विषय: आईआरडीएआई (विनियमित संस्थाओं द्वारा सूचना का अनुरक्षण और प्राधिकरण द्वारा सूचना की साझेदारी) विनियम, 2025 पर स्पष्टीकरण Sub: Clarification on IRDAI (Maintenance of Information by the Regulated Entities and Sharing of information by the Authority) Regulations, 2025
आईआरडीएआई (विनियमित संस्थाओं द्वारा सूचना का अनुरक्षण और प्राधिकरण द्वारा सूचना की साझेदारी) के विनियम 17 के अंतर्गत प्रदत्त शक्ति के आधार पर, निम्नलिखित स्पष्टीकरण जारी किया जाता है।
उपर्युक्त विनियमों के विनियम 9 के परंतुक के संदर्भ में, यह स्पष्ट किया जाता है कि विदेशी पुनर्बीमाकर्ता की शाखाएं और लॉयड्स इंडिया (इसके सिंडिकेट्स और सेवा कंपनियां सहित) जब ऐसे अभिलेख एकत्र करते हैं, तो उन अभिलेखों का अनुरक्षण भारत में किया जाएगा। यह इलेक्ट्रॉनिक रूप में रखे गए अभिलेख सहित सभी अभिलेखों पर लागू होता है।
यह भी स्पष्ट किया जाता है कि एफआरबी और लॉयड्स इंडिया (इसके सिंडिकेट्स और सेवा कंपनियां सहित), आईआरडीएआई (विनियमित संस्थाओं द्वारा सूचना का अनुरक्षण और प्राधिकरण द्वारा सूचना की साझेदारी), विनियम 2025 के अधीन निर्धारित सभी प्रावधानों का पालन करेंगे।
By virtue of the powers conferred under Regulation 17 of IRDAI (Maintenance of Information by the Regulated Entities and Sharing of Information by the Authority), Regulations 2025, the following clarification is issued:
With reference to the proviso to the regulation 9 of the aforesaid regulations, it is clarified that Foreign Reinsurer's branches and Lloyd's India (including its Syndicates and service companies) when they collect such records, those records shall be maintained in India. This is applicable to every record including those maintained in electronic form.
It is further clarified that FRBs and Lloyd's India (including its Syndicates and Service companies) shall comply with all the provisions stipulated under IRDAI (Maintenance of Information by the Regulated Entities and Sharing of Information by the Authority), Regulations 2025
