ददल्ली, 28 अगस्ट्त, 2024 का.आ. 3649(अ).––भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 17 के साथ पठित धारा 16 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, केंद्र सरकार िनजित में आवश्यक और समीचीन िोने के कारण और भारतीय मानक ब्यूरो के परामिश से एतद्द्वारा जनम्नजलजखत आदेि करती िै, अथाशत्:-- 1. संजिप्त िीर्शक, प्रारंभ और अनुप्रयोगण.––(1) इस आदेि को मिीनरी और जवद्युत उपकरण सुरिा (सावशजत्रक तकनीकी जवजनयमन) आदेि, 2024 किा िाएगा। (2) यि सरकारी रािपत्र में प्रकािन की तारीख से एक वर्श के पश्चात् प्रवृत्त िोगा। (3) यि आदेि इस आदेि के साथ संलग्न प्रथम अनुसूची में सूचीबद्ध मिीनों और जवद्युत उपकरणों और उनकी असेंबली, उप-असेंबली तथा घटकों पर लागू िोगा। (4) इस आदेि की कोई भी बात भारतीय मानक ब्यूरो अजधजनयम, 2016 की धारा 16 के अधीन िारी दकसी अन्य आदेि में िाजमल दकसी मिीनरी अथवा जवद्युत उपकरण और उनकी "अजधजनयम" से भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) अजभप्रेत िै; (ख) "अनुरूपता मूल्यांकन जवजनयम" का अथश भारतीय मानक ब्यूरो (अनुरूपता मूल्यांकन) जवजनयम, 2018 से िै; (ग) "मिीनरी", "अवजिष्ट िोजखम", "िोजखम" और "िोजखम मूल्यांकन" का विी अथश िोगा िो क्रमिः आईएस 16819:2018/आईएसओ 12100:2010 में उन्िें समनुदेजित िै; (घ) "सुरिा" का विी अथश िोगा िो आईएसओ/टीएस 37151:2015 (ईएन) में इसे समनुदेजित िै; (ङ) "अनुसूची" से इस आदेि के साथ संलग्न अनुसूची अजभप्रेत िै। (2) इसमें प्रयुि दकन्तु आदेि में पठरभाजर्त न दकए गए िब्दों और अजभव्यजियों के अथश विी िोंगे िो क्रमिः अजधजनयम, उसके अधीन बनाए गए जनयमों या जवजनयमों में उन्िें समनुदेजित िैं। 3. मानकों और आवश्यक अपेिाओं से अनुरूपता––(1) प्रत्येक मिीन (अथवा िैसा भी मामला िो) पिली अनुसूची में जनर्दशष्ट जवद्युत उपकरण नीचे ददए गए अनुसार यथाअनुप्रयोज्य तदनुरूपी भारतीय मानकों के अनुरूप िोंगे:– (क) टाइप ए मानक इस प्रकार िोंगे: आईएस 16819:2018/आईएसओ 12100:2010 (जडिाइन - िोजखम मूल्यांकन और िोजखम में कमी के जलए मिीनरी की सुरिा के सामान्य जसद्धांत); और (ख) टाइप बी मानक - दूसरी अनुसूची के अनुसार; (ग) टाइप सी मानक – तीसरी अनुसूची के अनुसार: बिते, यदद टाइप सी मानक का टाइप ए या टाइप बी मानक द्वारा प्रयुि एक या अजधक तकनीकी प्रावधानों से जवपथन िोता िै, तो टाइप सी मानक को अजधमानता दी िाएगी। (2) प्रत्येक मिीन (अथवा िैसा भी मामला िो) पिली अनुसूची में जनर्दशष्ट जवद्युत उपकरण, अनुरूपता मूल्यांकन जवजनयमों की स्ट्कीम X में प्रदान की गई लेबललंग और अंकन आवश्यकताओं के अनुरूप िोगा और यदद मिीनरी या जवद्युत उपकरण (िैसा भी मामला िो) पर लेबल लगाने या जचजननत करने की आवश्यकता िो, तो सुरिा जनदेिों या प्रतीकों का अनुपालन भी दकया िाएगा। (3) क. तकनीकी फाइल की अपेिा का अनुपालन अनुरूपता मूल्यांकन जवजनयमों की स्ट्कीम X में यथाजनर्दशष्ट अनुसार दकया िाएगा। 4. क. अजनवायश प्रमाणन––पिली अनुसूची में जवजनर्दशष्ट प्रत्येक मिीन या जवद्युत उपकरण (िैसा भी मामला िो) पर ब्यूरो की अनुज्ञजप्त वाला मानक जचनन अंदकत िोगा; अथवा मिीन के मामले में अनुरूपता प्रमाण-पत्र के साथ िारी दकया िाएगा, अथवा (िैसा भी मामला िो) जवद्युत उपकरण, अनुरूपता मूल्यांकन जवजनयमों की स्ट्कीम X में यथाजनर्दशष्ट जनरंतर आधार पर जनमाशण के जलए वांजित निीं िै। ख. इस आदेि के पैरा 4(क) के अंतगशत अनुज्ञजप्त अथवा अनुरूपता प्रमाण-पत्र प्राप्त करने से पिले, प्रथम अनुसूची में जनर्दशष्ट प्रत्येक मिीनरी या जवद्युत उपकरण का जवजनमाशता (िैसा भी मामला िो) भारतीय मानक ब्यूरो से पंिीकृत िोगा। 5. प्रमाणन और प्रवतशन प्राजधकारी –– ब्यूरो मिीनों या जवद्युत उपकरणों (िैसा भी मामला िो) के संबंध में प्रमाणन और प्रवतशन प्राजधकारी िोगा। 6. बािार जनगरानी––इन जनयमों के अंतगशत, दकसी भी मिीन या जवद्युत उपकरण (िैसा भी मामला िो) के संबंध में बािार जनगरानीसमय-समय पर िारी ददिाजनदेिों से िाजसत िोगी। [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 7. उल्लंघन के जलए िाजस्ट्त –– कोई भी व्यजि िो इस आदेि के उपबंधों का उल्लंघन करता िै, अजधजनयम के संगत उपबंधों के अंतगशत दण्डनीय िोगा। 8. भारतीय मानकों में संिोधन अथवा पुनरीिण के प्रभावी िोने की तारीख –– यदद ब्यूरो पिली अनुसूची में जवजनर्दशष्ट दकसी भारतीय मानक में कोई संिोधन अथवा पुनरीिण करता िै, तो ऐसा संिोधन अथवा पुनरीिण इस आदेि पर उस तारीख से अनुप्रयोज्य िोगा िो ब्यूरो द्वारा इस जनजमत्त अजधसूजचत की िाए। 9. बिते, इस आदेि में कुि भी जनयाशत के जलए घरेलू स्ट्तर पर जवजनर्मशत वस्ट्तुओं या सामग्री पर लागू निीं िोगा। 10. बिते, इस आदेि में कुि भी सड़क पठरविन और रािमागश मंत्रालय द्वारा िारी केंद्रीय मोटरयान जनयमावली, 1989 के अंतगशत आने वाले जवजनमाशण उपकरणों पर लागू निीं िोगा। प्रथम अनुसूची [जनयम 1(3), 3(1), 3(2), 4 और 8 देखें] इस आदेि के अंतगशत िाजमल मिीनरी INDUSTRIES ORDER New Delhi, the 28th August, 2024 S.O. 3649 (E).