सा.का.जन. 754(अ).— अन्तिेिीय िलयान (जविेष श्रेणी िलयान: स्ट्वायत्त और अधग-स्ट्वायत्त) जनयम,
2025 जिन्हें केंद्र सरकार अन्तिेिीय िलयान अजधजनयम, 2021 की धारा 106 की उपधारा (2) के खंड (यि) के
साथ परित धारा 98 की उपधारा (1) के खंड (क) और धारा 42 की उपधारा (1) और (2) के तहत प्रित्त िजियों
का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती है, का प्रारूप इससे प्रभाजवत होने वाले सभी व्यजियों की िानकारी
के जलए उि अजधजनयम की धारा 106 की उपधारा (1) द्वारा यथा अपेजित एतद्द्वारा प्रकाजित दकया िाता है;
और एतद्द्वारा सूचना िी िाती है दक उि प्रारूप जनयमों पर उस तारीख से तीस दिन की समाजि के पश्चात जवचार
दकया िाएगा, जिस तारीख को इस अजधसूचना की प्रजतयां, रािपत्र में यथा प्रकाजित, िनता को उपलब्ध कराई
िाती हैं;

इन प्रारूप जनयमों पर कोई आपजत्त या सुझाव, यदि कोई हो, जनिेिक (आईडब्ल्यूटी-II), पत्तन, पोत पररवहन
और िलमागग मंत्रालय, कमरा संख्या 545, पररवहन भवन, 1-संसि मागग, नई दिल्ली-110001 को या
dircoord2-psw@gov.in और naveen.deswal@nic.in पर ईमेल द्वारा ऊपर जनर्िगष्ट अवजध के भीतर
भेिे िा सकते हैं;
उि प्रारूप जनयमों के संबंध में दकसी भी व्यजि से जनर्िगष्ट अवजध के भीतर प्राि आपजत्तयों या सुझावों पर
केंद्र सरकार द्वारा जवचार दकया िाएगा।
प्रारूप जनयम
1. संजिि िीषगक और प्रारंभ - (1) इन जनयमों को अन्तिेिीय िलयान (जविेष श्रेणी िलयान: स्ट्वायत्त और
अधग-स्ट्वायत्त) जनयम, 2025 कहा िाएगा।
(2) ये जनयम रािपत्र में इनके अंजतम रूप से प्रकािन की जतजथ से प्रवृत्त होंगे।
2. पररभाषाएँ - (1) इन जनयमों में, िब तक दक संिभग से अन्यथा अपेजित न हो -
(क) "अजधजनयम" से अजभप्रेत है अन्तिेिीय िलयान अजधजनयम, 2021 (2021 का 24);
(ख) "स्ट्वायत्त िलयान" से अजभप्रेत है यांजत्रक रूप से चाजलत अन्तिेिीय िलयान िो जबना चालक िल के या
काफी कम कर्मगयों के साथ प्रचाजलत होता है और जिसकी िूर से जनगरानी और/या जनयंत्रण दकया िाता है;
(ग) "वगीकरण सोसायटी" से अजभप्रेत है अजधजनयम की धारा 3 के खंड (यण) के अथग में कोई मान्यता प्राि
संगिन, िो अंतरागष्ट्रीय वगीकरण सोसायटी संघ का सिस्ट्य है;
(घ) "जनयंत्रण केंद्र" से अजभप्रेत है कोई जनर्िगष्ट तट-आधाररत सुजवधा िो स्ट्वायत्त या अधग-स्ट्वायत्त िलयानों
की वास्ट्तजवक समय जनगरानी और जनयंत्रण के जलए जिम्मेिार होती है;
(ङ) "अनुकूल मौसम" से अजभप्रेत है पवन और समुद्र की उजचत जस्ट्थजत को ििागने वाली अवजध िो भारत के
नौवहन महाजनिेिालय या केंद्र सरकार द्वारा यथा जनधागररत दकसी अन्य प्राजधकरण द्वारा जनर्िगष्ट की िाए;
(च) "जवषम मौसम" से अजभप्रेत है, भारत के नौवहन महाजनिेिालय या केंद्र सरकार द्वारा यथा जनधागररत
दकसी अन्य प्राजधकारी द्वारा जनर्िगष्ट पवन और समुद्र की प्रजतकूल पररजस्ट्थजतयों को ििागने वाली अवजध; और
(छ) "अधग-स्ट्वायत्त िलयान" से अजभप्रेत है, कोई यंत्रचाजलत अन्तिेिीय िलयान जिसमें केंद्रीकृत या उन्नत
स्ट्वचाजलत प्रणाजलयाँ िाजमल हैं, लेदकन प्रचालन और पयगवेिण के जलए चालक िल को िलयान पर ही रखा
िाता है;
(2) इन जनयमों में प्रयुि और पररभाजषत नहीं दकए गए, ककंतु अजधजनयम में पररभाजषत िब्िों और
अजभव्यजियों के वही अथग होंगे िो अजधजनयम में क्रमिः उन्हें जनर्िगष् ट दकए गए हैं।

