सा.का.जन. 378(ऄ).—केंद्रीय सरकार, वाजणज्य पोत पररवहन ऄजधजनयम , 2025 (2025, का 24) की धारा
136 तथा धारा 142 की ईपधारा (1) के साथ परठत धारा 133 की ईपधारा (4), धारा 135 की ईपधारा (2) के साथ
परठत धारा 143 की ईपधारा (1) और ईपधारा (2) के खंड (घ) और खंड (झ)) द्वारा प्रदत्त िजियों का प्रयोग करते हुए,
वाजणज्य पोत पररवहन (पोत से जनकलने वाले कचरे से प्रदूषण का जनवारण) जनयम, 2009 को ईन बातों के जसवाय
ऄजधक्ांत करते हए, जजन्हे ऐसे ऄजधक्मण से पूवग दकया गया है या करने का लोप दकया गया है, जनम्नजलजखत जनयम बनाती
है, ऄथागत्: -
1. संजिप्त िीषगक और प्रारंभ.-(1) आन जनयमों को वाजणज्य पोत पररवहन (पोत से कचरे द्वारा प्रदूषण का जनवारण) जनयम,
2026 है।
(2) ये राजपत्र में आनके प्रकािन की तारीख को प्रवृत होंगे।
2. पररभाषाएँ.- (1) आन जनयमों में, जब तक संदभग ऄन्यथा ऄपेजित न हो,
(क) "ऄजधजनयम" से वाजणज्य पोत पररवहन ऄजधजनयम, 2025 (2025 का 24) ऄजभप्रेत है;
(ख) "प्रिासन" से महाजनदेिक है तथा दकसी ऄन्य राज्य का ध्वज फहराने के पात्र जलयानों के संबंध में ईस
राज्य की सरकार से है;

(ग) "पिु िव" से ईन जानवरों के िरीर ऄजभप्रेत है, जजन्हें माल के रूप में जहाज पर ले जाया जाता है और
जो यात्रा के दौरान मर जाते हैं या जजन्हें आच्छामृत्यु दी जाती है;
(घ) "ईपाबंध" से जहाजों से होने वाले प्रदूषण की रोकथाम के जलए ऄंतरागष्ट्रीय सम्मेलन, 1973 के ईपाबंध-

ऄजभप्रेत है, जैसा दक 1978 के प्रोटोकॉल (MARPOL) ईपांतररत दकया गया है, जैसा दक समय-समय पर
संिोजधत दकया गया है;
(ङ) "माल ऄविेष" से दकसी भी माल के वह ऄविेष ऄजभप्रेत है जो प्रदूषण जनवारण के संबंध में वाजणज्य
पोत पररवहन ऄजधजनयम, 2025 (2025 का 24) के ऄधीन बनाए गए ऄन्य जनयमों के ऄधीन नहीं अते हैं
और जो माल के लदान या ईतारने के पश्चात् डेक या होल्ड में रह जाते हैं, जजनमें के दौरान ऄजतररि माल
या ररसाव िाजमल है, चाहे वह गीली ऄवस्ट्था में हो या सूखी ऄवस्ट्था में धुलाइ के पानी में समाजहत धूल
आसमें िाजमल नहीं है, लेदकन आसमें झाडू लगाने के बाद डेक पर बची हुइ माल की धूल या जहाज की बाहरी
सतहों पर जमी धूल िाजमल नहीं है;
(च) “ऄजभसमय” से तात्पयग जहाजों से होने वाले प्रदूषण की रोकथाम के जलए ऄंतरागष्ट्रीय ऄजभसमय, 1973
से है, जजसमें समय-समय पर संिोजधत 1978 का प्रोटोकॉल भी िाजमल है;
(छ) "खाना पकाने का तेल" से तात्पयग दकसी भी प्रकार के खाद्य तेल या पिु वसा से है जजसका ईपयोग भोजन
तैयार करने या पकाने के जलए दकया जाता है या दकया जाना है, लेदकन आसमें वह भोजन िाजमल नहीं है जो
आन तेलों का ईपयोग करके तैयार दकया जाता है;
(ज) "घरेलू ऄपजिष्ट" से तात्पयग दकसी पोत के अवास स्ट्थानों के भीतर ईत्पन्न होने वाले ऄपजिष्ट की सभी
श्रेजणयों से है, जो प्रदूषण जनवारण से संबंजधत व्यापाररक जहाजरानी ऄजधजनयम, 2025 (24 ऑफ 2025) के
तहत बनाए गए दकसी ऄन्य जनयम के तहत जवजनयजमत नहीं हैं, और आसमें ग्रे जल िाजमल नहीं होगा;
(झ) "आलेक्ट्रॉजनक ऄजभलेख बुक" का ऄथग है प्रिासन द्वारा ऄनुमोददत कोइ ईपकरण या प्रणाली, जजसका
ईपयोग हाडग कॉपी ऄजभलेख बुक के स्ट्थान पर ऄनुलग्नक के ऄंतगगत अवश्यक जनवगहन, स्ट्थानांतरण और ऄन्य
कायों के जलए अवश्यक प्रजवजष्टयों को आलेक्ट्रॉजनक रूप से ऄजभलेख करने के जलए दकया जाता है;
(ञ) "मागग में" का ऄथग है दक पोत समुद्र में एक या एक से ऄजधक मागों पर चल रहा है, जजसमें सबसे छोटे
सीधे मागग से जवचलन भी िाजमल है, जो नौवहन ईद्देश्यों के जलए जजतना संभव हो ईतना व्यावहाररक रूप से
दकसी भी जनवगहन को समुद्र के ईतने बडे िेत्र में फैला देगा जजतना ईजचत और व्यावहाररक हो;
(ट) "इ-कूडा" का ऄथग है पोत के सामान्य संचालन या अवास स्ट्थानों में ईपयोग दकए जाने वाले जवद्युत और
आलेक्ट्रॉजनक ईपकरण, जजसमें सभी घटक, ईप-ऄसेंबली और ईपभोग्य वस्ट्तुएं िाजमल हैं, जो त्याग के समय
ईपकरण का जहस्ट्सा हैं, जजनमें मानव स्ट्वास्ट््य या पयागवरण के जलए संभाजवत रूप से खतरनाक सामग्री मौजूद
है;
(ठ) "मत्स्ट्य पकडने का ईपकरण" से तात्पयग दकसी भी भौजतक ईपकरण या ईसके भाग या वस्ट्तुओं के संयोजन
से है जजसे समुद्री या मीठे पानी के जीवों को पकडने, या बाद में पकडने या कटाइ के जलए जनयंजत्रत करने के
ईद्देश्य से पानी पर या समुद्र तल पर रखा जा सकता है;
(ड) "जस्ट्थर या तैरते हुए प्लेटफामग" से तात्पयग समुद्र में जस्ट्थत जस्ट्थर या तैरती हुइ संरचनाओं से है जो समुद्र
तल के खजनज संसाधनों की खोज, दोहन या संबंजधत ऄपतटीय प्रसंस्ट्करण में लगी हुइ हैं;
(ढ) "खाद्य ऄपजिष्ट" से तात्पयग दकसी भी खराब या जबना खराब हुए खाद्य पदाथों से है और आसमें फल,
सजजजयां, दुग्ध ईत्पाद, मुगी, मांस ईत्पाद और जहाज पर ईत्पन्न खाद्य ऄपजिष्ट िाजमल हैं;
(ण) "कूडा" से तात्पयग सभी प्रकार के खाद्य ऄपजिष्ट, घरेलू ऄपजिष्ट और पररचालन ऄपजिष्ट, सभी प्लाजस्ट्टक,
माल के ऄविेष, भस्ट्मीकरण की राख, खाना पकाने का तेल, मछली पकडने का सामान और पिु िवों से
है।पोत के सामान्य संचालन के दौरान ईत्पन्न होने वाले और जनरंतर या अवजधक रूप से जनपटान के जलए
ईत्तरदायी पदाथग, ईन पदाथों को छोडकर जो प्रदूषण जनवारण से संबंजधत व्यापाररक जहाजरानी ऄजधजनयम,
2025 (24 ऑफ 2025) के तहत बनाए गए ऄन्य जनयमों में पररभाजषत या सूचीबद्ध हैं:

बिते दक कचरे में ताजी मछली और ईसके जहस्ट्से िाजमल न हों जो यात्रा के दौरान की गइ मछली
पकडने की गजतजवजधयों के पररणामस्ट्वरूप ईत्पन्न हुए हों, या जलीय कृजष गजतजवजधयों के पररणामस्ट्वरूप
ईत्पन्न हुए हों जजनमें मछली (िंख सजहत) का पररवहन जलीय कृजष सुजवधा में रखने के जलए और ऐसी
सुजवधाओं से कटाइ की गइ मछली (िंख सजहत) को प्रसंस्ट्करण के जलए तट तक पररवहन करना िाजमल हो।
(त) ठोस थोक माल के संबंध में "HME" (समुद्री पयागवरण के जलए हाजनकारक) का ऄथग और मानदंड चौथी
ऄनुसूची में जनधागररत हैं;
(थ) "भस्ट्मीकरण संयंत्र की राख" से तात्पयग कचरे के भस्ट्मीकरण के जलए ईपयोग दकए जाने वाले जहाज पर
जस्ट्थत भस्ट्मीकरण संयंत्रों से ईत्पन्न राख और क्क्ट्लकर से है;
(द) "जनकटतम भूजम" का वही ऄथग होगा जो पररजिष्ट में ददया गया है, जजसमें ऑस्ट्रेजलया के ईत्तर-पूवी तट से
दूर जविेष अधार रेखा भी िाजमल है;
(ध) "पररचालनात्मक ऄपजिष्ट" से तात्पयग ईन सभी ठोस ऄपजिष्टों (स्ट्लरी सजहत) से है जो प्रदूषण जनवारण
से संबंजधत व्यापाररक जहाजरानी ऄजधजनयम, 2025 (24 ऑफ 2025) के ऄंतगगत बनाए गए ऄन्य जनयमों के
ऄंतगगत नहीं अते हैं और जो दकसी पोत के सामान्य रखरखाव या संचालन के दौरान जहाज पर एकत्र दकए
जाते हैं, या माल भंडारण और संचालन के जलए ईपयोग दकए जाते हैं, और आसमें कागो होल्ड और बाहरी
धुलाइ जल में जनजहत सफाइ एजेंट और योजक िाजमल हैं:
बिते दक पररचालन ऄपजिष्टों में ग्रे वाटर, जबलज वाटर या पोत के संचालन के जलए अवश्यक ऄन्य
समान जनवगहन िाजमल न हों, ऄंतरागष्ट्रीय समुद्री संगठन द्वारा जवकजसत ददिाजनदेिों को ध्यान में रखते हुए;
(न) "संगठन" से तात्पयग ऄंतरागष्ट्रीय समुद्री संगठन से है;
(प) "प्लाजस्ट्टक" से तात्पयग एक ठोस पदाथग से है जजसमें एक या एक से ऄजधक ईच्च अणजवक द्रव्यमान वाले
पॉजलमर एक अवश्यक घटक के रूप में होते हैं और जो पॉजलमर के जनमागण या तैयार ईत्पाद में जनमागण के
दौरान उष्मा और/या दबाव द्वारा अकार (रूप) में जनर्ममत होते हैं, जजनके भौजतक गुण कठोर और भंगुर से
लेकर नरम और लोचदार तक होते हैं और आसमें वह सभी कूडा िाजमल है जजसमें दकसी भी रूप में प्लाजस्ट्टक
होता है या िाजमल होता है, जजसमें क्सथेरटक रजस्ट्सयाँ, क्सथेरटक मछली पकडने के जाल, प्लाजस्ट्टक कूडा बैग,
माआक्ोप्लाजस्ट्टक, प्लाजस्ट्टक पेलेट्स और प्लाजस्ट्टक ईत्पादों से भस्ट्मीकरण राख िाजमल हैं;
(फ) "ध्रुवीय संजहता" से तात्पयग ध्रुवीय जलिेत्रों में संचाजलत होने वाले जहाजों के जलए ऄंतरागष्ट्रीय संजहता से
है, जजसमें एक प्रस्ट्तावना, भाग I-A और भाग 11-A तथा भाग 1-B और II-B िाजमल हैं, जैसा दक संकल्प
MSC 385(94) और MEPC 264(68) द्वारा ऄपनाया गया है, जैसा दक संिोजधत दकया जा सकता है:
(i) ध्रुवीय संजहता के भाग II-A के ऄध्याय 5 और प्रस्ट्तावना के पयागवरण संबंधी प्रावधानों में संिोधन,
ऄनुलग्नक के पररजिष्ट पर लागू संिोधन प्रदक्याओं से संबंजधत ऄजभसमय के ऄनुच्छेद 16 के प्रावधानों के
ऄनुसार ऄपनाए जाते हैं, लागू दकए जाते हैं और प्रभावी होते हैं; और
(ii) समुद्री पयागवरण संरिण सजमजत द्वारा ऄपनी कायगप्रणाली के जनयमों के ऄनुसार ध्रुवीय
संजहता के भाग II-B में संिोधन दकए जाते हैं;
(ब) "ध्रुवीय जल" से तात्पयग अकगरटक जल और/या ऄंटाकगरटक िेत्र से है,
स्ट्पष्टीकरण: आस खंड के प्रयोजन के जलए, अकगरटक जल का ऄथग ईन जल िेत्रों से है जो ऄिांि
58°00′.0 N और देिांतर 042°00′.0 W से ऄिांि 64°37′.0 N और देिांतर 035°27′.0 W तक खींची
गइ रेखा के ईत्तर में जस्ट्थत हैं, और दफर एक समचतुभुगज रेखा द्वारा ऄिांि 67°03.9 N और देिांतर
026°33′.4 W तक, और दफर एक समचतुभुगज रेखा द्वारा ऄिांि 70°49′.56 N और देिांतर 008°59′.61
W (सोरकाप, जन मायेन) तक, और जन मायेन के दजिणी तट से 73°31'.6 N और 019°01'.0 E तक,
जयोनॉय द्वीप तक, और दफर एक वृहत्तर वृत्त रेखा द्वारा ऄिांि तक जस्ट्थत हैं। 68°38′.29 ईत्तर ऄिांि और
043°23′.08 पूवग देिांतर (कैप काजनन नोस) से होते हुए एजियाइ महाद्वीप के ईत्तरी तट से पूवग की ओर
बेररग जलडमरूमध्य तक और दफर बेररग जलडमरूमध्य से पजश्चम की ओर 60° ईत्तर ऄिांि तक
आलजपरस्ट्की तक और 60वें ईत्तरी ऄिांि के समानांतर पूवग की ओर एटोजलन जलडमरूमध्य तक और दफर

