सा.का.जन. 704(अ).— अंतिेिीय िलयान (जविेष श्रेणी िलयान: वुडन, िीआरपी/एफआरपी और
समान सामग्री) जनयम, 2025 का प्रारूप को, जिसे केंद्र सरकार, अंतिेिीय िलयान अजधजनयम, 2021 की धारा
106 की उपधारा (2) के खंड (यझ) के साथ परित धारा 42 की उपधारा (1) और (2) तथा धारा 98 की
उपधारा (1) के खंड (क) के तहत प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती है, उि अजधजनयम
की धारा 106 की उपधारा (1) के द्वारा यथा अपेजित इससे प्रभाजवत होने वाले सभी व्यजियों की िानकारी के
जलए एतद्द्वारा प्रकाजित करती है; और एतद्द्वारा सूचना िी िाती है दक उि प्रारूप जनयमों पर उस तारीख से तीस
दिन की समाजि के पश्चात जवचार दकया िाएगा, जिस दिन इस अजधसूचना की, रािपत्र में यथा प्रकाजित,
प्रजतयां िनता को उपलब्ध कराई िाती हैं;
इन मसौिा जनयमों पर कोई आपजत्त या सुझाव, यदि कोई हो, जनिेिक (आईडब्ल्यूटी-II), पत्तन, पोत पररवहन

उि मसौिा जनयमों के संबंध में दकसी भी व्यजि से जनर्िगष्ट अवजध के भीतर प्राि आपजत्तयों या सुझावों पर केंद्र
सरकार द्वारा जवचार दकया िाएगा।
प्रारुप जनयम
1. संजिि िीषगक और प्रारंभ- (1) इन जनयमों को अंतिेिीय िलयान (जविेष श्रेणी िलयान: लकडी,
िीआरपी/एफआरपी और समान सामग्री) जनयम, 2025 कहा िाएगा।
(2) ये जनयम रािपत्र में इनके अंजतम रुप से प्रकािन की जतजथ से प्रवृत होंगे।
2. पररभाषाएँ - (1) इन जनयमों में, िब तक दक संिभग से अन्यथा अपेजित न हो -
(क) "अजधजनयम" से अंतिेिीय िलयान अजधजनयम, 2021 (2021 का 24) अजभप्रेत है;
(ख) "वगीकरण सजमजत" से अजधजनयम की धारा 3 के खंड (यण) के अथग में एक मान्यता प्राि संगिन अजभप्रेत है,
िो अंतरागष्ट्रीय वगीकरण सजमजतयों के संघ का सिस्ट्य है।
(ग) "अनुकूल मौसम" से पवन और समुद्र की अनुकूल ििा ििागने वाली अवजध अजभप्रेत है, िैसा दक भारत के
नौवहन महाजनिेिालय या केंद्र सरकार द्वारा जवजहत दकसी अन्य प्राजधकरण द्वारा जनर्िगष्ट िाए;
(घ) "जवषम मौसम" से पवन और समुद्र की जवषम ििा को ििागने वाली अवजध अजभप्रेत है, िैसा भारत के
नौवहन महाजनिेिालय या केन्द्रीय सरकार द्वारा जवजहत ऐसे अन्य प्राजधकरण द्वारा जनर्िगष्ट दकया िाए।
(2) इन जनयमों में प्रयुि तथा पररभाजषत नहीं दकए गए दकन्तु अजधजनयम में पररभाजषत िब्िों और
अजभव्यजियों से क्रमि: वही अजभप्रेत होगा िो अजधजनयम में उनके जलए जनर्िगष्ट हैं।
3. कायगिेत्र और प्रयोग– (1) जनम्नजलजखत यंत्रचाजलत अंतिेिीय िलयानों को उनकी जनमागण सामग्री के आधार
पर इन जनयमों के प्रयोिनों के जलए जविेष श्रेणी के िलयान के रूप में वगीकृत दकया िाएगा-
(क) पूणगतः या अजधकांितः (संरचनात्मक भार का 40% या अजधक) वुडन से जनर्मगत िलयान;
(ख) पूणगतः या अजधकांितः (संरचनात्मक भार का 40% या अजधक) कांच-प्रबजलत प्लाजस्ट्टक (िीआरपी),
फाइबर-प्रबजलत प्लाजस्ट्टक (एफआरपी), या अन्य समरूप जमजश्रत सामजग्रयों से जनर्मगत िलयान, जिसमें उच्च गजत
वाले िलयान, लैंडडंग िलयान, होवरक्राफ्ट, हाइड्रोफॉइल और स्ट् माल वॉटर लेन जववन हल (एसडब्ल्यूएटीएच)
िलयान िाजमल हैं, परंतु ये इन्हीं तक सीजमत नहीं हैं;
परन् तु यह दक ये जनयम अंतिेिीय िलयान (जविेष श्रेणी: प् लेिर क्राफ्ट एंड कैनल क्रूि बोवस) जनयम, 2025 के
अंतगगत आने वाले प् लेिर क्राफ्ट एंड कैनल क्रूि बोवस पर लागू नहीं होंगे।
(2) जनम्नजलजखत जनयम और उसके बाि के संिोधन उपजनयम (1) में जविेष श्रेणी के िलयानों के रूप में नाजमत
िलयानों पर लागू होंगे-
(क) अंतिेिीय िलयान (पंिीकरण और अन्य तकनीकी मुद्दे) जनयम, 2022;
