सा.का.जि.846(अ).–– डिडिटल वैजयजिक िेटा संरक्षण अडिडियम, 2023 (2023 का 22) की िारा 40 की
उप-िारा (1) के अंतर्गत यथापेडक्षत डिडिटल वैजयजिक िेटा संरक्षण डियमावली, 2025 का मसौिा, भारत सरकार के
इलेक्ट्रॉजिकी और सूचिा प्रौद्योजगकी मंत्रालय की दििांक 3 ििवरी, 2025 की अडिसूचिा संख्या िी.एस.आर. 02 (ई) के
तहत भारत के रािपत्र, असािारण, भार् II, खंि 3, उप-खंि (i) में दििांक 3 ििवरी, 2025 को प्रकाडित दकया र्या था,
डिसमें इससे प्रभाडवत होिे की संभाविा वाले सभी व्यडियों से उि अडिसूचिा वाले आडिकाररक रािपत्र की प्रडतयां
ििता को उपलब्ि कराए िािे की तारीख से पैंतालीस दििों की अवडि समाप्त होिे से पहले आपडियां और सुझाव
आमंडत्रतदकए र्ए थे;
और िबदक उि आडिकाररक रािपत्र की प्रडतयां 3 ििवरी, 2025 को ििता को उपलब्ि कराई र्ईं;
और िबदक उि मसौिा डियमों के संबंि में ििता से प्राप्त आपडियों और सुझावों पर केंद्र सरकार द्वारा डवचार
दकया र्या है;
अतः, अब डिडिटल वैजयजिक िेटा संरक्षण अडिडियम, 2023 (2023 का 22वां) की िारा 40 की उप-िारा (1)
और (2) द्वारा प्रिि िडियों का प्रयोर् करते हुए, केंद्र सरकार एतद्द्वारा डिम्नडलडखत डियम बिाती है, अथागत्: -
1. संडक्षप्त िाम और प्रारंभ — (1) इि डियमों को डिडिटल वैजयजिक िेटा संरक्षण डियमावली, 2025 कहा िाए।
(2) डियम 1, 2 और 17 से 21 रािपत्र में प्रकािि की डतडथ से प्रवृि होंर्े।

(4) डियम 3, 5 से 16, 22 और 23 इस रािपत्र के प्रकािि की डतडथ से अठारह माह के बाि प्रवृि होंर्े।
2. पररभार्ाएँ :—(1) इि डियमों में, िब तक दक संिभग के अिुसार अन्यथा अपेडक्षत ि हो, -
(क) "अडिडियम" से डिडिटल वैजयजिक िेटा संरक्षण अडिडियम, 2023 (2023 का 22वां) अजभप्रेत है;
(ख) "तकिीकी-कािूिी उपाय" से डियम 20 और 22 के अंतर्गत यथाजवडिर्िगष्ट अथि अजभप्रेत है;
(र्) "उपयोर्कताग खाता" से िेटा प्प्रंडसपल द्वारा िेटा द़िड्युसरी के साथ पंिीकृत ऑिलाइि खाताा अजभप्रेत है; और इसमें
कोई भी प्रो़िाइल, पृष्ठ, हैंिल, ई-मेल पता, मोबाइल िंबर और ऐसी ही अन्य उपडथथडतयाँ िाडमल हैं डििके माध्यम से
ऐसा िेटा प्प्रंडसपल ऐसे िेटा द़िड्युसरी की सेवाओं का अजभगम कर सकता है; और
(घ) "सत्यापि योग्य सहमडत" से डियम 10 या 11 में यथाजवडिर्िगष्ट सहमडत अजभप्रेत है।
(2) इि डियमों में प्रयुि और पररभाडर्त िहीं दकए गए, दकन्तु अडिडियम में पररभाडर्त उि िब्िों और अडभव्यडियों के
वही अथग अजभप्रेत होंर्े िो अडिडियम में क्रमिः उिके जलए पररभाजित दकए र्ए हैं।
3. िेटा द़िड्युसरी द्वारा िेटा प्प्रंडसपल को दिया गया िोरिस — िेटा द़िड्युसरी द्वारा िेटा प्प्रंडसपल को दियि गया
िोरिस—
(क) प्रथतुत दकया िाएगा और दकसी भी अन्य िािकारी से थवतंत्र रूप से समझिे योग्य होगा िो ऐसे िेटा द़िड्युसरी द्वारा
उपलब्ि कराई र्ई है, उपलब्ि है या उपलब्ि कराई िा सकती है;
(ख) थपष्ट और सरल भार्ा में, िेटा प्प्रंडसपल को उसके वैजयजिक िेटा के प्रसंथकरण के डलए डवडिष्ट और सूडचत सहमडत िेिे
में सक्षम बिािे के डलए आवश्यक उडचत डववरण िेगा, डिसमें कम से कम, -
(i) ऐसे वैजयजिक िेटा का एक मिवार डवथतृत डववरण; और
(ii) ऐसे प्रसंथकरण द्वारा प्रिाि की िािे वाली वथतुओं या सेवाओं या उपयोर्ों के जवडिर्िगष्ट उद्देश्य या उद्देश्यों और
डवडिष्ट डववरण दिए िाएंगे; और
(र्) ऐसे िेटा द़िड्युसरी की वेबसाइट या ऐप, या िोिों का अजभगम करिे के डलए डविेर् संचार प्लंक, और अन्य साििों
का डववरण, यदि कोई हो, डिसका उपयोर् करके ऐसा िेटा प्प्रंडसपल -
(i) अपिी सहमडत वापस ले सकता है, ऐसा करिे की सहूजलयत उस सहमडत के बराबर होर्ी डिससे ऐसी सहमडत
िी र्ई थी;
(ii) अडिडियम के तहत अपिे अडिकारों का प्रयोर् कर सकता है; और
(iii) बोिग में डिकायत ििग कर सकता है।
4. सहमडत प्रबंिक का पंिीकरण और िाडयत्व — (1) कोई व्यडि िो प्रथम अिुसूची के भार् ‘क’ में सहमडत प्रबंिकों के
पंिीकरण हेतु यथाडििागररत ितों को पूरा करता है, वह बोिग को सहमडत प्रबंिक के रूप में पंिीकरण हेतु ऐसे डववरण और
अन्य िािकारी तथा िथतावेि प्रथतुत करके आवेिि कर सकता है, डिन्हें बोिग अपिी वेबसाइट पर इिकी ओर से प्रकाडित
कर सकता है।
(2) ऐसा आवेिि प्राप्त होिे पर, बोिग अपिे जववेकािुसार प्रथम अिुसूची के भार् ‘क’ में यथाडििागररत ितों की पूर्तग के
संबंि में थवयं को संतुष्ट करिे के डलए ऐसी िांच कर सकता है और यदि वह -

(क) इस बात से संतुष्ट है, तो आवेिक को सहमडत प्रबंिक के रूप में पंिीकृत करेर्ा, आवेिक को सूडचत करेर्ा,
और ऐसे सहमडत प्रबंिक के डववरण अपिी वेबसाइट पर प्रकाडित करेर्ा; या
(ख) इस बात से संतुष्ट िहीं है, तो आवेिि को अथवीकार कर िेर्ा और आवेिक को अथवीकृडत के कारण बताएर्ा।
(3) सहमडत प्रबंिक के िाडयत्व प्रथम अिुसूची के भार् ख में डिर्िगष्ट अिुसार होंर्े।
(4) यदि बोिग की राय है दक कोई सहमडत प्रबंिक इस डियम के अंतर्गत ितों और िाडयत्वों का पालि िहीं कर रहा है, तो
वह सुिवाई का अवसर िेिे के पश्चात, सहमडत प्रबंिक को ऐसे र्ैर-अिुपालि की सूचिा िे सकता है और सहमडत प्रबंिक
को अिुपालि सुडिडश्चत करिे के डलए उपाय करिे का डििेि िे सकता है।
(5) यदि बोिग संतुष्ट हो दक िेटा प्प्रंडसपलों के डहत में ऐसा करिा आवश्यक है, तो वह सहमडत प्रबंिक को सुिवाई का
अवसर िेिे के पश्चात, डलडखत रूप में कारणों को ििग करते हुए, आिेि द्वारा, -
(क) ऐसे सहमडत प्रबंिक का पंिीकरण डिलंडबत या रद्द कर सकता है; और
(ख) िेटा प्प्रंडसपलों के डहतों की रक्षा के डलए उस सहमडत प्रबंिक को ऐसे डििेि िे सकता है िो वह उडचत
समझे।
(6) बोिग, इस डियम के प्रयोििों के डलए, सहमडत प्रबंिक से ऐसी िािकारी प्रिाि करिे की अपेक्षा कर सकता है डिसकी
बोिग मांर् करे।
5. राज्य और उसके उपकरणों द्वारा सडब्सिी, लाभ, सेवा, प्रमाण पत्र, लाइसेंस या परडमट के प्राविाि या िारी करिे के
डलए वैजयजिक िेटा का प्रसंथकरण — (1) इस डियम के तहत िेटा प्प्रंडसपल के वैजयजिक िेटा का प्रसंथकरण िूसरी
अिुसूची में डिर्िगष्ट मािकों का पालि करते हुए दकया िाएर्ा।
(2) इस डियम और िूसरी अिुसूची में, दकसी भी सडब्सिी, लाभ, सेवा, प्रमाण पत्र, लाइसेंस या परडमट का संिभग िो प्रिाि
दकया िाता है या िारी दकया िाता है -
(क) कािूि के तहत राज्य या उसके दकसी भी उपकरण द्वारा दकसी भी समय लार्ू कािूि के तहत दकसी भी िडि
के प्रयोर् या दकसी भी कायग के डिष्पािि में ऐसी सडब्सिी, लाभ, सेवा, प्रमाण पत्र, लाइसेंस या परडमट के
प्राविाि या िारी करिे के संिभग के रूप में समझा िाएर्ा;
(ख) िीडत के तहत केंद्र सरकार या राज्य सरकार द्वारा अपिी कायगकारी िडि के प्रयोर् में िारी की र्ई दकसी भी
िीडत या डििेि के तहत ऐसी सडब्सिी, लाभ, सेवा, प्रमाण पत्र, लाइसेंस या परडमट के प्राविाि या िारी करिे के
संिभग के रूप में समझा िाएर्ा; और
(र्) सावगिडिक डिडियों का उपयोर् करिे का अथग ऐसी सडब्सिी, लाभ, सेवा, प्रमाणपत्र, लाइसेंस या परडमट के
प्राविाि या िारी करिे के संिभग के रूप में लर्ाया िाएर्ा, उस पर प्राडप्तयों के प्रोद्भवि के साथ, —
(i) केंद्र सरकार या राज्य सरकार के मामले में, भारत की संडचत डिडि या राज्य की संडचत डिडि या
भारत के लोक लेखा या राज्य के लोक लेखा; या
(ii) भारत के क्षेत्र के भीतर या भारत सरकार या दकसी राज्य के डियंत्रण में दकसी थथािीय या अन्य
प्राडिकरण के मामले में, ऐसे प्राडिकरण की डिडि या डिडियाँ।
6. उडचत सुरक्षा उपाय.—(1) िेटा द़िड्युसरी अपिे कब्िे में या अपिे डियंत्रण में, वैजयजिक िेटा की सुरक्षा करेर्ा, डिसमें
उसके द्वारा या उसकी ओर से दकसी िेटा प्रोसेसर द्वारा दकए र्ए दकसी भी प्रसंथकरण के संबंि में, वैजयजिक िेटा भंर् को
रोकिे के डलए उडचत सुरक्षा उपाय िाडमल हैं, डििमें कम से कम डिम्नडलडखत िाडमल होंर्े -

(क) उपयुि िेटा सुरक्षा उपाय, िैसे एडन्क्रप्िि, अथपष्टीकरण, माप्थकंर् या उस वैजयजिक िेटा से िुडे वचुगअल
टोकि के उपयोर् के माध्यम से वैजयजिक िेटा की सुरक्षा;
(ख) ऐसे िेटा द़िड्युसरी या ऐसे िेटा प्रोसेसर द्वारा उपयोर् दकए िािे वाले कंप्यूटर संसाििों तक पहुँच को
डियंडत्रत करिे के डलए उपयुि उपाय, िहाँ भी लार्ू हो;
(र्) अिडिकृत पहुँच का पता लर्ािे, उसकी िाँच करिे और पुिरावृडि को रोकिे के डलए सुिार करिे हेतु उपयुि
लॉर्, डिर्रािी और समीक्षा के माध्यम से ऐसे वैजयजिक िेटा तक पहुँच की िृश्यता;
(घ) वैजयजिक िेटा के डविाि या पहुँच के िुकसाि या अन्यथा, िैसे िेटा-बैकअप के माध्यम से, ऐसे वैजयजिक िेटा
की र्ोपिीयता, अखंिता या उपलब्िता से समझौता होिे की डथथडत में डिरंतर प्रसंथकरण के डलए उडचत
उपाय;
(ड) अिडिकृत पहुँच का पता लर्ािे, उसकी िाँच करिे, पुिरावृडि रोकिे के डलए सुिार करिे और ऐसी दकसी
भी डथथडत में डिरंतर प्रसंथकरण के डलए, ऐसे लॉर् और वैजयजिक िेटा को एक वर्ग की अवडि तक बिाए
रखिा, िब तक दक वतगमाि में लार्ू दकसी कािूि के अिुपालि के डलए अन्यथा अपेडक्षत ि हो;
(च) ऐसे िेटा द़िड्युसरी और ऐसे िेटा प्रोसेसर के बीच दकए र्ए अिुबंि में, िहाँ भी लार्ू हो, उडचत सुरक्षा
उपाय करिे के डलए उपयुि प्राविाि; और
(छ) सुरक्षा उपायों का प्रभावी पालि सुडिडश्चत करिे के डलए उपयुि तकिीकी और संर्ठिात्मक उपाय।
(2) इस डियम में, "कंप्यूटर संसािि" पि का वही अथग होर्ा िो सूचिा प्रौद्योडर्की अडिडियम, 2000 (2000 का 21) में
दिया र्या है।
7. वैयजिक डािा उल् लंघि की सूचिा.—(1) दकसी भी वैयजिक डािा उल् लंघि की िािकारी प्राप् त होिे पर, िेटा
द़िड्युसरी, अपिी सवोिम िािकारी के अिुसार, प्रत्येक प्रभाडवत िेटा प्प्रंडसपल को, संडक्षप्त, थपष्ट और थपष्ट तरीके से और
डबिा दकसी िेरी के, अपिे उपयोर्कताग खाते या िेटा द़िड्युसरी के साथ पंिीकृत दकसी भी संचार माध्यम के माध्यम से,
सूडचत करेर्ी —
(क) भंर् का डववरण, डिसमें उसकी प्रकृडत, सीमा और उसके घरटत होिे का समय िाडमल है;
(ख) भंर् से उत्पन्न होिे वाले उसके डलए प्रासंडर्क पररणाम;
(र्) िोडखम को कम करिे के डलए िेटा द़िड्युसरी द्वारा कायागडन्वत और कायागडन्वत दकए िा रहे उपाय, यदि कोई
हों;
(घ) अपिे डहतों की रक्षा के डलए वह िो सुरक्षा उपाय कर सकती है; और
(ङ) उस व्यडि की व्यावसाडयक संपकग िािकारी िो िेटा द़िड्युसरी की ओर से िेटा प्प्रंडसपल के प्रश्नों, यदि कोई
हों, का उिर िेिे में सक्षम है।
(2) दकसी भी वैजयजिक िेटा भंर् की िािकारी डमलिे पर, िेटा द़िड्युसरी बोिग को सूडचत करेर्ा, -
(क) डबिा दकसी िेरी के, भंर् का डववरण, डिसमें उसकी प्रकृडत, सीमा, घटिा का समय और थथाि तथा
संभाडवत प्रभाव िाडमल हैं;
(ख) भंर् की िािकारी डमलिे के बहिर घंटों के भीतर, या बोिग द्वारा इस संबंि में डलडखत रूप में दकए र्ए
अिुरोि पर िी र्ई अडिक अवडि के भीतर, -
(i) ऐसे डववरण के संबंि में अद्यति और डवथतृत िािकारी;
(ii) भंर् के कारणों, घटिाओं और पररडथथडतयों से संबंडित व्यापक तथ्य;