ईत्तरी ऄमेररकी महाद्वीप के ईत्तरी तट से दजिण की ओर 60° ईत्तर ऄिांि तक और दफर 60° ईत्तर ऄिांि
के समानांतर पूवग की ओर 056°37′.1 पजश्चम देिांतर तक और दफर 58°00′.0 ईत्तर ऄिांि और
042°00′.0 पजश्चम देिांतर तक।
(भ) "ऄनुसूची" से तात्पयग आन जनयमों से संलग्न ऄनुसूजचयों से है, जजनमें जहाजों से होने वाले प्रदूषण की
रोकथाम के जलए ऄंतरागष्ट्रीय सम्मेलन, 1973 के ऄनुबंध V की अवश्यकताएं िाजमल हैं, जजसमें समय-समय
पर संिोजधत 1978 का प्रोटोकॉल भी िाजमल है;
(म) "जविेष िेत्र" से तात्पयग एक समुद्री िेत्र से है जहाँ आसकी समुद्र जवज्ञान और पाररजस्ट्थजतक जस्ट्थजत तथा
आसके यातायात की जविेष प्रकृजत के संबंध में मान्यता प्राप्त तकनीकी कारणों से कचरे द्वारा समुद्री प्रदूषण की
रोकथाम के जलए जविेष ऄजनवायग जवजधयों को ऄपनाना अवश्यक है और ये जविेष िेत्र भूमध्य सागर िेत्र,
बाजल्टक सागर िेत्र, काला सागर िेत्र, लाल सागर िेत्र, खाडी िेत्र, ईत्तरी सागर िेत्र, ऄंटाकगरटक िेत्र और
व्यापक कैरेजबयन िेत्र हैं, जजन्हें जनम्नानुसार पररभाजषत दकया गया है:
(i) भूमध्य सागर िेत्र का ऄथग है भूमध्य सागर, जजसमें ईसके भीतर की खाजडयाँ और समुद्र िाजमल हैं,
और भूमध्य सागर तथा काला सागर के बीच की सीमा 41° ईत्तरी ऄिांि द्वारा जनर्ममत है तथा पजश्चम
में जजब्राल्टर जलडमरूमध्य द्वारा 5°36′ पजश्चमी देिांतर पर जस्ट्थत है;
(ii) बाजल्टक सागर िेत्र का ऄथग है बाजल्टक सागर, जजसमें बोथजनया की खाडी और दफनलैंड की खाडी
िाजमल हैं, और बाजल्टक सागर का प्रवेि द्वार जो स्ट्केजराक में 57° 44.8′ ईत्तर पर जस्ट्थत है;
(iii) काला सागर िेत्र का तात्पयग भूमध्य सागर और काला सागर के बीच की सीमा सजहत काला सागर
से है, जो 41° ईत्तर ऄिांि रेखा द्वारा जनर्ममत है;
(iv) लाल सागर िेत्र का ऄथग है स्ट्वेज और ऄकाबा की खाडी सजहत लाल सागर िेत्र, जो दजिण में रास
सी अने (12º 28.5' Ν. 43" 19.6" पूवग) के बीच ऄंगूठे की रेखा द्वारा जघरा हुअ है और हुस्न मुराद
(12° 40.4′ ईत्तर, 43° 30.2" पूवग);
(v) खाडी िेत्र से तात्पयग रास ऄल हद्द (22° 30° ईत्तर, 59° 48′ पूवग) और रास ऄल फस्ट्तच (25° 04′
ईत्तर, 61° 25′ पूवग) के बीच की समचतुभुगज रेखा के ईत्तर-पजश्चम में जस्ट्थत समुद्री िेत्र से है:
(vi) ईत्तरी सागर िेत्र का ऄथग है ईत्तरी सागर, जजसमें ऄिांि 62° ईत्तर और देिांतर 4º पजश्चम के पूवग
में ईत्तरी सागर के बीच की सीमा, स्ट्कैगेरक, जजसकी दजिणी सीमा स्ट्काव के पूवग में ऄिांि 57° 44.8°
ईत्तर द्वारा जनधागररत की जाती है, और आंजग्लि चैनल और आसके पहुँच मागग देिांतर 5º पजश्चम और
ऄिांि 48° 30° ईत्तर के पूवग में;
(vii) ऄंटाकगरटक िेत्र से तात्पयग ऄिांि 60° दजिण के दजिण में जस्ट्थत समुद्री िेत्र से है;
(viii) व्यापक कैरेजबयन िेत्र का ऄथग है मेजक्ट्सको की खाडी और कैरेजबयन सागर, जजसमें ईसके भीतर की
खाजडयाँ और समुद्र िाजमल हैं, और ऄटलांरटक महासागर का वह भाग जो फ्लोररडा से पूवग की ओर
77°30′ पजश्चम देिांतर तक 30° ईत्तरी ऄिांि द्वारा खींची गइ सीमा के भीतर अता है, दफर 20°
ईत्तरी ऄिांि और 59° पजश्चम देिांतर के प्रजतच्छेदन तक एक सीधी रेखा, दफर 7°20′ ईत्तरी ऄिांि
और 50° पजश्चम देिांतर के प्रजतच्छेदन तक एक सीधी रेखा, और दफर दजिण-पजश्चम की ओर खींची गइ
एक सीधी रेखा जो फ्रेंच गुयाना की पूवी सीमा तक जाती है।
(2) आन जनयमों में प्रयुि िजद और ऄजभव्यजियाँ जो पररभाजषत नहीं हैं, परन्तु ऄजधजनयम में पररभाजषत हैं, ईनका
वही ऄथग होगा जो ऄजधजनयम में ईन्हें क्मिः ददया गया है।
3. अवेदन. (1) जब तक स्ट्पष्ट रूप से ऄन्यथा प्रदान न दकया गया हो, आन जनयमों के प्रावधान ऄजधजनयम की धारा 131
और 132 के ऄनुसार सभी जहाजों और बंदरगाहों पर लागू होंगे।
(2) जजन जहाजों और बंदरगाहों पर ये जनयम लागू होते हैं, ईन्हें आन जनयमों की ऄनुसूची में दी गइ अवश्यकताओं
का पालन करना होगा।

4. समुद्र में कूडा डालने पर सामान्य प्रजतबंध.- (1) सभी प्रकार के कूडे का जनवगहन और समुद्र में इ-कूडा डालना जनजषद्ध है,
जसवाय आसके दक प्रथम ऄनुसूची के ऄनुच्छेद 1 से 3 और ध्रुवीय संजहता के भाग II-A के जनयम 5 और धारा 5.2 में ऄन्यथा
प्रावधान दकया गया हो।
(2) आन जनयमों के जनयम 5 में ददए गए प्रावधानों को छोडकर, सभी प्रकार के प्लाजस्ट्टक, जजनमें क्सथेरटक रजस्ट्सयाँ,
क्सथेरटक मछली पकडने के जाल, प्लाजस्ट्टक कूडा बैग, माआक्ोप्लाजस्ट्टक, प्लाजस्ट्टक पेलेट्स और प्लाजस्ट्टक ईत्पादों से
जनकलने वाली भस्ट्मीकरण राख िाजमल हैं, का समुद्र में जनवगहन जनजषद्ध है।
5. ऄपवाद.- (1) जनयम 4 और प्रथम ऄनुसूची के ऄनुच्छेद 1 से 3 तथा ध्रुवीय संजहता के भाग 2-ए के ऄध्याय 5 की धारा
5.2 के प्रावधान जनम्नजलजखत पर लागू नहीं होंगे:
(क) दकसी पोत से कचरे का जनवगहन करना जो पोत और ईस पर सवार लोगों की सुरिा सुजनजश्चत
करने या समुद्र में जीवन बचाने के ईद्देश्य से अवश्यक हो; या
(ख) दकसी पोत या ईसके ईपकरण को हुए नुकसान के पररणामस्ट्वरूप कचरे का अकजस्ट्मक
नुकसान, बिते दक नुकसान होने से पहले और बाद में अकजस्ट्मक नुकसान को रोकने या कम करने
के जलए सभी ईजचत सावधाजनयां बरती गइ हों; या
(ग) दकसी पोत से मछली पकडने के ईपकरणों का अकजस्ट्मक नुकसान, बिते दक ऐसे नुकसान को
रोकने के जलए सभी ईजचत सावधाजनयां बरती गइ हों; या
(घ) समुद्री पयागवरण की सुरिा के जलए या ईस पोत या ईसके चालक दल की सुरिा के जलए दकसी
पोत से मछली पकडने के ईपकरण का जनवगहन।
(2) प्रथम ऄनुसूची के ऄनुच्छेद 1 और 2 तथा ध्रुवीय संजहता के भाग 2-ए के ऄध्याय 5 की मागग संबंधी
अवश्यकताएँ खाद्य ऄपजिष्टों के जनवगहन पर लागू नहीं होंगी, जहाँ यह स्ट्पष्ट हो दक आन खाद्य ऄपजिष्टों को
जहाज पर रखने से जहाज पर सवार लोगों के स्ट्वास्ट््य को तत्काल खतरा है।
6. ध्रुवीय जल.- (1) जजन जहाजों पर ये जनयम लागू होते हैं, वे ध्रुवीय जल में संचालन करते समय, आन जनयमों की दकसी
ऄन्य लागू अवश्यकताओं के ऄजतररि, प्रस्ट्तावना के पयागवरण संबंधी प्रावधानों और ध्रुवीय संजहता के भाग II-A के ऄध्याय
5 का ऄनुपालन करेंगे।
(2) ध्रुवीय संजहता के भाग II-A के ऄध्याय 5 को लागू करते समय, ध्रुवीय संजहता के भाग II-B में ददए गए
ऄजतररि मागगदिगन पर जवचार दकया जाएगा।
7. स्ट्वागत सुजवधाओं की पयागप्तता.- (1) भारत में प्रत्येक बंदरगाह और टर्ममनल यह सुजनजश्चत करेगा दक ऄजधजनयम की
धारा 142 की ईपधारा (1) के ऄनुसार, जहाजों को ऄनुजचत देरी दकए जबना कूडा प्राप्त करने के जलए पयागप्त सुजवधाएं
प्रदान करना।
(2) महाजनदेिक, ऄनुबंध के तहत प्रदान की जाने वाली सुजवधाओं के ऄपयागप्त होने के सभी मामलों की सूचना
संगठन को संबंजधत संजवदाकारी सरकारों को प्रेजषत करने हेतु देंगे।
(3) स्ट्वागत सुजवधाओं के लेखापरीिा या जनरीिण तथा बंदरगाह ऄपजिष्ट प्रबंधन योजना (पीडजल्यूएमपी) की
जांच, ऄनुमोदन और अवजधक समीिा के जलए बंदरगाहों और टर्ममनलों द्वारा महाजनदेिक को देय िुल्क
40,000 रुपये होगा।
8. पररचालन संबंधी अवश्यकताओं पर जनयंत्रण.- (1) बंदरगाह या ऄपतटीय िेत्र में जस्ट्थत प्रत्येक पोत भारत में जस्ट्थत
टर्ममनल आन जनयमों के तहत पररचालन संबंधी अवश्यकताओं के संबंध में सवेिक या दकसी ऄजधकृत व्यजि द्वारा जनरीिण

