सा.का.नि. 47(अ).—केन्द्रीय सरकार, भारतीय तार अधिनियम, 1885 (1885 का 13) की धारा 4 और धारा 7 और भारतीय बेतार तारयांत्रिकी अधिनियम, 1933 (1933 का 17) की धारा 4 और धारा 10 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ - (1) इन नियमों का संक्षिप्त नाम कम 6 गीगाहर्ट्स बैंड में रेडियो लोकल एरिया नेटवर्क सहित अल्प शक्ति और अत्यंत अल्प शक्ति वाले बेतार अभिगमन प्रणाली का उपयोग (अनुज्ञप्ति की अपेक्षा से छूट) नियम, 2026 है।

(2) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. लागू होना - ये नियम आवृत्ति बैंड 5925 – 6425 मेगाहर्ट्स पर लागू होंगे।

3. परिभाषाएं- (1) इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

(क) "अभिगमन बिन्दु" से वैसा ट्रांसिवर अभिप्रेत है जो या तो पीयर-टू-पीयर कनेक्शन में ब्रिज के रूप में या नेटवर्क के तार और बेतार खंड के बीच एक संयोजक के रूप में संचालित होता है;

(ख) "विवाद-आधारित नवाचार" से एक ऐसा नवाचार अभिप्रेत है जो कई उपयोगकर्ताओं को घटनाओं को परिभाषित करके एक ही स्पेक्ट्रम को साझा करने की अनुमति देता है, जब दो या अधिक ट्रांसमीटर एक ही चैनल का अभिगमन करने का प्रयास करते हैं, जिसमें नए प्रसारण शुरू करने की प्रक्रियाएं, चैनल की स्थिति (उपलब्ध या अनुपलब्ध) अवधारित करने की प्रक्रियाएं, और चैनल व्यस्त होने की स्थिति में पुनः प्रसारण का प्रबंधन करने की प्रक्रियाएं सम्मिलित हैं;

(ग) "यंत्र" से आवृत्ति बैंड 5925-6425 मेगाहर्ट्स में कार्य करने वाले रेडिएटर्स अभिप्रेत हैं जो वाइडबैंड डिजिटल मॉड्यूलेशन तकनीकों का उपयोग करते हैं और व्यक्तियों, व्यवसायों और संस्थाओं के लिए मोबाइल और फिक्स्ड संचार में उच्च डेटा दर की एक विस्तृत श्रृंखला प्रदान करते हैं;

(घ) "उत्सर्जन बैंडविड्थ" से मॉड्यूलेटेड कैरियर के अधिकतम स्तर के सापेक्ष मापा गया मॉड्यूलेटेड सिग्नल का 26 डीबी बैंडविड्थ अभिप्रेत है;

(ङ) "समतुल्य आइसोट्रोपिक विकिरणत शक्ति " या "ई.आई.आर.पी " से ऐसी कुल शक्ति अभिप्रेत है जिसमें से एंटीना के स्ट्रांगेस्ट बीम की दिशा में वास्तविक स्रोत के समान सिग्नल शक्ति देने के लिए एक काल्पनिक आइसोट्रोपिक एंटीना द्वारा विकिरणत किया जा सके;

(च) “भीतरी संचालन” से ट्रांसमीटर अभिप्रेत है जो ऐसे परिसर के अंदर स्थित होगा जो दरवाजे, खिड़कियां या गलियारों को छोड़कर रेडियो तरंगों के लिए अपारदर्शी दीवारों का है और उस परिसर की सिलिंग या छत रेडियो तरंगों के लिए अपारदर्शी होगीं;

(छ) "अधिकतम शक्ति स्पेक्ट्रल सघनता" या “मैक्स. पीएसडी” से यंत्र ऑपरेटिंग बैंड में विनिर्दिष्ट माप बैंडविड्थ के भीतर अधिकतम पावर अभिप्रेत है; 5925-6425 मेगाहर्ट्स बैंड में 1 मेगाहर्ट्स की बैंडविड्थ पर माप लिया जाता है;