(ख) अंतिेिीय िलयान (सवेिण और प्रमाणन) जनयम, 2022;
(ग) अंतिेिीय िलयान (अजििमन उपकरण) जनयम, 2022;
(घ) अंतिेिीय िलयान (िीवन रिक उपकरण) जनयम, 2022;
(ङ) अंतिेिीय िलयान (प्रिूषण की रोकथाम और जनयंत्रण) जनयम, 2022;

(च) अंतिेिीय िलयान (सुरजित नौचालन, संचार और जसग् नल् स) जनयम, 2022;
(छ) अंतिेिीय (चालन िल) जनयम, 2022;
(ि) अंतिेिीय िलयान (बीमा, सेवा प्रिाताओं और सेवा उपयोगकतागओं के िाजयत्व और िेयता की
पररसीमा) जनयम, 2022;
(झ) अंतिेिीय िलयान (केंद्रीय डाटाबेस और सहबद्ध मामले) जनयम, 2024; और
(ञ) अंतिेिीय िलयान (पररवतगन और आिोधन के जलए पूवग अनुमोिन), जनयम 2025।
(3) जडिाइन और जनमागण के जलए मानक-
(क) अंतिेिीय िलयान (पररकल् पना और संजनमागण) जनयम, 2024, यथा संिोजधत, अध्याय II से IV और
अध्याय IX में जनजहत प्रावधान, िहाँ तक ये उपजनयम (1) में जविेष श्रेणी के िलयान के रूप में जनर्िगष् ट
िलयान के जलए लागू हैं।
(ख) वैकजल्पक रूप से, उपयुगि जनयमों के दकसी भी प्रावधान के स्ट्थान पर, नाजमत प्राजधकारी जनम्नजलजखत
द्वारा जनर्िगष्ट मानकों पर जवचार कर सकता है:
(i) भारतीय मानक ब्यूरो या अंतरागष्ट्रीय मानक संगिन; या
(ii) एक वगीकरण सोसायटी
(ग) स्ट्वामी इन जनयमों के प्ररूप संख्या 1 में, पररकल् पना और संजनमागण के जलए अपनाए गए मानकों के
संबंध में एक घोषणा, नाजमत प्राजधकारी या ऐसे व्यजि या संगिन को प्रस्ट्तुत करेगा, िैसा अजधजनयम की
धारा 12 की उप-धारा (4) के तहत राज्य सरकार द्वारा प्रत्यायोजित दकया िाए।
(4) उप-जनयम (1) के अनुसरण में श्रेणी के िलयान के रूप में जचजन्हत िलयान को, इन िलयानों पर लागू
वगीकरण के आधार पर, अंतिेिीय िलयान (पररकल् पना और संजनमागण) जनयम, 2024 के जनयम 4 और इसके
उत्तरवती के संिोधनों के अनुसार, प्राजधकारी के सवेिण और पयगवेिण के तहत पररकल् पना, संजनमागण और
अनुरिण दकया िाएगा:
परन् तु यह दक, यदि िलयान का स्ट्वामी स्ट्वेच्छा से िलयान का संजनमागण और अनुरिण दकसी वगीकरण
सोसायटी के सवेिण के अंतगगत कराने का जनणगय लेता है, तो ऐसी वगीकरण सोसायटी द्वारा दकया गया सवेिण,
अजधजनयम की धारा 12 की उपधारा (4) के अंतगगत राज्य सरकार द्वारा यथा प्रत्यायोजित नाजमत प्राजधकारी या
ऐसे व्यजि या संगिन द्वारा दकए गए सवेिण के अजतररि होगा।
(5) लकडी, िीआरपी, एफआरपी या समान सामजग्रयों से संजनर्मगत और इन जनयमों के अंजतम रूप से प्रकािन की
जतजथ से पहले प्रचाजलत दकए िा रहे सभी जवद्यमान िलयान, यथासंिोजधत अंतिेिीय िलयान (पररकल् पना
और संजनमागण) जनयम, 2024 के जनयम 5 का अनुपालन करेंगे।
(6) अन्य जविेष श्रेणी जनयमों और जवजनयामक ढाँचों के साथ सामंिस्ट्य-
(क) िहाँ दकसी िलयान को इन जनयमों के अंतगगत जविेष श्रेणी पोत के रूप में नामोदद्दष् ट दकया गया है
और वह अजधजनयम के अंतगगत बनाए गए अन्य जविेष श्रेणी जनयमों द्वारा भी िाजसत है, वहाँ उसे उप-
धारा (2) के अंतगगत उजल्लजखत जनयमों के सभी लागू प्रावधानों और उन जविेष श्रेणी जनयमों का, िहाँ
तक वे असंगत न हों, अनुपालन करना होगा।

(ख) सिम प्राजधकारी प्रमुख कायगिमता, िोजखम प्रोफाइल और जनमागण के आधार पर िलयान के मुख्य
वगीकरण का जनधागरण करेगा; तथाजप, दफटनेस प्रमाणपत्र में अन्य सभी जविेष श्रेणी जनयमों और इन
िलयानों पर उनके लागू होने की सीमा का उल्लेख होगा।
(ग) इन जनयमों के लागू मानकों के अपेिाकृत अजधक किोर मानक तब तक लागू रहेंगे िब तक दक
जनर्िगष्ट प्राजधकारी द्वारा छूट न िी िाए।
4. प्रमाणन और वैधाजनक आवश्यकताएँ- जनयम 3 के उप-जनयम (1) के अनुसरण में जविेष श्रेणी िलयान के रूप
