का.आ. 2660(अ).— केंद्रीर् सरकार, दिवाला और िोधन अक्षमता संजिता, 2016 (2016 का 31) की धारा 14
की उपधारा (3) के खंड (क) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, र्ि अजधसूजचत करती िै दक दिवाला और िोधन
अक्षमता संजिता, 2016 (2016 का 31) की धारा 14 की उपधारा (1) के उपबंध विां लागू निीं िोंगे ििां कारपोरेट
िेनिार ने जनम्नजलजखत में से कोई संव्यविार, व्यवस्ट्था र्ा करार दकए िों, अथायत:-
(i)
तेल क्षेत्र (जवजनर्मन और जवकास) अजधजनर्म, 1948 (1948 का 53) और उसके अधीन बनाए गए जनर्मों
के अंतगयत की गई उत्पािन जिस्ट्सेिारी संजविाएं, रािस्ट्व जिस्ट्सेिारी संजविाएं, समन्वेषण लाइसेंस और खनन
पट्टे; और
(ii) खंड (i) में जनर्ियष्ट संव्यविारों, व्यवस्ट्थाओं र्ा करारों से संबद्ध र्ा आनुषंजगक प्रचालन करार सजित, कोई
संव्यविार, व्यवस्ट्था र्ा करार।

NOTIFICATION
New Delhi, the 14th June, 2023
S.O. 2660(E).—In exercise of the powers conferred by clause (a) of sub-section (3) of section 14 of the
Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Central Government hereby notifies that the provisions of
sub-section (1) of section 14 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), shall not apply where the
corporate debtor has entered into any of the following transactions, arrangements or agreements, namely: -
(i)
the Production Sharing Contracts, Revenue Sharing Contracts, Exploration Licenses and Mining
Leases made under the Oilfields (Regulation and Development) Act, 1948 (53 of 1948) and rules made
thereunder; and
(ii) any transactions, arrangements or agreements, including Joint Operating Agreement, connected or
ancillary to the transactions, arrangements or agreements referred to in clause (i).
