विषय : पीएफआरडीए (उपस्थिति अस्तित्व) विनियम, 2018 के विनियम 2(1)(ञ)(iv) के अंतर्गत पेंशन योजनाओं के वितरण हेतु ‘अन्य व्यक्तियों’ को पेंशन अभिकर्ताओं (एजेंट) के रूप में संलग्न करने हेतु उपस्थिति अस्तित्व (पीओपी) को अनुमति प्रदान करने के संबंध में।

यह परिपत्र, पीएफआरडीए (उपस्थिति अस्तित्व) विनियम, 2018 तथा उसके संशोधनों के अंतर्गत पेंशन अभिकर्ताओं की संलग्नता एवं परिचालन कार्यढाँचे के सम्बन्ध में प्राधिकरण द्वारा समय-समय पर जारी परिपत्र सं. पीएफआरडीए /2025/12/आरईजी-पीओपी/01 दिनांक 23 सितंबर, 2025, परिपत्र सं. पीएफआरडीए /2025/17/आरईजी-पीओपी/02 दिनांक 16 अक्टूबर, 2025, परिपत्र सं. पीएफआरडीए /2026/20/आरईजी-पीओपी/04 दिनांक 20 मार्च, 2026 तथा परिपत्र सं. पीएफआरडीए /2026/26/आरईजी-पीओपी/05 दिनांक 12 मई, 2026 की निरंतरता में जारी किया जाता है।

  1. पीएफआरडीए (उपस्थिति अस्तित्व) विनियम, 2018 के विनियम 45 के साथ पठित विनियम 2(1)(ञ)(iv) एवं अनुसूची-IV के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, प्राधिकरण द्वारा पेंशन निधि विनियामक और विकास प्राधिकरण अधिनियम, 2013 के अंतर्गत विनियमित पेंशन योजनाओं के वितरण हेतु निम्नलिखित अतिरिक्त श्रेणियों की संस्थाओं को पेंशन अभिकर्ता के रूप में कार्य करने की अनुमति प्रदान की जाती है, जो निम्नलिखित शर्तों के अधीन होगी:

(क) क्लस्टर-आधारित व्यावसायिक संगठन (सीबीबीओ) : उपस्थिति अस्तित्व (पीओपी), ऐसे क्लस्टर-आधारित व्यावसायिक संगठनों (सीबीबीओ) को पेंशन अभिकर्ता के रूप में संलग्न कर सकते हैं, जिन्हें किसान उत्पादक संगठनों (एफपीओ) के गठन, संवर्धन अथवा मार्गदर्शन के उद्देश्य से केंद्र सरकार के मंत्रालयों/ विभागों, राज्य सरकारों अथवा अन्य कार्यान्वयन एजेंसियों, जैसे कि स्मॉल फार्मर्स एग्री-बिजनेस कंसोर्टियम (एसएफएसी), भारतीय राष्ट्रीय कृषि सहकारी विपणन महासंघ (एनएएफईडी), राष्ट्रीय सहकारी विकास निगम (एनसीडीसी) अथवा राष्ट्रीय कृषि और ग्रामीण विकास बैंक (नाबार्ड) द्वारा सूचीबद्ध, नियुक्त अथवा संलग्न किया गया हो।

(ख) सहकारी समितियाँ : उपस्थिति अस्तित्व (पीओपी), बहु-राज्य सहकारी समितियाँ अधिनियम, 2002 अथवा केंद्रीय अथवा राज्य सहकारी समितियाँ अधिनियम के अंतर्गत केंद्रीय अथवा राज्य के सहकारिता निबंधक (रजिस्ट्रार) के साथ पंजीकृत सहकारी समिति, सहकारी संघ अथवा सहकारी महासंघ को पेंशन अभिकर्ता के रूप में संलग्न कर सकते हैं। ऐसी संलग्नता इस शर्त के अधीन होगी कि उपस्थिति अस्तित्व (पीओपी), संबंधित सहकारी समिति, सहकारी संघ अथवा सहकारी महासंघ को पेंशन अभिकर्ता के रूप में संलग्न करने से पूर्व उसकी लाभप्रदता के आकलन सहित उचित समुचित सावधानी बरतेगा।

  1. इस परिपत्र को, पीएफआरडीए (उपस्थिति अस्तित्व) विनियम, 2018 के विनियम 2(1)(ञ)(iv) के अंतर्गत पेंशन अभिकर्ताओं (एजेंट) की संलग्नता के सम्बन्ध में प्राधिकरण द्वारा पूर्व में जारी परिपत्रों के साथ पढ़ा जाएगा। पूर्व में जारी परिपत्रों में विनिर्दिष्ट अन्य सभी नियम एवं शर्तें यथा-आवश्यक परिवर्तन सहित लागू रहेंगी।

  2. यह परिपत्र पीएफआरडीए अधिनियम, 2013 की धारा 14 तथा पीएफआरडीए (उपस्थिति अस्तित्व) विनियम, 2018 के विनियम 45 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, सक्षम प्राधिकारी के अनुमोदन से जारी किया गया है।