में जचजन्हत िलयान को जनम्नजलजखत अनुपालन सुजनजश्चत करना होगा: -
(1) सुरिा उपाय और लोड लाइन अपेिाएं -
(क) िलयान को संबंजधत राज्य सरकार द्वारा जनधागररत उसके प्रचालन िेत्र के अनुसार सुरिा जगयर और
उपकरण प्रिान दकए िाएँगे।
(ख) िलयान की अजधकतम वहन िमता राज्य सरकार द्वारा जवजहत मानिंडों द्वारा जनधागररत की िाएगी,
जिनमें जनम्नजलजखत िाजमल हो सकते हैं, परंतु यह इन्हीं तक सीजमत नहीं होंगे:
(i) उत्प्लावन सुजनजश्चत करने के जलए सुरिा लोड लाइन या लोड लाइन सीमाओं का जवजनिेिन;
(ii) ऐसे िलयान की सुरजित यात्रा सुजनजश्चत करने के जलए इस अजधजनयम के तहत अन्यत्र उपबंजधत
ितों के अजतररक् त आवश्यक अन्य ितें।
(ग) िलयान की अजधकतम वहन िमता को दफटनेस प्रमाणपत्र में प्रमाजणत दकया िाएगा।
(घ) नाजमत प्राजधकारी, इन िलयानों के संबंध में, टकराव बल्कहेड की अपेिा से छूट प्रिान कर सकता है,
परन् तु दक वैकजल्पक सुरिा उपाय, जिन्हें प्राजधकारी द्वारा पयागि और उजचत समझा िाए, समतुल्य या उन्नत
सुरिा मानकों को सुजनजश्चत करने के जलए जवजधवत रूप से लागू दकए िाएंगे।
(2) अजधकाररयों की जनयुजि और दफटनेस प्रमाणपत्र प्रिान करना-
राज्य सरकार, अजधजनयम के अध्याय VII और इन जनयमों के प्रावधानों के कायागन्वयन और प्रवतगन के प्रयोिनाथग
उतनी संख् या में अजधकाररयों को, िैसा आवश् यक हो, जनयुि या प्राजधकृत करेगी-
(क) प्राजधकृत अजधकारी की जनम्नजलजखत िजियां होंगी :
(i) इन िलयानों के उपयुिता प्रमाणन हेतु आवेिन प्राि करना और उन पर कारगवाई करना;
(ii) जनरीिण और सवेिण करना;
(iii) दफटनेस प्रमाणपत्र िारी, जनलंजबत या रद्द करता है; और
(iv) इन जनयमों के अंतगगत अस्ट् वीकृत करने, जनलंजबत करने, रद्द करने या प्रवतगन के संबंध में की गई
अन्य कारगवाइयों के कारणों को ररकॉडग करेगा और इसे बरकरार रखेगा।
(ख) इन जनयमों के साथ एकरूपता हेतु प्ररूप संख्या 2 में दफटनेस प्रमाणपत्र हेतु आवेिन का एक आििग प्रपत्र
और प्ररूप संख्या 3 में दफटनेस प्रमाणपत्र, राज्य सरकारों के संिभग एवं उसके द्वारा अपनाए िाने हेतु संलि है।
(ग) दकसी भी यांजत्रक चाजलत अंतिेिीय िलयान के स्ट्वामी, संचालक या मास्ट्टर द्वारा इन जनयमों के प्ररूप 2 के
अनुसार आवेिन दकए िाने पर, प्राजधकृत अजधकारी, इस बात से संतुष्ट होने पर दक िलयान:
(i) जनधागररत सुरिा, संरचनात्मक और जस्ट्थरता मानकों को पूरा करता है;

(ii) अपेजित सुरिा उपकरणों से सुसजित है;
(iii) उस पर यथा लागू उपयुि भार रेखा जचह्न अंदकत हैं; और
(iv) अंतिेिीय िलयान अजधजनयम, 2021 और इन जनयमों के प्रावधानों का अनुपालन करता है,
(v) इन जनयमों के प्ररूप 3 के अनुसार, िलयान की वहन िमता ििागते हुए दफटनेस प्रमाणपत्र िारी
करेगा।
(घ) दफटनेस प्रमाणपत्र ऐसी ितों को पूरा करने के अध् यधीन िारी दकया िाएगा िैसा राज्य सरकार जवजहत करे,
जिनमें जनम्नजलजखत िाजमल हो सकते हैं, परंतु ये इन्हीं तक सीजमत नहीं होंगी:
(i) वैध सवेिण और बीमा प्रमाणपत्र धारक होना;
(ii) लागू फीस का भुगतान;
(iii) नवीनीकरण की प्रदक्रयाएँ;
(iv) जनरीिण अपेिाएं, जिनमें वार्षगक या अन्य आवजधकता वाली जनरीिण अपेिाएं िाजमल हैं; िैसा
राज्य सरकार द्वारा जनर्िगष्ट दकया िाए,और
(v) प्रचालन संबंध प्रजतबंध।
(ङ) राज्य सरकार या नाजमत प्राजधकरण, इन िलयानों के प्रचालन िेत्र िोजखम आकलन के आधार पर अपेिाओं
को अजधसूजचत करेंगे, िैसा दक अंतिेिीय िलयान (राष्ट्रीय निी यातायात और नौचालन प्रणाली) जनयम, 2025
में जनर्िगष्ट है
(च) इन जनयमों हेतु एकरूपता के जलए प्ररूप संख्या 2 में दफटनेस प्रमाणपत्र और प्ररूप संख्या 3 में दफटनेस