(iii) िोडखम को कम करिे के डलए कायागडन्वत या प्रथताडवत उपाय, यदि कोई हों;
(iv) भंर् करिे वाले व्यडि के संबंि में कोई डिष्कर्ग;
(v) ऐसे भंर् की पुिरावृडि को रोकिे के डलए दकए र्ए उपचारात्मक उपाय; और
(vi) प्रभाडवत िेटा प्प्रंडसपलों को िी र्ई सूचिाओं के संबंि में एक ररपोटग।
8. डिर्िगष्ट उद्देश्य के डलए समयावडि को अब पूरा िहीं मािा िाएर्ा.—(1) कोई िेटा द़िड्युसरी, िो उस वर्ग का है और
तृतीय अिुसूची में डिर्िगष्ट ऐसे संर्त उद्देश्यों के डलए वैजयजिक िेटा का प्रसंथकरण कर रहा है, ऐसे वैजयजिक िेटा को डमटा
िेर्ा, िब तक दक उसे बिाए रखिा दकसी भी समय लार्ू कािूि के अिुपालि के डलए आवश्यक ि हो, या, तृतीय अिुसूची
में डिर्िगष्ट संर्त समयावडि के डलए, यदि िेटा प्प्रंडसपल डिर्िगष्ट उद्देश्य के डिष्पािि के डलए ऐसे िेटा द़िड्युसरी से ि तो
संपकग करता है और ि ही ऐसे प्रसंथकरण के संबंि में अपिे अडिकारों का प्रयोर् करता है।
(2) इस डियम के तहत वैजयजिक िेटा के डवलोपि की समयावडि पूरी होिे से कम से कम अडतालीस घंटे पहले, िेटा
द़िड्युसरी िेटा प्प्रंडसपल को सूडचत करेर्ा दक ऐसा वैजयजिक िेटा ऐसी अवडि पूरी होिे पर डमटा दिया िाएर्ा, िब तक
दक वह अपिे उपयोर्कताग खाते में लॉर् इि ि करे या डिर्िगष्ट उद्देश्य के डिष्पािि के डलए िेटा द़िड्युसरी से अन्यथा संपकग
ि करे या ऐसे वैजयजिक िेटा के प्रसंथकरण के संबंि में अपिे अडिकारों का प्रयोर् ि करे।
(3) उप-डियम (1) और (2) के प्रडतकूल प्रभाव के डबिा, िेटा द़िड्युसरी, उसके द्वारा या उसकी ओर से िेटा प्रोसेसर द्वारा
दकए र्ए वैजयजिक िेटा के दकसी प्रसंथकरण के संबंि में, ऐसे वैजयजिक िेटा, संबद्ध ट्रैद़िक िेटा और प्रसंथकरण के अन्य
लॉर् को, ऐसी प्रसंथकरण की डतडथ से एक वर्ग की न्यूितम अवडि के डलए, सातवीं अिुसूची में डिर्िगष्ट उद्देश्यों के डलए
बिाए रखेर्ा, डिसके बाि िेटा द़िड्युसरी ऐसे वैजयजिक िेटा और लॉर् को डमटा िेर्ा, िब तक दक सरकार द्वारा
अडिसूडचत या लार्ू दकसी अन्य कािूि के अिुपालि के डलए आर्े प्रडतिारण की आवश्यकता ि हो।
उिाहरण
मामला 1: िेटा प्प्रंडसपल X, ई-बुक प्लेट़िॉमग Y पर एक ई-बुक खरीिता है। डिलीवरी पूरी होिे के बाि, प्रोसेप्संर्
का डिर्िगष्ट उद्देश्य पूरा हो िाता है। प्लेट़िॉमग Y को ऑिगर डववरण, वैजयजिक िेटा और प्रोसेप्संर् के लॉर् (िैसे ऑिगर की
पुडष्ट, भुर्ताि और डिलीवरी इवेंट) लेि-िेि की तारीख से कम से कम एक वर्ग तक बिाए रखिा होर्ा, भले ही X अपिा
खाता हटा िे।
मामला 2: कंपिी X, ग्राहक ररकॉिग होथट करिे के डलए क्लाउि सेवा प्रिाता C को अपिा िेटा प्रोसेसर डियुि
करती है। िेटा द़िड्युिरी के रूप में X को यह सुडिडश्चत करिा होर्ा दक C भी िेटा और संबंडित लॉर् को डमटािे से पहले
कम से कम एक वर्ग तक बिाए रखे, िब तक दक दकसी अन्य लार्ू कािूि में इससे अडिक अवडि की आवश्यकता ि हो।
9. प्रसंथकरण के बारे में प्रश्नों का उिर िेिे के डलए व्यडि की संपकग िािकारी.—प्रत्येक िेटा द़िड्युसरी अपिी वेबसाइट या
ऐप पर प्रमुखता से प्रकाडित करेर्ा, और अडिडियम के तहत िेटा प्प्रंडसपल के अडिकारों के प्रयोर् के डलए संचार के प्रत्येक
उिर में, िेटा संरक्षण अडिकारी की व्यावसाडयक संपकग िािकारी, यदि लार्ू हो, या उस व्यडि की िािकारी का उल्लेख
करेर्ा िो िेटा द़िड्युसरी की ओर से िेटा प्प्रंडसपल के वैजयजिक िेटा के प्रसंथकरण के बारे में प्रश्नों का उिर िेिे में सक्षम है।
10. बच्चे के वैजयजिक िेटा के प्रसंथकरण हेतु सत्यापि योग्य सहमडत.—(1) िेटा द़िड्युसरी यह सुडिडश्चत करिे के डलए
उपयुि तकिीकी और संर्ठिात्मक उपाय अपिाएर्ा दक बच्चे के दकसी भी वैजयजिक िेटा के प्रसंथकरण से पहले माता-डपता

की सत्यापि योग्य सहमडत प्राप्त कर ली िाए और यह िाँचिे के डलए उडचत तत्परता बरतेर्ा दक माता-डपता के रूप में
थवयं की पहचाि करिे वाला व्यडि एक वयथक है, डिसकी पहचाि भारत में वतगमाि में लार्ू दकसी भी कािूि के अिुपालि
के संबंि में, यदि आवश्यक हो, तो डिम्नडलडखत के संिभग में की िा सकती है—
(क) िेटा द़िड्युसरी के पास उपलब्ि व्यडि की पहचाि और आयु का डवश्वसिीय डववरण; या
(ख) पहचाि और आयु का डववरण, थवेच्छा से प्रिाि दकया र्या—
(i) व्यडि द्वारा; या
(ii) ऐसे डववरणों से िुडे एक वचुगअल टोकि के माध्यम से, िो दकसी अडिकृत संथथा द्वारा िारी दकया
िाता है।
(2) इस डियम में, अजभव् यजि—
(क) “वयथक”से ऐसा व्यडि अजभप्रेत होर्ा डिसिे अठारह वर्ग की आयु पूरी कर ली है;
(ख) "प्राडिकृत इकाई" से जिम् िजलजखत अजभप्रेत होर्ा -
(i) कोई इकाई डिसे डवडि द्वारा या केंद्र सरकार या राज्य सरकार द्वारा पहचाि और आयु का डववरण या ऐसे

(ii) खंि (i) के अंतर्गत डिर्िगष्ट इकाई द्वारा ऐसे िारी करिे के डलए डियुि या अिुमत व्यडि, और इसमें डिडिटल
लॉकर सेवा प्रिाता द्वारा उपलब्ि और सत्याडपत पहचाि और आयु या टोकि का डववरण भी िाडमल है;
(र्) "डिडिटल लॉकर सेवा प्रिाता" का अथग ऐसा मध्यवती होर्ा, डिसमें उपयुि सरकार का कोई डिर्डमत डिकाय या
एिेंसी िाडमल है, डिसे केंद्र सरकार द्वारा सूचिा प्रौद्योडर्की अडिडियम, 2000 (2000 का 21) के तहत इस संबंि में
बिाए र्ए डियमों के अिुसार अडिसूडचत दकया िा सकता है;
उिाहरण
C एक बच्चा है, P एक अडभभावक है, और DF एक िेटा द़िड्युसरी है। C के वैजयजिक िेटा को संसाडित करके, DF के
ऑिलाइि प्लेट़िॉमग पर C का एक उपयोर्कताग खाता बिाया िािा है।
मामला 1: C, DF को सूडचत करती है दक वह एक बच्ची है और P को अपिा अडभभावक घोडर्त करती है। DF,
P को अपिी वेबसाइट, ऐप या अन्य उपयुि माध्यमों से अपिी पहचाि बतािे में सक्षम बिाएर्ा। P थवयं को अडभभावक
के रूप में पहचािती है और DF को सूडचत करती है दक वह DF के प्लेट़िॉमग पर एक पंिीकृत उपयोर्कताग है और उसिे
पहले ही DF को अपिी पहचाि और आयु का डववरण उपलब्ि करा दिया है। उपयोर्कताग खाता बिािे के डलए C के
वैजयजिक िेटा को संसाडित करिे से पहले, DF यह पुडष्ट करिे के डलए िाँच करेर्ा दक उसके पास P की डवश्वसिीय
पहचाि और आयु का डववरण है और P एक पहचाि योग्य वयथक है।
मामला 2: C, DF को सूडचत करती है दक वह एक बच्ची है C का उपयोर्कताग खाता बिािे के डलए उसके
वैजयजिक िेटा को संसाडित करिे से पहले, DF, कािूि या सरकार द्वारा उि डववरणों के रखरखाव के डलए सौंपी र्ई
दकसी संथथा द्वारा िारी पहचाि और आयु के डववरण या पहचाि और आयु से मैप दकए र्ए वचुगअल टोकि के संिभग में, यह
िांच करेर्ा दक P एक पहचाि योग्य वयथक है। P थवेच्छा से डिडिटल लॉकर सेवा प्रिाता की सेवाओं का उपयोर् करके
ऐसे डववरण उपलब्ि करा सकता है।

मामला 3: P, C के डलए एक खाता खोल रही है और खुि को C की माता-डपता के रूप में पहचािती है और DF
को सूडचत करती है दक वह DF के प्लेट़िॉमग पर एक पंिीकृत उपयोर्कताग है और उसिे पहले DF को अपिी पहचाि और
आयु का डववरण उपलब्ि कराया है। C का उपयोर्कताग खाता बिािे के डलए उसके वैजयजिक िेटा को संसाडित करिे से
पहले, DF यह पुडष्ट करिे के डलए िांच करेर्ा दक उसके पास P की डवश्वसिीय पहचाि और आयु का डववरण है और P
एक पहचाि योग्य वयथक है।
मामला 4: P, C के डलए एक खाता खोल रही है और खुि को C की माता-डपता के रूप में पहचािती है और DF
को सूडचत करती है दक वह थवयं DF के प्लेट़िॉमग पर पंिीकृत उपयोर्कताग िहीं है। C का उपयोर्कताग खाता बिािे के
डलए उसके वैजयजिक िेटा को संसाडित करिे से पहले, DF, कािूि या सरकार द्वारा उि डववरणों के रखरखाव हेतु सौंपी
र्ई दकसी संथथा द्वारा िारी पहचाि और आयु संबंिी डववरणों, या पहचाि और आयु से िुडे दकसी वचुगअल टोकि के संिभग
में, यह िाँच करेर्ा दक P एक पहचाि योग्य वयथक है। P डिडिटल लॉकर सेवा प्रिाता की सेवाओं का उपयोर् करके
थवेच्छा से ऐसे डववरण उपलब्ि करा सकता है।
11. दिव्यांर्ििों के वैजयजिक िेटा के प्रसंथकरण के डलए सत्यापि योग्य सहमडत, डििके पास वैि अडभभावक है— (1)
िेटा द़िड्युसरी, थवयं को दिव्यांर्ििों के वैि अडभभावक के रूप में पहचाििे वाले व्यडि से सत्यापि योग्य सहमडत प्राप्त
करते समय, यह सत्याडपत करिे के डलए उडचत पररश्रम करेर्ा दक ऐसा अडभभावक दकसी न्यायालय द्वारा, या दकसी
िाडमत प्राडिकारी द्वारा, या संरक्षकता पर लार्ू कािूि के तहत दकसी थथािीय थतर की सडमडत द्वारा डियुि दकया र्या है।
(2) इस डियम में, अडभव्यडि -
(क) "िाडमत प्राडिकारी" से दिव्यांर्िि अडिकार अडिडियम, 2016 (2016 का 49) की िारा 15 के तहत
दिव्यांर्ििों को उिकी कािूिी क्षमता के प्रयोर् में सहायता प्रिाि करिे के डलए िाडमत प्राडिकारी अजभप्रेत
होर्ा;
(ख) "संरक्षकता पर लार्ू कािूि" से जिम् िजलजखत अजभप्रेत होर्ा, -
(i) ऐसे व्यडि के संबंि में, डिसे िीघगकाडलक िारीररक, मािडसक, बौडद्धक या संवेिी डवकलांर्ता है, िो
बािाओं के साथ डमलकर, समाि में िूसरों के समाि रूप से उसकी पूणग और प्रभावी भार्ीिारी में
बािा िालती है और िो पयागप्त और उडचत सहायता प्रिाि दकए िािे के बाविूि कािूिी रूप से
बाध्यकारी डिणगय लेिे में असमथग है, दिव्यांर्िि अडिकार अडिडियम, 2016 (2016 का 49) और
उसके अिीि बिाए र्ए डियमों में डिडहत कािूि के प्राविाि; और
(ii) ऐसे व्यडि के संबंि में, िो ऑरटज्म, सेरेब्रल पाल्सी, मािडसक मंिता या ऐसी डथथडतयों के संयोिि
से संबंडित दकसी भी डथथडत से पीडडत है और इसमें र्ंभीर बहु-डवकलांर्ता से पीडडत व्यडि भी
िाडमल है, ऑरटज्म, सेरेब्रल पाल्सी, मािडसक मंिता और बहु-डवकलांर्ता वाले व्यडियों के कल्याण
हेतु राष्ट्रीय न्यास अडिडियम, 1999 (1999 का 44) और उसके अिीि बिाए र्ए डियमों के कािूि
के प्राविाि;
(र्) "थथािीय थतर की सडमडत" का तात्पयग राष्ट्रीय ऑरटज्म, मडथतष्क पक्षाघात, मािडसक मंिता और बहु-
डिःििताग्रथत व्यडियों के कल्याण हेतु न्यास अडिडियम, 1999 (1999 का 44) की िारा 13 के अंतर्गत र्रठत
थथािीय थतर की सडमडत से होर्ा;
(घ) "डिःिि व्यडि" का तात्पयग और इसमें िाडमल होंर्े -