के ऄधीन है, जहां यह मानने के स्ट्पष्ट कारण हैं दक मास्ट्टर या चालक दल कचरे से होने वाले प्रदूषण की रोकथाम से संबंजधत
अवश्यक जहाज पर प्रदक्याओं से पररजचत नहीं हैं।
(2) ईप-जनयम (1) में जनर्ददष्ट पररजस्ट्थजतयों में, सवेिक या ऄजधकृत व्यजि यह सुजनजश्चत करने के जलए ऐसे कदम
ईठाएगा दक जब तक आन जनयमों की अवश्यकताओं के ऄनुसार जस्ट्थजत को व्यवजस्ट्थत नहीं कर जलया जाता तब
तक पोत रवाना न हो।
(3) आस जनयम में ऐसा कुछ भी नहीं है जजससे ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों या ऄजभसमय में
जविेष रूप से प्रदान की गइ पररचालन अवश्यकताओं पर जनयंत्रण रखने वाली केंद्र सरकार के ऄजधकारों और
दाजयत्वों को सीजमत दकया जा सके।
9.
दंड.- (1) आन जनयमों का ईल्लंघन या आसके दकसी भी प्रावधान का पालन न करने पर ऄजधजनयम में जनर्ददष्ट दंड
लागू होंगे।
(2) कोइ भी व्यजि जो आन जनयमों के प्रावधानों के ईल्लंघन में दकसी पोत का संचालन करता है, और जजसके
जलए ऄजधजनयम की धारा 281 की ईपधारा (2) के तहत कोइ जवजिष्ट दंड जनधागररत नहीं है, वह 50,000 रुपये
तक के दंड का भागी होगा, और यदद ईल्लंघन जनरंतर जारी रहता है, तो ईल्लंघन जारी रहने वाले पहले ददन के
बाद प्रत्येक ददन के जलए 5,000 रुपये तक का ऄजतररि दंड लगाया जा सकता है।
(3) आस जनयम के तहत दकसी भी दंड का ऄजधरोपण स्ट्वामी या मास्ट्टर को गैर-ऄनुपालन को सुधारने की
अवश्यकता से मुि नहीं करेगा।

पहली ऄनुसूची
[जनयम 4 के ईप-जनयम (1) और जनयम 5 देखें]
कचरे से होने वाले प्रदूषण की रोकथाम (पररजिष्ट V, जनयम 3-6)
1. जविेष िेत्रों के बाहर कूडा डालना.- (1) जविेष िेत्रों के बाहर समुद्र में जनम्नजलजखत कचरे का जनवगहन केवल तभी
ऄनुमत होगा जब पोत मागग में हो और जनकटतम भूजम से यथासंभव दूर हो, लेदकन दकसी भी जस्ट्थजत में, आससे कम नहीं
होना चाजहए: -
(क) कजमन्यूटर या ग्राआंडर से गुजरे खाद्य ऄपजिष्टों के जलए जनकटतम भूजम से तीन समुद्री मील की दूरी। ऐसे जपसे
हुए खाद्य ऄपजिष्ट 25 जममी से ऄजधक बडे जछद्रों वाली छलनी से गुजरने में सिम होने चाजहए;
(ख) खंड (क) के ऄनुसार ईपचाररत न दकए गए खाद्य ऄपजिष्टों के जलए जनकटतम भूजम से बारह समुद्री मील की
दूरी;
(ग) माल के ऄविेषों के जलए जनकटतम भूजम से बारह समुद्री मील की दूरी, जजन्हें अम तौर पर ईपलजध
ऄनलोक्डग जवजधयों का ईपयोग करके पुनप्रागप्त नहीं दकया जा सकता है, बिते दक पांचवीं ऄनुसूची में जनर्ददष्ट ितों
का ऄनुपालन दकया जाए। आन माल ऄविेषों में चौथी ऄनुसूची में जनधागररत मानदंडों के ऄनुसार समुद्री पयागवरण
के जलए हाजनकारक के रूप में वगीकृत कोइ भी पदाथग नहीं होना चाजहए;
(घ) पिु िवों के जलए, संगठन द्वारा जारी ददिा-जनदेिों को ध्यान में रखते हुए, जनकटतम भूजम से यथासंभव दूर
जनवगहन दकया जाएगा।
(2) कागो होल्ड, डेक और बाहरी सतहों के धुलाइ जल में जनजहत सफाइ एजेंट या योजक समुद्र में छोडे जा सकते हैं, बिते
दक ऐसा जनवगहन पांचवीं ऄनुसूची में जनर्ददष्ट ितों का ऄनुपालन करता हो, और ये पदाथग संगठन द्वारा जारी ददिाजनदेिों
को ध्यान में रखते हुए समुद्री पयागवरण के जलए हाजनकारक नहीं होने चाजहए।
(3) ऄंतरागष्ट्रीय समुद्री जीवन सुरिा ऄजभसमय (एसओएलएएस), 1974, संिोजधत, के जवजनयमन VI/1-1.2 में पररभाजषत
ठोस थोक माल, ऄनाज के ऄलावा, चौथी ऄनुसूची के ऄनुसार वगीकृत दकया जाएगा, और प्रेषक द्वारा घोजषत दकया
जाएगा दक वे समुद्री पयागवरण के जलए हाजनकारक हैं या नहीं।
(4) जब कूडा ऄन्य पदाथों के साथ जमला हुअ हो या ईनसे दूजषत हो, जजन्हें जनवगहन के जलए प्रजतबंजधत दकया गया हो या
जजनके जनवगहन की अवश्यकताएं जभन्न हों, तो ऄजधक कठोर अवश्यकताएं लागू होंगी।
2. जविेष िेत्रों के भीतर जनवगहन.- (1) जविेष िेत्रों के भीतर समुद्र में जनम्नजलजखत कचरे का जनवगहन केवल तभी ऄनुमत
होगा जब पोत मागग में हो और जनम्नानुसार हो:
(क) खाद्य ऄपजिष्ट का समुद्र में जनकटतम भूजम से यथासंभव दूर, लेदकन जनकटतम भूजम या जनकटतम जहमखंड से
कम से कम बारह समुद्री मील की दूरी पर ही जनस्ट् सारण दकया जाएगा । खाद्य ऄपजिष्ट को जवखंजडत या ऄवचूर्मणत करके
ऐसी छलनी से छानना चाजहए जजसके जछद्रों का अकार 25 जममी से ऄनजधक हो। खाद्य ऄपजिष्ट दकसी ऄन्य प्रकार के कचरे
से दूजषत नहीं होगा। ऄंटाकगरटक िेत्र में कुक्ट् कुट और ईसके ऄवयव सजहत, लाए गए पिी ईत्पादों का जनस्ट् सारण तब तक
ऄनुमत नहीं होगा, जब तक दक ईन्हें रोगाणु रजहत न कर ददया गया हो ।

(ख) स्ट् थोरा (माल कागो) के ईन ऄविेषों का जनस्ट् सारण जजन्हें सामान् यत: ईपलजध ऄनलोक्डग जवजधयों का ईपयोग
करके पुनप्रागप्त नहीं दकया जा सकता है, जहां जनम्नजलजखत सभी ितें पूरी होती हैं, ऄथागत्:
(i) स्ट् थोरामाल (कारगो) के पानी में जनजहत स्ट् थोरा (माल कागो) के ऄविेषों में चौथी ऄनुसूची में
जनधागररत मानदंडों के ऄनुसार समुद्री पयागवरण के जलए हाजनकारक के रूप में वगीकृत कोइ भी पदाथग सजम्मजलत
नहीं है;
(ii) ऄंतरागष्ट्रीय समुद्री जीवन सुरिा ऄजभसमय (एसओएलएएस), 1974, यथासंिोजधत, के जवजनयमन
6/1-1.2 में पररभाजषत ठोस थोक मालकागो, ऄनाज के जसवाय, चौथी ऄनुसूची के ऄनुसार वगीकृत दकया
जाएगा, और प्रेषक द्वारा यह घोजषत दकया जाएगा दक वे समुद्री पयागवरण के जलए हाजनकारक हैं या नहीं;
(iii) होल्ड वॉक्िग वॉटर में जनजहत सफाइ सक्ीय पदाथग या योजक में कोइ भी ऐसा पदाथग सजम्मजलत
होगा जजसे संगठन द्वारा जवकजसत मागग दिगक जसद्धांत को ध्यान में रखते हुए समुद्री पयागवरण के जलए हाजनकारक
के रूप में वगीकृत दकया गया हो;
(iv) प्रस्ट्थान पत् तन और ऄगला गंतव्य पत् तन दोनों जविेष िेत्र के भीतर हैं और पोत ईन पत् तनों के बीच
जविेष िेत्र से बाहर पारगमन नहीं करेगा;
(v) संगठन द्वारा जवकजसत मागगदिगक जसद्धांतोंको ध्यान में रखते हुए ईन पत् तनों पर पयागप्त स्ट्वागत
सुजवधाएं ईपलजध नहीं हैं; और
(vi) जहां ईप-खंड (i) से (v) की ितें पूरी हो गइ हों, वहां ऄविेषों युि कागो होल्ड धुलाइ जल का
जनस्ट् सारण जनकटतम भूजम या जनकटतम जहम चट्टान से यथासंभव दूर और जनकटतम भूजम या जनकटतम जहम चट्टान
से बारह समुद्री मील से कम दूरी पर नहीं दकया जाएगा ।
(2) डेक और बाहरी सतहों की धुलाइ के पानी में जनजहत सफाइ सक्ीय पदाथग या योजक समुद्र में जनस्ट् साररत दकए जा सकते
हैं, परन् तु केवल तभी, जब संगठन द्वारा जारी मागगदिगक जसद्धांतों को ध्यान में रखते हुए ये पदाथग समुद्री पयागवरण के जलए
हाजनकारक न हों।
(3) ईप-पैरा1 के ईपबंधों के ऄजतररि, ऄंटाकगरटक िेत्र के संबंध में जनम्नजलजखत जनयम भी लागू होंगे, ऄथागत्: -
(क) प्रत्येक पि जजसके पत् तन से ऄंटाकगरटक िेत्र के जलए रवाना होने वाले या वहां से अने वाले जलयान प्रस्ट्थान करते हैं,
यह सुजनजश्चत करने का वचन देगा दक सभी जलयान से जनकलने वाले सभी ऄपजिष् ट को जबना दकसी ऄनावश्यक जवलंब के
और ईनका ईपयोग करने वाले जलयानों की ऄपेिाताओं के ऄनुसार यथासाध् य यथािीघ्र यथायोग् य सुजवधाएं प्रदान की
जाएंगी ।
(ख) प्रत्येक पि यह सुजनजश्चत करेगा दक ऄंटाकगरटक िेत्र में प्रवेि करने से पहले, ईसके ध्वज को फहराने के हकदार सभी
जलयान में िेत्र में संचालन के दौरान कूडा रखने के जलए पयागप्त िमता हो और िेत्र छोडने के पश् चात् ऐसा कूडा दकसी
स्ट्वागत सुजवधा में ईतारने की व्यवस्ट्था की गइ है ।
(4) जब कूडा ऄन्य पदाथों से जमजश्रत हो या ईनसे दूजषत हो, जजनका जनस्ट् सारण जनजषद्ध है या जजनके जनस्ट् सारण के जलए
जभन्न ऄपेिाऍं हैं, तो वाजणजज्यक पोत पररवहन ऄजधजनयम, 2025 (2025 का 24) के ऄधीन बनाए गए ऄन्य जनयमों के
ऄंतगगत ऄजधक कठोर ऄपेिाऍं लागू होंगी ।

