सा.का.जन. 712(अ).—जनम्नजलजखत मसौिा जनयम, जिन्हें केंद्र सरकार व्यावसाजयक सुरक्षा, स्ट्वास्ट््य और कायय
ििाएँ संजहता, 2020 (2020 का 37) की धारा 23 और 24 द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव
करती है, को धारा 134 की उप धारा (1) की अपेक्षा के अनुसार, उन सभी व्यजियों की सूचना के जलए, जिनके इससे
प्रभाजवत होने की संभावना है, एतद्द्वारा अजधसूजचत दकया िाता है और एतद्द्वारा नोटिस दिया िाता है दक उि मसौिा
अजधसूचना पर उस तारीख से 45 दिनों की अवजध की समाजि के बाि जवचार दकया िाएगा, जिस तारीख को रािपत्र की
प्रजतयां, जिसमें यह अजधसूचना प्रकाजित की गई है, आम िन के जलए उपलब्ध करा िी िाती हैं; आपजत्तयां और सुझाव,
यदि कोई हों, को श्री रजविंकर जनराला, अवर सजचव, भारत सरकार, श्रम एवं रोिगार मंत्रालय, कमरा संख्या: 17, श्रम
िजि भवन, रफी मागय, नई दिल्ली को अथवा ईमेल (fas@dgfasli.nic.in तथा ravis.nirala@nic.in) द्वारा भेिा िा
सकता है। आपजत्तयां और सुझाव एक प्रोफामाय में भेिे िाएँ जिसमें कॉलम (i) में व्यजियों और संगठनों के नाम और पते का
उल्लेख हो, कॉलम (ii) में उस जनयम या उपजनयम का उल्लेख हो जिसे संिोजधत करने का प्रस्ट्ताव है, तथा कॉलम (iii) में
प्रस्ट्तुत दकए िाने वाले संिोजधत जनयम या उपजनयम और उसके कारणों का उल्लेख हो; उि मसौिा अजधसूचना के संबंध में
दकसी व्यजि या संगठन से ऊपर जनर्ियष्ट 45 दिनों की अवजध समाि होने से पहले प्राि आपजत्तयों और सुझावों पर केन्द्र
सरकार द्वारा जवचार दकया िाएगा।

मोिर पटरवहन कमयकारों के जलए व्यावसाजयक सुरक्षा, स्ट्वास्ट््य और कायय ििाएँ संजहता, 2020 की धारा 23 और 24 के
अधीन जवजहत मसौिा जनयम।
(ii)
संजक्षि नाम, जवस्ट्तार और प्रारंभ (i) इन जनयमों का नाम व्यावसाजयक सुरक्षा, स्ट्वास्ट््य और कायय ििाएँ
संजहता, 2020 की धारा-23 और 24 के अंतगयत मोिर पटरवहन कमयकार जनयम, 202.....है।
(iii) इनका जवस्ट्तार सम्पूणय भारत पर है।
(iv) ये रािपत्र में प्रकािन की तारीख से प्रवृत्त होंगे।
2. पटरभाषा.- (1) इन जनयमों में, िब तक दक संिभय से अन्यथा अपेजक्षत न हो, -
(क)
“
संजहता
”
से
व्यावसाजयक सुरक्षा, स्ट्वास्ट््य और कायय ििाएँ संजहता, 2020 अजभप्रेत है;
(ख) "प्रभारी कैंिीन अजधकारी" से वह व्यजि (प्रबंधक के अलावा) अजभप्रेत है जिसे जनयोिा द्वारा संजहता के अंतगयत
कैंिीनों के संबंध में प्रावधान का अनुपालन सुजनजित करने के जलए जनयुि दकया गया है।
(ग) “धारा” से संजहता की धारा अजभप्रेत है।
(घ) “संलग्नक” से इन जनयमों के साथ संलग्न सूची अजभप्रेत है;
(ङ) “नेगोजिएटिंग यूजनयन या नेगोजिएटिंग काउंजसल” का मतलब औद्योजगक संबंध संजहता, 2020 की धारा 14 में
उजल्लजखत नेगोजिएटिंग यूजनयन या नेगोजिएटिंग काउंजसल से है।
(2) इन जनयमों में प्रयुि िब्ि और पि जिन्हें यहां पटरभाजषत नहीं दकया गया है, दकन्तु वे संजहता में हैं, उनके क्रमिः वही
अथय होंगे िो संजहता में दिए गए हैं ।
3. धारा 23 की उपधारा (2) के खंड (i) के अधीन सफाई और स्ट्वच्छता :- प्रत्येक मोिर पटरवहन कंपनी के जनयोिा को
यह सुजनजित करना होगा दक :
(1) सभी काययस्ट्थलों, कायय कक्षों, गजलयारों, सीद़ियों, भंडार कक्षों और सेवा कक्षों को स्ट्वच्छ और स्ट्वास्ट््यकर ििा में
रखा िाए।
(2) िीवारों और छतों की सतहें, जिनमें जखड़दकयाँ और रोिनिान िाजमल हैं, हमेिा साफ-सुथरी और स्ट्वास्ट््यकर
ििा में रखी िाएं।
(3) प्रत्येक कायय कक्ष का फिय, िहां तक संभव हो, साफ-सुथरा रखा िाए तथा इसे सूखा और दफसलन रजहत रखा
िाए।
(4) िहाँ गीली कायय प्रदक्रयाएँ की िाती हैं—
(i)
प्रभावी िल जनकासी बनाई रखी िाए;
(ii) फॉल्स फिय, प्लेिफामय, चिाई या खड़े होने के अन्य सूखे स्ट्थान उपलब्ध कराए िाएं; और
(iii) काम करते समय इस्ट्तेमाल के जलए उपयुि दफसलनरोधी िूते, िहाँ भी इनकी आवयकता हो, कमयकारों को
जबना दकसी व्यय के उपलब्ध कराए िाएं ।
(5) दकए िाने वाले कायय की प्रकृजत के अनुसार जितनी आवयकता हो उतनी बार कायय कक्षों की सफाई की िाए।
(6) िहां तक संभव हो, झाड़ू लगाना और सफाई कायय—
(i)
काम के बीच के अंतराल के िौरान दकया िाए; और
(ii) यह इस तरह से दकया िाए दक धूल को उड़ने से रोका िा सके।

