L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधसूचना गांधीनगर, 3 जुलाई, 2023 अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (पूंजी बाजार मध्यस्ट्थ) (संिोधन) जिजनयम, 2023 आईएफएससीए/2023-24/जीएन/आरईजी040.—अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधजनयम, 2019 की धारा 12 की उपधारा (1) और धारा 13 की उपधारा (1) के साथ पठित धारा 28 की उपधारा (1), भारतीय प्रजतभूजत और जिजनमय बोडड अजधजनयम, 1992 की धारा 28ग द्वारा प्रदत्त िजियों का प्रयोग करते हुए, अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (पूंजी बाजार मध्यस्ट्थ) जिजनयम, 2021, (इसके बाद मूल जिजनयम के रूप में संदर्भभत ककया जाएगा), में संिोधन करने के जलए जनम्नजलजखत जनयम बनाता है अथाडत्: - 1. (1) इन जिजनयमों को अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (पूंजी बाजार मध्यस्ट्थ) (संिोधन) जिजनयम, 2023 कहा जाएगा। (2) िे िासकीय राजपत्र में उनके प्रकािन की तारीख से लागू होंगे। 2. मूल जिजनयम के जिजनयम 2 में, उप-जिजनयम (1) के खंड (छ) के बाद, जनम्नजलजखत खंड (छ क) डाला जाएगा, अथाडत्: - “ "पूंजी बाजार मध्यस्ट्थ" का अथड जिजनयम 3 में जनर्ददष्ट मध्यस्ट्थ है और यह इन जिजनयमों के अधीन प्राजधकरण में रजजस्ट्रीकृत है;" सं. 469] नई कदल्ली, मंगलिार, जुलाई 4, 2023/आषाढ़ 13, 1945 No. 469] NEW DELHI, TUESDAY, JULY 4, 2023/ASHADHA 13, 1945 सी.जी.-जी.जे.-अ.-04072023-247020 CG-GJ-E-04072023-247020 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 3. मूल जिजनयम के जिजनयम 2 में, उप-जिजनयम (1) के खंड (थ) के बाद, जनम्नजलजखत खंड (थक) अंतस्ट्थाडजपत ककया जाएगा, अथाडत्: - “ "जितरक" का अथड ऐसा व्यजि है जो पाठरश्रजमक के जलए जारीकताड या सेिा प्रदाता की ओर से ग्राहकों के साथ "पूंजी बाजार उत्पादों" या "पूंजी बाजार सेिाओं" में जनिेि या अंिदान की सुजिधा प्रदान करता है, जैसा कक प्राजधकरण द्वारा जारी पठरपत्र संख्या 817/आईएफएससीए/जितरण/2022-23 कदनांक 21 कदसंबर 2022 के तहत पठरभाजषत ककया गया है;'' 4. मूल जिजनयम के जिजनयम 2 में, उप-जिजनयम (1) के खंड (घघ) के बाद, जनम्नजलजखत खंड (घघए) अंतस्ट्थाडजपत ककया जाएगा, अथाडत्: - “ "रजजस्ट्रीकृत जितरक" का अथड इन जिजनयमों के अधीन प्राजधकरण के साथ रजजस्ट्रीकृत जितरक है;" 5. मूल जिजनयम के जिजनयम 3 में, उप-जिजनयम (1) के तहत खंड (छ) में, िब्द "और" का जिलोप कर कदया जाएगा। 6. मूल जिजनयम के जिजनयम 3 में, उप-जिजनयम (1) के खंड (छ) के बाद, जनम्नजलजखत खंड (छए) अंतस्ट्थाडजपत ककया जाएगा, अथाडत्: - “जितरक; और" इंजेती श्रीजनिास, अध्यक्ष [जिज्ञापन-III/4/असा./250/2023-24] नोट: 1. भारत के राजपत्र: असाधारण में अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (पूंजी बाजार मध्यस्ट्थ) जिजनयम, 2021 को कदनांक 18 अक्टूबर 2021 की अजधसूचना संख्या आईएफएससीए/2021-22/जीएन/आरई018 द्वारा प्रकाजित ककया गया। INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY NOTIFICATION Gandhinagar, the 3rd July, 2023 INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY (CAPITAL MARKET INTERMEDIARIES) (AMENDMENT) REGULATIONS, 2023 IFSCA/2023-24/GN/REG040.—In exercise of the powers conferred by sub-section (1) of Section 28 read with sub-section (1) of Section 12 and sub-section (1) of Section 13 of the International Financial Services Centres Authority Act, 2019, Section 28C of the Securities and Exchange Board of India Act, 1992, the International Financial Services Centres Authority hereby makes the following regulations, further to amend the International Financial Services Centres Authority (Capital Market Intermediaries) Regulations, 2021, (hereinafter referred to as the Principal Regulations), namely: - 1. (1) These regulations may be called the International Financial Services Centres Authority (Capital Market Intermediaries) (Amendment) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In regulation 2 of the Principal Regulations, after clause (g) of sub-regulation (1), the following clause (ga) shall be inserted, namely:— “ “capital market intermediary” means an intermediary referred to in regulation 3 and is registered with the Authority under these regulations;” 3. In regulation 2 of the Principal Regulations, after clause (o) of sub-regulation (1), the following clause (oa) shall be inserted, namely:— “ “distributor” means a person who for remuneration engages with clients on behalf of an issuer or a service provider to facilitate investment or subscription into “capital market products” or “capital market services”, as defined under circular no.817/IFSCA/Distribution/2022-23 dated December 21, 2022 issued by the Authority;” [भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 4. In regulation 2 of the Principal Regulations, after clause (dd) of sub-regulation (1), the following clause (dda) shall be inserted, namely:— “ “registered distributor” means a distributor registered with the Authority under these regulations;” 5. In regulation 3 of the Principal Regulations, in clause (g) under sub-regulation (1), the word “and” shall be omitted. 6.