प्रमाणपत्र के जलए आवेिन का एक आििग प्रपत्र राज्य सरकारों के संिभग और उसके द्वारा अपनाए िाने के जलए
संलग् न है।
(छ) एकाजधक जविेष श्रेणी जनयमों के जलए एकल दफटनेस प्रमाणपत्र-
िहाँ कहीं भी कोई िलयान, एक से अजधक जविेष श्रेणी िलयान जनयमों के अजधकार िेत्र में आता है, उसके
संबंध में एक ही दफटनेस प्रमाणपत्र िारी दकया िाएगा। यह प्रमाणपत्र अपेिाओं को िाजमल करेगा और इन
जनयमों के जनयम 3 के उपजनयम (6) की अपेिाओं के अनुसार होगा।
(3) अंतर-राज्यीय प्रचालन और िजियाँ/िाजयत् व-
(क) मूल राज्य को जविेष श्रेणी के िलयान के जलए दफटनेस प्रमाणपत्र िारी करने का अनन् य प्राजधकार होगा।
(ख) मूल राज्य द्वारा िारी वैध दफटनेस प्रमाणपत्र धारक िलयानों को िूसरे राज्य से डुजप्लकेट या अलग
प्रमाणीकरण की अपेिा के जबना, दकसी अन्य राज्य में प्रचालन की अनुमजत होगी, बिते दक:
(i) मूल राज्य द्वारा िारी दफटनेस प्रमाणपत्र उस राज्य द्वारा स्ट्वीकार दकया िाता है जिसमें िलयान का
प्रचालन दकया िाना अजभप्रेत है; और
(ii) प्रचालन के अजभप्रेत राज्य को पूवग सूचना िी िाती है, और उस राज्य द्वारा लगाई गई दकसी भी ितग का
जवजधवत अनुपालन दकया िाता है।
(ग) मूल राज्य द्वारा िारी दफटनेस प्रमाणपत्रों के सत्यापन और प्रमाणीकरण के जलए अंतर-राज्यीय डेटा
जवजनमय तंत्र, इस अजधजनयम और अंतिेिीय िलयान (केंद्रीय डाटाबेस और सहबद्ध मामले) जनयम 2024 के

तहत जवकजसत 'िलयान' और 'नाजवक' - केंद्रीय डेटाबेस पोटगल के माध्यम से होगा, िो अजधजनयम की धारा 3
के खंड (च), धारा 22, धारा 106 की उप-धारा (2) के खंड (क), (ण) और (ययक) और धारा 108 में जनजहत
उपबंध के अनुसार राज्यों में जविेष श्रेणी के िलयानों के जनबागध संचालन को सिम करेगा।
(4) सवेिक द्वारा जनरीिण-
(क) अजधजनयम के अंतगगत जनयुि कोई सवेिक, जनधागररत सवेिण के प्रयोिन के अलावा, दकसी भी
समय पर जनरीिण के प्रयोिनाथग दकसी जविेष श्रेणी के िलयान पर िा सकता है। ऐसे जनरीिण में
जनम्नजलजखत की िाँच में िाजमल हो सकता है, परंतु यह इन्हीं तक सीजमत नहीं :
(i) पतवार,
(ii) उपस्ट् कर,
(iii) मिीनरी, और
(iv) िलयान का कोई भाग या संपजत्त।
(ख) िलयान का स्ट्वामी, प्रचालक, अजभकताग, मास्ट्टर, या इसका प्रभारी कोई भी व्यजि:
(i) जनरीिण या सवेिण करने के जलए सवेिक को सभी आवश्यक पहुँच और सुजवधाएँ प्रिान
करेगा, और
(ii) िलयान, उसकी मिीनरी, उपस्ट् कर, या उसके दकसी भाग के संबंध में ऐसी िानकारी प्रिान
करेगा, जिसकी सवेिक या कोई प्राजधकृत अजधकारी यथोजचत रूप से अपेिा करे।
(5) अनुपालन का प्रवतगन और दफटनेस प्रमाण पत्र का जनलंबन या रद्दीकरण -
(क) इन जनयमों के अनुसरण में, जविेष श्रेणी के िलयान के रूप में जचजन्हत दकसी िलयान को, रािपत्र में
इन जनयमों की अजधसूचना की जतजथ से बारह महीने की अवजध के भीतर दफटनेस प्रमाणपत्र प्राि करना
होगा।
(ख) यदि इन जनयमों के अंतगगत जविेष श्रेणी के िलयान के रूप में जचजन्हत दकसी यंत्रीकृत अंतिेिीय
िलयान में अजधजनयम या उसके अधीन बनाए गए जनयमों के उपबंधों का अनुपालन नहीं पाया िाता है, तो
राज्य सरकार िलयान के स्ट्वामी, प्रचालक, मास्ट्टर या प्रभारी व्यजि को सुधार का नोरटस िारी कर सकती
है, जिसमें अनुपालन न करने का स्ट् वरूप और वह समय सीमा जनर्िगष्ट की िाएगी जिसके भीतर ऐसा सुधार
पूरा दकया िाना चाजहए।
(ग) यदि अजधजनयम की धारा 46 की उपधारा (1) के अंतगगत िारी नोरटस में जनर्िगष्ट समय के बाि भी गैर-
अनुपालन िारी रहता है, तो राज्य सरकार संबंजधत व्यजि को सुनवाई और जलजखत में कारण ििग कराने
