का.आ. 3417(अ).— भारतीय मानक ब् यूरो अजधजनयम, 2016 (2016 का 11) की धारा 25 की उप-धारा (3) के साथ परित धारा 16 द्वारा प्रदत् त िजियों का प्रयोग करते हुए, केंद्र सरकार का, यह म त है दक यह िनजहत में आवश् यक है, और ब् यूरो से परामिध करने के बाद एतद्द्वारा जनम् नजलजखत आदेि करती है, नामत: -

संजिप् त िीर्धक और प्रारंभ - (1) इस आदेि को अंतरण सुजवधा (गुणवत्ता जनयंत्रण) आदेि, 2026 कहा िाएगा।
(2) यह आदेि िासकीय रािपत्र में इसके प्रकािन की तारीख से लागू होगा।

लागू होना- यह आदेि, इस आदेि के साथ संलग्न अनुसूची में जनर्दधष्ट गुणवत्ता जनयंत्रण आदेिों के अंतगधत आने वाले माल या वस्ट्तुओं पर लागू होगा।

मानक जचह्न का अजनवायध प्रयोग – (1) अनुसूची में जनर्दधष्ट गुणवत्ता जनयंत्रण आदेिों में जनजहत दकसी भी बात के होते हुए, उसके अंतगधत आने वाले सामान या वस्ट्तुएं संबंजधत भारतीय मानकों के अनुरूप होंगे और इस आदेि के प्रावधानों के अध्यधीन, भारतीय मानक ब्यूरो (अनुपालन मूल्यांकन) जवजनयम, 2018 की अनुसूची II की स्ट्कीम-II के अनुसार भारतीय मानक ब्यूरो के लाइसेंस के तहत एक मानक जचह्न के उपयोग की अनुमजत दी िाएगी।
(2) उप-खंड (1) के तहत लाइसेंस, केवल उस व्यजि को आपूर्तध करने के जलए ऐसे जवजनमाधता के जलए उपलब्ध होगा जिसे इस आदेि के खंड 4 के तहत जवजिष्ट अनुमजत प्रदान की गई है।
(3) जिस व्यजि को अनुमजत प्रदान की गई है वह यह सुजनजित करेगा दक इस आदेि के तहत अनुमत सामान या वस्ट्तुएं संबंजधत गुणवत्ता जनयंत्रण आदेिों के तहत जनधाधररत लागू भारतीय मानकों के अनुरूप हैं।
(4) भारतीय मानक ब्यूरो, उद्योग संवधधन और आंतररक व्यापार जवभाग के परामिध से, या तो प्रत्यि रूप से या उसके द्वारा अजधसूजचत एिेंजसयों के माध्यम से ऐसे सामानों के बािार की जनगरानी करेगा तादक लागू भारतीय मानकों से उनकी अनुरूपता को सत्याजपत दकया िा सके।
- अनुमजत प्रदान करना- (1) इस आदेि के अधीन जनम्नजलजखत को उद्योग संवधधन और आंतररक व्यापार जवभाग द्वारा अनुमजत प्रदान की िा सकेगी, -
(क) ऐसे व्यजि को िो दक कंपनी अजधजनयम, 2013 के तहत जनगजमत कंपनी है; तथा
(ख) आदेि के तहत गरित एक कायाधन्वयन सजमजत द्वारा व्यजि के िोजखम मूल्यांकन के आधार पर।
(2) उप-खंड (1) के अधीन दी गई अनुमजत, उसमें जवजनर्दधष्ट ितों के अधीन होगी।
(3) इस आदेि के प्रयोिनों के जलए एक कायाधन्वयन सजमजत होगी, और उि सजमजत में जनम्नजलजखत िाजमल होंगे-
(क) अपर सजचव या संयुि सजचव (प्रभारी, तकनीकी जवजनयम), उद्योग संवधधन और आंतररक व्यापार जवभाग-अध्यि;
(ख) संबंजधत उत्पाद के जलए उद्योग संवधधन और आंतररक व्यापार जवभाग के अपर सजचव अथवा संयुि सजचव – सदस्ट्य;
(ग) उपभोिा मामले जवभाग के संयुि सजचव – सदस्ट्य;
(घ) वाजणज्य जवभाग के संयुि सजचव – सदस्ट्य;
(ङ) जवदेि व्यापार महाजनदेिालय के प्रजतजनजध (संयुि सजचव स्ट्तर से नीचे के स्ट्तर के न हो) – सदस्ट्य;
(च) भारतीय मानक ब्यूरो के प्रजतजनजध (संयुि सजचव स्ट्तर से नीचे के स्ट्तर के न हो) – सदस्ट्य;
(छ) उद्योग संवधधन और आंतररक व्यापार जवभाग में जनदेिक अथवा उप सजचव अथवा समकि अजधकारी (प्रभारी तकनीकी जवजनयम) – संयोिक; तथा
(ि) अध्यि द्वारा आमंजत्रत दकसी अन्य मंत्रालय अथवा जवभाग अथवा संगिन का प्रजतजनजध, िो उप सजचव अथवा जनदेिक के पद के स्ट्तर से नीचे के स्ट्तर का न हो।
