प्रति, राष्ट्रीय पेंशन प्रणाली (एनपीएस) के अंतर्गत सभी हितधारक

विषय - एनपीएस अभिदाता द्वारा भारतीय नागरिकता का त्याग करने और ओसीआई कार्ड धारित नहीं करने की स्थिति में एनपीएस खाते को बंद करने और कॉर्पस का निपटान करने के संबंध में

1. 18-70 वर्ष की आयु के बीच के किसी भी भारतीय नागरिक को स्वैच्छिक आधार पर एनपीएस के अंतर्गत व्यक्तिगत पेंशन खाता खोलने की अनुमति प्रदान की गई है। यह खाता किसी अनिवासी भारतीय और विदेशी भारतीय नागरिक (ओसीआई) द्वारा भी खोला जा सकता है, बशर्ते कि उन्होंने पीएफआरडीए द्वारा समय-समय पर जारी परिपत्रों और दिशानिर्देशों के अंतर्गत निर्धारित की गयी शर्तों को पूरा किया हो।

2. तदनुसार, ऐसे अभिदाताओं के संबंध में, जिन्होंने अपनी भारतीय नागरिकता का वैध रूप से त्याग कर दिया हो और उनके पास ओसीआई कार्ड न हो तो, उक्त अभिदाता को उनकी स्थिति में परिवर्तन के बारे में तत्काल आधार पर राष्ट्रीय पेंशन प्रणाली (एनपीएस ट्रस्ट) को सप्रमाण सूचित करना आवश्यक है और ऐसी स्थिति में अभिदाता द्वारा धारित स्थायी सेवानिवृत्ति खाता संख्या (प्रान)/एनपीएस खाता बंद कर दिया जाएगा और संपूर्ण संचित पेंशन राशि केवल अनिवासी साधारण खाते (एनआरओ) में अंतरित की जाएगी, जो इस परिपत्र के पैरा 3 के अंतर्गत निर्धारित प्रक्रिया के अध्यधीन होगी।

3. निपटान की प्रक्रिया :

क) अभिदाता द्वारा उनका एनपीएस खाता बंद करने के लिए निम्नलिखित दस्तावेजों के साथ एनपीएस ट्रस्ट को आवेदन प्रस्तुत करना होगा;

i. एक वचनपत्र जिसमें यह उल्लिखित हो कि अभिदाता ने अपनी भारतीय नागरिकता का त्याग कर दिया है और वे ओसीआई कार्ड धारक नहीं हैं।

ii. सक्षम प्राधिकारी द्वारा जारी भारतीय नागरिकता त्यागने का वैध प्रमाणपत्र / अभ्यर्पण प्रमाणपत्र / रद्द किया गया भारतीय पासपोर्ट।

ख) स्थायी सेवानिवृत्ति खाता संख्या (प्रान) में अभिदाता की कुल संचित पेंशन राशि को भारतीय रिज़र्व बैंक द्वारा जारी विदेशी मुद्रा प्रबंध अधिनियम (फेमा) दिशानिर्देशों के अनुसार, केवल अभिदाता के एनआरओ खाते में अंतरित किया जाएगा।

ग) एनपीएस ट्रस्ट, सीआरए के साथ समन्वय बनाते हुए ऐसे अभिदाताओं से प्राप्त अनुरोधों पर कार्रवाई करेगा।

4. यह परिपत्र पेंशन निधि विनियामक और विकास प्राधिकरण अधिनियम, 2013 की धारा 14 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए जारी किया गया है।

To, All Stakeholders under National Pension System (NPS)

Subject- Settlement of Corpus & Closure of NPS account in case NPS subscriber renounces Indian citizenship and does not hold OCI card – reg.

1. Any Indian Citizen between the age of 18-70 years is allowed to open an individual pension account under NPS on voluntary basis. The said account can also be opened by a Non-Resident Indian and Overseas Citizen of India (OCI) subject to fulfilment of certain conditions as stipulated under relevant circulars and guidelines issued by PFRDA from time to time.

2. Accordingly, in respect of such subscribers who have validly renounced their Indian citizenship and do not hold an OCI card, the said subscriber is required to forthwith intimate National Pension System Trust (NPS Trust) of the change in status along-with proof thereof and PRAN/NPS account held by the subscriber shall be closed and the entire accumulated pension wealth may be transferred to Non-Resident Ordinary (NRO) account only, subject to process stipulated under para 3 of this circular.

3. Process of settlement:

a) The subscriber shall submit an application for closure of his/her NPS account along with the following additional documents to NPS Trust;

i. An Undertaking stating that s/he has renounced his/her Indian citizenship and does not hold an OCI card.

ii. Valid certificate of Renunciation of India Citizenship/ Surrender Certificate/ Cancelled Indian Passport, issued by competent authority.

b) The total accumulated pension wealth of the subscriber in the PRAN shall be transferred only to the NRO account of the subscriber, in accordance with the FEMA guidelines issued by the RBI.

c) The NPS Trust in co-ordination with CRAs shall process the requests received from such subscribers.

4. This circular is issued in exercise of the powers conferred under Section 14 of the Pension Fund Regulatory and Development Authority Act, 2013.
