सा.का.जन. 79(अ).— केंरीय उत्पाि िुल्क अजधजनयम, 1944 (1944 का 1) की धारा 3क की उप-धाराओं (2)
और (3) द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंरीय सरकार एतद्वारा चबाने वाली तंबाकू, ििाा सुगंजधत तंबाकू और
गुटखा पैककंग मिीनें (क्षमता जनधाारण और िुल्क संग्रहण) जनयम, 2026 में संिोधन करने के जलए जनम्नजलजखत जनयम बनाती
है, अर्ाात्—
1.
(1) इन जनयमों को चबाने वाले तंबाकू, ििाा सुगंजधत तंबाकू और गुटखा पैककंग मिीनें (क्षमता जनधाारण और िुल्क
संग्रहण) संिोधन जनयम, 2026 कहा िाएगा;
(2) ये जनयम 1 फरवरी, 2026 से प्रवृत्त होंगे।

(क) जनयम 5 में, अंत में जनम्नजलजखत स्ट्पष्टीकरण िोडा िाएगा, अर्ाात्:
“स्ट्पष्टीकरण : इस जनयम के प्रयोिनों के जलए, मिीन की ‘अजधकतम जनधााररत गजत’ की गणना जनम्नजलजखत सूत्र का
उपयोग करके की िाएगी, अर्ाात् -
स = ( र
ग ) × न
िहााँ—
स = मिीन की अजधकतम जनधााररत गजत, िो प्रजत जमनट पाउच या रटन या कंटेनरों की संख्या के रूप में होगी;
र = मिीन के मुख्य जडस्ट्क रोटरी मोटर की प्रजत जमनट घूणान (आर.पी.एम.) रेटटंग, िो पाउच;
ग = मिीन के मुख्य जडस्ट्क रोटरी मोटर और मिीन के घूणान ड्रम के बीच जस्ट्र्त जगयर असेंबली का समग्र जगयर
अनुपात;
न = क्षैजति मिीन में फ़नलों की संख्या या ऊर्धवााधर मिीन में कपों की संख्या।”;
(ख)
जनयम 6 में, उप-जनयम (2) में, “रैकों ” िब्ि के स्ट्र्ान पर “कप” िब्ि प्रजतस्ट्र्ाजपत दकया िाएगा;
(ग)
फॉमा सीई डीईसी -01 में,
(i) पैराग्राफ 4 पर िी गई ताजलका में,—
I.
कॉलम (8) की कॉलम हेडडंग में, " रैकों" िब्ि के स्ट्र्ान पर "कप्स" िब्ि प्रजतस्ट्र्ाजपत दकया
िाएगा;
II. कॉलम (14) की कॉलम हेडडंग में, "रैकों " िब्ि के स्ट्र्ान पर "कप या फ़नल" िब्ि प्रजतस्ट्र्ाजपत
दकया िाएगा;
III. कॉलम (14) की हेडडंग में, "जमनट)" िब्ि के बाि, जनम्नजलजखत अन्द्त:स्ट्र्ाजपत दकया िाएगा,
अर्ाात्:- "[10/9]";

G.S.R. 79(E).— In exercise of the powers conferred by sub-sections (2) and (3) of section 3A of the Central
Excise Act, 1944 (1 of 1944), the Central Government hereby makes the following rules, to amend Chewing Tobacco,
Jarda Scented Tobacco and Gutkha Packing Machines (Capacity Determination and Collection of Duty) Rules, 2026,-
1.
(1) These rules shall be called the Chewing Tobacco, Jarda Scented Tobacco and Gutkha Packing Machines
(Capacity Determination and Collection of Duty) Amendment Rules, 2026;
(2) They shall come into force on the 1st day of February, 2026;

In the Chewing Tobacco, Jarda Scented Tobacco and Gutkha Packing Machines (Capacity Determination and
Collection of Duty) Rules, 2026,

(a) in rule 5, the following Explanation shall be inserted at the end, namely : -
“Explanation : For the purposes of this rule, “maximum rated speed” of the machine shall be calculated using
the following formula, namely:-
S = (𝑟
𝑔) × n
Where:
S = Maximum rated speed of the machine in terms of number of pouches per minute;
r = Revolutions per minute (RPM) rating of the main disc rotary motor of the machine that fills the pouches;
g = Overall gear ratio of the gear assembly between the main disc rotary motor and the rotating drum of the
machine;
n = Number of funnels in a horizontal machine or number of cups in a vertical machine.”;
(b)
in rule 6, in sub-rule (2), for the words “number of funnels, number of tracks”, the words “number of
funnels in a horizontal machine or number of cups in a vertical machine ” shall be substituted;
(c)
in FORM CE DEC-01,
(i) in paragraph 4 in the Table,-
(i)
in the column heading of column (8), for the word “tracks”, the word “cups” shall be substituted;
(ii)
in the column heading of column (14), for the word “track”, the words “cup or funnel” shall be
substituted;
(iii) in the heading of column (14), after the word “minute)”, the following shall be inserted,
namely:- “[10/9]”;
(iv) in the heading of column (15), after the word “Speed)”, the following shall be inserted,
namely: - “[14x11] or [14x8]”;
(ii) in paragraph 5, in Part A, in the Table,-

in the heading of column (15), for the numbers and symbols “(8)*(14)”, the following shall be

(iv) in paragraph 6, in the Table,-

in the heading of column (4), for the word “tracks”, the word “cups” shall be substituted;
II.
in the heading of column (11), for the word “track”, the word “cup or funnel” shall be substituted;
III.

in the heading of column (10), after the word “minute)”, the following shall be inserted,
