L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधसूचना गांधीनगर, 11 अप्रैल, 2023 अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (जनजध प्रबंधन) (संिोधन) जिजनयम, 2023 आईएफएससीए/2022-23/िीएन/आरईिी034.—अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण अजधजनयम, 2019 की धारा 12 की उप-धारा (1) और धारा 13 की उप-धारा (1) के साथ पठित धारा 28 की उप-धारा (1), भारतीय प्रजतभूजत और जिजनमय बोडड अजधजनयम, 1992 की धारा 28ग द्वारा प्रदत्त िजियों का प्रयोग करते हुए, अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण, अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (जनजध प्रबंधन) जिजनयम, 2022 (इसके पश्चात प्रमुख जिजनयम कहा िाएगा) में और संिोधन करने के जलए जनम्नजलजखत जनयम बनाता है, अथाडत्: - 1. (1) इन जिजनयमों को अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (जनजध प्रबंधन) (संिोधन) जिजनयम, 2023 कहा िाएगा। (2) ये रािपत्र में इनके प्रकािन की तारीख से लागू होंगे। 2. प्रमुख जिजनयम के जिजनयम 77 में, उप-जिजनयम (2) को जनम्नजलजखत उप-जिजनयम से प्रजतस्ट्थाजपत ककया िाएगा, अथाडत्:- "पोर्डफोजलयो प्रबंधन सेिाओं (केिल सलाहकारी सेिाओं का लाभ उिाने िालों को छोड़कर) का लाभ उिाने िाले ग्राहक की जनजध को - (क) बैंककंग इकाई में एफएमई का जिजिष्ट बैंक खाते में; (ख) बैंककंग इकाई मेंभारत में या जिदेिी क्षेत्राजधकार में जस्ट्थत बैंक में ग्राहक का जिजिष्ट बैंक खाते में; या सं. 237] नई कदल्ली, बृहस्ट् पजतिार, अप्रैल 13, 2023/चैत्र 23, 1945 No. 237] NEW DELHI, THURSDAY, APRIL 13, 2023/CHAITRA 23, 1945 सी.जी.-जी.जे.-अ.-13042023-245165 CG-GJ-E-13042023-245165 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) प्राजधकरण द्वारा यथा-जनर्दडष्ट ककसी अन्य तरीके से अनुरजक्षत ककया िा सकता है। बिते कक िब ककसी ग्राहक के जिजिष्ट बैंक खाते में धनराजि अनुरजक्षत कीिाएगी, तो पोर्डफोजलयो प्रबंधक के रूप में कायडरत एफएमई यह सुजनजश्चत करेगा कक िह उि बैंक खाते को स्ट्ियं या ककसी अजभरक्षक के माध्यम से संचाजलत करने के जलए जिजधित रूप से अजधकृत है और िह, प्राजधकरण को ऐसे सभी बैंक खाते, जिसमें उसके अधीन ककए गए लेनदेन िाजमल हैं, का जििरण, ऐसा करने का जनदेि कदए िाने पर, प्राजधकरण को प्रदान करेगा। इंिेती श्रीजनिास, अध्यक्ष [जिज्ञापन-III/4/असा./017/2023-24] ठर्प्पणी: 1. अंतरराष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण (जनजध प्रबंधन) जिजनयम, 2022 भारत के रािपत्र: असाधारण में अजधसूचना सं. IFSCA/2021-22/GN/REG024 में 19 अप्रैल 2022 को प्रकाजित ककए गए थे। INTERNATIONAL FINANCIAL SERVICES CENTRES AUTHORITY NOTIFICATION Gandhinagar, the 11th April, 2023 International Financial Services Centres Authority (Fund Management) (Amendment) Regulations, 2023 IFSCA/2022-23/GN/REG034.—In exercise of the powers conferred by sub-section (1) of Section 28 read with sub-section (1) of Section 12 and sub-section (1) of Section 13 of the International Financial Services Centres Authority Act, 2019, Section 28C of the Securities and Exchange Board of India Act, 1992, the International Financial Services Centres Authority hereby makes the following regulations, further to amend the International Financial Services Centres Authority (Fund Management) Regulations, 2022, (hereinafter referred to as the principal Regulations), namely: - 1. (1)These regulations may be called the International Financial Services Centres Authority (Fund Management) (Amendment) Regulations, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In regulation 77 of the principal Regulations, for sub-regulation (2) , the following sub-regulation shall be substituted, namely:— “The funds of a client availing portfolio management services (other than those availing only advisory services) may be maintained in- (a) a specific bank account of the FME in a Banking Unit; (b) a specific bank account of the client in a Banking Unit, a bank in India or a Foreign Jurisdiction; or (c) any other manner as may be specified by the Authority. Provided that when the funds are maintained in the specific bank account of a client, the FME operating as portfolio manager shall ensure that it is duly authorised to operate the said bank account either by itself or through a custodian and that it shall provide the details of all such bank accounts including transactions carried out thereunder, to the Authority, whenever directed to do so.” INJETI SRINIVAS, Chairperson [ADVT.-III/4/Exty./017/2023-24] Note: 1.