(7) िहां तकनीकी कारणों से कायय समय के िौरान सफाई करना आवयक हो, वहां धूल या अन्य हाजनकारक पिाथों से
वायु के संिूषण से बचने के जलए उजचत साधन का उपयोग दकया िाए तथा सावधानी बरती िाए ।
(8) प्रभावी पययवेक्षण के तहत अपजिष्ट के िैजनक संग्रहण, भंडारण, जनपिान या उपचार के जलए उपयुि व्यवस्ट्था की
िाए ।
4. धारा 23 की उपधारा (2) के खंड (ii) के अधीन वेंटिलेिन, तापमान और आद्रयता :
प्रत्येक मोिर पटरवहन कंपनी का जनयोिा यह सुजनजित करेगा दक :
-
(1) काययस्ट्थलों में प्राकृजतक या कृजत्रम तरीकों से उपयुि वातावरणीय ििाएं बनाए रखी िाएं, तादक अपयायि वायु
आपूर्तय, जस्ट्थर या िूजषत वायु, हाजनकारक हवाएं, अत्यजधक गमी या ठंड, तापमान में अचानक पटरवतयन से बचा
िा सके, तथा िहां व्यावहाटरक हो, वहां की िाने वाली प्रदक्रयाओं की प्रकृजत को ध्यान में रखते हुए, अत्यजधक
आद्रयता या सूखापन तथा असहनीय गंध से बचा िाए सके।
(2) मोिर पटरवहन कंपनी के सभी काययस्ट्थलों पर धुआं और धूम, भाप और धूल को िूर करने के जलए पयायि वेंटिलेिन
उपलब्ध कराने तथा ज्वलनिील या हाजनकारक गैसों को पतला करने के जलए आवयक किम उठाए िाएं, तादक
वे हाजनरजहत बन सकें।
(3) कमयचाटरयों को मौसम की चरम जस्ट्थजत से बचाने के जलए पयायि उपाय दकए िाएं, िैसे दक कायय के घंिों में उजचत
पटरवतयन करना, आवयकतानुसार सुरक्षात्मक कपड़े या अन्य उपयुि प्रावधान जनःिुल्क उपलब्ध कराना।
(4) िहां प्राकृजतक वेंटिलेिन द्वारा पयायि मात्रा में स्ट्वच्छ हवा प्राि नहीं की िा सके, या िहां प्रवेि द्वारों के पास
सुजवधािनक हवा का प्रवाह बनाए जबना कायय कक्ष में वांजछत मात्रा में हवा पहुंचाना कटठन होता है, वहां यांजत्रक
वेंटिलेिन की व्यवस्ट्था की िाए ।
5. धारा 23 की उपधारा (2) के खंड (iii) के अधीन धूल के जलए सावधानी - प्रत्येक मोिर पटरवहन कंपनी का जनयोिा
यह सुजनजित करेगा दक: -
(1)
ज्वलनिील धुएं, गैसों, कोहरे, वाष्प या अविेषों को हिाने के जलए एग्िॉस्ट्ि जसस्ट्िम को दकसी अन्य वेंटिलेिन
जसस्ट्िम से नहीं िोड़ा िाना चाजहए या इसे िहन गैसों को ले िाने वाले जचमनी या फ्लल्यू में नहीं जनकाला िाए।
(2)
िब जनकास प्रणाजलयों से जनकलने वाले धुएं, गैसों, धुंध, वाष्प, धूल और अन्य स्राव से कमयचाटरयों या
पड़ोस के स्ट्वास्ट््य पर प्रजतकूल प्रभाव पड़ने की संभावना हो या वे हाजनकारक हों, तो जनकास को एक
ऐसी प्रणाली के माध्यम से दकया िाए िो जवषाि पिाथों को जनजष्क्रय कर िे, संक्रामक पिाथों को
िीवाणुरजहत कर िे और धुएं, गैसों, धुंध या वाष्प को िुगयन्धमुि कर िे।
(3)
दकसी भी कमयकार से दकसी काययस्ट्थल या पटररूद्ध स्ट्थान में प्रवेि करने की अपेक्षा नहीं लकी िाए अथवा अनुमजत
नहीं िी िाए, िब तक दक वहां उपजस्ट्थत हाजनकारक गैस, धुएं, वाष्प या धूल के स्ट्तर को स्ट्वीकायय सीमा के
भीतर लाने के जलए व्यावहाटरक उपाय नहीं दकए िाएं।
6. पेयिल - धारा 23 की उपधारा (2) के खंड (v) के अधीन:- प्रत्येक मोिर पटरवहन कंपनी का जनयोिा यह सुजनजित
करेगा दक: -
(1)
सभी काययस्ट्थलों पर सभी कमयचाटरयों के जलए स्ट्वच्छ, स्ट्वास्ट््यवधयक और सुरजक्षत पेयिल की पयायि आपूर्तय
उपलब्ध कराई िाए तथा यह सुलभता से उपलब्ध दकए िाएं ।
(2)
पाइप द्वारा आपूर्तय के अलावा पेयिल की दकसी भी आपूर्तय को उपयुि पात्रों में रखा िाए, जिन पर हहंिी,
अंग्रेिी और अजधकांि कमयकारों द्वारा समझी िाने वाली स्ट्थानीय भाषा में स्ट्पष्ट रूप से जचह्न अंदकत या प्रिर्ियत
दकया िाए, तादक यह ििाया िा सके दक िल पीने के जलए सुरजक्षत है और ऐसी आपूर्तय को प्रजतदिन भरा िाए
तथा िल और पात्रों को संिूषण से बचाने के जलए सभी आवयक सावधाजनयां बरती िाएं; को छोड़कर, सामान्य
पीने के जगलास या कप का उपयोग जनजषद्ध है।

(3)
िहां पानी राइहिंग िेि द्वारा दिया िाता है, वहां को छोड़कर, सामान्य पीने के जगलास या कप का उपयोग
जनजषद्ध है।
(4)
िहां िल पीने के जलए असुरजक्षत है, या औद्योजगक प्रदक्रयाओं या अन्य प्रयोिनों में उपयोग के जलए
उपलब्ध कराया गया है, वहां इसका उल्लेख हहंिी, अंग्रेिी और स्ट्थानीय भाषा में दकया िाए, जिसे अजधकांि
कमयकार समझते हों।
7.
भीड़भाड़ - धारा 23 की उपधारा (2) के खंड (vi) के अधीन:
प्रत्येक मोिर पटरवहन कंपनी का जनयोिा यह सुजनजित करेगा दक: -
(1)
दकसी भी इमारत में फिय की िगह इस तरह वाहनों से भरी हुई नहीं होनी चाजहए जिससे कमयचाटरयों को खतरा
हो, या उसमें इतने ज़्यािा सामान या उत्पाि नहीं होने चाजहए दक कमयचाटरयों के जलए वह खतरनाक हो िाए।
(2)
मोिर पटरवहन कंपनी पटरसर में दकसी भी स्ट्थान पर, िहां कमयचाटरयों को काम करना हो या दकसी भी कारण से
एकत्र होना हो, वहां भीड़भाड़ को रोकने के जलए पयायि प्रावधान दकए िाएं, जिनमें िाजमल हैं:
(i)
सभी कायय क्षेत्रों में भीड़भाड़ से संबंजधत खतरों को ििायने वाले संकेतों या प्रतीकों का जडिाइन और उपयोग
दकया िाए, जिसमें दकसी भी समय ऐसे स्ट्थानों पर काम करने के जलए अनुमत कमयकारों की संख्या जनर्ियष्ट
की गई हो;
(ii)
वाहनों और पैिल याजत्रयों के रास्ट्तों को अलग-अलग रंगों से जचजह्नत अवरोधों का उपयोग करके अलग रखा
िाए।
(iii) वाहनों की तैनाती को प्रभावी ढंग से प्रबंजधत दकया िाए और भीड़भाड़ से बचा िाए।
8. प्रकाि (ईल्यूजमनेिन) - धारा-23 की उपधारा (2) के खण्ड (vii) के अधीन: प्रत्येक मोिर पटरवहन कंपनी का
जनयोिा यह सुजनजित करेगा दक: -
(1) मोिर पटरवहन कंपनी में सभी स्ट्थानों, जिनमें उपयोजगता सेवाओं से संबंजधत सभी सुजवधाएँ िाजमल हैं, िहाँ
कमयचारी काम करते हैं या गुिरते हैं, या जिन्हें आपात जस्ट्थजत में काम करना या गुिरना पड़ सकता है, में
उपयोग के समय पयायि प्राकृजतक या कृजत्रम प्रकाि व्यवस्ट्था, या िोनों उपलब्ध हैं, िो संचालन और दकए िा
रहे जविेष प्रकार के कायय के जलए उपयुि हैं। िहाँ भी संभव हो, प्राकृजतक प्रकाि व्यवस्ट्था की िाए।
(2) कृजत्रम प्रकाि व्यवस्ट्था तब प्रिान की िाए या व्यवजस्ट्थत की िाए िब दिन का प्रकाि कम हो या ऐसे क्षेत्रों में
िहां दिन का प्रकाि अपयायि हो।
(3) प्रत्येक काययस्ट्थल पर, िहां कृजत्रम प्रकाि व्यवस्ट्था के जवफल होने की जस्ट्थजत में कमयचाटरयों को िोजखम का
सामना करना पड़ता है, वहां पयायि क्षमता की स्ट्वचाजलत आपातकालीन प्रकाि व्यवस्ट्था उपलब्ध कराई िाए,
जिसके ऊिाय स्रोत सामान्य प्रकाि व्यवस्ट्था प्रणाजलयों के जलए स्ट्थाजपत उपकरणों से स्ट्वतंत्र होने चाजहएं।
9. धारा 23 की उपधारा (2) के खंड (viii) के अधीन िौचालय और मूत्रालय की व्यवस्ट्था: प्रत्येक मोिर पटरवहन
कंपनी का जनयोिा यह सुजनजित करेगा दक: -
(1) (i) मोिर पटरवहन कंपनी के प्रत्येक कायय स्ट्थल पर पुरुष, मजहला, रांसिेंडर और जन:िि कमयचाटरयों के उपयोग
के जलए सुजवधािनक अलग-अलग स्ट्थानों पर पयायि िौचालय और मूत्रालय की व्यवस्ट्था की िाए।
(ii) ऐसे आवास में पयायि रोिनी और हवािार व्यवस्ट्था होनी चाजहए तथा उसे हर समय साफ और स्ट्वच्छ रखा
िाए।
(2)
(i) िौचालय, मूत्रालय और स्ट्वच्छता ब्लॉकों का फिय दफसलन रजहत जस्ट्थजत में रखा िाए।
(ii) िौचालयों, मूत्रालयों और सैजनिरी ब्लॉकों की आंतटरक िीवारों पर चमकिार िाइलें लगाई िाएं। वैकजल्पक
रूप से, िौचालयों और मूत्रालयों की आंतटरक िीवारों को इस तरह से तैयार दकया िाए दक वे जचकनी,
पॉजलि की हुई और अभेद्य सतह प्रिान करें जिससे स्ट्वच्छता और स्ट्वास्ट््यपरकता को ब़िावा जमले;
(iii) िौचालयों और मूत्रालयों के सैजनिरी पैन को हर समय धोया हुआ और साफ रखा िाए।

