और उि रािपत्र की प्रजतयां िनता को 3 नवंबर, 2025 को उपलब्ध करा िी गई थीं; और उि प्रारूप जनयमों पर िनता से प्राि आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा जवचार कर जलया गया है; अतः, अब, उि अजधजनयम की धारा 12 और धारा 33 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केंद्रीय सरकार, औषजध तकनीकी सलाहकार बोडि से परामिि करने के पश्चात्, नए औषजध और नैिाजनक परीक्षण जनयम, 2019 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती है, अथाित्:—

1. (i) इन जनयमों का संजक्षि नाम नए औषजध और नैिाजनक परीक्षण (िूसरा संिोधन) जनयम, 2026 है। (ii) ये रािपत्र में उनके प्रकािन की तारीख से नब्बे दिनों के पश्चात् प्रवृत्त होंगे।
2. नए औषजध और नैिाजनक परीक्षण जनयम, 2019 (जिसे इसमें इसके पश्चात् "उि जनयम" कहा गया है) के, जनयम 31 के, उप-जनयम (2) के पश्चात्, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित्:— "परंतु यह दक सामान्य स्ट्वस्ट्थ वयस्ट्क मानव स्ट्वयंसेवकों में (केवल जनयाित प्रयोिन के जलए) दकसी औषजध (साइटोटोजससक, हामोन, स्ट्वापक और मन:प्रभावी पिाथि प्रवाग्रों की औषजधयों से जभन्न और िो संकीणि जचदकत्सीय सूचकांक वाली औषजध नहीं है या अत्यजधक पररवतिनिील फामािकोकाइनेरटसस वाली औषजध नहीं है) के मौजखक खुराक रूप के एकल-खुराक, िो-अवजध, िो-अनुक्रम, िो-उपचार, िैव-उपलब्धता या िैव-तुल्यता अध्ययन, िो भारत में या इन िेिों, अथाित् संयुि राज्य अमेररका, यूरोपीय संघ, िापान, ऑस्ट्रेजलया, कनाडा और यूनाइटेड ककंगडम में से दकसी एक िेि में पहले से ही अनुमोदित है, के मामले में, अध्ययन प्ररूप सीटी-05 में पूवि सूचना के रूप में एक ऑनलाइन आवेिन प्रस्ट्तुत करने और केंद्रीय अनुज्ञापन प्राजधकारी द्वारा उसकी पावती के पश्चात्, जनम्नजलजखत ितों के अधीन रहते हुए, संचाजलत दकए िा सकेंगे, अथाित्:— (क) पूवि सूचना के आवेिन के साथ जनयम 8 के अधीन केंद्रीय अनुज्ञापन प्राजधकारी के पास पंिीकृत आचार जनयम सजमजत का अनुमोिन संलग्न होगा; (ख) आचार जनयम सजमजत पूवि सूचना की पावती के आधार पर संचाजलत दकए िा रहे ऐसे िैव- उपलब्धता या िैव-तुल्यता अध्ययनों की समीक्षा और अनुमोिन का एक अलग अजभलेख रखेगी, जिसकी समीक्षा केंद्रीय अनुज्ञापन प्राजधकारी द्वारा आचार जनयम सजमजत के पंिीकरण के नवीनीकरण के समय की िाएगी; और (ग) नमूना आकार अठारह से अजधक या उसके बराबर होगा होगा [unclear in source]।".
3. उि जनयम के, जनयम 33 में,—
4. पार्श्ि िीषि में, "अनुज्ञा" िब्ि के स्ट्थान पर, "अनुज्ञा या पूवि सूचना" िब्ि रखें िाएंगे; (ख) उप-जनयम (1) में, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाित्:— "परंतु यह दक जनयम 31 के उप-जनयम (2) के परंतुक में यथा जनर्ििष्ट िैव-उपलब्धता या िैव अध्ययन के मामले में, ऐसे अध्ययन जनयम 31 के उप-जनयम (2) के परंतुक में यथा जवजनर्ििष्ट प्ररूप सीटी-05 में ऑनलाइन आवेिन प्रस्ट्तुत करके संचाजलत दकए जा सकेंगे [unclear in source]।"। (ग) उप-जनयम (2) के स्ट्थान पर, जनम्नजलजखत रखा िाएगा, अथाित्:—