3. कायगिेत्र और अनुप्रयोग - (1) यांजत्रक रूप से चाजलत अन्तिेिीय िलयानों के जनम्नजलजखत वगों को उनके
पररकल् पना, संजनमागण और उद्देय को ध्यान में रखते हुए जविेष श्रेणी के िलयान माना िाएगा:
(क) पूणगतः स्ट्वायत्त अन्तिेिीय िलयान जिनकी िूर से जनगरानी और/या जनयंत्रण दकया िाता
है;
(ख) केंद्रीकृत जनयंत्रण प्रणाजलयों और िलयान पर चालक िल के साथ अधग-स्ट्वायत्त अन्तिेिीय
िलयान।
(2) इस अजधजनयम के अंतगगत बनाए गए अन्तिेिीय िलयान जनयमों की अपेिाएं उप-जनयम (1) के अनुसरण
में जचजननत जविेष श्रेणी के िलयनों पर लागू होंगी।
(3) पररकल् पना और संजनमागण के मानक-
(क) इन िलयानों की पररकल् पना और संजनमागण के मानक, यथा संिोजधत अन्तिेिीय िलयान
(पररकल् पना और संजनमागण) जनयम, 2024 द्वारा िाजसत होंगे।
(ख) ऐसे िलयानों के स्ट्वचालन संबंधी घटक या अन्य घटक िो उप-जनयम 3(क) के अंतगगत िाजमल नहीं
हैं, उन्हें जनम्नजलजखत द्वारा जनर्िगष्ट मानकों के अनुसार पररकजल्पत और संजनर्मगत दकया िाएगा:
(i) भारतीय मानक ब्यूरो (बीआईएस); या
(ii) एक वगीकरण सोसायटी; या
(iii) अंतरागष्ट्रीय मानक संगिन
(ग) स्ट्वामी, इन जनयमों के प्ररूप संख्या 1 में, पररकल् पना और संजनमागण के जलए अपनाए गए मानकों के संबंध
में एक घोषणा जनर्िगष्ट प्राजधकारी या ऐसे व्यजि या संगिन को प्रस्ट्तुत करेगा िो अजधजनयम की धारा 12 की
उपधारा (4) के अंतगगत राज्य सरकार द्वारा प्रत्यायोजित दकया िाए।
(4) चालक िल-
(क) इन जविेष श्रेणी के िलयानों के जलए चालक िल की अपेिाओं का जनधागरण जनम्नजलजखत बातों को
ध्यान में रखते हुए जनर्िगष्ट प्राजधकारी द्वारा दकए गए िोजखम-आधाररत मूल्यांकन के आधार पर दकया
िाएगा:
(i) स्ट्वचालन का स्ट्तर;
(ii) प्रचालन िेत्र;
(iii) प्रचालन का प्रकार (कागो, यात्री, सवेिण या अन्य);
(iv) यात्रा की अवजध; और
(v) अजतररि प्रणाजलयों की उपलब्धता और पयागिता।

(ख) उप-जनयम (3) में जनजहत दकसी भी बात के होते हुए भी, अधग-स्ट्वायत्त िलयानों में, यथा संिोजधत
अन्तिेिीय िलयान (चालक िल) जनयम, 2022 की धारा 4, उप-धारा (3) के अंतगगत जनधागररत कमी
स्ट्तर के अनुसार कम से कम एक मास्ट्टर, एक इंिन चालक होगा और उसकी एक िीपी रेटटंग होगी।
परंतु यह दक जनर्िगष्ट प्राजधकारी ऐसे िलयानों के जलए मास्ट्टर के अलावा अन्य चालक िल की अपेिा को
कम कर सकता है:
(i) प्रचालन िेत्र के आधार पर; और
(ii) यदि यात्रा अवजध चार घंटे से कम है।
(iii) िलयान सुरिा और जस्ट्थरता
(iv) नौचालन और संचार जवश्वसनीयता; और
(v) अजधजनयम और उसके अंतगगत बनाए गए जनयमों के लागू प्रावधानों का अनुपालन।
(ग) स्ट्वायत्त िलयान, जनर्िगष्ट प्राजधकारी के अनुमोिन के अनुसार िूरस्ट्थ जनगरानी और तट-आधाररत
सहायता के अध्यधीन, जबना चालक िल के प्रचाजलत होंगे।
(घ) जविेष श्रेणी के िलयानों का प्रचालन या पयगवेिण करने वाले चालक िल के जलए प्रजििण और
प्रमाणन अपेिाएं इस प्रकार होंगी:
(i) यथा संिोजधत अन्तिेिीय िलयान (चालक िल) जनयम, 2022 के अनुसार; और
(ii) सिम प्राजधकारी द्वारा समय-समय पर जनधागररत दकसी भी अजतररि प्रजििण, अनुभव या
कौिल अपेिाओं के अध्यधीन।
(ङ) ऐसे मामलों में िहाँ चालक िल िलयान पर मौिूि नहीं है, िलयान और जनर्िगष्ट जनयंत्रण केंद्र के
बीच जनरंतर संचार प्रणाली और वास्ट्तजवक समय जनगरानी अवसंरचना बनाए रखना अजनवायग होगा।
(5) सवेिण एवं प्रमाणन-
उप-जनयम (1) के अनुसरण में जविेष श्रेणी के िलयान के रूप में जचजननत िलयान की पररकल् पना,
संजनमागण और रखरखाव, यथा संिोजधत अन्तिेिीय िलयान (पररकल् पना एवं संजनमागण) जनयम, 2024
के जनयम 4 में जनजहत दकसी भी बात के बाविूि, एक वगीकरण सोसायटी के सवेिण के अंतगगत दकया
िाएगा।
(6) जविेष श्रेणी के िलयानों के जलए अनुपालन की सीमा -
(क) इन जनयमों के लागू होने से पहले प्रचाजलत सभी जवद्यमान अधग-स्ट्वायत्त और स्ट्वायत्त अन्तिेिीय
िलयान, इन जनयमों के प्रवृत्त होने से पहले लागू अपेिाओं का अनुपालन करते रहेंगे;

