जसतम् बर, 2025 सा.का.जन. 596(अ).— केन्द्रीय सरकार, आप्रवास और जविेजियों जवषयक अजधजनयम, 2025 (2025 का 13) की धारा 30 द्वारा प्रित्त िजियों का प्रयोग करते हुए, और पासपोर्ट (भारत में प्रवेि) जनयम, 1950, जविेजियों का रजिस्ट्रीकरण जनयम, 1992 और आप्रवास (वाहक िाजयत्व) जनयम, 2007 को उन बातों के जसवाय अजधक्ांत करते हुए, जिन्द्हे ऐसे अजधक्मण से पूवट दकया गया है या करने का लोप दकया गया है, जनम्नजलजखत जनयम बनाती है, अर्ाटत:- अध्याय 1 प्रारंजभक 1. संजिप्त नाम और प्रारंभ.- (1) इन जनयमों का संजिप्त नाम आप्रवास और जविेजियों जवषयक जनयम, 2025 है । (2) ये रािपत्र में प्रकािन की तारीख से लागू होंगे । 2. पररभाषाएं.-- (1) इन जनयमों में, िब तक दक संिभट से अन्द्यर्ा अपेजित न हो,-- (क) “अजधजनयम” से आप्रवास और जविेजियों जवषयक अजधजनयम, 2025 (2025 का 13) अजभप्रेत है; सं. 552] नई दिल्ली, सोमवार, जसतम् बर 1, "बायोमेररक्स सूचना" से दकसी व्यजि का फोर्ो, फफंगर प्प्रंर्, आईररस स्ट्कैन या ऐसी अन्द्य िैजवक जविेषताएं अजभप्रेत हैं, िो केंरीय सरकार द्वारा जवजनर्िटष्ट की िाए; (ग) “रजिस्ट्रीकरण प्रमाणपत्र” से जनयम 13 के अधीन िारी रजिस्ट्रीकरण प्रमाणपत्र अजभप्रेत है; (घ) “प्ररूप” से इन जनयमों के सार् संलग्न प्ररूप अजभप्रेत है; (ङ) “जनवास” से भारत में साधारण जनवास स्ट्र्ान अजभप्रेत है । (2) उन िब्िों और पिों के, िो इसमें प्रयुि हैं फकंतु पररभाजषत नहीं हैं, वही अर्ट होगा िो अजधजनयम में उनके हैं । अध्याय 2 आप्रवास से संबंजधत मामले 3. आप्रवास अजधकारी के अन्द्य कायट.- आप्रवास कायों के अजतररि, आप्रवास अजधकारी जनम्नजलजखत अन्द्य कायट भी करेगा, अर्ाटत्:- (क) ऐसे आप्रवास पोस्ट्र् के जलए जनधाटररत मानकों को पूरा करने के जलए आप्रवास पोस्ट्र् पर कायों की जनयजमत रूप से जनगरानी करना; (ख) आप्रवास धोखाधड़ी के मामलों की िांच करना; (ग) आप्रवास मामलों में जवजध प्रवतटन अजभकरणों और अन्द्य जहतधारको के सार् समन्द्वय करना; (घ) आप्रवास से संबंजधत डेर्ाबेस को एकजत्रत करना और बनाए रखना; और (ङ) आप्रवास प्रदक्या से गुिर रहे व्यजियों का मागटििटन और सहायता प्रिान करना । 4. आप्रवास ब्यूरो के अन्द्य कायट.- अजधजनयम की धारा 5 की उपधारा (1) में उपबंजधत कायों के अजतररि, आसूचना ब्यूरो के पयटवेिण के अधीन कायटरत आप्रवास ब्यूरो जनम्नजलजखत कायट भी करेगा, अर्ाटत्:- (क) जविेजियों को रजिस्ट्रीकरण सेवाएं और अन्द्य वीजा संबंधी सेवाएं प्रिान करना; (ख) अजधजनयम के उपबंधों, जनयमों, आिेिों और केन्द्रीय सरकार द्वारा बनाए गए आिेिों को लागू करना; (ग) जविेजियों की पहचान, आवागमन पर जनबंधन और जनवाटसन से संबंजधत मामलों पर राज्य सरकारों या संघ राज्यिेत्र प्रिासनों और अन्द्य अजभकरणों के सार् समन्द्वय करना; (घ) सूचना प्रौद्योजगकी प्रणाजलयों का प्रबंधन करना तर्ा आप्रवास और जविेजियों से संबंजधत मामलों पर डेर्ा का संरिक; और (ङ) आप्रवास और जविेजियों से संबंजधत नीजतगत मामलों पर केंरीय सरकार को सलाह िेना । 5. आप्रवास ब्यूरो के अजधकाररयों की जनयुजि की रीजत.- (1) केन्द्रीय सरकार, आसूचना ब्यूरो के जनिेिक की जसफाररिों पर, आप्रवास ब्यूरो के आयुि की जनयुजि करेगी, िो आसूचना ब्यूरो का एक अजधकारी होगा । (2) आप्रवास ब्यूरो के अजधकारी, िो आसूचना ब्यूरो द्वारा उपलब्ध कराए िाएंगे, केन्द्रीय सरकार द्वारा जवजनर्िटष्ट रीजत से जनयुि दकए िाएंगे । 6. आप्रवास ब्यूरो के आयुि के अन्द्य कायट.- आप्रवास ब्यूरो के आयुि में आप्रवास कायों के समग्र पयटवेिण के अजतररि, जनम्नजलजखत अन्द्य कायट जनजहत होंगे, अर्ाटत्:- (क) आप्रवास ब्यूरो के प्रिासन, सतकटता और प्रोजविप्नंग संबंधी मामलें ; (ख) आप्रवास ब्यूरो के जवत्तीय मामलें; और (ग) जनयम 3 और जनयम 4 में जनर्िटष्ट सभी मामलों और कायों की जनगरानी और पयटवेिण। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अध्याय 3 जविेजियों से संबंजधत मामले 7. अन्द्य यात्रा िस्ट्तावेि िारी करने की ितें.- (1) दकसी भारतीय नागररक को िारी दकया गया कोई अन्द्य यात्रा िस्ट्तावेि पासपोर्ट अजधजनयम, 1967 (1967 का 15) के उपबंधों और उसके अधीन बनाए गए जनयमों के अनुरूप होगा । (2) दकसी जविेिी िेि की सरकार के प्राजधकार के अधीन िारी दकया गया कोई अन्द्य यात्रा िस्ट्तावेि, जिसके आधार पर कोई जविेिी भारत में प्रवेि कर सकता है या भारत से होकर पारगमन कर सकता है या भारत में रह सकता है या भारत से बाहर जनकल सकता है, जनम्नजलजखत ितों के अनुरूप होगा, अर्ाटत्: - (क) यह उस िेि की सरकार द्वारा या उसकी ओर से िारी या नवीकृत दकया गया हो जिसका वह व्यजि नागररक है जिससे यह संबंजधत है और इसकी जवजधमान्द्यता अवजध के भीतर हो; (ख) यह दक उस पर उस व्यजि का फोर्ो लगा हो जिससे वह संबंजधत है तर्ा यात्रा िस्ट्तावेि िारी करने वाले प्राजधकारी द्वारा सम्यक् रूप से प्रमाजणत दकया गया हो; और (ग) उसके पास जनयम 9 में जनर्िटष्ट प्राजधकाररयों द्वारा प्रिान दकया गया उजचत श्रेणी का जवजधमान्द्य वीजा होगा िो जविेजियों को भारत के राज्यिेत्र में प्रवेि करने या पारगमन करने या रहने या जनकास की अनुमजत िेगा। 8. पासपोर्ट िारी करने की ितें.- (1) दकसी भारतीय नागररक को िारी दकया गया भारतीय पासपोर्ट, पासपोर्ट अजधजनयम, 1967 (1967 का 15) के उपबंधों और उसके अधीन बनाए गए जनयमों के अनुरूप हो । (2) दकसी जविेिी सरकार के प्राजधकार के अधीन िारी दकया गया कोई पासपोर्ट, जिसके आधार पर कोई जविेिी भारत में प्रवेि कर सकता है या भारत से होकर पारगमन कर सकता है या भारत में रह सकता है या भारत से बाहर जनकल सकता है, जनम्नजलजखत ितों के अनुरूप हो, अर्ाटत्: - (क) यह उस िेि की सरकार द्वारा या उसकी ओर से िारी या नवीकृत दकया गया हो, जिसका वह व्यजि नागररक है, जिससे यह संबंजधत है, और इसकी जवजधमान्द्यता की अवजध के भीतर हो; (ख) इसमें उस व्यजि का फोर्ो लगाया हो जिससे यह संबंजधत है, जिसे पासपोर्ट िारी करने वाले प्राजधकारी द्वारा सम्यक् रूप से प्रमाजणत दकया हो, जसवाय उन मामलों के िहां पंरह वषट से कम आयु के बच्चे को उसके माता- जपता में से दकसी के पासपोर्ट में सजम्मजलत दकया गया हो; और (ग) उसके पास जनयम 9 में जनर्िटष्ट प्राजधकाररयों द्वारा प्रित्त उजचत श्रेणी का जवजधमान्द्य वीजा हो िो जविेिी को भारत में प्रवेि करने या पारगमन करने या रहने या जनकास की अनुमजत िेता हो, अर्वा नागररकता अजधजनयम, 1955 (1955 का 57) के उपबंधों के अधीन भारत के काडटधारक जविेिी नागररक के रूप में रजिस्ट्रीकृत व्यजियों के पास भारत का जविेिी नागररक काडट हो। (3) उपजनयम (2) के खंड (ग) में अंतर्वटष्ट कोई भी बात जनम्नजलजखत पर या उसके संबंध में लागू नहीं होगी, - (क) िजिण एजियाई िेत्रीय सहयोग संगठन िेिों के नागररकों की कोई भी श्रेणी, िो िजिण एजियाई िेत्रीय सहयोग संगठन िेिों की वीजा छूर् स्ट्कीम या वीजा उिारीकरण स्ट्कीम के अधीन आती है, बिते, उनके पास िजिण एजियाई िेत्रीय सहयोग संगठन िेिों का जवजधमान्द्य वीजा समर्टन और संबंजधत राष्ट्र का पासपोर्ट हो; और (ख) दकसी िेि के नागररक या नागररकों का वगट या कोई भी जविेिी या जविेिी वगट या प्रकार का जविेिी जिसे अजधजनयम की धारा 33 के अधीन पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि और वीजा की आवश्यकता से छूर् िी गई है । 9. वीजा िेने या रद्द करने के जलए प्राजधकृत प्राजधकारी.- (1) दकसी जविेिी को भारत में प्रवेि करने या पारगमन करने या रहने या जनकास की अनुमजत िेने वाला वीजा जनम्नजलजखत प्राजधकाररयों में से दकसी के द्वारा प्रिान दकया िाएगा, अर्ाटत:- (क) केन्द्रीय सरकार में जविेि मंत्रालय, जिसमें जविेि जस्ट्र्त भारतीय जमिन या िूतावास भी सजम्मजलत हैं; या (ख) आप्रवास ब्यूरो । (2) उपजनयम (1) में जनर्िटष्ट प्राजधकारी पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि के आधार पर िारी दकए गए वीजा को रद्द कर या उसकी अवजध कम कर सकते है । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10. रजिस्ट्रीकरण अजधकारी.-- (1) रजिस्ट्रीकरण अजधकारी, केन्द्रीय सरकार के अनुमोिन से, दकसी अजधकारी को उसकी ओर से रजिस्ट्रीकरण अजधकारी के कतटव्यों का पालन करने के जलए जलजखत रूप में प्राजधकृत कर सकेगा । (2) जविेिी जवषयक िेत्रीय रजिस्ट्रीकरण अजधकारी, जविेिी जवषयक रजिस्ट्रीकरण अजधकारी और आप्रवास पोस्ट्र् पर आप्रवास अजधकारी रजिस्ट्रीकरण अजधकारी के कायट जनष्पादित करेंगे। (3) जविेिी जवषयक रजिस्ट्रीकरण अजधकारी अजधजनयम, जनयमों, आिेिों और जनिेिों के प्रयोिन के जलए िेत्राजधकार प्राप्त जविेिी जवषयक िेत्रीय रजिस्ट्रीकरण अजधकारी के अधीन कायट करेगा । 11. भारत में आने वाले जविेजियों के जलए आप्रवास केंर पर ररपोर्ट करने की ितें और रीजत.