सा.का.जन. 883(ऄ).––केन्द रीय सरकार जचदकत्सा युजि जनयम, 2017 में संिोधन करने के जलए कजतपय जनयमों
का जनम्नजलजखत प्रारूप, जिसे ओषजध और प्रसाधन सामग्री ऄजधजनयम,1940 (1940 का 23) की धारा 12 की ईप-धारा
(1) और धारा 33 की ईप-धारा(1) द्वारा प्रदत्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती है,को औषजध
तकनीकी सलाहकार बोडड के परामिड के पश् चात्, आससे प्रभाजवत होने वाले सभी संभाजवत व्यजियों की िानकारी के जलए
प्रकाजित दकया िाता है और आसके द्वारा सूजचत दकया िाता है दक आस ऄजधसूचना वाले रािपत्र की प्रजतयां िनता को
ईपलब् ध कराने की तारीख से या तीस ददन की ऄवजध की समाजि के पश् चात् ई त प्रारूप जनयमों पर जवचार दकया िाएगा
ईपरोि जवजनर्ददष्ट ऄवजध के भीतर दकसी भी व्यजि से प्राि अपजत्तयों और सुझावों पर केंर सरकार द्वारा जवचार
दकया िाएगा;

1.
(i) आन जनयमों का संजिप् त नाम जचदकत्सा युजि (......संिोधन) जनयम, 2024 है
(ii) ये जनयम, िब तक ऄन्दयथा जवजनर्ददष्टन दकया िाए, रािपत्र में ईनके ऄंजतम प्रकािन की तारीख से प्रवृत्त होंगे

जचदकत्सा युजि जनयम, 2017 (जिसे आसमें आसके पश् चात् ईि जनयम कहा िाएगा) में, जनयम 44 के खंड
(ड) में, “एम.एल” िब्द के पश्चात्, या “रजिस्ट् रीकरण संख्या” या ‘’रजि. सं., जवसंक्रमणकारी वगड क के मामले में
(जवसंक्रमणकारी और गैर-मापनीय) जचदकत्सा युजियां”ऄंत:स्ट्थाजपत दकया िाएगा
3.
ईि जनयमों में, जनयम 44, खंड (ढ) में, "अयात ऄनुज्ञजि संख्या" िब्द के पश्चात, या ‘’रजिस्ट् रीकरण संख्या" या
‘’रजि. सं.
वगडक (जवसंक्रमणकारी और गैर-मापनीय) जचदकत्सा
युजियों के मामले में जचदकत् सा युजियां’’ ऄंत:स्ट्थाजपत दकया िाएगा
4.
ईि जनयमों के जनयम 45 में, खंड (ङ) में “ऄनुज्ञजि संख्या” िब्द के पश्चात्; “या“ रजिस्ट् रीकरण संख्या” या वगड क
(जवसंक्रमणकारी और गैर-मापनीय) जचदकत्सा युजियों के मामले में “जवसंक्रमणकारी संख्या” िब्द ऄंतःस्ट्थाजपत
दकए िाएंगे
5.
ईि जनयमों में, जनयम 45 के प्रथम परंतु कमें, “जवजनमाडण ऄनुज्ञजि संख्या”िब्द के पश्चात्“ या वगड क (गैर-
जवसंक्रजमत और गैर-मापनीय) जचदकत्सा युजियों के मामले में रजिस्ट् रीकरण संख्या”िब्द ऄंतःस्ट्थाजपत दकए
िाएंगे
6.
ईि जनयमों में, ऄध्याय 9 के िीषडक में, "और ऄजधसूजचत जनकाय" िब्द का लोप दकया िाएगा
7.
ईि जनयमों में, जनयम 85 में, ईप-जनयम (x) के पश्चात, जनम्नजलजखत जनयम प्रजतस्ट्थाजपत दकया िाएगा, ऄथाडत्:
"(xi) रजिस्ट् रीकरण प्रमाण पत्र धारण करने वाले व्यजि, जचदकत्सा युजि के परीिण या मूल्यांकन के पररणामों की
ररपोर्ड प्ररूप एमडी-44 में प्रस्ट्तुत करेगा "

