सा.का.जन.829(ऄ).––िायुयान (दुघघटनाओं और घटनाओं का ऄन्िेषण) जनयम, 2025 का प्रारूप,
भारतीय िायुयान ऄजधजनयम, 2024 (2024 का16) की धारा 34 की ऄपेक्षानुसार, भारत के राजपत्र,
ऄसाधारण, भाग 2, खंड 3, ईप-खंड (i), तारीख 14 मइ, 2025 में भारत सरकार के नागर जिमानन मंत्रालय
की ऄजधसूचना संख्या सा.का.जन. 310(ऄ) द्वारा ईन सभी व्यजियों से जजनके आससे प्रभाजित हनने की संभािना
हन, ईि ऄजधसूचना की प्रजतयााँ राजपत्र में ईपलब्ध कराए जाने की तारीख़ से तीस ददनों की ऄिजध समाप्त हनने
से पूिघ, अपजियााँ और सुझाि अमंजत्रत करते हुए प्रकाजित दकया गया था;
और, ईि प्रारूप जनयमों कन 14 मइ, 2025 कन जनता के जलए ईपलब्ध कराया गया था;
और, जिजनर्ददष्ट ऄिजध के भीतर ईि प्रारूप जनयमों पर जनता से प्राप्त अपजियों और सुझािों पर जिचार कर
जलया गया है;
ऄत:, ऄब, केंद्रीय सरकार भारतीय िायुयान ऄजधजनयम, 2024 (2024 का 16) की धारा 11, धारा 12, धारा
19, धारा 30, धारा 32 और धारा 33 द्वारा प्रदि िजियों का प्रयनग करते हुए जनम्नजलजखत जनयम बनाती है,
ऄथाघत् : –
1.
संजक्षप्त नाम, जिस्ट्तार, लागू हनना और प्रारम्भ.–– (1) आन जनयमों का संजक्षप्त नाम िायुयान (दुघघटनाओं और
घटनाओं का ऄन्िेषण) जनयम, 2025 है|
(2) आन जनयमों का जिस्ट्तार सम्पूणघ भारत पर है और यह लागू हनगा –

(क) भारत के नागररक जहााँ कहीं भी िे हों;
(ख) भारत में रजजस्ट्रीकृत िायुयानों पर और ईस पर जिद्यमान व्यजियों पर, जहााँ
कहीं भी िे हों;
(ग) भारत के बाहर रजजस्ट्रीकृत िायुयानों पर और ईस पर जिद्यमान व्यजियों पर, दकन्तु जन
ईस समय भारत के भीतर या भारत की िायुसीमा में हों; और
(घ) ऐसा िायुयान जजसका प्रचालन ऐसे व्यजि द्वारा दकया जा रहा हों जन भारत का नागररक
नहीं है दकन्तु ईसके कारनबार का मुख्य स्ट्थान या स्ट्थाइ जनिास भारत में है |
(3) ये जनयम राजपत्र में ईनके प्रकािन की तारीख से लागू होंगे |
2.
पररभाषाएाँ.–– (1) आन जनयमों में, जब तक दक संदभघ से ऄन्यथा ऄपेजक्षत न हन, –
(क) “दुघघटना” से दकसी जिमान के प्रचालन से जुड़ी ऐसी घटना ऄजभप्रेत है जन, –
(i) दकसी मानि युि िायुयान के मामले में, दकसी व्यजि के ईड़ान के आरादे से िायुयान पर
सिार हनने के समय से लेकर ऐसे सभी व्यजियों के ईतरने के समय के बीच घरटत हन; या
(ii) दकसी मानि रजहत िायुयान के मामले में, दकसी िायुयान के ईड़ान के ईद्देश्य से चलने के
जलए तैयार हनने के समय से लेकर ईड़ान के ऄंत में रुक जाने और प्रमुख प्रचालन प्रणाली के बंद
दकए जाने के बीच घरटत हन, जजसमें –
(क) कनइ व्यजि जनम्न के पररणामस्ट्िरूप घातक रूप से या गंभीर रूप से चनट-ग्रस्ट्त
हुअ हन,
(i) िायुयान में सिार हनने से, या