- (1) भारत में आगमन पर प्रत्येक जविेिी को आप्रवास केंर पर अपना पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि, और वीिा या भारत का जविेिी नागररक काडट या इलेक्रॉजनक यात्रा प्राजधकार प्रस्ट्तुत करना होगा, जिसका उद्देश्य नाम, राष्ट्रीयता, आयु, प्लंग और िन्द्म स्ट्र्ान का सत्यापन करना होगा; और िब आप्रवास अजधकारी द्वारा मांग की िाती है, तो उसे भारत में पता या इजछछत पता, यात्रा का उद्देश्य और भारत में रहने की प्रस्ट्ताजवत अवजध या कोई अन्द्य सुसंगत िानकारी िेनी होगी । (2) दकसी जविेिी को, जिसकी बायोमेररक िानकारी आप्रवास अजधकारी के पास उपलब्ध नहीं है, या जिसे उसके द्वारा बायोमेररक िानकारी प्रस्ट्तुत करने का जनिेि दिया गया है, आप्रवास पोस्ट्र् पर ऐसा करना अपेजित होगा । 12. भारत में आने वाले जविेजियों के जलए रजिस्ट्रीकरण अजधकारी के पास रजिस्ट्रीकरण कराने की ितें और रीजत.- (1) भारत में रजिस्ट्रीकरण के प्रयोिन और वीिा सेवाओं के जलए, कोई जविेिी भारत में आगमन के चौिह दिनों के भीतर आवेिन प्रस्ट्तुत करेगा- (क) मोबाइल एप्लीकेिन, अर्ाटत् “भारतीय वीजा सुस्ट्वागतम” या दकसी नाम या नामों से, िो समय-समय पर ऐसे एप्लीकेिन को दिए िा सकते हैं, पर; या (ख) रजिस्ट्रीकरण अजधकारी के पास जनर्िटष्ट ऑनलाइन पोर्टल अर्ाटत् https://indianfrro.gov.in पर प्ररूप-I में : परंतु यदि कोई जविेिी वीजा के अजतररि दकसी अन्द्य आधार पर भारत में प्रवेि करता है और यदि वह भारत में रहने का आिय रखता है, तो उसे आगमन पर रहने के जलए अनुमत अवजध की समाजप्त से पहले रजिस्ट्रीकरण कराना होगा: परन्द्तु यह और भी दक िहां भारत का कोई जनवासी नागररक भारत का नागररक न रहने के कारण जविेिी हो िाता है, तो उसे भारत का नागररक न रहने के तीस दिन के भीतर रजिस्ट्रीकरण कराना होगा । स्ट्पष्टीकरण-- इस परंतुक के प्रयोिनों के जलए, वह तारीख, जिस दिन संबंजधत व्यजि भारत का नागररक नहीं रह गया समझा िाएगा, — (क) िहां उसने स्ट्वेछछा से िेिीकरण या रजिस्ट्रीकरण द्वारा दकसी अन्द्य िेि की नागररकता अर्िटत की है, वहां ऐसे िेिीकरण या रजिस्ट्रीकरण की तारीख; (ख) िहां उसने दकसी अन्द्य िेि की सरकार से पासपोर्ट प्राप्त दकया है, वह तारीख जिस दिन ऐसा पासपोर्ट प्राप्त दकया गया र्ा; या (ग) ऐसे व्यजि की ििा में, जिसके संबंध में नागररकता अजधजनयम, 1955 (1955 का 57) की धारा 9 की उपधारा (2) के अधीन यह अजभजनधाटररत करते हुए आिेि दिया गया है दक उसने दकसी जविेिी िेि की नागररकता प्राप्त कर ली है, ऐसे आिेि के िारी दकए िाने की तारीख, होगी: परंतु यह भी दक कोई जविेिी व्यजि एक सौ अस्ट्सी दिन या उससे कम अवजध के जलए भारत में रहने के जलए जवजधमान्द्य वीजा पर भारत में प्रवेि करता है और एक सौ अस्ट्सी दिन की अवजध से अजधक भारत में रहना चाहता है, तो उसे भारत में अपने आगमन के एक सौ अस्ट्सी दिन की समाजप्त के बाि चौिह दिनों के भीतर रजिस्ट्रीकरण कराना होगा: परंतु यह भी दक ऐसे जविेिी के मामले में िो एक सौ अस्ट्सी दिन से अजधक अवजध के जलए भारत में रहने के जलए जवजधमान्द्य वीजा पर भारत में प्रवेि करता है, इस ितट के सार् दक 'प्रत्येक प्रवास एक सौ अस्ट्सी दिन से अजधक नहीं होगा' और िो दकसी एक अवसर पर या एक कैलेंडर वषट में कुल जमलाकर एक सौ अस्ट्सी दिन की अवजध से अजधक भारत में रहना चाहता है, तो उसे उि एक सौ अस्ट्सी दिन की अवजध की समाजप्त से पहले दकसी भी समय रजिस्ट्रीकरण कराना होगा: [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 परंतु यह भी दक दकसी जविेिी के मामले में िो दकसी जवजनर्िटष्ट िेि का नागररक है या दकसी जवजनर्िटष्ट वगट या वगों से संबंजधत है, जिसके जलए सामान्द्य या जविेष आिेि द्वारा रजिस्ट्रीकरण के जलए एक अलग समयरेखा जवजहत की गई है, ऐसा जविेिी उि आिेि में जवजनर्िटष्ट अवजध के भीतर रजिस्ट्रीकरण अजधकारी के पास रजिस्ट्रीकरण करेगा । (2) भारत में जविेजियों से िन्द्मे बच्चो के संबंध में (िहां माता-जपता में से कोई एक या िोनों जविेिी हैं), संबंजधत जविेिी, उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एजप्लकेिन पर नए वीिा की मंिूरी और जनकास की अनुमजत सजहत वीिा सेवाओं के जलए िन्द्म के तीस दिनों के भीतर रजिस्ट्रीकरण अजधकारी को बच्चे के िन्द्म की सूचना इलेक्रॉजनक माध्यम से िेंगे । (3) रजिस्ट्रीकरण अजधकारी जविेिी से कोई अजतररि िानकारी मांग सकता है या जविेिी को व्यजिगत सािात्कार के जलए तर्ा बायोमेररक िानकारी प्राप्त करने के जलए ऐसे स्ट्र्ान और समय पर बुला सकता है, जिसे वह जनजित करे । (4) जनम्नजलजखत के मामले में ऐसा रजिस्ट्रीकरण आवश्यक नहीं होगा- (क) कोई जविेिी िो एक सौ अस्ट्सी दिन से कम की अवजध के जलए जवजधमान्द्य वीजा पर भारत में प्रवेि करता है और िो उि अवजध से अजधक भारत में नहीं रहता है, िब तक दक वीजा पर पृष्ांकन में जविेष रूप से यह अपेिा न की गई हो दक वह पृष्ांकन में जवजनर्िटष्ट अवजध के भीतर भारत आगमन पर स्ट्वयं को रजिस्ट्रीकृत कराए; (ख) एक जविेिी िो एक सौ अस्ट्सी दिनों से अजधक की अवजध के जलए भारत में रहने के जलए जवजधमान्द्य वीजा पर भारत में प्रवेि करता है, इस ितट के सार् दक ‘प्रत्येक प्रवास एक सौ अस्ट्सी दिनों से अजधक नहीं होगा’ और िो दकसी भी एक अवसर पर या एक कैलेंडर वषट में कुल जमलाकर एक सौ अस्ट्सी दिनों की अवजध से अजधक भारत में नहीं रहना चाहता है; (ग) एक जविेिी िो बारह वषट से कम आयु का बच्चा है; और (घ) नागररकता अजधजनयम, 1955 (1955 का 57) की धारा 7क के अधीन भारत के काडटधारक जविेिी नागररक के रूप में रजिस्ट्रीकृत व्यजि । (5) भारत का जनवासी कोई भारत का काडटधारक जविेिी नागररक, िब भी उसके स्ट्र्ायी आवासीय पते या व्यवसाय में कोई पररवतटन होता है, तो उसे इलेक्रॉजनक रूप से या उपजनयम (1) के खंड (ख) में जनर्िटष्ट ऑनलाइन पोर्टल के माध्यम से रजिस्ट्रीकरण अजधकारी को सूजचत करना होगा । (6) रजिस्ट्रीकरण के प्रयोिन के जलए, भारत में दकसी जविेिी का पता होगा - (क) उसका जनवास स्ट्र्ान; या (ख) यदि उसके पास कोई जनवास नही है तो िहां रजिस्ट्रीकरण के जलए आवेिन करते समय रह रहा है, या िहां वह भारत आने के बाि पहली बार रहने का आिय रखता है : परन्द्तु वह भारत में जनवास करने वाले व्यजि या वास सुजवधा चलाने वाले की पूवट सहमजत से ऐसे व्यजि का नाम और पता भारत में उसके पते के रूप में ररपोर्ट कर सकेगा : परंतु यह और दक जविेिी को अपने वतटमान पते की िानकारी ऐसे व्यजि या वास सुजवधा चलाने वाले को िेनी होगी : परंतु यह भी दक संबंजधत व्यजि या वास सुजवधा चलाने वाला, जविेिी से संबंजधत अपने पास जवद्यमान ऐसी सभी िानकारी प्रस्ट्तुत करेगा, जिसकी मांग रजिस्ट्रीकरण अजधकारी, आप्रवास अजधकारी, जिला मजिस्ट्रेर् या पुजलस अजधकारी िो हेड कांस्ट्र्ेबल के पि से नीचे का न हो, द्वारा की िाए । 13. रजिस्ट्रीकरण प्रमाणपत्र.- (1) रजिस्ट्रीकरण अजधकारी, ऐसी िांच करने के पिात्, िो वह आवश्यक समझे, संतुष्ट हो िाने पर दक जनयम 12 के उपजनयम (1) के अधीन दकए गए आवेिन में अंतर्वटष्ट जवजिजष्टयां सही और पूणट हैं, जविेिी को रजिस्ट्रीकरण प्रमाणपत्र प्रिान करेगा । (2) उपजनयम (1) के अधीन प्रिान दकए गए रजिस्ट्रीकरण प्रमाणपत्र में वह अवजध ििाटई िाएगी जिसके जलए जविेिी को भारत में रहने के जलए प्राजधकृत दकया गया है और वीजा पर भारत में रहने के स्ट्र्ान, यदि कोई हों, भी ििाटए िाएंगे । (3) ऐसा रजिस्ट्रीकरण प्रमाण पत्र प्रिान करते समय, रजिस्ट्रीकरण अजधकारी उस अवजध को भी जनबंजधत कर सकता है जिसके जलए जविेिी को भारत में रहने के जलए प्राजधकृत दकया गया है और जविेिी के रहने के स्ट्र्ानों को भी वीजा में जवजनर्िटष्ट दकसी भी स्ट्र्ान तक सीजमत कर सकता है । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) प्रत्येक जविेिी जिसे उपजनयम (1) के अधीन रजिस्ट्रीकरण प्रमाणपत्र िारी दकया गया है - (क) यदि रजिस्ट्रीकरण प्रमाणपत्र में भारत में रहने के जलए स्ट्र्ान या स्ट्र्ानों का उल्लेख है तो वह दकसी अन्द्य स्ट्र्ान पर तब तक नहीं िाएगा िब तक दक उसने ऐसे अन्द्य स्ट्र्ान पर िाने के जलए रजिस्ट्रीकरण अजधकारी से जविेष अनुमजत प्राप्त नहीं कर ली हो; (ख) यदि रजिस्ट्रीकरण प्रमाणपत्र में भारत में रहने के जलए स्ट्र्ान या स्ट्र्ानों का उल्लेख है, तो वह, यर्ाजस्ट्र्जत, ऐसे दकसी स्ट्र्ान पर अपने आगमन और वहां से प्रस्ट्र्ान की सूचना, आगमन के चौबीस घंर्े के भीतर या अपने इजछछत प्रस्ट्र्ान से पूवट, संबंजधत रजिस्ट्रीकरण अजधकारी को िेगा; और (ग) यदि रजिस्ट्रीकरण अजधकारी द्वारा रजिस्ट्रीकरण प्रमाण पत्र में ििाटई अवजध को नहीं बढाया िाता है, उि अवजध की समाजप्त से पहले भारत से प्रस्ट्र्ान करना होगा । 14. पहचान के सबूत का प्रस्ट्तुतीकरण.