L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY कृजि एवं ककसान कल् याण मंत्रालय (कृजि एवं ककसान कल् याण जवभाग) अजधसूचना नई किल् ली, 4 िुलाई, 2025 सा.का.जन. 483(अ).—केन्द्रीय सरकार के पूवव अनुमोिन से पौधा ककस्ट्म और कृिक अजधकार संरक्षण प्राजधकरण, पौधा ककस्ट्म और कृिक अजधकार संरक्षण अजधजनयम, 2001 (2001 का 53) की धारा 95 की उपधारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए, पौधा ककस्ट्म और कृिक अजधकार संरक्षण जवजनयम, 2006 को और संिोजधत करने के जलए जनम्नजलजखत जवजनयम बनाता है, अर्ावत्:- 1. संजक्षप्त नाम और प्रारंभ.- (1) इन जवजनयमों का संजक्षप् त नाम पौधा ककस्ट्म और कृिक अजधकार संरक्षण (संिोधन) जवजनयम, 2025 है। (2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृत् त होंगे1 2. पौधा ककस्ट्म और कृिक अजधकार संरक्षण जवजनयम, 2006 (जिसे इसमे उि जवजनयम के रूप में जनर्िवष्ट ककया गया है), में जवजनयम 4 के स्ट्र्ान पर जनम्नजलजखत जवजनयम रखा िाएगा, अर्ावत्:- “4. अजधकाररता.- (1) रजिस्ट्रार की अजधकाररता वह होगी िो प्राजधकरण द्वारा समय-समय पर जनधावररत की िाए और जिसकी सहायता संयुि रजिस्ट्रार, उप रजिस्ट्रार, उप जनिेिक (प्रिासन), लेखाकार और अन्द्य तकनीकी, जवजधक सलाहकार, जवत्तीय और प्रिासजनक कमवचाररयों द्वारा की िाएगी।” 3. उि जवजनयम में, जवजनयम 5 के स्ट्र्ान पर जनम्नजलजखत जवजनयम रखा िाएगा।- “5. रजिस्ट्रारों की पिावजध और सेवा की ितें ।- (1) रजिस्ट्रार, संयुि रजिस्ट्रार और उप रजिस्ट्रारों की पिावजध, अहवताएं, अनुभव और सेवा ितें इन जवजनयमों से उपाबद्ध अनुसूची में जवजनर्िवष्ट उपबंधों के अनुरूप होंगी। सं. 440] नई किल्ली, सोमवार, िुलाई 21, 2025/आिाढ़ 30, 1947 No. 440] NEW DELHI, MONDAY, JULY 21, 2025/ASHADHA 30, 1947 सी.जी.-डी.एल.-अ.-23072025-264900 CG-DL-E-23072025-264900 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5 क. प्रारंजभक गठन- (1) इन जवजनयमों के प्रारंभ होने से ठीक पूवव अनुसूची के स्ट्तंभ (1) में जवजनर्िवष्ट पिों को जनयजमत आधार पर धारण करने वाले कार्मवकों को इन जवजनयमों के उपबंधों के अधीन जनयुि ककया गया समझा िाएगा। (2) इन जवजनयमों के प्रारंभ होने से ठीक पूवव संबंजधत श्रेणी में उप-जवजनयम (1) में जवजनर्िवष्ट कार्मवकों की जनयजमत जनरंतर सेवा की, सेवा में पररवीक्षा अवजध और प्रोन्नजत, पुजष्ट और पेंिन के जलए अहवक सेवा और पेंिन के जलए गणना की िाएगी । ” 4. उि जवजनयम में, प्रारूप 1 क के पश्चात, जनम्नजलजखत अनुसूची अंत:स्ट्र्ाजपत की िाएगी, अर्ावत्:- “अनुसूची पि का नाम पिों की संख्या वगीकरण वेतन मैररक्स में स्ट्तर चयन पि है या अचयन पि सीधी भती ककए िाने वाले व्यजियों के जलए आयु सीमा (1) (2) (3) (4) (5) (6) रजिस्ट्रार 03 (2025) समूह ‘क’ अरािपजत्रत स्ट्तर -13 (123100- 215900 रुपये) लागू नहीं होता । पचास विव से अनजधक सीधी भती ककए िाने वाले व्यजियों के जलए अपेजक्षत िैजक्षक और अन्द्य अहवताएं । सीधी भती के जलए जवजहत आयु और िैजक्षक अहवताएं प्रोन्नत