बीमा लोकपालों के लिए हाल ही में संचालित अभिमुखता कार्यक्रम में बीमा लोकपालों के साथ किये गये परस्पर सक्रिय विचार-विमर्श (इंटरऐक्शन) के दौरान यह चिंताजनक बात देखी गई कि बीमा लोकपाल कार्यालयों के द्वारा अपेक्षित स्वतः पूर्ण नोट (एससीएन), समर्थक दस्तावेज और अतिरिक्त सूचना प्रस्तुत करने में बीमाकर्ताओं के द्वारा असाधारण विलंब किया जा रहा है। यह भी सूचना मिली है कि अनुवर्ती सूचना/ दस्तावेज बीमाकर्ताओं के द्वारा खंडशः (पीसमील में) और असाधारण विलंब के साथ प्रस्तुत किये जा रहे हैं। इस प्रकार, ऐसी कार्यवाहियाँ पॉलिसीधारकों / लाभार्थियों के द्वारा उठाई गई शिकायतों के निपटान में विलंब के रूप में परिणत हो रही हैं।
जबकि स्वतःपूर्ण नोट (एससीएन) और अनुवर्ती सूचना / दस्तावेज, शिकायतों के तथ्य की जाँच करने और एक निष्कर्ष पर पहुँचने के लिए बीमा लोकपालों के लिए आवश्यक हैं, बीमा लोकपालों (आईओ) के द्वारा बीमा लोकपाल नियम, 2017 के नियम 15(2) के अनुसार माँगे गये दस्तावेज, मामले में निर्णय लेने और नियम 17(4) की भावना को पूरा करने के लिए तत्परतापूर्वक प्रस्तुत करने की आवश्यकता है, जो व्यवस्था करता है कि किसी भी शिकायत पर अपेक्षित सारे दस्तावेज आदि शिकायतकर्ता से प्राप्त करने के बाद 90 दिन के अंदर निर्णय लिया जाना चाहिए।
प्राधिकरण, समय पर शिकायतों के निपटान को सुसाध्य बनाने और बीमा लोकपाल (आईओ) प्रणाली की कार्यकुशलता में सुधार लाने के लिए बीमाकर्ताओं को निम्नानुसार सूचित करता है कि वे-
i. बीमा लोकपाल के संबंधित कार्यालय से नोटिस प्राप्त करने की तारीख से सात (7) दिन के अंदर संबंधित दस्तावेजों के द्वारा विधिवत् समर्थित रूप में, अपेक्षित स्वतः पूर्ण नोट (एससीएन) प्रस्तुत करें। ii. नियमों के अंतर्गत नियम 15(2) के अनुसार बीमा लोकपाल कार्यालय से जब भी माँग की जाती है, तब अतिरिक्त सूचना अथवा दस्तावेज, नोटिस प्राप्त करने की तारीख से 3 दिन के अंदर प्रस्तुत करें। iii. संबंधित दस्तावेजों के साथ अपेक्षित सूचना “एक ही बार में” प्रस्तुत करें, न कि थोड़ा-थोड़ा करके (पीसमील में)। iv. बीमा लोकपाल कार्यालय द्वारा अपेक्षित स्वतः पूर्ण नोटों तथा अतिरिक्त सूचना और/या दस्तावेजों की सभी लंबित माँगें इस परिपत्र के निर्गम की तारीख से 30 दिन के अंदर पूरी करें। v. जहाँ कोई बीमाकर्ता उपयुक्तानुसार अनुपालन नहीं करता, वहाँ बीमा लोकपाल का संबंधित कार्यालय, नियम 17(4) में दी गई समय-सीमा का अनुपालन करने के लिए आगे कोई अतिरिक्त विलंब किये बिना, अभिलेखों में उपलब्ध महत्वपूर्ण सूचना के आधार पर एकपक्षीय तौर पर मामले में अग्रसर होगा।
During the interaction with Insurance Ombudsmen (IO) in the recent Orientation Programme conducted for the IOs, it has been noted with concern that there are inordinate delays by the Insurers in submissions of Self Contained Note (SCN), supporting documents and additional information, sought by the Offices of the Insurance Ombudsman. It has also been reported that follow up information / documents are submitted by the insurers in piecemeal and with inordinate delay. Thus, such actions are resulting into delay in disposal of the complaints raised by the policyholders / beneficiaries
While the submissions of the SCN and the follow up information / documents are necessary for the IOs to examine the fact of the complaints and to come to a conclusion, the documents called by the IOs in terms of rule 15 (2) of Insurance Ombudsman Rules 2017 (the Rule) needs to be provided promptly by the insurers to decide the case and to meet the spirit of rule 17 (4) of the Rule which provides that a complaint shall be decided within 90 days of the receipt of all the requirement from the complainant.
The Authority, in order to facilitate timely disposal of complaints and to improve the efficiency of the IO system advises the insurers as under
i. To submit the required SCNs duly supported by the relevant documents within seven (7) days from the date of receipt of the notice from the concerned Office of the Insurance Ombudsman. ii. To submit additional information or documents, as and when sought by the Office of the Insurance Ombudsman in terms of rule 15 (2) of the Rules within 3 days from the date of the notice. iii. To submit the required information including relevant documents in “one-go” and not in a piece-meal manner. iv. To clear all the pending demands of SCNs and additional information and / or documents required by Office of the Insurance Ombudsman within 30 days from the date of issuance of this Circular. v. Where an insurer fails to comply with the above, the concerned Office of the Insurance Ombudsman, in order to comply with the timeline provided in Rule 17 (4), shall proceed with the matter, ex parte, without any further delay, basis the material information available on record.