- (1) प्रत्येक जविेिी को रजिस्ट्रीकरण अजधकारी, आप्रवास अजधकारी, जिला मजिस्ट्रेर् या पुजलस अजधकारी िो हेड कांस्ट्र्ेबल के पि से नीचे का न हो, द्वारा मांगे िाने के चौबीस घंर्े के भीतर, ऐसे स्ट्र्ान पर, िो जवजनर्िटष्ट दकया िाए, अपना पासपोर्ट या अपनी पहचान के अन्द्य यात्रा िस्ट्तावेि, जिनकी आवश्यकता हो, प्रस्ट्तुत करना होगा: परन्द्तु रजिस्ट्रीकरण अजधकारी, आप्रवास अजधकारी, जिला मजिस्ट्रेर् या पुजलस अजधकारी िो हेड कांस्ट्र्ेबल के पि से नीचे का न हो, पयाटप्त कारण ििाटए िाने पर, उि पासपोर्ट या अन्द्य यात्रा िस्ट्तावेिों को प्रस्ट्तुत करने के जलए आवश्यक पररजस्ट्र्जतयों में, चौबीस घंर्े की पूवोि अवजध को अजधकतम सात दिन तक बढा सकेगा । (2) भारत में प्रवेि करने वाला प्रत्येक जविेिी, रजिस्ट्रीकरण अजधकारी या आप्रवास अजधकारी द्वारा मांगे िाने पर, अपना पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि उस अजधकारी को सौंप िेगा, तत्पिात् अपना पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि वापस प्राप्त करने के जलए वह ऐसे समय और स्ट्र्ान पर उपजस्ट्र्त होगा िैसा रजिस्ट्रीकरण अजधकारी या आप्रवास अजधकारी जनिेजित करे । (3) िहां उपजनयम (2) के अनुसरण में कोई जविेिी अपना पासपोर्ट या अन्द्य यात्रा िस्ट्तावेि समर्पटत करता है, वहां वह, यर्ाजस्ट्र्जत, रजिस्ट्रीकरण अजधकारी या आप्रवास अजधकारी से पावती प्राप्त करने का हकिार होगा । 15. पते से अनुपजस्ट्र्जत, पते में पररवतटन या अन्द्य जववरणों में पररवतटन की ररपोर्ट.- (1) यदि दकसी भी समय, कोई जविेिी अपने पते से आठ सप्ताह या उससे अजधक की जनरंतर अवजध के जलए अनुपजस्ट्र्त रहने का प्रस्ट्ताव करता है या वह अपना पता पररवर्तटत कर रहा है, तो वह िाने से पहले, रजिस्ट्रीकरण अजधकारी को अस्ट्र्ायी रूप से या स्ट्र्ायी रूप से छोड़ने के अपने आिय के बारे में, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एजप्लकेिन के माध्यम से इलेक्रॉजनक रूप से रजिस्ट्रीकरण अजधकारी को सूजचत करेगा । (2) यदि कोई जविेिी भारत से प्रस्ट्र्ान कर रहा है तो उसे रजिस्ट्रीकरण अजधकारी को प्रस्ट्र्ान की तारीख की सूचना िेनी होगी और यदि वह कहीं और िा रहा है तो पते में पररवतटन की सूचना भी रजिस्ट्रीकरण अजधकारी को िेनी होगी । (3) प्रत्येक जविेिी, िो अपने पते वाले जिले के अलावा दकसी अन्द्य जिले में दकसी स्ट्र्ान पर आठ सप्ताह से अजधक अवजध तक रहता है, वह जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से इलेक्रॉजनक रूप से उस जिले के रजिस्ट्रीकरण अजधकारी को अपनी उपजस्ट्र्जत की सूचना िेगा । (4) यदि जविेिी अपने पते वाले जिले से जभन्न जिले में आगमन से पूवट उि जिले के रजिस्ट्रीकरण अजधकारी को जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से अपने प्रस्ट्ताजवत आगमन और वहां से प्रस्ट्र्ान की तारीखों की सूचना इलेक्रॉजनक रूप से प्रस्ट्तुत कर िेता है तो उपजनयम (3) की अपेिाएं पूरी हुई मानी िाएंगी । (5) दकसी जविेिी के बारे में यह समझा िाएगा दक उसने अपना पता पररवर्तटत कर जलया है- (क) यदि वह भारत से प्रस्ट्र्ान करता है; (ख) यदि वह भारत में एक स्ट्र्ान से िूसरे स्ट्र्ान पर अपना जनवास स्ट्र्ान पररवर्तटत करता है; (ग) यदि उसके पास कोई जनवास स्ट्र्ान नहीं है, वह यह िानते हुए अपना पता छोड़ िेता है दक उसके वहां से िाने के आठ सप्ताह के भीतर उसके वहां वापस लौर्ने की संभावना नहीं है; या [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (घ) दकसी भी मामले में, जिस पर जनयम 12 के उपजनयम (6) का पहला परंतुक लागू होता है, यदि वह या संबंजधत व्यजि या वास सुजवधा चलाने वाला, जिसका पता उसका पता माना िाता है, उस जनयम के उपजनयम (6) द्वारा उन पर लगाए गए िाजयत्वों से मुि होने के जलए रजिस्ट्रीकरण अजधकारी को आवेिन करता है या दकसी भी समय उनका जनवटहन करने में जवफल रहता है । (6) प्रत्येक जविेिी व्यजि को अपने रजिस्ट्रीकरण प्रमाणपत्र में अजभजलजखत जववरणों की सर्ीकता को दकसी भी तरह से प्रभाजवत करने वाली दकसी भी पररजस्ट्र्जत का जववरण, पररजस्ट्र्जतयों के घरर्त होने के चौिह दिन के भीतर प्रस्ट्तुत करना होगा और साधारणतया रजिस्ट्रीकरण अजधकारी को ऐसी सभी िानकारी िेनी होगी िो प्रमाणपत्र की सर्ीकता को बनाए रखने के जलए आवश्यक हो । 16. जवश्वजवद्यालय और िैजिक संस्ट्र्ा या दकसी अन्द्य संस्ट्र्ा द्वारा ररपोर्ट करने की रीजत.- प्रत्येक जवश्वजवद्यालय और िैजिक संस्ट्र्ा, जिसमें स्ट्कूल या कोई अन्द्य संस्ट्र्ा सजम्मजलत है, िो भारत के काडटधारक जविेिी नागररक सजहत, दकसी जविेिी को, प्रवेि िेती है, रजिस्ट्रीकरण अजधकारी को जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एजप्लकेिन के माध्यम से प्ररूप II में अपनी संस्ट्र्ा में नामांदकत जविेिी छात्रों के संबंध में उसमें उजल्लजखत अवजध के भीतर इलेक्रॉजनक रूप से िानकारी प्रस्ट्तुत करेगी, और यह छात्रावास में आवास प्रिान दकए गए छात्रों के संबंध में प्रस्ट्तुत दकए िाने वाले प्ररूप III के अजतररि होगा । 17. वास सुजवधा चलाने वाले द्वारा ररपोर्ट करने की रीजत.- (1) प्रत्येक वास सुजवधा चलाने वाला , अपने पररसर में आवास चाहने वाले प्रत्येक जविेिी नागररक से, जिसके अधीन भारत का काडटधारक जविेिी नागररक भी है, यह अपेिा करेगा दक वह आवास पर पहुंचने पर और प्रस्ट्र्ान के समय, अपने प्रस्ट्र्ान की तारीख और समय तर्ा जिस पते पर वह िा रहा है, उसका जववरण अजभजलजखत करने तर्ा हस्ट्तािर करने के जलए आवश्यक जववरण प्रस्ट्तुत करे, जिसे वास सुजवधा चलाने वाले द्वारा कम से कम एक वषट की अवजध के जलए इलेक्रॉजनक रूप में अनुरजित रखा िाएगा । (2) उपजनयम (1) में जनर्िटष्ट जववरण रजिस्ट्रीकरण अजधकारी, जिला मजिस्ट्रेर् या पुजलस अजधकारी िो हेड कांस्ट्र्ेबल के पि से नीचे का न हो, द्वारा मांगे िाने पर जनरीिण के जलए हर समय उपलब्ध रहेंगे । (3) वास सुजवधा चलाने वाले द्वारा सभी जववरण अंग्रेिी भाषा में, यदि वह ऐसा करने में सिम हो, अन्द्यर्ा दकसी भारतीय भाषा में अजभजलजखत दकए िाएंगे । (4) यदि जविेिी अंग्रेिी भाषा नहीं समझता है, तो वास सुजवधा चलाने वाले का यह कतटव्य होगा दक वह जविेिी को इस जनयम की आवश्यकताएं समझाए, यदि ऐसा अनुरोध दकया िाए। (5) आवास का रखवाला, दकसी जविेिी के आगमन के पिात्, यर्ासंभव िीघ्र, दकन्द्तु चौबीस घंर्े के पहले, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से रजिस्ट्रीकरण अजधकारी को सम्यक् रूप से भरे गए प्ररूप III, जिसमें जविेिी द्वारा प्रस्ट्तुत दकए गए जववरण जवजनर्िटष्ट हों, की एक प्रजत इलेक्रॉजनक रूप से प्रेजषत करेगा । (6) प्रस्ट्र्ान का जववरण भी, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से इलेक्रॉजनक रूप से जविेिी के प्रस्ट्र्ान के पिात् रजिस्ट्रीकरण अजधकारी को यर्ासंभव िीघ्र, दकन्द्तु अजधकतम चौबीस घंर्े के पहले प्रेजषत दकए िाएंगे । (7) इस जनयम के प्रयोिनों के जलए,-- (क) “आवास” में कोई बोर्डंग हाउस, क्लब, डाक बंगला, जवश्राम गृह, छात्रावास, पेइंग गेस्ट्र् हाउस, सराय, दकराए का आवास, होम स्ट्र्े, र्ेंर्, अस्ट्पताल या समान प्रकृजत का कोई अन्द्य पररसर, धार्मटक संस्ट्र्ानों के पररसर, धमाटर्ट न्द्यासों, दकन्द्हीं अन्द्य न्द्यासों, सावटिजनक संगठनों या सामाजिक या धार्मटक या सावटिजनक प्रकृजत के दकन्द्हीं अन्द्य संगठनों या अजस्ट्तत्वों के, सुसजित या असजित पररसर, सजम्मजलत होंगे ; और (ख) “हस्ट्तािर” में ऐसे जविेिी के संबंध में, िो जलखने में असमर्ट है, अंगूठे का जनिान या अन्द्य जचह्न लगाना सजम्मजलत है, जिसके माध्यम से वह दकसी िस्ट्तावेज को प्रमाजणत करने का अभ्यस्ट्त है । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 18. अस्ट्पताल, नर्संग होम या दकसी जचदकत्सा संस्ट्र्ान द्वारा ररपोर्ट करने को रीजत—(1) प्रत्येक अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान द्वारा, िो अपने पररसर में जचदकत्सा, आवास या ियन सुजवधा प्रिान करता है, प्रत्येक जविेिी नागररक से, जिसमें भारत का काडटधारक जविेिी नागररक भी सजम्मजलत है, यह अपेिा की िाएगी दक वह ऐसे अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान में आगमन पर आवश्यक जववरण प्रस्ट्तुत करे और हस्ट्तािर करे, तर्ा प्रस्ट्र्ान के समय प्रस्ट्र्ान की तारीख और समय तर्ा वह पता, िहां वह िा रहा है, प्रस्ट्तुत करे, जिसे अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान द्वारा एक वषट की अवजध के जलए इलेक्रॉजनक रूप से अनुरजित रखा िाएगा । (2) उपजनयम (1) में जनर्िटष्ट जववरण, रजिस्ट्रीकरण अजधकारी, जिला मजिस्ट्रेर् या पुजलस अजधकारी िो हेड कांस्ट्र्ेबल के पि से जनचे का न हो, द्वारा मांग दकए िाने पर, जनरीिण के जलए हर समय उपलब्ध रहेंगे । (3) सभी जववरण अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान के प्रभारी व्यजि द्वारा अंग्रेिी भाषा में, यदि वह ऐसा करने में सिम हो तो, अन्द्यर्ा, दकसी भारतीय भाषा में ििट दकए िाएँगे । (4) यदि जविेिी अंग्रेिी भाषा नहीं समझता है, तो अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान के प्रभारी व्यजि का यह कतटव्य होगा दक वह जविेिी को इस जनयम की आवश्यकताओं के बारे में समझाए यदि ऐसा अनुरोध दकया िाए। (5) अस्ट्पताल, नर्संग होम या दकसी अन्द्य जचदकत्सा संस्ट्र्ान का प्रभारी व्यजि, जविेिी के आगमन के पिात् यर्ासंभव िीघ्र, दकन्द्तु चौबीस घंर्े के पहले, जविेिी द्वारा दिए गए जववरणों को जनर्िटष्ट करते हुए, जवजधवत भरे हुए प्ररूप III की एक प्रजत, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से इलेक्रॉजनक रूप से रजिस्ट्रीकरण अजधकारी को भेिेगा । (6) प्रस्ट्र्ान जववरण भी, जविेिी के प्रस्ट्र्ान के पिात् यर्ासंभव िीघ्र, दकन्द्तु चौबीस घंर्े के अपिात्, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन के माध्यम से इलेक्रॉजनक रूप से रजिस्ट्रीकरण अजधकारी को भेिेगा । (7) प्रत्येक अस्ट्पताल, नर्संग होम या कोई अन्द्य जचदकत्सा संस्ट्र्ान, जविेजियों (माता-जपता में से कोई एक या िोनों जविेिी हों) से िन्द्मे दकसी बच्चे या उनके स्ट्र्ान पर दकसी जविेिी की मृत्यु के संबंध में, यर्ाजस्ट्र्जत, िन्द्म या मृत्यु की घर्ना के सात दिनों के भीतर, जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन पर इलेक्रॉजनक रूप से रजिस्ट्रीकरण अजधकारी को सूचना उपलब्ध कराएगा । 