[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 "(2) यथाजस्ट्थजत दकसी नई औषजध या अन्वेषणात्मक नई औषजध के िैव-उपलब्धता या िैव-तुल्यता अध्ययन के संचालन की अनुज्ञा प्रिान करने के जलए, या जनयम 31 के उप-जनयम (2) के परंतुक में जवजनर्ििष्ट िैव-उपलब्धता या िैव-तुल्यता अध्ययन आरम्भ करने के जलए पूवि सूचना के रूप में, आवेिन के साथ छठी अनुसूची में यथा जवजनर्ििष्ट फीस और ऐसी अन्य िानकारी और िस्ट्तावेि संलग्न होंगे िो चौथी अनुसूची की सारणी 2 में जवजनर्ििष्ट हैं: परंतु यह दक केंद्रीय सरकार या राज्य सरकार के पूणितः और भागतः स्ट्वाजमत्वाधीन या जवत्त पोजषत दकसी संस्ट्था या संगठन द्वारा िैव-उपलब्धता या िैव-तुल्यता अध्ययन संचाजलत करने के जलए कोई फीस संिेय नहीं होगा।"। 4. उि जनयमों के, जनयम 35 में,— (क) पार्श्ि िीषि में, "अनुज्ञा" िब्ि के स्ट्थान पर, "अनुज्ञा या पूवि सूचना" िब्ि रखें िाएंगे; (ख) प्रारंजभक पैरा के, "जनयम 34 के अधीन अध्ययन" िब्िों और अंकों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती, " िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे; (ग) खंड (xiii) में, "अनुज्ञा प्रिान" िब्िों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती, िैसा भी मामला हो," िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे। 5. उि जनयमों में, जनयम 36 में,— (क) पार्श्ि िीषि में, "अनुज्ञा" िब्ि के स्ट्थान पर, "अनुज्ञा या पूवि सूचना की पावती" िब्ि रखें िाएंगे; (ख) उप-जनयम (1) में, "प्ररूप सीटी-07 में जनयम 34 के अधीन प्रिान दकए गए अध्ययन" िब्िों, अंकों और अक्षरों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती, िैसा भी मामला हो," िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे; (ग) उप-जनयम (2) के स्ट्थान पर, जनम्नजलजखत उप-जनयम रखा िाएगा, अथाित्:— "(2) अपवादिक पररजस्ट्थजतयों में, िहां केंद्रीय अनुज्ञापन प्राजधकारी का एक वषि से अजधक के जवस्ट्तार की आवश्यकता के बारे में समाधान हो िाता है, वहााँ उि प्राजधकारी, आवेिक के जलजखत अनुरोध पर, प्रिान की गई अनुज्ञा या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती की अवजध को एक वषि की और अवजध के जलए बढा सकेगा है।"। 6. उि जनयमों के जनयम 37 में, "प्ररूप सीटी-07 में जनयम 34 के अधीन अध्ययन" िब्िों, अंकों और अक्षरों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती के अधीन, िैसा भी मामला हो," िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे। 7. उि जनयम के, जनयम 38 में,— (क) पार्श्ि िीषि में, "अनुज्ञा" िब्ि के स्ट्थान पर, "अनुज्ञा या पूवि सूचना की पावती" िब्ि रखे िाएंगे; (ख) उप-जनयम (1) में,–– (i) "प्ररूप सीटी-07 में जनयम 34 के अधीन अनुज्ञा प्रिान की गई है" िब्िों, अंकों और अक्षरों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती का धारक, िैसा भी मामला हो," िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे;

(ii) खंड (iii) में, "प्ररूप सीटी-07 में जनयम 34 के अधीन प्रिान की गई अनुज्ञा" िब्िों, अंकों और अक्षरों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती, िैसा भी मामला हो," िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे; (ग) उप-जनयम (2) में, "प्ररूप सीटी-07 में जनयम 34 के अधीन अनुज्ञा प्रिान की गई है" िब्िों, अंकों और अक्षरों के पश्चात्, "या जनयम 31 के उप-जनयम (2) के परंतुक के अधीन पूवि सूचना की पावती का धारक" िब्ि, कोष्ठक और अंक अंतःस्ट्थाजपत दकए िाएंगे। 8. उि जनयम की, आठवीं अनुसूची में,— (a) प्ररूप सीटी-05 में,— (क) िीषिक में, "अनुज्ञा प्रिान करने के जलए" िब्िों के पश्चात्, "या पूवि सूचना की" िब्ि अंतःस्ट्थाजपत दकए िाएंगे; (ख) प्रारंजभक पैरा में, "अनुज्ञा प्रिान करने के जलए आवेिन" िब्िों के पश्चात्, "या पूवि सूचना के रूप में" िब्ि अंतःस्ट्थाजपत दकए िाएंगे। [फा. सं. G.S.R. 50(E).—Whereas a draft of certain rules further to amend the New Drugs and Clinical Trials Rules, 2019 was published, as required under sub-section (1) of section 12 and sub-section (1) of section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) vide notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health and Family Welfare) number G.S.R. 587 (E), dated the 27th August, 2025, in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette were made available to the public on the 28th August, 2025; Further, a corrigendum to the notification number G.S.R. 587(E), dated the 27th August, 2025, was published vide notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health and Family Welfare) number G.S.R. 810 (E), dated the 31th October, 2025 in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and suggestions from persons likely to be affected thereby, before the expiry of a period of fifteen days from the date on which the copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette were made available to the public on the 3rd November, 2025; And whereas, objections and suggestions received from the public on the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 12 and section 33 of the said Act, the Central Government, after consultation with the Drugs Technical Advisory Board, hereby makes the following rules further to amend the New Drugs and Clinical Trials Rules, 2019, namely: —