व्यजियों या प्रजतजनयुजि की ििा में लागू होंगी। पररवीक्षा की अवजध, यकि कोई हो। भती की पद्धजत; भती सीधे होगी या प्रोन्द् नजत द्वारा या प्रजतजनयुजि या स्ट्र्ानान्द्तरण या आमेलन द्वारा तर्ा जवजभन्न पद्धजतयों द्वारा भरे िाने वाली ररजियों की प्रजतितता । (7) (8) (9) (10) आवश्यक: (i) आनुवंजिकी और पािप प्रिनन या आनुवंजिकी या कृजि वनस्ट्पजत जवज्ञान या बीि जवज्ञान और प्रौद्योजगकी या बीि प्रौद्योजगकी या पािप आनुवंजिकी संसाधन में जविेिज्ञता के सार् कृजि में मास्ट्टर जडग्री या पािप प्रिनन और आनुवंजिकी में जविेिज्ञता के सार् वाजनकी या बागवानी या पािप िैव प्रौद्योजगकी या पािप आणजवक िीव जवज्ञान और िैव प्रौद्योजगकी में मास्ट्टर जडग्री। (ii) कृजि जवज्ञान या बीि जवकास के कियाकलापों में पंरह विव का अनुभव, जिसमें से कम से कम 3 विव का अनुभव ककस्ट्म सुधार या बौजद्धक संपिा अजधकार के क्षेत्र में आवश्यक है। स्ट्तंभ (11) के अनुसार एक विव प्रोन्नजत न होने पर प्रजतजनयुजि (अल्पकाजलक अनुबंध सजहत) द्वारा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 वांछनीय: बीि जवकास कायविम या बौजद्धक संपिा अजधकार और पौध ककस्ट्म सुधार के कियाकलापों या वृक्ष सुधार में तीन विव के अनुसंधान अनुभव के सार् डॉक्टरेट की जडग्री। प्रोन्नजत या प्रजतजनयुजि या आमेलन द्वारा भती की ििा में, वे श्रेणी जिनसे प्रोन्नजत या प्रजतजनयुजि या आमेलन ककया िाएगा। यकि जवभागीय प्रोन्नजत सजमजत या चयन सजमजत जवद्यमान है, तो उसकी संरचना भती करने की ककन पररजस्ट्र्जतयों में संघ लोक सेवा आयोग से परामिव ककया िाएगा (11) (12) (13) प्रोन्नजत: (i) संयुि रजिस्ट्रार जिसने वेतन स्ट्तर-12 में पांच विव की जनयजमत सेवा की हो; या (ii) जिसने वेतन मैररक्स में वेतन स्ट्तर-12 में संयुि रजिस्ट्रार और वेतन स्ट्तर-11 में उप रजिस्ट्रार की श्रेणी में िस विव की संयुि सेवा की हो, जिसमें से संयुि रजिस्ट्रार की श्रेणी में न्द्यूनतम तीन विव की जनयजमत सेवा की हो। प्रजतजनयुजि: (क) (i) िो मूल संवगव या जवभाग में जनयजमत आधार पर सिृि पि धारण ककए हुए हों; या (ii) जिसने मूल संवगव या जवभाग में वेतन मैररक्स में वेतन स्ट्तर-12 (78800-209200 रुपये) या समतुल्य में जनयजमत आधार पर जनयुजि के बाि उस श्रेणी में पांच विव की जनयजमत सेवा की हो; और (ख) िो जनम्नानुसार िैजक्षक अहवताएं रखता हो: आनुवंजिकी और पािप प्रिनन या आनुवंजिकी या कृजि वनस्ट्पजत जवज्ञान या बीि जवज्ञान और प्रौद्योजगकी या बीि प्रौद्योजगकी या पािप आनुवंजिकी संसाधन में जविेिज्ञता के सार् कृजि में मास्ट्टर जडग्री या पािप प्रिनन और आनुवंजिकी में जविेिज्ञता के सार् वाजनकी या बागवानी या पािप िैव प्रौद्योजगकी या पािप आणजवक िीव जवज्ञान और िैव प्रौद्योजगकी में मास्ट्टर जडग्री। रटप्पणी 1: केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पजललक सेक्टर उपिमों या जवश्वजवद्यालयों या कानूनी या स्ट्वायत्त संगठनों या भारतीय कृजि अनुसंधान पररिि के अधीन ऐसे अजधकारी, जिनकी आयु आवेिन प्राप्त करने की अंजतम जतजर् पर