19. दकसी जविेिी का नाम पररवतटन--(1) कोई जविेिी, िो अजधजनयम की धारा 12 के अनुसार अपना नाम पररवर्तटत कराना चाहता है, उसे अपने नाम पररवतटन के जलए रजिस्ट्रीकरण अजधकारी से जवजिष्ट अनुमजत प्राप्त करनी होगी और नाम पररवतटन के जलए जनयम 12 के उपजनयम (1) में जनर्िटष्ट ऑनलाइन पोर्टल या मोबाइल एप्लीकेिन पर रजिस्ट्रीकरण अजधकारी को इलेक्रॉजनक रूप से प्ररूप IV में आवेिन प्रस्ट्तुत करना होगा । (2) रजिस्ट्रीकरण अजधकारी, उपजनयम (1) के अधीन प्रस्ट्तुत आवेिन की जवजधवत िांच करने के पिात्, जविेिी के नाम पररवतटन की अनुमजत िे सकेगा । 20. जविेजियों को या उनके जलए वस्ट्तुओं के प्रेषण पर प्रजतबंध--मािक पेय, मािक पिार्ट, जवस्ट्फोर्क और िहरीली वस्ट्तुएं, दकसी भी प्रकार के हजर्यार, सैर्ेलाइर् फोन, कोई अन्द्य प्रजतबंजधत वस्ट्तुएं या कोई अन्द्य वस्ट्तु, िो जसजवल प्राजधकारी द्वारा प्रजतबंजधत हो, दकसी बाहरी स्ट्र्ान से, दकसी जविेिी को या उसके जलए नहीं भेिी िाएगी, जिसके दक्याकलाप अजधजनयम की धारा 7 की उपधारा (2) के खंड (च) के अधीन आिेि द्वारा प्रजतबंजधत हैं । [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 21. जविेजियों के बार बार आने वाले स्ट्र्ानों को जनयंजत्रत करने के जलए जसजवल प्राजधकारी की िजि के प्रयोग की ितें- (1) जसजवल प्राजधकारी, दकसी भी पररसर के स्ट्वामी या रखवाले िहाँ जविेिी बार बार आते है, को जनिेि िे सकेगा दक उसके अजधकार िेत्र में कोई भी पररसर, जिसका उपयोग पररसर में उपभोग दकए िाने वाले िलपान की जबक्ी के जलए या सावटिजनक समागम या मनोरंिन के स्ट्र्ान के रूप में, या क्लब के रूप में दकया िाता है और िहाँ हाल ही में जविेजियों का बार बार आना िाना रहा है या दकसी अवैध प्रवासी को ठहराने के जलए उपयोग दकया गया है, को, या तो पूरी तरह से बंि कर दिया िाएगा या ऐसे समय के िौरान या ऐसे उद्देश्यों के जलए बंि रखा िाएगा, िैसा उसके द्वारा अपेजित हो, यदि उसकी राय में— (क) पररसर में इस प्रकार आने वाला जविेिी अपराधी है या गैरकानूनी संगठन का सिस्ट्य है या अन्द्यर्ा अवांछनीय है ; (ख) पररसर अव्यवजस्ट्र्त या अनुजचत तरीके से संचाजलत होता है, या सावटिजनक जहत के प्रजतकूल तरीके से संचाजलत होता है ; या (ग) पररसर में रहने वाला जविेिी अवैध प्रवासी है । (2) िहां दकसी पररसर को उपजनयम (1) के अधीन बंि कर दिया गया है, वहां अजधभोगी या पररसर पर जनयंत्रण रखने वाला व्यजि उस िेत्र के जसजवल प्राजधकारी की सहमजत के जबना दकसी अन्द्य पररसर पर अजधभोग या जनयंत्रण नहीं करेगा, जिसका उपयोग िलपान की जबक्ी, या सावटिजनक समागम या मनोरंिन स्ट्र्ल, या क्लब के रूप में दकया िाता है । (3) कोई पुजलस अजधकारी, यदि जसजवल प्राजधकारी द्वारा प्राजधकृत हो, तो आवश्यक होने पर ऐसे दकसी भी पररसर में प्रवेि कर सकेगा और तलािी ले सकेगा या अजधभोग कर सकेगा, जिसके संबंध में जसजवल प्राजधकारी द्वारा उपजनयम (1) के अधीन जनिेि दिए गए हैं । (4) जसजवल प्राजधकारी द्वारा दिए गए दकसी भी जनिेि की सूचना तत्काल केंरीय सरकार को िी िाएगी । (5) जसजवल प्राजधकारी द्वारा दिए गए जनिेि से व्यजर्त कोई भी स्ट्वामी या रखवाला अजधजनयम की धारा 14 की उपधारा (3) के अधीन केंरीय सरकार को अपील कर सकेगा । स्ट्पष्टीकरण--इस जनयम के प्रयोिनों के जलए, अवैध प्रवासी का वही अर्ट होगा, िो नागररकता अजधजनयम, 1955 (1955 का 57) की धारा 2 की उपधारा (1) के खंड (ख) में दिया गया है। अध्याय 4 वाहकों का िाजयत्व 22. वाहक का कुछ सूचना प्रिान करने का िाजयत्व--(1) भारत से, भारत के बाहर दकसी जवमानपत्तन के जलए प्रस्ट्र्ान या जवमान में चढने वाली, भारत के बाहर दकसी जवमानपत्तन से भारत में आगमन या लैंप्डंग करने वाली एयरलाइन का िेि प्रजतजनजध या स्ट्र्ेिन प्रबंधक, जसजवल प्राजधकारी या आप्रवास अजधकारी को जनम्नजलजखत सूचना प्रिान करेगा, अर्ाटत् :— (क) प्ररूप V में यात्री और चालक िल का जववरण ; (ख) भारत के बाहर जवमान में चढने के पत्तन से जवमान के रवाना होने या जवमान से उतरने के पंरह जमनर् के भीतर अजग्रम यात्री सूचना डेर्ा , और भारत के भीतर बोर्डंग के बंि होने पर या जवमान से उतरने के पिात्, अंतराटष्ट्रीय नागररक उड्डयन संगठन के उपाबंध-9 (सुजवधा) के अनुसार, डेर्ा फील्ड और डेर्ा प्रारूप UNEDIFACT-PAXLST सजहत यात्री सूचना (नाम, प्लंग, िन्द्म की तारीख और राष्ट्रीयता) और 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] पासपोर्ट और वीजा (प्रकार, संख्या, िारी करने और समाजप्त तारीख), उड़ान और यात्रा की सूचना सजहत यात्रा िस्ट्तावेज सूचना ; (ग) अंतराटष्ट्रीय नागररक उड्डयन संगठन के उपाबंध-9 (सुजवधा) के अनुसार भारत में आगमन या भारत से प्रस्ट्र्ान के जलए र्ी-72 घंर्े, र्ी-24 घंर्े, र्ी-08 घंर्े और र्ी-0 घंर्े पर याजत्रयों के यात्री नाम ररकॉडट डेर्ा, िहां र्ी, यर्ाजस्ट्र्जत, भारत में आगमन या भारत से प्रस्ट्र्ान का जनधाटररत समय है, डेर्ा फील्ड और डेर्ा प्रारूप UNEDIFACT-PNRGOV, जिसमें यात्री सूचना (नाम, प्लंग, िन्द्म की तारीख और प्रजतजनजध या मास्ट्र्र, जसजवल प्राजधकारी या आप्रवास अजधकारी को, र्ी-72 घंर्े पर, िहां र्ी भारत में आगमन या भारत से प्रस्ट्र्ान का जनधाटररत समय है, प्ररूप VI के अनुसार यात्री सूची और चालक िल सूची उपलब्ध कराएगा । 23. वाहक द्वारा अपील की रीजत--(1) अजधजनयम की धारा 17 की उपधारा (4) और धारा 19 की उपधारा (2) में जनर्िटष्ट कोई भी अपील वाहक या उसके अजभकताट या प्रजतजनजध द्वारा, जनयम 12 के उपजनयम (1) के खंड (ख) में जनर्िटष्ट ऑनलाइन पोर्टल के माध्यम से इलेक्रॉजनक रीजत में, प्ररूप VII में आप्रवास ब्यूरो के आयुि के समि प्रस्ट्तुत की िाएगी और इलेक्रॉजनक रीजत या ऐसे अन्द्य रीजत के माध्यम से पाँच हिार रुपये की फीस का भुगतान करना होगा । (2) अपील प्राप्त होने पर, आप्रवास ब्यूरो के आयुि, पिकारों को सुनवाई का उजचत अवसर िेने के पिात्, एक तकटसंगत आिेि पाररत करेंगे और सामान्द्यतः अपील प्राप्त होने की the powers conferred by section 30 of the Immigration and Foreigners Act, 2025 (13 of 2025), and in supersession of the Passport (Entry into India) Rules, 1950, the Registration of Foreigners Rules, 1992 and the Immigration (Carriers’ Liability) Rules, 2007, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:— CHAPTER I PRELIMINARY 1. Short title and commencement.— (1) These rules may be called the Immigration and Foreigners Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.—(1) In these rules, unless the context otherwise requires,— (a) “Act” means the Immigration and Foreigners Act, 2025 (13 of 2025); (b) “biometrics information” means photograph, finger print, iris scan or such other biological attributes of an individual as may be specified by the Central Government; (c) “Certificate of Registration” means a Certificate of Registration issued under rule 13; (d) “Form” means Forms appended to these rules; (e) “residence” means ordinary dwelling place in India. (2) Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act. CHAPTER II MATTERS RELATED TO IMMIGRATION 3. Other functions of Immigration Officer.— In addition to the immigration functions, an Immigration Officer shall also carry out the following other functions, namely:— (a) regularly monitor functions at the immigration post to meet with the standards set for such immigration post; (b) examine cases of immigration fraud; (c) co-ordinate with law enforcement agencies and other stakeholders in immigration matters; (d) collate and maintain databases relating to immigration; or (e) provide guidance and assistance to individuals navigating the immigration process. 