(ज) "शक्ति स्पेक्ट्रल सघनता" से एक पल्स या पल्स के अनुक्रम से प्रति यूनिट बैंडविड्थ कुल ऊर्जा उत्पादन अभिप्रेत है जिसके लिए पारेषित शक्ति अपने अधिकतम स्तर पर होती है और जिसे पल्स की कुल अवधि से विभाजित किया गया है तथा कुल समय में पल्स के बीच का ऐसा समय सम्मिलित नहीं है जिसके दौरान पारेषित पावर बंद या उसके अधिकतम स्तर से नीचे है;

(2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त है और परिभाषित नहीं किए गए है परन्तु जिन्हें भारतीय तार अधिनियम, 1885 (1885 का 13) और भारतीय बेतार तारयांत्रिकी अधिनियम, 1933 (1933 का 17) अधिनियम में परिभाषित हैं, के वही अर्थ होंगे जो उन अधिनियम में विनिर्दिष्ट किए गए हैं।

4. छूट – आवृत्ति बैंड 5925-6425 मेगाहर्ट्स में गैर-अंतरावरोधन, गैर-संरक्षण और साझा (गैर-अनन्य) आधार पर संचालित रेडियो लोकल एरिया नेटवर्क सहित अल्प शक्ति भीतरी और अत्यंत अल्प शक्ति बाहरी बेतार अभिगमन प्रणाली के प्रयोजन के लिए किसी भी बेतार उपस्कर को स्थापित करने, बनाए रखने, कार्य करने, रखने या सौदा करने के लिए किसी व्यक्ति द्वारा अनुज्ञप्ति या आवृत्ति समनुदेशन की आवश्यकता नहीं होगी परन्तु वे निम्नलिखित तकनीकी मापदंडों का अनुपालन करेंगे जैसा कि नीचे दी गई सारणी में विनिर्दिष्ट है; अर्थात्:

सारणी (अल्प शक्ति भीतरी और अत्यंत अल्प शक्ति बाहरी बेतार अभिगमन प्रणाली या रेडियो लोकल एरिया नेटवर्क अभिगमन बिन्दु और यंत्र)

5. परिचालन प्रतिबंध - (1) ऑयल संबंधी प्लेटफॉर्म पर 5925 – 6425 मेगाहर्ट्स आवृत्ति बैंड निषिद्ध रहेगी।

(2) ज़मीन पर चलने वाली गाड़ियों (जैसे कार या ट्रेन), नावों और हवाई जहाज़ों पर भीतरी इस्तेमाल सिवाय तब जब वे दस हज़ार फीट से ऊपर उड़ान भर रहे हों, निषिद्ध होगा।

(3) ड्रोन और मानवरहित हवाई प्रणालियों के साथ संचार और नियंत्रण निषिद्ध है।

(4) 5925 – 6425 मेगाहर्ट्स आवृत्ति बैंड में काम करने वाले यंत्र में विवाद-आधारित नवाचार का प्रयोग होगा।

6. आवृत्ति बैंड 5925 – 6425 मेगाहर्ट्स के भीतर संचालित ट्रांसमीटरों के लिए बैंड उत्सर्जन सीमाएं -(1) आवृत्ति बैंड 5925 – 6425 मेगाहर्ट्स के बाहर कोई भी उत्सर्जन -27 डीबीएम/मेगाहर्ट्स के समतुल्य आइसोट्रोपिक विकिरणत शक्ति से अधिक नहीं होगा।

(2) शक्ति स्पेक्ट्रल सघनता को चैनल एज के बाहर 1 मेगाहर्ट्स पर 20 डीबी तक, चैनल केंद्र से एक चैनल बैंडविड्थ पर 28 डीबी तक, और चैनल केंद्र से चैनल बैंडविड्थ से डेढ़ गुना चैनल बैंडविड्थ पर 40 डीबी तक कम किया जाएगा।

