Amendment in the Central Motor Vehicles Rules 1989

सा.का.जन. 712(अ).— केंद्रीय मोटर वाहन अजधजनयम, 1989 का और संिोधन करने के जलए प्रारूप जनयम,मोटर वाहन अजधजनयम, 1988 (1988 का 59) धारा 212 की उपधारा (1) के अधीन यथा अपेजित, सड़क पररवहन और रािमागग मंत्रालय की भारत सरकार की अजधसूचना संख्या सा.का.जन 214 (अ), तारीख 20 माचग 2026 द्वारा प्रकाजित दकया गया था, िो भारत के रािपत्र, असाधारण, भाग 2, खंड (3), उप खंड (i), तारीख 27 माचग, 2026 में प्रकाजित हुई थी, जिसमें उक्त अजधसूचना वाले रािपत्र की प्रजतयां िनता के जलए उपलब्ध होने की तीस दिनों की अवजध की समाजि से पहले इससे प्रभाजवत होने की संभावना वाले लोगों से आपजियां और सुझाव आमंजत्रत दकए गए थे;

और उक्त प्रारूप जनयमों की उक्त रािपत्र अजधसूचना की प्रजतयां 27 माचग, 2026 को िनता के जलए उपलब्ध थीं;

और, उक्त प्रारूप जनयमों के संबंध में िनता से प्राि आपजियों और सुझावों पर केंद्रीय सरकार द्वारा जवचार दकया गया है।

अतः अब, केंद्रीय सरकार, मोटर वाहन जनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रिि िजक्तयों का प्रयोग करते हुए, केंद्रीय मोटर वाहन जनयम, 1989 में जनम्नजलजखत संिोधन करती है, अथागत्:-

संजिि नाम और प्रारंभ. (1) इन जनयमों का संजिि नाम केंद्रीय मोटर वाहन (बारहवााँ संिोधन) जनयम, 2026 है।

(2) ये रािपत्र में इनके प्रकािन की तारीख को प्रवृि होंगे।

केंद्रीय मोटर वाहन जनयम, 1989 (इसके इसमें इसके पश्चात उक्त जनयम कहा गया है) के जनयम 93 के उप-जनयम (1) के खंड (क) में, छठे परंतुक के बाि, उप-खंड (vi) में सारणी के नीचे, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत्:-

“परंतु यह और दक रटपर और डम्पर के मामले में, जनयम 138ख के िूसरे परंतुक में दिए गए उपबंधों के अनुसार, लोड बॉडी को घेरने के जलए लगाई गई प्रणाली को मोटर वाहनों की कुल ऊंचाई मापने में ध्यान में नहीं रखा िाएगा।“

उक्त जनयमों में, जनयम 93 के उप-जनयम (1) के खंड (ख) में, उप-खंड (i) के स्ट्थान पर जनम्नजलजखत उप-खंड रखा िाएगा, अथागत्:-

"(i) मोटर वाहनों की कुल ऊंचाई मापने में ररयर-व्यू जमरर या अप्रत्यि िृजि के जलए उपकरण, या गाडग रेल या दििा संकेतक रबर-रेल (रबर बीडडंग) जिसकी बॉडी के प्रत्येक तरफ अजधकतम मोटाई 20 जमलीमीटर हो या साइड फुट स्ट्टेप, या रटपर और डम्पर पर लोड बॉडी को घेरने के जलए जनयम 138ख के िूसरे परंतुक में दिए गए उपबंधों के अनुसार लगाई गई प्रणाली को ध्यान में नहीं रखा िाएगा।"

उक्त जनयमों में, जनयम 138ख में, प्रथम परंतुक के बाि, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथागत्:-

“परंतु यह और दक 1 अप्रैल, 2027 को या उसके बाि, सभी डम्पर और रटपरों के मामले में, लोड बॉडी को ऊपर से ढकने के जलए जवद्युत, जवद्युत-यांजत्रक, ड्राउजलक या यांजत्रक रूप से संचाजलत प्रणाली से सुसजित दकया िाएगा, जिससे वाहन के सड़क पर चलते समय लोड बॉडी पूरी तरह से बंि रहे। ऊपर जवजनर्िगि प्रणाली लोड बॉडी की छत को ढकने के जलए दकसी भी उपयुक्त सामग्री का उपयोग कर सकती है। इसके अजतररक्त, चालक के केजबन में एक ऑजडयो-जविुअल अलटग जसस्ट्टम प्रिान दकया िाएगा जिससे वाहन के चलने के िौरान लोड बॉडी का कवर खुला या असुरजित होने पर चालक को चेतावनी िी िा सके।”

MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 28th July, 2026

G.S.R. 712(E).— Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 214 (E), dated the 20th March, 2026, published in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), dated the 27th March, 2026, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;

And whereas, the copies of the said Gazette notification of the said draft rules were made available to the public on 27th March, 2026;

And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government.

Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:—

Short title and commencement. - (1) These rules may be called the Central Motor Vehicles ( Twelfth Amendment) Rules, 2026.
