प्राधिकरण ने बीमा लोकपाल के सभी कार्यालयों के लंबित मामलों की व्यापक समीक्षा की है। बीमा लोकपालों की परिषद से प्राप्त आंकड़ों के अनुसार, ऐसे कुल 711 बीमा लोकपाल अधिनिर्णय हैं जो अनुपालन के लिए लंबित हैं, जिनमें से 162 अधिनिर्णय एक वर्ष से अधिक अवधि के लिए लंबित हैं जो काफी असंतोषजनक है।

अतः बीमाकर्ताओं को सूचित किया जाता है कि वे बीमा लोकपाल नियम, 2017 के नियम 17(6) के अनुसार अधिनिर्णय के निपटान की समय-सीमाओं का पालन करें। बीमा लोकपाल द्वारा जारी किये गये अधिनिर्णय के विरुद्ध अपील करने की स्थिति में बीमाकर्ता प्राधिकरण के परिपत्र संदर्भ: आईआरडीएआई/ सीएडी/ सीआईआर/ विविध/063/03/2016 दिनांक 01-04-2016 के अनुसार शिकायतकर्ता को सूचित करें तथा इसके बारे में संबंधित बीमा लोकपाल को भी सूचना दें। बीमाकर्ताओं का ध्यान उपर्युक्त विषय पर प्राधिकरण के परिपत्र संदर्भ: आईआरडीएआई/सीएडी/ सीआईआर/विविध/038/03/2019 दिनांक 05-03-2019 की ओर आकर्षित किया जाता है जिसमें बीमाकर्ताओं को चेतावनी दी गई कि बीमा लोकपाल द्वारा पारित अधिनिर्णयों का अनुपालन निर्धारित समय-सीमाओं के अंदर न करने के प्रति अत्यंत गंभीर दृष्टिकोण अपनाया जाएगा।

उपर्युक्त को ध्यान में रखते हुए, बीमाकर्ताओं को इसके द्वारा सूचित किया जाता है कि वे 30 दिन से अधिक अवधि के लिए लंबित सभी बीमा लोकपाल अधिनिर्णयों का निपटान सुनिश्चित करें।

The Authority undertook comprehensive review of pending cases of all offices of Insurance Ombudsman. As per the data obtained from Council for Insurance Ombudsmen, there are total 711 Insurance Ombudsman awards that are pending for compliance, of which, 162 awards are pending for more than one year, which is rather unsatisfactory.

Insurers are therefore advised to adhere to the timelines of award settlement as per Rule 17(6) of the Insurance Ombudsman Rules, 2017. In case of appeal against the award issued by the Insurance Ombudsman, the insurers are advised to inform the complainant as per Authority's circular ref. IRDA/CAD/CIR/MISC/063/03/2016 dated 01-04-2016 and also inform the respective Insurance Ombudsman about the same. Insurers attention is drawn to Authority's Circular ref. IRDA/CAD/CIR/MISC/038/03/2019 dated 05-03-2019 on the above subject matter wherein the insurers were cautioned that non-compliance of awards passed by Insurance Ombudsman within the prescribed timelines would be viewed very seriously.

In view of the above, Insurers are hereby advised to ensure settlement of all Insurance Ombudsman awards pending for more than 30 days.