(3)
प्रत्येक 25 पुरुष और 15 मजहला कमयकारों के जलए कम से कम एक अलग िौचालय की व्यवस्ट्था की िाए और
जन:िि कमयकारों और रांसिेंडर कमयकारों के जलए कम से कम एक अलग िौचालय की व्यवस्ट्था की िाए। साथ ही,
एक ही समय में काययरत प्रत्येक 15 पुरुष कमयकारों के जलए कम से कम एक मूत्रालय की व्यवस्ट्था की िाए। प्रत्येक
िौचालय और मूत्रालय में पयायि िल आपूर्तय उपलब्ध हो।
(4)
नल के पानी सजहत वॉिबेजसन की सुजवधा उपलब्ध कराई िाए।
(5)
मजहलाओं के उपयोग के जलए उनके िौचालयों में पयायि मात्रा में सैजनिरी नैपदकन उपलब्ध कराए िाएं तथा उनका
रखरखाव दकया िाए तथा इन्हें िैजनक आधार पर भरा िाए।
(6)
मजहलाओं के िौचालयों में इस्ट्तेमाल दकए गए सैजनिरी नैपदकन इकट्ठा करने के जलए ढक्कन वाले जडस्ट्पोिेबल
कूड़ेिान उपलब्ध कराए िाए। इस्ट्तेमाल दकए गए नैपदकन का सुरजक्षत जनपिान दकया िाए। पुरुषों, रांसिेंडर और
दिव्यांग व्यजियों के जलए भी िौचालयों में ढक्कन वाले जडस्ट्पोिेबल कूड़ेिान उपलब्ध कराए िाएँ।
(7)
प्रत्येक िौचालय को कवर दकया िाए तथा इस प्रकार जवभाजित दकया िाए दक गोपनीयता बनी रहे, तथा उजचत
िरवािा, फास्ट्िहनंग और एग्ज़्हॉस्ट्ि हो।
(8)
िहां पुरुष, मजहला, रांसिेंडर और जन:िि व्यजि कमयचारी काययरत हैं, वहां प्रत्येक िौचालय ब्लॉक के बाहर
हहंिी, अंग्रेिी और अजधकांि कमयचाटरयों द्वारा समझी िाने वाली स्ट्थानीय भाषा में, िैसा भी मामला हो, "केवल
पुरुषों के जलए" या "केवल मजहलाओं के जलए" या "केवल रांसिेंडर व्यजियों के जलए" या "केवल जन:िि व्यजियों
के जलए" नोटिस प्रिर्ियत दकया िाए।
(9)
िौचालयों और मूत्रालयों से जनकलने वाले अपजिष्ट और बजह:स्राव का उपचार दकया िाए और सुरजक्षत तरीके से
उसका जनपिान दकया िाए।
(10) िौचालयों में पानी के नल-
i.
िहां पाइप द्वारा िल आपूर्तय उपलब्ध है, वहां ऐसे िौचालय में या उसके जनकि िल के नल लगाए िाएं;
और
ii.
यदि पाइप द्वारा िल आपूर्तय उपलब्ध नहीं है, तो नल या अन्य माध्यम से िल उपलब्ध कराया िाए,
तादक िौचालय और मूत्रालयों में या उनके जनकि आसानी से िल उपलब्ध हो सके।
10. धारा 23 की उप-धारा (2) के खंड (ix) के अधीन अपजिष्ट और बजह:स्राव का उपचार:- प्रत्येक मोिर पटरवहन
कंपनी का जनयोिा यह सुजनजित करेगा दक: -
(1)
मोिर पटरवहन कंपनी से जनकलने वाले तरल अपजिष्ट और गैसीय उत्सियन के जनकास तथा ठोस कचरे के
जनपिान के जलए उजचत व्यवस्ट्था की िाए।
(2)
सुरक्षा और स्ट्वास्ट््य संबंधी आवयकताओं का पालन सुजनजित करते हुए, अपजिष्ट और बजह:स्राव के
उपचार के जलए प्रभावी व्यवस्ट्था की िाए।
(3)
अपजिष्ट और बजह:स्राव के संग्रहण, भंडारण और प्रसंस्ट्करण से िुड़े खतरों और िोजखमों की पहचान की
िाती है और उजचत जनवारक और जनयंत्रण उपाय लागू दकए िाएं।
(4)
अपजिष्ट और बजह:स्राव के प्रबंधन के िोजखम के आकलन के आधार पर, उपयुि व्यजिगत सुरक्षा उपकरण
(पीपीई) जनःिुल्क उपलब्ध कराए िाएं; और
(5)
अपजिष्ट और बजह:स्राव का प्रबंधन करने वाले कमयचाटरयों को पहचाने गए खतरों और िोजखमों के बारे में
और प्रजिक्षण दिया िाए।
11. धुलाई की सुजवधा - धारा 24 की उप-धारा (1) के खंड (i) के अधीन: प्रत्येक मोिर पटरवहन कंपनी का
जनयोिा यह सुजनजित करेगा दक: -
(1) आसानी से पहुँच वाली िगहों पर पुरुष, मजहला, रांसिेंडर और जनःिि कमयचाटरयों के जलए अलग-अलग
साबुन, तौजलए और पानी की जनयजमत और पयायि आपूर्तय उजचत और पयायि धुलाई की सुजवधा उपलब्ध
कराई िाए। िो इस प्रकार हैं:

i.
काययस्ट्थल से अलग हो;
ii.
अच्छी तरह हवािार हो;
iii.
उजचत िल जनकासी प्रणाली हो;
iv.
साफ-सुथरी और स्ट्वच्छ जस्ट्थजत में हो;
v.
गोपनीयता बनाए रखने के जलए अंिर से बंि हो सके और उसमें उजचत िरवािे और ताले हों;
vi.
हहंिी, अंग्रेिी और अजधकांि कमयचाटरयों द्वारा समझी िाने वाली भाषा में बाहर उजचत संकेत िैसे- "केवल
पुरुषों के जलए", "केवल मजहलाओं के जलए", "केवल रांसिेंडर व्यजियों के जलए" या "केवल जनःिि
व्यजियों के जलए" (िो भी लागू हो) प्रिर्ियत हों।
(2) एक ही तौजलये का इस्ट्तेमाल करना जनजषद्ध है।
12. धारा 24 की उप-धारा (1) के खंड (ii) के अधीन स्नान गृह और लॉकर रूम की व्यवस्ट्था: प्रत्येक मोिर पटरवहन
कंपनी का जनयोिा यह सुजनजित करेगा दक:-
(1) आसानी से पहुँच वाली िगहों पर पुरुष, मजहला, रांसिेंडर और जनःिि कमयचाटरयों के जलए अलग-अलग साबुन,
तौजलए और पानी की जनयजमत और पयायि आपूर्तय उजचत और पयायि धुलाई की सुजवधा उपलब्ध कराई िाए। िो
इस प्रकार हैं:
(i)
काययस्ट्थल से अलग हो;
(ii)
अच्छी तरह हवािार हो;
(iii)
उजचत िल जनकासी प्रणाली हो;
(iv)
साफ-सुथरी और स्ट्वच्छ जस्ट्थजत में हो;
(v)
गोपनीयता बनाए रखने के जलए अंिर से बंि हो सके और उसमें उजचत िरवािे और ताले हों;
(vi)
हहंिी, अंग्रेिी और अजधकांि कमयचाटरयों द्वारा समझी िाने वाली भाषा में बाहर उजचत संकेत िैसे- "केवल
पुरुषों के जलए", "केवल मजहलाओं के जलए", "केवल रांसिेंडर व्यजियों के जलए" या "केवल जनःिि
व्यजियों के जलए" (िो भी लागू हो) प्रिर्ियत हों।
(2) कायय की प्रकृजत के अनुसार, कायय के समय पहने िाने वाले कपड़ों और ऐसे जविेष कपड़ों को रखने के जलए, िो
कमयचारी कायय स्ट्थल पर पहनते हैं लेदकन घर नहीं ले िाते, पुरुषों, मजहलाओं, रांसिेंडर और जनःिि व्यजियों के
जलए आसानी से उपलब्ध िगहों पर उपयुि और अलग लॉकर सुजवधा उपलब्ध होनी चाजहए।
13. धारा 24 की उप-धारा (1) के खंड (v) के अधीन कैंिीन की व्यवस्ट्था: प्रत्येक मोिर पटरवहन कंपनी का जनयोिा
यह सुजनजित करेगा दक: -
(1)
ऐसी हर मोिर पटरवहन कंपनी में, िहाँ 100 या उससे अजधक कमयचारी, जिनमें ठेका श्रजमक भी िाजमल हैं, काम
करते हैं, मोिर पटरवहन कंपनी पटरसर में या उसके आस-पास एक कैंिीन है िहां कमयचाटरयों को पौजष्टक, स्ट्वच्छ
और स्ट्वस्ट्थ भोिन उपलब्ध हो।
(2)
मोिर पटरवहन कंपनी का अजधष्ठाता मोिर पटरवहन कंपनी पटरसर में या उसके आस-पास एक कॉमन कैंिीन के
माध्यम से भी कैंिीन की सुजवधा िे सकता है।
(3)
कैंिीन को धूल, धुएं या बिबूिार गैस से बचाने के जलए िौचालय, मूत्रालय और प्रोसेस एटरया से उजचत िूरी पर
हो।
(4)
कैंिीन में कम से कम एक डाइहनंग हॉल, दकचन, स्ट्िोर रूम, पेंरी और कमयचाटरयों के हाथ धोने तथा बतयन धोने के
जलए अलग-अलग िगह हो।
(5)
कैंिीन में प्रवेि और जनकास के जलए अलग-अलग िरवािे हो।