3. जस्ट्थर या तैरते प् लेटफामग से ऄपजिष् ट जनकालने के जलए जविेष ऄपेिाऍं—(1) ईप-पैरा (2) के ईपबंधों के ऄधीन रहते
हुए, जस्ट्थर या तैरते प्लेटफामग से और ऄन्य सभी जलयान से, जब वे ऐसे प्लेटफामग के साथ या 500 मीटर के भीतर हों, तो
समुद्र में दकसी भी ऄपजिष् ट का जनस्ट् सारण जनजषद्ध है। ।
(2) जनकटतम भूजम से बारह समुद्री मील से ऄजधक दूरी पर जस्ट्थत जस्ट्थर या तैरते प्लेटफामग से और ऐसे प्लेटफामग
के जनकट या 500 मीटर के भीतर जस्ट्थत ऄन्य सभी जलयान से खाद्य ऄपजिष्ट को समुद्र में ऄपजिष्ट को कजमन्यूटर या
ग्राआंडर से होकर ही जनस्ट् साररत दकया जा सकेगा । आस प्रकार जपसे हुए खाद्य ऄपजिष्ट 25 जममी से ऄजधक बडे जछद्रों वाली
छलनी से जनकलने में सिम होने चाजहए ।
4. प् लेकाडग —12 मीटर या ईससे ऄजधक लंबाइ वाले प्रत्येक जलयान और जस्ट्थर या तैरते प् लेटफामग पर,सभी जलयान पर,
तीसरी ऄनूसूची में जवजनर्ददष् ट, यथालागू प्लेकाडग प्रदर्मित दकए जाएंगे, जो जलयान के कर्ममयों की कायग भाषा में और
ऄंतरागष्ट्रीय यात्राओं के जलए ऄंग्रेजी भाषा में भी होंगे, जो चालक दल और याजत्रयों को जनयम 4 और आस ऄनुसूची के पैरा1,
2 और 3 तथा पोलर कोड के भाग 2कके खंड 5.2 के कूडाजनस्ट् सारणऄपेिाओं के संबंध में सूजचत करेंगे।
5. कूडा प्रबंध योजना (जीएमपी)— (1) 100 सकल टन और ईससे ऄजधक के प्रत्येक जलयान, और पंद्रह या ऄजधक
व्यजियों को ले जाने के जलए प्रमाजणत प्रत्येक जलयान, और जस्ट्थर या तैरते प् लेटफामग को तीसरी ऄनुसूची में जवजनर्ददष्ट कूडा
प्रबंध योजना रखेंगे, जजसका चालक दल पालन करेगा।
(2) आस योजना में कूडे को कम करने, आकट्ठा करने, भंडारण करने, प्रसंस्ट्करण करने और जनपटान करने के जलए
जलजखत प्रदक्याओं का ईपबंध दकया जाएगा, जजसके ऄंतगगत जलयान पर ईपस्ट् कर का ईपयोग भी है । आसमें योजना को
दक्याजन्वत करने के प्रभारी व्यजि या व्यजियों को भी नाजमत दकया जाएगा।
(3) ऐसी योजना संगठन द्वारा जारी मागगदिगक जसद्धांतो पर अधाररत होगी और जलयान-जवजिष्ट, समझने में
असान और जलयान की कायग भाषा में लेखबद्ध की जाएगी ।
6. कूडा ऄजभलेख पुजस्ट्तका (जीअरबी) और ऄजभलेख-रखरखाव— (1) 100 ग्रॉस के प्रत्येक टन भार और ईससे ऄजधक
वाले प्रत्येक जलयान, जो पंद्रह या ईससे ऄजधक व्यजियों को ले जाने के जलए प्रमाजणत है और ऄजभसमय के दकसी ऄन्य पि
के ऄजधकार िेत्र में अने वाले पत् तन या ऄपतटीय टर्ममनलों की यात्राओं में संलग्न है, तथा प्रत्येक जस्ट्थर या तैरते हुए
प्लेटफॉमग पर एक कूडा ऄजभलेख पुजस्ट्तका (गाबेज ऄजभलेख बुक) ईपलजध कराइ जाएगी। यह कूडा ऄजभलेख पुजस्ट्तका, चाहे
पोत की अजधकाररक लॉगबुक का जहस्ट्सा हो या महाजनदेिक द्वारा संगठन द्वारा जारी मागगदिगक जसद्धांतों को ध्यान में रखते
हुए ऄनुमोददत आलेक्ट्रॉजनक ऄजभलेख पुजस्ट्तका, जद्वतीय ऄनुसूची में जवजनर्ददष्ट प्ररूप में होगी ।
(2) समुद्र में या दकसी संग्रहण केंद्र में प्रत्येक जनस्ट् सारण या पूणग भस्ट्मीकरण को कूडा ऄजभलेख पुजस्ट्तका में तुरंत दजग
दकया जाएगा और जनस्ट् सारण या भस्ट्मीकरण की तारीख पर प्रभारी ऄजधकारी द्वारा हस्ट्तािर दकए जाएंगे। कूडा ऄजभलेख
पुजस्ट्तका के प्रत्येक पूणग पृष्ठ या आलेक्ट्रॉजनक प्रजवजष्टयों के समूह पर जलयान के कप् तान द्वारा हस्ट्तािर दकए जाएंगे। कूडा
ऄजभलेख पुजस्ट्तका में प्रजवजष्टयाँ जलयान की कायगकारी भाषा और, यदद ऄपेजित हो, तो ऄंग्रेजी में होंगी ।
(3) आस ऄनुसूची के पैरा1 से 3 या ध्रुवीय संजहता के भाग 2क के ऄध्याय 5 के खंड 5.2 के ऄंतगगत समुद्र में दकए
गए प्रत्येक जनस्ट् सारण के जलए प्रजवजष्ट में तारीख और समय, जलयान की जस्ट्थजत (ऄिांि और देिांतर), कचरे की श्रेणी और
जनस्ट् सारण की गइ ऄनुमाजनत मात्रा (घन मीटर में) सजम्मजलत होगी। माल ऄविेषों के जनस्ट् सारण के जलए, ईपरोि के
ऄजतररि जनस्ट् सारण प्रारंभ और समाजप्त स्ट्थानों को भी दजग दकया जाएगा।।

(4) प्रत्येक पूणग भस्ट्मीकरण के जलए प्रजवजष्ट में भस्ट्मीकरण के प्रारंभ और समाजप्त पर जलयान की तारीख और
समय तथा जस्ट्थजत (ऄिांि और देिांतर), भस्ट्मीकृत कूडा की श्रेणी और प्रत्येक श्रेणी के जलए घन मीटर में भस्ट्मीकृत
ऄनुमाजनत मात्रा सजम्मजलत होगी।
(5) पत् तन स्ट् वागत सुजवधा या दकसी ऄन्य जलयान में प्रत्येक जनस्ट् सारण के जलए प्रजवजष्ट में जनस्ट् सारण की तारीख
और समय, पत् तन या सुजवधा या जलयान का नाम, जनस्ट् सारण दकए गए कूडे की श्रेणी और प्रत्येक श्रेणी के जलए ऄनुमाजनत
जनस्ट् सारण मात्रा घन मीटर में सजम्मजलत होंगी ।
(6) कूडा ऄजभलेख पुजस्ट्तका, जजसमें संग्रहण सुजवधाओं से प्राप्त रसीदें भी सजम्मजलत हों, जलयान या जस्ट्थर या
तैरते हुए प्लेटफामग पर रखी जाएगी और ऐसे स्ट्थान पर रखी जाएगी जहाँ युजियुक्ट् त समय पर जनरीिण के जलए वह
असानी से ईपलजध हो सके। आस दस्ट्तावेज़ को आसमें ऄंजतम प्रजवजष्ट की तारीख से कम से कम दो वषग की ऄवजध तक
संरजित रखा जाएगा।
(7) जनयम 5 में जनर्ददष्ट दकसी भी जनस्ट् सारण या अकजस्ट्मक हाजन की जस्ट्थजत में, कूडा ऄजभलेख पुजस्ट्तका में प्रजवजष्ट
की जाएगी, या 100 सकल टन से कम भार वाले दकसी भी जलयान की दिा में, घटना की तारीख और समय, घटना के
समय पोत का पत् तन या जस्ट्थजत (ऄिांि, देिांतर और जल की गहराइ, यदद ज्ञात हो), जनस्ट् सारण या हाजन का कारण,
जनस्ट् सारण या हाजन हुइ वस्ट्तुओं के जयौरे, जनस्ट् सारण या हाजन हुए कूडे की श्रेणी, प्रत्येक श्रेणी के जलए घन मीटर में
ऄनुमाजनत मात्रा का ज यौरे,ऐसे जनस्ट् सारण या अकजस्ट्मक नुकसान को रोकने या कम करने के जलए बरती गइ युजियुक्ट् त
तत् परता और सामान्य रटप्पजणयां जलयान की अजधकाररक लॉगबुक में दजग दकया जाएगा।
(8) महाजनदेिक कूडा ऄजभलेख पुजस्ट्तकाओं की ऄपेिाओं को त् याग सकता हैं
(क) एक घंटे या ईससे कम ऄवजध की यात्राओं में लगा कोइ भी जलयान जो पंद्रह या ऄजधक व्यजियों को
ले जाने के जलए प्रमाजणत हो; या
(ख) जस्ट्थर या तैरते हुए प्लेटफामग।
(9) सवेिक या कोइ प्राजधकृत व्यजि, आन जनयमों के ऄंतगगत अने वाले दकसी भी जलयान पर, भारत के पत् तन
या ऄपतटीय टर्ममनलों में रहते हुए, जलयान के कूडा ऄजभलेख पुजस्ट्तका या अजधकाररक लॉगबुक का जनरीिण कर सकता है
और ईन पुस्ट्तकों में दजग दकसी भी प्रजवजष्ट की प्रजतजलजप बना सकता है, और जलयान के स्ट् वामी यह प्रमाजणत करना ऄपेजित
होगा है दक प्रजतजलजप ऐसी प्रजवजष्ट की सही प्रजतजलजप है। आस प्रकार बनाइ गइ कोइ भी प्रजतजलजप, जजसे जलयान के स्ट् वामी
द्वारा जलयान के कूडा ऄजभलेख पुजस्ट्तका या अजधकाररक लॉगबुक में दजग प्रजवजष्ट की सही प्रजतजलजप के रूप में प्रमाजणत
दकया गया हो, दकसी भी न्याजयक कायगवाही में प्रजवजष्ट में वर्मणत त्यों के साक्ष्य के रूप में स्ट्वीकायग होगी। आस पैरा के
ऄधीन सवेिक या दकसी प्राजधकृत व्यजि द्वारा जलयान के कूडा ऄजभलेख पुजस्ट्तका या अजधकाररक लॉगबुक का जनरीिण