(ii) िायुयान के दकसी भी जहस्ट्से जजसमे िायुयान से ऄलग हुए जहस्ट्से भी िाजमल
है, के साथ सीधे संपकघ में अने से; या
(iii) जेट ब्लास्ट्ट के सीधे संपकघ में अने से,
ईन जस्ट्थजतयों कन छनड़कर , जब चनट प्राकृजतक कारणों से , स्ट्ियं द्वारा ईत्पन्न की गइ हन
या ऄन्य व्यजियों द्वारा ईत्पन्न की गइ हन, या चनट याजत्रयों और कमीदल के जलए
सामान्यत: ईपलब्ध क्षेत्रों से बाहर लगी हन; या
(ख) िायुयान कन ऐसी क्षजत या संरचनागत जिफलता हुइ हन जजससे –
(i) िायुयान की संरचनागत िजि, कायघ जनष्पादन या ईड़ान संबंधी जिजिष्टताएं
प्रजतकूल रूप से प्रभाजित हुए हों; और
(ii) जजसके जलए प्रभाजित पूजे की सामान्यतया बड़ी मरम्मत या बदले जाने की
ऄपेक्षा हन, जसिाय आंजन की जिफलता या क्षजत के, जब यह क्षजत ससगल आंजन
(जजसमें आसके कनसललग या सहायक पुजे िाजमल हैं), प्रनपेलर ,सिगरटप , एंटीना
,प्रनब , िेन , टायर , ब्रेक , पजहये ,फैररग , पैनल, लैंसडग जगयर डनर ,सिड
स्ट्क्रीन ,एयरक्राफ्ट स्ट्कीन (जैसे छनटे डेंट या पंक्चर हनल) या मेन रनटर ब्लेड
,टेल रनटर ब्लेड ,लैंसडग जगयर कन हुइ मामूली क्षजत और ओले पड़ने या पक्षी के
टकराने के पररणामस्ट्िरूप हुइ मामूली क्षजत (जजसमें रेडनम में हुए जछद्र िाजमल
हैं) तक सीजमत हन; या
(ग) िायुयान लापता हन गया हन या पूरी तरह से पहुाँच से बाहर हन |
स्ट्पष्टीकरण: आस खंड के प्रयनजनाथघ, यह स्ट्पष्ट दकया जाता है दक –
(1) िायुयान कन हुइ क्षजत के जनधाघरण हेतु ददिाजनदेि ऄनुसूची “ख” में ददए गए हैं|
(2) केिल ईस मानि रजहत िायुयान पर जिचार दकया जाएगा जजसे दकसी देि द्वारा जडजाआन या
पररचालन के जलए मंजूरी दी गइ हन|

(3) दकसी िायुयान कन लापता तब माना जाएगा जब ईसकी अजधकाररक तलाि कन बंद कर ददया गया
हन और ईसका मलबा न जमला हन|
(ख) “दुघघटना ऄन्िेषण प्राजधकरण” से दकसी देि द्वारा नामजनर्ददष्ट प्राजधकरण ऄजभप्रेत है जजसे ऄंतराघष्ट्रीय
नागर जिमानन संगठन (अइसीएओ) के ईपाबंध 13 के सन्दभघ में िायुयान दुघघटनाओं और घटनाओं के
ऄन्िेषण की जजम्मेदारी दी गइ हन;
(ग) “प्रत्याजयत प्रजतजनजध” से ऐसा व्यजि ऄजभप्रेत है जजसे दकसी देि द्वारा ईसकी ऄहघता के अधार पर
नामजनर्ददष्ट दकया गया हन तादक िह दकसी ऄन्य देि द्वारा दकए जाने िाले ऄन्िेषण में भाग ले सके और
प्रत्याजयत प्रजतजनजध सामान्यत: ईस देि के दुघघटना ऄन्िेषण प्राजधकरण से हनगा;
(घ) “ऄजधजनयम” से भारतीय िायुयान ऄजधजनयम, 2024 (2024 का 16) ऄजभप्रेत है |
(ङ) “सलाहकार” से ऐसा व्यजि ऄजभप्रेत है जजसे दकसी देि द्वारा ईसकी ऄहघता के अधार पर दकसी
ऄन्िेषण में ऄपने प्रत्याजयत प्रजतजनजध कन सहायता प्रदान करने के ईद्देश्य से जनयुि दकया गया हन;