(i)
डाइहनंग हॉल को ऐसी दकसी भी िगह से अलग रखा िाए िहाँ कोई खतरनाक पिाथय खाने-पीने की चीजों,
थाजलयों या बतयनों को िूजषत कर सकता हो;
(ii) डाइहनंग हॉल में कमयचाटरयों के बैठने के जलए पयायि िगह हो, तादक एक समय में ज़्यािा कमयचारी भी
आराम से बैठ सकें;
(iii) डाइहनंग हॉल और सर्वयस काउंिर का एक जहस्ट्सा अलग करके मजहला कमयचाटरयों और जनःिि कमयचाटरयों
के जलए आरजक्षत दकया िाए ; और
(iv) पुरुष, मजहला, रांसिेंडर और जनःिि कमयचाटरयों के जलए अलग-अलग वॉिरूम होंऔर उनकी जनिता का
ध्यान रखते हुए उन्हें पिे से अलग दकया िाए।
(7) उपकरण
(i) भोिन के जलए प्रयोग दकया िाने वाला सारा सामान और बतयन साफ दकए िाते हैं और उन्हें स्ट्वच्छ जस्ट्थजत में
रखा िाए;
(ii) फनीचर और अन्य उपकरण साफ और स्ट्वच्छ जस्ट्थजत में रखे िाए।
(8) भोिन का भंडारण, तैयारी और रखरखाव
(i) हर खाद्य प्रबंधक को भोिन से संबंजधत ऐसे तरीकों का प्रजिक्षण और जनिेि दिए िाएं जिससे भोिन िूजषत न
हो; और
(ii) कोई भी व्यजि िो संक्रामक बीमारी से पीजड़त है, उसे खाद्य प्रबंधक के रूप में काम करने की अनुमजत न िी
िाए ।
(9) भोिन बनाने की िगह या डाइहनंग हॉल से बचा हुआ खाना और कचरा हिाकर ढके हुए कंिेनर में िमा दकया िाए
और समय-समय पर उसका जनपिान दकया िाए।
(10) खाना, पेय और अन्य सामान जबना दकसी लाभ या हाजन के बेचा िाए, जिसकी कीमतें कैंिीन प्रबंधन सजमजत तय
करती है; और
(11) कैंिीन में दिए िाने वाले भोिन, पेय और अन्य सामान का प्रजत सर्विंग मूल्य कैंिीन में प्रिर्ियत दकया िाए।
(12) कैंिीन प्रबंधन सजमजत
(i) जनम्नजलजखत कायों को करने के जलए एक कैंिीन प्रबंधन सजमजत का गठन दकया िाए:
क. कैंिीन में दिए िाने वाले खाद्य पिाथों की गुणवत्ता और मात्रा;
ख. मेनू की व्यवस्ट्था;
ग. कैंिीन में भोिन का समय; और
घ. कोई अन्य संबंजधत मामला
बिते दक, यदि कैंिीन का प्रबंधन बहु-राज्य सहकारी सजमजत अजधजनयम,2002 के तहत पंिीकृत दकसी सहकारी संस्ट्था
द्वारा दकया िाता है, तो कैंिीन प्रबंधन सजमजत को जनयुि करना आवयक नहीं होगा।
(ii) कैंिीन प्रबंधन सजमजत में कमयचाटरयों और जनयोिा के बराबर संख्या में प्रजतजनजध हों;
(iii) जनयोिा के प्रजतजनजधयों की जनयुजि जनयोिा द्वारा की िाए और
(iv) कमयचाटरयों के प्रजतजनजध की जनयुजि संबंजधत यूजनयन या काउंजसल द्वारा की िाए और यदि कोई यूजनयन या
काउंजसल नहीं है, तो कमयचारी स्ट्वयं कैंिीन सजमजत के जलए अपने प्रजतजनजध चुनेंगे। िहां भी मजहला कमयचारी काम
करती हैं, वहां कैंिीन प्रबंधन सजमजत में कम से कम एक मजहला कमयचारी को नाजमत दकया िाए।
(v) सजमजत का काययकाल आपसी सहमजत से तय दकया िाए। कमयचाटरयों और जनयोिा, िोनों पक्षों के सजमजत सिस्ट्यों
में से एक-जतहाई सिस्ट्य हर िो साल में बिले िाएंगे।
(vi) कैंिीन प्रबंधन सजमजत, कैंिीन प्रबंधक से परामिय करके कैंिीन के संचालन के बारे में जनणय लेती है।

14. फस्ट्िय एड और मेजडकल उपकरण - धारा 24 की उप-धारा (1) के खंड (vii) के अधीन: प्रत्येक मोिर पटरवहन
कंपनी का जनयोिा यह सुजनजित करेगा दक: -
(1) हर मोिर पटरवहन कंपनी में िहां कमयचारी काम करते हैं, पयायि संख्या में फस्ट्िय-एड बॉक्स या अलमारी
उपलब्ध हो और उनमें िरूरी सामान हो तादक काम के समय वे आसानी से उपलब्ध रहें।
(2) हर जिफ्लि में, हर फस्ट्िय-एड बॉक्स या अलमारी की जिम्मेिारी फस्ट्िय-एड उपचार का प्रमाणपत्र रखने वाले
दकसी कमयचारी या सुपरवाइिर को सौंपी िाए, िो मोिर पटरवहन कंपनी के काम के घंिों के िौरान उपलब्ध
हो। हर ऑपरेटिंग सेंिर और हाहल्िंग स्ट्िेिन (जसिी सर्वयस के मामले में इसमें केवल जडपो और अन्य ऑदफस
िाजमल होंगे) में कम से कम एक पूरी तरह से सुसजित फस्ट्िय-एड बॉक्स या अलमारी होनी चाजहए और काम
के घंिों के िौरान उसका रखरखाव ठीक से दकया िाए। अगर ऑपरेटिंग सेंिर और हाहल्िंग स्ट्िेिन में
कमयचाटरयों की संख्या 200 से ज़्यािा है, तो फस्ट्िय-एड बॉक्स की संख्या ब़िाई िाए। हर फस्ट्िय-एड बॉक्स या
अलमारी में रखी सामग्री की एक उिाहरण सूची अनुभाग-I में िी गई है और जनयोिा अपनी जरूरत के
अनुसार और भी सामान िोड़ सकता है।
(3) दकसी मोिर पटरवहन कंपनी में कम से कम 33 प्रजतित कमयचाटरयों को फस्ट्िय-एड की रेहनंग िी िाए और हर
3 साल में उन्हें दफर से रेहनंग िी िाए। िहां मजहला कमयचारी काम करती हैं, वहां कम से कम एक मजहला
कमयचारी को भी रेहनंग िी िाए। फस्ट्िय-एड रेहनंग भारतीय जचदकत्सा पटरषि अजधजनयम,1956 की अनुसूची-I,
अनुसूची-II या अनुसूची-III के भाग-II में िाजमल जचदकत्सा योग्यता वाले रेनर द्वारा िी िाए। भारतीय
जचदकत्सा पटरषि अजधजनयम,1956 की अनुसूची-III के भाग-II में िाजमल योग्यता वाले व्यजि को भारतीय
जचदकत्सा पटरषि अजधजनयम 1956 की धारा 13(3) या 2019 के नेिनल मेजडकल कमीिन (एनएमसी)
एक्ि के अध्याय-VI में उजल्लजखत ितों को भी पूरा करना होगा। इसके अलावा, उनके पास इंडजस्ट्रयल हेल्थ,
पजब्लक हेल्थ, इमरिेंसी मेजडजसन या समकक्ष में जडप्लोमा या जडग्री भी होनी चाजहए।
(4) काम के िौरान होने वाली हर चोि या बीमारी की सूचना मोिर पटरवहन कंपनी के सुपरवाइिर को िी िाए,
तादक चोि या बीमारी पर निर रखी िा सके। साथ ही, मोिर पटरवहन कंपनी में काम करने वाले ऐसे
कमयचाटरयों के जलए उजचत व्यवस्ट्था की िाए, जिन्हें ड्यूिी के िौरान गंभीर चोि लगती है या बीमारी होती है,
या जिन्हें फस्ट्िय-एडर के अनुसार इलाि की आवयकता होती है। ऐसे कमयचाटरयों को तुरंत मोिर पटरवहन
कंपनी या उसके आस-पास के इलाके की नििीकी जडस्ट्पेंसरी या अस्ट्पताल पहुंचाया िाए।
(5) काम के िौरान चोि लगने पर हर कमयचारी को यह बात फस्ट्िय-एड का प्रमाणपत्र रखने वाले कमयचारी या
सुपरवाइिर को बतानी चाजहए िो घायल व्यजि को आवयक फस्ट्िय-एड उपलब्ध कराने की व्यवस्ट्था करेगा।
यदि चोि लगने वाला कमयचारी फस्ट्िय-एड का प्रमाणपत्र रखने वाले कमयचारी या सुपरवाइिर को यह िानकारी
िेने की जस्ट्थजत में नहीं है, तो यह उस व्यजि की जिम्मेिारी होगी जिसे इस घिना के बारे में सबसे पहले पता
चलता है दक वह यह िानकारी फस्ट्िय-एड का प्रमाणपत्र रखने वाले कमयचारी या सुपरवाइिर को िे।
(6) यदि सुपरवाइिर की राय में चोि ऐसी है दक उसे तुरंत दकसी योग्य जचदकत्सक से इलाि की आवयकता है,
तो वह तुरंत जचदकत्सक को बुलाने की व्यवस्ट्था करेगा या इस बारे में मोिर पटरवहन कंपनी के जनयोिा या
उसके प्रजतजनजध को सूजचत करेगा।
(7) यह जनयोिा या उसके प्रजतजनजध का यह कतयव्य है दक वह यह सुजनजित करे दक कमयचारी को िल्ि से िल्ि
नििीकी जडस्ट्पेंसरी/अस्ट्पताल पहुंचाया िाए, बेहतर होगा दक इसके जलए एक उजचत एम्बुलेंस वाहन का
उपयोग दकया िाए।
15. धारा 24 की उप-धारा (2) के खंड (ii) के अधीन मेजडकल सुजवधाएं:- प्रत्येक मोिर पटरवहन कंपनी का जनयोिा
यह सुजनजित करेगा दक: -
(1) हर ऑपरेटिंग सेंिर और ठहराव वाले स्ट्िेिन (जसिी सर्वयस के मामले में इसमें केवल जडपो और अन्य ऑदफस
िाजमल होंगे) पर एक उपयुि मेजडकल सुजवधा कक्ष या जडस्ट्पेंसरी 24 घंिे या कायय समय के िौरान उपलब्ध
होती है और उसे अच्छी हालत में रखा िाए।
(2) मेजडकल सुजवधा कक्ष या जडस्ट्पेंसरी ऑपरेटिंग सेंिर और ठहराव स्ट्थल पर सुजवधािनक स्ट्थान पर होनी चाजहए
और उसमें मेजडकल इमरिेंसी से जनपिने के जलए पयायि िगह और व्यवस्ट्था होनी चाजहए। इसमें कम से कम