छप्पन विव से अजधक न हो। रटप्पणी 2: प्रजतजनयुजि की अवजध, जिसके जवभागीय प्रोन्नजत सजमजत (प्रोन्नजत पर जवचार करने के जलए) में जनम्नजलजखत िाजमल होंगे:- (1) महारजिस्ट्रार, पीपीवीएफआरए - अध्यक्ष; (2) पीपीवीएफआरए के अध्यक्ष द्वारा नाजमत ककया िाने वाला ऐसा अजधकारी िो भारत सरकार के संयुि सजचव के पि से नीचे के पि न हो - सिस्ट्य; (3) पीपीवीएफआरए के अध्यक्ष द्वारा नाजमत ककये िाने वाले ऐसे िो जविेिज्ञ, िो वेतन स्ट्तर-14 में संयुि सजचव के पि से नीचे पि पर न हो - सिस्ट्य लागू नहीं होता । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अंतगवत उसी या ककसी अन्द्य संगठन या जवभाग में इस जनयुजि से ठीक पहले धाररत ककसी अन्द्य बाह्य संवगव पि पर प्रजतजनयुजि की अवजध (अल्पकाजलक संजविा सजहत) भी सजममजलत है, सामान्द्यतया पांच विव से अजधक नहीं होगी। (1) (2) (3) (4) (5) (6) संयुि रजिस्ट्रार। 2 (2025) समूह ‘क’ अरािपजत्रत स्ट्तर-12 (78800- 209200 रुपये) लागू नहीं होता । लागू नहीं होता । (7) (8) (9) (10) लागू नहीं होता । लागू नहीं होता । लागू नहीं होता । प्रोन्नजत द्वारा जिसके न होने पर प्रजतजनयुजि द्वारा। (11) (12) (13) प्रोन्नजत: वेतन मैररक्स में वेतन स्ट्तर-11 (67700-208700 रुपये) में पांच विव की जनयजमत सेवा वाले उप रजिस्ट्रार। प्रजतजनयुजि: केन्द्रीय सरकार या राज्य सरकारों या संघ राज्यक्षेत्रों या जवश्वजवद्यालयों या कानूनी या स्ट्वायत्त संगठनों या भारतीय कृजि अनुसंधान पररिि के अधीन ऐसे अजधकारी: (क) (i) िो मूल संवगव या जवभाग में जनयजमत आधार पर सुसंगत क्षेत्र में सिृि पि धारण ककए हुए; या (ii) जिसने वेतन मैररक्स के वेतन स्ट्तर-11 (67700- 208700 रुपये) या समकक्ष में जनयजमत आधार पर जनयुजि के बाि सुसंगत क्षेत्र में प्रिान की गई श्रेणी में पांच विव की सेवा की हो; या (iii) सुसंगत वेतन मैररक्स के वेतन स्ट्तर-10 (56100- 177500 रुपये) में जनयजमत आधार पर जनयुजि के बाि सुसंगत क्षेत्र में प्रिान की गई श्रेणी में िस विव की सेवा की हो; और (ख) िो जनम्नानुसार िैजक्षक अहवताएं रखता हो: आनुवंजिकी और पािप प्रिनन या आनुवंजिकी या कृजि वनस्ट्पजत जवज्ञान या बीि जवज्ञान और प्रौद्योजगकी या बीि प्रौद्योजगकी या पािप आनुवंजिकी संसाधन में जविेिज्ञता के सार् कृजि में मास्ट्टर जडग्री या पािप प्रिनन और आनुवंजिकी में जविेिज्ञता के सार् वाजनकी या बागवानी या पािप िैव प्रौद्योजगकी या पािप आजण्वक िीव जवज्ञान और िैव प्रौद्योजगकी में मास्ट्टर जडग्री। नोट 1: केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पजललक सेक्टर उपिमों या जवश्वजवद्यालयों या कानूनी या स्ट्वायत्त संगठनों या भारतीय कृजि अनुसंधान पररिि के अधीन ऐसे अजधकारी, जिनकी आयु आवेिन प्राप्त करने की अंजतम जतजर् को छप्पन विव से अजधक न हो। जवभागीय प्रोन्नजत सजमजत में जनम्नजलजखत िाजमल होंगे:- (1) महारजिस्ट्रार, पीपीवीएफआरए - अध्यक्ष; (2) पीपीवीएफआरए के अध्यक्ष द्वारा नाजमत ककया िाने वाला ऐसा अजधकारी िो भारत सरकार के संयुि सजचव के पि से नीचे के पि