(3) किसी अनुज्ञप्तिरहित यंत्र के चैनल एज के बाहर एक मेगाहर्ट्स और चैनल के केंद्र से एक चैनल बैंडविड्थ के बीच आवृत्तियों पर सीमाओं को 20 डीबी और 28 डीबी सप्रेशन के बीच लिनियर रूप से इंटरपोलेट किया जाएगा और एक से डेढ़ गुना के बीच की आवृत्तियों पर किसी अनुज्ञप्तिरहित यंत्र के चैनल बैंडविड्थ पर सीमाओं को 28 डीबी और 40 डीबी सप्रेशन के बीच लिनियर रूप से इंटरपोलेट किया जाएगा।

(4) चैनल बैंडविड्थ के एक से डेढ़ गुना से अधिक चैनल केंद्र से हटाए गए उत्सर्जन को कम से कम 40 डीबी तक सप्रेस किया जाएगा।

(5) उत्सर्जन माप 1 मेगाहर्ट्स के न्यूनतम रिज़ॉल्यूशन बैंडविड्थ का उपयोग करके लिया जाएगा और बैंड एज के पास एक कम रिज़ॉल्यूशन बैंडविड्थ, जब आवश्यक हो, नियोजित किया जा सकता है बशर्ते कि मापी गई ऊर्जा को 1 मेगाहर्ट्स पर कुल शक्ति दर्शाने के लिए एकीकृत किया जाए।

(6) उत्सर्जन सीमा मापते समय नाममात्र कैरियर आवृत्ति को ऊपरी और निचले आवृत्ति बैंड एज के पास समायोजित किया जाएगा क्योंकि उपस्कर को इसी प्रकार डिज़ाइन किया गया है।

7. हस्तक्षेप - (1) जहां कोई व्यक्ति जिसे भारतीय तार अधिनियम, 1885 (1885 का 13) की धारा 4 और भारतीय बेतार तारयांत्रिकी अधिनियम, 1933 (1933 का 17) की धारा 4 के उपबंधों के अधीन अनुज्ञप्ति जारी की गई है, केन्द्रीय सरकार या उसके द्वारा इस प्रयोजन के लिए प्राधिकृत किसी अधिकारी को यह सूचित करता है कि उसकी अनुज्ञप्ति प्राप्त प्रणाली में इन नियमों के अंतर्गत छूट प्राप्त किसी अन्य रेडियो संचार प्रणाली से हानिकारक हस्तक्षेप हो रहा है, तो केन्द्रीय सरकार या उसके द्वारा इस प्रयोजन के लिए प्राधिकृत कोई अधिकारी ऐसे छूट प्राप्त बेतार उपस्कर के उपयोगकर्ता से हस्तक्षेप से बचने के लिए आवश्यक उपाय करने के लिए कहेगा, जिसमें उपस्कर का स्थान बदल देना, शक्ति कम कर देना और विशेष प्रकार के एंटीना का उपयोग करना सम्मिलित है, ऐसा न करने पर केन्द्रीय सरकार या उसके द्वारा इस प्रयोजन के लिए प्राधिकृत कोई अधिकारी द्वारा ऐसे बेतार उपयोग को बंद करने की सिफारिश की जाएगी।

(2) बेतार उपस्कर के प्रयोगता को उप-नियम (1) के अधीन बेतार उपयोग को बंद करने की कोई सिफारिश करने से पहले सुनवाई का समुचित अवसर दिया जाएगा।

स्पष्टीकरण - इस नियम के प्रयोजनों के लिए, "हस्तक्षेप" अभिव्यक्ति से किसी रेडियो संचार प्रणाली में रिसेप्शन होने पर उत्सर्जन, विकिरण या इंडक्शन में से किसी एक या कई कारणों से होने वाली अनचाही एनर्जी का असर अभिप्रेत है, जो परफॉरमेंस में कमी, गलत अर्थ निकालने या जानकारी की हानि के रूप में प्रकट होता है जिसे ऐसी अनचाही एनर्जी के बिना प्राप्त किया जा सकता था।