वह उपकरण होने चाजहए िो अनुभाग-II में िी गई सूची में बताए गए हैं। जनयोिा आवयकतानुसार और भी
उपकरण िोड़ सकता है।
(3) मेजडकल सुजवधा कक्ष या जडस्ट्पेंसरी की िेखरेख एक पूणयकाजलक योग्य मेजडकल प्रैजक्ििनर करेगा, जिसे
जनयोिा सीधे जनयुि करेगा। इसके साथ ही पयायि संख्या में पैरामेजडकल स्ट्िाफ (कम से कम एक नसय और एक
िनरल ड्यूिी अजसस्ट्िेंि-हेल्थकेयर/नर्सिंग अजसस्ट्िेंि) भी होंगे।
(4) उप-जनयम (3) के तहत जनयुि दकए िाने वाले मेजडकल प्रैजक्ििनर के पास भारतीय जचदकत्सा पटरषि
अजधजनयम,1956 की पहली या िूसरी अनुसूची या तीसरी अनुसूची के भाग II में िाजमल कोई मेजडकल
योग्यता होनी चाजहए। तीसरी अनुसूची के भाग II में िाजमल योग्यता वाले व्यजियों को उि अजधजनयम के
खंड 13(3) में उजल्लजखत ितय या नेिनल मेजडकल कमीिन (एनएमसी) अजधजनयम 2019 के अनुसार या
इंडजस्ट्रयल/ऑक्यूपेिनल हेल्थ में जडप्लोमा/जडग्री या समकक्ष योग्यता पूरी करनी होगी।
(5) उप-जनयम (3) के तहत जनयुि की िाने वाली योग्य नसय के पास राज्य नर्सिंग काउंजसल से पंिीकृत योग्यता
होनी चाजहए और उसे बेजसक लाइफ सपोिय (बीएलएस) की रेहनंग पूरी करनी होगी, साथ ही उसे दकसी
मल्िीस्ट्पेजियजलिी अस्ट्पताल में कम से कम 6 महीने का इमरिेंसी का अनुभव भी होना चाजहए।
(6) जचदकत्सा सुजवधा कक्ष या औषधालय में कम से कम िो कमरे होने चाजहए। एक कमरा कमयचाटरयों के बैठने और
िवाइयों के भंडारण के जलए उपयोग दकया िाए। िूसरा कमरा आपातकालीन कक्ष सह ड्रेहसंग कक्ष/मरीिों के
जलए जनरीक्षण कक्ष के रूप में उपयोग दकया िाए।
(7) जचदकत्सा सुजवधा कक्ष या औषधालय में आपातकालीन प्रकाि व्यवस्ट्था और उपयुि संचार माध्यम
अजधमानतः हाथ में पकड़े िाने वाला उपकरण उपलब्ध कराया िाए।
16. धारा 24 की उप-धारा (2) के खंड (iii) के अधीन आश्रय स्ट्थल और जवश्राम कक्ष: प्रत्येक मोिर पटरवहन कंपनी
का जनयोिा यह सुजनजित करेगा दक: -
(1) हर उस मोिर पटरवहन कंपनी में, िहाँ आमतौर पर 50 से अजधक कमयचारी काम करते हैं, वहां कमयचाटरयों के
भोिन करने के जलए पयायि और उपयुि लंचरूम होना चाजहए, जिसमें पीने के पानी और हाथ-पैर धोने की सुजवधा
भी हो।
(2) ये सुजवधाएं पुरुष, मजहला और रांसिेंडर कमयचाटरयों के जलए अलग-अलग उपलब्ध कराई िाएं और उनका
रखरखाव दकया िाए।
बिते दक जनयम 16 के तहत प्रावधानों के अनुसार बनाई गई दकसी भी कैंिीन को इस जनयम का पालन माना िाए।
(3) आश्रय स्ट्थल या जवश्राम कक्ष और लंच रूम में जनम्नजलजखत सुजवधाएं होनी चाजहएं:
i
ऐसे कमरे पयायि रोिनी वाले और हवा-िार हों और हमेिा साफ-सुथरे और स्ट्वच्छ जस्ट्थजत में रखें िाएं।
ii सभी िीवारें और छत उपयुि गमी प्रजतरोधी सामग्री की बनी हों;
iii ऐसे कमरे की छत फिय से उजचत ऊंचाई पर हो और उसमें उस समय काम कर रहे कमयचाटरयों के जलए पयायि
िगह हो;
iv हर कमरे में बैठने और खाने के जलए उजचत फनीचर हो।
(4)
प्रत्येक मोिर पटरवहन उपक्रम का जनयोिा यह सुजनजित करेगा दक उपक्रम में जनयोजित मोिर पटरवहन श्रजमकों
को विी, रेनकोि और अन्य सुजवधाएं जनःिुल्क प्रिान की िाएं।