4. Other functions of Bureau of Immigration.— In addition to the functions provided in sub-section (1) of section 5 of the Act, the Bureau of Immigration, functioning under the supervision of the Intelligence Bureau, shall also perform the following functions, namely:— (a) provide registration services and other visa related services to foreigners; (b) implement provisions of the Act, rules, orders and directions made therein by the Central Government; (c) co-ordinate with the State Governments or Union territory Administrations and other agencies, on matters related with identification, restriction of movement and deportation of foreigners; 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (d) administer information technology systems and custodian of data on matters related with immigration and foreigners; and (e) advise the Central Government on policy matters related to immigration and foreigners. 5. Manner of appointment of officers of Bureau of Immigration.— (1) The Central Government shall appoint the Commissioner, Bureau of Immigration, who shall be an officer of the Intelligence Bureau, on the recommendations of the Director, Intelligence Bureau. (2) The officers of the Bureau of Immigration, who shall be provided by the Intelligence Bureau, shall be appointed by the Central Government in the manner as may be specified. 6. Other functions of Commissioner of Bureau of Immigration.— In addition to the overall supervision of the immigration functions, the following other functions shall vest in the Commissioner of Bureau of Immigration, namely:— (a) the administration, vigilance and provisioning matters of Bureau of Immigration; (b) financial matters of Bureau of Immigration; and (c) monitoring and supervision of all matters and functions referred to in rules 3 and 4. CHAPTER III MATTERS RELATED TO FOREIGNERS 7. Conditions for issuance of other travel document.— (1) Any other travel document issued to an Indian citizen shall conform to the provisions in the Passports Act, 1967 (15 of 1967) and the rules made thereunder. (2) Any other travel document issued under the authority of the Government of a foreign country on which a foreigner may seek entry into India or transit through India or stay in India or exit from India shall conform to the following conditions, namely: — (a) that it shall have been issued or renewed by or on behalf of the Government of the country of which the person to whom it relates is a national and shall be within the period of its validity; (b) that it shall have affixed to it a photograph of the person to whom it relates duly authenticated by the authority issuing the travel document; and (c) that it shall have an appropriate category of valid visa permitting the foreigner to enter into or transit through or stay in or exit from the territory of India granted by authorities referred to in rule 9. 8. Conditions for issuance of passport.— (1) An Indian passport issued to an Indian citizen shall conform to the provisions in the Passports Act, 1967 (15 of 1967) and rules made thereunder. (2) Any passport issued under the authority of the Government of a foreign country on which a foreigner may seek entry into India or transit through India or stay in India or exit from India shall conform to the following conditions, namely: — (a) that it shall have been issued or renewed by or on behalf of the Government of the country of which the person to whom it relates is a national thereof, and shall be within the period of its validity; (b) that it shall have affixed to it a photograph of the person to whom it relates duly authenticated by the authority issuing the passport except in cases where a child below the age of fifteen years has been included in the passport of either of his parents; and (c) that it shall have an appropriate category of valid visa permitting the foreigner to enter into or transit through or stay in or exit from the territory of India granted by authorities referred to in rule 9 or it is accompanied by an Overseas Citizen of India Card by persons registered as an Overseas Citizen of India Cardholder under the provisions of the Citizenship Act, 1955 (57 of 1955). (3) Nothing contained in clause (c) of sub-rule (2) shall apply to, or in relation to, - (a) any category of citizens of South Asian Association for Regional Cooperation Countries, covered by the South Asian Association for Regional Cooperation Countries Visa Exemption Scheme or Visa Liberalisation Scheme provided they are in possession of valid visa endorsement of South Asian Association for Regional Cooperation Countries and respective national passports; and [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25 (b) citizens or class of citizens of any country or any individual foreigner or class or description of foreigner exempted from the requirement of passport or other travel document and visa under section 33 of the Act. 9. Authority authorised to grant or cancel visa.— (1) A visa permitting a foreigner to enter into or transit through or stay in or exit from the territory of India shall be granted by any of the following authorities, namely:- (a) the Central Government in the Ministry of External Affairs including Indian Missions or Consulates abroad; or (b) Bureau of Immigration. (2) The authorities referred to in sub-rule (1) shall cancel the visa or curtail the period of the visa issued against the passport or other travel document. 10. Registration Officer. — (1) The Registration Officer may, with the approval of the Central Government, authorise in writing any officer to perform the duties of the Registration Officer on his behalf. (2) The Foreigners Regional Registration Officer, the Foreigners Registration Officer and the Immigration Officer at the immigration post shall perform the functions of the Registration Officer. (3) The Foreigners Registration Officer shall function under the jurisdictional Foreigners Regional Registration Officer for the purpose of the Act, rules, orders and directions. 11. Conditions and manner for foreigners arriving in India to report at immigration post.— (1) Every foreigner on arrival in India shall be required to produce at the immigration post, his passport or other travel document, and visa or Overseas Citizen of India Card or an Electronic Travel Authorisation for the purpose of verification of name, nationality, age, gender and place of birth; and when required by the Immigration Officer, shall furnish to him the address or intended address in India, the purpose of visit and the proposed length of stay in India or any other relevant information. (2) A foreigner whose biometric information is not available with the Immigration Officer, or has been directed by him to submit his biometric information, shall be required to do so at the immigration post. 12. Conditions and manner for foreigners arriving in India to register with Registration Officer.— (1) For the purpose of registration and to avail of visa services in India, a foreigner shall within fourteen days of his arrival in India submit an application— (a) on the mobile application namely, “Indian Visa Su-Swagatam” or by any name or names that may be assigned to such an application from time to time; or (b) with the Registration Officer in Form-I on the designated online portal namely, https://indianfrro.gov.in : Provided that in case of a foreigner who enters India other than on a visa and if he intends to stay in India, he shall register before expiry of the period permitted for stay on arrival: Provided further that where a resident citizen of India becomes a foreigner by reason of his having ceased to be a citizen of India, he shall register within thirty days of his ceasing to be citizen of India. Explanation.