DIRECTION
Subject: Direction under section 13, read with section 11, of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) to service providers regarding submission of FTTH Tariff Plans/Data offered under the PM-WANI Scheme.
F. No. RG-(6)/2024-FEA-II: Whereas the Telecom Regulatory Authority of India (hereinafter referred to as "the Authority"), established under sub-section (1) of section 3 of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997) (hereinafter referred to as "TRAI Act"), has been entrusted with discharge of certain functions, inter alia, to regulate telecommunication services; notify the rates at which the telecommunication services within India and outside India shall be provided; to protect the interests of the service providers and consumers of the telecom sector;
And whereas the Authority has, in exercise of the powers conferred upon it under sub-section (2) of section 11 of the TRAI Act, notified the Telecommunication Tariff Order, 1999 (hereinafter referred to as " TTO 1999");
And whereas item (3A) of Schedule VI to TTO 1999 pertaining to the Tariff for retail broadband connectivity for Public Data Offices (PDOs) under the PM-WANI Scheme provides as under:-
"Every service provider providing retail Fiber to the Home (FTTH) broadband services shall offer all of its retail FTTH broadband plans upto 200 Mbps to the PDOs under the PM-WANI scheme, at tariff not exceeding twice the tariff applicable to the retail subscribers for the corresponding FTTH broadband plan of the bandwidth (capacity) offered.";
And whereas the Authority has decided to monitor the proliferation and usage of the PM-WANI scheme and review the tariff offered by the service providers to PDOs under the said scheme;
Now, therefore, the Authority, in exercise of the powers conferred upon it under section 13, read with sub-clause (i) of clause (b) of sub-section (1) of section 11, of the Telecom Regulatory Authority of India Act, 1997 (24 of 1997), hereby directs all service providers providing retail Fiber to the Home (FTTH) broadband services to submit the details of broadband plans being offered by them to PDOs under the PM-WANI scheme, in the format provided in the Annexure to this Direction, within ten (10) days from the end of each quarter, starting from the quarter ending 30th September 2025.