17. धारा 24 की उपधारा (3) के अधीन क्रेच सुजवधा:- प्रत्येक मोिर पटरवहन कंपनी का जनयोिा यह सुजनजित करेगा
दक: -
(1) प्रत्येक मोिर पटरवहन कंपनी में, िहाँ सामान्यतः 50 से अजधक कमयचारी काययरत हैं, कमयचाटरयों के छह वषय
से कम आयु के बच्चों के उपयोग के जलए एक क्रेच सुजवधा प्रिान की िाए और उसका रखरखाव दकया िाए।
(2)
िहाँ भी आवयकता हो, मोबाइल क्रेच उपलब्ध कराया िाए।
(3)
प्रत्येक क्रेच सुजवधा सभी कमयचाटरयों के जलए जनःिुल्क और सुलभ हो;
(4)
क्रेच यथासंभव काययस्ट्थल के भीतर या दकसी जनकिवती सुलभ स्ट्थान पर जस्ट्थत होना चाजहए;
(5)
क्रेच भवन जनमायण स्ट्थल के दकसी ऐसे भाग के जनकि जस्ट्थत नहीं होना चाजहए िहाँ से हाजनकारक धुआँ, धूल
या िुगिंध जनकलती हो या िहाँ अत्यजधक िोरगुल वाली प्रदक्रयाएँ चलती हों;
(6)
क्रेच में या उसके आस-पास बच्चों और उनके कपड़ों की धुलाई के जलए एक उपयुि िौचालय हो;
(7)
क्रेच को स्ट्वच्छ, स्ट्वास्ट््यकर और स्ट्वच्छतापूणय जस्ट्थजत में रखा िाए;
(8)
बच्चे की व्यजिगत स्ट्वच्छता का ध्यान रखा िाए।
(9)
क्रेच बच्चों और जििुओं की िेखभाल के जलए अजधमानतः मजहला के अधीन हो;
(10) क्रेच के प्रभारी, सहायक कमयचारी और गाडय का पुजलस सत्यापन अजनवायय है।
(11) क्रेच के प्रभारी व्यजि के पास बच्चे की पहचान, जनवास का पता आदि की िानकारी हो और इसका रखरखाव
दकया िाए।
(12) क्रेच में बच्चे को लाने और छोड़ने वाले व्यजि का जववरण िेखभालकताय के पास उपलब्ध होना चाजहए और बच्चे
को केवल उसी व्यजि को सौंपा िाए। यदि कोई अन्य व्यजि बच्चे को लेने या छोड़ने िाता है तो माता-जपता
की अनुमजत के साथ उसकी पहचान आवयक होगी।
(13) सुबह बच्चे के आगमन पर और बच्चे को लेने के समय सभी बच्चों की उपजस्ट्थजत ििय की िाए।
(14) क्रेच में रहने के िौरान प्रत्येक बच्चे के जलए पयायि मात्रा में साफ कपड़े, साबुन और साफ तौजलए उपलब्ध हों;
(15) क्रेच में आराम करने के जलए पयायि व्यवस्ट्था हो;
(16) सभी बच्चों को उनकी आहार संबंधी आवयकताओं के अनुसार पौजष्टक, सम्पूणय और स्ट्वास्ट््यकारी भोिन की
पयायि आपूर्तय की िाए;
(17) कैंची, चाकू, ब्लेड, जपन आदि िैसी सभी नुकीली चीजें बच्चों से हमेिा िूर रखी िाए।
(18) जडििेंि, सफाई एिेंि, दफनाइल आदि िैसे रसायन बच्चों की पहुँच से िूर रखे िाए।
(19) क्रेच में बचे हुए खाने या अन्य अपजिष्ट पिाथों के जनपिान के जलए गैर-िहनिील ढके हुए पात्र उपलब्ध कराए
िाएं;
(20) सभी जबिली के जस्ट्वच/प्लग बच्चों की पहुँच से िूर रखे िाए।
(21) क्रेच में जनकासी योिना प्रिर्ियत की िाए।
(22) क्रेच में दकसी भी समय यहाँ तक दक अवकाि के िौरान भी दकसी भी बच्चे को अकेला नहीं छोड़ा िाए।
(23) दकसी भी प्रकार का मौजखक या िारीटरक िुव्ययवहार सख्त वर्ियत दकया िाए।
(24) दकसी भी प्रकार के यौन िुव्ययवहार और यौन िोषण को लैंजगक अपराधों से बालकों का संरक्षण (पॉक्सो)
अजधजनयम, 2012 अजधजनयम के अंतगयत सख्ती से जनपिा िाए।
(25) सुपरवाइजर के माध्यम से क्रेच के कायय समय के िौरान दकसी भी समय, दकसी भी ज्ञात या अज्ञात व्यजि को
क्रेच के अंिर प्रवेि की अनुमजत नहीं िी िाए। उिाहरण के जलए जसजवल कायय केवल सिाहांत/छुटियों के
िौरान ही दकए िाएं।

(26) क्रेच में कायय समय के िौरान सीसीिीवी जनगरानी हो।
(27) महत्वपूणय और आपातकालीन संपकय नंबर (िैसे 112, 1098, अजग्निमन सेवा, बाल संरक्षण अजधकारी,
जनकितम पुजलस स्ट्िेिन आदि िैसी हेल्पलाइन) क्रेच पटरसर में आसान पहुँच और संिभय के जलए प्रिर्ियत दकए
िाएं।

New Delhi, the 24th September, 2025
G.S.R. 712(E).—The following draft rules, which the Central Government proposes to make in exercise of
powers conferred by Sections 23 & 24 of the Occupational Safety, Health and Working Conditions Code, 2020 (37 of
2020) are hereby notified as required by sub-section (1) of Section 134, for information of all persons likely to be
affected thereby and notice is hereby given that the said draft notification will be taken into consideration after the
expiry of a period of 45 days from the date on which the copies of the Official Gazette in which this notification is
published are made available to the public; Objections and suggestions, if any, may be addressed to Shri Ravishankar
Nirala, Under Secretary to the Government of India, Ministry of Labour and Employment, Room No: 17, Shram
Shakti Bhawan, Rafi Marg, New Delhi or by email (fas@dgfasli.nic.in and ravis.nirala@nic.in). The objections and
suggestions should be sent in a proforma containing columns (i) specifying the name and address of the persons and
organizations and column (ii) specifying the rule or sub-rule which is proposed to be modified and column (iii)
specifying the revised rule or sub rule proposed to be submitted and the reasons therefore; Objections and suggestions,
which may be received from any person or organization with respect to the said draft notification before expiry of a
period of 45 days, specified above, will be considered by the Central Government.

Short title, extent and commencement (i) These rules may be called the Motor Transport Workers Rules,
202… under Sections 23 and 24 of the Occupational Safety, Health, And Working Conditions Code, 2020.

(ii)
They extend to whole of India.
(iii) They shall come into force on the date of their publication in the Official Gazette.
2. Definition. - (1) In these rules, unless the context otherwise requires, -
(a) “Code” means the Occupational Safety, Health and Working Conditions Code, 2020;
(b) “Officer In charge Canteen” means the person (other than manager) appointed by the employer, for
securing compliance with the provision in respect of canteens under the code.
(c)
“Section” means the Section of the Code.
(d) “Annexure” means list annexed to these rules;
(e) “Negotiating Union or negotiating council” means negotiating union or negotiating council referred to in
Section 14 of the Industrial Relations Code, 2020.
(2) The words and expressions used in these Rules and are not defined herein, but are in the Code, shall have
respectively meaning assigned to them in the Code.
3. Cleanliness and hygiene under clause (i) of sub-section (2) of section 23: The employer of every motor
transport undertaking shall ensure that: -
(1) All workplaces, workrooms, passageways, staircases, storerooms and service rooms are kept in sanitary and
hygienic condition.
(2) Surfaces of walls and ceilings, including windows and skylights, are always kept clean and maintained in a
hygienic condition.
(3) The floor of every workroom is maintained in a clean and, so far as possible, dry and non-slippery condition.
(4) Where wet work processes are carried out—
(i) effective drainage is maintained;
(ii) false floors, platforms, mats or other dry standing places are provided; and
(iii) suitable anti-skid footwear for use while at work where ever required in such places without expense to
employees.
(5) Workrooms are cleaned as often as required by the nature of the work carried on.
(6) As far as practicable, sweeping and cleaning are done—
(i)
during intervals between work; and
(ii) in such a manner as to prevent the raising of dust.
(7) Where, for technical reasons, cleaning must be carried out during working hours, appropriate means are used
and precautions are taken to avoid contamination of the air with dust or other obnoxious substances.
(8)
Suitable arrangements for daily collection, storage, disposal or treatment of waste are made under the
effective supervision.
4. Ventilation, Temperature and Humidity under clause (ii) of sub-section (2) of section 23: The employer of
every motor transport undertaking shall ensure that: -
(1)
Suitable atmospheric conditions are maintained in workplaces, by natural or artificial means, to avoid
insufficient air supply, stagnant or vitiated air, harmful draughts, excessive heat or cold, sudden variations in

temperature, and where practicable, having regard to the nature of the processes carried on, to avoid excessive
humidity or dryness, and objectionable odours.
(2)
Steps are taken as are necessary to provide at all workplaces of the motor transport undertaking, adequate
ventilation to clear away smoke and fume, steam and dust, to dilute gases that are inflammable or noxious so as
to render them harmless.
(3)
Adequate and sufficient measures are taken to protect the employees from exposing to extreme weather
conditions by suitably changing the working hours, providing protective clothes or other suitable provisions, as
necessary free of charge.
(4)
Where an adequate supply of fresh air cannot be obtained by natural ventilation, or where it is difficult to get the
desired amount of air to the workroom without creating uncomfortable draughts near the inlets, mechanical
ventilation is provided.
5. Precaution against dust under clause (iii) of sub section (2) of section 23 – The employer of every motor
transport undertaking shall ensure that: -
(1)
Where exhaust systems for removal of flammable fumes, gases, mists, vapors or residues are not to be
connected to any other ventilating system or discharged into a chimney or flue used for conveying gases of
combustion.
(2)
When fumes, gases, mists, vapors, dust and other refuse discharged from exhaust systems is likely to have
adverse effect on the health or noxious for the employees or the neighborhood, the exhaustion shall be affected
through a system that neutralizes toxic substances, sterilize infectious substances and deodorize fumes, gases,
mists or vapors.
(3)
No employee is required or allowed to enter any workplace or confined space until practicable measures have
been taken to bring the levels of noxious gas, fume, vapour or dust, which may be present, within the
permissible limits.
6. Potable drinking water - under clause (v) of sub-section (2) of section 23: - The employer of every motor
transport undertaking shall ensure that: -
(1) Adequate supply of clean, wholesome and safe drinking water is provided for, and be readily accessible to,
all employees in all workplaces.
(2) Any supply of drinking water other than the piped supply is contained in suitable vessels clearly marked or
displayed in Hindi, English and local language understood by the majority of the employees, to indicate that
the water is safe for drinking and such supply is replenished daily and all necessary precautions are taken to
preserve the water and vessels from contamination;
(3) Except where the water is delivered by a rising jet, the use of common drinking tumblers or cups is
prohibited.
(4) Where water is unsafe for drinking purposes, or is provided for use in industrial processes or other purposes,
it is to be so indicated in Hindi, English and local language understood by the majority of the employees.
7. Overcrowding -under clause (vi) of sub-section (2) of section 23: The employer of every motor transport
undertaking shall ensure that: -
(1)
The floor space in any building is not crowded with vehicles in a manner dangerous to employees, or be
overcrowded with materials or products so as to constitute a menace to them.
(2) Adequate provisions are made to prevent overcrowding at any place where employees are required to work or
assemble for any reason in the motor transport undertaking premises, including:
(i) Design and use of signs or symbols that indicate and illustrate overcrowding related hazards in all
working areas specifying the number of employees allowed to work at such places at any one time;