परंतु यह दक िहां ऐसे िलयान में उसकी नौचालन प्रणाजलयों, प्रणोिन प्रणाजलयों, जनयंत्रण संरचना,
या स्ट्वचाजलत घटकों का कोई बडा रूपांतरण, पररवतगन या प्रजतस्ट्थापन होता है, वहाँ इन जनयमों के
प्रावधान पररवर्तगत प्रणाजलयों या घटकों पर लागू होंगे।
(ख) उप-जनयम (क) में जनजहत दकसी भी बात के होते हुए भी, ऐसे सभी मौिूिा िलयान इन जनयमों
के लागू होने की तारीख से िो वषों के भीतर जनम्नजलजखत से संबंजधत प्रावधानों का अनुपालन करेंगे:
(i) जस्ट्थरता संबंधी िानकारी और फ्रीबोडग की गणना; िैसा दक यथा संिोजधत अन्तिेिीय
िलयान (पररकल् पना और संजनमागण) जनयम, 2024 के जनयम 13 और 15 के अंतगगत जनर्िगष्ट
है।
(ii) अजतररिता, संचार और जवफल न होने वाला तंत्र।
(ग) प्रत्येक नए अधग-स्ट्वायत्त या स्ट्वायत्त अन्तिेिीय िलयान को:
(i) इन जनयमों के प्रावधानों के पूणग अनुपालन में पररकजल्पत, संजनर्मगत, सुसजित, अनुरजित
और प्रचाजलत दकया िाएगा; और
(ii) स्ट्वायत्तता के स्ट्तर, प्रचालन िेत्र और सेवा के प्रकार को ध्यान में रखते हुए, जनर्िगष्ट प्राजधकारी
द्वारा वांजछत सेवा के जलए उपयुिता का मूल्यांकन दकया िाएगा।
(घ) अजधजनयम के अंतगगत दकसी भी नए अधग-स्ट्वायत्त या स्ट्वायत्त अन्तिेिीय िलयान को सवेिण
प्रमाणपत्र तब तक िारी नहीं दकया िाएगा िब तक दक ऐसा िलयान इन जनयमों में जनर्िगष्ट लागू
पररकल् पना, संजनमागण, स्ट्वचालन, नौचालन, सुरिा और जनयंत्रण मानकों का पूणग अनुपालन न करता
हो।
(7) अन्य जविेष श्रेणी जनयमों और जवजनयामक ढाँचों के साथ सामंिस्ट्य-
क. िहाँ दकसी िलयान को इन जनयमों के अंतगगत जविेष श्रेणी िलयान के रूप में जनर्िगष्ट
दकया गया है और वह अजधजनयम के अंतगगत बनाए गए अन्य जविेष श्रेणी जनयमों द्वारा भी
िाजसत होता है, तो उसे सभी लागू जनयमों का उस सीमा तक अनुपालन करना होगा, िहाँ
तक वे असंगत न हों।
ख. जनर्िगष्ट प्राजधकारी या अजधजनयम की धारा 43 के अंतगगत जनयुि प्राजधकारी प्रमुख
कायगकरण, िोजखम रूपरेखा और संजनमागण के आधार पर िलयान के मुख्य वगीकरण का
जनधागरण करेंगे; तथाजप, इन जनयमों के साथ संलग्न प्ररूप संख्या 3 में उपयुिता प्रमाणपत्र
में अन्य सभी जविेष श्रेणी जनयमों और इन िलयानों पर उनके लागू होने की सीमा का
उल्लेख होगा।
4. प्रमाणन और सांजवजधक अपेिाएं - जनयम 3 के उप-जनयम (1) के अनुसरण में, जविेष श्रेणी के िलयान
के रूप में जचजननत िलयान को जनम्नजलजखत अनुपालन सुजनजश्चत करना होगा -