का अवसर िेने के पश्चात, इन जनयमों के अंतगगत ऐसे िलयान को दिए गए दफटनेस प्रमाणपत्र को जनलंजबत
या रद्द कर सकती है।
(घ) कोई िलयान जिसका दफटनेस प्रमाणपत्र अजधजनयम की धारा 46 की उपधारा (2) के अधीन जनलंजबत
या रद्द कर दिया गया है, वह:
(i) तब तक प्रचालन बंि रखेगा िब तक दक जनलंबन वापस नहीं ले जलया िाता; या

(ii) रद्दीकरण की जस्ट्थजत में, इस अध्याय के उपबंधों के अनुसार नया दफटनेस प्रमाणपत्र प्रिान दकए िाने
तक प्रचालन बंि रखेगा।
(6) अपील-
राज्य सरकार इन जनयमों के अधीन जिकायत जनवारण के जलए एक अपीलीय प्राजधकारी जनयुि करेगी। व्यजथत
आवेिक, उपयुिता प्रमाण-पत्र अस्ट्वीकार करने, जनलंजबत करने या रद्द करने के जनणगय के जवरुद्ध ऐसे आिेि की
सूचना की जतजथ से 30 दिन के भीतर राज्य सरकार के जनर्िगष्ट अपीलीय प्राजधकारी के समि अपील िायर कर
सकता है।
5. िलयान के स्ट्वामी के िाजयत्व -
(1) िलयान का सुरजित प्रचालन
सुरजित प्रचालन ितों के अनुपालन के अध् यधीन, िलयान का स्ट्वामी राज्य सरकार के प्राजधकृत अजधकारी द्वारा
िारी दफटनेस प्रमाणपत्र में जनर्िगष्ट प्रचालन ितों का पालन करेगा।
(2) अनुपालन न करने पर िाजस्ट्तयां
(क) िलयान का स्ट्वामी इन जनयमों के अजतररि अजधजनयम और उसके अंतगगत बनाए गए जनयमों के सभी संगत
उपबंधों का अनुपालन सुजनजश्चत करेगा। अंतिेिीय िल में प्रचालन हेतु इन िलयानों के जलए जनम्नजलजखत वैध
िस्ट्तावेज़ अजनवायग हैं:
(i) पंिीकरण प्रमाणपत्र।
(ii) सवेिण प्रमाणपत्र।
(iii) बीमा पॉजलसी।
(iv) दफटनेस प्रमाणपत्र।
(v) प्रिूषण रोकथाम प्रमाणपत्र।
(ख) स्ट्वामी को उपरोि सभी अपेजित िस्ट्तावेि हर समय उपलब्ध कराने होंगे और अजधजनयम के संगत उपबंधों के
तहत राज्य सरकार द्वारा जनयुि अजधकाररयों या प्राजधकाररयों के समि मांगे िाने पर उन्हें प्रस्ट्तुत करना होगा।
(ग) इन जनयमों के दकसी भी उपबंध का पालन न करने पर स्ट्वामी पर अंतिेिीय पोत अजधजनयम, 2021 की धारा
87 के तहत लगाए िा सकने वाली िाजस्ट्त, िुमागना या अन्य कारगवाई की िा सकती है।
6. करिनाइयों को िूर करने की िजि- केन्द्रीय सरकार, रािपत्र में आिेि द्वारा, अजधजनयम की धारा 110 के अधीन
उपबंधों के अनुसार इन जनयमों के कायागन्वयन में दकसी करिनाई को िूर करने के जलए जनिेि िारी कर सकेगी।

NOTIFICATION
New Delhi, the 22nd September, 2025
G.S.R. 704(E).–– The draft of the Inland Vessels (Special Category Vessels: Wooden, GRP/FRP
and Similar Material) Rules, 2025, which the Central Government proposes to make, in exercise of the
powers conferred under sub-section (1) and (2) of section 42 and clause (a) of sub-section (1) of section 98
read with clause (zh) of sub-section (2) of section 106 of the Inland Vessels Act, 2021, is hereby published
as required by sub-section (1) of section 106 of the said Act for information of all persons likely to be
affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after
the expiry of thirty days from the date on which the copies of this notification, as published in the Official
Gazette, are made available to the public;
Objections or suggestions, if any, to these draft rules may be sent to the Director (IWT-II), Ministry of
Ports, Shipping & Waterways, Room No. 545, Transport Bhawan, 1-Parliament Street, New Delhi-110001,