(ii)
Vehicle and pedestrian pathways are kept separated using barriers indicated by distinctive colours and
(iii) Deployment of vehicles are managed effectively and overcrowding is avoided.
8. Lighting (Illumination) - under clause (vii) of sub-section (2) of section-23: The employer of every motor
transport undertaking shall ensure that: -
(1)
All places in the motor transport undertaking including all amenities for utility services where employees
work or pass, or may have to work or pass in emergencies, are provided during time of use with adequate
natural or artificial lighting, or both, suitable for the operations and the special type of work performed.
Natural lighting is arranged wherever possible.
(2)
Artificial lighting is provided or arranged when daylight fails or for areas where the daylight illumination
is insufficient.
(3)
At every work place where employees are exposed to risks in the event of failure of artificial lighting, are
provided with automatic emergency lighting of sufficient intensity that should have energy sources
independent of the installations for the general lighting systems.
9. Latrine and urinal accommodation under clause (viii) of sub-section (2) of section23: The employer of every
motor transport undertaking shall ensure that: -
(1)
(i) In every work place of a motor transport undertaking, sufficient latrine and urinal accommodation are
provided at conveniently accessible places separately for the use of male, female, transgender and person
with disabilities employees.
(ii) Such accommodation is sufficiently lighted and ventilated and maintained in a clean and sanitary
condition at all times.
(2)
(i) Floor of the latrine, urinal and the sanitary blocks are maintained in non-slippery condition.
(ii) the internal walls of the latrines, urinals and the sanitary blocks are laid in glazed tiles. Alternatively,
internal walls of the latrines and urinals are finished in such a manner to provide a smooth, polished
and impervious surface to facilitate cleanliness and hygiene;
(iii) Sanitary pans of latrines and urinals are kept washed and cleaned at all times.
(3)
At least one separate latrine accommodation, for every 25 male and 15 female employees, and at least one
separate latrine accommodation each for person with disabilities employees and for transgender employees is
provided and at least one urinal for every 15 males employed at the same time. Sufficient water supply is
provided in every latrine and urinal accommodation.
(4)
Washbasin facility with tap water is made available.
(5)
Sanitary napkins in sufficient quantity are provided and maintained in the women’s toilets for their use and
the same are to be replenished on a daily basis.
(6)
Disposable bins with lids are provided within the women’s toilets for the collection of the used sanitary
napkins. The used napkins are safely disposed off. Disposable bins with lids shall also be provided within the
toilets for men, transgender and person with disabilities.
(7)
Every latrine is kept under cover and so partitioned off as to secure privacy, and to have a proper door,
fastenings and exhaust.
(8)
Where male, female, transgender and person with disabilities are employed, outside each latrine block a
notice “For men only” or “For women only” or “For transgender persons only” or “For persons with
disabilities only”, as the case may be, in Hindi, English and local language understood by the majority of the
employees, are displayed.

(9)
Waste or sullage water from latrines and urinals is treated and safely disposed of.
(10) Water taps in latrines-
(i) where piped water supply is available, water taps are to be provided in or near such latrine accommodation;
and
(ii) if piped water supply is not available, water is provided by the means of tap or otherwise so as to be
conveniently accessible in or near the latrine and urinals.
10. Treatment of waste and effluents under clause (ix) of sub-section (2) of section 23: - The employer of every
motor transport undertaking shall ensure that: -
(1)
Proper arrangements for discharging liquid effluents and gaseous emission, and disposal of solid waste
generated in the motor transport undertaking are made.
(2)
Effective arrangements are made for the treatment of wastes and effluents by ensuring compliance with the
safety and health requirements.
(3)
Hazards and risks with the handling, storage and processing of wastes and effluents are identified and
appropriate preventive and control measures are implemented.
(4)
Appropriate personal protective equipment (PPE) based on risk assessment of handling the waste and
effluents are provided, free of charge; and
(5)
Employees handling the wastes and effluents are trained on the identified hazards and risks.
11. Washing facility - under clause (i) of sub-section (1) of section24: The employer of every motor transport
undertaking shall ensure that: -
(1)
Suitable and sufficient washing facilities at easily accessible places are provided with regular and adequate
supply of water including soap, towels separately for male, female, transgender and person with disabilities
employees, which are:
(i)
separated from the workplaces;
(ii)
Well ventilated;
(iii) With proper drainage system;
(iv) maintained in a sanitary and hygienic condition;
(v)
capable of being secured from inside to secure privacy and have a proper door, fastenings;
(vi) Appropriately demarcated with "For men only” or “For women only” or “for transgender persons only” or
“For persons with disabilities only”, as the case may be, in Hindi, English and local language understood
by the majority of the employees, are displayed outside.
(2) The use of common towels is prohibited.
12. Provisions of bathing places and locker rooms under clause (ii) of sub-section (1) of section-24: The
employer of every motor transport undertaking shall ensure that: -
(1) Suitable, separate and sufficient bathing places and locker facility, as may be necessary owing to the nature of
work, at easily accessible places with regular and adequate supply of water including soap and towels for male,
female, transgender and persons with disabilities separately, are provided which are: -
(i)
separated from the workplaces;
(ii)
well ventilated;
(iii) with proper drainage system;
(iv) maintained in a sanitary and hygienic condition;
(v)
capable of being secured from inside to secure privacy and have a proper door, fastenings;
(vi) Properly demarcated with "For men only” or “For women only” or “For transgender persons only” or “For
person with disabilities only”, as the case may be, in Hindi, English and local language understood by the
majority of the employees, are displayed outside

(2) Suitable, separate locker facilities, as may be necessary owing to the nature of work, at easily accessible places
for storing clothing that are worn during working hours and for special clothing which is worn by any employee
at work but is not taken home, for male, female, transgender and persons with disabilities.
13. Provision of Canteens under clause (v) of sub-section (1) of section 24: The employer of every motor
transport undertaking shall ensure that: -
(1)
At every motor transport undertaking where in 100 or more workers including contract labourers are
ordinarily employed, a canteen in or adjacent to the precincts of the motor transport undertaking, is
provided and maintained to provide nutritious, wholesome and healthy food for the employees;
(2) The employer of motor transport undertaking can also provide facility of canteen through common canteen
in or adjacent to undertaking premises;
(3) The canteen is situated at appropriate distance from any latrine, urinal and process area to avoid dust,
smoke or obnoxious fumes;
(4) The canteen is constructed to accommodate at least a dining hall, kitchen, store room, pantry and washing
places separately for employees and for utensils.
(5) Canteen has separate doors for entry and exit.
(6) Dining Hall
(i) The dining hall is separated from any place where a hazardous substance may contaminate food, dishes
or utensils;
(ii) The dining hall is furnished with a sitting arrangement to accommodate sufficient number of employees
normally using at any one time;
(iii) A portion of the dining hall and service counter is partitioned off and reserved for women employees
and person with disabilities employees; and
(iv) Washing places for male, female, transgender and person with disabilities employees are separate and
screened to secure privacy.
(7)
Equipment
(i) All equipment and utensils that come into contact with food are cleaned and maintained in hygienic
condition;
(ii) Furniture and other equipment are maintained in a clean and hygienic condition.
(8)
Storage, Preparation and Handling of food
(i) Each food handler is trained and instructed in food handling practices that prevent the contamination of
food; and
(ii) No person who is suffering from a communicable disease is allowed to work as a food handler.
(9)
Food waste and garbage are removed from the food preparation area or dining hall, stored in covered
containers and disposed of periodically.
(10)
Food, drink and other items are sold on a no profit no loss basis wherein the rates are fixed by canteen
management committee; and
(11)
The charges per portion of food items, beverages and any other items served in the canteen are displayed in the
canteen.
(12)
Canteen Management Committee
(i) A Canteen Managing Committee is constituted to carry out the following functions:
a.
the quality and the quantity of food stuffs to be served in the canteen;
b. the arrangements of the menu;
c.
the timings of meals in the canteen; and