— For the purposes of this proviso, the date on which the person concerned shall be deemed to have ceased to be a citizen of India shall be, — (a) where he has voluntarily acquired the citizenship of another country by naturalisation or registration, the date of such naturalisation or registration; (b) where he has obtained a passport from the Government of any other country, the date on which such passport was obtained; or (c) in case of a person in respect of whom an order has been made under sub-section (2) of section 9 of the Citizenship Act, 1955 (57 of 1955), holding that he had acquired the citizenship of a foreign country, the date of issuance of such order: Provided also that in case of a foreigner who enters into India on a visa valid for a stay in India for a period of one hundred and eighty days or less and wishes to stay in India beyond a period of one hundred and eighty days, he shall register within fourteen days after the expiry of one hundred and eighty days of his arrival in India: 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided also that in case of a foreigner who enters India on a visa valid for stay in India for a period of more than one hundred and eighty days with a stipulation that ‘each stay shall not exceed one hundred and eighty days’ and who wishes to stay in India beyond the period of one hundred and eighty days on any single occasion or in the aggregate in a calendar year, he shall register any time before the expiry of the said period of one hundred and eighty days: Provided also that in the case of a foreigner who is a citizen of any specified country or belonging to any specified class or classes for whom a different timeline has been specified for registration by a general or special order, such a foreigner shall register with the Registration Officer within the period as specified in the said order. (2) With regard to children born to foreigners in India (where either or both parents are foreigner), the foreigners concerned shall intimate electronically, the birth of the child to the Registration Officer within thirty days of the birth for availing visa services including grant of new visa and exit permission on the designated online portal or the mobile application as referred to in sub-rule (1). (3) The Registration Officer may call for any additional information from the foreigner or call the foreigner for a personal interview and for obtaining biometric information at such place and time as he may fix. (4) No such registration shall be necessary in the case of – (a) a foreigner who enters India on a visa valid for a period of not more than one hundred and eighty days and who does not remain in India beyond the said period, unless the endorsement on the visa specifically require him to get himself registered on arrival in India within the period specified in the endorsement; (b) a foreigner who enters into India on a visa valid for stay in India for a period of more than one hundred and eighty days with a stipulation that ‘each stay shall not exceed one hundred and eighty days’ and who does not wish to stay in India beyond the period of one hundred and eighty days on any single occasion or in the aggregate in a calendar year; (c) a foreigner who is a child below twelve years of age; and (d) a person registered as an Overseas Citizen of India Cardholder under section 7A of the Citizenship Act, 1955 (57 of 1955). (5) An Overseas Citizen of India Cardholder who is resident in India shall inform the Registration Officer electronically or through the designated online portal as referred to in clause (b) of sub-rule (1) whenever there is a change in his permanent residential address or occupation. (6) For the purpose of registration, the address of a foreigner in India shall be – (a) the place of his residence; or (b) if he has no residence, the place at which, at the time of making his application for registration he is living, or at which he first intends to live after his arrival in India: Provided that he may, with the prior consent of the person residing in India or a keeper of accommodation, report name and address of such person as his address in India: Provided further that the foreigner shall inform of his current address to such person or keeper of accommodation: Provided also that the person concerned or a keeper of accommodation shall furnish all such information in his possession relating to the foreigner as may be demanded by the Registration Officer, Immigration Officer, District Magistrate or police officer not below the rank of Head Constable. 13. Certificate of Registration.— (1) On being satisfied, the Registration Officer, after making such inquiry as he thinks necessary, that the particulars contained in the application made under sub-rule (1) of rule 12 are correct and complete, shall grant a Certificate of Registration to the foreigner. (2) The Certificate of Registration granted under sub-rule (1) shall indicate the period for which the foreigner is authorised to stay in India and also the place or places of stay in India, if any, specified on the visa. (3) While granting such Certificate of Registration, the Registration Officer may also restrict the period for which the foreigner is authorised to stay in India and also the places of stay of the foreigner to any of the places specified in the visa. (4) Every foreigner to whom a Certificate of Registration is issued under sub-rule (1) — (a) shall not, if the Certificate of Registration indicates the place or places for stay in India, visit any other place unless he has obtained specific permission from the Registration Officer to visit such other place; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 (b) shall, if the Certificate of Registration indicates the place or places for stay in India, report upon his arrival at, and departure from, any such place to the Registration Officer concerned, within twenty-four hours after his arrival or, as the case may be, before his intended departure; and (c) shall, unless the period indicated in the Certificate of Registration is extended by the Registration Officer, depart from India before the expiry of the said period. 14. Production of proof of identity.— (1) Every foreigner shall within twenty-four hours of demand being made of him by Registration Officer, Immigration Officer, District Magistrate or police officer, not below the rank of a Head Constable, produce at such place as may be specified, his passport or other travel documents of his identity as may be required: Provided that the Registration Officer, Immigration Officer, District Magistrate or police officer not below the rank of Head Constable may, on sufficient cause being shown, extend the aforesaid period of twenty-four hours to a maximum period of seven days, in the circumstances, as may be necessary for the production of the said passport or other travel documents. (2) Every foreigner entering India shall, on demand being made of him by the Registration Officer or Immigration Officer, deliver his passport or other travel documents to that officer, shall thereafter be present at such time and place as the Registration Officer or Immigration Officer may direct for the purpose of receiving back his passport or other travel documents. (3) Where in pursuance of sub-rule (2), a foreigner surrenders his passport or other travel documents, he shall be entitled to receive a receipt from the Registration Officer or Immigration Officer, as the case may be. 15. Report of absence from address, change in address or changes in other particulars.