Following the delegation of powers under Sections 10 and 12 of the ID Act to Deputy Chief Labour Commissioners (Central) and the Chief Labour Commissioner (Central), authorities must ensure Failure of Conciliation reports are processed via the SAMADHAN portal. Regional Heads are mandated to synchronize online and offline data for industrial disputes and claims. Additionally, Regional Heads must ensure maximum inspections under the HOER and enforce the submission of annual returns by Railway Administrations, taking necessary action against those failing to comply with statutory deadlines.

Subject: Gazette Notification No. SO 1262(E) and SO 1263(E) both dated 17.03.2023 regarding delegation of power exercised by appropriate government under Section 10 & Section 12 respectively, subject to the provisions of sub-section (1) of section 10 to CLC(C) and Dy.CLC(C)- reg
Sir/Madam,
Reference is invited to the Gazette Notification No. SO 1262(E) and SO 1263(E) both dated 17.03.2023 (copy enclosed) which have come into effect on 17.03.2023.
(i) All Dy.CLC(C) are advised to take necessary action in compliance of the above notification and accordingly examine the Failure of Conciliation report submitted by RLC/ALC/LEOs post 17.03.2023 i.e. date of notification properly and if the same is found to be fit for adjudication then such disputes should be referred to the Industrial Tribunal/ Labour Court having jurisdiction by issuing a statutory order and the copy of the order shall be submitted to CLC(C) as well. The format of reference order is attached as Annexure I. (ii) In case the dispute is found not fit for reference for adjudication, the Dy.CLC(C) shall record and communicate to the parties concerned, its reasons therefore and a copy of the said communication along with all relevant documents should be sent to the CLC(C).
(i) where the conciliation officer is of the rank of Dy.CLC(C) or Additional CLC(C), he shall at the first instance send such Failure of Conciliation (FOC) reports to the Chief Labour Commissioner (Central), who shall examine the FOC report and if the same is found to be fit for adjudication then CLC(C) should refer such disputes to the Industrial Tribunal/ Labour Court having jurisdiction by issuing a statutory order. (ii) in case the CLC(C) is of the opinion that the said industrial dispute is not fit for adjudication, then he shall record and communicate to the parties concerned, its reasons therefore.
In case Dy. CLC(C)s/Addl. CLC(C) are the Conciliation Officer, the RoC/MoS/FoCs shall be addressed to the CLC(C), and in case RLC/ALC/LEOs are the Conciliation Officer, the RoC/MoS/FoCs shall be addressed to the concerned Dy. CLC(C).
All disputes should be initiated and disposed through SAMADHAN Portal only.

का.आ. 1262(अ).—केंद्रीय सरकार, औद्योगिक विवाद अधिनियम, 1947 (1947 का 14) की धारा 39 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निदेश करती है कि उक्त अधिनियम की धारा 10 की उप धारा(1) और उप धारा (2) के अधीन इसके द्वारा प्रयोग की जाने वाली शक्तियों का प्रयोग निम्नलिखित सारणी में यथाविनिर्दिष्ट अधिकारियों द्वारा भी अपनी संबंधित क्षेत्राधिकारिता में किया जाएगा, अर्थात:-

New Delhi, the 17th March, 2023
S.O. 1262(E).—In exercise of the powers conferred by section 39 of the Industrial Disputes Act, 1947(14 of 1947), the Central Government hereby directs that the powers exercisable by it under sub-sections (1) and (2) of the section 10 of the said Act, shall also be exercisable by the officers as specified in the following Table in their respective jurisdictions, namely:-
