फा. सं. क्यूए/11023/31/2022-क्यूए-एफएसएसएआई(1).—खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34) की धारा 92 की उपधारा (1) के अधीन यथा अपेक्षित भारतीय खाद्य सुरक्षा और मानक प्राधिकरण की अधिसूचना फा.सं. क्यूए/11023/31/2022-क्यूए-एफएसएसएआई(1), तारीख 3 अक्टूबर, 2024 द्वारा खाद्य सुरक्षा और मानक (आयात) संशोधन विनियम, 2024 का प्रारूप भारत के राजपत्र, असाधारण, भाग 3, खंड 4 में प्रकाशित किया गया था, जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की सम्भावना है, उक्त अधिसूचना अंतर्विष्ट करने वाली राजपत्र की प्रतियां जनता को उपलब्ध करवाए जाने की तारीख से साठ दिन की अवधि के भीतर आक्षेप और सुझाव आमंत्रित किये गए थे;

और उक्त राजपत्र की प्रतियां जनता को 7 अक्टूबर, 2024 को उपलब्ध करा दी गई थी;

और उक्त विनियमों के प्रारूप के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा विचार कर लिया गया है ।

अतः, अब, केंद्रीय सरकार के पूर्व अनुमोदन से भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34) की धारा 92 की उपधारा (2) के खंड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए खाद्य सुरक्षा और मानक (आयात) विनियम, 2017 में और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्:-

(1) इन विनियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (आयात) प्रथम संशोधन विनियम, 2025 है। (2) ये तारीख 1 मई, 2026 को प्रवृत होंगे ।
खाद्य सुरक्षा और मानक (आयात) विनियम, 2017 के, विनियम 10 में, -

(i) उप-विनियम (4) में, खंड (ख) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्:-

“(ख) खाद्य वस्तुओं के नमूनों के विश्लेषण के लिए प्राधिकरण द्वारा समय – समय पर संशोधित या अपनाई गई विश्लेषण पद्धति की नियम पुस्तिका (मैनुअल) का उपयोग किया जाएगा। तथापि, किसी मानदंड का विश्लेषण करने की पद्धति इन नियम पुस्तिका (मैनुअल) में उपलब्ध ना होने की दशा में, खाद्य प्रयोगशाला एओएसी/ आईएसओ/ पियरसन/जैकब/आईयूपीएसी/खाद्य रसायन कोडेक्स/ बीआईएस/ कोडेक्स एलिमेंटेरियस/ वुडमेन/विंटन-विंटन/जोसलिन या अन्तराष्ट्रीय स्तर पर मान्यता प्राप्त किसी विनियामक अभिकरण द्वारा विहित विधिमान्य विश्लेषण पद्धति अपना सकती है।”;

(ii) उप–विनियम (5) के स्थान पर, निम्नलिखित उप-विनियम रखा जाएगा, अर्थात्:-

“(5) अधिसूचित प्रयोगशाला या रेफरल प्रयोगशाला, प्रयोगशाला विश्लेषण रिपोर्ट को, नमूना प्राप्ति की तारीख से पाँच दिन के भीतर प्रारूप-2 में यथा स्थिति, उसके खाद्य विश्लेषक या निदेशक द्वारा सम्यक रूप से हस्ताक्षरित कर प्रदान करेगी।”।

FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA NOTIFICATION

No. QA/11023/31/2022-QA-FSSAI(1).—Whereas a draft of the Food Safety and Standards (Import) Amendment Regulations, 2024, were published vide notification of the Food Safety and Standards Authority of India number F. No. QA/11023/31/2022-QA-FSSAI(1), dated the 3rd October, 2024, in the Gazette of India, Extraordinary, Part III, Section 4 as required under sub- section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), inviting objections and suggestions from persons likely to be affected thereby, within a period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;
