सा.का.नि. 447(अ).— जबकि गैस सिलेंडर नियम, 2016 के मसौदे को, विस्फोटक अधिनियम, 1884 (1884 का 4) की धारा 18 की उप-धारा (1) के अधीन अपेक्षित रूप से, भारत सरकार, वाणिज्य और उद्योग मंत्रालय, (उद्योग संवर्धन और आंतरिक व्यापार विभाग) की अधिसूचना संख्या सा.का.नि.146 (अ) तारीख 24 फरवरी, 2026 द्वारा भारत के राजपत्र, असाधारण, भाग 2, खंड 3, उप-खंड (i), तारीख 25 फरवरी, 2026 में प्रकाशित किया गया था, तथा उससे प्रभावित होने की संभावना रखने वाले सभी व्यक्तियों से, उक्त अधिसूचना वाले राजपत्र की प्रतियां जनता को उपलब्ध कराए जाने की तारीख से, तीस दिन की अवधि की समाप्ति से पूर्व आक्षेप अथवा सुझाव आमंत्रित किए गए थे;
और जबकि, उक्त राजपत्र अधिसूचना की प्रतियां 25 फरवरी, 2026 को जनता के लिए उपलब्ध करा दी गई थी;
और जबकि, उक्त मसौदा नियमों के संबंध में प्राप्त आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा सम्यक विचार कर लिया गया है;
अतः, अब, विस्फोटक अधिनियम, 1884 (1884 का 4) की धारा 5 और 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केंद्रीय सरकार गैस सिलेंडर नियम, 2016 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: -
-
संक्षिप्त नाम और प्रारम्भ- (1) इन नियमों का संक्षिप्त नाम गैस सिलेंडर (दूसरा संशोधन) नियम, 2026 है।
(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

गैस सिलेंडर नियम, 2016 (जिसे इसके पश्चात उक्त नियम कहा गया है) में नियम 48 का विलोप किया जाएगा;

उक्त नियमों के प्ररूप-ग में, “प्ररूप 'ङ', अथवा 'ङ' और 'घ' अथवा 'च' अथवा 'छ' अथवा 'ज' में अनुज्ञप्ति हेतु इस आवेदन के साथ जमा किए जाने वाले दस्तावेज” शीर्षक के अधीन मद (vi) का लोप किया जाएगा;

उक्त नियमों के, प्ररूप-च में, शर्त 8 के बाद, निम्नलिखित शर्त अंतःस्थापित की जाएगी, अर्थात्:-
"8क. औद्योगिक गैस सिलेंडरों के लिए, अनुज्ञापन प्राधिकारी द्वारा उच्च जमावट (स्टैकिंग) और कम गलियारा स्थान (गैंगवे) की अनुमति दी जा सकेगी, यदि सिलेंडरों को प्रमाणित संरचित पैकेजिंग (रैक, पिंजरे) में पर्याप्त पट्टियों, क्लिपों अथवा इंटरलॉक के साथ पैक किया गया हो, जिसमें सिलेंडर, उसके फिटिंगों और सिलेंडरों के समुचित संचालन की अखंडता सुनिश्चित हो तथा ऐसी प्रमाणित संरचित पैकेजिंग तथा लदान और उतार की प्रक्रिया राष्ट्रीय अथवा अंतर्राष्ट्रीय संहिताओं के अनुरूप हो।

NOTIFICATION
New Delhi, the 5th June, 2026
G.S.R. 447(E).— Whereas the draft of the Gas Cylinders Rules, 2016 were published, as required under sub-section (1) of section 18 of the Explosives Act, 1884 (4 of 1884), vide notification of the Government of India in the Ministry of Commerce and Industry (Department for Promotion of Industry and Internal Trade), number G.S.R. 146(E), dated 24th February, 2026 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) dated the 25th February, 2026, inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette containing the said notification was made available to the public;
And whereas, the copies of the Gazette said notification were made available to the public on the 25th February, 2026;
And whereas, objections and suggestions received in respect of the said draft rules, have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules further to amend the Gas Cylinders Rules, 2016, namely:-

Short title and commencement.—(1) These rules may be called the Gas Cylinders (Second Amendment) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.

In the Gas Cylinders Rules, 2016 (hereinafter referred to as the said rules), rule 48 shall be omitted.

In the said rules, in FORM C, under the heading “DOCUMENTS REQUIRED TO BE SUBMITTED WITH THIS APPLICATION FOR A LICENCE IN FORM E, or E and D or F or G or H”, item (vi) shall be omitted.

In the said rules, in FORM F, after condition 8, the following condition shall be inserted, namely:-
“8A. For industrial gas cylinders, higher stacking and lesser gangway may be permitted by the licensing authority, if cylinders are packed in certified structured packaging (racks, cages) with adequate straps, clips or interlocks to ensure the integrity of the cylinder, its fittings and proper maneuvering of cylinders are ensured with these certified structured packaging and loading and unloading procedure shall comply with the national or international codes.”.