(i) ऐसा व्यडि डिसकी िीघगकाडलक िारीररक, मािडसक, बौडद्धक या संवेिी क्षीणता है, िो बािाओं के
कारण, समाि में िूसरों के समाि रूप से उसकी पूणग और प्रभावी भार्ीिारी में बािा िालती है और
िो पयागप्त और उडचत सहायता प्रिाि दकए िािे के बाविूि, कािूिी रूप से बाध्यकारी डिणगय लेिे में
असमथग है; और
(ii) ऐसा व्यडि िो ऑरटज्म, मडथतष्क पक्षाघात, मािडसक मंिता या ऐसी दकन्हीं िो या अडिक डथथडतयों
के संयोिि से संबंडित दकसी भी डथथडत से पीडडत है और इसमें र्ंभीर बहु-डिःििता से पीडडत
व्यडि भी िाडमल है और िो पयागप्त और उडचत सहायता प्रिाि दकए िािे के बाविूि, कािूिी रूप से
बाध्यकारी डिणगय लेिे में असमथग है।
12. बच्चे के वैजयजिक िेटा के प्रसंथकरण पर लार्ू कुछ िाडयत्वों से छूट— (1) अडिडियम की िारा 9 की उप-िारा (1) और
(3) के प्राविाि, िेटा द़िड्युसरी के ऐसे वर्ग द्वारा बच्चे के वैजयजिक िेटा के प्रसंथकरण पर लार्ू िहीं होंर्े, िैसा दक चौथी
अिुसूची के भार् ए में डिर्िगष्ट हैं, ऐसी ितों के अिीि िो उि भार् में डिर्िगष्ट हैं।
(2) अडिडियम की िारा 9 की उप-िारा (1) और (3) के प्राविाि, ऐसे प्रयोििों के डलए बच्चे के वैजयजिक िेटा के
प्रसंथकरण पर लार्ू िहीं होंर्े, िैसा दक चौथी अिुसूची के भार् बी में डिर्िगष्ट हैं, ऐसी ितों के अिीि िो उि भार् में
डिर्िगष्ट हैं।
13. महत्वपूणग िेटा द़िड्युसरी के अडतररि िाडयत्व—(1) एक महत्वपूणग िेटा द़िड्युसरी, इस अडिडियम और उसके अिीि
बिाए र्ए डियमों के प्राविािों का प्रभावी पालि सुडिडश्चत करिे के डलए, उस डतडथ से बारह महीिे की प्रत्येक अवडि में
एक बार िेटा संरक्षण प्रभाव आकलि और लेखा परीक्षा करेर्ा, डिस डतडथ को उसे इस प्रकार अडिसूडचत दकया िाता है या
िेटा द़िड्युसरी वर्ग में िाडमल दकया िाता है।
(2) एक महत्वपूणग िेटा द़िड्युसरी, िेटा संरक्षण प्रभाव आकलि और लेखा परीक्षा करिे वाले व्यडि से िेटा संरक्षण प्रभाव
आकलि और लेखा परीक्षा में महत्वपूणग रटप्पडणयों वाली एक ररपोटग बोिग को प्रथतुत करवाएर्ा।
(3) एक महत्वपूणग िेटा द़िड्युसरी यह सत्याडपत करिे के डलए उडचत पररश्रम करेर्ा दक उसके द्वारा संसाडित वैजयजिक
िेटा की होप्थटंर्, प्रििगि, अपलोप्िंर्, संिोिि, प्रकािि, प्रेर्ण, भंिारण, अद्यति या साझा करिे के डलए उसके द्वारा
अपिाए र्ए एल्र्ोररिडमक सॉफ़्टवेयर सडहत तकिीकी उपायों से िेटा प्प्रंडसपलों के अडिकारों को कोई खतरा होिे की
संभाविा िहीं है।
(4) एक महत्वपूणग िेटा द़िड्युसरी यह सुडिडश्चत करिे के डलए उपाय करेर्ा दक केंद्र सरकार द्वारा र्रठत सडमडत की
डसफाररिों के आिार पर, उसके द्वारा डिर्िगष्ट वैजयजिक िेटा को इस प्रडतबंि के अिीि संसाडित दकया िाए दक वैजयजिक
िेटा और इसके प्रवाह से संबंडित ट्रैद़िक िेटा भारत के क्षेत्र के बाहर थथािांतररत िहीं दकया िाता है।
(5) इस डियम में, "सडमडत" का अथग इस डियम के प्रयोिि के डलए केंद्र सरकार द्वारा र्रठत एक सडमडत है, डिसमें
इलेक्ट्रॉडिक्स और प्रौद्योडर्की मंत्रालय के अडिकारी िाडमल होंर्े और इसमें केंद्र सरकार के अन्य मंत्रालयों या डवभार्ों के
अडिकारी िाडमल हो सकते हैं।

14. िेटा प्प्रंडसपल के अडिकार.—(1) अडिडियम के तहत िेटा प्प्रंडसपल को अपिे अडिकारों का प्रयोर् करिे में सक्षम
बिािे के डलए, िेटा द़िड्यूिरी और, िहाँ लार्ू हो, सहमडत प्रबंिक, अपिी वेबसाइट या ऐप, या िोिों पर, िैसा भी
मामला हो, प्रमुखता से प्रकाडित करेर्ा, -
(क) उि साििों का डववरण डििके उपयोर् से िेटा प्प्रंडसपल ऐसे अडिकारों के प्रयोर् के डलए अिुरोि कर सकता
है; और
(ख) डववरण, यदि कोई हो, िैसे दक ऐसे िेटा प्प्रंडसपल का उपयोर्कताग िाम या अन्य पहचािकताग, िो उसकी
सेवा की ितों के तहत उसकी पहचाि के डलए आवश्यक हो सकता है।
(2) अडिडियम के तहत िेटा प्प्रंडसपल के अडिकारों का प्रयोर् करिे के डलए, वह उस िेटा द़िड्यूिरी से अिुरोि कर सकती
है, डिसे उसिे पहले अपिे वैजयजिक िेटा के प्रसंथकरण के डलए सहमडत िी है, ऐसे अडिकारों के प्रयोर् के डलए ऐसे िेटा
द़िड्यूिरी द्वारा आवश्यक साििों का उपयोर् करके और डववरण प्रथतुत करके।
(3) प्रत्येक िेटा द़िड्युसरी और सहमडत प्रबंिक, िेटा प्प्रंडसपलों की डिकायतों का समािाि करिे के डलए अपिी डिकायत
डिवारण प्रणाली के अंतर्गत िब्बे दििों से अडिक ि होिे वाली उडचत अवडि के भीतर, अपिी वेबसाइट या ऐप, या िोिों
पर, िैसा भी मामला हो, प्रमुखता से प्रकाडित करेर्ा और ऐसी अवडि के भीतर समािाि करिे में प्रणाली की
प्रभाविीलता सुडिडश्चत करिे के डलए, उपयुि तकिीकी और संर्ठिात्मक उपायों को लार्ू करेर्ा।
(4) अडिडियम के तहत िेटा प्प्रंडसपल के अडिकारों का प्रयोर् करिे के डलए, वह िेटा द़िड्युसरी की सेवा की ितों और ऐसे
लार्ू कािूि के अिुसार, ऐसे अडिकार के प्रयोर् के डलए ऐसे िेटा द़िड्युसरी द्वारा अपेडक्षत साििों का उपयोर् करके और
डववरण प्रथतुत करते हुए, एक या अडिक व्यडियों को िाडमत कर सकता है।
(5) इस डियम में, "पहचािकताग" िब्ि का अथग िेटा द़िड्युसरी द्वारा िेटा प्प्रंडसपल की पहचाि करिे के डलए िारी दकए
र्ए वणों के दकसी भी क्रम से होर्ा और इसमें ग्राहक पहचाि ़िाइल संख्या, ग्राहक अडिग्रहण प्रपत्र संख्या, आवेिि संिभग
संख्या, िामांकि आईिी, ईमेल पता, मोबाइल िंबर या लाइसेंस िंबर िाडमल है िो ऐसी पहचाि को सक्षम बिाता है।
15. भारतीय क्षेत्राजधकार से बाहर वैजयजिक िेटा का थथािांतरण—अडिडियम के तहत िेटा द़िड्युिरी द्वारा संसाडित
दकसी भी वैजयजिक िेटा को भारत के क्षेत्र के बाहर थथािांतररत दकया िा सकता है, इस प्रडतबंि के अिीि दक िेटा
द़िड्युिरी उि आवश्यकताओं को पूरा करेर्ा, डिन्हें केंद्र सरकार सामान्य या डविेर् आिेि द्वारा, दकसी भी डविेिी राज्य
को या ऐसे राज्य के डियंत्रण में दकसी व्यडि या संथथा या दकसी एिेंसी को ऐसे वैजयजिक िेटा उपलब्ि करािे के संबंि में
डिर्िगष्ट कर सकती है।
16. अिुसंिाि, अडभलेखीकरण या सांडख्यकीय उद्देश्यों के डलए अडिडियम से छूट— अडिडियम के प्राविाि अिुसंिाि,
अडभलेखीकरण या सांडख्यकीय उद्देश्यों के डलए आवश्यक वैजयजिक िेटा के प्रसंथकरण पर लार्ू िहीं होंर्े यदि यह िूसरी
अिुसूची में डिर्िगष्ट मािकों के अिुसार दकया िाता है।
17. अध्यक्ष और अन्य सिथयों की डियुडि— (1) केंद्र सरकार, अध्यक्ष के रूप में डियुडि के डलए व्यडियों की डसफाररि
करिे हेतु एक खोि-सह-चयि सडमडत का र्ठि करेर्ी, डिसका अध्यक्ष कैडबिेट सडचव होर्ा और भारत सरकार के सडचव
िो डवडि कायग डवभार् और इलेक्ट्रॉडिक्स एवं सूचिा प्रौद्योडर्की मंत्रालय के प्रभारी होंर्े, और िो प्रडतडष्ठत डविेर्ज्ञ डििके

पास दकसी ऐसे क्षेत्र में डविेर् ज्ञाि या व्यावहाररक अिुभव हो िो केंद्र सरकार की राय में बोिग के डलए सिथयों के रूप में
उपयोर्ी हो, होंर्े।
(2) केंद्र सरकार, अध्यक्ष के अलावा दकसी अन्य सिथय के रूप में डियुडि के डलए व्यडियों की डसफाररि करिे हेतु एक
खोि-सह-चयि सडमडत का र्ठि करेर्ी, डिसका अध्यक्ष इलेक्ट्रॉडिक्स एवं सूचिा प्रौद्योडर्की मंत्रालय में भारत सरकार के
सडचव होंर्े और भारत सरकार के सडचव िो डवडि कायग डवभार् के प्रभारी होंर्े, और िो प्रडतडष्ठत डविेर्ज्ञ डििके पास
दकसी ऐसे क्षेत्र में डविेर् ज्ञाि या व्यावहाररक अिुभव हो िो केंद्र सरकार की राय में बोिग के डलए सिथयों के रूप में
उपयोर्ी हो।
(3) केन्द्रीय सरकार, खोि-सह-चयि सडमडत द्वारा अिुिंडसत व्यडियों की उपयुिता पर डवचार करिे के पश्चात्,
यथाडथथडत, अध्यक्ष या अन्य सिथय की डियुडि करेर्ी।
(4) इस डियम के उप-डियम (1) और (2) में डवडिर्िगष्ट खोि-सह-चयि सडमडत के दकसी कायग या कायगवाही को केवल इस
आिार पर प्रश्नर्त िहीं दकया िाएर्ा दक ऐसी सडमडत में कोई ररडि है या अिुपडथथत है या इसके र्ठि में कोई त्रुरट है।
18. अध्यक्ष और अन्य सिथयों का वेति, भिे और सेवा की अन्य डिबंिि एवं िते.— अध्यक्ष और प्रत्येक अन्य सिथय को
ऐसा वेति और भिे प्राप्त होंर्े तथा उिकी सेवा की ऐसी अन्य डिबंिि एवं िते होंर्ी िो पांचवीं अिुसूची में डवडिर्िगष्ट हैं।
19. बोिग की बैठकों की प्रदक्रया और उसके आिेिों, डििेिों और िथतावेिों का प्रमाणीकरण— (1) अध्यक्ष, बोिग की बैठकों
की डतडथ, समय और थथाि डिडश्चत करेर्ा, उिके डलए कायगसूची के मिों का अिुमोिि करेर्ा, और उन्हें डिर्िगष्ट करते हुए
अपिे हथताक्षर से या ऐसे अन्य व्यडि के हथताक्षर से, डिसे अध्यक्ष डलडखत रूप में सामान्य या डविेर् आिेि द्वारा प्राडिकृत
करे, सूचिा िारी करवाएर्ा।
(2) बोिग की बैठकों की अध्यक्षता अध्यक्ष द्वारा की िाएर्ी और उिकी अिुपडथथडत में, ऐसे अन्य सिथय द्वारा, डिन्हें बैठक
में उपडथथत सिथय अपिे बीच से चुिेंर्े, की िाएर्ी।
(3) बोिग की एक-डतहाई सिथयता इसकी बैठकों के डलए र्णपूर्तग होर्ी।
(4) बोिग की दकसी भी बैठक में आिे वाले सभी प्रश्नों का डिणगय उपडथथत और मतिाि करिे वाले सिथयों के बहुमत से
दकया िाएर्ा, और मतों के बराबर होिे की डथथडत में, अध्यक्ष, या उिकी अिुपडथथडत में, अध्यक्षता करिे वाले व्यडि के
पास िूसरा या डिणागयक मत होर्ा।
(5) यदि दकसी सिथय का बोिग की बैठक में डिपटाए िािे वाले दकसी कायग-डवर्य में डहत है, तो वह उसमें भार् िहीं लेर्ा
या उस पर मतिाि िहीं करेर्ा और ऐसी डथथडत में, ऐसे डवर्य पर डिणगय उपडथथत और मतिाि करिे वाले अन्य सिथयों
के बहुमत से डलया िाएर्ा।
(6) यदि दकसी आपात डथथडत में बोिग द्वारा तत्काल कारगवाई आवश्यक हो और बोिग की बैठक बुलािा संभव ि हो, तो
अध्यक्ष डलडखत रूप में कारण ििग करते हुए, आवश्यक कारगवाई कर सकता है, डिसकी सूचिा सात दििों के भीतर सभी
सिथयों को िी िाएर्ी और बोिग की अर्ली बैठक में अिुमोिि के डलए उसके समक्ष रखी िाएर्ी।

(7) यदि अध्यक्ष ऐसा डििेि िेता है, तो कायग या मुद्दे का कोई डवर्य, डिस पर बोिग के डिणगय की आवश्यकता हो,
पररचालि द्वारा सिथयों को भेिा िा सकता है और ऐसे डवर्य पर सिथयों के बहुमत के अिुमोिि से डिणगय डलया िा
सकता है।
(8) बोिग का अध्यक्ष या कोई सिथय, या उसके द्वारा डलडखत सामान्य या डविेर् आिेि द्वारा अडिकृत कोई व्यडि, अपिे
हथताक्षर से, उसके आिेि, डििेि या डलखत को प्रमाडणत कर सकता है।
(9) बोिग द्वारा िांच अडिडियम की िारा 27 के अिीि सूचिा, डिकायत, संिभग या डििेि की प्राडप्त की तारीख से छह
महीिे की अवडि के भीतर पूरी की िाएर्ी, िब तक दक ऐसी अवडि को डलडखत रूप में ििग दकए िािे वाले कारणों से एक
बार में तीि महीिे से अिडिक की अडतररि अवडि के डलए िहीं बढाया िाता है।
20. बोिग का डिडिटल कायागलय के रूप में कायग करिा—बोिग एक डिडिटल कायागलय के रूप में कायग करेर्ा, दकसी भी
व्यडि को बुलािे और उसकी उपडथथडत सुडिडश्चत करिे तथा िपथ पर उसकी िांच करिे की अपिी िडि पर प्रडतकूल
प्रभाव िाले डबिा, कायगवाही को इस प्रकार संचाडलत करिे के डलए तकिीकी-कािूिी उपाय अपिा सकता है डिससे दकसी
व्यडि की भौडतक उपडथथडत अपेडक्षत ि हो।
21. बोिग के अडिकाररयों और कमगचाररयों की डियुडि और सेवा की ितें—(1) बोिग, केन्द्रीय सरकार के पूवग अिुमोिि से,
ऐसे अडिकाररयों और कमगचाररयों की डियुडि कर सकेर्ा डिन्हें वह अडिडियम के उपबंिों के अिीि अपिे कायों के कुिल
डिवगहि के डलए आवश्यक समझे।
(2) बोिग के अडिकाररयों और कमगचाररयों की सेवा की ितें और डियम वे होंर्े िो छठी अिुसूची में डिर्िगष्ट हैं।
22. अपीलीय न्यायाडिकरण में अपील—(1) बोिग के दकसी आिेि या डििेि से व्यडथत कोई भी व्यडि अपीलीय
न्यायाडिकरण के समक्ष अपील कर सकेर्ा। यह अपीलीय न्यायाडिकरण के डिणगयािुसार डिडिटल रूप में िायर की
िाएर्ी।
(2) अपीलीय न्यायाडिकरण में िायर अपील के साथ उतिी ही राडि का िुल्क संलग्न होर्ा डितिा भारतीय िूरसंचार
डवडियामक प्राडिकरण अडिडियम, 1997 (1997 का 24) के अंतर्गत िायर अपील के संबंि में लार्ू है, िब तक दक
अपीलीय न्यायाडिकरण के अध्यक्ष द्वारा अपिे डववेकािुसार इसे कम या माफ िहीं दकया िाता है, और यह िुल्क एकीकृत
भुर्ताि इंटरफेस या भारतीय ररिवग बैंक द्वारा अडिकृत ऐसी अन्य भुर्ताि प्रणाली का उपयोर् करके डिडिटल रूप से िेय
होर्ा।
(3) अपीलीय न्यायाडिकरण—
(क) डसडवल प्रदक्रया संडहता, 1908 (1908 का 5) द्वारा डििागररत प्रदक्रया से बाध्य िहीं होर्ा, बडल्क प्राकृडतक
न्याय के डसद्धांतों द्वारा डििेडित होर्ा और अडिडियम के प्राविािों के अिीि रहते हुए, अपिी थवयं की
प्रदक्रया को डवडियडमत कर सकता है; और
(ख) एक डिडिटल कायागलय के रूप में कायग करेर्ा, िो दकसी भी व्यडि को बुलािे और उसकी उपडथथडत
सुडिडश्चत करिे तथा िपथ पर उसकी िांच करिे की अपिी िडि पर प्रडतकूल प्रभाव िाले डबिा, कायगवाही
को इस प्रकार संचाडलत करिे के डलए तकिीकी-कािूिी उपाय अपिा सकता है, डिसमें दकसी व्यडि की
भौडतक उपडथथडत की आवश्यकता ि हो।