––In exercise of the powers conferred by section 16 read with section 17 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary and expedient so to do, in the public interest and in consultation with the Bureau of Indian Standards, hereby makes the following Order, namely:–– 1. Short title, commencement and application.––(1) This Order may be called as the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024. (2) It shall come into force after one year from the date of its publication in the Official Gazette. (3) This Order shall apply to machines and electrical equipment and their assemblies, sub-assemblies and components listed in the first Schedule annexed to this Order. (4) Nothing in this Order shall apply to any machinery or electrical equipment and their assemblies, sub-assemblies or components covered under any other order made under section 16 of the Bureau of Indian Standards Act, 2016. 2. Definitions.––(1) In this Order, unless the context otherwise requires,–– (a)“Act” means the Bureau of Indian Standards Act, 2016 (11 of 2016); (b)“Conformity Assessment Regulations” means the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018; (c)“machinery”, “residual risk”, “risk” and “risk assessment” shall have the same meanings as assigned to them in IS 16819:2018/ISO 12100:2010, respectively; (d)“safety” shall have the same meaning assigned to it in ISO/TS 37151:2015(en); (e)“Schedule” means a Schedule annexed to this Order. (2) Words and expressions used herein but not defined in the Order shall have the meanings respectively assigned to them in the Act, rules or regulations made thereunder. 3.Conformity to standards and essential requirements.––(1) Each machine, or as the case may be, electrical equipment specified in the first Schedule shall conform to the corresponding Indian Standards, as applicable, as given below:- (a) Type A standards as given below: IS 16819:2018/ISO 12100:2010 (Safety of Machinery General Principles for Design- Risk Assessment and Risk Reduction and, (b) Type B Standards –as per the second schedule; (c) Type C Standards – as per the third Schedule: Provided that if a Type C standard deviates from one or more technical provisions dealt with by Type A or Type B standard, Type C standard takes precedence. (2) Each machine, or as the case may be, electrical equipment, specified in the first Schedule shall conform to the labeling and marking requirements as provided in the Scheme X of the Conformity Assessment Regulations and also to be complied with the safety instructions or symbols, if any required to be labeled or marked on the machinery or electrical equipment, as the case may be. (3) a. Requirement of technical file shall be complied with as provided in the Scheme X of the Conformity Assessment Regulations. 4. (a) Compulsory certification.––Each machine or electrical equipment, as the case may be, specified in the first Schedule shall bear the standard mark under a license from the Bureau; or issued with a certificate of conformity in case of machine, or as the case may be, electrical equipment, is not desired to be manufactured on a continuous basis as provided in the Scheme X of the Conformity Assessment Regulations. (b) Prior to obtaining license or certificate of conformity under para4(a) of this order, manufacturer of each machinery or electrical equipment, as the case may be, specified in the first schedule shall register with the BIS 5. Certification and enforcement authority.–– The Bureau shall be the certifying and enforcement authority in respect of the machines, or as the case may be, electrical equipment. 6. Market surveillance.––The market surveillance in respect of any machine or electrical equipment, as the case may be, under these rules, shall be governed by such guidelines as may be issued time to time. Penalty for contravention.––Any person who contravenes the provisions of this Order shall be punishable under the relevant provisions of the Act. 8.Date of effect of amendment or revision in Indian Standards.––When any amendment or revision is made by the Bureau to any of the Indian Standards specified in the Schedules, such amendment or revision shall be applicable to this Order with effect from such date as may be notified by the Bureau in this behalf. 9.Provided that nothing in this Order shall apply to goods or articles manufactured domestically for export. 10.Provided that nothing in this Order shall apply for Construction Equipment's covered under CMVR Rule 1989 issued by MoRTH.
