फरवरी, 2024 का.आ. 574(अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) (इसके उपरांत उपययुक् त अजधजनयम के रूप में संदर्भुत) की धारा 17 के साथ पठित धारा 16 तथा धारा 25 की उप-धारा (3) के द्वारा प्रदत िजियों का प्रयोग करते हुए तथा ददनांक 22 ददसंबर, 2020 की अजधसूचना सं. का.आ. 4637 (ई) के तहत भारत के रािपत्र, असाधारण, भाग-II, खण्ड-3, उप खण्ड (ii), ददनांक 22 ददसंबर, 2020 में प्रकाजित इस्ट्पात और इस्ट्पात उत्पाद (गयणवत्ता जनयंत्रण) आदेि, 2020, को उन बातों के जसवाय अजधक्ांत करते हैं जिन्हें ऐसे अजधक्मण से पहले दकया गया है या करने का लोप दकया गया है, केंद्रीय सरकार यह मत रखते हुए दक सावुिजनक जहत में ऐसा करना आवश्यक अथवा समीचीन है और ब्यूरो से परामिु करने के पश्चात जनम्नजलजखत आदेि करती है, अथाुत् :- 1. संजिप्त नाम और प्रारंभ होना– (1) इस आदेि को इस्ट्पात और इस्ट्पात उत्पाद (गयणवत्ता जनयंत्रण) आदेि, 2020 कहा िाएगा। (2) इस आदेि में अन्यथा उपबंजधत के जसवाय, यह आदेि िासकीय रािपत्र में इसके प्रकािन की जतजथ से प्रवृत्त होगा। 2. अनयप्रयोग- यह आदेि अनयसूची-1 के कॉलम (3) में जवजनर्दुष्ट इस्ट्पात और इस्ट्पात उत्पादों और अनयसूची-2 के कॉलम (2) में जवजनर्दुष्ट वस्ट्तयओं अथवा सामजियों पर लागू होगा लेदकन यह स्ट्वदेि में जवजनर्मुत ऐसे इस्ट्पात और इस्ट्पात उत्पादों पर लागू नहीं होगा, िो जनयाुत के जलए प्रत्येक इस्ट्पात और इस्ट्पात उत्पाद उि अनयसूची-1 के कॉलम (5) में जवजनर्दुष्ट जतजथयों से उि अनयसूची के कॉलम (2) में जवजनर्दुष्ट संबंजधत भारतीय मानकों के अनयरूप होगा। (2) अनयसूची-1 के कॉलम (3) में जवजनर्दुष्ट प्रत्येक इस्ट्पात और इस्ट्पात उत्पाद के मामले में प्रत् येक कंसाइनमेंट के साथ भारतीय मानक ब् यूरो से प्रमाजणत जवजनमाुता द्वारा िारी मानक जचन् ह ययक् त िांच प्रमाण-पत्र होना चाजहए। (3) क्म सं. 1 पर अनयसूची 2 के कॉलम (2) में जवजनर्दुष्ट वस्ट्तयएँ और सामजियां भारतीय मानक ब्यूरो (अनयरूपता आकलन) जवजनयम 2018 की अनयसूची-II की योिना-IV के अनयसार भारतीय मानक ब्यूरो से अनयरूपता प्रमाणपत्र के तहत उि अनयसूची के कॉलम(3) में जवजनर्दुष्ट संबंजधत अजनवायु अपेिाओं के अनयरूप होंगी। (4) क्म सं 2 पर अनयसूची 2 के कॉलम (2) में जवजनर्दुष्ट वस्ट्तयओं और सामजियों को अनयसूची 1 के कॉलम (3) में यथा जवजनर्दुष्ट, इनपयट सामिी के रूप में स्ट्टेनलेस स्ट्टील से बनाया िाएगा िो अनयसूची 1 के कॉलम (2) में जवजनर्दुष्ट भारतीय मानकों के अनयरूप होगा और उस पर भारतीय मानक ब्यूरो (अनयरूपता आकलन) जवजनयम, 2018 की अनयसूची-II की योिना-Iके अनयसार भारतीय मानक ब्यूरो के लाइसेंस के तहत मानक जचन्ह होगा और जनम्न की अनयपालना करेगा:- (क) प्रत् येक कंसाइनमेंट के साथ क्म सं.2 पर अनयसूची 2 के कॉलम (2) में जवजनर्दुष्ट वस्ट्तयओं और सामजियों के िांच प्रमाण पत्र होगा; और (ख) प्रत्येक कंसाइन् मेंट के साथ इनपयट सामिी पर भारतीय मानक ब् यूरो द्वारा प्रमाजणत जवजनमाुता द्वारा िारी मानक जचन् ह ययक् त िांच प्रमाण-पत्र होगा। (5) क्म सं. 3, 4, 5, 6 एंव 7 पर अनयसूची 2 के कॉलम (2) में जवजनर्दुष्ट वस्ट्तयओं और सामजियों को अनयसूची 1 के कॉलम (3) में क्म संख्या 108 और 109 के समि यथाजवजनर्दुष्ट, इनपयट सामिी के रूप में ठटन प्लेट और ठटन मयि स्ट्टील से बनाया िाएगा िो अनयसूची 1 के संबंजधत कॉलम (2) में जवजनर्दुष्ट भारतीय मानकों के अनयरूप होगा, उस पर भारतीय मानक ब्यूरो (अनयरूपता आकलन) जवजनयम, 2018 की अनयसूची-II की योिना-I के अनयसार ब्यूरो के लाइसेंस के तहत मानक जचन्ह होगा और इसके साथ इनपयट सामिी का िांच प्रमाण-पत्र होगा। 4. मानक जचन्ह का अजनवायु उपयोग– अनयसूची 1 के कॉलम (3) में जवजनर्दुष्ट प्रत्येक इस्ट्पात और इस्ट्पात उत्पाद पर भारतीय मानक ब्यूरो (अनयरूपता आकलन) जवजनयम, 2018 की अनयसूची- II की योिना-I के अनयसार ब्यूरो से लाइसेंस के तहत मानक जचह्न होना चाजहए। (2) जवजनर्दुष् ट मानकों के अनयरूप नहीं पाए िाने वाले जनम् न स्ट् तरीय अथवा दोषपूणु इस्ट् पात एवं इस्ट् पात उत् पादों का स्ट् क्ैप के रूप में इस प्रकार जनपटान दकया िाएगा जिससे भारतीय मानक ब् यूरो अजधजनयम, 2016 (2016 का 11) की धारा 17 की उप-धारा (1) के खंड (ख) के प्रावधानों का उल् लंघन न हो। 5. प्रमाणन और प्रवत्तुन प्राजधकारी - भारतीय मानक ब्यूरो इस आदेि में जवजनर्दुष्ट इस्ट्पात और इस्ट्पात उत्पादों, वस्ट्तय एवं सामजियों के संबंध में प्रमाणन एवं प्रवत्तुन प्राजधकारी होगा। 6. उल्लंघन के जलए सिा-िो भी व्यजि इस आदेि के दकसी प्रावधान का उल्लंघन करेगा, उसे भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 29 के अंतगुत दंड ददया िाएगा। 7. भारतीय मानकों में संिोधन अथवा सयधार प्रवृत्त होने की जतजथ- यदद अनयसूची 1 के कॉलम 2 में जवजनर्दुष्ट दकसी भी भारतीय मानक में ब्यूरो द्वारा कोई संिोधन अथवा सयधार दकया िाता है, तो उस पर यह आदेि ब्यूरो द्वारा इस संबंध में अजधसूजचत की 5th February, 2024 S.O. 574(E).