1. (i) These rules may be called the New Drugs and Clinical Trials (Second Amendment) Rules, 2026. (ii) They shall come into force after ninety days from the date of their publication in the Official Gazette.
2. In the New Drugs and Clinical Trials Rules, 2019 (hereinafter referred to as “the said rules”), in rule 31, after sub-rule (2), the following proviso shall be inserted, namely: ― ‘‘Provided that in case of single-dose, two-period, two-sequence, two-treatment, bioavailability or bioequivalence studies in normal healthy adult human volunteers (for export purpose only), of oral dosage form of a drug (other than drugs of Cytotoxic, Hormone, Narcotic and Psychotropic substances categories and not a drug of Narrow Therapeutic Index or a drug having highly variable pharmacokinetics) already approved in India or any one of the countries, namely, United States of America, European Union, Japan, Australia, Canada and United Kingdom, the studies may be conducted after submission of an online application as prior intimation in Form CT-05 and its acknowledgement by the Central Licensing Authority, subject to the following conditions, namely: ― a. the application of the prior intimation shall be accompanied with approval of the Ethics Committee registered with the Central Licensing Authority under rule 8; b. the Ethics Committee shall maintain a separate record of review and approval of such bioavailability or bioequivalence studies being conducted on the basis of the acknowledgement of prior intimation, which shall be reviewed by the Central Licensing Authority at the time of renewal of the Registration of the Ethics Committee; and c. the samples size shall be more than or equal to eighteen.".
3. In the said rules, in rule 33, ― a. in the marginal heading, for the word “permission”, the words “permission or prior intimation” shall be substituted; b. in sub-rule (1), the following proviso shall be inserted, namely: ― "Provided that in case of bioavailability or bioequivalence studies as referred to in the proviso of sub-rule (2) of rule 31, such studies may be conducted by submitting an online application in Form CT- 05 as specified in the proviso of sub-rule (2) of rule 31.". c. for sub-rule (2), the following shall be substituted, namely: ― "(2) An application for grant of permission to conduct bioavailability or bioequivalence study of any new drug or investigational new drug, or as prior intimation for initiation of bioavailability or bioequivalence studies specified in the proviso to sub-rule (2) of rule 31, as the case may be, shall be accompanied by a fee as specified in the Sixth Schedule and such other information and documents as specified in the Table 2 of the Fourth Schedule: Provided that no fee shall be payable for conducting a bioavailability or bioequivalence study by an institution or organisation owned or funded wholly and partially by the Central Government or a State Government.".
4. In the said rules, in rule 35, ― a. in the marginal heading, for the word “permission”, the words “permission or prior intimation” shall be substituted; b. in the opening paragraph, after the words and figures “study under rule 34”, the words, brackets and figures “or the acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted; c. in clause (xiii), after the words “grant of permission”, the words, brackets and figures “or the acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted.
5. In the said rules, in rule 36, ― a. in the marginal heading, for the word “permission”, the words “permission or acknowledgement of prior intimation” shall be substituted; b. in sub-rule (1), after the words, figures and letters “study granted under rule 34 in Form CT-07”, the words, brackets and figures “or the acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted;

c. for the sub-rule (2), the following sub-rule shall be substituted, namely: ― “(2) In exceptional circumstances, where the Central Licencing Authority is satisfied about the necessity for an extension beyond one year, the said authority may, on the request of the applicant made in writing, extend the period of permission granted or the acknowledgment of prior intimation under the proviso to sub-rule (2) of rule 31 for a further period of one year.”. 6. In the said rules, in rule 37, after the words, figures and letters “study under rule 34 in Form CT-07”, the words, brackets and figures “or under the acknowledgement of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted. 7. In the said rules, in rule 38, ― a. in the marginal heading, for the word “permission”, the words “permission or acknowledgement of prior intimation” shall be substituted; b. in sub-rule (1),–– i. after the words, figures and letters “permission has been granted under rule 34 in Form CT-07”, the words, brackets and figures “or holder of acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted; ii. in clause (iii), after the words, figures and letters “permission granted under rule 34 in Form CT-07”, the words, brackets and figures “or the acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31, as the case may be,” shall be inserted; c. in sub-rule (2), after the words, figures and letters “permission has been granted under rule 34 in Form CT- 07”, the words, brackets and figures “or holder of acknowledgment of prior intimation under the proviso of sub-rule (2) of rule 31” shall be inserted; 8. In the said rules, in the Eighth Schedule, ― a. in Form CT-05, ― A. in the heading, after the words “FOR GRANT OF PERMISSION”, the words “OR OF PRIOR INTIMATION” shall be inserted; B. in the opening paragraph, after the words “apply for grant of permission”, the words “or as prior intimation” shall be inserted.