7. ऄजधसूचनाएं और ररपोटें- जनयम 5 के ईप-जनयम (1) के खंड (ग) और (घ) में यथाजनर्ददष्ट मत् स्ट् य के ईपकरणों की
अकजस्ट्मक हाजन या जनस्ट्सारण , जजससे नौवहन में बाधा ईत्पन्न हो या समुद्री पयागवरण को खतरा हो, की सूचना छठी
ऄनुसूची में जवजनर्ददष्ट प्ररूप में ईस देि के प्रिासन को जबना जवलंब के दी जाएगी जजसका ध्वज को फहराने का वह जलयान
हकदार है। यदद ऐसी हाजन या जनस्ट्सारण दकसी तटीय राज्य के ऄजधकार िेत्र में अने वाले जलिेत्र में होता है, तो आसकी
सूचना जनकटतम तटीय राज्य प्राजधकरण को भी दी जाएगी। आस ऄनुच्छेद के ऄधीन ररपोर्टटग की सुजवधा आलेक्ट्रॉजनक
माध्यम से दी जाएगी ।

1. प्रस्ट् तावना:
ऄंतरागष्ट्रीय जहाज प्रदूषण जनवारण ऄजभसमय, 1973, जजसे 1978 के प्रोटोकॉल (MARPOL 73/78) द्वारा संिोजधत
दकया गया है, के ईपाबंध 5 के जनयम 10 के ऄनुसार, प्रत्येक जनस्ट्सारण संचालन या पूणग भस्ट्मीकरण का ऄजभलेजखत दकया
जाएगा । आसमें समुद्र में, स्ट्वागत सुजवधाओं में, या ऄन्य जलयानों में दकए गए जनस्ट् सारण के साथ-साथ कूडे का अकजस्ट्मक
नुकसान भी सजम्मजलत है।
2. कूडा और कूडा प्रबंधन:
कूडे से सभी प्रकार के खाद्य ऄपजिष्ट, घरेलू ऄपजिष्ट और पररचालन ऄपजिष्ट, सभी प्लाजस्ट्टक, माल के ऄविेष, भस्ट्मीकरण
की राख, खाना पकाने का तेल, मछली पकडने का सामान और पिु िव जो पोत के सामान्य संचालन के दौरान ईत्पन्न होते
हैं और जजनका जनरंतर या अवजधक रूप से जनपटान दकया जाना अवश्यक है,ऄजभप्रेत है ।ईन पदाथों के जसवाय जो
ऄजभसमय के ऄन्य ईपाबंध में पररभाजषत या सूचीबद्ध हैं। कूडे के ऄंतगगत में यात्रा के दौरान की गइ मत् स्ट् य गजतजवजधयों के
पररणामस्ट्वरूप ईत्पन्न ताजी मछली और ईसके भाग, या जलीय कृजष गजतजवजधयों के पररणामस्ट्वरूप ईत्पन्न मछली (िंख
सजहत) सजम्मजलत नहीं हैं, जजनमें जलीय कृजष सुजवधा में रखने के जलए मछली का पररवहन और ऐसी सुजवधाओं से
प्रसंस्ट्करण के जलए तट तक काटी गइ मछली (िंख सजहत) का पररवहन सजम्मजलत है। सुसंगत जानकारी के जलए
MARPOL 73/78 के ईपाबंध V के कायागन्वयन के जलए मागग दिगक जसद्धांतों का संदभग भी जलया जा सकता है, जैसा दक
संकल् पों द्वारा संिोजधत दकया गया है।
3. कूडे का जववरण:
कूडा ऄजभलेख पुजस्ट्तका (या पोत की अजधकाररक लॉगबुक) भाग 1और 2में ऄजभलेख के ईद्देश्य से कूडे को जनम् नजलजखत
श्रेजणयों में वगीकृत दकया गया है।

4. कूडाऄजभलेख पुजस्ट्तका में दजग प्रजवजष्टयाँ:
1) कूडा ऄजभलेख पुजस्ट्तका में जनम्नजलजखत प्रत्येक ऄवसर पर प्रजवजष्टयाँ की जाएंगी:
(क) जब कूडा-कूडा तट पर जस्ट्थत संग्रहण सुजवधाओं या ऄन्य पोतों में जनस्ट्साररत दकया जाता है:
(i) जनस्ट्सारण की तारीख और समय;
(ii) पत् तन या सुजवधा, या पोत का नाम;
(iii) ईत्सर्मजत कूडे की श्रेजणयाँ;
(iv) प्रत्येक श्रेणी के जलए घन मीटर में ऄनुमाजनत जनस्ट् सारण पररमाण;
(v) संचालन के प्रभारी ऄजधकारी के हस्ट्तािर।

(ख) जब कूडा जाता है:
(i) भस्ट्मीकरण के प्रारंभ और समाजप्त की तारीख और समय;
(ii) भस्ट्मीकरण के प्रारंभ और समाजप्त के समय जलयान का कजज़ा (ऄिांि और देिांतर);
(iii) भस्ट् म होने वाले कूडे की श्रेजणयाँ;
(iv) घन मीटर में भस्ट् मक की ऄनुमाजनत मात्रा;
पोत के स्ट् वामी द्वारा संग्रहण सुजवधाओं के संचालक से, जजनमें बजरा और रक सजम्मजलत हैं, ऄंतररत दकए गए कूडे की
ऄनुमाजनत मात्रा को स्ट् पष् ट करने वाली प्राजप्त या प्रमाण पत्र प्राप्त दकया जाएगा। प्राजप्त या प्रमाण पत्र को कूडा ऄजभलेख
पुजस्ट्तका के साथ सुरजित रखाजाएगा।
(v) ऄजभयान के प्रभारी ऄजधकारी के हस्ट्तािर ।
(ग) मारपोल के ईपाबंध 5 के जवजनयम 4, 5, या 6 ऄथवा पोलर कोड के भाग 2 क के ऄध्याय 5 के ऄनुसार समुद्र में कूडा
ईत्सर्मजत दकया जाता है:
(i) छुट्टी की तारीख और समय;
(ii) पोत की जस्ट्थजत (ऄिांि और देिांतर)। नोट: कागो ऄविेषों के जनवगहन के जलए, जनवगहन प्रारंभ और समाजप्त
स्ट्थानों को िाजमल करें;
(iii) ईत्सर्मजत कचरे की श्रेणी;
(iv) प्रत्येक श्रेणी के जलए घन मीटर में ऄनुमाजनत जनवगहन मात्रा;
(v) ऄजभयान के प्रभारी ऄजधकारी के हस्ट्तािर।
(घ) समुद्र में कचरे का अकजस्ट्मक या ऄन्य ऄसाधारण जनवगहन या हाजन, जजसमें मारपोल के ईपाबंध 5 के जवजनयमन 7 के
ऄनुसार भी िाजमल है:
(i) घटना की तारीख और समय;
(ii) घटना घरटत होने के समय पोत का बंदरगाह या स्ट्थान;
(iii) ईत्सर्मजत या नष्ट हुए कचरे की श्रेजणयाँ;
(iv) घन मीटर में प्रत्येक श्रेणी के जलए ऄनुमाजनत मात्रा;
(v) ईत्सर्मजत या नष्ट और साधारण रटप्पणी के जलए कारण
(2) कचरे की राजि:
यदद संभव हो तो श्रेणी के ऄनुसार बोडग पर कचरे की मात्रा का घन मीटर में ऄलग से ऄनुमान लगाया जाना चाजहए। कूडा
ऄजभलेख बुक में कचरे की ऄनुमाजनत मात्रा के कइ संदभग हैं। यह माना जाता है दक कचरे की मात्रा का ऄनुमान लगाने की

सटीकता जनवगचन पर छोड दी गइ है। प्रसंस्ट्करण से पहले और बाद में मात्रा ऄनुमान ऄलग-ऄलग होंगे। कुछ प्रसंस्ट्करण
प्रदक्याएं मात्रा के ईपयोग योग्य ऄनुमान की ऄनुमजत नहीं दे सकती हैं, ईदाहरण के जलए, खाद्य ऄपजिष्ट का जनरंतर
प्रसंस्ट्करण। ऄजभलेख में की गइ प्रजवजष्टयों को बनाते और जनवगचन करते समय ऐसे कारकों को ध्यान में रखा जाना चाजहए ।

1. मॉडल प्लेकाडग (संकेतात्मक पाठ)। —
(1) क्ू और पोतबोडग के संचालन को लजित करने वाला नमूना प्लेकाडग
ऄन्यथा जवजहत ईपबंधों के जसवाय समुद्र में सभी कचरे का जनस्ट्सारण प्रजतजषद्ध है
मारपोल ऄजभसमय और ऄन्तदेिीय जवजध जलयानों से ऄजधकांि कचरे के जनस्ट्सारण को प्रजतबंजधत करते हैं। केवल
जनम्नजलजखत कूडा प्रकारों को जनर्ददष्ट ितों के ऄन्तगगत जनस्ट्सारण करने की ऄनुमजत है।
मारपोल ईपाबंध 5 और अकगरटक जल के ऄन्तगगत जवजनर्ददष्ट जविेष िेत्रों के बाहर:
कटे हुए या जपसे हुए खाद्य ऄपजिष्ट (25 जममी से कम खुले वाले स्ट्क्ीन से गुजरने में सिम) को जनकटतम
भूजम से 3 एनएम से कम नहीं जनस्ट्सारण दकया जा सकता है।
ऄन्य खाद्य ऄपजिष्ट जनकटतम भूजम से 12 एनएम से कम नहीं ईत्सर्मजत दकए जा सकते हैं।
समुद्री पयागवरण के जलए हाजनकारक नहीं के रूप में वगीकृत कागो ऄवजिष्टों को जनकटतम भूजम से 12
एनएम से कम नहीं जनस्ट्सारण दकया जा सकता है।
कागो होल्ड, डेक और बाहरी सतहों की सफाइ के जलए पानी में जमलाए जाने वाले ऄजभकताग या योजक
तभी ईत्सर्मजत दकए जा सकते हैं जब वे समुद्री पयागवरण के जलए हाजनकारक न हों।
समुद्री पयागवरण के जलए हाजनकारक नहीं होने वाले और धोए गए पानी में जनजहत सफाइ ऄजभकतागओ या
योजकों को छोडकर, जलयान को मागग पर और यथासंभव जनकटतम भूजम से दूर होना चाजहए ।
मारपोल ईपाबंध 5 और अकगरटक जल के ऄन्तगगत जनर्ददष्ट जविेष िेत्रों के भीतर:
खाद्य ऄपजिष्ट और कागो ऄवजिष्टों के जनस्ट्सारण के जलए ऄजधक कठोर जनस्ट्सारण ऄपेिाएं लागू होती हैं;
और
ऄजधक जानकारी के जलए पोलर कोड के भाग-2 क के ऄध्याय 5 के मारपोल ईपाबंध 5 और पोतबोडग पर
जवद्यमान कूडा प्रबंधन योजना से परामिग करें ।
समुद्र के सभी िेत्रों के जलए, जीजवत जानवरों या ठोस बल्क कागो जैसे जविेष कागो ले जाने वाले जलयानों को ईपाबंध 5
और ईपाबंध 6 के कायागन्वयन के जलए संबंजधत ददिाजनदेिों से परामिग करना चाजहए।
दकसी भी प्रकार के कचरे का जनस्ट्सारण कूडा ऄजभलेख बुक में दजग दकया जाना चाजहए।
आन ऄपेिाओं का ईल्लंघन करने पर दंड हो सकता है।
(2) ऐसे प्लेटफॉमों के 500 मीटर के भीतर काम करने वाले जनजश्चत या तैरते प्लेटफॉमग और जलयानों को लजित करने
वाला नमूना प्लेकाडग
ऄन्यथा प्रदान दकए जाने के ऄलावा समुद्र में सभी कचरे का जनस्ट्सारण प्रजतजषद्ध है
मारपोल ऄजभसमय और ऄन्तदेिीय जवजध सभी कचरे को समुद्र में जनजश्चत या तैरते प्लेटफामों से और ऐसे प्लेटफामों के
दकनारे या 500 मीटर के भीतर से सभी ऄन्य जलयानों से जनस्ट्सारण करने पर रोक लगाते हैं।