— (1) If at any time, a foreigner proposes to be absent from his address for a continuous period of eight weeks or more or he is changing his address, he shall before he leaves, inform the Registration Officer electronically through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12 of his intention to leave either temporarily or permanently the jurisdiction of the Registration Officer. (2) In case a foreigner is leaving India, he shall inform the Registration Officer of such date of leaving and in case he is moving away, the change of address shall also be informed to the Registration Officer. (3) Every foreigner, who stays for a period of more than eight weeks at any place in any district other than the district in which his address is situated, shall inform the Registration Officer of that district electronically of his presence through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (4) The requirements of the sub-rule (3) shall be deemed to have been fulfilled if, prior to his arrival in a district other than that in which his address is situated, the foreigner furnishes to the Registration Officer of the said district electronically, information of the dates of his proposed arrival and departure therefrom through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (5) A foreigner shall be deemed to have changed his address– (a) if he departs from India; (b) if he changes his residence from one place to another place in India; (c) if having no residence, he leaves his address knowing that he is not likely thereafter to return thereto within eight weeks of leaving it; or (d) in any case to which the first proviso to sub-rule (6) of rule 12 applies, if either he or the person concerned or a keeper of accommodation whose address is deemed to be his address applies to the Registration Officer to be absolved from or fails at any time to discharge the obligations laid upon them by sub-rule (6) of that rule. (6) Every foreigner shall also furnish particulars of any circumstances affecting in any manner the accuracy of the particulars recorded in his Certificate of Registration within fourteen days after the circumstances have occurred and generally supply to the Registration Officer all such information as may be necessary for maintaining the accuracy of the Certificate. 16. Manner of report by University and Educational Institution or any other institution.— Every University and Educational Institution including school or any other institution, admitting any foreigner, including an Overseas Citizen of India Cardholder, shall furnish to the Registration Officer electronically, the information in respect of foreign students enrolled in their institution in Form II through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12, within the period mentioned therein and this shall be in addition to the Form III to be submitted in respect students provided with accommodation in a hostel. 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 17. Manner of report by keeper of accommodation.—(1) Every keeper of accommodation shall require every foreigner, including an Overseas Citizen of India Cardholder, seeking accommodation in his premises to furnish the necessary particulars for recording, and sign, on his arrival at the accommodation, and at the time of his departure, the date and time of his departure and the address to which he is proceeding, which shall be maintained by the keeper of accommodation electronically for a period of at least one year. (2) The particulars referred to in sub-rule (1) shall at all times be available for inspection, on demand by Registration Officer, District Magistrate or police officer not below the rank of a Head Constable. (3) All particulars shall be recorded by the keeper of the accommodation in English language, if he is so able, or otherwise, in an Indian language. (4) If the foreigner does not understand English language, it shall be the duty of the keeper of the accommodation, if so requested, to explain to the foreigner, the requirements of this rule. (5) The keeper of the accommodation shall, as soon as may be but not beyond twenty-four hours, after the arrival of a foreigner, transmit a copy of duly filled in Form III, specifying the particulars furnished by the foreigner, electronically to the Registration Officer through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (6) The departure details shall also be transmitted as soon as may be but not beyond twenty-four hours, after departure of the foreigner, electronically to the Registration Officer through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (7) For the purposes of this rule, — (a) “accommodation” shall include any boarding house, club, dak-bungalow, rest house, hostel, paying guest house, sarai, rented accommodation, home stay, tents, hospital or other premises of like nature, premises of religious institutions, charitable trusts, any other trusts, public organisations or any other organisations or entity of social or religious or of public nature, furnished or unfurnished; and (b) “sign” includes in respect of a foreigner who is unable to write, the marking of a thumb impression or other mark by means of which he is accustomed to attest a document. 18. Manner of report by hospital, nursing home or any medical institution.— (1) Every hospital, nursing home or any other medical institution providing medical, lodging or sleeping facility in their premises shall require every foreigner, including an Overseas Citizen of India Cardholder, to furnish the necessary particulars for recording, and sign, on his arrival at such hospital, nursing home or any other medical institution, and at the time of his departure, to furnish the date and time of his departure and the address to which he is proceeding, which shall be maintained by the hospital, nursing home or any other medical institution electronically for a period of one year. (2) The particulars referred to in sub-rule (1) shall at all times be available for inspection, on demand by Registration Officer, District Magistrate or police officer not below the rank of a Head Constable. (3) All particulars shall be recorded by the person in charge of hospital, nursing home or any other medical institution in English language, if he is so able, or otherwise, in an Indian language. (4) If the foreigner does not understand English language, it shall be the duty of the person in charge of hospital, nursing home or any other medical institution, if so requested, to explain to the foreigner, the requirements of this rule. (5) The person in charge of hospital, nursing home or any other medical institution shall, as soon as may be but not beyond twenty-four hours, after the arrival of a foreigner, transmit a copy of duly filled in Form III, specifying the particulars furnished by the foreigner, electronically to the Registration Officer through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (6) The departure details shall also be transmitted as soon as may be but beyond twenty-four hours, after departure of the foreigner, electronically to the Registration Officer through the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. (7) Every hospital, nursing home or any other medical institution shall furnish information in respect of any children born to foreigners (either or both the parents are foreigner) or death of any foreigner in their place within seven days of the occurrence of the birth or death, as the case may be, electronically to the Registration Officer in the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12. 