23. िेटा द़िड्युसरी या मध्यवती से सूचिा मांर्िा—(1) केंद्र सरकार, अडिडियम के ऐसे प्रयोििों के डलए, िो सातवीं
अिुसूची में जवडिर्िगष्ट हैं, उि अिुसूची में जवडिर्िगष्ट तत्थथािी प्राडिकृत व्यडि के माध्यम से कायग करते हुए, दकसी िेटा
द़िड्युसरी या मध्यवती से ऐसी सूचिा, डिसकी मांर् की िाए, उस अिुसूची में िी र्ई डिर्िगष्ट अवडि के भीतर प्रथतुत करिे
की अपेक्षा कर सकती है।
(2) िहां उप-डियम (1) में डिर्िगष्ट सूचिा के प्रकटीकरण से भारत की संप्रभुता और अखंिता या राज्य की सुरक्षा पर
प्रडतकूल प्रभाव पडिे की संभाविा है, केंद्र सरकार िेटा द़िड्युसरी या मध्यवती से यह अपेक्षा कर सकती है दक वह
प्राडिकृत व्यडि की पूवग डलडखत अिुमडत के डबिा प्रभाडवत िेटा थवामी या दकसी अन्य व्यडि को ऐसी सूचिा का खुलासा ि
करे।
(3) इस डियम के प्रयोििों के डलए, "मध्यवती" पि का वही अथग होर्ा िो सूचिा प्रौद्योडर्की अडिडियम, 2000 (2000
का 21) में इसके डलए डिर्िगष्ट है।

1. आवेिक भारत में डिर्डमत एक कंपिी है।
2. आवेिक के पास सहमडत प्रबंिक के रूप में अपिे िाडयत्वों को पूरा करिे के डलए तकिीकी, पररचालि और डविीय
क्षमता सडहत पयागप्त क्षमता है।
3. आवेिक की डविीय डथथडत और प्रबंिि का सामान्य थवरूप सुिृढ है।
4. आवेिक की डिवल संपडि िो करोड रुपए से कम िहीं है।
5. आवेिक के डलए उपलब्ि संभाडवत व्यवसाय की मात्रा और उसकी पूँिी संरचिा एवं आय की संभाविाएँ पयागप्त हैं।
6. आवेिक कंपिी के डििेिक, प्रमुख प्रबंिकीय कमगचारी और वररष्ठ प्रबंिि सामान्य प्रडतष्ठा और डिष्पक्षता एवं सत्यडिष्ठा
के ररकॉिग वाले व्यडि हैं।
7. आवेिक कंपिी के संथथा के ज्ञापि और संथथा के अिुच्छेिों में ऐसे प्राविाि हैं डििके अिुसार भार् ब की मि 9 और 10
के अंतर्गत िाडयत्वों का पालि दकया िािा आवश्यक है, ऐसे पालि को सुडिडश्चत करिे के डलए िीडतयाँ और प्रदक्रयाएँ
मौिूि हैं, और ऐसे प्राविािों में केवल बोिग के पूवग अिुमोिि से ही संिोिि दकया िा सकता है।
8. आवेिक द्वारा प्रथताडवत संचालि िेटा प्प्रंडसपल के डहत में हैं।
9. यह थवतंत्र रूप से प्रमाडणत दकया िाता है दक-
(क) आवेिक का अंतर-संचालिीय प्लेट़िॉमग, िो िेटा प्प्रंडसपल को अपिी सहमडत िेिे, प्रबंडित करिे, समीक्षा
करिे और वापस लेिे में सक्षम बिाता है, ऐसे िेटा संरक्षण मािकों और आश्वासि ढाँचे के अिुरूप है, डिन्हें
बोिग द्वारा समय-समय पर अपिी वेबसाइट पर प्रकाडित दकया िा सकता है; और
(ख) ऐसे मािकों और ढाँचे का पालि सुडिडश्चत करिे और भार् ख की मि 11 के अंतर्गत िाडयत्वों का प्रभावी
पालि सुडिडश्चत करिे के डलए उपयुि तकिीकी और संर्ठिात्मक उपाय मौिूि हैं।

1. सहमडत प्रबंिक, अपिे प्लेट़िॉमग का उपयोर् करिे वाले िेटा प्प्रंडसपल को, ऐसे प्लेट़िॉमग पर ऑिबोिग दकए र्ए िेटा
द़िड्यूिरी द्वारा उसके वैजयजिक िेटा के प्रसंथकरण के डलए सहमडत िेिे में सक्षम बिाएर्ा। यह सहमडत सीिे उस िेटा
द़िड्यूिरी को या ऐसे प्लेट़िॉमग पर ऑिबोिग दकए र्ए दकसी अन्य िेटा द़िड्यूिरी के माध्यम से िी िाएर्ी, िो उस िेटा
प्प्रंडसपल की सहमडत से ऐसे वैजयजिक िेटा का रखरखाव करता है।
उिाहरण
व्यडि, सहमडत प्रबंिक द्वारा संचाडलत प्लेट़िॉमग P के माध्यम से अपिे वैजयजिक िेटा के प्रसंथकरण के डलए अपिी सहमडत
िे सकते हैं, उसका प्रबंिि कर सकते हैं, उसकी समीक्षा कर सकते हैं और उसे वापस ले सकते हैं। X, एक व्यडि, P पर एक
पंिीकृत उपयोर्कताग है। B1 और B2, P पर ऑिबोिग दकए र्ए बैंक हैं।
मामला 1: B1, अपिे बैंक खाता डववरण में डिडहत वैजयजिक िेटा के प्रसंथकरण के डलए सहमडत हेतु P पर X को एक
अिुरोि भेिती है। X, अपिे डिडिटल लॉकर में बैंक खाता डववरण को एक डिडिटल ररकॉिग के रूप में रखती है। X, B1 को
सीिे अपिी सहमडत िेिे के डलए P का उपयोर् करती है, और B1 को अपिे बैंक खाता डववरण तक पहुँच प्रिाि करती है।
मामला 2: B1, अपिे बैंक खाते के डववरण में डिडहत वैजयजिक िेटा को संसाडित करिे के डलए सहमडत हेतु P के माध्यम
से X को अिुरोि भेिती है। X, B2 के साथ अपिा बैंक खाता रखती है। X, B2 के माध्यम से B1 तक अपिी सहमडत भेििे
के डलए P का उपयोर् करती है, साथ ही B2 को डिडिटल रूप से डििेि िेती है दक वह B1 को अपिा बैंक खाता डववरण
भेिे। B2, B1 को बैंक खाता डववरण भेिती है।
2. सहमडत प्रबंिक यह सुडिडश्चत करेर्ा दक वैजयजिक िेटा उपलब्ि करािे या उसे साझा करिे का तरीका ऐसा हो दक
उसकी सामग्री उसके द्वारा पढी ि िा सके।
3. सहमडत प्रबंिक अपिे प्लेट़िॉमग पर डिम्नडलडखत का ररकॉिग रखेर्ा, अथागत्:—
(क) उसके द्वारा िी र्ई, अथवीकृत या वापस ली र्ई सहमडत;
(ख) सहमडत के अिुरोि से पहले या साथ में दिए र्ए िोरटस; और
(र्) हथतांतररती िेटा द़िड्युिरी के साथ उसके वैजयजिक िेटा को साझा करिा।
4. सहमडत प्रबंिक:—
(क) ऐसे प्लेट़िॉमग का उपयोर् करिे वाले िेटा प्प्रंडसपल को ऐसे ररकॉिग तक पहुँच प्रिाि करेर्ा;
(ख) िेटा प्प्रंडसपल के अिुरोि पर और उसकी सेवा ितों के अिुसार, उसे ऐसे अडभलेख में डिडहत िािकारी
मिीि-पठिीय रूप में उपलब्ि कराएर्ा; और
(र्) ऐसे अडभलेख को कम से कम सात वर्ों तक, या उससे अडिक अवडि तक, डिस पर िेटा प्प्रंडसपल और
सहमडत प्रबंिक सहमत हों, या िैसा दक कािूि द्वारा अपेडक्षत हो, बिाए रखेर्ा।

5. सहमडत प्रबंिक एक वेबसाइट या ऐप, या िोिों का डवकास और रखरखाव प्राथडमक माध्यम के रूप में करेर्ा डिसके
माध्यम से िेटा प्प्रंडसपल सहमडत प्रबंिक द्वारा प्रिाि की र्ई सेवाओं तक पहुँच प्राप्त कर सकेर्ा।
6. सहमडत प्रबंिक अडिडियम और इि डियमों के तहत अपिे दकसी भी िाडयत्व के डिष्पािि को उप-अिुबंडित या िहीं
सौंपेर्ा ।
7. सहमडत प्रबंिक वैजयजिक िेटा भंर् को रोकिे के डलए उडचत सुरक्षा उपाय करेर्ा।
8. सहमडत प्रबंिक िेटा प्प्रंडसपल के संबंि में एक द़िड्युसरी क्षमता में कायग करेर्ा।
9. सहमडत प्रबंिक िेटा द़िड्युसरी के साथ डहतों के टकराव से बचेर्ा, डिसमें उिके प्रमोटरों और प्रमुख प्रबंिकीय कर्मगयों
के संबंि में भी िाडमल है।
10. सहमडत प्रबंिक यह सुडिडश्चत करिे के डलए उपाय करेर्ा दक उसके डििेिकों, प्रमुख प्रबंिकीय कार्मगकों और वररष्ठ
प्रबंिि के पास िेटा द़िड्युिरीज़ में डििेिक पि, डविीय डहत, रोज़र्ार या लाभकारी थवाडमत्व होिे, या उिके साथ कोई
भौडतक आर्थगक संबंि होिे के कारण डहतों का कोई टकराव ि हो।
11. सहमडत प्रबंिक अपिी वेबसाइट या ऐप, या िोिों पर, िैसा भी मामला हो, आसािी से सुलभ तरीके से डिम्नडलडखत
के बारे में िािकारी प्रकाडित करेर्ा: -
(क) सहमडत प्रबंिक के रूप में पंिीकृत कंपिी के प्रवतगक, डििेिक, प्रमुख प्रबंिकीय कार्मगक और वररष्ठ प्रबंिि;
(ख) प्रत्येक व्यडि िो सहमडत प्रबंिक के रूप में पंिीकृत कंपिी की िेयरिाररता के िो प्रडतित से अडिक िेयर
रखता है;
(र्) प्रत्येक कॉपोरेट डिसकी िेयरिाररता में सहमडत प्रबंिक का कोई प्रवतगक, डििेिक, प्रमुख प्रबंिकीय कार्मगक
या वररष्ठ प्रबंिि डपछले कैलेंिर माह के पहले दिि तक िो प्रडतित से अडिक िेयर रखता है; और
(घ) ऐसी अन्य िािकारी डिसे बोिग पारिर्िगता के डहत में सहमडत प्रबंिक को प्रकट करिे का डििेि िे सकता है।
12. सहमडत प्रबंिक के पास ऐसे लेखापरीक्षा पररणामों की समीक्षा, डिर्रािी, मूल्यांकि और बोिग को समय-समय पर
और ऐसे अन्य अवसरों पर, िैसा दक बोिग डििेडित करे, ररपोटग करिे के डलए प्रभावी लेखापरीक्षा तंत्र थथाडपत होंर्े, िो
डिम्नडलडखत के संबंि में होंर्े -
(क) तकिीकी और संर्ठिात्मक डियंत्रण, प्रणाडलयाँ, प्रदक्रयाएँ और सुरक्षा उपाय;
(ख) पंिीकरण की ितों का डिरंतर पालि; और
(र्) अडिडियम और इि डियमों के तहत अपिे िाडयत्वों का पालि।
13. सहमडत प्रबंिक के रूप में पंिीकृत कंपिी का डियंत्रण डबक्री, डवलय या अन्यथा दकसी भी प्रकार से हथतांतररत िहीं
दकया िाएर्ा, डसवाय बोिग के पूवग अिुमोिि के और ऐसी ितों की पूर्तग के अिीि, डिन्हें बोिग इस संबंि में डिर्िगष्ट कर
सकता है।

(क) "डिर्म डिकाय" में कंपिी अडिडियम, 2013 (2013 का 18) की िारा 2 के खंि (11) के अंतर्गत पररभाडर्त कंपिी,
डिर्डमत डिकाय, फमग, डविीय संथथाि, अिुसूडचत बैंक या दकसी केंद्रीय अडिडियम, प्रांतीय अडिडियम या राज्य

(घ) "प्रवतगक" और "वररष्ठ प्रबंिि" पिों के वही अथग होंर्े िो कंपिी अडिडियम, 2013 (2013 का 18) में क्रमिः उिके
डलए डिर्िगष्ट हैं।