ऄपवाद: कटे हुए या जपसे हुए खाद्य ऄपजिष्टों को जनकटतम भूजम से 12 समुद्री मील से ऄजधक दूरी पर जस्ट्थत जनजश्चत या
तैरते प्लेटफामों से और सभी ऄन्य जलयानों से ऐसे प्लेटफामों के दकनारे या 500 मीटर के भीतर जनस्ट्सारण जा सकता है।
जपसे हुए या जपसे हुए खाद्य ऄपजिष्ट 25 जमलीमीटर से कम वाले स्ट्क्ीन से गुजरने में सिम होने चाजहए।
दकसी भी प्रकार के कचरे का जनस्ट्सारण कूडा ऄजभलेख बुक में दजग दकया जाना चाजहए।
आन ऄपेिाओं का ईल्लंघन करने पर िाजस्ट्त प्रदान की जा सकती है।
(3) याजत्रयों को लजित करने वाला नमूना प्लेकाडग
ऄन्यथा प्रदान दकए जाने के ऄलावा समुद्र में सभी कचरे का जनस्ट्सारण प्रजतजषद्ध है
मारपोल ऄजभसमय और ऄन्तदेिीय जवजध जलयानों से समुद्र में ऄजधकांि प्रकार के कचरे के जनस्ट्सारण को प्रजतबंजधत करते
हैं।
आन ऄपेिाओं का ईल्लंघन करने पर दंड ददया जा सकता है।
सभी कचरे को जहाज पर ही रखा जाना चाजहए और प्रदान दकए गए जडजबे में रखा जाना चाजहए।
2. कूडा प्रबंधन योजना की न्यूनतम सामग्री। —
(1) पोत का जववरण, संगठन और ईत्तरदायी व्यजि।
(2) कूडा पृथक्करण योजना और जनर्ददष्ट संग्रह क्बदु।
(3) प्रसंस्ट्करण और भंडारण: संघनन, जवखंडन, पीसना, भस्ट्मीकरण (कोइ प्लाजस्ट्टक नहीं), कंटेनर और लेबक्लग।
(4) श्रेणी और समुद्री िेत्र द्वारा जनस्ट्सारण /जनपटान प्रदक्याएं।
(5) ररसेप्िन सुजवधाओं में जवतरण और ऄजभलेख

आस ऄनुसूची के प्रयोजन के जलए, कागो ऄवजिष्टों को समुद्री पयागवरण (एचएमइ) के जलए हाजनकारक माना जाता है यदद वे
ठोस बल्क कागो के ऄवजिष्ट हैं, जजन्हें संयुि राष्ट्र के जवश्व स्ट्तर पर सामंजस्ट्यपूणग वगीकरण और लेबक्लग प्रणाली
(जीएचएस) के मानदंडों के ऄनुसार वगीकृत दकया गया है, जो जनम्नजलजखत मापदंडों को पूरा करता है
1. एक्ट्युट एक्वारटक टॉजक्ट्सजसटी श्रेणी 1; और / या
2. क्ोजनक एक्वारटक टॉजक्ट्सजसटी श्रेणी 1 या 2; और / या

G.S.R. 378(E).— In exercise of the powers conferred by sub-section (1) and clauses (d) and (i) of sub-
section (2) of section 143 read with sub-section (4) of section 133, sub-section (2) of section 135 read with section
136 and sub-section (1) of section 142 of the Merchant Shipping Act, 2025 (24 of 2025), and in supersession of the
Merchant Shipping (Prevention of Pollution by Garbage from Ships) Rules, 2009, except as respects things done or
omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: –
1. Short title and commencement. — (1) These rules may be called the Merchant Shipping (Prevention of
Pollution by Garbage from Vessels) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. — (1) In these rules, unless the context otherwise requires, —
(a) ―Act‖ means the Merchant Shipping Act, 2025 (24 of 2025);
(b) ―administration‖ means the Director-General for Indian vessels and with respect to a vessel entitled to fly a
flag of another State means the Government of that State;
(c) ―animal carcasses‖ means the bodies of any animals that are carried on board as cargo and that die or are
euthanised during the voyage;
(d) ―Annex‖ means Annex V to the International Convention for the Prevention of Pollution from Ships, 1973, as
modified by the Protocol of 1978 (MARPOL), as amended from time to time;
(e) ―cargo residues‖ means the remnants of any cargo which are not covered by other rules made under the
Merchant Shipping Act, 2025 (24 of 2025) in relation of pollution prevention and which remain on the deck or
in holds following loading or unloading, including loading and unloading excess or spillage, whether in wet or
dry condition or entrained in wash water but does not include cargo dust remaining on the deck after sweeping
or dust on the external surfaces of the vessel;
(f) ―convention‖ means the International Convention for the Prevention of Pollution from Ships, 1973 including
its Protocol of 1978, as amended from time to time;
(g) ―cooking oil‖ means any type of edible oil or animal fat used or intended to be used for the preparation or
cooking of food, but does not include the food itself that is prepared using these oils;

(h) ―domestic wastes‖ means all categories of waste generated within the accommodation spaces of a vessel which
are not regulated under any other rules made under the Merchant Shipping Act, 2025 (24 of 2025) in relating
to pollution prevention, and shall not include grey water;
(i) ―electronic record book‖ means a device or system, approved by the administration, used to electronically
record the required entries for discharges, transfers and other operations as required under the Annex in lieu of
a hard copy record book;
(j) ―en route‖ means that the vessel is underway at sea on a course or courses, including deviation from the
shortest direct route, which as far as practicable for navigational purposes, will cause any discharge to be
spread over as great an area of the sea as is reasonable and practicable;
(k) ―e-waste‖ means electrical and electronic equipment used for the normal operation of the vessel or in the
accommodation spaces, including all components, sub-assemblies and consumables, which are part of the
equipment at the time of discarding, with the presence of material potentially hazardous to human health or to
the environment;
(l) ―fishing gear‖ means any physical device or part thereof or combination of items that may be placed on or in
the water or on the sea-bed with the intended purpose of capturing, or controlling for subsequent capture or
harvesting, marine or fresh water organisms;
(m) ―fixed or floating platforms‖ means fixed or floating structures located at sea which are engaged in the
exploration, exploitation or associated offshore processing of sea-bed mineral resources;
(n) ―food wastes‖ means any spoiled or unspoiled food substances and includes fruits, vegetables, dairy products,
poultry, meat products and food scraps generated aboard vessel;
(o) ―garbage‖ means all kinds of food wastes, domestic wastes and operational wastes, all plastics, cargo residues,
incinerator ashes, cooking oil, fishing gear, and animal carcasses generated during the normal operation of the
vessel and liable to be disposed of continuously or periodically except those substances which are defined or
listed in other rules made under the Merchant Shipping Act, 2025 (24 of 2025) relating to pollution
prevention:
Provided that garbage does not include fresh fish and parts thereof generated as a result of fishing
activities undertaken during the voyage, or as a result of aquaculture activities which involve the transport of
fish including shellfish for placement in the aquaculture facility and the transport of harvested fish including
shellfish from such facilities to shore for processing;
(p) ―HME‖ (harmful to the marine environment) in relation to solid bulk cargoes has the meaning and criteria set
out in the Fourth Schedule;
(q) ―incinerator ashes‖ means ash and clinkers resulting from shipboard incinerators used for the incineration of
garbage;
(r) ―nearest land‖ shall have the same meaning as assigned in the Annex, including the special baseline off the
north-eastern coast of Australia;
(s) ―operational wastes‖ means all solid wastes (including slurries) not covered by other rules made under the
Merchant Shipping Act, 2025 (24 of 2025) relating to pollution prevention that are collected on board during
normal maintenance or operations of a vessel, or used for cargo stowage and handling and it includes cleaning
agents and additives contained in cargo hold and external wash water:
Provided that operational wastes do not include grey water, bilge water, or other similar discharges essential to
the operation of a vessel, taking into account the guidelines developed by the International Maritime
Organization;
(t) ―Organisation‖ means the International Maritime Organization;
(u) ―plastic‖ means a solid material which contains as an essential ingredient one or more high molecular mass
polymers and which is formed (shaped) during either manufacture of the polymer or the fabrication into a

finished product by heat and/or pressure, having material properties ranging from hard and brittle to soft and
elastic and includes all garbage that consists of or includes plastic in any form, including synthetic ropes,
synthetic fishing nets, plastic garbage bags, microplastics, plastic pellets and incinerator ashes from plastic
products;
(v) ―Polar Code‖ means the International Code for vessels operating in polar waters, consisting of an introduction,
Part I-A and Part II-A and Parts I-B and II-B, as adopted by resolutions MSC.385(94) and MEPC.264(68), as
may be amended:
Provided that:
(i) amendments to the environment-related provisions of the introduction and Chapter 5 of Part II-A of the
Polar Code are adopted, brought into force and take effect in accordance with the provisions of Article
16 of the Convention concerning the amendment procedures applicable to an appendix to an annex; and
(ii) amendments to Part II-B of the Polar Code are adopted by the Marine Environment Protection
Committee in accordance with its Rules of Procedure;
(w) ―Polar waters‖ means Arctic waters and/or the Antarctic area.
Explanation: For the purpose of this clause, Arctic waters means those waters which are located north of a
line from the latitude 58º00΄.0 N and longitude 042º00΄.0 W to latitude 64º37΄.0 N, longitude 035º27΄.0 W and
thence by a rhumb line to latitude 67º03΄.9 N, longitude 026º33΄.4 W and thence by a rhumb line to the
latitude 70º49΄.56 N and longitude 008º59΄.61 W (Sørkapp, Jan Mayen) and by the southern shore of Jan
Mayen to 73º31'.6 N and 019º01'.0 E by the Island of Bjørnøya, and thence by a great circle line to the latitude
68º38΄.29 N and longitude 043º23΄.08 E (Cap Kanin Nos) and hence by the northern shore of the Asian
Continent eastward to the Bering Strait and thence from the Bering Strait westward to latitude 60º N as far as
Il'pyrskiy and following the 60th North parallel eastward as far as and including Etolin Strait and thence by the
northern shore of the North American continent as far south as latitude 60º N and thence eastward along
parallel of latitude 60º N, to longitude 056º37΄.1 W and thence to the latitude 58º00΄.0 N, longitude 042º00΄.0
W;
(x) ―Schedule‖ means the Schedules annexed to these rules containing the requirements of Annex V of the
International Convention for the Prevention of Pollution from Ships, 1973, including its Protocol of 1978, as
amended from time to time;
(y) ―special area‖ means a sea area where for recognised technical reasons in relation to its oceanographic and
ecological condition and to the particular character of its traffic the adoption of special mandatory methods for
the prevention of sea pollution by garbage is required and the special areas are the Mediterranean Sea area, the
Baltic Sea area, the Black Sea area, the Red Sea area, the Gulfs area, the North Sea area, the Antarctic area and
the Wider Caribbean Region, which are defined as follows:
(i) the Mediterranean Sea area means the Mediterranean Sea proper including the gulfs and seas therein
with the boundary between the Mediterranean and the Black Sea constituted by the 41º N parallel and
bounded to the west by the Straits of Gibraltar at the meridian 5°36΄ W;
(ii) the Baltic Sea area means the Baltic Sea proper with the Gulf of Bothnia and the Gulf of Finland and the
entrance to the Baltic Sea bounded by the parallel of the Skaw in the Skagerrak at 57º 44.8΄ N;
(iii) the Black Sea area means the Black Sea proper with the boundary between the Mediterranean and the
Black Sea constituted by the parallel 41º N;

