उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय (उपभोक्ता मामले विभाग) अधिसूचना नई दिल्ली, 23 अक्तूबर, 2025

सा.का.नि. 778(अ).—केन्द्रीय सरकार, विधिक मापविज्ञान अधिनियम, 2009 (2010 का 1) की धारा 52 की उपधारा (2) के खंड (ञ) और (थ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विधिक मापविज्ञान (पैक में रखी वस्तुएं) नियम, 2011 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ - (1) इन नियमों का संक्षिप्त नाम विधिक मापविज्ञान (पैक में रखी वस्तुएं) संशोधन नियम, 2025 है।

(2) वे राजपत्र में उनके प्रकाशन की तारीख को लागू होंगे।

2. विधिक मापविज्ञान (पैक में रखी वस्तुएं) नियम, 2011 (जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) में, नियम 2 के, खंड (h) में, निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-

"परंतु यह कि चिकित्सा युक्तियां अंतर्वर्ष्ट करने वाले पैकेजों के लिए, घोषणाएं करने हेतु चिकित्सा युक्ति नियम, 2017 के उपबंध लागू होंगे;"।

3. मूल नियमों के, नियम 7 में, -

(i) उप-नियम (2) में, अंत में निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-

"परंतु यह कि चिकित्सा युक्तियां अंतर्वर्ष्ट करने वाले पैकेजों के लिए, घोषणा करने हेतु किसी भी अंक और अक्षर की ऊंचाई के लिए, चिकित्सा युक्ति नियम, 2017 के उपबंध लागू होंगे;";

(ii) उप-नियम (3) में, अंत में निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-

"परंतु यह कि चिकित्सा युक्तियां अंतर्वर्ष्ट करने वाले पैकेजों के लिए, घोषणा करने हेतु किसी भी अंक और अक्षर की चौड़ाई के लिए, चिकित्सा युक्ति नियम, 2017 के उपबंध लागू होंगे।"

4. मूल नियमों में, नियम 33 उप-नियम (1) के रूप में संख्यांकित होगा और इस प्रकार संख्यांकित नियमों के पश्चात्, निम्नलिखित उप-नियम अंतःस्थापित किया जाएगा, अर्थात् :-

"(2) उस दशा में जहां चिकित्सा युक्ति नियम, 2017 लागू होते हैं, इस नियम के अधीन दिया गया शिथिलीकरण लागू नहीं होगा।"

टिप्पण : मूल नियम, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में सा.का.नि. संख्या 202(अ), तारीख 7 मार्च, 2011 द्वारा प्रकाशित किए गए थे और अंतिम बार सा.का.नि. संख्या 722(अ) तारीख 6 अक्तूबर, 2023 द्वारा संशोधित किए गए थे।

MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Consumer Affairs) NOTIFICATION New Delhi, the 23rd October, 2025.

G.S.R. 778(E).—In exercise of the powers conferred by (j) and (q) of sub-section (2) of section 52 of the Legal Metrology Act, 2009 (1 of 2010), the Central Government hereby makes the following rules further to amend the Legal Metrology (Packaged Commodities) Rules, 2011, namely:-

1. Short title and commencement. – (1) These rules may be called the Legal Metrology (Packaged Commodities) Amendment Rules, 2025.

(2) They shall come into force on the date of their publication in the official gazette.

2. In the Legal Metrology (Packaged Commodities) Rules, 2011 (hereinafter referred to as the principal rules), in rule 2, to clause (h), the following proviso shall be inserted, namely:-

"Provided that for packages containing medical devices, the provisions of the Medical Devices Rules, 2017, shall apply to make declarations;".

3. In the principal rules, in rule 7,-

(i) in sub-rule (2), the following proviso shall be inserted at the end, namely:-

"Provided that for packages containing medical devices, the provisions of the Medical Devices Rules, 2017, shall apply for the height of any numeral and letter to make declarations.";

(ii) to sub-rule (3), the following proviso shall be inserted at the end, namely:-

"Provided that for packages containing medical devices, the provisions of the Medical Devices Rules, 2017, shall apply for the width of any numeral and letter to make declarations.".

4. In the principal rules, rule 33 shall be numbered as sub-rule (1) and after the rules as so number, the following sub-rule shall be inserted, namely:-

"(2) In case where the Medical Devices Rules, 2017 are applicable, the relaxation given under this rule shall not apply.".

Note : The principal rules were published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 202(E), dated the 7th March, 2011 and was last amended vide number G.S.R. 722(E), dated $6^{\text{th}}$ October, 2023.
