L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY उपभोक्ता मामले, खाद्य और सार्विजिक जर्तरण मंत्रालय (खाद्य और सार्विजिक जर्तरण जर्भाग) आदेि िई ददल्ली, 1 अगस्ट्त, 2025 सा.का.जि. 523(अ).— केंद्रीय सरकार, आर्श्यक र्स्ट्तु अजधजियम, 1955 (1955 का 10) की धारा 3 द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 में संिोधि करिे के जलए जिम्नजलजखत आदेि करती है, अर्ावत:- 1. संजिप्त िाम और प्रारंभ.- (1) इस आदेि का संजिप् त िाम र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) संिोधि आदेि, 2025 है। (2) यह रािपत्र में उसके प्रकािि की तारीख को प्रर्ृत होगा। 2. र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 (जिसे इसमें इसके पश् चात् उक्त आदेि कहा गया है) में, पैरा 2 के स्ट् र्ाि पर जिम्नजलजखत रखा िाएगा, अर्ावत्:- "2. पररभाषाएं.-(1) इस आदेि में, िब तक दक संदभव से अन्यर्ा अपेजित ि हो,- (क) "अजधजियम" से आर्श्यक र्स्ट्तु अजधजियम, 1955 (1955 का 10) अजभप्रेत है; सं. 480] िई ददल्ली, िुक्रर्ार, अगस्ट् त 1, 2025/श्रार्ण 10, 1947 No. 480] NEW DELHI, FRIDAY, AUGUST 1, 2025/SHRAVANA 10, 1947 सी.जी.-डी.एल.-अ.-02082025-265189 CG-DL-E-02082025-265189 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) "न्यायजिणावयक अजधकारी" से सांजययकीय संग्रहण अजधजियम, 2008 (2009 का 7) की धारा 15क के अधीि जियुक्त अजधकारी अजभप्रेत है; (ग) "अपीली प्राजधकारी" से सांजययकीय संग्रहण अजधजियम, 2008 (2009 का 7) की धारा 15ख के अधीि अपीलीय प्राजधकारी अजभप्रेत है; (घ) "जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय)" से इस आदेि के अधीि दकसी या सभी िजक्तयों का प्रयोग करिे के जलए केंद्रीय सरकार द्वारा जियुक्त ऐसा अजधकारी अजभप्रेत है; (ड.) "जिदेिालय" से चीिी और र्िस्ट्पजत तेल जिदेिालय अजभप्रेत है; (च) "सूचिा अिुसूची" से सांजययकीय संग्रहण अजधजियम, 2008 (2009 का 7) की धारा 2 के खंड (घ) में यर्ा पररभाजषत सूचिा अिुसूची अजभप्रेत है; (छ). "िोडल अजधकारी" से सांजययकीय संग्रहण अजधजियम, 2008 (2009 का 7) की धारा 2 के खंड (घक) में यर्ा पररभाजषत अजधकारी अजभप्रेत है; (ि). "उत्पादक" से दकसी व्यजक्त या फमव या कंपिी अजभप्रेत है, िो दकसी र्िस्ट्पजत तेल उत्पाद या दकसी जर्लायक- जिष्कर्षवत र्िस्ट्पजत तेल के उत्पादि के कारबार में, या तो अपिे कारखािे में या उसके जिजमत कायवरत दकसी अन्य व्यजक्त के कारखािे में लगा हुआ है; (झ). "रिीस्ट् रीकरण प्रमाणपत्र" से इस आदेि के पैरा 4 के अधीि दकसी उत्पादक को अिुदत् त रजिस्ट् रीकरण अजभप्रेत है। (ञ) "अिुसूची" से इस आदेि के सार् उपाबद्ध अिुसूची अजभप्रेत है; (ट) "र्िस्ट्पजत तेल" से खली या जतलहि या पादप मूल की तेलयुक्त सामग्री से उत्पाददत तेल अजभप्रेत है और जिसमें जललसराइड्स होते हैं; (ठ) "र्िस्ट्पजत तेल उत्पाद" से कोई भी र्िस्ट्पजत तेल अजभप्रेत है, िो अपिे कच्चे रूप में हो, या जिसे दकसी प्रदक्रया िैसे दक जिस्ट्पंदि, अपकेंद्रण, िोधि (सामान् यीकरण सजहत, जर्रंिि अर्व का उपयोग करके जर्रंिि और दुगवन्धीकरण), इंटरजस्ट्रदफकेिि, हाइड्रोििीकरण, प्रभािि, िीत ऋत् र्ि, िल के सार् पायसीकरण या सरकार द्वारा समय-समय पर अजधसूजचत दकसी अन्य प्रदक्रया, सजमजश्रत (दो या अजधक जर्जभन्न प्रकार के र्िस्ट्पजत तेलों का जमश्रण) के अधीि दकया गया हो; (2) इस आदेि में प्रयुक्त दकन्तु पररभाजषत िहीं दकए गए िब्दों और अजभव्यजक्तयों तर्ा आर्श्यक र्स्ट्तु अजधजियम, 1955 (1955 का 10) या खाद्य सुरिा और मािक अजधजियम, 2006 (2006 का 34) या उसके अधीि बिाए गए जियमों या जर्जियमों में पररभाजषत िब्दों एर्ं अजभव्यजक्तयों के र्ही अर्व होंगे िो उन्हें क्रमिः यर्ाजस्ट्र्जत उस अजधजियम या जियमों या जर्जियमों, में ददए गए हैं।” 