(1) सुरिा उपाय और लोड लाइन आपेिाएं: -
(क) िलयान को इन जनयमों में जनधागररत उसके प्रचालन िेत्र के अनुसार सुरिा जगयर और
उपकरण प्रिान दकए िाएँगे।
(ख) िलयान की अजधकतम वहन िमता इन जनयमों में जनधागररत मानिंडों द्वारा जनधागररत की
िाएगी, जिनमें जनम्नजलजखत िाजमल हो सकते हैं, परंतु यह इन्हीं तक सीजमत नहीं होगा:
(i) उत् ् लावकता सुजनजश्चत करने के जलए सुरिा लोड लाइन या लोड लाइन सीमाओं का
जवजनिेिन;
(ii) इस अजधजनयम के अंतगगत अन्यत्र उपबंजधत ितों के अजतररि ऐसे िलयानों की सुरजित
यात्रा सुजनजश्चत करने के जलए आवयक अन्य ितें।
(ग) िलयान की अजधकतम वहन िमता, उपयुिता प्रमाणपत्र में अंदकत की िाएगी।
(2) अजधकाररयों की जनयुजि और उपयुिता प्रमाणपत्र प्रिान करना: -
राज्य सरकार उतनी संख्या में अजधकाररयों को जनयुक् त या प्राजधकृत करेगी जितनी संख् या में अजधजनयम के
अध्याय VII और इन जनयमों के प्रावधानों के अंतगगत कायागन्वयन और प्रवतगन के प्रयोिनाथग आवयक हो।
(क) प्राजधकृत अजधकारी को जनम्नजलजखत अजधकार होंगे:
(i) इन िलयानों के उपयुिता प्रमाणन हेतु आवेिन प्राि करना और उन पर कारगवाई करना;
(ii) जनरीिण और सवेिण करना;
(iii) उपयुिता प्रमाणपत्र िारी करना, जनलंजबत करना या रद्द करना; और
(iv) इन जनयमों के अंतगगत इनकार, जनलंबन, रद्दीकरण या प्रवतगन संबंधी की गई अन्य कारगवाइयों के
कारणों को ररकॉडग करना और उनका रखरखाव करना।
(ख) दकसी भी यंत्रीकृत प्रणोदित अंतिेिीय िलयान के स्ट्वामी, प्रचालक या मास्ट्टर द्वारा इन जनयमों के साथ
संलग्न प्ररूप संख्या 2 के अनुसार आवेिन दकए िाने पर, प्राजधकृत अजधकारी िलयान की वहन िमता ििागते
हुए एक उपयुिता प्रमाणपत्र िारी करेगा, बिते दक वह संतुष्ट हो िाए दक िलयान:
(i) जनधागररत सुरिा, अवसंरचना और जस्ट्थरता मानकों को पूरा करता है;
(ii) अपेजित सुरिा उपकरणों से सुसजित है;
(iii) उस पर यथा लागू उपयुि लोड लाइन जचनन अंदकत हैं, और
(iv) अंतिेिीय िलयान अजधजनयम, 2021 और इन जनयमों के प्रावधानों का अनुपालन करता है,
(ग) इन जनयमों के साथ संलग्न प्ररूप संख्या 3 में उपयुिता प्रमाणपत्र, इन जनयमों में जनधागररत ितों को पूरा
करने के अध् यधीन िारी दकया िाएगा, जिनमें जनम्नजलजखत िाजमल हो सकते हैं, लेदकन यह इन्हीं तक सीजमत
नहीं होगा:
(i) एक वैध सवेिण और बीमा प्रमाणपत्र का होना;
(ii) लागू िुल्क का भुगतान;
(iii) नवीनीकरण हेतु प्रदक्रयाएँ

(iv) जनरीिण अपेिाएं, जिनमें यथा संिोजधत अंतिेिीय पोत सवेिण एवं प्रमाणन जनयम, 2022 में
उजल्लजखत के अजतररि वार्षगक या राज्य सरकार द्वारा जनर्िगष्ट अन्य कालावजधयां िाजमल हैं; और
(v) पररचालन प्रजतबंध।
(घ) इन जनयमों के साथ संलग्न प्ररूप संख्या 2 में उपयुिता प्रमाणपत्र हेतु आवेिन का एक आििग प्रारूप और
इन जनयमों के साथ संलग्न प्ररूप संख्या 3 में उपयुिता प्रमाणपत्र राज्य सरकारों के संिभग एवं उनके द्वारा
अपनाने हेतु संलग्न है तादक इन जनयमों में एकरूपता सुजनजश्चत की िा सके।
(ङ) एकाजधक जविेष श्रेणी जनयमों के जलए एकल उपयुिता प्रमाणपत्र:
िहाँ कहीं कोई िलयान एकाजधक जविेष श्रेणी िलयान जनयमों के अजधकार िेत्र में आता है, वहाँ उसके संबंध
में एक ही उपयुिता प्रमाणपत्र िारी दकया िाएगा। इस प्रमाणपत्र में इन जनयमों के जनयम 3 के उप-जनयम
(7) के अनुसार अपेिाएं समादिष् ट होंगी।
(3) अंतर-राज्यीय प्रचालन और िजियाँ/जिम्मेिाररयाँ: -
(क) गृह राज्य, जविेष श्रेणी के िलयान के जलए उपयुिता प्रमाणपत्र िारी करने का एकमात्र प्राजधकारी
होगा।
(ख) गृह राज्य द्वारा िारी वैध उपयुिता प्रमाणपत्र धारक ऐसे िलयानों को दकसी अन्य राज्य से
डुज्लकेट या अलग प्रमाणीकरण की आवयकता के जबना उसमे प्रचालन की अनुमजत होगी, बिते दक:
(i) गृह राज्य द्वारा िारी उपयुिता प्रमाणपत्र उस राज्य द्वारा स्ट्वीकार दकया िाता है जिसमें पोत
का पररचालन अजभप्रेत है; और
(ii) प्रचालन के अजभप्रेत राज्य को पूवग सूचना िी गई हो, और उस राज्य द्वारा लगाई गई दकसी भी
ितग का जवजधवत अनुपालन दकया िाता हो।
(ग) केंद्र सरकार, गृह राज्य द्वारा िारी उपयुिता प्रमाणपत्रों के जवजधमान् यकरण और सत्यापन के जलए
अंतर-राज्यीय डाटा जवजनमय तंत्र को सुगम बनाएगी, िो इस अजधजनयम और अंतिेिीय िलयान (केंद्रीय
डाटाबेस और संबद्ध मामले) जनयम 2024 के तहत जवकजसत केंद्रीय डेटाबेस पोटगल 'िलयान' और 'नाजवक'
के माध्यम से होगा, जिससे सभी राज्यों में जविेष श्रेणी के पोतों का जनबागध प्रचालन संभव हो सकेगा।
(4) सवेिक द्वारा जनरीिण: -
(क) अजधजनयम के अंतगगत जनयुि कोई सवेिक, जनधागररत सवेिण के प्रयोिन के अलावा, दकसी भी
उजचत समय पर जनरीिण के प्रयोिनाथग दकसी जविेष श्रेणी के िलयान पर प्रवेि कर सकता है। ऐसे
जनरीिण में जनम्नजलजखत की िाँच िाजमल हो सकती है, परंतु ये इन्हीं तक सीजमत नहीं होगा:
(i) पतवार;
(ii) उपकरण;
(iii) मिीनरी; और
(iv) िलयान का कोई भाग या सामग्री।
(ख) स्ट् वामी, प्रचालक, एिेंट, मास्ट्टर या पोत का प्रभारी कोई भी व्यजि:
(i) जनरीिण या सवेिण करने के जलए सवेिक को सभी आवयक पहुँच और सुजवधाएँ प्रिान करेगा;
और
(ii) पोत, उसकी मिीनरी, उपकरण या उसके दकसी भाग के बारे में ऐसी िानकारी प्रिान करेगा,
जिसकी सवेिक या दकसी भी प्राजधकृत अजधकारी यथोजचत रूप से अपेिा करे।

