The Central Government appoints the 1st day of December, 2019 as the date on which specific provisions of the Insolvency and Bankruptcy Code, 2016 come into force. These provisions apply only in so far as they relate to personal guarantors to corporate debtors. The enforced provisions include clause (e) of section 2, section 78 except with regard to the fresh start process, section 79, and sections 94 to 187 both inclusive. They also include specific clauses of sub-section (2) of section 239, specific clauses of sub-section (2) of section 240, and section 249.

का.आ. 4126(अ).—केंद्रीय सरकार, दिवाला और शोधन अक्षमता संहिता, 2016 (2016 का 31) की धारा 1 की उप-धारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त संहिता के निम्नलिखित उपबंधों, जो निगमृ ऋणजी के व्यक्तिगत प्रत्याभूतिकर्ताओं से संबंधित हैं, के लिए 01 दिसम्बर, 2019 को उस तारीख के रूप में नियत करती है, जिस तारीख को उक्त अधिनियम के उपबंध प्रवृत्त होंगेः—

S.O. 4126(E).—In exercise of the powers conferred by sub-section (3) of section 1 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Central Government hereby appoints the 1st day of December, 2019 as the date on which the following provisions of the said Code only in so far as they relate to personal guarantors to corporate debtors, shall come into force:—