—In exercise of the powers conferred by section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) (hereinafter referred to as the said Act) and in supersession of the Steel and Steel Products (Quality Control) Order, 2020, published vide notification number S.O. 4637(E), dated the 22nd December, 2020 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (ii), dated the 22nd December, 2020, except as respects things done or omitted to be done before such supersession, the Central Government being of the opinion that it is necessary to do so in the public interest and after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:- 1. Short title and commencement.– (1) This Order may be called the Steel and Steel Products (Quality Control) Order, 2024. (2) Save as otherwise provided in this Order, it shall come into force on the date of its publication in the Official Gazette. 2. Application.– This Order shall apply to steel and steel products specified in column (3) of Schedule 1 and goods or articles specified in column (2) of Schedule 2, annexed to this Order, except steel and steel products manufactured domestically for export which conform to any other specification required by a foreign buyer. 3. Conformity to Standards and essential requirements.– (1) Every steel and steel product specified in column (3) of Schedule 1 shall conform to the corresponding Indian Standards specified in column (2) of the said Schedule with effect from the dates specified in column (5) thereof. 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (2) Every steel and steel products specified in column (3) of Schedule 1 shall be accompanied with a Test Certificate bearing the Standard Mark, issued by the Bureau of Indian Standards certified manufacturer, with each consignment. (3) Goods and articles specified in column (2) of Schedule 2 against serial number 1 shall conform to the corresponding essential requirements specified in column (3) of the said Schedule under a Certificate of Conformity from the Bureau of Indian Standards in accordance with Scheme–IV of Schedule–II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. (4) Goods and articles specified in column (2) of Schedule 2 against serial number 2 shall be made from the stainless steel as input material, specified in column (3) of Schedule 1, conforming to Indian Standards specified in column (2) of Schedule 1, bearing Standard Mark under a licence from the Bureau of Indian Standards in accordance with Scheme – I of Schedule – II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 and shall be accompanied with– (a) the test certificate of the goods and articles specified in column (2) of Schedule 2 against serial number 2 with each consignment; and (b) the test certificate bearing the Standard Mark of input material issued by the Bureau of Indian Standards certified manufacturer with each consignment. (5) Goods and articles specified in column (2) of Schedule 2 against serial numbers 3, 4, 5, 6 and 7 shall be made from tin plate and tin free steel as input materials, as specified against serial numbers. 108 and 109 in column (3) of Schedule 1, conforming to Indian Standards specified in corresponding column (2) of Schedule 1, bearing Standard Mark under a license from the Bureau of Indian Standards in accordance with Scheme – I of Schedule – II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 and shall be accompanied with the test certificate of the input material. 4. Compulsory use of Standard Mark.– (1) Every steel and steel products specified in column (3) of Schedule 1 shall bear the Standard Mark under a licence from the Bureau of Indian Standards in accordance with Scheme–I of Schedule–II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. (2) The sub-standard or defective steel and steel product, which do not conform to the specified standard, shall be disposed off as scrap in such a way so that there is no violation of the provisions of clause (b) of sub-section (1) of section 17 of the Bureau of Indian Standards Act, 2016 (11 of 2016). 5. Certifying and enforcement authority.– The Bureau of Indian Standards shall be the certifying and enforcing authority in respect of the steel and steel products and the goods and articles specified in this Order. 6. Penalty for contravention.– Any person who contravenes any of the provisions of this Order shall be punishable under section 29 of the Bureau of Indian Standards Act, 2016 (11 of 2016). 7. Date of effect of amendment or revision in Indian Standards.– Any amendment or revision made by the Bureau of Indian Standards to any of the Indian Standards specified in column (2) of Schedule 1 shall apply to this Order with effect from the date of its publication by the said Bureau.