The objections or suggestions which may be received from any person concerning the said draft rules,
within the period so specified will be considered by the Central Government.
DRAFT RULES
1. Short title and commencement. - (1) These rules may be called the Inland Vessels (Special Category
Vessels: Wooden, GRP/FRP and Similar Materials) Rules, 2025.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. Definitions. - (1) In these rules, unless the context otherwise requires -
(a) “Act” means the Inland Vessels Act, 2021 (24 of 2021);
(b) “classification society” means a recognized organization within the meaning of clause (zo) of section 3
of the Act, which is a member of International Association of Classification Societies.
(c) "fair season" means the period showing fair conditions of wind and sea as may be specified by the
Directorate General of Shipping, India or by such other authority as may be prescribed by Central
Government;
(d) “foul season” means the period showing foul conditions of wind and sea as may be specified by the
Directorate General of Shipping, India or by such other authority as may be prescribed by Central
Government.
(2) Words and expressions used and not defined in these rules but defined in the Act, shall have the
meanings respectively assigned to them in the Act.
3. Scope and application.– (1) The following mechanically propelled inland vessels shall be classified as
special category vessel for the purposes of these rules, on the basis of their construction material-
(a) vessel constructed, whether wholly or substantially (40% or more of the structural weight) of
wood;
(b) vessel constructed, whether wholly or substantially (40% or more of the structural weight) of glass-
reinforced plastic (GRP), fibre-reinforced plastic (FRP), or other analogous composite materials,
including but not limited to high-speed crafts, landing crafts, hovercrafts, hydrofoils, and small
waterplane area twin hull (SWATH) vessels;

Provided that these rules shall not apply to Pleasure Craft and Canal Cruise Boats covered under the Inland
Vessels (Special Category: Pleasure Craft and Canal Cruise Boats) Rules, 2025.
(2) The following rules and its subsequent amendments shall apply to the vessels designated as special
category vessels in sub rule (1)-
(a) Inland Vessels (Registration and Other Technical Issues) Rules, 2022;
(b) Inland Vessels (Survey and Certification) Rules, 2022;
(c) Inland Vessels (Firefighting appliances) Rules, 2022;
(d) Inland Vessels (Life savings appliances) Rules, 2022;
(e) Inland Vessels (Prevention and containment of pollution) Rules, 2022;
(f) Inland Vessels (Safe Navigation, communication, and signals) Rules, 2022;
(g) Inland Vessels (Manning) Rules, 2022;
(h) Inland Vessels (Insurance, Limitation of Liability and Obligations of Service Providers and Service
Users) Rules, 2022;
(i) Inland Vessels (Central Database and Allied Matters) Rules, 2024; and
(j) Inland Vessels (Prior Approval for Alteration and Modification), Rules 2025.
