Subject: Direction under section 13, read with sub-clauses (i) of clause (b) of sub-section (1) of section 11 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) on submission of Internet Subscription data/ report(s) in the specified format

No. D-11/(1)/2025-BBPA- Whereas the Telecom Regulatory Authority of India (hereinafter referred to as the “Authority”), established under sub-section (1) of section 3 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) (hereinafter referred to as the “TRAI Act”), has been entrusted with discharge of certain functions, inter alia, to regulate the telecommunication services; ensure technical compatibility and effective interconnection between different service providers; lay down standards of quality of service to be provided by service providers and conduct the periodical survey of such services provided by the service providers so as to protect interest of the consumers of telecommunication service;
And whereas in accordance with the provisions contained in section 11 (1)(b)(i) of the TRAI Act, the Authority monitors the performance of the Telecom Service Providers by calling reports pertaining to internet subscription data from the Licensees on a regular basis, via an online PMR portal (www.pmr.trai.gov.in);
And whereas condition 9 of Chapter I of License Agreement for Unified License provides that the Licensee shall furnish to the Licensor/TRAI, on demand in the manner and as per specified timelines such documents, accounts, estimates, returns, reports or other information in accordance with the rules/ orders as may be prescribed or as directed from time to time and the Licensee shall also submit information to TRAI as per any order or direction or regulation issued from time to time under the provisions of TRAI Act, 1997 as amended from time to time and the said condition reads as under:-
“9. Requirement to furnish information:
9.1 The Licensee shall furnish to the Licensor/TRAI, on demand in the manner and as per specified timelines such documents, accounts, estimates, returns, reports or other information in accordance with the rules/ orders as may be prescribed or as directed from time to time. The Licensee shall also submit information to TRAI as per any order or direction or regulation issued from time to time under the provisions of TRAI Act, 1997 as amended from time to time.”;
And whereas the Authority, vide letter nos. RP-2/15(3)/2023-BBPA dated 28.03.2024, RP-2/15(3)/2023-BBPA dated 27.11.2024 and RP-2/15(3)/2023-BBPA dated 02.01.2025, requested M/s Bharti Airtel Ltd., to report Fixed Wireless Access-5G (FWA-5G) broadband subscription data under ‘Wireless’ category of the prescribed report format, on the online PMR portal;
And whereas it has come to the notice of the Authority that M/s Bharti Airtel Ltd. has either not submitted the internet subscription data or has not provided the internet subscription data as instructed, since November 2024;
Now, therefore, the Authority, in the exercise of the powers conferred upon it under section 13, read with sub-clause (i) of clause (b) of sub-section (1) of section 11 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) hereby directs M/s Bharti Airtel Ltd. to:-
i) submit the Fixed Wireless Access-5G (FWA-5G) Internet/Broadband subscription data under the ‘Wireless’ category in the prescribed report format immediately; ii) submit the Monthly Internet subscription report in the prescribed format on the online PMR portal (www.pmr.trai.gov.in);
