का.आ. 4391(अ).—विधिविरुद्ध क्रियाकलाप (निवारण) अधिनियम, 1967 (1967 का 37) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) व्यक्तियों और संगमों के कतिपय विधिविरुद्ध क्रियाकलापों के अधिक प्रभावी निवारण और आतंकवादी क्रियाकलापों से निपटने लिए और उससे संबंधित विषयों के लिए उपबंध करने हेतु अधिनियमित किया गया है;

और, उक्त अधिनियम की धारा 2 की उपधारा (1) के खंड (ड) के अनुसार “आतंकवादी संगठन” से उक्त अधिनियम की प्रथम अनुसूची में सूचीबद्ध संगठन या इस प्रकार सूचीबद्ध संगठन के रूप में समान नाम के अधीन क्रियाशील संगठन अभिप्रेत है;

और, उक्त अधिनियम की पहली अनुसूची में इस प्रकार के आतंकवादी संगठनों की सूची अंतर्विष्ट है;

और, ‘हिज्ब-उत-तहरीर (एचयूटी)’ एक ऐसा संगठन है जिसका उद्देश्य देश के नागरिकों को सम्मिलित करके जिहाद और आतंकवादी गतिविधियों के माध्यम से लोकतांत्रिक रूप से निर्वाचित सरकारों को उखाड़ फेंककर भारत सहित विश्व स्तर पर इस्लामिक राज्य और खिलाफत स्थापित करना है, जो देश की लोकतांत्रिक व्यवस्था और आंतरिक सुरक्षा के लिए एक गंभीर खतरा है;

और, ‘हिज्ब-उत-तहरीर (एचयूटी)’ भोले-भाले युवाओं को आईएसआईएस (जिसे उक्त अधिनियम की प्रथम अनुसूची के अधीन क्रम संख्या 38 पर आतंकवादी संगठन के रूप में सूचीबद्ध किया गया है) जैसे आतंकवादी संगठनों में सम्मिलित होने के लिए कट्टरपंथी बनाने और प्रेरित करने तथा आतंकवादी गतिविधियों के लिए धन जुटाने में सम्मिलित है;

और, ‘हिज्ब-उत-तहरीर (एचयूटी)’ विभिन्न सोशल मीडिया प्लेटफ़ॉर्म, सुरक्षित ऐप का उपयोग करके और भोले-भाले युवाओं को आतंकवादी कृत्यों में सम्मिलित होने के लिए प्रोत्साहित करने के लिए दावा बैठकें आयोजित करके आतंकवाद को बढ़ावा दे रहा है;

और, केन्द्रीय सरकार का यह विश्वास है कि ‘हिज्ब-उत-तहरीर (एचयूटी)’ आतंकवाद में संलिप्त है और उसने भारत में आतंकवाद के विभिन्न कृत्यों में भाग लिया है;

अतः, अब, केन्द्रीय सरकार, विधिविरुद्ध क्रियाकलाप (निवारण) अधिनियम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की पहली अनुसूची में निम्नलिखित और संशोधन करती है, अर्थात् :-

उक्त अधिनियम की पहली अनुसूची में क्रम संख्यांक 44 और उससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्यांक और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात् :-

"45. ‘हिज्ब-उत-तहरीर (एचयूटी)’ और उसके सभी रूप और फ्रंट संगठन"

टिप्पण:- अधिसूचना संख्या का. आ. 747 (अ), तारीख 17 फरवरी, 2023 द्वारा विधिविरुद्ध क्रियाकलाप (निवारण) अधिनियम, 1967 की पहली अनुसूची में अंतिम बार संशोधन किया गया था।

MINISTRY OF HOME AFFAIRS NOTIFICATION

New Delhi, the 10th October, 2024

S.O. 4391(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith;

And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, 'terrorist organisation' means an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an organisation so listed;

And whereas, the First Schedule to the said Act contains the list of such terrorist organisations;

And whereas, 'Hizb-Ut-Tahrir (HuT)' is an organisation which aims to establish Islamic state and Caliphate globally including in India by overthrowing democratically elected Governments through jihad and terrorist activities by involving citizens of the country, which is a grave threat to the democratic setup and internal security of the country;

And whereas, the 'Hizb-Ut-Tahrir (HuT)' is involved in radicalisation and motivation of gullible youth to join terrorist organisations, such as ISIS (which is listed as a terrorist organisation under the First Schedule to the said Act at serial number 38) and raising funds for terror activities;

And whereas, the ‘Hizb-Ut-Tahrir (HuT)' is promoting terrorism by using various social media platforms, secure apps and by conducting Dawah meetings to encourage gullible youth to indulge in acts of terrorism;

And whereas, the Central Government believes that ‘Hizb-ut-Tahrir (HuT)’ is involved in terrorism and has participated in various acts of terrorism in India;

Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby makes the following further amendments in the First Schedule to the said Act, namely: -