(च) “िायुयान” से ऐसी कनइ मिीन ऄजभप्रेत है जन िायुमंडल में, भू-सतह के जिरुद्ध िायु की प्रजतदक्रयाओं
से जभन्न, िायु की प्रजतदक्रयाओं से सहायता प्राप्त कर सके;
(छ) “िायुयान दुघघटना ऄन्िेषण ब्यूरन या एएअइबी” से ऄजधजनयम की धारा 7 के ऄनुसार केन्द्रीय सरकार
द्वारा गरठत दुघघटना ऄन्िेषण प्राजधकरण ऄजभप्रेत है;
(ज) “ईपाबंध 13” से तारीख 7 ददसंबर, 1944 कन जिकागन में हस्ट्ताक्षररत ऄंतराघष्ट्रीय नागर जिमानन से
संबंजधत ऄजभसमय के ईपाबंध 13 ऄजभप्रेत है;
(झ) “ऄपीलीय ऄजधकारी” से एएअइबी के ऐसे ऄजधकारी ऄजभप्रेत है जजसे नामजनर्ददष्ट ऄजधकारी द्वारा
जलए गए जनणघयों की समीक्षा करने के जलए प्राजधकृत दकया गया हन;
(ञ) “कारण” से ऐसी कारघिाइयों, जिलनपन, घटनाओं, जस्ट्थजतयों, या ईनके संयनजन ऄजभप्रेत है जजसके
पररणामस्ट्िरूप कनइ दुघघटना या घटना घरटत हुइ है दकन्तु िे दनष समनुदेजित करने या प्रिासजनक,
जसजिल या अपराजधक दाजयत्ि जनधाघररत करने की कनरट में नहीं अते;
(ट)"सी2 सलक" - से दूरस्ट्थ रूप से संचाजलत जिमान और दूरस्ट्थ पायलट स्ट्टेिन के बीच ईड़ान प्रबंधन के
ईद्देश्य से जनड़ा गया डेटा ऄजभप्रेत है;
(ठ) “जिकागन ऄजभसमय” से तारीख 7 ददसंबर, 1944 कन जिकागन में हस्ट्ताक्षररत ऄंतराघष्ट्रीय नागर
जिमानन से संबंजधत ऄजभसमय ऄजभप्रेत है;
(ड) “सहायक घटक” से कारघिाइयों, जिलनपन, घटनाओं, जस्ट्थजतयों, या ईनके संयनजन ऄजभप्रेत है जजसकी
समाजप्त, टाले जाने या ऄनुपजस्ट्थजत ने दुघघटना या घटना के घरटत हनने की संभािना कन कम कर ददया
हनगा, या दुघघटनाओं या घटनाओं के परीणामों की तीव्रता कन कम कर ददया हनगा और सहायक घटकों की
पहचान प्रिासजनक, जसजिल या अपराजधक दाजयत्ि के जनधाघरण या गलती का संकेत नही करता है;
(ढ) “नामजनर्ददष्ट ऄजधकारी” से एएअइबी के ऄजधकारी ऄजभप्रेत है जजसे आन जनयमों के ईल्लंघन की
गम्भीरता स्ट्तर के अधार पर ऄनुसूची ‘ग’ की सारणी-1 और सारणी-2 मे जिजनर्ददष्ट ईपबंधों के ऄनुसार
दकसी व्यजि या संगठन के जिरुद्ध ईजचत कायघिाही करने के जलए प्राजधकृत दकया गया हन;
(ण) “महाजनदेिक, नागर जिमानन महाजनदेिालय” से महाजनदेिक ऄजभप्रेत है जन नागर जिमानन
महाजनदेिालय का प्रमुख हनगा;
(त) “महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन” से महाजनदेिक ऄजभप्रेत है जन िायुयान दुघघटना
ऄन्िेषण ब्यूरन का प्रमुख हनगा;
(थ) “ऄंजतम प्रारूप ररपनटघ” से जनयम 14 के ईप-जनयम (1) के ऄधीन परामिघ के जलए दकसी देि कन
ऄग्रेषण के जलए, जनयम (11) या जनयम (12) के ऄधीन जनयुि ऄन्िेषकों द्वारा प्रस्ट्तुत की गइ ररपनटघ
ऄजभप्रेत है;

(द) “घातक चनट” से ऐसी चनट ऄजभप्रेत है जन दकसी व्यजि कन दकसी दुघघटना में लगी हन, जजसके