(5) अनुपालन का प्रवतगन और उपयुक् तता प्रमाण पत्र का जनलंबन या रद्दीकरण -
(क) इन जनयमों के अनुसरण में, जविेष श्रेणी के िलयान के रूप में जचजननत कोई िलयान, इन जनयमों
की अजधसूचना की जतजथ से बारह महीने की अवजध के भीतर इन जनयमों के साथ संलग् न प्ररूप सं. 2 में
उपयुक् तता प्रमाणपत्र प्राि करेगा।
(ख) यदि इन जनयमों के अंतगगत जविेष श्रेणी के िलयान के रूप में जचजननत दकसी यंत्रीकृत प्रणोदित
अन्तिेिीय िलयान को अजधजनयम या उसके अधीन बनाए गए जनयमों के उपबंधों का अनुपालन नहीं
दकया िाता है, तो राज्य सरकार, िलयान के स्ट्वामी, प्रचालक, मास्ट्टर या प्रभारी व्यजि को सुधार का
नोरटस िारी कर सकती है, जिसमें अनुपालन न करने का स्ट् वरूप और वह समय सीमा जनर्िगष्ट की
िाएगी जिसके भीतर ऐसा त्रुरट सुधार पूरा दकया िाना होगा।
(ग) यदि अजधजनयम की धारा 46 की उपधारा (1) के अंतगगत िारी नोरटस में जनर्िगष्ट समय के बाि भी
अनुपालन न दकया िाना िारी रहता है, तो राज्य सरकार, संबंजधत व्यजि को सुनवाई का अवसर िेने
और जलजखत में कारण ििग करने के पश्चात, इन जनयमों के अंतगगत ऐसे िलयान को दिए गए उपयुक् तता
प्रमाणपत्र को जनलंजबत या रद्द कर सकती है।
(घ) कोई िलयान, जिसका इस अजधजनयम की धारा 46 की उपधारा (2) के अधीन उपयुक् तता
प्रमाणपत्र जनलंजबत या रद्द कर दिया गया है, वह:
(i) तब तक प्रचालन बंि रखेगा िब तक दक उक् त जनलंबन वापस नहीं ले जलया िाता; या
(ii) रद्दीकरण की जस्ट्थजत में, तब तक प्रचालन बंि रखेगा इस अध्याय के उपबंधों के अनुसार इन
जनयमों के साथ संलग् न प्ररूप सं. 3 में नया उपयुक् तता प्रमाणपत्र प्रिान नहीं कर दिया िाता।
(6) अपील-
राज्य सरकार इन जनयमों के अधीन जिकायत जनवारण के जलए एक अपीलीय प्राजधकारी जनयुि करेगी।
असंतुष् ट आवेिक, उपयुिता प्रमाण-पत्र अस्ट्वीकार करने, जनलंजबत करने या रद्द करने के जनणगय के जवरुद्ध
ऐसे आिेि की सूचना की जतजथ से 30 दिन के भीतर राज्य सरकार के जनर्िगष्ट अपीलीय प्राजधकारी के समि
अपील िायर कर सकता है।
5. िलयान के स्ट्वामी के िाजयत्व - (1) िलयान का सुरजित प्रचालन-
सुरजित प्रचालन ितों के अनुपालन के अध् यधीन, िलयान का स्ट्वामी राज्य सरकार के प्राजधकृत अजधकारी
द्वारा िारी उपयुक् तता प्रमाणपत्र में जनर्िगष्ट प्रचालन ितों का पालन करेगा।
(2) अनुपालन न करने संबंधी िाजस्ट्तयां