िारा 7 के खंि (ख) के अंतर्गत राज्य और उसके डिकायों द्वारा वैजयजिक िेटा के प्रसंथकरण और िारा 17 की उप-िारा (2)
के खंि (ख) में जवडिर्िगष्ट उद्देश्यों के डलए आवश्यक वैजयजिक िेटा के प्रसंथकरण के जलए मािक
वैजयजिक िेटा के प्रसंथकरण के डलए, लार्ू कािूि के अिुसार, डिम्नडलडखत का प्रभावी पालि सुडिडश्चत करिे हेतु उपयुि
तकिीकी और संर्ठिात्मक उपायों का कायागन्वयि, अथागत्: -
(क) प्रसंथकरण डवडिसम्मत तरीके से दकया िाता है;
(ख) प्रसंथकरण अडिडियम की िारा 7 के खंि (ख) में डिर्िगष्ट उपयोर्ों के डलए या अडिडियम की िारा 17 की उप-िारा
(2) के खंि (ख) में डिर्िगष्ट उद्देश्यों के डलए दकया िाता है, िैसा भी मामला हो;
(र्) प्रसंथकरण ऐसे वैजयजिक िेटा तक सीडमत है िो ऐसे उपयोर्ों या ऐसे उद्देश्यों की प्राडप्त के डलए आवश्यक है, िैसा भी
मामला हो;
(घ) प्रसंथकरण वैजयजिक िेटा की पूणगता, सटीकता और एकरूपता सुडिडश्चत करिे के डलए उडचत प्रयास करते हुए दकया
िाता है;
(ड.) वैजयजिक िेटा को ऐसे उपयोर्ों या ऐसे उद्देश्यों की प्राडप्त के डलए, िैसा भी मामला हो, या वतगमाि में लार्ू दकसी
कािूि के अिुपालि हेतु आवश्यक होिे तक बिाए रखा िाता है;
(च) िेटा द़िड्युसरी के कब्िे या डियंत्रण में वैजयजिक िेटा की सुरक्षा के डलए वैजयजिक िेटा भंर् को रोकिे हेतु उडचत
सुरक्षा उपाय, डिसमें उसके द्वारा या उसकी ओर से िेटा प्रोसेसर द्वारा दकए र्ए दकसी भी प्रसंथकरण के संबंि में
िाडमल है;
(छ) िहां अडिडियम की िारा 7 के खंि (बी) के तहत प्रसंथकरण दकया िािा है, वहां िेटा प्प्रंडसपल को इसके संबंि में
सूचिा िेते हुए ऐसा दकया िाता है और—
(i) उस व्यडि की व्यावसाडयक संपकग िािकारी िेिा िो िेटा द़िड्युसरी की ओर से उसके वैजयजिक िेटा के
प्रसंथकरण के बारे में िेटा प्प्रंडसपल के प्रश्नों का उिर िेिे में सक्षम हो;

(ii) ऐसे िेटा द़िड्युसरी की वेबसाइट या ऐप, या िोिों तक पहुँचिे के डलए डविेर् संचार प्लंक डिर्िगष्ट करिा, और
अन्य साििों का डववरण, यदि कोई हो, डिसका उपयोर् करके ऐसा िेटा प्प्रंडसपल अडिडियम के तहत अपिे
अडिकारों का प्रयोर् कर सकता है; और
(iii) ऐसे अन्य मािकों के अिुरूप दकया िाता है िो केंद्र सरकार द्वारा िारी िीडत या उस समय लार्ू दकसी कािूि
के तहत ऐसे वैजयजिक िेटा के प्रसंथकरण पर लार्ू हो सकते हैं; और
(ि) इि मािकों के प्रभावी पालि के डलए, उस व्यडि की िवाबिेही िो अकेले या अन्य व्यडियों के साथ डमलकर
वैजयजिक िेटा के प्रसंथकरण के उद्देश्य और सािि का डििागरण करता है।

सामाि या सेवाओं की पेिकि करिे वाला डवक्रेता िाडमल िहीं है;
(ख) “ऑिलाइि र्ेप्मंर् मध्यवती”से ऐसा कोई मध्यवती अजभप्रेत है िो अपिे कंप्यूटर संसािि के उपयोर्कतागओं को
एक या अडिक ऑिलाइि र्ेम का अजभगम करिे में सक्षम बिाता है;
(र्) “सोिल मीडिया मध्यवती”से ऐसा कोई मध्यवती अजभप्रेत है िैसा दक सूचिा प्रौद्योडर्की अडिडियम, 2000
(2000 का 21वां) में पररभाडर्त दकया र्या है िो मुख्य रूप से या पूरी तरह से िो या अडिक उपयोर्कतागओं
के बीच ऑिलाइि बातचीत को सक्षम बिाता है और उन्हें अपिी सेवाओं का उपयोर् करके िािकारी बिािे,
अपलोि करिे, साझा करिे, प्रसाररत करिे, संिोडित करिे या उस तक पहुँचिे की अिुमडत िेता है; और
(घ) “उपयोर्कताग, के संबंि में—
(i) एक ई-कॉमसग इकाई, से तात्पयग ऐसे दकसी व्यडि से है िो दकसी ई-कॉमसग इकाई के दकसी कंप्यूटर संसािि
तक पहुँचता है या उसका लाभ उठाता है; और
(ii) ऑिलाइि र्ेप्मंर् मध्यवती या सोिल मीडिया मध्यवती का अथग है कोई भी व्यडि िो सूचिा को होथट
करिे, प्रकाडित करिे, साझा करिे, लेि-िेि करिे, िेखिे, प्रिर्िगत करिे, िाउिलोि करिे या अपलोि
करिे के उद्देश्य से मध्यवती के दकसी भी कंप्यूटर संसािि तक पहुँचता है या उसका लाभ उठाता है।

दकसी भी थवाथथ्य िेखभाल उपचार और रेफरल योििा
के कायागन्वयि का समथगि करिे तक सीडमत है, िो उसके
थवाथथ्य की सुरक्षा के डलए आवश्यक है
3.
एक िेटा द़िड्युसरी िो एक िैक्षडणक संथथाि
है
प्रसंथकरण ट्रैककंर् और व्यवहाररक डिर्रािी तक सीडमत
है –
(क) ऐसी संथथा की िैडक्षक र्डतडवडियों के डलए; या
(ख) ऐसी संथथा में िामांदकत बच्चे की सुरक्षा के डहत में।
4.
िेटा द़िड्युसरी वह व्यडि होता है डिसकी
िेखभाल में क्रेच या चाइल्ि िे केयर सेंटर में
डििुओं और बच्चों को सौंपा िाता है
ऐसी संथथा, डििुर्ृह या केंद्र की िेखभाल में सौंपे र्ए
बच्चे की सुरक्षा के डहत में प्रसंथकरण को ट्रैककंर् और
व्यवहाररक डिर्रािी तक सीडमत रखा र्या है।
5.
एक िेटा द़िड्युसरी डिसे दकसी िैक्षडणक
संथथाि, क्रेच या चाइल्ि केयर सेंटर द्वारा ऐसे
संथथाि, क्रेच या केंद्र में िामांदकत बच्चों के
पररवहि के डलए डियुि दकया िाता है
ऐसे बच्चे की सुरक्षा के डहत में, ऐसे संथथाि, डििुर्ृह या
केंद्र से आिे-िािे के िौराि उिके थथाि पर िज़र रखिे
तक ही प्रसंथकरण को सीडमत दकया र्या है।

प्रसंथकरण, ऐसे बच्चे की सुरक्षा और संरक्षण के डहत में,
उसके वाथतडवक समय के थथाि की ट्रैककंर् तक सीडमत
है।
5.
यह सुडिडश्चत करिा दक कोई भी सूचिा, सेवा
या डवज्ञापि, डिससे बच्चे के थवाथथ्य पर कोई
हाडिकारक प्रभाव पडिे की संभाविा हो, उस
तक ि पहुंचे।
प्रसंथकरण को उस सीमा तक प्रडतबंडित दकया िाता है,
डिससे यह सुडिडश्चत हो सके दक ऐसी िािकारी, सेवा
या डवज्ञापि बच्चे के डलए सुलभ ि हो।
6.
िेटा द़िड्युसरी द्वारा इस बात की पुडष्ट के डलए
दक िेटा प्प्रंडसपल बच्चे िहीं है और डियम 10
के तहत उडचत पररश्रम का पालि
प्रसंथकरण ऐसी पुडष्ट या पालि के डलए आवश्यक सीमा
तक ही प्रडतबंडित है।
िोट: इस अिुसूची में, -
(क) "डवज्ञापि" का वही अथग अजभप्रेत होर्ा िो उपभोिा संरक्षण अडिडियम, 2019 (2019 का 35वां) में दिया र्या
है।
(क) "संबद्ध थवाथथ्य िेखभाल पेिेवर" का वही अथग अजभप्रेत होर्ा िो राष्ट्रीय संबद्ध और थवाथथ्य िेखभाल व्यवसाय
आयोर् अडिडियम, 2021 (2021 का 14वां) की िारा 2 के खंि (घ) में दिया र्या है;
(ख) "िैिाडिक प्रडतष्ठाि" का वही अथग अजभप्रेत होर्ा िो िैिाडिक प्रडतष्ठाि (पंिीकरण और डवडियमि) अडिडियम,

अध्यक्ष और अन्य सिथयों की सेवा संबंिी डिबंिि और ितें
1. वेति-(1) अध्यक्ष को मकाि और कार की सुडविा के डबिा, प्रडतमाह चार लाख पचास हिार रुपए का समेदकत
वेति प्राप्त करिे का अडिकार होर्ा।
(2) अध्यक्ष के अलावा प्रत्येक सिथय को मकाि और कार की सुडविा के डबिा, प्रडतमाह चार लाख रुपए का समेदकत
वेति प्राप्त करिे का अडिकार होर्ा।
2. भडवष्य डिडि-अध्यक्ष और प्रत्येक अन्य सिथय बोिग की भडवष्य डिडि में अंििाि करिे के डलए पात्र होंर्े, तथा इस
संबंि में लार्ू तरीके और डियम एवं ितें, यथावश्यक पररवतगिों सडहत, वही होंर्ी िो बोिग के अन्य अडिकाररयों और
कमगचाररयों को उिकी भडवष्य डिडि के डलए लार्ू हैं।
3. पेंिि और ग्रेच्युटी-अध्यक्ष और प्रत्येक अन्य सिथय बोिग में की र्ई सेवा के डलए पेंिि या ग्रेच्युटी के भुर्ताि के
हकिार िहीं होंर्े।
4. यात्रा भिा-(1) अध्यक्ष और प्रत्येक अन्य सिथय, बोिग में िाडमल होिे के डलए थथािांतरण के समय, या बोिग के
साथ अपिे कायगकाल की समाडप्त पर पररवार के साथ अपिे र्ृह िर्र िािे के डलए (उसके और उसके पररवार द्वारा
की र्ई यात्रा के संबंि में भी िाडमल है), या भारत के भीतर िौरे पर, यात्रा भिा, िैडिक भिा और वैजयजिक सामाि
के पररवहि पर व्यय की प्रडतपूर्तग ऐसे वेतिमािों और िरों पर पािे के हकिार होंर्े िो वेति मैरट्रक्स के डिम्नडलडखत
थतर में केंद्रीय सरकार के अडिकारी को लार्ू हैं, अथागत्:—
(क) थतर 17, अध्यक्ष के मामले में; और
(ख) थतर 15, प्रत्येक अन्य सिथय के मामले में।
(2) अध्यक्ष और प्रत्येक अन्य सिथय भारत के बाहर केवल केंद्रीय सरकार द्वारा िारी दििाडििेिों या डििेिों के
अिुसार िौरा कर सकते हैं, और ऐसे िौरे के संबंि में, वह वही भिे पािे के हकिार होंर्े िो वेति मैरट्रक्स के
डिम्नडलडखत थतर में केंद्रीय सरकार के अडिकारी पािे के हकिार हैं, अथागत्:—
(क) थतर 17, अध्यक्ष के मामले में; तथा
(ख) थतर 15, प्रत्येक अन्य सिथय के मामले में।
5. डचदकत्सा सहायता-(1) अध्यक्ष तथा प्रत्येक अन्य सिथय बोिग के अडिकाररयों तथा कमगचाररयों और उिके पात्र आडश्रतों
के डलए बोिग की दकसी समूह थवाथथ्य बीमा योििा के अंतर्गत उन्हें थवीकायग डचदकत्सा सहायता के हकिार होंर्े।
(2) यदि अध्यक्ष या अन्य सिथय सरकारी सेवा से, या दकसी सावगिडिक क्षेत्र की इकाई या दकसी केंद्रीय अडिडियम, प्रांतीय
अडिडियम या राज्य अडिडियम द्वारा थथाडपत डिर्डमत डिकाय की सेवा से सेवाडिवृि हो र्ए हैं, और ऐसी सेवा के डलए
डचदकत्सा सहायता प्रिाि करिे के डलए अलर् डियम हैं, तो वह उप-अिुच्छेि (1) के अंतर्गत डचदकत्सा सहायता के बिले में
ऐसे डियमों द्वारा िाडसत होिे का डवकल्प चुि सकते हैं।

6. छुट्टी.-(1) अध्यक्ष के संबंि में छुट्टी थवीकृत करिे के डलए सक्षम प्राडिकारी केंद्रीय सरकार होर्ी, और दकसी अन्य सिथय
के संबंि में अध्यक्ष होर्ा।
(2) अध्यक्ष तथा प्रत्येक अन्य सिथय ऐसे प्रकार के अवकाि का लाभ उठा सकेंर्े िो केन्द्रीय डसडवल सेवा (अवकाि) डियम,
1972 (डिसे इसके पश्चात् "अवकाि डियम" कहा िाएर्ा) के डियम 26 के उपडियम (1) के खण्ि (क) के उपखण्ि (i) तथा
खण्ि (ख), डियम 27, 29, 30 तथा 40 से 43- र् के अन्तर्गत सरकारी सेवक को अिुमन्य हैं।
(3) अवकाि, अवकाि डियमों के डियम 7 से 11 तथा 22 से 25 के अन्तर्गत सरकारी सेवक पर लार्ू ितों के अिीि होर्ा
तथा केन्द्रीय सरकार, यदि संतुष्ट हो दक उि डियमों में से दकसी के दक्रयान्वयि से दकसी डविेर् मामले में अिुडचत करठिाई
होती है, तो वह आिेि द्वारा उस डियम की अपेक्षाओं को उस सीमा तक तथा ऐसे अपवािों तथा ितों के अिीि डिडथल कर
सकेर्ी डिन्हें वह मामले को न्यायसंर्त तथा समतापूणग तरीके से डिपटािे के डलए आवश्यक समझे।
(4) अध्यक्ष तथा प्रत्येक अन्य सिथय, केन्द्रीय सरकार द्वारा िारी अिुिेिों के अन्तर्गत सरकारी सेवक को अिुमन्य सीमा तक
आकडथमक अवकाि के हकिार होंर्े।
(5) अध्यक्ष तथा प्रत्येक अन्य सिथय, अपिे खाते में िमा अर्िगत अवकाि के िकिीकरण के हकिार होंर्े, ऐसी ितों तथा
उसी प्रकार के अिीि िो डियम 38-क, उपडियम (1) तथा (2) तथा डियम 39 के उपडियम (6) के खण्ि (क) के उपखण्ि
(i) तथा (ii), डियम 39-क तथा डियम 39-र् के अन्तर्गत सरकारी सेवक पर लार्ू होते हैं, डियम 38-क को छोडकर उि
डियमों में से दकसी के अन्तर्गत िकिीकरण की अडिकतम सीमा, अपिे खाते में िमा अर्िगत अवकाि के पचास प्रडतित के
अिीि होर्ी।
7. छुट्टी यात्रा ररयायत.- (1) अध्यक्ष और प्रत्येक अन्य सिथय को केंद्रीय डसडवल सेवा (छुट्टी यात्रा ररयायत) डियम, 1988
के डियम 3, डियम 4 के खंि (क) और (घ), डियम 5 से 15 और डियम 17 के अिीि भारत संघ के कायों के संबंि में
डसडवल सेवाओं और पिों पर डियुि व्यडियों पर लार्ू प्राविािों के अिुसार छुट्टी यात्रा ररयायत थवीकायग होर्ी और ऐसी
ररयायत के डलए पात्रता वही होर्ी िो अध्यक्ष के मामले में वेति मैरट्रक्स के थतर 17 में केंद्रीय सरकार के अडिकाररयों के
डलए लार्ू है, और सिथय के मामले में वेति मैरट्रक्स के थतर 15 में केंद्रीय सरकार के अडिकाररयों के डलए लार्ू है।
(2) अध्यक्ष और प्रत्येक अन्य सिथय या तो छुट्टी यात्रा ररयायत का लाभ उठािे के डलए पात्र होंर्े या सिथय के रूप में
अपिा पिभार ग्रहण करिे की डतडथ से िो वर्ग की दकसी भी अवडि में भारत में दकसी भी थथाि की यात्रा के डलए पात्र
होंर्े।
8. सेवा की अन्य डिबंिि और ितें.-(1) अध्यक्ष और प्रत्येक अन्य सिथय यह सुडिडश्चत करेंर्े दक उिके पि के कायों के
डिष्पािि में डहतों का टकराव ि हो और उिका कोई ऐसा डविीय या अन्य डहत िहीं होर्ा डिससे ऐसे पि के कायों के
डिष्पािि पर प्रडतकूल प्रभाव पडिे की संभाविा हो।
(2) केंद्रीय डसडवल सेवा (वर्ीकरण, डियंत्रण और अपील) डियम, 1965 के भार् IV से भार् IX में डिडहत प्राविाि, िो
केंद्रीय सरकार के दकसी अडिकारी पर लार्ू होते हैं िो केंद्रीय डसडवल सेवा, समूह 'क' का सिथय है, अध्यक्ष और प्रत्येक
अन्य सिथय पर यथावश्यक पररवतगिों सडहत लार्ू होंर्े।