(4) कायाधन्वयन सजमजत दकसी व्यजि का मूल्यांकन उसकी तकनीकी िमता, प्रदर्िधत दकए गए अनुभव; उसके जडिाइन एवं जवजनमाधण पर जनयंत्रण सजहत अपनी आपूर्तध िृंखला में गुणवत्ता आश्वासन सुजनजित करने के तरीके; उसके आचरण एवं अनुपालन की सत्यजनष्ठा का पूवधवृत्त; तथा प्रौद्योजगकी को अपनाने/उन्नयन या जडिाइन िमताओं अथवा अनुसंधान एवं जवकास को बढावा देकर संबंजधत वस्ट्तुओं और सामजियों के जलए भारत में आपूर्तध िृंखला िमताओं की स्ट्थापना करने की उसकी प्रजतबद्धता; अथवा संबंजधत गुणवत्ता जनयंत्रण आदेि का लगातार तीन वर्ों की अवजध तक जबना दकसी चूक के अनुपालन; तथा अन्य दकसी संबंजधत कारकों के आधार पर करेगी।
(5) कायाधन्वयन सजमजत व्यजि के साथ वाताध करेगी तथा व्यजि द्वारा उपलब्ध कराए गए दस्ट्तावेिों, घोर्णाओं, प्रमाणपत्रों, वचनबद्धताएं, स्ट्वतंत्र आकलनों तथा ऐसी अन्य सामजियों जिन्हें वह अपने मूल्यांकन के प्रयोिन के जलए उपयुि समझती है, पर भरोसा कर सकती है।
(6) ितों के उल्लंघन, सामिी के तथ्यों का जमथ्या प्रस्ट्तुतीकरण अथवा उत्पाद के लागू भारतीय मानकों के अनुरूप न पाए िाने की जस्ट्थजत में, केंद्र सरकार सुनवाई का अवसर प्रदान करने के पिात्, इस आदेि के अंतगधत प्रदत्त दकसी भी अनुमजत को जनलंजबत, संिोजधत अथवा वापस ले सकती है।
- आवेदन तथा अन्य प्रदियाएं.— (1) इस आदेि के अंतगधत अनुमजत के जलए आवेदन, इस आदेि के प्रभावी होने की तारीख से चौबीस माह की अवजध के भीतर स्ट्वीकार दकए िाएंगे।
(2) आवेदन प्रदिया, अपेजित दस्ट्तावेिीकरण, हकदारी, मॉजनटीररंग एवं अनुपालन आदद के संबंध में इस आदेि से संबंजधत सभी संबंजधत िानकारी, उद्योग संवधधन और आंतररक व्यापार जवभाग द्वारा िारी ददिा-जनदेिों में जवजनर्दधष्ट दकए िाएंगे तथा जवभाग की वेबसाइट (https://www.dpiit.gov.in) पर उपलब्ध होंगे।
- अवजध और व् यावृजत्त.— (1) यह आदेि इसके िुरू होने की तारीख से पांच वर्ध की अवजध तक लागू रहेगा और उसके पिात्, िब तक दक केंद्र सरकार रािपत्र में अजधसूचना द्वारा इसकी अवजध का जवस्ट्तार न करे, यह रद्द माना िाएगा।
(2) इस तरह रद्द होने के बाविूद, इस आदेि को रद्द दकए िाने की तारीख से पहले इस आदेि के अंतगधत प्रदान की गई कोई भी अनुमजत, उसमें जवजनर्दधष्ट की गई अवजध तक वैध रहेगी, िब तक दक उसे इस आदेि के उपबंधों के अनुसार जनलंजबत, संिोजधत अथवा वापस न ले जलया िाए।
(3) इस आदेि के रद्द होने से, ऐसे रद्द दकए िाने से पूवध इस आदेि के अंतगधत उत्पन्न दकसी अजधकार, दाजयत्व, देयता, िांच, कायधवाही अथवा की गई दकसी कारधवाई पर कोई प्रभाव नहीं पडेगा।
- व्याख्या- यदद इस आदेि की व्याख्या से संबंजधत कोई प्रश्न उिता है, तो उसे उद्योग संवधधन और आंतररक व्यापार जवभाग को उस पर जनणधय के जलए भेिा िाएगा।

ORDER
New Delhi, the 25th June, 2026
S.O. 3417(E).— In exercise of the powers conferred by section 16 read with sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary so to do in the public interest and after consulting the Bureau, hereby makes the following Order, namely: –

Short title and commencement. - (1) This Order may be called the Transition Facilitation (Quality Control) Order, 2026.
(2) It shall come into force on the date of its publication in the Official Gazette.

