परिपत्र CIRCULAR

विषय: सरकारी प्रतिभूतियों में वायदा संविदाओं (बांड फॉरवर्ड्स) में एक्सपोज़र Sub: Exposure to Forward Contracts in Government Securities (Bond Forwards).

1. आईआरडीएआई (बीमाकर्ताओं के बीमांकिक, वित्त और निवेश कार्य) विनियम, 2024 संबंधी मास्टर परिपत्र के अध्याय 3 के पैरा 1.8 क (अ) के अनुसार बीमाकर्ताओं को ब्याज दर जोखिम से बचाव करने के लिए निम्नलिखित प्रकार के रुपया ब्याज दर डेरिवेटिव्स के साथ प्रयोगताओं के रूप में अनुमति दी गई है: i. वायदा दर करार (एफआरएएस); ii. ब्याज दर अदला-बदलियां (स्वैप) (आईआरएस) तथा iii. विनिमय व्यापारित ब्याज दर फ्यूचर्स (आईआरएफ)।

2. भारतीय रिज़र्व बैंक (आरबीआई) ने हाल ही में भारतीय रिज़र्व बैंक (सरकारी प्रतिभूतियों में वायदा संविदाएं) निदेश, 2025 जारी किये हैं। इन निदेशों के अंतर्गत यह विनिर्दिष्ट किया गया है कि गैर-खुदरा उपयोगकर्ता के रूप में वर्गीकृत किये जाने के लिए पात्र कोई भी संस्था एक प्रयोगता के रूप में सरकारी प्रतिभूतियों (बांड फॉरवर्ड्स) में वायदा संविदाओं में लेनदेन करने के लिए पात्र होगी।

3. उपर्युक्त निदेशों और बांड फॉरवर्ड्स प्रारंभ करने के लिए बीमाकर्ताओं से प्राप्त अनुरोधों को ध्यान में रखते हुए बीमाकर्ताओं को इसके द्वारा आईआरडीएआई (बीमाकर्ताओं के बीमांकिक, वित्त और निवेश कार्य) विनियम, 2024 की अनुसूची III के खंड 13 के अंतर्गत निम्नलिखित शर्तों के अधीन बचाव कार्य के प्रयोजन के लिए प्रयोगताओं के रूप में बांड फॉरवर्ड्स में लेनदेन करने के लिए अनुमति दी जाती है: i. बीमाकर्ता बांड फॉरवर्ड्स में केवल अधिक्रय की स्थितियों (लांग पोजीशनों) अर्थात् बांड फॉरवर्ड्स खरीदने संबंधी कार्य ही करेंगे; ii. यूलिप व्यवसाय के लिए बांड फॉरवर्ड्स को अनुमति नहीं है; iii. बीमाकर्ता आईआरडीएआई (बीमाकर्ताओं के बीमांकिक, वित्त और निवेश कार्य) विनियम, 2024 संबंधी मास्टर परिपत्र के अध्याय 3 के पैरा 1.8 क (ग से ञ तक) के उपबंधों अर्थात् अनुमति-प्राप्त प्रयोजन, विनियामक एक्सपोज़र और विवेकपूर्ण मानदंडों, प्रलेखीकरण संबंधी अपेक्षाओं, लेखांकन, आंतरिक जोखिम प्रबंध नीति और प्रक्रिया, उपयुक्तता और औचित्य नीति, कारपोरेट अभिशासन तथा सीआरओ की भूमिका और ब्याज दर डेरिवेटिव्स के लिए निर्धारित दायित्वों का अनुपालन करेंगे; iv. बीमाकर्ता ब्याज दर वायदा दर करारों के लिए निर्धारित रिपोर्टों के अनुरूप तिमाही आधार पर बांड फॉरवर्ड्स में लेनदेनों की सूचना देंगे; v. बीमाकर्ता समय-समय पर यथासंशोधित बांड फॉरवर्ड्स के लिए जारी किये गये आरबीआई निदेशों का अनुपालन करेंगे; vi. बीमाकर्ता समय-समय पर यथासंशोधित निपटान आधार और बाजार की प्रथाओं आदि के संबंध में भारतीय नियत आय मुद्रा बाजार और व्युत्पन्न संघ (एफआईएमएमडीए) द्वारा जारी किये गये परिचालन संबंधी दिशानिर्देशों का अनुपालन करेंगे।

यह परिपत्र सक्षम प्राधिकारी के अनुमोदन से जारी किया जाता है।

1. As per para 1.8 a (A) of Chapter 3 of the Master Circular on IRDAI (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024 insurers are allowed as users with following types of Rupee Interest Rate Derives to hedge the interest rate risk: i. Forward Rate Agreements (FRAs); ii. Interest Rate Swaps (IRS) and iii. Exchange Traded Interest Rate Futures (IRF).

2. RBI has recently issued Reserve Bank of India (Forward Contracts in Government Securities) Directions, 2025. Under these directions, it is specified that any entity, eligible to be classified as a non-retail user shall be eligible to undertake transactions in Forward Contracts in Government Securities (Bond Forwards) as a user.

3. In view of the above directions and considering insurers requests for introduction of Bond Forwards, insurers are hereby permitted under clause 13 of Schedule III of IRDAI (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024 to undertake transactions in Bond Forwards as users for hedging purpose subject to the following conditions: i. Insurers shall undertake only long positions in Bond Forwards i.e. buying Bond Forwards; ii. Bond Forwards are not permitted for ULIP business; iii. Insurers shall comply with provisions of paras 1.8 a (C to J) of Chapter 3 of the Master Circular on IRDAI (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024 i.e conditions of Permitted Purpose, Regulatory Exposure and Prudential norms, Documentation Requirements, Accounting, Internal Risk Management Policy & Process, Suitability and Appropriateness Policy, Corporate Governance and CRO role & responsibilities prescribed for Interest Rate Derivatives; iv. Insurers shall report the transactions in the Bond Forwards on quarterly basis in line with reports stipulated for Interest Rate Forward Rate Agreements. v. Insurers shall comply with RBI directions issued for Bond Forwards as amended from time to time; vi. Insurers shall comply with Operational Guidelines issued by Fixed Income Money Market and Dealers Association of India(FIMMDA) with respect to settlement basis and market conventions etc., as amended from time to time.

This circular is issued with approval of the Competent Authority.