8. उपस्कर – (1) बेतार उपस्कर में अंतर्निहित और एकीकृत एंटीना होगा और इसे टाइप अप्रूव्ड, डिज़ाइन और विनिर्माण किया जाएगा ताकि उत्सर्जन की बैंडविड्थ और दूसरे पैरामीटर्स नियम 4, 5 और 6 में बताई गई सीमाओं के अनुरूप हों।

(2) उपस्कर टाइप अनुमोदन प्राप्त करने के लिए आवेदन इन नियमों के साथ दी गई अनुसूची में बताए गए प्ररूप में किया जाएगा।

(3) सुरक्षा संबंधी अपेक्षाएँ वही होंगी जो अंतरराष्ट्रीय या राष्ट्रीय मानकों जैसे कि इंटरनेशनल टेलीकम्युनिकेशन यूनियन या यूरोपियन टेलीकम्युनिकेशन स्टैंडर्ड्स इंस्टीट्यूट या अमेरिकन नेशनल स्टैंडर्ड्स इंस्टीट्यूट या ब्यूरो ऑफ इंडियन स्टैंडर्ड्स या इंटरनेशनल कमीशन ऑन नॉन-आयनाइजिंग रेडिएशन प्रोटेक्शन के अनुरूप संबंधित यंत्र और फ्रीक्वेंसी बैंड के लिए निर्धारित हैं।

MINISTRY OF COMMUNICATIONS NOTIFICATION New Delhi, the 20th January, 2026

G.S.R.47(E).—In exercise of the powers conferred by sections 4 and 7 of the Indian Telegraph Act, 1885 (13 of 1885) and sections 4 and 10 of the Indian Wireless Telegraphy Act, 1933 (17 of 1933), the Central Government hereby makes the following rules, namely: —

1. Short title and commencement. — (1) These rules may be called the Use of Low Power and Very Low Power Wireless Access System including Radio Local Area Network in Lower 6 GHz band (Exemption from Licensing Requirement) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. — These rules shall apply in the frequency band 5925 – 6425 MHz.

3. Definitions. — (1) In these rules, unless the context otherwise requires, —

(a) “access point” means a transceiver that operates either as a bridge in a peer-to-peer connection or as a connector between the wired and wireless segments of the network;

(b) “Contention-based protocol” means a protocol that allows multiple users to share the same spectrum by defining the events that occurs when two or more transmitters attempt to simultaneously access the same channel which may consist of procedures for initiating new transmissions, procedures for determining the state of the channel (available or unavailable), and procedures for managing retransmissions in the event of a busy channel;

(c) “device” means the radiators operating in the frequency band 5925-6425 MHz that use wideband digital modulation techniques and provide a wide array of high data rate in mobile and fixed communications for individuals, businesses and institutions;

(d) “emission bandwidth” means the 26 dB bandwidth of the modulated signal measured relative to the maximum level of the modulated carrier;

(e) “equivalent isotropic radiated power” or “e.i.r.p” means the total power that would be radiated by a hypothetical isotropic antenna to give the same signal strength as the actual source in the direction of the strongest beam of the antenna;

(f) “indoor operation” means that the transmitter is located inside premises which are wholly enclosed by walls that are non-transparent to radio waves, except for any doors, windows or passageways and the premises have ceiling or roof that are non-transparent to radio waves;

(g) “maximum power spectral density” or “Max. PSD” means the maximum power within the specified measurement bandwidth, within the device operating band; measurements in the 5925-6425 MHz band are made over a bandwidth of 1 MHz;

(h) “power spectral density” means the total energy output per unit bandwidth from a pulse or sequence of pulses for which the transmit power is at its maximum level, divided by the total duration of the pulses and the total time which shall not include the time between pulses during which the transmit power is off or below its maximum level.