ईि जनयमों में, जनयम 85 के ईपजनयम (ix) में, “जनरीिण पुजस्ट्तका”िब्दों के पश्चात् “प्ररूप एमडी-11 में ” िब्द
प्रजतस्ट्थाजपत दकया िाएगा
9.
ईि जनयमों में, जद्वतीय ऄनुसूची में, क्रम संख्या 39(ि) में, जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा, ऄथाडत्:
“(ि) कोइ जवदेिी स्ट्थल िो आन-जवरो नैदाजनक जचदकत्सा युजियों वगडग या वगडघ का जवजनमाडण करता है”
10. ईि जनयमों में, पााँचवीं ऄनुसूची में, खंड 2 के ऄंतगडत लागू होने को जनम्नानुसार प्रजतस्ट्थाजपत दकया िा सकता है:
“आस ऄनुसूची के प्रावधान आन-जवरो नैदाजनक जचदकत्सा युजियों सजहत जचदकत्सा युजियों के जवजनमाडताओं पर लागू
होंगे ”
11. ईि जनयमों में, पांचवीं ऄनुसूची में, ऄनुलग्नक 'क' में "आन-जवरो नैदाजनक जचदकत्सा युजि (दकर्/ऄजभकमडक)" िब्द
के पश् चात्, जनम्नजलजखत स्ट्थाजपत दकया िाएगा

i. वबदु संख्या 3 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
“4. रजिस्ट् रीकरण प्रमाण पत्र तब तक स्ट्थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द या ऄभ्यर्पपत
नहीं दकया िाता, परंतु यह दक रजिस्ट् रीकरण प्रमाण पत्र धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017
के प्रावधानों के ऄनुसार रजिस्ट् रीकरण प्रजतधारण िुल्क िमा करे”
13. ईि जनयमों में, पररजिष्ट में, “प्ररूप एमडी-5” में,
i. वबदु संख्या 3 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
“4.ऄनुज्ञजि तब तक स्ट्थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द या ऄभ्यर्पपत नहीं दकया िाता,
परंतु यह दक ऄनुज्ञजि धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017 के प्रावधानों के ऄनुसार ऄनुज्ञजि
प्रजतधारण िुल्क िमा करे ”
14. ईि जनयमों में, पररजिष्ट में, “प्ररूप एम.डी.-6” में
i. वबदु संख्या 3 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
“4. ऄनुज्ञजि तब तक स्ट्थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द या ऄभ्यर्पपत नहीं दकया िाता,
परंतु यह दक ऄनुज्ञजि धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017 के प्रावधानों के ऄनुसार ऄनुज्ञजि
प्रजतधारण िुल्क िमा करे ”
15. ईि जनयमों में, पररजिष्ट में, “प्ररूप एम डी- 9” में,
i. वबदु संख्या 4 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
“5. ऄनुज्ञजि तब तक स्ट्थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द या ऄभ्यर्पपत नहीं दकया िाता,
परंतु यह दक ऄनुज्ञजि धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017 के प्रावधानों के ऄनुसार ऄनुज्ञजि

