आदेश/ORDER

विषय: खाद्य परीक्षण प्रयोगशालाओं द्वारा एफएसएसएआई के अधिसूचित दायित्वों का अनुपालन

Subject: Compliance to provisions of Food Safety and Standards (Recognition and Notification of the laboratories) Regulations 2018 by FSSAI recognized Laboratories-reg.

खाद्य सुरक्षा एवं मानक (प्रयोगशालाओं की मान्यता एवं अधिसूचना) विनियम 2018 के अनुसार, खाद्य सुरक्षा एवं मानक अधिनियम, 2006 की धारा 43(1) और 43(2) के अंतर्गत सभी एफएसएसएआई (FSSAI) द्वारा अधिसूचित प्रयोगशालाओं के लिए विनियम 9 (खाद्य प्रयोगशाला की बाध्यता) में उल्लेखित दायित्वों का पालन करना अनिवार्य है।

2. यह देखा गया है कि कई अधिसूचित खाद्य परीक्षण प्रयोगशालाएं उपरोक्त विनियम का पालन नहीं कर रही हैं। उपरोक्त के मद्देनजर, एफएसएसएआई द्वारा अधिसूचित सभी प्रयोगशालाओं को निर्देश दिया जाता है कि:-

क) उनके द्वारा विश्लेषित सभी खाद्य नमूनों की परीक्षण रिपोर्ट बिना किसी विलंब के इनफोलनेट (InFoLNet) पोर्टल पर अपलोड करें और अपने इनफोलनेट (InFoLNet) प्रोफाइल को वास्तविक समय के आधार पर अद्यतन और सटीक रखें, जिसमें मान्यता वैधता विवरण, संपर्क विवरण, पीटी/आईएलसी विवरण, खाद्य विश्लेषक सहित जनशक्ति विवरण और विश्लेषणात्मक क्षमता आदि शामिल हों।

ख) खाद्य सुरक्षा एवं मानक नियमों और विनियमों के तहत निर्दिष्ट मान्य और निर्धारित परीक्षण विधियों का सख्ती से पालन करें और एनएबीएल (NABL) द्वारा प्रदत्त मान्यता के दायरे में ही रहें।

ग) खाद्य सुरक्षा एवं मानक नियमों और विनियमों के तहत निर्धारित परीक्षण रिपोर्ट प्रारूप का बिना किसी विचलन के पालन करें।

3. उपरोक्त आवश्यकताओं का निरंतर अनुपालन न करने की स्थिति में, एफएसएस अधिनियम, उसके अंतर्गत बनाए गए नियमों और विनियमों के प्रावधानों के अनुसार उचित कार्रवाई की जा सकती है।

As per Food Safety and Standards (Recognition and Notification of the laboratories) Regulations 2018, it is mandatory for all FSSAI notified laboratories notified under section 43(1) and 43(2) of FSS Act, 2006 to comply with the obligations as mentioned in Regulation 9 i.e Obligation of food laboratories.

2. It has been observed that several notified food testing laboratories are not complying with the aforesaid regulation. In view of the above, all FSSAI notified laboratories are hereby directed to:

a) Upload test reports of all food samples analysed by them on the InFoLNet portal without delay and shall maintain their InFoLNet profiles updated and accurate on a real-time basis, including accreditation validity details, contact details, PT/ILC details, manpower details including Food Analyst(s), and analytical capacity etc.

b) Strictly adhere to validated and prescribed test methods as specified under the Food Safety and Standards Rules and Regulations and strictly within the scope of accreditation granted by NABL.

c) Comply with the prescribed test report format as stipulated under the Food Safety and Standards Rules and Regulations without any deviation.

3. In case of continued non-compliance with the above requirements, appropriate action may be initiated as per the provisions of the FSS Act, rules, and regulations made thereunder.