d. any other relevant matter
Provided that where the canteen is managed by a co-operative society registered under the Multi State Co-operative
Societies Act, 2002 it shall not be necessary to appoint a Canteen Managing Committee.
(ii)The Canteen Managing Committee consists of an equal number of representative of employees and employer;
(iii) the representatives of employer are nominated by the employer and
(iv) the representatives of worker are nominated by negotiating union or negotiating council as the case may be and
where there is no negotiating union or negotiating council the employees will choose amongst themselves the worker
representatives of the canteen committee. At least one-woman worker is nominated in the canteen management
committee wherever women workers are employed.
(v) The tenure of the committee shall be determined mutually. One-third of the committee members of employees and
occupier shall be rotated every two years.
(vi) The canteen managing committee decides on the running of the canteen in consultation with the canteen manager.
14. First Aid and Medical Appliances - under clause (vii) of sub-section (1) of section 24: The employer of every
motor transport undertaking shall ensure that: -
(1) In every motor transport undertaking where employees are at work, first aid boxes or cup-boards in adequate
numbers with necessary items are provided and maintained so as to be readily accessible during working hours.
(2) In each shift, every first-aid box or cupboard is kept under the charge of a worker or supervisor who holds a
certificate in first-aid treatment and who is available during the working hours of the motor transport undertaking. At
least one fully equipped first-aid box or cupboard in every operating centre and halting station (which, in the case of
city service, shall include only depots and other offices) is available and maintained properly all the time during
working hours. The number of first aid boxes has to increase if the number of employees is more than 200
employees in operating centre and halting station. The illustrative list of contents of every first-aid box or cupboard
is annexed at Annexure- I and employer may add more items as per requirement.
(3) At least 33 percent of the workers in a motor transport undertaking are trained in first-aid procedures and refreshers
training to be imparted in every 3 years. Wherever woman workers are employed, at least one-woman worker is
trained. First Aid training is conducted by the trainer having medical qualification included in the Schedule- I or
Schedule- II or Part- II of the Schedule- III of the Indian Medical Council Act of 1956. The person possessing
qualifications included in Part II of Schedule- III of the Indian Medical Council Act of 1956 should also fulfil the
condition specified in section 13(3) of the Indian Medical Council Act 1956 or as per the Chapter- VI of National
Medical Commission (NMC) Act 2019 or diploma or degree in Industrial Health, Public Health, Emergency
Medicine or equivalent.
(4) Every case of injury or illness during the course of work is reported to the supervisor in the motor transport
undertaking for injury and illness surveillance and adequate and suitable arrangements are made available for
speedy evacuation or referral of persons employed in the motor transport undertaking who while on duty suffers
from serious bodily injury or illness of a serious nature or as the nature of injury and illness as decided by the first
aider, from the motor transport undertaking or part thereof to the nearest dispensary or hospital.
(5) Every employee receiving an injury during the course of work shall report the same to the worker or supervisor who
holds a certificate in first-aid treatment and who shall make arrangements for rendering first-aid to the injured as
may be required. Where the employee receiving an injury is not in a position to report the same to the worker or
supervisor who holds a certificate in first-aid treatment, it shall be the duty of the person who first comes to know of
it to report the same to the worker or supervisor.
(6) If in the opinion of the supervisor, the injury is of such a nature so as to require immediate medical attention by the
qualified medical practitioner, he shall arrange for the qualified medical practitioner to be called or bring it to the

notice of the employer or his representative in the motor transport undertaking.
(7) It is the duty of the employer or his representative to ensure that adequate and suitable arrangements are made
available for speedy transportation of that employee to nearest dispensary/ hospitals preferably by means of a proper
ambulance van.
15. Medical facilities under clause (ii) of sub-section (2) of section 24: The employer of every motor transport
undertaking shall ensure that: -
(1) At every operating centre and halting station (which, in the case of city service, shall include only depots and
other offices), a suitable medical facilities room or dispensary is available round the clock or during working
hours as the case may be and is maintained in good order.
(2) The medical facilities room or dispensary is situated at a convenient place in the operating centre and halting
station and have adequate space and arrangements to cope up with medical emergency and contains at least the
equipment as mentioned in illustrative list given in Annexure- II. The employer may add more items as per
requirement.
(3) Medical facilities room or dispensary is under the charge of a full time qualified medical practitioner appointed
directly by the employer and is assisted by adequate number of paramedical staffs (at least one nurse and one
General Duty Assistant-Healthcare/Nursing Assistant).
(4) The medical practitioner required to be appointed under sub-rule (3) has a medical qualification included in the I
or II schedule or part II of the Third schedule of the Indian Medical Council Act of 1956. Persons possessing
qualifications included in part II of Third schedule should also fulfil the condition specified in section 13(3) of
the Act or as per the National Medical Commission (NMC) Act 2019 or Diploma/Degree in
Industrial/Occupational Health or equivalent.
(5) Qualified Nurse required to be appointed under sub-rule (3) shall have qualification registered under State
Nursing Council and completed training in Basic Life Support (BLS) along with experience in emergency of not
less than 6 months duration from a multispecialty hospital.
(6) Medical facilities room or dispensary is having a minimum of two rooms. One of the rooms is used for sitting of
staff and storage of medicines. The other room is used as emergency cum dressing room/observation room for
sick.
(7) Medical facilities room or dispensary is provided with Emergency Lighting Supply and a suitable
communication medium preferably handheld device.
16. Shelter and Rest Room under clause (iii) of sub-section (2) of section 24: – The employer of every motor
transport undertaking shall ensure that: -
(1) In every motor transport undertaking, wherein more than 50 workers are ordinarily employed sufficient and a
suitable lunchroom, with provision for drinking water and washing facilities, where employees can eat their
meals is provided.
(2) These facilities are provided separately and maintained for male, female, and transgender employees.
Provided that any canteen maintained in accordance with the provisions under rule 16 shall be regarded as
compliance of this rule.
(3) The shelters or rest rooms and lunch rooms conform to the following:
i.
Such rooms are sufficiently lighted and ventilated and maintained in a clean and hygienic condition at all
times.

ii.
All the walls and roof are of suitable heat resisting materials;
iii.
The roof of such room is at suitable height from the floor level and there is sufficient floor area for employee
employed at any given time;
iv.
Every room is sufficiently furnished with suitable seating and eating arrangement.
(4) The employer of every motor transport undertaking shall ensure that the motor transport workers employed in the
undertaking are provided with uniforms, raincoats and other like amenities, free of charge.
17. Crèche Facility under sub-section (3) of section 24 :- The employer of every motor transport undertaking shall
ensure that: -
(1)
In every motor transport undertaking wherein more than than 50 workers are ordinarily employed, a crèches
facility is provided and maintained for the use of children under the age of six years of employees.
(2)
Mobile crèche will be provided, wherever required.
(3)
Each Crèche facility is free and accessible to all employees;
(4)
The Crèche is located within the workplace as much as possible, or in a nearby accessible location;
(5)
The Crèche is not situated in close proximity to any part of the building and construction worksite where
obnoxious fumes, dust or odours are given off or in which excessively noisy processes are carried on;
(6)
There is in or adjoining the crèche a suitable washroom for the washing of the children and their clothing;
(7)
The Crèche is maintained in a clean, hygienic and sanitary condition;
(8)
Personal cleanliness of the child is maintained.
(9)
The Crèche is under the charge preferably woman for the care of children and infants;
(10)
Police verifications of in charge of creche, support staff and guard are mandatory.
(11)
The person in charge of the crèche should have and maintain information about the child’s identity, residential
address etc.
(12)
Details of the person who is picking up and dropping the child to the creche should be available with the
caretaker and the child should be handed over to that person only. In case any other person picks up or drops
the child, then his/her identity with the authorization from parents would be necessary.
(13)
Attendance of all children is taken in the morning on the child’s arrival as well as at the time when child is
picked up.
(14)
Sufficient supply of clean clothes, soaps and clean towels is available for each child while the child is in the
Crèche;
(15)
The Crèche is furnished with a suitable number of resting arrangements;
(16)
Sufficient supply of nutritious, wholesome and healthy food to all children as per their dietary requirements is
provided;
(17)
All sharp objects like scissors, knives, blades, pins etc. are always kept away from the children.
(18)
Chemicals such as detergents, cleaning agents, phenyl etc. are kept out of the child’s reach.
(19)
The Crèche is provided with non-combustible covered receptacles for the disposal of waste food or other waste
material;
(20)
All electrical switches/plugs are out of children’s reach.
(21)
Evacuation plan to be displayed at the crèche.
(22)
No child is left alone at any point in the crèche, even during breaks.
(23)
Any kind of verbal or physical abuse is strictly prohibited.
(24)
Any kind of sexual abuse and sexual exploitation to be strictly dealt under Protection of Children from Sexual
Offences (POCSO) Act, 2012.
(25)
Through the supervisor, that no persons, known or unknown be allowed inside the crèche at any point of time,
during the functioning hours of the crèche. For example, civil work should preferably be done during
weekend/holidays only.
(26)
The Crèche has CCTV monitoring during the working hours.
(27)
Important and emergency contact numbers (helplines like 112, 1098, fire services, child protection officer,
nearest police station etc.) are displayed within the creche premises for easy access and reference.
(28)
Required Medical support system / staff is made available on call.

18. Mock Drills: Section 24 (2) (vii): Any other matter which may be prescribed: - The employer of every motor
transport undertaking shall shall ensure quarterly conduct of Mock drills to check emergency preparedness to deal
with various emergencies.
