और, उक्त अजधजनयम की धारा 2 की उपधारा (1) के खंड (ड) के अनुसार “आतंकिािी संगठन” से उक् त अजधजनयम की प्रथम अनुसूची में सूचीबद्ध संगठन या इस प्रकार सूचीबद्ध संगठन के रूप में समान नाम के अधीन दियािील संगठन अजभप्रेत है; और, उक् त अजधजनयम की पहली अनुसूची में इस प्रकार के आतंकिािी संगठनों की सूची अंतर्ििष् ट है ; और, ‘जहज़्ब-उत-तहरीर (एचयूटी)’ एक ऐसा संगठन है जिसका उद्देश्य िेि के नागररकों को सजममजलत करके जिहाि और आतंकिािी गजतजिजधयों के माध्यम से लोकतांजत्रक रूप से जनिािजचत सरकारों को उखाड़ फेंककर भारत सजहत जिश्व स्ट्तर पर इस्ट्लाजमक राज्य और जखलाफत स्ट्थाजपत करना है, िो िेि की लोकतांजत्रक व्यिस्ट्था और आंतररक सुरक्षा के जलए एक गंभीर खतरा है; सं. 4028] नई दिल्ली, बृहस्ट् पजतिार, अक् तूबर 10, 2024/आजश् िन 18, 1946 No. 4028] NEW DELHI, THURSDAY, OCTOBER 10, 2024/ASVINA 18, 1946 सी.जी.-डी.एल.-अ.-10102024-257794 CG-DL-E-10102024-257794 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, ‘जहज़्ब-उत-तहरीर (एचयूटी)’ भोले-भाले युिाओं को आईएसआईएस (जिसे उक्त अजधजनयम की प्रथम अनुसूची के अधीन िम संख्या 38 पर आतंकिािी संगठन के रूप में सूचीबद्ध दकया गया है) िैसे आतंकिािी संगठनों में सजममजलत होने के जलए कट्टरपंथी बनाने और प्रेररत करने तथा आतंकिािी गजतजिजधयों के जलए धन िुटाने में सजममजलत है; और, ‘जहज़्ब-उत-तहरीर (एचयूटी)’ जिजभन्न सोिल मीजडया प्लेटफॉमि, सुरजक्षत ऐप का उपयोग करके और भोले- भाले युिाओं को आतंकिािी कृत्यों में सजममजलत होने के जलए प्रोत्साजहत करने के जलए िािा बैठकें आयोजित करके आतंकिाि को बढािा िे रहा है; और, केन्‍द रीय सरकार का यह जिश् िास है दक ‘जहज़्ब-उत-तहरीर (एचयूटी)’ आतंकिाि में संजलप् त है और उसने भारत में आतंकिाि के जिजभन्न कृत्यों में भाग जलया है; अतः, अब, केंरीय सरकार, जिजधजिरूद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की पहली अनुसूची में जनम्नजलजखत और संिोधन करती है, अथाित् :- उक्त अजधजनयम की पहली अनुसूची में िम संख्यांक 44 और उससे संबंजधत प्रजिजियों के पश्चात् , जनम्नजलजखत िम संख्यांक और प्रजिजियां अंतःस्ट्थाजपत की िाएगी, अथाित् :- "45. ‘जहज़्ब-उत-तहरीर (एचयूटी)’ और उसके सभी रूप और फ्रंट संगठन" [फा. सं.11034/17/2023/ सी. टी. प्रथम] प्रिीण िजिष्ठ, अपर सजचि रटप्पण:- अजधसूचना संख्या का. आ. 747 (अ), तारीख 17 फरिरी, 2023 द्वारा जिजधजिरुद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 की पहली अनुसूची में अंजतम बार संिोधन दकया गया था। MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 10th October, 2024 S.O. 4391(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith; And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, 'terrorist organisation' means an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an organisation so listed; And whereas, the First Schedule to the said Act contains the list of such terrorist organisations; And whereas, 'Hizb-Ut-Tahrir (HuT)' is an organisation which aims to establish Islamic state and Caliphate globally including in India by overthrowing democratically elected Governments through jihad and terrorist activities by involving citizens of the country, which is a grave threat to the democratic setup and internal security of the country; And whereas, the 'Hizb-Ut-Tahrir (HuT)' is involved in radicalisation and motivation of gullible youth to join terrorist organisations, such as ISIS (which is listed as a terrorist organisation under the First Schedule to the said Act at serial number 38) and raising funds for terror activities; And whereas, the ‘Hizb-Ut-Tahrir (HuT)' is promoting terrorism by using various social media platforms, secure apps and by conducting Dawah meetings to encourage gullible youth to indulge in acts of terrorism; [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, the Central Government believes that ‘Hizb-ut-Tahrir (HuT)’ is involved in terrorism and has participated in various acts of terrorism in India; Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby makes the following further amendments in the First Schedule to the said Act, namely: - In the First Schedule to the said Act, after serial number 44 and entries relating thereto, the following serial number and entries shall be inserted, namely: - "45. 'Hizb-Ut-Tahrir (HuT)' and all its manifestations and front organisations" [F. No. 11034/17/2023/CT-l] PRAVEEN VASHISTA, Addl. Secy.