(2) The words and expressions used in these rules and not defined but defined in the Indian Telegraph Act, 1885 (13 of 1885) and the Indian Wireless Telegraphy Act, 1933 (17 of 1933) shall have the meanings respectively assigned to them in the said Acts.

4. Exemption. — No licence or frequency assignment shall be required by any person to establish, maintain, work, possess or deal in any wireless equipment for the purpose of low power indoor and very low power outdoor wireless access systems, including radio local area networks operating in the frequency band 5925-6425 MHz on non-interference, non-protection and shared (non-exclusive) basis, and complying with the following technical parameters as specified in the Table below, namely:—

5. Operational restrictions. — (1) Frequency band 5925 – 6425 MHz shall be prohibited on oil platforms.

(2) Indoor use shall be prohibited on land vehicles (such as cars or trains), boats and aircrafts except when flying above ten thousand feet.

(3) Communication with and control of drones and unmanned aerial systems shall be prohibited.

(4) Devices operating in the frequency band 5925 – 6425 MHz shall employ a contention-based protocol.

6. Out of band emission limits for transmitters operating within the frequency band 5925 – 6425 MHz. — (1) Any emissions outside the frequency band 5925 – 6425 MHz shall not exceed an equivalent isotropic radiated power of −27 dBm/MHz.

(2) Power spectral density shall be suppressed by 20 dB at 1 MHz outside of channel edge, by 28 dB at one channel bandwidth from the channel centre, and by 40 dB at one and one-half times the channel bandwidth away from channel centre.

(3) At frequencies between one megahertz outside channel edge and one channel bandwidth from the centre of the channel, the limits referred to in sub-rule (2) shall be linearly interpolated between 20 dB and 28 dB suppression, and at frequencies between one and one and one-half times channel bandwidth, the limits shall be linearly interpolated between 28 dB and 40 dB suppression.

(4) Emissions removed from the channel centre by more than one and one-half times the channel bandwidth shall be suppressed by at least 40 dB.

(5) The emission measurements shall be performed using a minimum resolution bandwidth of 1 MHz and a lower resolution bandwidth may be employed near the band edge, when necessary, provided the measured energy is integrated to show the total power over 1 MHz.

(6) When measuring the emission limits, the nominal carrier frequency shall be adjusted as close to the upper and lower frequency band edges as the design of the equipment permits.

7. Interference.— (1) Where any person to whom a licence have been issued under the provisions of section 4 of the Indian Telegraph Act, 1885 (13 of 1885) and section 4 of the Indian Wireless Telegraphy Act, 1933 (17 of 1933), informs the Central Government or any officer authorized by it for this purpose that his licensed system is receiving harmful interference from any other radio communication system exempted under these rules, then such Central Government or any officer authorized by it for this purpose shall call upon the user of such exempted wireless equipment to take necessary steps to avoid interference by relocating the equipment, reducing the power and using special type of antennae, failing which such Central Government or any officer authorized by it for this purpose shall recommend discontinuation of such wireless use.

(2) The user of wireless equipment shall be given a reasonable opportunity of being heard before any recommendation of discontinuation of wireless use under sub-rule (1) is made.

Explanation. – For the purposes of this rule, the expression “interference” means the effect of unwanted energy due to one or a combination of emissions, radiations or induction upon reception in a radio communication system, manifested by any performance degradation, misinterpretation, or loss of information, which could have been extracted in the absence of such unwanted energy.

8. Equipment. — (1) The wireless equipment shall have in-built and integrated antenna and shall be type approved, designed and manufactured so that the bandwidth of emission and other parameters shall conform to the limits specified in rules 4, 5 and 6.

(2) The application for obtaining equipment type approval shall be made in the format specified in the Schedule annexed to these rules.

(3) The safety related requirements shall be in accordance with the international or national standards such as the International Telecommunication Union or European Telecommunications Standards Institute or the American National Standards Institute or the Bureau of Indian Standards or International Commission on Non-Ionizing Radiation Protection for the respective devices and frequency bands.