न हो - सिस्ट्य; (3) पीपीवीएफआरए के अध्यक्ष द्वारा नाजमत ककये िाने वाले ऐसे िो जविेिज्ञ, िो वेतन स्ट्तर-14 में संयुि सजचव के पि से नीचे पि पर न हो - सिस्ट्य लागू नहीं होता । [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 नोट 2: प्रजतजनयुजि की अवजध, जिसके अंतगवत उसी या ककसी अन्द्य संगठन या जवभाग में इस जनयुजि से ठीक पहले धाररत ककसी अन्द्य बाह्य संवगव पि पर प्रजतजनयुजि की अवजध (अल्पकाजलक संजविा सजहत) भी सजममजलत है, सामान्द्यतया पांच विव से अजधक नहीं होगी। (1) (2) (3) (4) (5) (6) उप रजिस्ट्रार 03 (2025) समूह ‘क’ अरािपजत्रत स्ट्तर-11 (रु. 67700- 208700) लागू नहीं होता । पैंतालीस विव से अनजधक। नोट 1: केन्द्रीय सरकार द्वारा समय समय पर िारी अनुिेिों या आिेिों के अनुसार सरकारी सेवकों के जलए पांच विव तक जिजर्ल की िा सकती है। नोट 2: आयु-सीमा अवधाररत करने के जलए जनणावयक तारीख भारत में अभ्यर्र्वयों से आवेिन प्राप्त करने के जलए जनयत की गई अंजतम तारीख होगी, न कक वह अंजतम तारीख िो असम, मेघालय, अरुणाचल प्रिेि, जमिोरम, मजणपुर, नागालैंड, जत्रपुरा, जसकिम, संघ राज्य क्षेत्र लद्दाख, जहमाचल प्रिेि के लाहौल और स्ट्पीजत जिले तर्ा चमबा जिले के पांगी उप-मंडल, अंडमान और जनकोबार द्वीप समूह, लक्षद्वीप, िममू और कश्मीर के अभ्यर्र्वयों के जलए जवजहत की गई है। (7) (8) (9) (10) आवश्यक : पािप प्रिनन और आनुवंजिकी या आनुवंजिकी या कृजि वनस्ट्पजत जवज्ञान या बीि जवज्ञान एवं प्रौद्योजगकी या वाजनकी या बागवानी या पािप िैव प्रौद्योजगकी में जविेिज्ञता के सार् पािप प्रिनन एवं आनुवंजिकी में जविेिज्ञता के सार् कृजि में मास्ट्टर जडग्री। अनुभव: सुसंगत क्षेत्र में िस विव का अनुभव। वांछनीय: बीि जवकास कायविम या बौजद्धक संपिा अजधकार और पािप जवजवधता सुधार कियाकलापों या वृक्ष सुधार में अनुसंधान संबंधी अनुभव के सार् डॉक्टरेट की जडग्री। स्ट्तंभ (11) के अनुसार िो विव (क) 67 प्रजतित प्रोन्नजत द्वारा, जिसके न होने पर प्रजतजनयुजि द्वारा। (ख) 33 प्रजतित सीधी भती द्वारा। नोट: सीधी भती कोटे के अंतगवत पिधारी के प्रजतजनयुजि पर या लंबी बीमारी या अध्ययन अवकाि पर या अन्द्य पररजस्ट्र्जतयों में एक विव या उससे अजधक अवजध के जलए अनुपजस्ट्र्त रहने के कारण हुई ररजियों को प्रजतजनयुजि के आधार पर भरा िा सकेगा। (11) (12) (13) प्रोन्नजत: पौधा ककस्ट्म परीक्षक, जिसने वेतन मैररक्स में वेतन स्ट्तर-7 (44900-142400 रुपये) में नौ विव की जनयजमत सेवा की हो। प्रजतजनयुजि: केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पजललक सेक्टर उपिमों या जवभागीय प्रोन्नजत या चयन या स्ट्र्ायीकरण सजमजत (प्रोन्नजत या चयन और स्ट्र्ायीकरण पर जवचार करने वाली) – (1) महारजिस्ट्रार, पीपीवीएफआरए - अध्यक्ष; लागू नहीं होता । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जवश्वजवद्यालयों या कानूनी या स्ट्वायत्त संगठनों या भारतीय कृजि अनुसंधान पररिि के अधीन ऐसे अजधकारी: (क) (i) िो मूल संवगव या जवभाग में जनयजमत आधार पर सिृि पि धारण ककए हुए हों; या (ii) जिसने वेतन मैररक्स के वेतन स्ट्तर-10 (56100- 177500 रुपये) में जनयजमत आधार पर जनयुजि के पश्चात सुसंगत क्षेत्र में श्रेणी में पांच विव की सेवा की हो; या (iii) वेतन मैररक्स के वेतन स्ट्तर-8 (47600-151100 रुपये) में जनयजमत आधार पर जनयुजि के पश्चात सुसंगत क्षेत्र में श्रेणी में आठ विव की सेवा की हो; तर्ा (ख) िो, स्ट्तंभ (7) में जवजनर्िवष्ट िैजक्षक अहवता रखता हो। नोट 1: केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्रों या पजललक सेक्टर उपिमों या जवश्वजवद्यालयों या कानूनी या स्ट्वायत्त संगठनों या भारतीय कृजि अनुसंधान पररिि के अधीन ऐसे अजधकारी, जिनकी आयु आवेिन प्राप्त होने की अंजतम जतजर् को छप्पन विव से अजधक न हो। नोट 2: प्रजतजनयुजि की अवजध, जिसके अंतगवत केंर सरकार के उसी या ककसी अन्द्य संगठन या जवभाग में इस जनयुजि से ठीक पहले धाररत ककसी अन्द्य बाह्य- संवगव पि पर प्रजतजनयुजि की अवजध (अल्पकाजलक संजविा सजहत) भी सजममजलत है, सामान्द्यतया तीन विव से अजधक नहीं होगी। (2) अध्यक्ष, पीपीवीएफआरए द्वारा नाजमत ककया िाने वाला ऐसे अजधकारी, िो भारत सरकार के संयुि सजचव के पि से नीचे का ना हो - सिस्ट्य; (3) अध्यक्ष, पीपीवीएफआरए द्वारा नाजमत ककये िाने वाला ऐसे िो जविेिज्ञ, िो वेतन स्ट्तर-14 में संयुि सजचव के पि से नीचे न हो - सिस्ट्य। [फा.सं. 14012/1/2023-SD-V] अिीत कुमार साहू, संयुि सजचव नोट:- मूल जवजनयम भारत के रािपत्र में अजधसूचना संख्यांक सा.का.जन. 740 (अ) तारीख 7 किसमबर, 2006 द्वारा प्रकाजित ककए गए र्े तर्ा अंजतम बार सा.का.जन. 496 (अ) तारीख 15 िून, 2015 द्वारा संिोजधत ककए गए र्े। MINISTRY OF AGRICULTURE AND FARMERS’ WELFARE (DEPARTMENT OF AGRICULTURE AND FARMERS’ WELFARE) NOTIFICATION New Delhi, the 4th July, 2025 G.S.R. 483(E).—In exercise of the powers conferred by sub-section (1) of section 95 of the Protection of Plant Varieties and Farmers’ Rights Act, 2001 (53 of 2001), the Protection of Plant Varieties and Farmers’ Rights Authority, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Protection of Plant Varieties and Farmers’ Rights Regulations, 2006, namely: - 1. Short title and commencement.- (1) These regulations may be called the Protection of Plant Varieties and Farmers’ Rights (Amendment) Regulations, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 2. In the Protection of Plant Varieties and Farmers’ Rights Regulations, 2006 (herein referred as said regulation), for regulation 4, the following regulation shall be substituted, namely:- “4. Jurisdiction.- (1) The jurisdiction of the Registrar shall be such as may be determined by the Authority from time to time and shall be assisted by the Joint Registrar, Deputy Registrar, Deputy Director (Administration), Accountant and other technical, legal advisor, financial and administrative staff.”