फा. सं. रेग-11013/1/2026-विनियमन-एफएसएसएआई.— भारत के राजपत्र असाधारण, भाग- III, खंड -4 में दिनांक 20 जनवरी, 2026 को प्रकाशित प्रारूप खाद्य सुरक्षा और मानक (खाद्य व्यवसाय का अनुज्ञापन और पंजीकरण) संशोधन विनियम, 2026, अधिसूचना सं. फा.सं. रेग-11013/1/2026-विनियमनएफ़एसएसएआई को अधिक्रांत करते हुए खाद्य सुरक्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) विनियम, 2011 में और संशोधन के लिए कतिपय विनियमों का निम्नलिखित प्रारूप, जिसे भारतीय खाद्य सुरक्षा और मानक प्राधिकरण केंद्र सरकार के पूर्व अनुमोदन से, खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का संख्यांक 34) की धारा 92 की उप-धारा (2) के खंड (ण) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करता है, इससे प्रभावित होने वाले संभावित सभी व्यक्तियों को सूचना देने के लिए उक्त अधिनियम की धारा 92 की उप-धारा (1) की अपेक्षा के अनुसार एतद्द्वारा प्रकाशित किया जाता है और यह नोटिस दिया जाता है कि उक्त प्रारूप विनियमों पर उस तिथि से तीस दिनों की अवधि समाप्त होने के बाद विचार किया जाएगा, जिस तिथि को इस अधिसूचना को प्रकाशित करने वाले राजपत्र की प्रतियां जनता को उपलब्ध कराई जाएँगी।
आपत्ति अथवा सुझाव, यदि कोई हो, मुख्य कार्यकारी अधिकारी, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, एफडीए भवन, कोटला रोड, नई दिल्ली- 110002 को अथवा regulation@fssai.gov.in पर ईमेल के माध्यम से भेजा जा सकता है।
उक्त प्रारूप विनियमों के संबंध में निर्दिष्ट अवधि की समाप्ति से पहले प्राप्त होने वाली आपत्तियों और सुझावों पर खाद्य प्राधिकरण द्वारा विचार किया जाएगा।
प्रारूप विनियम
इन विनियमों को खाद्य सुरक्षा और मानक (खाद्य व्यवसाय का अनुज्ञापन और पंजीकरण) संशोधन विनियम, 2026 कहा जा सकता हैं।
खाद्य सुरक्षा और मानक (खाद्य व्यवसाय का अनुज्ञापन और पंजीकरण) विनियम, 2011 में,-
(1) अनुसूची 2 में, "लाइसेंस की शर्तें" से संबंधित उपाबंध 3 में, क्रम संख्या 8 के स्थान पर निम्नलिखित को रखा जाएगा, अर्थात्: -
"8. उत्पादन तथा कच्चे माल के उपयोग का दैनिक अभिलेख पृथक रूप से बनाए रखें। परंतु यह शर्त गैर- निर्माण खाद्य व्यवसायों पर लागू नहीं होगी "।
(2) अनुसूची 4 में, "लाइसेंस हेतु आवेदन करने वाले सभी खाद्य व्यवसाय संचालकों द्वारा पालन की जाने वाली स्वच्छ एवं सैनिटरी प्रथाओं संबंधी सामान्य आवश्यकताएँ" से संबंधित भाग 2 में, खंड 5.2.5 के स्थान पर निम्नलिखित को रखा जाएगा, अर्थात्: -
"5.2.5 कच्चे माल, अवयवों, प्रगति में कार्य (वर्क-इन-प्रोग्रेस) तथा प्रसंस्कृत/पकाए गए या पैके ज्ड खाद्य उत्पादों के भंडारण में FIFO (फर्स्ट इन फर्स्ट आउट) तथा FEFO (फर्स्ट एक्सपायर फर्स्ट आउट) सिद्धांतों का पालन किया जाएगा। परंतु यह प्रावधान खुदरा विक्रेताओं पर लागू नहीं होगा।"

नोट :- मुख्य विनियम खाद्य सुरक्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) विनियम भारत के राजपत्र, असाधारण, भाग III, खंड 4 में अधिसूचना संख्या फा. सं. 2-15015/30/2010, दिनांक 1 अगस्त, 2011 द्वारा प्रकाशित किए गए एवं आखिरी बार दिनांक 13 जुलाई, 2016 की अधिसूचना फा. स. 2-15015/30/2012, द्वारा संशोधित किए गए थे।

**F. No. REG-11013/1/2026-Regulation-FSSAI.—**In the supersession of the Food Safety and Standards (Licensing and Registration of Food Business) Amendment Regulations, 2026 vide no. F.No. REG-11013/1/2026-Regulation-FSSAI, published on dated 20th January,2026 in the Gazette of India, Extraordinary, Part-III, Section-4, the following draft of certain regulations further to amend the Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011, which the Food Safety and Standards Authority of India, with previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (o) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by the sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public;