(3) अध्यक्ष और प्रत्येक अन्य सिथय बोिग की बैठकों में भार् लेिे के डलए दकसी बैठक िुल्क के हकिार िहीं होंर्े।
(4) अध्यक्ष और प्रत्येक अन्य सिथय दकसी सत्कार भिे के हकिार िहीं होंर्े।
(5) अध्यक्ष या दकसी अन्य सिथय की सेवा की ितों से संबंडित कोई मामला, डिसके संबंि में इि डियमों में कोई थपष्ट
प्राविाि िहीं दकया र्या है, केन्द्रीय सरकार को उसके डिणगय के डलए भेिा िाएर्ा और उस पर केन्द्र सरकार का डिणगय
अंडतम होर्ा।
9. इस अिुसूची में, "वेति मैरट्रक्स" का अथग 25 िुलाई, 2016 की अडिसूचिा संख्या 1-2/2016-आईसी द्वारा आडिकाररक
रािपत्र में प्रकाडित केन्द्रीय सरकार के संकल्प के अिुलग्नक 1 में यथाडवडिर्िगष्ट वेति मैरट्रक्स होर्ा।

बोिग के अडिकाररयों और कमगचाररयों की डियुडि और सेवा की ितें
1. अडिकाररयों की श्रेडणयाँ- (1) बोिग कार्मगक, लोक डिकायत और पेंिि मंत्रालय, कार्मगक और प्रडिक्षण डवभार् द्वारा
िारी मौडलक डियमों और लार्ू दििा-डििेिों के अिुसार, केंद्र सरकार, राज्य सरकार, केंद्र सरकार या राज्य सरकार के
समग्र डियंत्रण के तहत एक थवायि डिकाय, एक सांडवडिक डिकाय, या सावगिडिक क्षेत्र के उद्यम से पांच साल से अडिक
की अवडि के डलए प्रडतडियुडि पर अडिकाररयों और कमगचाररयों की डियुडि कर सकता है।
(2) बोिग िेििल इंथटीट्यूट फॉर थमाटग र्विगमेंट से दकसी भी अडिकारी या अन्य कमगचारी को पांच साल से अडिक की
अवडि के डलए बािार मािकों द्वारा डििेडित वेति और भिे के साथ और ऐसे अन्य डिबंिि और ितें पर प्राप्त या
प्रडतडियुि कर सकता है, िैसा दक बोिग तय कर सकता है।
2. ग्रेच्युटी- अडिकारी और कमगचारी ऐसे ग्रेच्युटी के भुर्ताि के हकिार होंर्े, िो ग्रेच्युटी भुर्ताि अडिडियम, 1972
(1972 का 39) के तहत थवीकायग हो सकते हैं।
3. यात्रा भिा- अडिकाररयों और कमगचाररयों को िेय यात्रा भिा, यथावश्यक पररवतगिों सडहत, वही होर्ा िो केन्द्रीय
सरकार के अडिकाररयों और कमगचाररयों के डलए लार्ू है।
4. डचदकत्सा सहायता- अडिकारी और कमगचारी ऐसी डचदकत्सा सहायता के हकिार होंर्े िो उन्हें और उिके पात्र आडश्रतों
को केन्द्रीय सरकार के पूवग अिुमोिि से बोिग की दकसी समूह थवाथथ्य बीमा योििा के अन्तर्गत अिुमन्य हो।
5. छुट्टी- (1) अडिकारी और कमगचारी केन्द्रीय डसडवल सेवा (छुट्टी) डियम, 1972 के अन्तर्गत सरकारी सेवक को अिुमन्य
छुरट्टयों का लाभ उठा सकते हैं, िो उि डियमों के अन्तर्गत लार्ू ितों के अिीि हैं, और वे उसमें उपबडन्ित अर्िगत छुरट्टयों
के िकिीकरण के डलए पात्र होंर्े।
(2) अडिकारी और कमगचारी उस सीमा तक आकडथमक छुट्टी के हकिार होंर्े िो केन्द्रीय सरकार द्वारा िारी अिुिेिों के
अन्तर्गत सरकारी सेवक के डलए अिुमन्य है।

6. छुट्टी यात्रा ररयायत- छुट्टी यात्रा ररयायत, पैरा 1 के खंि (1) के अिीि डियुि अडिकाररयों और कमगचाररयों को, केन्द्रीय
डसडवल सेवा (छुट्टी यात्रा ररयायत) डियम, 1988 के अिीि डसडवल सेवाओं और भारत संघ के कायगकलापों से संबंडित पिों
पर डियुि व्यडियों पर लार्ू उपबंिों के अिुसार अिुमेय होर्ी।
7. सेवा की अन्य डिबंिि और ितें-(1) डसडवल सेवा (आचरण) डियम, 1964 के उपबंि, अडिकाररयों और कमगचाररयों पर
उसी प्रकार लार्ू होंर्े, िैसे दक उि डियमों के अिीि भारत संघ के कायगकलापों से संबंडित दकसी डसडवल सेवा या पि पर
डियुि व्यडि पर लार्ू होते हैं।
(2) केन्द्रीय डसडवल सेवा (वर्ीकरण, डियंत्रण और अपील) डियम, 1965 के भार् IV से भार् IX में अंतर्वगष्ट उपबंि,
यथावश्यक पररवतगिों सडहत, पैरा 1 के खंि (1) के अिीि डियुि अडिकाररयों और कमगचाररयों पर उसी प्रकार लार्ू होंर्े,
िैसे दक उि डियमों के अिीि दकसी सरकारी सेवक पर लार्ू होते हैं।
(3) पैरा 1 के खंि (1) के अिीि डियुि अडिकाररयों और कमगचाररयों की सेवा के डिबंििों और ितों से संबंडित कोई

NOTIFICATION
New Delhi, the 13th November, 2025
G.S.R. 846(E).––– Whereas draft of the Digital Personal Data Protection Rules, 2025 were
published, as required under sub-section (1) of section 40 of the of the Digital Personal Data Protection
Act, 2023 (22 of 2023), vide notification of the Government of India in the Ministry of Electronics and
Information Technology vide number G.S.R. 02 (E), dated the 3rd January, 2025, in the Gazette of India,
Extraordinary, Part II, Section 3, Sub-section (i), dated the 3rd January, 2025, inviting objections and
suggestions from all persons likely to be affected thereby, before the expiry of the period of forty-five days
from the date on which copies of the Official Gazette containing the said notification were made available
to public;
And whereas copies of the said Official Gazette were made available to the public on the 3rd January,
2025;
And whereas objections and suggestions were received from the public in respect of the said draft
rules have been considered by the Central Government;
Now, therefore in exercise of powers conferred by sub-sections (1) and (2) of section 40 of the
Digital Personal Data Protection Act, 2023 (22 of 2023), the Central Government hereby makes the
following rules, namely: —
1. Short title and commencement. — (1) These rules may be called the Digital Personal Data Protection
Rules, 2025.
(2) Rules 1, 2 and 17 to 21 shall come into force on the date of their publication in the Official Gazette.
(3) Rule 4 shall come into force one year after the date of publication of this Gazette.
(4) Rules 3, 5 to 16, 22 and 23 shall come into force eighteen months after the date of publication
of this Gazette.
2. Definitions. — (1) In these rules, unless the context otherwise requires, –
(a) “Act” means the Digital Personal Data Protection Act, 2023 (22 of 2023);
(b) “techno-legal measures” means as referred to under rules 20 and 22;
(c) “user account” means the online account registered by the Data Principal with the Data Fiduciary, and
includes any profiles, pages, handles, email address, mobile number and other similar presences by means
of which such Data Principal is able to access the services of such Data Fiduciary; and
(d) “verifiable consent” means a consent as specified in rule 10 or 11.
(2) The words and expressions used in these rules and not defined, but defined in the Act, shall have the
same meanings respectively assigned to them in the Act.
3. Notice given by Data Fiduciary to Data Principal. —The notice given by the Data Fiduciary to the
Data Principal shall—
(a) be presented and be understandable independently of any other information that has been, is or may
be made available by such Data Fiduciary;
(b) give, in clear and plain language, a fair account of the details necessary to enable the Data Principal
to give specific and informed consent for the processing of her personal data, which shall include,
at the minimum, —
(i) an itemised description of such personal data; and
(ii) the specified purpose or purposes of, and specific description of the goods or services to be
provided or uses to be enabled by, such processing; and
(c) give, the particular communication link for accessing the website or app, or both, of such Data
Fiduciary, and a description of other means, if any, using which such Data Principal may—

(i)
withdraw her consent, with the ease of doing so being comparable to that with which
such consent was given;
(ii)
exercise her rights under the Act; and
(iii) make a complaint to the Board.
4. Registration and obligations of Consent Manager. — (1) A person who fulfils the conditions for
registration of Consent Managers set out in Part A of First Schedule may apply to the Board for registration
as a Consent Manager by furnishing such particulars and such other information and documents as the
Board may publish in this behalf on its website.
(2) On receipt of such application, the Board may make such inquiry as it may deem fit to satisfy itself
regarding fulfilment of the conditions set out in Part A of First Schedule, and if it—
(a) is satisfied, register the applicant as a Consent Manager, under intimation to the applicant, and
publish on its website the particulars of such Consent Manager; or
(b) is not satisfied, reject the application and communicate the reasons for the rejection to the
applicant.
(3) The Consent Manager shall have obligations as specified in Part B of First Schedule.
(4) If the Board is of the opinion that a Consent Manager is not adhering to the conditions and obligations
under this rule,it may, after giving an opportunity of being heard, inform the Consent Manager of such non-
adherence and direct the Consent Manager to take measures to ensure adherence.
(5) The Board may, if it is satisfied that it is necessary so to do in the interests of Data Principals, after
giving the Consent Manager an opportunity of being heard, by order, for reasons to be recorded in writing,
—
(a) suspend or cancel the registration of such Consent Manager; and
(b) give such directions as it may deem fit to that Consent Manager, to protect the interests of the Data
Principals.
(6) The Board may, for the purposes of this rule, require the Consent Manager to furnish such information
as the Board may call for.
5. Processing of personal data for provision or issue of subsidy, benefit, service, certificate, licence or
permit by State and its instrumentalities. — (1) Processing the personal data of a Data Principal under
this rule shall be done following the standards specified in Second Schedule.
(2) In this rule and the Second Schedule, the reference to any subsidy, benefit, service, certificate, licence
or permit that is provided or issued—
(a) under law shall be construed as a reference to provision or issuance of such subsidy, benefit,
service, certificate, licence or permit in exercise of any power of or the performance of any
function by the State or any of its instrumentalities under any law for the time being in force;
(b) under policy shall be construed as a reference to provision or issuance of such subsidy, benefit,
service, certificate, licence or permit under any policy or instruction issued by the Central
Government or a State Government in exercise of its executive power; and
(c) using public funds shall be construed as a reference to provision or issuance of such subsidy,
benefit, service, certificate, licence or permit by incurring expenditure on the same from, or with
accrual of receipts to, —
(i) in case of the Central Government or a State Government, the Consolidated Fund of India
or the Consolidated Fund of the State or the public account of India or the public
account of the State; or
(ii) in case of any local or other authority within the territory of India or under the control of
the Government of India or of any State, the fund or funds of such authority.

6. Reasonable security safeguards. — (1) A Data Fiduciary shall protect personal data in its possession or
under its control, including in respect of any processing undertaken by it or on its behalf by a Data
Processor, by taking reasonable security safeguards to prevent personal data breach, which shall include, at
the minimum, —
(a) appropriate data security measures, such as securing of personal data through encryption,
obfuscation, masking or the use of virtual tokens mapped to that personal data;
(b) appropriate measures to control access to the computer resources used by such Data Fiduciary or
such a Data Processor, wherever applicable;
(c) visibility on the accessing of such personal data, through appropriate logs, monitoring and review,
for enabling detection of unauthorised access, its investigation and remediation to prevent
recurrence;
(d) reasonable measures for continued processing in the event of confidentiality, integrity or
availability of such personal data being compromised as a result of destruction or loss of access to
personal data or otherwise, such as by way of data-backups;
(e) for enabling the detection of unauthorised access, its investigation, remediation to prevent
recurrence and continued processing in the event of such a compromise, retain such logs and
personal data for a period of one year, unless compliance with any law for the time being in force
requires otherwise;
(f) appropriate provision in the contract entered into between such Data Fiduciary and such a Data
Processor, wherever applicable, for taking reasonable security safeguards; and
(g) appropriate technical and organisational measures to ensure effective observance of security
safeguards.
(2) In this rule, the expression “computer resource” shall have the same meaning as is assigned to it in
Information Technology Act, 2000 (21 of 2000).
7. Intimation of personal data breach. — (1) On becoming aware of any personal data breach, the Data
Fiduciary shall, to the best of its knowledge, intimate to each affected Data Principal, in a concise, clear and
plain manner and without delay, through her user account or any mode of communication registered by her
with the Data Fiduciary, —
(a) a description of the breach, including its nature, extent and the timing of its occurrence;
(b) the consequences relevant to her, that are likely to arise from the breach;
(c) the measures implemented and being implemented by the Data Fiduciary, if any, to mitigate risk;
(d) the safety measures that she may take to protect her interests; and
(e) business contact information of a person who is able to respond on behalf of the Data Fiduciary, to
queries, if any, of the Data Principal.
(2) On becoming aware of any personal data breach, the Data Fiduciary shall intimate to the Board, —
(a) without delay, a description of the breach, including its nature, extent, timing and location of
occurrence and the likely impact;
(b) within seventy-two hours of becoming aware of the breach, or within such longer period as the
Board may allow on a request made in writing in this behalf, —
(i)
updated and detailed information in respect of such description;
(ii) the broad facts related to the events, circumstances and reasons leading to the breach;
(iii) measures implemented or proposed, if any, to mitigate risk;
(iv) any findings regarding the person who caused the breach;
(v) remedial measures taken to prevent recurrence of such breach; and
(vi) a report regarding the intimations given to affected Data Principals.