(iv) the Red Sea area means the Red Sea proper including the Gulfs of Suez and Aqaba bounded at the south
by the rhumb line between Ras si Ane (12º 28.5΄ N, 43º 19.6΄ E) and Husn Murad (12º 40.4΄ N, 43º
30.2΄ E);
(v) the Gulfs area means the sea area located north-west of the rhumb line between Ras al Hadd (22º 30΄ N,
59º 48΄ E) and Ras al Fasteh (25º 04΄ N, 61º 25΄ E);
(vi) the North Sea area means the North Sea proper including seas therein with the boundary between the
North Sea southwards of latitude 62º N and eastwards of longitude 4º W, the Skagerrak, the southern
limit of which is determined east of the Skaw by latitude 57º 44.8΄ N and the English Channel and its
approaches eastwards of longitude 5º W and northwards of latitude 48º 30΄ N;
(vii) the Antarctic area means the sea area south of latitude 60º S;
(viii) the wider Caribbean Region means the Gulf of Mexico and Caribbean Sea proper including the bays and
seas therein and that portion of the Atlantic Ocean within the boundary constituted by the 30° N parallel
from Florida eastward to 77°30΄ W meridian, thence a rhumb line to the intersection of 20° N parallel
and 59° W meridian, thence a rhumb line to the intersection of 7°20' N parallel and 50° W meridian,
thence a rhumb line drawn southwesterly to the eastern boundary of French Guiana
(2)
Words and expressions used in these rules and not defined but defined in the Act shall have the meanings
respectively assigned to them in the Act.
3. Application. — (1) Unless expressly provided otherwise, the provisions of these rules shall apply in accordance
with sections 131 and 132 of the Act to all vessels and ports.
(2)
The vessels and ports to which these rules apply shall comply with the requirements given in the Schedule to
these rules.
4. General prohibition on discharge of garbage into the sea. — (1) Discharge of all garbage and e-waste into the sea is
prohibited, except as provided otherwise in paragraphs 1 to 3 of the First Schedule and rule 5 and section 5.2 of Part
II-A of the Polar Code.
(2)
Except as provided in rule 5 of these rules, discharge into the sea of all plastics, including synthetic ropes,
synthetic fishing nets, plastic garbage bags, microplastics, plastic pellets and incinerator ashes from plastic products is
prohibited.
5. Exceptions. — (1) The provisions of rule 4 and paragraphs 1 to 3 of the First Schedule and section 5.2 of Chapter
5 of Part II-A of the Polar Code shall not apply to —
(a) the discharge of garbage from a vessel necessary for the purpose of securing the safety of a vessel and those on
board or saving life at sea; or
(b) the accidental loss of garbage resulting from damage to a vessel or its equipment, provided that all reasonable
precautions have been taken before and after the occurrence of the damage, to prevent or minimise the accidental
loss; or
(c) the accidental loss of fishing gear from a vessel provided that all reasonable precautions have been taken to
prevent such loss; or
(d) the discharge of fishing gear from a vessel for the protection of the marine environment or for the safety of that
vessel or its crew.

(2)
The en route requirements of paragraphs 1 and 2 of the First Schedule and chapter 5 of Part II-A of the Polar
Code shall not apply to the discharge of food wastes where it is clear the retention on board of these food wastes
presents an imminent health risk to the people on board.
6. Polar waters. — (1) The vessels to which these rules apply while operating in polar waters shall comply with the
environment-related provisions of the introduction and with Chapter 5 of part II-A of the Polar Code, in addition to
any other applicable requirements of these rules.
(2)
In applying Chapter 5 of Part II-A of the Polar Code, consideration shall be given to the additional guidance
in Part II-B of the Polar Code.
7. Adequacy of reception facilities. — (1) Every port and terminal in India shall ensure the provision of adequate
facilities for the reception of garbage without causing undue delay to vessels, in accordance with sub-section (1) of
section 142 of the Act.
(2) The Director-General shall notify the Organisation, for transmission to the contracting governments concerned, of
all cases where the facilities to be provided under the Annex are alleged to be inadequate.
(3) The fees payable by ports and terminals to the Director-General for audit or inspection of reception facilities and
scrutiny, approval and periodic review of the Port Waste Management Plan (PWMP) shall be Rs. 40,000/-.
8. Control on operational requirements. — (1) Every vessel when in a port or an offshore terminal in India is
subject to inspection by surveyor or an authorised person concerning operational requirements under these rules,
where there are clear grounds for believing that the master or crew are not familiar with essential shipboard
procedures relating to the prevention of pollution by garbage.
(2) In the circumstances specified in sub-rule (1), the surveyor or authorised person shall take such steps to ensure
that the vessel shall not sail until the situation has been brought to order in accordance with the requirements of
these rules.
(3) Nothing in this rule shall be construed to limit the rights and obligations of the Central Government carrying out
control over operational requirements specifically provided for in the Act or rules made thereunder or
Convention.
9. Penalty. — (1) Any contravention of these rules or failure to comply with any requirement thereof shall be liable
to penalties as specified in the Act.
(2) Any person who operates any vessel in contravention of the provisions of these rules, and for which no specific
penalty is provided under sub-section (2) of section 281 of the Act, shall be liable to penalty which may extend to
Rs. 50,000, and if the breach is a continuing one, with further penalty which may extend to Rs. 5,000 for every
day after the first day during which the breach continues.
(3) The imposition of any penalty under this rule shall not absolve the owner or master from the requirement of
rectifying the non-compliance.

FIRST SCHEDULE

Prevention of Pollution by Garbage (Annex V, Regs. 3–6)
1.
Discharge of garbage outside special areas. — (1) Discharge of the following garbage into the sea outside
special areas shall only be permitted while the vessel is en route and as far as practicable from the nearest land, but in
any case, not less than, —
(a) three nautical miles from the nearest land for food wastes which have been passed through a comminuter or
grinder. Such comminuted or ground food wastes shall be capable of passing through a screen with openings no
greater than 25 mm;
(b) twelve nautical miles from the nearest land for food wastes that have not been treated in accordance with clause
(a);
(c) twelve nautical miles from the nearest land for cargo residues that cannot be recovered using commonly available
methods for unloading, subject to compliance with the conditions specified in the Fifth Schedule. These cargo
residues shall not contain any substances classified as harmful to the marine environment, in accordance with the
criteria set out in the Fourth Schedule;
(d) for animal carcasses, discharge shall occur as far from the nearest land as possible, taking into account the
guidelines issued by the Organisation.
(2) Cleaning agents or additives contained in cargo hold, deck and external surfaces wash water may be discharged
into the sea, provided that such discharge complies with the conditions specified in the Fifth Schedule, and these
substances must not be harmful to the marine environment, taking into account guidelines issued by the
Organisation.
(3) Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of Life at Sea
(SOLAS), 1974, as amended, other than grain, shall be classified in accordance with the Fourth Schedule, and
declared by the shipper as to whether or not they are harmful to the marine environment.
(4) When garbage is mixed with or contaminated by other substances prohibited from discharge or having different
discharge requirements, the more stringent requirements shall apply.
2.
Discharge within special areas. — (1) Discharge of the following garbage into the sea within special areas
shall only be permitted while the vessel is en route and as follows:
(a) Discharge into the sea of food wastes as far as practicable from the nearest land, but not less than twelve
nautical miles from the nearest land or the nearest ice shelf. Food wastes shall be comminuted or ground and
shall be capable of passing through a screen with openings no greater than 25 mm. Food wastes shall not be
contaminated by any other garbage type. Discharge of introduced avian products, including poultry and
poultry parts, is not permitted in the Antarctic area, unless it has been treated to be made sterile.
(b) Discharge of cargo residues that cannot be recovered using commonly available methods for unloading,
where all the following conditions are satisfied, namely: —
(i) Cargo residues contained in hold washing water do not include any substances classified as harmful to
the marine environment according to the criteria set out in the Fourth Schedule;
(ii) Solid bulk cargoes as defined in regulation VI/1-1.2 of the International Convention for the Safety of
Life at Sea (SOLAS), 1974, as amended, other than grain, shall be classified in accordance with the

Fourth Schedule, and declared by the shipper as to whether or not they are harmful to the marine
environment;
(iii)Cleaning agents or additives contained in hold washing water do not include any substances classified as
harmful to the marine environment taking into account guidelines developed by the Organisation;
(iv) Both the port of departure and the next port of destination are within the special area and the vessel will
not transit outside the special area between those ports;
(v) No adequate reception facilities are available at those ports taking into account guidelines developed by
the Organisation; and
(vi) Where the conditions of sub-clauses (i) to (v) above have been fulfilled, discharge of cargo hold washing
water containing residues shall be made as far as practicable from the nearest land or the nearest ice shelf
and not less than twelve nautical miles from the nearest land or the nearest ice shelf.
(2) Cleaning agents or additives contained in deck and external surfaces wash water may be discharged into the sea,
but only if these substances are not harmful to the marine environment, taking into account guidelines issued by
the Organisation.
(3) In addition to the provisions of sub-paragraph 1, the following rules shall also apply with respect to the Antarctic
area, namely: -
(a) Each party at whose ports vessels depart en route to or arrive from the Antarctic area undertakes to ensure
that as soon as practicable adequate facilities are provided for the reception of all garbage from all vessels,
without causing undue delay, and according to the needs of the vessels using them.
(b) Each party shall ensure that all vessels entitled to fly its flag, before entering the Antarctic area, have
sufficient capacity on board for the retention of all garbage, while operating in the area and have concluded
arrangements to discharge such garbage at a reception facility after leaving the area.
(4) When garbage is mixed with or contaminated by other substances prohibited from discharge or having different
discharge requirements, the more stringent requirements covered by other rules made under the Merchant
Shipping Act, 2025 (24 of 2025) shall apply.
3.
Special requirements for discharge of garbage from fixed or floating platforms. — (1) Subject to the
provisions of sub-paragraph (2), the discharge into the sea of any garbage is prohibited from fixed or floating
platforms and from all other vessels when alongside or within 500 m of such platforms.
(2)
Food wastes may be discharged into the sea from fixed or floating platforms located more than twelve
nautical miles from the nearest land and from all other vessels when alongside or within 500 m of such platforms, but
only when the wastes have been passed through a comminuter or grinder. Such comminuted or ground food wastes
shall be capable of passing through a screen with openings not greater than 25 mm.
4.
Placards. — Every vessel of 12 metres or more in length and fixed or floating platforms, overall shall
display placards as applicable which are specified in the Third Schedule, in the working language of the vessel’s
personnel and also in English for international voyages, notifying the crew and passengers of the garbage discharge
requirements of rule 4 and paragraphs 1, 2 and 3 of this Schedule and section 5.2 of Part II-A of the Polar Code.
5.
Garbage Management Plan (GMP). — (1) Every vessel of 100 gross tonnage and above, and every vessel
which is certified to carry fifteen or more persons, and fixed or floating platforms shall carry a garbage management
plan as specified in the Third Schedule, which the crew shall follow.

