लघु उद्यमों के
जलए यह आदेि इस अजधसूचना के प्रकािन की तारीख से नौ माह की अवजध के बाद प्रभावी होगा।
बिते दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत यथा पररभाजर्त सूक्ष्म उद्यमों
के जलए यह आदेि इस अजधसूचना के प्रकािन की तारीख से बारह माह की अवजध के बाद प्रभावी होगा।
2. मानक जचह्न का अजनवायध प्रयोग - ताजलका के कॉलम (1) में जवजनर्दधष्ट वस्ट्तुएँ या सामान उि ताजलका के कॉलम (2)
में उजल्लजखत तद्नुरूपी भारतीय मानक के अनुरूप होंगे तथा उनमें भारतीय मानक ब्यूरो (अनुपालन मूल्यांकन) जवजनयम,
2018 की अनुसूची-II की स्ट्कीम-1 के अनुसार ब्यूरो के लाइसेंस के तहत मानक जचन्ह लगा होगा।

बिते दक इस आदेि में से कुछ भी जनयाधत की िाने वाली स्ट् वदेि में जवजनर्मधत वस्ट्तुओं या सामान पर लागू नहीं होगा।
बिते इसके अलावा दक इस आदेि में से कुछ भी उन वस्ट्तुओं अथवा सामान पर लागू नहीं होगा जिन्हे दकसी तैयार वस्ट्तु
अथवा उनके जहस्ट् से अथवा घटक के रूप में आयात दकया गया है।
बिते दक इस आदेि में से कुछ भी उन वस्ट्तुओं अथवा सामान पर लागू नहीं होगा जिनका घरेलू जवजनमाधता द्वारा जनयाधत
हेतु उत्पाद जवजनर्मधत करने के जलए आयात दकया गया है।
बिते दक इस आदेि में से कुछ भी सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय के ‘उद्यम पोटधल’ के तहत पंिीकृत उद्यमों द्वारा
स्ट्वदेिी रूप से जवजनर्मधत वस्ट्तुओं अथवा सामान पर लागू नहीं होगा, जिसमें मूल लागत पर संयंत्र एवं मिीनरी अथवा
उपकरण में जनवेि पच्चीस लाख रूपए से अजधक नहीं है तथा चाटधडध अकाउंटेंट द्वारा यथा सत्याजपत उत्पादन जपछले जवत्तीय
वर्ध में दो करोड़ रूपए से अजधक नहीं है, उसे संगत गुणवत्ता जनयंत्रण आदेि के कायाधन्वयन से छूट दी िाएगी।
3. प्रमाणन और प्रवतधन प्राजधकरण – यह ब्यूरो ताजलका के कॉलम (1) में जवजनर्दधष्ट वस्ट्तुओं या सामान के जलए प्रमाणन
और प्रवतधन प्राजधकरण होगा।
4. उल्लंघन के जलए पेनल्टी – इस आदेि के प्रावधानों का उल्लंघन करने वाले व्यजि को भारतीय मानक ब्यूरो
अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा।

ORDER
New Delhi, the 21st July, 2023
S.O. 3267(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with
section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central
Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to
do in the public interest, hereby makes the following Order, namely: -
1.
Short title and commencement. - (1) This Order may be called The Bolts, Nuts and Fasteners (Quality
Control) Order, 2023.
(2) It shall come into force with effect from six months from the date of publication of notification:
Provided that for Small Enterprises, as defined under the Micro, Small and Medium Enterprises Development Act,
2006 (27 of 2006), it shall come into force with effect from Nine months from the date of publication of this
notification.
Provided that for Micro Enterprises, as defined under the Micro, Small and Medium Enterprises Development Act,
2006 (27 of 2006), it shall come into force with effect from Twelve months from the date of publication of this
notification.
2.
Compulsory use of Standard Mark. - Goods or articles specified in the column (1) of the Table below shall
conform to the corresponding Indian Standard specified in column (2) of the said Table and shall bear the Standard
Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity
Assessment) Regulations, 2018:
Provided that nothing in this Order shall apply to goods or articles manufactured domestically for export:
Provided further that nothing in this Order shall apply to goods or articles imported as a part of any finished good or
sub-assembly or component:
Provided also that nothing in this Order shall apply to goods or articles imported by domestic manufacturer for
manufacturing products for export:
Provided also that nothing in this Order shall apply to goods or articles manufactured domestically by an enterprise,
registered under "Udyam portal" of the Ministry of Micro, Small and Medium Enterprises, wherein the investment in
plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not
exceed two crore rupees for the previous financial year as certified by a Chartered Accountant shall be exempted from
implementation of the relevant Quality Control Order.
3.
Certification and enforcing authority. - The Bureau shall be the certifying and enforcing authority for the
goods or articles specified in the column (1) of the said Table.
4.
Penalty for contravention. – Any person who contravenes the provisions of this Order shall be punishable
under the provisions of the Bureau of Indian Standards Act, 2016.
