The Central Government amends the Employees' Deposit-Linked Insurance Scheme, 1976 to provide a minimum assurance benefit of rupees fifty thousand upon an employee's death even if the average provident fund balance is less than that amount. The scheme also allows a gap of up to sixty days between two spells of employment to be ignored when determining the continuous period of twelve months required for eligibility. An employee who dies in service within six months of the last contribution received while still on the employer rolls is eligible for the assurance benefit. The amendment comes into effect on the date of its publication in the Official Gazette.

सा.का.नि. 476(अ).— केन्द्रीय सरकार, कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1952 (1952 का 19) की धारा 7 की उपधारा (1) के साथ पठित धारा 6ग द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कर्मचारी निक्षेप-सहबद्ध बीमा स्कीम, 1976 का और संशोधन करने के लिए निम्नलिखित स्कीम बनाती है, अर्थात्:-
(2) यह राजपत्र में उसके प्रकाशन की तारीख से लागू होगी।
(i) उप-पैरा (1) के पश्चात निम्नलिखित उप-पैरा अंतःस्थापित किया जाएगा, अर्थात्:-
“(1क) उप-पैरा (1) के अधीन किसी कर्मचारी की, पूर्ववर्ती बारह मास के दौरान या उसकी सदस्यता की अवधि के दौरान मृत्यु होने की स्थिति में, भले ही किसी कर्मचारी का यथास्थिति, जो निधि का या अधिनियम की धारा 17 के अधीन छूट प्राप्त भविष्य निधि का सदस्य है, औसत भविष्य निधि अतिशेष पचास हजार रुपये से कम हो, तो उसे पचास हजार रुपये का न्यूनतम बीमा फायदा संदेय किया जाएगा।”
(ii) उप-पैरा (3) में “जो भी अधिकतर हो” शब्दों के पश्चात और स्पष्टीकरण से पहले निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात्:-
"परंतु कि स्कीम के उप-पैरा (3) के अधीन संदेय न्यूनतम बीमा फायदों की पात्रता के लिए अपेक्षित बारह मास की निरंतर अवधि के अवधारण के प्रयोजनार्थ, नियोजन की दो अवधियों के बीच साठ दिन तक के अंतराल को अनदेखा कर दिया जाएगा और ऐसी बहु सेवाओं को जोड़कर इसे निरंतर सेवा माना जाएगा।"
(iii) उप-पैरा (4) के पश्चात निम्नलिखित उप-पैरा अंतःस्थापित किया जाएगा, अर्थात्:-
“(5) यदि कोई कर्मचारी, जो, यथास्थिति, अधिनियम की धारा 17 के अधीन छूट प्राप्त निधि या भविष्य निधि का सदस्य है, नियोजक की उपस्थिति पंजिका पर रहते हुए अंतिम अभिदाय प्राप्त होने के छह मास के भीतर सेवा के दौरान मर जाता है, तो ऐसे कर्मचारी को स्कीम के अनुसार बीमा फायदा मिलेगा।”

MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION
New Delhi, the 18th July, 2025
G.S.R. 476(E).— In exercise of the powers conferred by section 6C read with sub-section (1) of section 7 of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby makes the following Scheme further to amend the Employees' Deposit-Linked Insurance Scheme, 1976, namely:-
(2) It shall come into effect from the date of its publication in the Official Gazette.
(i) after sub-paragraph (1), the following subparagraph shall be inserted, namely: -
“(1A) In the event of death of an employee under sub-paragraph (1) during the preceding twelve months or during the period of his membership, even if the average provident fund balance of an employee who is a member of the Fund or of a provident fund exempted under section 17 of the Act, as the case may be, is less than rupees fifty thousand, a minimum assurance benefit of rupees fifty thousand shall be payable.”
(ii) in sub-paragraph (3) after the words “whichever is higher” and before the Explanation, the following proviso shall be inserted, namely :-
"Provided that for the purpose of determination of continuous period of twelve months required for eligibility of minimum assurance benefits payable under sub-paragraph (3) of the Scheme, the gap of upto sixty days between two spells of employment shall be ignored and such multiple services shall be added being treated as continuous service."
(iii) after sub-paragraph (4), the following sub-paragraph shall be inserted, namely:-
“(5) In the event an employee who is a member of the Fund or of a provident fund exempted under section 17 of the Act, as the case may be, dies in service within six months of the last contribution received while still being on the rolls of the employer, such an employee shall get the assurance benefit as per the Scheme.”