(2) This plan shall provide written procedures for minimising, collecting, storing, processing and disposing of
garbage, including the use of the equipment on board. It shall also designate the person or persons in charge of
carrying out the plan.
(3) Such a plan shall be based on the guidelines issued by the Organisation and vessel-specific, easy to understand,
and written in the working language of the vessel.
6.
Garbage Record Book (GRB) and record-keeping. — (1) Every vessel of 100 gross tonnage and above
and every vessel which is certified to carry fifteen or more persons engaged in voyages to ports or offshore terminals
under the jurisdiction of another party to the convention and every fixed or floating platform shall be provided with a
Garbage Record Book. The Garbage Record Book, whether as a part of the vessel’s official log-book, or as an
electronic record book which shall be approved by the Director-General taking into account the guidelines issued by
the Organisation, shall be in the form specified in the Second Schedule.
(2) Each discharge into the sea or to a reception facility, or a completed incineration, shall be promptly recorded in
the Garbage Record Book and signed for on the date of the discharge or incineration by the officer-in-charge.
Each completed page or group of electronic entries of the Garbage Record Book shall be signed by the master of
the vessel. The entries in the Garbage Record Book shall be in working language of the vessel and English, if
required.
(3) The entry for each discharge into the sea under paragraphs 1 to 3 of this Schedule or section 5.2 of Chapter 5 of
Part II-A of the Polar Code shall include date and time, position of the vessel (latitude and longitude), category of
the garbage and the estimated amount (in cubic metres) discharged. For discharge of cargo residues, the
discharge start and stop positions shall be recorded in addition to the foregoing.
(4) The entry for each completed incineration shall include date and time and position of the vessel (latitude and
longitude) at the start and stop of incineration, categories of garbage incinerated and the estimated amount
incinerated for each category in cubic metres.
(5) The entry for each discharge to a port reception facility or another vessel shall include date and time of discharge,
port or facility or name of vessel, categories of garbage discharged, and the estimated amount discharged for
each category in cubic metres.
(6) The Garbage Record Book along with receipts obtained from reception facilities shall be kept on board the vessel
or the fixed or floating platform, and in such a place as to be readily available for inspection at all reasonable
times. This document shall be preserved for a period of at least two years from the date of the last entry made in
it.
(7) In the event of any discharge or accidental loss referred to in rule 5, an entry shall be made in the Garbage
Record Book, or in the case of any vessel of less than 100 gross tonnage, an entry shall be made in official
logbook of the vessel of the date and time of occurrence, port or position of the vessel at time of occurrence
(latitude, longitude and water depth, if known), the reason for the discharge or loss, details of the items
discharged or lost, categories of garbage discharged or lost, estimated amount for each category in cubic metres,
reasonable precautions taken to prevent or minimise such discharge or accidental loss and general remarks.
(8) The Director-General may waive the requirements for Garbage Record Books for —
(a) any vessel engaged on voyages of one hour or less in duration which is certified to carry fifteen or more
persons; or
(b) fixed or floating platforms.

(9) The surveyor or an authorised person may inspect the Garbage Record Books or official logbook of the vessel on
board any vessel to which these rules apply while the vessel is in ports or offshore terminals in India and may
make a copy of any entry in those books, and may require the master of the vessel to certify that the copy is a
true copy of such an entry. Any copy so made, which has been certified by the master of the vessel as a true copy
of an entry in Garbage Record Book of the vessel or official logbook of the vessel, shall be admissible in any
judicial proceedings as evidence of the facts stated in the entry. The inspection of a Garbage Record Book or
official logbook of the vessel and the taking of a certified copy by the surveyor or an authorised person under this
paragraph shall be performed as expeditiously as possible without causing the ship to be unduly delayed.
7.
Notifications and reports. — Any accidental loss or discharge of fishing gear, as referred to in clauses (c)
and (d) of sub-rule (1) of rule 5, which poses a hazard to navigation or a threat to the marine environment shall be
reported without delay to the Administration of the State whose flag the vessel is entitled to fly in form specified
under Sixth Schedule. Where such loss or discharge occurs within waters subject to the jurisdiction of a coastal
State, the same shall also be reported to the nearest coastal State authority. Reporting under this paragraph may be
facilitated electronically.

1. Introduction:
In accordance with regulation 10 of Annex V of the International Convention for the Prevention of Pollution from
Ships, 1973, as modified by the Protocol of 1978 (MARPOL 73/78), a record is to be kept of each discharge operation
or completed incineration. This includes discharges at sea, to reception facilities, or to other vessels as well as the
accidental loss of garbage.
2. Garbage and garbage management:
Garbage means all kinds of food wastes, domestic wastes and operational wastes, all plastics, cargo residues,
incinerator ashes, cooking oil, fishing gear, and animal carcasses generated during the normal operation of the ship
and liable to be disposed of continuously or periodically, except those substances which are defined or listed in other
Annexes to the Convention. Garbage does not include fresh fish and parts thereof generated as a result of fishing
activities undertaken during the voyage, or as a result of aquaculture activities which involve the transport of fish

including shellfish for placement in the aquaculture facility and the transport of harvested fish including shellfish
from such facilities to shore for processing.
The guidelines for the Implementation of Annex V of MARPOL 73/78, as amended by resolutions, shall also be
referred to for relevant information.
3. Description of the garbage:
Garbage is to be grouped into categories for the purposes of recording in parts I and II of the Garbage Record Book
(or ship's official log-book) as follows:
Part I
A. Plastics;
B. Food wastes;
C. Domestic wastes;
D. Cooking oil;
E. Incinerator ashes;
F. Operational wastes;
G. Animal carcasses;
H. Fishing gear;
I. E-waste.
Part II
J. Cargo residues (non-HME);
K. Cargo residues (HME).
4. Entries in the Garbage Record Book:
(1) Entries in the Garbage Record Book shall be made on each of the following occasions:
(a) When garbage is discharged to reception facilities* ashore or to other ships:
(i) Date and time of discharge;
(ii) Port or facility, or name of vessel;
(iii) Categories of garbage discharged;
(iv) Estimated amount discharged for each category in cubic metres;
(v) Signature of officer in charge of the operation.
(b) When garbage is incinerated:
(i) Date and time of start and stop of incineration;
(ii) Possession of the vessel (latitude and longitude) at the start and stop of incineration;
(iii) Categories of garbage incinerated;
(iv) Estimated amount incinerated in cubic metres;
(v) Signature of the officer in charge of the operation.
(c) When garbage is discharged into the sea in accordance with regulations 4, 5 or 6 of MARPOL Annex V or
chapter 5 of Part II-A of the Polar Code:
(i) Date and time of discharge;
* Ship's masters should obtain from the operator of the reception facilities, which includes barges and trucks, a receipt or certificate
specifying the estimated amount of garbage transferred. The receipts or certificates must be kept together with the Garbage Record Book.

(ii) Position of the vessel (latitude and longitude). Note: for cargo residue discharges, include discharge
start and stop positions;
(iii) Category of garbage discharged;
(iv) Estimated amount discharged for each category in cubic metres;
(v) Signature of the officer in charge of the operation.
(d) Accidental or other exceptional discharges or loss of garbage into the sea, including in accordance
with regulation 7 of Annex V of MARPOL:
(i) Date and time of occurrence;
(ii) Port or position of the vessel at time of occurrence;
(iii) Categories of garbage discharged or lost;
(iv) Estimated amount for each category in cubic metres;
(v) The reason for the discharge or loss and general remarks.
(2) Amount of Garbage:
The amount of garbage on board should be estimated in cubic metres, if possible, separately according to category.
The Garbage Record Book contains many references to estimated amount of garbage. It is recognised that the
accuracy of estimating amounts of garbage is left to interpretation. Volume estimates will differ before and after
processing. Some processing procedures may not allow for a usable estimate of volume, e.g., the continuous
processing of food waste. Such factors should be taken into consideration when making and interpreting entries made
in a record.

DISCHARGE OF ALL GARBAGE INTO THE SEA IS PROHIBITED EXCEPT PROVIDED OTHERWISE
The MARPOL Convention and domestic law prohibit the discharge of most garbage from vessels. Only the
following garbage types are allowed to be discharged under the specified conditions.
Outside special areas designated under MARPOL Annex V and Arctic waters:
Comminuted or ground food wastes (capable of passing through a screen with openings no larger than
25 mm) may be discharged not less than 3 nm from the nearest land.
Other food wastes may be discharged not less than 12 nm from the nearest land.
Cargo residues classified as not harmful to the marine environment may be discharged not less than 12
nm from the nearest land.
Cleaning agents or additives in cargo hold, deck and external surfaces washing water may be
discharged only if they are not harmful to the marine environment.
With the exception of discharging cleaning agents or additives that are not harmful to the marine
environment and are contained in washing water, the vessel must be en route and as far as practicable
from the nearest land.
Within special areas designated under MARPOL Annex V and Arctic waters:
More stringent discharge requirements apply for the discharges of food wastes and cargo residues; and
Consult MARPOL Annex V, chapter 5 of part II-A of the Polar Code and the shipboard garbage
management plan for details.
For all areas of the sea, vessels carrying specialised cargoes such as live animals or solid bulk cargoes should
consult Annex V and the associated Guidelines for the implementation of Annex V.
Discharge of any type of garbage must be entered in the Garbage Record Book.
Violation of these requirements may result in penalties.
(2) Sample placard targeting fixed or floating platforms and vessels operating within 500 m of such platforms

The MARPOL Convention and domestic law prohibit the discharge of all garbage into the sea from fixed or
floating platforms and from all other vessels when alongside or within 500 metres of such platforms.
Exception: Comminuted or ground food wastes may be discharged from fixed or floating platforms located
more than 12 nautical miles from the nearest land and from all other vessels when alongside or within 500
metres of such platforms. Comminuted or ground food wastes must be capable of passing through a screen no
larger than 25 millimetres.

(2) Garbage segregation plan and designated collection points.
(3) Processing and storage: compaction, comminution, grinding, incineration (no plastics), containers and labelling.
(4) Discharge/disposal procedures by category and sea area.
(5) Delivery to reception facilities and record-keeping.
(6) Training and familiarisation, drills, internal checks and audits.
(7) Contingencies for accidental loss, damage, and reporting.
(8) Use of electronic GRB where approved.

FOURTH SCHEDULE

Criteria for the Classification of Solid Bulk Cargoes as Harmful to the Marine Environment (HME)
For the purpose of this Schedule, cargo residues are considered to be harmful to the marine environment (HME) if
they are residues of solid bulk cargoes which are classified according to the criteria of the United Nations Globally
Harmonized System of Classification and Labelling of Chemicals (GHS) meeting the following parameters1:
1. Acute Aquatic Toxicity Category 1; and/or
2. Chronic Aquatic Toxicity Category 1 or 2; and/or
3. Carcinogenicity* Category 1A or 1B combined with not being rapidly degradable and having high
bioaccumulation;
4. MutagenicityError! Bookmark not defined. Category 1A or 1B combined with not being rapidly
degradable and having high bioaccumulation;
5. Reproductive ToxicityError! Bookmark not defined. Category 1A or 1B combined with not being rapidly
degradable and having high bioaccumulation;
6. Specific Target Organ Toxicity Repeated ExposureError! Bookmark not defined. Category 1 combined
with not being rapidly degradable and having high bioaccumulation; and/or
7. Solid bulk cargoes containing or consisting of synthetic polymers, rubber, plastics, or plastic feedstock
pellets (this includes materials that are shredded, milled, chopped or macerated or similar materials).
Note: Shipper’s declaration of HME status shall accompany cargo information.

guidance available in UN GHS, annexes 9 and 10 is essential for proper interpretation of the criteria and

4. Discharge only when reception facilities are not available or not practicable to use.