(3) Standards for design and construction-
(a) the provisions contained in Chapters II to IV and Chapter IX of the Inland Vessels (Design and
Construction) Rules, 2024, as amended, insofar as they are applicable for the vessel designated as
special category vessel in sub rule (1).
(b) alternatively, in lieu of any of the provisions in above mentioned rules, designated authority may
consider the standards, as specified by the:
(i) Bureau of Indian Standards or International Standards Organization; or
(ii) a classification society
(c) The owner shall furnish a declaration regarding standards for design and construction followed, in
Form No. 1 of these rules to the designated authority or such person or organization, as may be
delegated by the State Government under sub-section (4) of section 12 of the Act.
(4) The vessel identified as special category vessel pursuant to sub-rule (1), shall be designed, constructed,
and maintained under the survey and supervision of the authority, in accordance with rule 4 of the Inland
Vessels (Design and Construction) Rules, 2024 and its subsequent amendments, based on the
categorization applicable to these vessels:
Provided that, in case the owner of the vessel willingly decides to have the vessel constructed and
maintained under the survey of a Classification Society, the survey carried out by such Classification
Society shall be in addition to the survey carried out by the designated authority or by such person or
organization as may be delegated by the State Government under sub-section (4) of section 12 of the Act.
(5) All existing vessels constructed of wooden, GRP, FRP or similar materials and operating before the date
of final publication of these rules shall comply with rule 5 of the Inland Vessels (Design and Construction)
Rules, 2024, as amended.
(6) Harmonization with other special category rules and regulatory frameworks-

(a) where a vessel is designated as a special category vessel under these rules and is also governed by
other special category rules framed under the Act, it shall comply with all applicable provisions of
rules mentioned under sub-section (2) and those special category rules to the extent they are not
inconsistent.
(b) the competent authority shall determine the principal classification of the vessel based on dominant
functionality, risk profile, and construction; however, the certificate of fitness shall have mention of
all other special category rules and their extent of application on these vessels.
(c) the more stringent of applicable standards of these rules shall prevail unless exempted by the
designated authority.
4. Certification and statutory requirements. – The vessel identified as special category vessel pursuant to
sub-rule (1) of rule 3, shall ensure following compliances: -
(1) Safety Measures and Load line Requirements-
(a) the vessel shall be provided with safety gear and equipment in accordance with its area of
operation as prescribed by the respective State Government.
(b) the maximum carrying capacity of the vessel shall be determined by such criteria as may be
prescribed by the State Government, which may include but not limited to:
(i) the specification of a safety load line or load line limits to ensure buoyancy;
(ii) other condition necessary to ensure the safe voyage of such vessel, in addition to those
provided elsewhere under the Act.
(c) the maximum carrying capacity of the vessel shall be endorsed in the certificate of fitness.
(d) the designated authority may, in respect of these vessels, grant exemption from the requirement of
collision bulkheads, provided that alternate safety measures, deemed adequate and appropriate by
the authority, are duly implemented to ensure equivalent or enhanced safety standards.
(2) Appointment of officers and grant of certificate of fitness-
The State Government shall appoint or authorize such number of officers, as may be necessary for the
purpose of implementation and enforcement of the provisions under the Chapter VII of the Act and these
rules-
(a) The authorized officer shall be empowered to:
(i) receive and process applications for fitness certification of these vessels;
(ii) conduct inspections and surveys;
(iii) issue, suspend, or cancel certificates of fitness; and
(iv) record and maintain reasons for refusal, suspension, cancellation, or other enforcement actions
taken under these rules.
(b) A model format of the application for certificate of fitness in Form No. 2 and the certificate of
fitness in Form No. 3 is annexed for reference and adoption by State Governments for uniformity
with these rules.
(c) Upon an application made by the owner, operator, or master of any mechanically propelled inland
vessel, as per Form 2 of these rules, the authorized officer shall, upon being satisfied that the
vessel:
(i) meets the prescribed safety, structural, and stability standards;
(ii) is equipped with the requisite safety equipment;
(iii) bears appropriate load line markings, as applicable; and
(iv) complies with the provisions of the Inland Vessels Act, 2021 and these rules,

(v) issue a certificate of fitness indicating the carrying capacity of the vessel, as per Form 3 of
these rules.
(d) The certificate of fitness shall be issued subject to fulfillment of such conditions as may be
prescribed by the State Government, which may include but not limited to:
(i) possession of a valid survey and insurance certificate;
(ii) payment of applicable fees;
(iii) procedures for renewal;
(iv) inspection requirements, including annual or such other periodicity as may be specified by the
State Government; and
(v) operational restrictions.