8. Time period for specified purpose to be deemed as no longer being served.—(1) A Data Fiduciary,
who is of such class and is processing personal data for such corresponding purposes as are specified in
Third Schedule, shall erase such personal data, unless its retention is necessary for compliance with any law
for the time being in force, or, for the corresponding time period specified in the Third Schedule, if the Data
Principal neither approaches such Data Fiduciary for the performance of the specified purpose nor exercises
her rights in relation to such processing.
(2) At least forty-eight hours before completion of the time period for erasure of personal data under this
rule, the Data Fiduciary shall inform the Data Principal that such personal data shall be erased upon
completion of such period, unless she logs into her user account or otherwise initiates contact with the Data
Fiduciary for the performance of the specified purpose or exercises her rights in relation to the processing
of such personal data.
(3) Without prejudice to sub-rules (1) and (2), a Data Fiduciary shall retain, in respect of any processing of
personal data undertaken by it or on its behalf by a Data Processor, such personal data, associated traffic
data and other logs of the processing for a minimum period of one year from the date of such processing,
for the purposes as specified in the Seventh Schedule, after which the Data Fiduciary shall cause such
personal data and logs to be erased, unless further retention is required for compliance with any other law
for the time being in force or notified by the Government.
Illustration.
Case 1: X, a Data Principal purchases an e-book on an e-book platform Y. Once delivery is
completed, the specified purpose of processing is served. The platform Y must retain the order details,
personal data, and logs of the processing (such as order confirmation, payment, and delivery events) for at
least one year from the date of the transaction, even if X deletes her account.
Case 2: X, a company engages a cloud service provider C as its Data Processor to host customer
records. X as the Data Fiduciary, is required to ensure that the C also retains the data and associated logs
for at least one year before erasure, unless any other applicable law requires a longer period.
9. Contact information of person to answer questions about processing.— Every Data Fiduciary shall
prominently publish on its website or app, and mention in every response to a communication for the
exercise of the rights of a Data Principal under the Act, the business contact information of the Data
Protection Officer, if applicable, or a person who is able to answer on behalf of the Data Fiduciary the
questions of the Data Principal about the processing of her personal data.
10. Verifiable consent for processing of personal data of child.—(1) A Data Fiduciary shall adopt
appropriate technical and organisational measures to ensure that verifiable consent of the parent is obtained
before the processing of any personal data of a child and shall observe due diligence, for checking that the
individual identifying herself as the parent is an adult who is identifiable if required in connection with
compliance with any law for the time being in force in India, by reference to—
(a) reliable details of identity and age of the individual available with the Data Fiduciary; or
(b) details of identity and age, voluntarily provided —
(i) by the individual; or
(ii) through a virtual token mapped to such details, which is issued by an authorised entity.
(2) In this rule, the expression—
(a) “adult” shall mean an individual who has completed the age of eighteen years;
(b) “authorised entity" shall mean —
(i)
an entity entrusted by law or by the Central Government or by the State Government with
the issuance of details of the identity and age or a virtual token mapped to such details; or

(ii)
a person appointed or permitted by the entity specified under clause (i), for such issuance,
and also includes details of identity and age or token made available and verified by a Digital
Locker Service Provider;
(c) “Digital Locker service provider” shall mean such intermediary, including a body corporate or an
agency of the appropriate Government, as may be notified by the Central Government, in
accordance with the rules made in this regard under the Information Technology Act, 2000 (21 of
2000);
Illustration.
C is a child, P is a parent, and DF is a Data Fiduciary. A user account of C is sought to be created
on the online platform of DF, by processing the personal data of C.
Case 1: C informs DF that she is a child and declares P as her parent. DF shall enable P to identify
herself through its website, app or other appropriate means. P identifies herself as the parent and informs
DF that she is a registered user on DF’s platform and has previously made available her identity and age
details to DF. Before processing C’s personal data for the creation of her user account, DF shall check to
confirm that it holds reliable identity and age details of P and that P is an identifiable adult.
Case 2: C informs DF that she is a child and declares P as her parent. DF shall enable P to identify
herself through its website, app or other appropriate means. P identifies herself as the parent and informs
DF that she herself is not a registered user on DF’s platform. Before processing C’s personal data for the
creation of her user account, DF shall, by reference to identity and age details issued by an entity entrusted
by law or the Government with maintenance of the said details or to a virtual token mapped to the identity
and age, check that P is an identifiable adult. P may voluntarily make such details available using the
services of a Digital Locker service provider.
Case 3: P is opening an account for C and identifies herself as C’s parent and informs DF that she
is a registered user on DF’s platform and has previously made available her identity and age details to DF.
Before processing C’s personal data for the creation of her user account, DF shall check to confirm that it
holds reliable identity and age details of P and that P is an identifiable adult.
Case 4: P is opening an account for C and identifies herself as C’s parent and informs DF that she
herself is not a registered user on DF’s platform. Before processing C’s personal data for the creation of her
user account, DF shall, by reference to identity and age details issued by an entity entrusted by law or the
Government with maintenance of the said details or to a virtual token mapped to the identity and age, check
that P is an identifiable adult. P may voluntarily make such details available using the services of a Digital
Locker service provider.
11. Verifiable consent for processing of personal data of person with disability who has lawful
guardian. — (1) A Data Fiduciary, while obtaining verifiable consent from an individual identifying
herself as the lawful guardian of a person with disability, shall observe due diligence to verify that such
guardian is appointed by a court of law, or by a designated authority or by a local level committee, under
the law applicable to guardianship.
(2) In this rule, the expression—
(a) “designated authority” shall mean an authority designated under section 15 of the Rights of Persons
with Disabilities Act, 2016 (49 of 2016) to support persons with disabilities in exercise of their
legal capacity;
(b) “law applicable to guardianship” shall mean, —
(i) in relation to an individual who has long term physical, mental, intellectual or sensory
impairment which, in interaction with barriers, hinders her full and effective participation
in society equally with others and who despite being provided adequate and appropriate
support is unable to take legally binding decisions, the provisions of law contained in

Rights of Persons with Disabilities Act, 2016 (49 of 2016) and the rules made thereunder;
and
(ii) in relation to a person who is suffering from any of the conditions relating to autism,
cerebral palsy, mental retardation or a combination of such conditions and includes a
person suffering from severe multiple disability, the provisions of law of the National Trust
for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple
Disabilities Act, 1999 (44 of 1999) and the rules made thereunder;
(c) “local level committee” shall mean a local level committee constituted under section 13 of the
National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and
Multiple Disabilities Act, 1999 (44 of 1999);
(d) “person with disability” shall mean and include—
(i) an individual who has long term physical, mental, intellectual or sensory impairment
which, in interaction with barriers, hinders her full and effective participation in society
equally with others and who, despite being provided adequate and appropriate support, is
unable to take legally binding decisions; and
(ii) an individual who is suffering from any of the conditions relating to autism, cerebral palsy,
mental retardation or a combination of any two or more of such conditions and includes an
individual suffering from severe multiple disability and who, despite being provided
adequate and appropriate support, is unable to take legally binding decisions.
12. Exemptions from certain obligations applicable to processing of personal data of child. — (1) The
provisions of sub-sections (1) and (3) of section 9 of the Act shall not be applicable to processing of
personal data of a child by such class of Data Fiduciaries as are specified in Part A of Fourth Schedule,
subject to such conditions as are specified in the said Part.
(2) The provisions of sub-sections (1) and (3) of section 9 of the Act shall not be applicable to processing of
personal data of a child for such purposes as are specified in Part B of Fourth Schedule, subject to such
conditions as are specified in the said Part.
13. Additional obligations of Significant Data Fiduciary. — (1) A Significant Data Fiduciary shall, once
in every period of twelve months from the date on which it is notified as such or is included in the class of
Data Fiduciaries notified as such, undertake a Data Protection Impact Assessment and an audit to ensure
effective observance of the provisions of this Act and the rules made thereunder.
(2) A Significant Data Fiduciary shall cause the person carrying out the Data Protection Impact Assessment
and audit to furnish to the Board a report containing significant observations in the Data Protection Impact
Assessment and audit.
(3) A Significant Data Fiduciary shall observe due diligence to verify that technical measures including
algorithmic software adopted by it for hosting, display, uploading, modification, publishing, transmission,
storage, updating or sharing of personal data processed by it are not likely to pose a risk to the rights of
Data Principals.
(4) A Significant Data Fiduciary shall undertake measures to ensure that personal data specified by the
Central Government, on the basis of the recommendations of a committee constituted by it, is processed
subject to the restriction that the personal data and the traffic data pertaining to its flow is not transferred
outside the territory of India.
(5) In this rule, “committee” means a committee constituted by the Central Government for the purpose of
this rule, which shall include officials from the Ministry of Electronics and Technology and may include
officials from other Ministries or Department of the Central Government.
14. Rights of Data Principals. — (1) For enabling Data Principals to exercise their rights under the Act,
the Data Fiduciary and, where applicable, the Consent Manager, shall prominently publish on its website or
app, or both, as the case may be, —

(a) the details of the means using which a Data Principal may make a request for the exercise of such
rights; and
(b) the particulars, if any, such as the username or other identifier of such a Data Principal, which may
be required to identify her under its terms of service.
(2) To exercise the rights of the Data Principal under the Act, she may make a request to the Data Fiduciary
to whom she has previously given consent for processing of her personal data, using the means and
furnishing the particulars required by such Data Fiduciary for the exercise of such rights.
(3) Every Data Fiduciary and Consent Manager shall prominently publish on its website or app, or both, as
the case may be, within a reasonable period not exceeding ninety days under its grievance redressal system
for responding to the grievances of Data Principals and shall, for ensuring the effectiveness of the system in
responding within such period, implement appropriate technical and organisational measures.
(4) To exercise the rights of the Data Principal under the Act, she may, in accordance with the terms of
service of the Data Fiduciary and such law as may be applicable, nominate one or more individuals, using
the means and furnishing the particulars required by such Data Fiduciary for the exercise of such right.
(5) In this rule, the expression “identifier” shall mean any sequence of characters issued by the Data
Fiduciary to identify the Data Principal and includes a customer identification file number, customer
acquisition form number, application reference number, enrolment ID, email address, mobile number or
licence number that enables such identification.
15. Transfer of personal data outside the territory of India.— Any personal data processed by a Data
Fiduciary under the Act may be transferred outside the territory of India subject to the restriction that the
Data Fiduciary shall meet such requirements as the Central Government may, by general or special order,
specify in respect of making such personal data available to any foreign State, or to any person or entity
under the control of or any agency of such a State.
16. Exemption from Act for research, archiving or statistical purposes. —The provisions of the Act
shall not apply to the processing of personal data necessary for research, archiving or statistical purposes if
it is carried on in accordance with the standards specified in Second Schedule.
17.Appointment of Chairperson and other Members.— (1) The Central Government shall constitute a
Search-cum-Selection Committee, with the Cabinet Secretary as the chairperson and the Secretaries to the
Government of India in charge of the Department of Legal Affairs and the Ministry of Electronics and
Information Technology and two experts of repute having special knowledge or practical experience in a
field which in the opinion of the Central Government may be useful to the Board as members, to
recommend individuals for appointment as Chairperson.
(2) The Central Government shall constitute a Search-cum-Selection Committee, with the Secretary to the
Government of India in the Ministry of Electronics and Information Technology as the chairperson and the
Secretary to the Government of India in charge of the Department of Legal Affairs, and two experts of
repute having special knowledge or practical experience in a field which in the opinion of the Central
Government may be useful to the Board as members, to recommend individuals for appointment as a
Member other than the Chairperson.
(3) The Central Government shall, after considering the suitability of individuals recommended by the
Search-cum-Selection Committee, appoint the Chairperson or other Member, as the case may be.
(4) No act or proceeding of the Search-cum-Selection Committee specified in sub-rules (1) and (2) of this
rule shall be called in question on the ground merely of the existence of any vacancy or absences in such
committee or defect in its constitution.
18. Salary, allowances and other terms and conditions of service of Chairperson and other Members.
—The Chairperson and every other Member shall receive such salary and allowances and shall have such
other terms and conditions of service as are specified in Fifth Schedule.
19. Procedure for meetings of Board and authentication of its orders, directions and instruments. —

(1) The Chairperson shall fix the date, time and place of meetings of the Board, approve the items of
agenda therefor, and cause notice specifying the same to be issued under her signature or that of such other
individual as the Chairperson may authorise by general or special order in writing.
(2) Meetings of the Board shall be chaired by the Chairperson and, in her absence, by such other Member
as the Members present at the meeting may choose from amongst themselves.
(3) One-third of the membership of the Board shall be the quorum for its meetings.
(4) All questions which come up before any meeting of the Board shall be decided by a majority of the
votes of Members present and voting, and, in the event of an equality of votes, the Chairperson, or in her
absence, the person chairing, shall have a second or casting vote.
(5) If a Member has an interest in any item of business to be transacted at a meeting of the Board, she shall
not participate in or vote on the same and, in such a case, the decision on such item shall be taken by a
majority of the votes of other Members present and voting.
(6) In case an emergent situation warrants immediate action by the Board and it is not feasible to call a
meeting of the Board, the Chairperson may, while recording the reasons in writing, take such action as may
be necessary, which shall be communicated within seven days to all Members and laid before the Board for
ratification at its next meeting.
(7) If the Chairperson so directs, an item of business or issue which requires decision of the Board may be
referred to Members by circulation and such item may be decided with the approval of majority of the
Members.
(8) The Chairperson or any Member of the Board, or any individual authorised by it,by a general or special
order in writing, may, under her signature, authenticate its order, direction or instrument.
(9) The inquiry by the Board shall be completed within a period of six months from the date of receipt of
the intimation, complaint, reference or direction under section 27 of the Act, unless such period is extended
by it, for reasons to be recorded in writing, for a further period not exceeding three months at a time.
20. Functioning of Board as digital office. — The Board shall function as a digital office, without
prejudice to its power to summon and enforce the attendance of any person and examine her on oath, may
adopt techno-legal measures to conduct proceedings in a manner that does not require physical presence of
any individual.
21. Terms and conditions of appointment and service of officers and employees of Board.— (1) The
Board may, with previous approval of the Central Government, appoint such officers and employees as it
may deem necessary for the efficient discharge of its functions under the provisions of the Act.
(2) The terms and conditions of service of officers and employees of the Board shall be such as are
specified in Sixth Schedule.
22. Appeal to Appellate Tribunal. — (1) Any person aggrieved by an order or direction of the Board,
may prefer an appeal before the Appellate Tribunal, it shall be filed in digital form as the Appellate
Tribunal may decide.
(2) An appeal filed with the Appellate Tribunal shall be accompanied by fee of like amount as is applicable
in respect of an appeal filed under the Telecom Regulatory Authority of India Act, 1997 (24 of 1997),
unless reduced or waived by the Chairperson of the Appellate Tribunal at her discretion, and the same shall
be payable digitally using the Unified Payments Interface or such other payment system authorised by the
Reserve Bank of India.
(3) The Appellate Tribunal—
(a) shall not be bound by the procedure laid down by the Code of Civil Procedure, 1908 (5 of 1908),
but shall be guided by the principles of natural justice and, subject to the provisions of the Act, may
regulate its own procedure; and
(b) shall function as a digital office which, without prejudice to its power to summon and enforce the
attendance of any person and examine her on oath, may adopt techno-legal measures to conduct
proceedings in a manner that does not require physical presence of any individual.

23. Calling for information from Data Fiduciary or intermediary. — (1) The Central Government may,
for such purposes of the Act as are specified in Seventh Schedule, acting through the corresponding
authorised person specified in the said Schedule, require any Data Fiduciary or intermediary to furnish such
information as may be called for, within the specified period as may be given in such.
(2) Where the disclosure of furnishing of information as referred to in sub-rule (1) is likely to prejudicially
affect the sovereignty and integrity of India or security of the State, the Central Government may require
the Data Fiduciary or intermediary to not disclose such furnishing to affected Data Principal or any other
person except with the previous permission, in writing, of the authorised person.
(3) For the purposes of this rule, the expression “intermediary” shall have the same meaning as assigned to
it in the Information Technology Act, 2000 (21 of 2000).
FIRST SCHEDULE
[See rule 4]
PART A
Conditions for registration of Consent Manager
1. The applicant is a company incorporated in India.
2. The applicant has sufficient capacity, including technical, operational and financial capacity, to fulfil its
obligations as a Consent Manager.
3. The financial condition and the general character of management of the applicant are sound.
4. The net worth of the applicant is not less than two crore rupees.
5. The volume of business likely to be available to and the capital structure and earning prospects of the
applicant are adequate.
6. The directors, key managerial personnel and senior management of the applicant company are
individuals with a general reputation and record of fairness and integrity.
7. The memorandum of association and articles of association of the applicant company contain provisions
requiring that the obligations under items 9 and 10 of Part B are adhered to, that policies and procedures are
in place to ensure such adherence, and that such provisions may be amended only with the previous
approval of the Board.
8. The operations proposed to be undertaken by the applicant are in the interests of Data Principals.
9. It is independently certified that—
(a) the interoperable platform of the applicant to enable the Data Principal to give, manage, review and
withdraw her consent is consistent with such data protection standards and assurance framework
as may be published by the Board on its website from time to time; and
(b) appropriate technical and organisational measures are in place to ensure adherence to such
standards and framework and effective observance of the obligations under item 11 of Part B.
PART B
Obligations of Consent Manager
1.
The Consent Manager shall enable a Data Principal using its platform to give consent to the
processing of her personal data by a Data Fiduciary onboarded onto such platform either directly to such
Data Fiduciary or through another Data Fiduciary onboarded onto such platform, who maintains such
personal data with the consent of that Data Principal.