(क) िलयान का स्ट्वामी इन जनयमों के अजतररि अजधजनयम और उसके अंतगगत बनाए गए जनयमों के सभी
संगत उपबंधों का अनुपालन सुजनजश्चत करेगा। इन िलयानों के जलए अन्तिेिीय िलिेत्र में प्रचालन हेतु
जनम्नजलजखत वैध िस्ट्तावेज़ अजनवायग हैं:
(i) पंिीकरण प्रमाणपत्र।
(ii) सवेिण प्रमाणपत्र।
(iii) बीमा पॉजलसी।
(iv) उपयुक् तता प्रमाणपत्र।
(v) प्रिूषण रोकथाम प्रमाणपत्र।
(ख) स्ट्वामी को उपरोि सभी अपेजित िस्ट्तावेि हर समय उपलब्ध कराने होंगे और उन् हें अजधजनयम के संगत
उपबंधों के तहत राज्य सरकार द्वारा जनयुि अजधकाररयों या प्राजधकाररयों के मांगे िाने पर प्रस्ट्तुत करना होगा।
(ग) इन जनयमों के दकसी भी प्रावधान का पालन न करने पर स्ट्वामी ऐसी िाजस्ट्त, िुमागने का िायी होगा या
उसका जवरूद्ध अन्य कारगवाई की िा सकेगी, िो अन्तिेिीय पोत अजधजनयम, 2021 की धारा 87 के तहत
अजधरोजपत की िाए।
6. करिनाइयों को िूर करने की िजि- केन्द्रीय सरकार, रािपत्र में आिेि द्वारा, इन जनयमों के कायागन्वयन में
दकसी भी करिनाई को िूर करने के जलए जनिेि िारी कर सकेगी।

NOTIFICATION
New Delhi, the 14th October, 2025
G.S.R. 754(E).—The draft of the Inland Vessels (Special Category Vessels: Autonomous
and Semi-Autonomous) Rules, 2025, which the Central Government proposes to make, in exercise
of the powers conferred under clause (a) of sub-section (1) of section 98 and sub-section (1) and
(2) of section 42 read with clause (zh) of sub-section (2) of section 106 of the Inland Vessels Act,
2021, is hereby published as required by sub-section (1) of section 106 of the said Act for
information of all persons likely to be affected thereby; and notice is hereby given that the said
draft rules shall be taken into consideration after the expiry of thirty days from the date on which
the copies of this notification, as published in the Official Gazette, are made available to the public;
Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT-II), Ministry
of Ports, Shipping & Waterways, Room No. 545, Transport Bhawan, 1-Parliament Street, New

The objections or suggestions which may be received from any person concerning the said draft
rules, within the period so specified will be considered by the Central Government.
DRAFT RULES
1. Short title and commencement. (1) These Rules may be called the Inland Vessels (Special
Category Vessels: Autonomous and Semi-Autonomous) Rules, 2025.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. Definitions. - (1) In these rules, unless the context otherwise requires -
(a) “Act” means the Inland Vessels Act, 2021 (24 of 2021);
(b) “autonomous vessels” means a mechanically propelled inland vessel that operates without
onboard crew or significantly reduced manning and is remotely monitored and/or controlled;
(c) “classification society” means a recognized organization within the meaning of clause (zo) of
section 3 of the Act, which is a member of International Association of Classification Societies;
(d) "control centre" means a designated shore-based facility responsible for the real-time
monitoring and control of autonomous or semi-autonomous vessels;
(e) "fair season" means the period showing fair conditions of wind and sea as may be specified by
the Directorate General of Shipping, India or by such other authority as may be prescribed by
Central Government;
(f) “foul season” means the period showing foul conditions of wind and sea as may be specified by
the Directorate General of Shipping, India or by such other authority as may be prescribed by
Central Government; and

(g) “semi-autonomous vessels” means a mechanically propelled inland vessel that incorporates
centralized or advanced automated systems but retains onboard crew for operation and
supervision;
(2) Words and expressions used and not defined in these rules but defined in the Act, shall have
the meanings respectively assigned to them in the Act.
3. Scope and application. - (1) The following classes of mechanically propelled inland vessels
shall be considered as special category vessels, considering their design, construction, and purpose:
(a) Fully autonomous inland vessels which are remotely monitored and/or controlled;
(b) Semi-autonomous inland vessels with centralized control systems and onboard crew.
(2) The requirements in the Inland Vessels rules framed under the Act shall apply to special
category vessels identified pursuant to sub-rule (1).
(3) Standards for design and construction-
(a) The standards for design and construction of these vessels shall be governed by Inland
Vessels (Design and construction) Rules, 2024, as amended.
(b) The automation related components or other components of such vessels not covered under
sub rule 3(a) shall be designed, and constructed in accordance with the standards specified by:
(i) Bureau of Indian Standards (BIS); or
(ii) a classification society; or
(iii) International Standards Organisation
(c) The owner shall furnish a declaration regarding standards for design and construction
followed, in Form No. 1 of these rules to the designated authority or such person or
organization, as may be delegated by the State Government under sub-section (4) of section
12 of the Act.
(4) Manning-
(a) The manning requirements for these special category vessels shall be determined based on
a risk-based assessment conducted by the designated authority, taking into account:
(i) the level of automation;
(ii) the operating zone;
(iii) the type of operation (cargo, passenger, survey or otherwise);
(iv) the duration of the voyage; and
(v) the availability and adequacy of redundancy systems.
(b) Notwithstanding anything contained in sub-rule (3), semi-autonomous vessels shall carry
at least one Master, one Engine Driver, and one GP Rating in accordance with the manning
scale prescribed under section 4, sub-section (3) of the Inland Vessels (Manning) Rules, 2022,
as amended.
Provided that the designated authority may reduce the crew requirement, other than the
Master, for such vessels:
(i) based on the zone of operation; and
(ii) if the voyage duration is less than four hours.

