March 11, 2013 Foreign Exchange Management (Guarantees) (Third Amendment) Regulations, 2013 In exercise of the powers conferred by clause (j) of sub-section (3) of Section 6 and sub section (2) of Section 47 of the Foreign Exchange Management Act, 1999 (42 of 1999), the Reserve Bank of India hereby makes the following amendments in the Foreign Exchange Management (Guarantees) Regulations, 2000 ( Notification No.FEMA 8/2000-RB dated May 3, 2000 ) (hereinafter referred to as 'the Principal Regulations'), namely:- 1. Short title and commencement (a) These Regulations may be called the Foreign Exchange Management (Guarantees) (Third Amendment) Regulations, 2013. (b) They shall come into force from the date of their publication in the Official Gazette. 2. Amendment of the Regulations : In the Principal Regulations, in Regulation 3A, in the Proviso, for the words, “a company resident in India engaged exclusively in development of infrastructure (infrastructure defined by the Reserve Bank from time to time in this regard) and infrastructure financial companies, as categorized by Reserve Bank from time to time,”, the  words “a person resident in India who is eligible to raise foreign currency loan under sub-regulation (1) of Regulation 6 of Foreign Exchange Management (Borrowing or Lending in Foreign Exchange) Regulations, 2000 read with Schedule I thereto,” shall be substituted.
