ORDER

Subject: Implementation of 'Food Recall' functionality under Food Safety Compliance System (FoSCoS)-reg.

The Food Safety and Standards Authority of India (FSSAI) has brought in Food Safety and Standards (Food Recall Procedure) Regulations, 2017 along with the guidelines for food recall to ensure dissemination of information to consumers, and retrieval, destruction, or reprocessing of food under recall. Sub-regulation 2 of regulation 16 of FSS (Food Recall Procedure) Regulations, 2017 empowers Food Authority to establish a web based facility titled 'Food Recall portal' on its website with a unique identification number assigned to each recall for monitoring and to provide information to the consumers about such recall.

2. In this regard, in order to streamline the food recall and its monitoring, FSSAI has implemented the 'Food Recall' functionality in the FoSCoS system as below, which will be effective from the date of issuance of this order-

i. For Designated Officers (DOs)/Central licensing Authorities (CLAs): All new food recalls initiated by the enforcement authorities shall be created in the FoSCoS system by using their respective login. The enforcement authorities shall also view the existing food recall created in the FoSCoS and record subsequent actions, as appropriate.
ii. For Food Business Operators (FBOs): All FBOs shall create the food recall initiated by them and record subsequent actions by using their FoSCoS login. Further, all food recalls created by the enforcement authorities shall also be visible to the concerned FBOs under section 'view food recall' for taking necessary actions, as appropriate.
iii. For stakeholders/consumers: The information on food recall shall be accessed by the stakeholders/consumers on FoSCoS homepage under the name 'Food Recall'.

The user manual for the above functionality is at Annexure-1 for easy reference.

3. In this regard, the Commissioner of Food Safety of all States/UTs and Regional Directors of FSSAI are advised to direct the Designated Officer (DO)/Central licensing Authority (CLA) under their jurisdiction to fill-in the information related to food recall undertaken in the FoSCoS system through their respective login. Further, FBOs initiating recall process in accordance with the FSS (Food Recall Procedure) Regulations, 2017 is also directed to fill-in the necessary details in the FoSCoS system, as appropriate.

This issues with the approval of Competent Authority.

आदेश

विषय: खाद्य सुरक्षा अनुपालन प्रणाली (FoSCoS) के अंतर्गत 'फूड रिकॉल' का कार्यान्वयन – के संबंध में

खाद्य सुरक्षा और मानक प्राधिकरण (FSSAI) ने उपभोक्ताओं तक सूचना के प्रसार तथा रिकॉल किए गए खाद्य पदार्थों की वापसी, नष्ट करने या पुनः प्रसंस्करण सुनिश्चित करने हेतु खाद्य सुरक्षा एवं मानक (फूड रिकॉल प्रक्रिया) विनियम, 2017 तथा इसके दिशा-निर्देश लागू किए हैं। उक्त विनियमों के विनियमन 16 के उप-विनियमन (2) के अंतर्गत खाद्य प्राधिकरण को अपनी वेबसाइट पर 'फूड रिकॉल पोर्टल' नामक एक वेब-आधारित सुविधा स्थापित करने का अधिकार दिया गया है, जिसमें प्रत्येक रिकॉल को एक विशिष्ट पहचान संख्या प्रदान की जाती है, ताकि निगरानी की जा सके तथा उपभोक्ताओं को संबंधित जानकारी उपलब्ध कराई जा सके।

2 . इस संदर्भ में, खाद्य रिकॉल प्रक्रिया को सुव्यवस्थित करने एवं उसकी निगरानी सुनिश्चित करने हेतु, FSSAI द्वारा FoSCoS प्रणाली में 'फूड रिकॉल' कार्यक्षमता निम्नानुसार लागू की गई है, जो इस आदेश के निर्गमन की तिथि से प्रभावी होगी—

i. नामित अधिकारी (DOs)/केंद्रीय लाइसेंसिंग प्राधिकरण (CLAs) के लिए: प्रवर्तन प्राधिकरणों द्वारा प्रारंभ किए गए सभी नए फूड रिकॉल, उनके संबंधित लॉगिन के माध्यम से FoSCoS प्रणाली में बनाए जाएंगे। प्रवर्तन प्राधिकरण FoSCoS में उपलब्ध मौजूदा फूड रिकॉल को देखेंगे तथा आवश्यकतानुसार आगे की कार्रवाई दर्ज करेंगे।
ii. खाद्य व्यवसाय संचालकों (FBOs) के लिए: सभी FBOs अपने द्वारा प्रारंभ किए गए फूड रिकॉल को FoSCoS लॉगिन के माध्यम से दर्ज करेंगे तथा आवश्यकतानुसार आगे की कार्रवाई का विवरण भी दर्ज करेंगे। इसके अतिरिक्त, प्रवर्तन अधिकारियों द्वारा बनाए गए सभी फूड रिकॉल संबंधित FBOs को 'व्यू फूड रिकॉल' अनुभाग में उपलब्ध होंगे, ताकि वे आवश्यक कार्रवाई कर सकें।
iii. हितधारकों/उपभोक्ताओं के लिए: फूड रिकॉल से संबंधित जानकारी FoSCoS के होमपेज पर 'फूड रिकॉल' शीर्षक के अंतर्गत उपलब्ध होगी।

उक्त कार्यक्षमता हेतु उपयोगकर्ता मार्गदर्शिका (User Manual) संदर्भ हेतु परिशिष्ट-1 में संलग्न है।

3 . इस संबंध में, सभी राज्यों/केंद्र शासित प्रदेशों के खाद्य सुरक्षा आयुक्तों एवं FSSAI के क्षेत्रीय निदेशकों को सलाह दी जाती है कि वे अपने-अपने क्षेत्राधिकार के अंतर्गत नामित अधिकारी (DO)/केंद्रीय लाइसेंसिंग प्राधिकरण (CLA) को निर्देशित करें कि वे FoSCoS प्रणाली में अपने लॉगिन के माध्यम से फूड रिकॉल से संबंधित जानकारी भरें। इसके अतिरिक्त, खाद्य सुरक्षा एवं मानक (फूड रिकॉल प्रक्रिया) विनियम, 2017 के अनुसार रिकॉल प्रक्रिया प्रारंभ करने वाले FBOs को भी निर्देशित किया जाता है कि वे FoSCoS प्रणाली में आवश्यक विवरण दर्ज करें।