16.ईि जनयमों में, पररजिष्ट में, “प्ररूप एमडी-10” में,
ii. वबदु संख्या 4 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
“5. ऄनुज्ञजि तब तक स्ट्थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द या ऄभ्यर्पपत नहीं दक या िाता,
परंतु यह दक ऄनुज्ञजि धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017 के प्रावधानों के ऄनुसारऄनुज्ञजि प्रजत
धारण िुल्क िमा करे ”
17. ईि जनयमों में, पररजिष्ट में, “प्ररूप एम.डी.-11” में,
i. “जनयम 26 का खंड (vii) देखें”िब्द के पश्चात् “और जनयम 85 का ईप-जनयम (ix)” िब्द प्रजतस्ट्थाजपत दकया
िाएगा
ii. (क) (1) में, “ऄनुज्ञजिधारी”िब्द के पश्चात् या “रजिस्ट् रीकरण धारण करने वाला व् यजि”िब्द प्रजतस्ट्थाजपत दकया
िाएगा
iii. (क) (2) में, “ऄनुज्ञजि संख्या”िब्द के पश्चात् या “रजिस्ट् रीकरण संख्या”िब्द प्रजतस्ट्थाजपत दकया िाएगा
iv. (ख) (i) में, “क्रमवार संख् यादकत”िब्द के पश्चात्” और केंरीय ऄनुज्ञापन प्राजधकारी /राज्य ऄनुज्ञापन प्राजधकारी द्वारा
सम् यक रूप से मुहर लगी होगी”िब्द का लोप दकया िाएगा

v. (ख) (ii) में, "ऄनुज्ञजि संख्या" िब्द के पश्चात्, "या रजिस्ट् रीकरण संख्या" िब्द प्रजतस्ट्थाजपत दकया िाएगा
vi. "राज्य ऄनुज्ञापन प्राजधकारी" िब्द के नीचे, "[जडजिर्ल रूप से हस्ट्तािररत दकया िाना है]" िब्द का लोप दकया
िाएगा और "हस्ट्तािर, मुहर या स्ट्र्ाम्प" िब्द ऄंत:स्ट् थाजपत दकया िाएगा
vii. नोर् (i), (ii), (iii) में, "ऄनुज्ञजिधारी" िब्द के पश्चात् "या रजिस्ट् रीकरण धारण करने वाला व् यजि" िब्द

18. ईि जनयमों में, पररजिष्ट में, “प्ररूप एमडी-15” में,
i. वबदु संख्या 5 के पश्चात, जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा
6. ऄनुज्ञजि तब तक स्ट् थायी रूप से वैध रहेगा, िब तक दक आसे जनलंजबत या रद्द नहीं दकया िाता या ऄभ् यर्पपत नहीं दकया
िाता, परंतु यह दक ऄनुज्ञजि धारण करने वाला व् यजि जचदकत्सा युजि जनयम, 2017 के प्रावधानों के ऄनुसार ऄनुज्ञजि
प्रजतधारण िुल्क िमा करे ”
19. ईि जनयमों में, पररजिष्ट में, “प्ररूप एम.डी-34” में,
ii. िीषडक में “धारा (1) की ईपधारा” िब्दों के पश् चात्संख्या “22” को ऄंत:स्ट् थाजपत दकया िाएगा
iii. हाजिए के िीषडक के नीचे, िब्द “को………….”ऄंत:स्ट् थाजपत दकया िाएगा
20. ईि जनयमों में, पररजिष्ट में, “प्ररूप एम.डी-35” में,