3. उक्त आदेि में, पैरा 3 के स्ट्र्ाि पर जिम्नजलजखत रखा िाएगा, अर्ावत्:-“3. रजिस्ट् रीकरण.-(1) कोई उत्पादक, िो र्िस्ट्पजत तेल, र्िस्ट्पजत तेल उत्पाद, जर्लायक जिष्कर्षवत तेल का उत्पादि, जर्क्रय हेतु स्ट्टॉक या जर्क्रय हेतु प्रस्ट्तार् करिे का आिय रखता है, उसे अिुसूची-1 में यर्ाजर्जिर्दवष् ट जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय) को आर्ेदि करिा होगा और अिुसूची-2 में यर्ाजर्जिर्दवष्ट रजिस्ट् रीकरण प्रमाणपत्र प्राप्त करिा होगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय) आर्श्यक पूछताछ करिे के पश् चात्, िैसा र्ह उजचत समझे, आर्ेदकों को अिुसूची-2 में यर्ाजर्जिर्दवष्ट रजिस्ट् रीकरण प्रमाण पत्र िारी कर सकते हैं या कारणों को लेखबद्ध करके आर्ेदि को अस्ट्र्ीकार कर सकते हैं। 4. उक्त आदेि के पैरा 4 में,- (क) "जर्तैजलत अर्चूणव या खािे योल य आटा" िब् दों का लोप दकया िाएगा; (ख) "खंड", िब्द के स्ट्र्ाि पर "पैरा" िब्द रखा िाएगा। 5. उक्त आदेि में, पैरा 5 में, "मुयय जिदेिक" िब्दों के स्ट् र्ाि पर "जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय)" िब्द और कोष्ठक रखे िाएंगे। 6. उक्त आदेि में, पैरा 6 में, दोिों स्ट्र्ािों पर आिे र्ाले "खंड" िब्द के स्ट् र्ाि पर "पैरा" िब्द रखा िाएगा। 7. उक्त आदेि में, पैरा 8 में, "मुयय जिदेिक" िब्दों के स्ट् र्ाि पर "जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय)" िब्द और कोष् ठक रखे िाएंगे। 8. उक्त आदेि में, पैरा 9 के स्ट् र्ाि पर जिम्नजलजखत रखा िाएगा, अर्ावत्:- “9. प्रत्येक उत्पादक, उत् तरर्ती मास की पंद्रहर्ीं तारीख तक जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय) को जिम्नजलजखत के संबंध में माजसक जर्र्रणी प्रस्ट्तुत करेगा- (क) प्रसंस्ट्करण इकाई द्वारा कच्चे माल के रूप में प्राप्त और प्रयुक्त प्रत्येक र्िस्ट्पजत तेल तर्ा जपछले एक मास के दौराि समय-समय पर जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय) द्वारा जर्जिर्दवष्ट प्ररूप में जर्जिर्मवत, जर्क्रय दकया गया, आयाजतत या जियावजतत प्रत्येक र्िस्ट्पजत तेल उत्पाद; (ख) पूर्वर्ती एक मास के दौराि उसके द्वारा धाररत स्ट्टॉक और जिष्कर्षवत जर्लायक तेल, उत्पाददत या प्रेजषत तेल की मात्रा और दकस्ट्में; (ग) पूर्वर्ती एक मास के दौराि धाररत स्ट्टॉक तर्ा प्रयुक्त तेल-युक्त सामग्री की मात्रा और दकस्ट्में।” 9. उक्त आदेि में, पैरा 10 के स्ट् र्ाि पर जिम्नजलजखत रखा िाएगा, अर्ावत्:- “10. सूचिा मांगिे, प्रजर्जष्ट करिे तर्ा जिरीिण करिे की िजक्त- जिदेिक (चीिी और र्िस्ट्पजत तेल जिदेिालय) या िोडल अजधकारी या उिके द्वारा जियुक्त कोई भी व्यजक्त दकसी भी पररसर में प्रर्ेि कर जिरीिण कर सकता है या प्रर्ेि करा सकता है तर्ा र्िस्ट्पजत तेल उत्पादों के उत्पादि, आपूर्तव, जर्तरण, आयात और जियावत से संबंजधत दकसी भी अजभलेख, जिसमें उिके उत्पादि में प्रयुक्त कच्चे माल की खरीद भी िाजमल है, र्ाहिों या िलयािों का जिरीिण कर सकता है तर्ा र्िस्ट्पजत तेल उत्पादों के स्ट्टॉक को िब्त कर सकता है, जिसके संबंध में उसे ऐसा जर्श्वास है दक र्ास्ट्तजर्क उत्पादि या जबक्री का मूल्य जिदेिालय में फाइल की गई जर्र्रणी और आंकडों के अिुरूप िहीं है तर्ा प्रत्येक उत्पादक जिदेिक, (चीिी और र्िस्ट्पजत तेल जिदेिालय) को ऐसी सभी िािकारी देिे के जलए बाध्य होगा।” 10. उक्त आदेि में, पैरा 11 के, उप-पैरा (2) का लोप दकया िाएगा। 11. उक्त आदेि में, पैरा 12 के स्ट्र्ाि पर जिम्नजलजखत रखा िाएगा, अर्ावत्:- “12. आदेिों का अिुपालि – प्रत्येक उत्पादक, जिसे इस आदेि द्वारा या इसके अधीि प्रदत्त दकसी भी िजक्त के अधीि कोई आदेि या जिदेि िारी दकया िाता है, ऐसे आदेि या जिदेि का अिुपालि करेगा।” 