Individuals are enabled to give, manage, review and withdraw their consent to the processing of
their personal data through P, a platform maintained by a Consent Manager. X, an individual, is a registered
user on P. B1 and B2 are banks onboarded onto P.
Case 1:B1 sends a request on P to X for consent to process personal data contained in her bank
account statement. X maintains the bank account statement as a digital record in her digital locker. X uses P
to directly give her consent to B1, and proceeds to give B1 access to her bank account statement.
Case 2:B1 sends a request on P to X for consent to process personal data contained in her bank
account statement. X maintains her bank account with B2. X uses P to route her consent through B2 to B1,
while also digitally instructing B2 to send her bank account statement to B1. B2 proceeds to send the bank
account statement to B1.
2.
The Consent Manager shall ensure that the manner of making available the personal data or its sharing
is such that the contents thereof are not readable by it.
3.
The Consent Manager shall maintain on its platform a record of the following, namely:—
(a) Consents given, denied or withdrawn by her;
(b) Notices preceding or accompanying requests for consent; and
(c) Sharing of her personal data with a transferee Data Fiduciary.
4.
The Consent Manager: —
(a) shall give the Data Principal using such platform access to such record;
(b) shall, on the request of the Data Principal and in accordance with its terms of service, make
available to her the information contained in such record, in machine-readable form; and
(c) shall maintain such record for at least seven years, or for such longer period as the Data
Principal and Consent Manager may agree upon or as may be required by law.
5.
The Consent Manager shall develop and maintain a website or app, or both, as the primary means
through which a Data Principal may access the services provided by the Consent Manager.
6.
The Consent Manager shall not sub-contract or assign the performance of any of its obligations under
the Act and these rules.
7.
The Consent Manager shall take reasonable security safeguards to prevent personal data breach.
8.
The Consent Manager shall act in a fiduciary capacity in relation to the Data Principal.
9.
The Consent Manager shall avoid conflict of interest with Data Fiduciaries, including in respect of
their promoters and key managerial personnel.
10. The Consent Manager shall have in place measures to ensure that no conflict of interest arises on
account of its directors, key managerial personnel and senior management holding a directorship, financial
interest, employment or beneficial ownership in Data Fiduciaries, or having a material pecuniary
relationship with them.
11. The Consent Manager shall publish in an easily accessible manner, on its website or app, or both, as
the case may be, information regarding: —
(a) the promoters, directors, key managerial personnel and senior management of the company
registered as Consent Manager;
(b) every person who holds shares in excess of two per cent. of the shareholding of the company
registered as Consent Manager;

(c) everybody corporate in whose shareholding any promoter, director, key managerial personnel or
senior management of the Consent Manager holds shares in excess of two per cent. as on the
first day of the preceding calendar month; and
(d) such other information as the Board may direct the Consent Manager to disclose in the interests
of transparency.
12. The Consent Manager shall have in place effective audit mechanisms to review, monitor, evaluate and
report the outcome of such audit to the Board, periodically and on such other occasions as the Board may
direct, in respect of—
(a) technical and organisational controls, systems, procedures and safeguards;
(b) continued fulfilment of the conditions of registration; and
(c) adherence to its obligations under the Act and these rules.
13. The control of the company registered as the Consent Manager shall not be transferred by way of sale,
merger or otherwise, except with the previous approval of the Board and subject to fulfilment of such
conditions as the Board may specify in this behalf.
Note: In this Schedule, —
(a) the expression “body corporate” shall include a company, a body corporate as defined under
clause (11) of section 2 of the Companies Act, 2013 (18 of 2013), a firm, a financial institution,
a scheduled bank or a public sector enterprise established or constituted by or under any Central
Act, Provincial Act or State Act, and any other incorporated association of persons or body of
individuals;
(b) the expressions “company”, “control”, “director” and “key managerial personnel” shall have the
same meanings as are respectively assigned to them in the Companies Act, 2013 (18 of 2013);
(c) the expression “net worth” shall mean the aggregate value of total assets as reduced by the value
of liabilities of the Consent Manager as appearing in its books of accounts; and
(d) the expressions “promoter” and “senior management” shall have the same meanings as are
respectively assigned to them in the Companies Act, 2013 (18 or 2013).
SECOND SCHEDULE

Standards for processing of personal data by State and its instrumentalities under clause (b) of
section 7 and for processing of personal data necessary for the purposes specified in clause (b) of sub-
section (2) of section 17
Implementation of appropriate technical and organisational measures to ensure effective observance of the

(f) Reasonable security safeguards to prevent personal data breach to protect personal data in the
possession or under control of the Data Fiduciary, including in respect of any processing
undertaken by it or on its behalf by a Data Processor;
(g) Where processing is to be done under clause (b) of section 7 of the Act, the same is undertaken
while giving the Data Principal an intimation in respect of the same and—
(i) giving the business contact information of a person who is able to answer on behalf of
the Data Fiduciary the questions of the Data Principal about the processing of her
personal data;
(ii) specifying the particular communication link for accessing the website or app, or both,
of such Data Fiduciary, and a description of other means, if any, using which such Data
Principal may exercise her rights under the Act; and
(iii) is carried on in a manner consistent with such other standards as may be applicable to
the processing of such personal data under policy issued by the Central Government or
any law for the time being in force; and
(h) Accountability of the person who alone or in conjunction with other persons determines the
purpose and means of processing of personal data, for effective observance of these standards.

accesses or avails of any computer resource of an intermediary for the purpose of hosting,
publishing, sharing, transacting, viewing, displaying, downloading or uploading
information.

(a) “advertisement” shall have the same meaning as is assigned to it in the Consumer Protection Act,
2019 (35 of 2019).
(a) “allied healthcare professional” shall have the same meaning as is assigned to it in the clause (d) of
section 2 of the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021);
(b) “clinical establishment” shall have the same meaning as assigned to it in the clause (c) of section 2
of the Clinical Establishments (Registration and Regulation) Act, 2010 (23 of 2010);
(c) “educational institution” shall mean and include an institution of learning that imparts education,
including vocational education;
(d) “healthcare professional” shall have the same meaning as is assigned to it in clause (j) of section 2
of the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021);
(e) “health services” shall mean the services required to be provided by a healthcare professional as
referred to in clause (j) of section 2 of the National Commission for Allied and Healthcare Professions
Act, 2021 (14 of 2021); and
(f) “mental health establishment” shall have the same meaning as is assigned to it in clause (p) of sub-
section (1) of section 2 of the Mental Healthcare Act, 2017 (10 of 2017).
FIFTH SCHEDULE

Terms and conditions of service of Chairperson and other Members
1. Salary. — (1) The Chairperson shall be entitled to receive a consolidated salary of rupees four lakh fifty
thousand per month, without the facility of house and car.
(2) Every Member other than the Chairperson shall be entitled to receive a consolidated salary of rupees
four lakh per month, without the facility of house and car.
2. Provident Fund. —The Chairperson and every other Member shall be eligible to contribute to the
Provident Fund of the Board, and the manner and terms and conditions applicable in this regard shall,
mutatis mutandis, be the same as those applicable to other officers and employees of the Board for their
Provident Fund.
3. Pension and gratuity. —The Chairperson and every other Member shall not be entitled to payment of
pension or gratuity for service rendered in the Board.
4. Travelling allowance.—(1) The Chairperson and every other Member, while on transfer to join the
Board, or on the expiry of her term with the Board for proceeding to her home town with family (including
in respect of journey undertaken by her and her family), or on tour within India, shall be entitled to journey
allowance, daily allowance and reimbursement of expense on transportation of personal effects at such
scales and rates as are applicable to an officer of the Central Government in the following level of the pay
matrix, namely:—
(a) level 17, in the case of the Chairperson; and
(b) level 15, in the case of every other Member.
(2) The Chairperson and every other Member may undertake tour outside India only in accordance with
guidelines or instructions issued by the Central Government, and in respect of such tour, she shall be
entitled to draw the same allowances as an officer of the Central Government, in the following level of the
pay matrix, is entitled to draw, namely: —
(a) level 17, in the case of the Chairperson; and
(b) level 15, in the case of every other Member.
5. Medical assistance. — (1) The Chairperson and every other Member shall be entitled to such medical
assistance as may be admissible to them under any group health insurance scheme of the Board for officers
and employees of the Board and their eligible dependants.

(2) If the Chairperson or other Member has retired from Government service, or from the service of a
public sector entity or a body corporate established by a Central Act, Provincial Act or State Act, and there
are a separate set of rules for the grant of medical assistance for such service, she may, in lieu of medical
assistance under sub-paragraph (1), opt to be governed by such rules.
6. Leave. — (1) The authority competent to sanction leave shall be the Central Government in respect of
the Chairperson, and the Chairperson in respect of any other Member.
(2) The Chairperson and every other Member may avail of such kinds of leave as are admissible to a
Government servant under sub-clause (i) of clause (a) and clause (b) of sub-rule (1) of rule 26, rules 27, 29,
30 and 40 to 43-C of the Central Civil Services (Leave) Rules, 1972 (hereinafter referred to as “Leave
Rules”).
(3) Leave shall be subject to the conditions applicable to a Government servant under rules 7 to 11 and 22
to 25 of the Leave Rules, and the Central Government may, if satisfied that the operation of any of the said
rules causes undue hardship in a particular case, by order relax the requirements of that rule to such extent
and subject to such exceptions and conditions as it may consider necessary for dealing with the case in a
just and equitable manner.
(4) The Chairperson and every other Member shall be entitled to casual leave to such extent as is
admissible to a Government servant under instructions issued by the Central Government.
(5) The Chairperson and every other Member shall be entitled to encashment of earned leave standing to
her credit, subject to such conditions and in like manner as are applicable to a Government servant under
rule 38-A, sub-rules (1) and (2) and sub-clauses (i) and (ii) of clause (a) of sub-rule (6) of rule 39, rule 39-A
and rule 39-C of the Leave Rules, subject to the maximum extent of encashment under any of the said
rules, other than rule 38-A, being fifty per cent. of the earned leave standing to her credit.
7. Leave travel concession.—(1) Leave travel concession shall be admissible to the Chairperson and every
other Member in accordance with the provisions applicable to persons appointed to civil services and posts
in connection with the affairs of the Union of India under rule 3, clauses (a) and (d) of rule 4, rules 5 to 15
and rule 17 of the Central Civil Services (Leave Travel Concession) Rules, 1988, and the entitlement for
such concession shall be the same as is applicable to officers of the Central Government in level 17 of the
pay matrix in the case of the Chairperson, and to officers of the Central Government in level 15 of the pay
matrix in the case of a Member.
(2) The Chairperson and every other Member shall be eligible to avail of either leave travel concession to
home town or leave travel concession to any place in India in any period of two years from the date of
assumption of their office as a Member.
8. Other terms and conditions of service. — (1) The Chairperson and every other Member shall ensure
absence of conflict of interest in the performance of the functions of her office and shall not have any such
financial or other interests as are likely to prejudicially affect the performance of the functions of such
office.
(2) The provisions contained in Part IV to Part IX of the Central Civil Services (Classification, Control and
Appeal) Rules, 1965, as applicable to an officer of the Central Government who is a member of a Central
Civil Services, Group ‘A’, shall apply, mutatis mutandis, to the Chairperson and every other Member.
(3) The Chairperson and every other Member shall not be entitled to any sitting fee for attending meetings
of the Board.
(4) The Chairperson and every other Member shall not be entitled to any sumptuary allowance.
(5)Any matter relating to the conditions of service of the Chairperson or any other Member, in respect of
which no express provision has been made in these rules, shall be referred to the Central Government for its
decision, and the decision of the Central Government on the same shall be final.
9. In this Schedule, “pay matrix” shall mean the pay matrix specified in Annexure I to the Central
Government’s Resolution published in the Official Gazette vide Notification no. 1-2/2016-IC, dated the 25th
July, 2016.

SIXTH SCHEDULE
[See rule 21(2)]
Terms and conditions of appointment and service of officers and employees of Board
1. Classes of officials. — (1) The Board may, in accordance with the Fundamental Rules and applicable
guidelines issued by the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel
and Training, appoint officers and employees on deputation from the Central Government, a State
Government, an autonomous body under the overall control of the Central Government or a State
Government, a statutory body, or a public sector enterprise, for a period not exceeding five years.
(2) The Board may also receive or take on deputation any officer or other employee from the National
Institute for Smart Government, for a period not exceeding five years, with salary and allowances guided
by market standards and on such other terms and conditions as the Board may decide.
2. Gratuity. —The officers and employees shall be entitled to payment of such gratuity as may be
admissible under the Payment of Gratuity Act, 1972 (39 of 1972).
3. Travelling allowance. —The travelling allowance payable to the officers and employees shall, mutatis
mutandis, be the same as those applicable to the officers and employees of the Central Government.
4. Medical assistance. —The officers and employees shall be entitled to such medical assistance as may be
admissible to them and their eligible dependants under any group health insurance scheme of the Board,
made with the previous approval of the Central Government.
5. Leave. — (1) The officers and employees may avail of such kinds of leaves as are admissible to a
Government servant under the Central Civil Services (Leave) Rules, 1972, subject to the conditions
applicable under the said rules, and shall be eligible for encashment of earned leave as provided therein.
(2) The officers and employees shall be entitled to casual leave to such extent as is admissible to a
Government servant under instructions issued by the Central Government.
6. Leave travel concession. — Leave travel concession shall be admissible to the officers and employees
appointed under clause (1) of paragraph 1, in accordance with the provisions applicable to persons
appointed to civil services and posts in connection with the affairs of the Union of India under the Central
Civil Services (Leave Travel Concession) Rules, 1988.
7. Other terms and conditions of service. — (1) The provisions of the Civil Service (Conduct) Rules,
1964 shall apply to the officers and employees in like manner as applicable to a person appointed to a civil
service or post in connection with the affairs of the Union of India under the said rules.
(2) The provisions contained in Part IV to Part IX of the Central Civil Services (Classification, Control and
Appeal) Rules, 1965 shall apply, mutatis mutandis, to the officers and employees appointed under clause
(1) of paragraph 1, in like manner as applicable to a Government servant under the said rules.
(3)Any matter relating to the terms and conditions of service of the officers and employees appointed under
clause (1) of paragraph 1, in respect of which no express provision has been made in these rules, shall be
referred to the Central Government for its decision, and the decision of the Central Government on the
same shall be final.

instrumentality, as the case may be, may
designate in this behalf.

personal data of a Data Principal for the following
purposes, namely: —
(i) performance of any function under any
law for the time being in force in India; or
(ii) disclosure of any information for
fulfilling any obligation under any law for
the time being in force in India.
Person authorised under applicable law.
3.
Carrying out assessment for notifying any Data
Fiduciary or class of Data Fiduciaries as
Significant Data Fiduciary.
Such officer of the Central Government, in the
Ministry of Electronics and Information
Technology, as the Secretary in charge of the
said Ministry may designate in this behalf.