NOTIFICATION
New Delhi the 4th December, 2025
G.S.R. 883(E).—The following draft of certain rules to amend Medical Device Rules, 2017, which the
Central Government proposes to make, in exercise of the powers conferred by Sub-section (1) of section 12 and Sub-
section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940), is hereby published after consultation
with the Drugs Technical Advisory Board for information of all persons likely to be affected thereby and notice is
hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of thirty days
from the date on which copies of the Gazette of India containing these draft rules are made available to public;
Objections and suggestions which may be received from any person within the period specified above will be
considered by the Central Government;
Objections and suggestions, if any, may be addressed to the Under
Secretary (Drugs), Ministry of Health and Family Welfare, Government of India, Room No. 437, C Wing, Nirman
Bhavan, New Delhi - 110011 or emailed at drugsdiv-mohfw@gov.in.
DRAFT RULES
1.
(i) These rules may be called the Medical Devices (......Amendment) Rules, 2024.
(ii) These rules shall, unless specified otherwise, come into force on the date of their final publication in the Official
Gazette.
2.
In the Medical Devices Rules, 2017 (hereinafter referred to as said rules), In the said rules, in rule 44, clause
(m), after the word or “M. L”; the word “or “Registration number” or “Reg. No.” in case of Class A (Non-Sterile and
Non-Measuring) Medical Devices” shall be inserted.
3.
In the said rules, in rule 44, clause (n), after the word “import licence number”, the word “or “Registration
number” or
“Reg. No.” in case of Class A (Non-Sterile and Non-Measuring) Medical
Devices” shall be inserted.
4.
In the said rules, in rule 45, clause (e) after the word “Lic. No.”; the word “or “Registration number” or “Reg.
No.” in case of Class A (Non-Sterile and Non-Measuring) Medical Devices” shall be inserted.
5.
In the said rules, in rule 45, in first proviso, after the word “manufacturing licence number” the word “or
Registration number in case of Class A (Non-Sterile and Non-Measuring) Medical Devices” shall be inserted.
6.
In the said rules, in Chapter IX, in heading, the word “AND NOTIFIED BODY” shall be omitted.
7.
In the said rules, in rule 85, after sub-rule (x), the following rule shall be inserted, namely:
“(xi) The person holding registration certificate shall furnish reports of the results of tests or evaluation of a medical
device in Form MD-44.”,
8.
In the said rules, in rule 85, in sub rule (ix), after the words “inspection book”, the words “in Form MD-11”
shall be inserted.
9.
In the said rules, in Second Schedule, at Sr no. 39(h), the following shall be substituted, namely:
“(h) One overseas site manufacturing Class C or Class D in vitro diagnostic medical device”
10.
In the said rules, in Fifth Schedule, under the clause 2 Applicability may be substituted as under:
“The provisions of this Schedule shall be applicable to manufacturers of
Medical devices including In-vitro diagnostic medical devices.”
11.
In the said rules, in Fifth Schedule, in the Annexure „A‟ after the word “In vitro diagnostic medical devices
(Kit/Reagents)”, the following shall be inserted

12. In the said rules, in Appendix, in “Form MD-2 and Form MD-40,
i. after the point no. 3, the following shall be inserted.
“4. The registration certificate shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered,
provided that the registration certificate holder deposits a registration retention fee as per the provisions of Medical
Devices Rules, 2017.”
13. In the said rules, in Appendix, in “Form MD-5,
i.
after the point no. 3, the following shall be inserted.
“4. The licence shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered, provided that the
licence holder deposits a licence retention fee as per the provisions of Medical Devices Rules, 2017”.
14. In the said rules, in Appendix, in “Form MD-6
i.
after the point no. 3, the following shall be inserted.
“4. The licence shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered, provided that the
licence holder deposits a licence retention fee as per the provisions of Medical Devices Rules, 2017”.
15.
In the said rules, in Appendix, in “Form MD-9,
i.
after the point no. 4, the following shall be inserted.
“5. The licence shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered, provided that the
licence holder deposits a licence retention fee as per the provisions of Medical Devices Rules, 2017”.
16. In the said rules, in Appendix, in “Form MD-10,
ii. after the point no. 4, the following shall be inserted.
“5. The licence shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered, provided that the
licence holder deposits a licence retention fee as per the provisions of Medical Devices Rules, 2017”.
17. In the said rules, in Appendix, in “Form MD-11”,
i. After the word “See clause (vii) of rule 26” the word “and sub-rule (ix) of rule 85” shall be inserted.
ii. At (A) (1), after the word “licensee”, the word “ or Registration holder” shall be inserted.

In the said rules, in Appendix, in “Form MD-15,
i. after the point no. 5, the following shall be inserted.
“6. The licence shall remain valid in perpetuity, unless, it is suspended or cancelled or surrendered, provided
that the licence holder deposits a licence retention fee as per the provisions of Medical Devices Rules, 2017”.