12. उक्त आदेि में, "अिुसूची-1" के स्ट् र्ाि पर जिम्नजलजखत रखी िाएगी, अर्ावत्:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “अिुसूची-1 [पैरा 3(1) देजखए] र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 के अधीि रजिस्ट् रीकरण के जलए आर्ेदि सेर्ा में, जिदेिक महोदय, चीिी और र्िस्ट्पजत तेल जिदेिालय, पााँचर्ीं मंजिल, ई वर्ंग, कृजष भर्ि, िई ददल्ली-110001 महोदय, मैं/हम ………………… (आर्ेदक का िाम और पता) अिुरोध करता/करती हाँ दक मुझे/हमें र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 के अधीि रजिस्ट् रीकृत दकया िाए। 1. (क) इकाई का िाम और पता (स्ट्र्ाि): जिला: ________________ राज् य: _________________जपि__________________ (ख) प्रधाि कायावलय या प्रिासजिक कायावलय का पता: जिला: ________________ राज् य: _________________जपि__________________ 2. जर्जिमावण की र्स्ट्तु और र्ार्षवक स्ट्र्ाजपत िमता: क्र. सं र्िस्ट्पजत तेल उत्पाद जर्जिमावण इकाई की स्ट्र्ापिा की तारीख र्ार्षवक स्ट्र्ाजपत िमता (टि में) 3. खाद्य सुरिा और मािक अजधजियम, 2006 (2006 का 34) के अधीि रजिस्ट् रीकरण या अिुज्ञजप्त संयया: (संलग्न की िािे र्ाली प्रजतजलजप) 4. संयंत्र और मिीिरी का जर्र्रण: (पृर्क िीट संलग्न करें, यदद अपेजित हो) मैं/हम एतद्द्वारा प्रमाजणत करता/करती हाँ/करते हैं दक उपरोक्त कर्ि मेरी/हमारी सर्ोत्तम िािकारी और जर्श्वास के अिुसार सत्य और सही है। मैं/हम एतद्द्वारा र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 के सभी उपबंधों का अिुपालि करिे का र्चि देता/देती हाँ/देते हैं। हस्ट्तािर िाम पता फोि िंबर ई-मेल (आर्ेदक की पूरी जर्जिजष्टयां अर्ावत िाम और पदिाम आदद बडे अिरों में).” [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 13. उक्त आदेि में, "अिुसूची-2" के स्ट् र्ाि पर जिम्नजलजखत रखी िाएगी, अर्ावत्:- “अिुसूची -2 [पैरा 3(2) देजखए] भारत सरकार उपभोक्ता मामले, खाद्य और सार्विजिक जर्तरण मंत्रालय (खाद्य और सार्विजिक जर्तरण जर्भाग) चीिी और र्िस्ट्पजत तेल जिदेिालय रजिस्ट् रीकरण प्रमाणपत्र यह प्रमाजणत दकया िाता है दक सुश्री ............................................................... इस जिदेिालय में र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 के अधीि रजिस्ट् रीकृत हैं तर्ा उन्हें िीचे उजल्लजखत रजिस्ट् रीकरण संयया आर्ंरटत की गई है: संय या.……………………………………… तारीख……………………… जिम्नजलजखत उत्पादों के जर्जिमावण हेतु …………………………. जस्ट्र्त कारखािे के जलए: मद र्ार्षवक स्ट्र्ाजपत िमता (टि में) (i) (ii) (iii) तारीख: (……………………) जिदेिक”. 14. उक्त आदेि में अिुसूची-3 का लोप दकया िाएगा। [फा. सं. 25/01/2018/-ओआईएल] ऐजलस टेटे, जिदेिक रटप् पण: र्िस्ट्पजत तेल उत्पाद उत्पादि और उपलब्धता (जर्जियमि) आदेि, 2011 भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में संय यांक सा.का.जि. 664(अ), तारीख 7 जसतंबर, 2011 द्वारा प्रकाजित हुआ र्ा। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Food and Public Distribution) ORDER New Delhi, the 1st August, 2025 G.S.R. 523(E).— In exercise of powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following order to amend the Vegetable Oil Products Production and Availability (Regulation) Order, 2011, namely:- 1. Short title and commencement.- (1) This order may be called the Vegetable Oil Products Production and Availability (Regulation) Amendment Order, 2025. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Vegetable Oil Products Production and Availability (Regulation) Order, 2011 (hereinafter referred to as the said order), for paragraph 2,the following shall be substituted, namely:–“2. Definitions.