(e) The State Government or designated authority shall notify requirements based on operational area
risk assessments of these vessels as specified in Inland Vessels (National River Traffic and
Navigation System) Rules, 2025 while issuing certificate of fitness.
(f) A model format of the application for certificate of fitness in Form No. 2 and the certificate of
fitness in Form No. 3 is annexed for reference and adoption by State Governments for uniformity
with these rules.
(g) Single certificate of fitness for multiple special category rules-
Wherever a vessel falls within the jurisdiction of more than one set of Special Category Vessel
Rules, a single Certificate of Fitness shall be issued in respect thereof. This certificate shall
incorporate the requirements and in accordance with sub rule (6) of rule 3 of these rules.
(3) Inter-State Operation and powers/responsibilities-
(a) the home State shall be the sole authority for issuing the certificate of fitness for a special category
vessel.
(b) such vessels holding a valid certificate of fitness issued by the home State shall be permitted to
operate in any other State, without requiring a duplicate or separate certification from other State,
provided that:
(i) the certificate of fitness issued by the home State is accepted by the State in which the vessel is
intended to be operated; and
(ii) prior intimation is given to the intended State of operation, and any conditions imposed by that
State are duly complied with.
(c) Inter-state data exchange mechanism for the validation and verification of Certificates of Fitness
issued by the home State, shall be through ‘Jalyan’ and ‘Navic’ - Central database portal,
developed under the Act and Inland Vessels (Central Database and Allied Matters) Rules 2024,
enabling seamless operation of special category vessels across States as per the provision contained
in clause (f) of section 3, section 22, clauses (a), (o) and, (zza) of sub-section (2) of section 106,
and section 108 of the Act.
(4) Inspection by Surveyor-
(a) a surveyor appointed under the Act, other than for the purpose of a scheduled survey, may at any
reasonable time, board a special category vessel for the purpose of inspection. Such inspection may
include, but not be limited to, examination of:
(i) the hull,
(ii) equipment,
(iii) machinery, and
(iv) any part or properties of the vessel.
(b) the owner, operator, agent, master, or any person in charge of the vessel shall:

(i) provide all necessary access and facilities to the surveyor for conducting the inspection or
survey, and
(ii) furnish such information regarding the vessel, its machinery, equipment, or any part thereof, as
the surveyor or any authorized officer may reasonably require.
(5) Enforcement of Compliance and Suspension or Cancellation of Certificate of Fitness-
(a) a vessel identified as a special category vessel pursuant to these rules shall obtain the certificate of
fitness within a period twelve months from the date of notification of these rules in the Official
Gazette.
(b) if any mechanically propelled inland vessel identified as a special category vessel under these
rules, is found to be in non-compliance with the provisions of the Act or the rules made thereunder,
the State Government may issue a notice of rectification to the owner, operator, master, or person
in charge of the vessel, specifying the nature of non-compliance and the time within which such
rectification must be completed.
(c) in the event that the non-compliance continues beyond the time specified in the notice issued under
sub-section (1) of section 46 of the Act, the State Government may after giving the concerned
person an opportunity to be heard and recording reasons in writing, suspend or cancel the
Certificate of Fitness granted to such vessel under these rules.
(d) a vessel whose Certificate of Fitness has been suspended or cancelled under sub-section (2) of
Section 46 of the Act shall:
(i) cease to operate until such suspension is revoked; or
(ii) in the event of cancellation, cease to operate until a new Certificate of Fitness is granted in
accordance with the provisions of this Chapter.
(6) Appeal-
State Government shall appoint an appellate authority for grievance redressal under these rules. An
aggrieved applicant may file an appeal against the decision of refusal, suspension or cancellation of fitness
certificate to the designated appellate authority of the State Government within 30 days from the date of
communication of such order.
5. Obligations of the Owner of vessel. -
(1) Safe operation of vessel
Subject to compliance with safe operating conditions, the Owner shall adhere to the operational conditions
specified in the certificate of fitness granted by the authorized officer of State Government.
(2) Penalties for Non-Compliance
(a) The owner of the vessel shall ensure compliances of all relevant provisions of the Act and rules framed
there under applicable to them in addition to these rules. The following valid documents are mandatory
for these vessels for plying in Inland Waters:
(i) Certificate of Registration.
(ii) Survey Certificate.
(iii) Insurance Policy.
(iv) Fitness Certificate.
(v) Prevention of Pollution Certificate.
(b) The owner shall make available all the above requisite documents at all times and shall produce the
same on demand to the officers or authorities appointed by the State Government under relevant
provisions of the Act.
(c) Failure to comply with any provision of these rules shall render the Owner liable to penalties, fines, or
other actions as may be imposed under Section 87 of the Inland Vessels Act, 2021.

6. Power to Remove Difficulties. - The Central Government may, by order in the Official Gazette, issue
directions to remove any difficulty in implementation of these rules as per provision under section 110 of
the Act
