NOTICE INVITING APPLICATIONS FOR EMPANELMENT OF ADVOCATES

(For Representing Employees' State Insurance Corporation (ESIC), All Offices of NCT of Delhi, before the EI Courts and District Level Quasi-Judicial/Judicial within the NCT of Delhi.

1. Employees' State Insurance Corporation (ESIC), a statutory body under the Ministry of Labour & Employment, Government of India, invites applications from eligible practicing Advocates for empanelment to represent the Corporation before the Hon'ble EI Courts and Other District Level Courts/Judicial/Quasi-Judicial Fora within the NCT of Delhi. The empaneled Advocates shall represent the ESIC Regional Office, Sub-Regional Offices, Hospitals, Medical Colleges, Medical Institutions and other field units situated within the NCT of Delhi, as may be assigned by the Competent Authority.

2. Practicing Advocates duly enrolled with the Bar Council of India or any State Bar Council and fulfilling the eligibility criteria prescribed in the Standard Guidelines for Empanelment of Advocates in ESIC (Appendix–A) are eligible to apply. The eligibility criteria, qualifications, experience, schedule of fees (Refer Appendix-B), terms and conditions governing empanelment, prescribed application formats and all other relevant provisions shall be governed by and shall be as specified in the Standard Guidelines for Empanelment of Advocates in ESIC (Appendix–A), which shall form an integral part of this Notice.

3. The existing panel of Advocates engaged by ESIC Offices in the NCT of Delhi shall remain valid only until the finalization of the fresh panel pursuant to this Notice. Existing panel Advocates who wish to continue their engagement with ESIC are also required to submit fresh applications in the prescribed format. Submission of a fresh application shall not confer any right to re-empanelment, which shall be subject to selection in accordance with the prescribed Guidelines.

4. Eligible practicing Advocates who are not presently empaneled with ESIC shall submit their applications in the prescribed format contained in Annexure-II of Appendix-A. Advocates who are presently empaneled with ESIC and desirous of being considered for fresh empanelment shall submit fresh applications in the prescribed format contained in Annexure-III of Appendix-A, along with all supporting documents required under the Standard Guidelines for Empanelment of Advocates in ESIC.


5. Applications, complete in all respects, shall reach the following address on or before the prescribed last date:

6. The last date for receipt of applications in the prescribed format is 07.09.2026 up to 05.30 PM. Applications received after the prescribed date and time or found to be incomplete shall be liable to be rejected.

7. Mere submission of an application for empanelment shall not confer any right or claim for empanelment. The applications shall be scrutinized and evaluated in accordance with the Standard Guidelines for Empanelment of Advocates in ESIC, and only such applicants as are found suitable by the Competent Authority shall be empaneled.

8. The list of selected Advocates shall be published on the official website of ESIC Regional Office, Delhi. Separate letters of empanelment shall thereafter be issued to the selected Advocates.

9. ESIC reserves the absolute right to accept or reject any application, wholly or partly, without assigning any reason whatsoever. ESIC also reserves the right to modify, withdraw, postpone, cancel or reissue this Notice or the empanelment process, in whole or in part, at any stage, without incurring any liability or obligation to the applicants. The decision of the Competent Authority in all matters relating to the empanelment process shall be final and binding.

Subject: Standard Guidelines for Empanelment of Advocates in ESIC

The undersigned is directed to convey that the Director General, ESIC has approved the enclosed Standard Guidelines for Empanelment of Advocates in ESIC.

  1. The objective of these Guidelines is to prescribe a simple and uniform procedure for empanelment of Advocates by ESIC Offices across India so that legal representation before Courts and Tribunals is transparent, merit-based, and effectively monitored.

  2. The Guidelines provide a standardized framework for empanelment of Advocates, including eligibility criteria, the selection process, tenure, renewal, performance evaluation, and other related matters. The adoption of a uniform procedure across all ESIC Offices is intended to promote consistency, transparency, accountability, and efficiency in the engagement and management of legal counsel.

  3. All Regional Offices, Sub-Regional Offices, Medical Institutions, and other Field Offices of ESIC are hereby directed to adopt and implement the enclosed Standard Guidelines for Empanelment of Advocates in ESIC in spirit. All future empanelment of Advocates shall be carried out strictly in accordance with these Guidelines. Existing panels may be aligned with the provisions of the Guidelines at the time of renewal/reconstitution.

  4. Difficulties, if any, in the implementation of these Guidelines may be brought to the notice of Headquarters (Legal Branch) for clarification.

STANDARD GUIDELINES FOR EMPANELMENT OF ADVOCATES IN ESIC

1. Objective

The objective of these Guidelines is to prescribe a simple and uniform procedure for empanelment of Advocates by ESIC Offices across India so that legal representation before Courts and Tribunals is transparent, merit-based and effectively monitored.

2. Applicability

These Guidelines shall apply to ESIC Headquarters, Regional Offices, Sub-Regional Offices, Hospitals, Medical Colleges, Medical Institutions and other ESIC field units requiring representation before Courts, Tribunals or other quasi-judicial authorities.

3. Centralized Panel at Regional Office Level

a) In order to ensure uniformity and centralized litigation management within a State, the panel of Advocates for the concerned Hon'ble High Court, all EI Courts within the State and other State-level judicial/ quasi-judicial fora shall be advertised, empanelled and administered by the concerned Regional Office.
b) Sub-Regional Offices, Hospitals, Medical Institutions and other field units shall utilize the panel constituted by the concerned Regional Office and shall not maintain separate panels once the Regional Office panel is notified.
c) The concerned Regional Office shall coordinate with SROs, Hospitals and other units for effective conduct of litigation through the approved panel.
d) In respect of NCT of Delhi, existing arrangements shall continue. However, Regional Office, Delhi shall separately constitute the panel for EI Courts and other district-level judicial/quasi-judicial fora in NCT of Delhi.