-(1) In this order, unless the context otherwise requires,- (a) “Act” means the Essential Commodities Act, 1955(10 of1955); (b) “adjudicating officer” means the officer appointed under section 15A of the Collection of Statistics Act, 2008 (7 of 2009); (c) “appellate authority” means the appellate authority under section 15B ofthe Collection of Statistics Act, 2008 (7 of 2009); (d) “Director (Directorate of Sugar and Vegetable Oils)” means such officer appointed by the Central Government to exercise any or all of the powers under this order; (e) “Directorate” means the Directorate of Sugar and Vegetable Oils; (f) “information schedule” means information schedule as defined in clause (d) of section 2 of the Collection of Statistics Act, 2008 (7 of 2009); (g) “nodal officer” means officer as defined in clause (da) of section 2 of the Collection of Statistics Act, 2008 (7 of 2009); (h) “producer” means a person or firm or company engaged in the business of producing any vegetable oil product or any solvent-extracted vegetable oil, either in his own factory or in the factory of any other person, acting on his behalf; (i) “registration certificate” means the registration granted to a producer under paragraph 4 of this order. (j) “Schedule” means Schedule annexed to this order; (k) “vegetable oil” means oil produced from oilcake or oilseed or oil-bearing material of plant origin and containing glycerides; (l) “vegetable oil product” means any vegetable oil in its crude form, or subjected to any process like filtration, centrifugation, refining (including neutralisation, bleaching using bleaching earths and deodorisation), interestrification, hydrogenation, fractionation, winterisation, emulsification with water or any other process notified by the Government from time to time, blended (blends of two or more different types of vegetable oils); (2) Words and expressions used but not defined in this order and defined in the Essential Commodities Act, 1955 (10 of 1955) or the Food Safety and Standards Act, 2006 (34 of 2006) or rules or regulations made thereunder, shall have the meanings assigned to them in that Act or rules or regulations, as the case may be, respectively”. 3. In the said order, for paragraph 3, the following shall be substituted, namely:– “3.Registration.-(1) A producer who intends to produce, stock for sale or offer for sale vegetable oil, vegetable oil product, solvent extracted oil, shall make an application to the Director (Directorate of Sugar and Vegetable Oils) as specified in Schedule-ɪ and obtain a registration certificate as specified in Schedule-ɪɪ. (2) The Director (Directorate of Sugar and Vegetable Oils)may after making necessary enquiries, as he deems fit, issue the registration certificate, as specified in Schedule-ɪɪ to the applicants or reject the application, for reasons to be recorded in writing”. In the said order, in paragraph 4,- (a) the words“,de-oiled meal or edible flour” shall be omitted; (b) for the word “Clause”, the word “paragraph” shall be substituted. 5. In the said order, in paragraph 5,for the words, “Chief Director”, the words and brackets “Director (Directorate of Sugar and Vegetable Oils)"shall be substituted. 6. In the said order, in paragraph 6, for the word “Clause”, occurring at both the places, the word “paragraph” shall be substituted. 