(iii) vessel safety and stability
(iv) navigation and communication reliability; and
(v) compliance with the applicable provisions of the Act and rules made thereunder.
(c) Autonomous vessels shall operate without onboard crew subject to remote monitoring and
shore based support in accordance with approval by designated authority.
(d) The training and certification requirements for crew operating or supervising special
category vessels shall be:
(i) as per the Inland Vessels (Manning) Rules, 2022, as amended; and
(ii) subject to any additional training, experience, or skill requirements that the competent
authority may prescribe from time to time.
(e) In cases where crew are not physically present onboard, it shall be mandatory to maintain
continuous communication systems, and real-time monitoring infrastructure between the
vessel and the designated control centre.
(5) Survey and Certification-
The vessel identified as special category vessel pursuant to sub-rule (1), shall be designed,
constructed, and maintained under the survey of a classification society, notwithstanding anything
contained in rule 4 of the Inland Vessels (Design and Construction) Rules, 2024, as amended.
(6) Threshold of Compliance for Special Category Vessels-
(a) All existing semi-autonomous and autonomous inland vessels operating prior to the
commencement of these rules shall continue to comply with the requirements that were
applicable before the coming into force of these rules;
Provided that where such a vessel undergoes a major conversion, modification, or replacement
of its navigation systems, propulsion systems, control architecture, or automated components,
the provisions of these rules shall apply to the altered systems or components.
(b) Notwithstanding anything contained in sub-rule (a), all such existing vessels shall within
two years from the date of commencement of these rules, comply with the provisions relating
to:
(i) stability information and calculation of freeboard; as specified under rules 13 and 15 of
Inland Vessels (Design and construction) Rules, 2024, as amended.
(ii) redundancy, communication, and fail-safe mechanisms.
(c) Every new semi-autonomous or autonomous inland vessel shall be:
(i) designed, constructed, equipped, maintained, and operated in full compliance with the
provisions of these rules; and
(ii) assessed for fitness for intended service by the designated authority, taking into account
the level of autonomy, zone of operation, and type of service.

(d) No certificate of survey shall be issued under the Act to any new semi-autonomous or
autonomous inland vessel unless such vessel is in full compliance with the applicable design,
construction, automation, navigation, safety, and control standards specified in these rules.
(7) Harmonization with other special category rules and regulatory frameworks-
a. Where a vessel is designated as a special category vessel under these rules and is
also governed by other special category rules framed under the Act, it shall
comply with all applicable rules to the extent they are not inconsistent.
b. The Designated Authority or authorities appointed under Section 43 of the Act
shall determine the principal classification of the vessel based on dominant
functionality, risk profile, and construction; however, the certificate of fitness in
Form No. 3 appended to these rules shall have mention of all other special
category rules and their extent of application on these vessels.
4. Certification and statutory requirements.- The vessel identified as special category vessel
pursuant to sub-rule (1) of rule 3, shall ensure following compliances -
(1) Safety Measures and Load line Requirements: -
(a) The vessel shall be provided with safety gear and equipment in accordance with its area of
operation as prescribed in these rules.
(b) The maximum carrying capacity of the vessel shall be determined by such criteria as may
be prescribed in these rules, which may include but not limited to:
(i) the specification of a safety load line or load line limits to ensure buoyancy;
(ii) other condition necessary to ensure the safe voyage of such vessel, in addition to those
provided elsewhere under the Act.
(c) The maximum carrying capacity of the vessel shall be endorsed in the certificate of fitness.
(2) Appointment of officers and grant of certificate of fitness: -
The State Government shall appoint or authorize such number of officers, as may be necessary for
the purpose of implementation and enforcement of the provisions under the Chapter VII of the Act
and these rules.
(a) The authorized officer shall be empowered to:
(i) receive and process applications for fitness certification of these vessels;
(ii) conduct inspections and surveys;
(iii) issue, suspend, or cancel certificates of fitness; and
(iv) record and maintain reasons for refusal, suspension, cancellation, or other enforcement
actions taken under these rules.
(b) Upon an application made by the owner, operator, or master of any mechanically propelled
inland vessel, as per Form No. 2 appended to these Rules, the authorized officer shall issue a
certificate of fitness indicating the carrying capacity of the vessel, upon being satisfied that the
vessel:
(i) meets the prescribed safety, structural, and stability standards;
(ii) is equipped with the requisite safety equipment;