. 3. In the said regulation, for regulation 5, the following regulations shall be substituted.- “5. The term of office and the conditions of service of the Registrars.- (1) The term of office, qualifications, experience and conditions of service of the Registrars, Joint Registrars and Deputy Registrars shall be as per provisions specified in the Schedule annexed to these regulations. 5A. Initial constitution.- (1) Personnel holding the posts specified in column (1) of the Schedule, immediately before the commencement of these regulations on a regular basis, shall be deemed to have been appointed under the provisions of these regulations. (2) The regular continuous service of personnel referred to in sub-regulation (1) in the respective grade immediately before the commencement of these regulations, shall count for the probation period and qualifying service for promotion, confirmation, and pension in the service.”. 4. In the said regulation, after Form 1A, the following Schedule shall be inserted, namely:- “SCHEDULE Name of the post. Number of posts. Classification Level in pay matrix. Whether selection or non- selection post. Age-limit for Direct Recruits. (1) (2) (3) (4) (5) (6) Registrar. 03 (2025). Group ‘A’ Non- Gazetted. Level-13 (Rs. 123100- 215900) Not applicable. Not exceeding fifty years Educational and other qualification required for direct recruits. Whether age and educational qualifications prescribed for direct recruits will apply in the case of promotion or deputations. Period of probation, if any. Method of recruitment; whether by direct recruitment or by promotion or by deputation or transfer or absorption and percentage of the posts to be filled by various methods. (7) (8) (9) (10) Essential: (i) Master Degree in Agriculture with specialisation in Genetics and Plant Breeding or Genetics or Agricultural Botany or Seed Science and Technology or Seed Technology or Plant Genetics Resources or Master Degree in Forestry or Horticulture or Plant Biotechnology or Plant Molecular Biology and Biotechnology with specialization in Plant Breeding and Genetics. (ii) Fifteen years of experience in Agricultural science or Seed Development activities, out of which at As per column (11). One year. Desirable: Doctorate degree with three years of research experience in Seed Development Program or Intellectual Property Rights and Plant Varietal Improvement activities or Tree Improvement. In case of recruitment by promotion or deputation or absorption, grades from which promotion or deputation or absorption to be made.