7. In the said order, in paragraph 8, for the words and brackets “Chief Director”, the words “Director (Directorate of Sugar and Vegetable Oils)" shall be substituted. 8. In the said order, for paragraph 9, the following shall be substituted, namely:- “9. Every producer shall furnish monthly return by the fifteenth day of the succeeding month to the Director (Directorate of Sugar and Vegetable Oils)in respect of- (a) each vegetable oil received and used by the processing unit as raw material and each vegetable oil product manufactured, sold or imported or exported during the past one month in a form specified by the Director (Directorate of Sugar and Vegetable Oils) from time to time; (b) the stocks heldand the quantities and varieties of solvent extracted oil, produced or dispatched by him during the preceding one month; (c) the stocks held and the quantities and varieties of oil-bearing material used during the preceding one month”. 9. In the said order, for paragraph 10, the following shall be substituted,namely:- “10. Power to call for information and entry and carry out inspection.- The Director (Directorate of Sugar and Vegetable Oils) or nodal officer or any person appointed by them may enter and inspect or cause to enter and inspect any premises, any record relating to the production, supply, distribution, import and export of vegetable oil products including the purchase of raw materials used in their production, vehicles or vessels and seize the stocks of vegetable oil products, in respect of which he has reason to believe that the value of actual production or sale are not commensurate with the returns and the data filed with the Directorate and every producer shall be bound to furnish all such information to the Director, (Directorate of Sugar and Vegetable Oils)”. 10. In the said order, in paragraph 11, sub-paragraph (2) shall be omitted. 11. In the said order, for paragraph 12, the following shall be substituted, namely:- “12. Compliance of orders. –Every producer to whom any order or direction is issued under any powers conferred by or under this order, shall comply with such order or direction”. 12. In the said order, for "SCHEDULE–I", the following shall be substituted,namely:- “ SCHEDULE-I [Seeparagraph 3(1)] Application for registration under the Vegetable Oil Products Production and Availability (Regulation) Order, 2011. To The Director, Directorate of Sugar and Vegetable Oils, 5th floor, E wing, KrishiBhawan, New Delhi-110001 Sir, I/we ………………… (Name and address of the applicant) request that I/We may be registered under the Vegetable Oil Products Production and Availability (Regulation) Order, 2011. 1. Item of manufacture and annual installed capacity: Sl. I/We hereby undertake to comply with all the provisions of the Vegetable Oil Products Production and Availability (Regulation) Order, 2011. In the said order, SCHEDULE-III shall be omitted. [F. No. 25/01/2018/-OIL] ALICE TETE, Director Note: The Vegetable Oil Products Production and Availability (Regulation) Order, 2011 was published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) vide number G.S.R. 664(E), dated the 7th September, 2011.