Application. - This Order shall apply to the goods or articles covered under the Quality Control Orders specified in the Schedule appended to this Order.

Compulsory use of standard mark.- (1) Notwithstanding anything contained in the Quality Control Orders specified in the Schedule, goods or articles covered thereunder shall conform to the corresponding Indian Standards and shall be permitted use of a Standard Mark under a license from Bureau of Indian Standards as per Scheme II of the Schedule II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, subject to the provisions of this Order.
(2) The license under sub-clause (1) shall be available only to a manufacturer for supplying to the person who has been granted specific permission under clause 4 of this Order.
(3) The person granted permission shall ensure that the goods or articles permitted under this Order conform to the applicable Indian Standards prescribed under the corresponding Quality Control Orders.
(4) The Bureau of Indian Standards, in consultation with the Department for Promotion of Industry and Internal Trade, shall either directly or through agencies notified by it, carry out market surveillance of such goods to verify continued conformance with the applicable Indian Standards.
- Grant of permission. - (1) Permission under this Order may be granted by the Department for Promotion of Industry and Internal Trade, -
(a) to a person that is a company incorporated under the Companies Act, 2013; and
(b) based on the risk assessment of the person by an Implementation Committee constituted under the Order.
(2) The permission granted under sub-clause (1) shall be subject to such conditions as may be specified therein.
(3) There shall be an Implementation Committee for the purposes of this Order, and the said Committee shall consist of-
(a) Additional Secretary or Joint Secretary (I/c Technical Regulations), Department for Promotion of Industry and Internal Trade-Chairperson;
(b) Additional Secretary or Joint Secretary, Department for Promotion of Industry and Internal Trade of the concerned Product- Member;
(c) Joint Secretary, Department of Consumer Affairs -Member;
(d) Joint Secretary, Department of Commerce - Member;
(e) Representative of Directorate General of Foreign Trade (not below the rank of Joint Secretary level) --Member;
(f) Representative of Bureau of Indian Standards (not below the rank of Joint Secretary level)-Member;
(g) Director or Deputy Secretary or equivalent (I/c Technical Regulations), Department for Promotion of Industry and Internal Trade- Convenor; and
(h) Any other representative not below the rank of Deputy Secretary or Director from other Ministry or Department or Organization invited by the Chairperson;
(4) The Implementation Committee shall assess the person based on its technical capability, demonstrated experience; manner of ensuring quality assurance across its supply chain including through control over its design and manufacturing; history of conduct and compliance integrity; and its commitment to establish supply chain capabilities in India for the concerned goods and articles by promoting technological adoption/advancement or design capabilities or research and development; or its compliance for the concerned Quality Control Order for a continuous period of three years without any default; and any other relevant factors.
(5) The Implementation Committee may interact with the person and rely upon documents, declarations, certifications, undertakings, independent assessments, as may be provided by the person, and such other material that it considers appropriate for the purpose of its assessment.
(6) In case of breach of conditions, misrepresentation of material facts or failure of product to conform to applicable Indian standards, the Central Government may suspend, modify or withdraw any permission granted under this Order, after giving opportunity to be heard.
- Application and other modalities. - (1) The applications for permission under the Order shall be accepted within twenty-four months from the date of commencement of this Order.
(2) All relevant details pertaining to this Order in respect of the application process, documentation required, entitlements, monitoring and compliance, etc., shall be specified in guidelines issued by the Department for Promotion of Industry and Internal Trade and be available at the website (https://www.dpiit.gov.in).
- Duration and savings. - (1) This Order shall remain in force for a period of five years from the date of its commencement and shall thereafter stand rescinded unless it is extended by the Central Government by notification in the Official Gazette.
(2) Notwithstanding such rescission, any permission granted under this Order prior to the date of rescission shall continue to remain valid for the period specified therein unless suspended, modified or withdrawn in accordance with the provisions of this Order.
(3) The rescission of this Order shall not affect any right, obligation, liability, investigation, proceeding or action arising under this Order prior to such rescission.
- Interpretation. - If any question arises relating to the interpretation of this Order, the same shall be referred to the Department for Promotion of Industry and Internal Trade for its decision.