पररणामस्ट्िरूप दुघघटना के तीस ददन के भीतर ईसकी मृत्यु हन गइ हन;
(ध) “फ्लाइट ररकाडघर” से िायुयान में दुघघटना या घटना के ऄन्िेषण में सहायता प्रदान करने के ईद्देश्य से
संस्ट्थाजपत दकसी प्रकार का ररकाडघर ऄजभप्रेत है;
(न) “अइसीएओ” से 07 ददसंबर ,1944 कन जिकागन में हस्ट्ताक्षररत ऄंतराघष्ट्रीय नागर जिमानन से संबंजधत
ऄजभसमय के ऄधीन बनाया गया ऄंतराघष्ट्रीय नागर जिमानन संगठन ऄजभप्रेत है;
(प) “घटना” से दुघघटना कन छनड़कर, दकसी िायुयान के प्रचालन से जुड़ी कनइ ऐसी घटना ऄजभप्रेत है
जजसके प्रचालन से सुरक्षा प्रभाजित हुइ हन या हन सकती हन;
(फ) “ऄन्िेषण” से दुघघटना की रनकथाम के प्रयनजनाथघ अयनजजत ऐसी प्रदक्रया ऄजभप्रेत है, जजसमें कारणों,
सहायक घटकों के जनधाघरण सजहत सूचना एकत्रण और जिश्लेषण, जनष्कषघ जनकालने और जहााँ ईपयुि हन,
ररपनटघ के रूप में सुरक्षा संबंधी जसफाररिें दकया जाना िाजमल है;
(ब) “ऄन्िेषक” से िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा जनयम 11 के ऄधीन दुघघटना, ऄथिा दकसी गंभीर
घटना का ऄन्िेषण करने के जलए प्रभारी ऄन्िेषक के रूप में जनयुि, ऄथिा जनयम 12 के ऄधीन
औपचाररक ऄन्िेषण के जलए केन्द्रीय सरकार द्वारा, ऄथिा ब्यूरन द्वारा जनयम 9 के ईप-जनयम (1) ऄथिा
जनयम 7 के ईप-जनयम (2) के ऄधीन प्राथजमक ऄन्िेषण करने के जलए प्राजधकृत व्यजि; ऄथिा जनयम 13
के ऄधीन महाजनदेिक नागर जिमानन महाजनदेिालय द्वारा जनयुि प्रभारी ऄन्िेषक ऄजभप्रेत है;
(भ) “प्रभारी ऄन्िेषक” से ऐसा व्यजि ऄजभप्रेत है जजसे ईसकी ऄहघता के अधार पर दकसी ऄन्िेषण के
संगठन, संचालन और जनयंत्रण की जजम्मेदारी सौंपी गइ है|
परन्तु आस खंड में कुछ भी जनयम 12 में जनर्ददष्ट कनटघ या ऄन्य जनकाय कन प्रभारी ऄन्िेषक के कायघ सौंपने
से नहीं रनकेगा;
(म) “ऄजधकतम मास” से ऄजधकतम प्रमाजणत टेक –ऑफ़ मास ऄजभप्रेत है;
(य) “गुमिुदा िायुयान” से जब अजधकाररक खनज समाप्त हन गइ हन और िायुयान के मलबे कन ढूाँढा नहीं
जा सका हन, ऄजभप्रेत है;
(यक) “घटना” से दकसी सुरक्षा-संबंधी घटना जन जनजखम में डालती है या जजसे यदद सुधारा ऄथिा ध्यान
नहीं ददया जाए तन दकसी िायुयान, ईसके याजत्रयों या दकसी ऄन्य व्यजि कन जनजखम में डाल देगी, आसमें
घटना, गंभीर घटना और दुघघटना िाजमल है, ऄजभप्रेत है;
(यख) “प्रचालक” से दकसी िायुयान के प्रचालन में संजलप्त या संजलप्त हनने के जलए प्रस्ट्ताि करने िाले दकसी
व्यजि या संगठन या ईद्यम ऄजभप्रेत है;
(यग) “प्रारंजभक ररपनटघ” से ऄन्िेषण की प्रारंजभक ऄिस्ट्थाओं के दौरान प्राप्त दकए गए अंकड़ों के त्िररत
प्रसारण के जलए प्रयुि संचार साधन ऄजभप्रेत है;