19. Change of name of a foreigner.— (1) Any foreigner who intends to get his name changed in terms of section 12 of the Act, shall obtain specific permission of the Registration Officer for the change of his name and shall submit an application in Form IV electronically to the Registration Officer in the designated online portal or the mobile application as referred to in sub-rule (1) of rule 12 for change of name. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29 (2) The Registration Officer may, after due examination of the application filed under sub-rule (1), permit the change of name of the foreigner. 20. Restriction on dispatch of articles to or for foreigner.— No articles such as alcoholic beverages, narcotic substances, explosive and poisonous articles, weapons of any kind, satellite phones, any other contraband items or any other item that may be restricted by the civil authority, shall be dispatched from an outside place to or for a foreigner whose movements are restricted by an order under clause (f) of sub-section (2) of section 7 of the Act. 21. Conditions for exercise of power of civil authority to control places frequented by foreigners.— (1) The civil authority may direct the owner or keeper having control of any premises frequented by foreigners that any premises in its jurisdiction which are used for the sale of refreshments to be consumed on the premises or as a place of public resort or entertainment, or as a club and which are or have recently been frequented by foreigners or used for accommodating an illegal migrant, shall either be closed altogether or kept closed during such hours or for such purposes as may be required by it, if in its opinion — (a) the foreigner so frequenting the premises is criminal or is a member of unlawful associations or otherwise undesirable; (b) the premises are conducted in a disorderly or improper manner, or in a manner prejudicial to the public good; or (c) the foreigner accommodated in the premises is an illegal migrant. (2) Where any premises have been closed under sub-rule (1), the occupier or person having control of the premises shall not occupy or control any other premises which are used for sale of refreshments, or as a place of public resort or entertainment, or as a club without the consent of the civil authority of the area in which the premises are situated. (3) Any police officer, if authorised by the civil authority may enter, if necessary, and search or occupy any premises in respect of which directions under sub-rule (1) has been given by the civil authority. (4) Any directions given by the civil authority shall be reported forthwith to the Central Government. (5) Any owner or keeper aggrieved by the direction given by the civil authority may prefer an appeal to the Central Government under sub-section (3) of section 14 of the Act. Explanation.— For the purposes of this rule, illegal migrant shall have the same meaning as assigned to it in clause (b) of sub-section (1) of section 2 of the Citizenship Act, 1955 (57 of 1955). CHAPTER IV OBLIGATION OF CARRIERS 22. Obligation of carrier to provide certain information.— (1) The country representative or station manager of an airline departing or embarking from India to an airport outside India, arriving or landing in India from an airport outside India, shall provide the following information to the civil authority or the Immigration Officer, namely:— (a) the passenger and crew manifest in Form V; (b) advance passenger information data of passengers on board and crew, within fifteen minutes of leaving or wheels-off of the aircraft from the port of embarkation outside India, and after closure of boarding or wheels-off the aircraft from the port of embarkation within India, as per International Civil Aviation Organisation Annex-9 (Facilitation) data fields and data format UNEDIFACT-PAXLST including passenger information (Name, Gender, Date of Birth and Nationality) and travel document information of passport and visa (type, number, date of issue and expiry), flight and journey information; (c) passenger name record data of passengers for arrival in India or for departure from India at T-72 hours, at T-24 hours, at T-08 hours and at T-0 hours, where T is the scheduled time of arrival in India or departure from India, as the case may be, as per International Civil Aviation Organisation Annex-9 (Facilitation) data fields and data format UNEDIFACT-PNRGOV including passenger information (Name, Gender, Date of Birth and Nationality), travel document information of passport and visa (type, number, date of issue and expiry), travel and payment information, flight and journey information. (2) The country representative or master of a vessel (cargo or cruise or general movement chartered ships) departing or embarking from India to a port or place outside India and arriving or berthing in India from a port or place outside India shall provide the passenger manifest and crew manifest as in Form VI at T-72 hours, where T is the scheduled time of arrival in India or departure from India, as the case may be, to the civil authority or the Immigration Officer. 23. Manner of appeal by carrier.— (1) Any appeal referred to in sub-section (4) of section 17 and sub-section (2) of section 19 of the Act shall be preferred by the carrier or his agent or representative, in electronic mode through the 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] designated online portal as referred to in clause (b) of sub-rule (1) of rule 12 before the Commissioner of Bureau of Immigration in Form VII and shall pay a fee of five thousand rupees through electronic mode or such other mode. (2) On receipt of the appeal, the Commissioner of Bureau of Immigration, after giving the parties a reasonable opportunity of being heard, shall pass a reasoned order and endeavor to complete the proceedings ordinarily within sixty days from the date of receipt of the appeal. 24. Liability of carrier to furnish information.— Every carrier shall, when required, provide information to the District Magistrate or Commissioner of Police or, where there is no Commissioner of Police, Superintendent of Police or the civil authority or the Immigration Officer, of passenger and crew manifest in Form V or Form VI, as the case may be. 25. General Declaration furnished by carrier to Immigration Officer.—(1) Every carrier shall submit a general declaration to the Immigration Officer in Form VIII prior to the departure of the flight, vessel or other mode of transport at D-45 minutes, where D is the scheduled departure time. (2) No flight or vessel or other mode of transport shall be permitted by the carrier to depart from a port of place in India until the Immigration Officer has given clearance on such general declaration.