(iii) bears appropriate load line markings, as applicable; and
(iv) complies with the provisions of the Inland Vessels Act, 2021 and these rules,
(c) The certificate of fitness in Form No. 3 appended to these rules shall be issued subject to
fulfilment of such conditions as may be prescribed in these rules, which may include but not
limited to:
(i) possession of a valid survey and insurance certificate;
(ii) payment of applicable fees;
(iii) procedures for renewal
(iv) inspection requirements, including annual or such other periodicity as may be specified
by the State Government over and above the Inland Vessels Survey and Certification Rules
2022 as amended; and
(v) operational restrictions.
(d) A model format of the application for certificate of fitness in Form No. 2 appended to these
rules and the certificate of fitness in Form No. 3 appended to these rules is annexed for
reference and adoption by State Governments for uniformity with these rules.
(e) Single certificate of fitness for multiple special category rules:
Wherever a vessel falls within the jurisdiction of more than one set of Special Category Vessel
Rules, a single Certificate of Fitness shall be issued in respect thereof. This certificate shall
incorporate the requirements and in accordance with sub-rule (7) of rule 3 of these rules.
(3) Inter-State Operation and powers/responsibilities: -
(a) the home State shall be the sole authority for issuing the certificate of fitness for a special
category vessel.
(b) Such vessels holding a valid certificate of fitness issued by the home State shall be
permitted to operate in any other State, without requiring a duplicate or separate certification
from other State, provided that:
(i) the certificate of fitness issued by the home State is accepted by the State in which the
vessel is intended to be operated; and
(ii) prior intimation is given to the intended State of operation, and any conditions imposed
by that State are duly complied with.
(c) The Central Government shall facilitate Inter-state data exchange mechanisms for the
validation and verification of Certificates of Fitness issued by the home State, shall be through
‘Jalyan’ and ‘Navic’, Central database portal, developed under the Act and Inland Vessels
(Central Database and Allied Matters) Rules 2024, enabling seamless operation of special
category vessels across States. (4) Inspection by Surveyor: -
(a) A surveyor appointed under the Act, other than for the purpose of a scheduled survey, may
at any reasonable time, board a special category vessel for the purpose of inspection. Such
inspection may include, but not be limited to, examination of:
(i) the hull;
(ii) equipment;
(iii) machinery; and
(iv) any part or properties of the vessel.

(b) The owner, operator, agent, master, or any person in charge of the vessel shall:
(i) provide all necessary access and facilities to the surveyor for conducting the inspection
or survey; and
(ii) furnish such information regarding the vessel, its machinery, equipment, or any part
thereof, as the surveyor or any authorized officer may reasonably require.
(5) Enforcement of Compliance and Suspension or Cancellation of Certificate of Fitness: -
(a) A vessel identified as a special category vessel pursuant to these rules shall obtain the
certificate of fitness in Form No. 2 appended to these rules within a period of twelve months
from the date of commencement of these rules.
(b) If any mechanically propelled inland vessel identified as a special category vessel under
these rules is found to be in non-compliance with the provisions of the Act or the rules made
thereunder, the State Government may issue a notice of rectification to the owner, operator,
master, or person in charge of the vessel, specifying the nature of non-compliance and the time
within which such rectification must be completed.
(c) In the event that the non-compliance continues beyond the time specified in the notice
issued under sub-section (1) of section 46 of the Act the State Government may after giving
the concerned person an opportunity to be heard and recording reasons in writing suspend or
cancel the Certificate of Fitness granted to such vessel under these rules.
(d) A vessel whose certificate of fitness has been suspended or cancelled under sub-section (2)
of section 46 of the Act shall:
(i) cease to operate until such suspension is revoked; or
(ii) in the event of cancellation, cease to operate until a new certificate of fitness in Form
No. 3 appended to these rules is granted in accordance with the provisions of this Chapter.
(6) Appeal: -
State Government shall appoint an appellate authority for grievance redressal under these rules.
An aggrieved applicant may file an appeal against the decision of refusal, suspension or
cancellation of fitness certificate to the designated appellate authority of the State Government
within 30 days from the date of communication of such order.
5. Obligations of the Owner of vessel. – (1) Safe operation of vessel -
Subject to compliance with safe operating conditions, the owner shall adhere to the operational
conditions specified in the certificate of fitness granted by the authorized officer of State
Government.
(2) Penalties for Non-Compliance-
(a) The owner of the vessel shall ensure compliances with all relevant provisions of the Act and
rules framed thereunder applicable to them in addition to these rules. The following valid
documents are mandatory for these vessels for plying in Inland Waters:
(i) Certificate of Registration;
(ii) Certificate of Survey;
(iii) Insurance Policy;

(iv) Certificate of Fitness; and
(v) Certificate of Prevention of Pollution.
(b) The owner shall make available all the above requisite documents at all times and shall produce
the same on demand to the officers or authorities appointed by the State Government under relevant
provisions of the Act.
(c) Failure to comply with any provision of these rules shall render the owner liable to penalties,
fines, or other actions as may be imposed under section 87 of the Inland Vessels Act, 2021.
6. Power to Remove Difficulties. - The Central Government may, by order in the Official Gazette,
issue directions to remove any difficulty in implementation of these rules.