(यघ) "दूरस्ट्थ पायलट स्ट्टेिन" से दूरस्ट्थ रूप से संचाजलत जिमान प्रणाली का िह घटक ऄजभप्रेत है जजसमें
दूरस्ट्थ रूप से संचाजलत जिमान कन संचाजलत करने के जलए ईपयनग दकए जाने िाला ईपस्ट्कर िाजमल
हनता है;
(यङ) "दूरस्ट्थ रूप से संचाजलत जिमान" से ऐसा मानि रजहत जिमान ऄजभप्रेत है जजसे दूरस्ट्थ पायलट
स्ट्टेिन से संचाजलत दकया जाता है;
(यच) "दूरस्ट्थ रूप से संचाजलत जिमान प्रणाली" से एक दूरस्ट्थ रूप से संचाजलत जिमान, ईससे संबंजधत
दूरस्ट्थ पायलट स्ट्टेिन, अिश्यक सी2 सलक और टाआप जडजाआन में जनर्ददष्ट कनइ ऄन्य घटकों ऄजभप्रेत है;
(यछ) “सुरक्षा जसफाररि” से, –
(i) दकसी ऄन्िेषण से व्युत्पन्न जानकारी के अधार पर दुघघटनाओं या घटनाओं कन रनकने के अिय से
दकसी दुघघटना ऄन्िेषण प्राजधकरण द्वारा दकए गए प्रस्ट्ताि ऄजभप्रेत है और जजसमें दकसी दुघघटना या
घटना के जलए अरनप या दाजयत्ि की धारणा बनाने का ईद्देश्य न हन; या

(ii) जिजिध स्त्रनतों और सुरक्षा ऄध्ययनों से प्राप्त जसफाररिें ऄजभप्रेत है;
(यज) “िैजिक प्रजतष्ठानों की संरक्षा संबंधी जसफाररि” से प्रणालीगत कमी से संबंधी संरक्षा जसफाररि
ऄजभप्रेत है, जजनके दकसी िैजिक स्ट्तर पर महत्िपूणघ पररणामों सजहत पुन: हनने की संभािना हन और
सुरक्षा में सुधार के जलए समय पर कारिाइ ऄपेजक्षत हन;
(यझ) “ऄनुसूची” से आन जनयमों के साथ संलग्न ऄनुसूची ऄजभप्रेत है;
(यञ) “गंभीर घटना” से ऐसी घटना ऄजभप्रेत है, जजसमें ऐसी पररजस्ट्थजतयां िाजमल हों जन यह आंजगत
कराती हों दक दकसी दुघघटना की ऄत्यजधक संभािना थी और यह ऐसे िायुयान के प्रचालन से संबंजधत हन
जन –
(i) दकसी मानि युि िायुयान के मामले में, दकसी व्यजि के ईड़ान के आरादे से िायुयान पर सिार हनने
के समय से लेकर ऐसे सभी व्यजियों के ईतरने के समय के बीच घरटत हन; या
(ii) दकसी मानि रजहत िायुयान के मामले में, दकसी िायुयान के ईड़ान के ईद्देश्य से चलने के जलए तैयार
हनने के समय से लेकर ईड़ान के ऄंत में रुक जाने और प्रमुख प्रचालन प्रणाली के बंद दकए जाने के बीच
घरटत हन, जजसमें-
स्ट्पष्टीकरण- संदेह दूर करने हेतु यह स्ट्पष्ट दकया जाता है दक गंभीर घटनाओं के ईदाहरण ऄनुसूची क में
जनर्ददष्ट हैं |
(यट) “गंभीर चनट” से दकसी घटना में व्यजि द्वारा लगी चनट ऄजभप्रेत है, जजसमें –
(i) चनट लगने की जस्ट्थजत के सात ददन के भीतर 48 घंटें से ऄजधक समय के जलए ऄस्ट्पताल में
रहना ऄपेजक्षत हन; या
(ii) जजसके पररणामस्ट्िरूप कनइ हड्डी टूट गइ हन (ऄाँगुजलयों, ऄंगूठों या नाक के मामूली फ्रैक्चर
कन छनड़कर); या
(iii) ऐसी चनटें लगी अइ हों जजनमें रिस्त्राि, स्नायु, मांसपेिी या नस कन ऄत्यजधक क्षजत हुइ
हन; या
(iv) दकसी अन्तररक ऄंग कन चनट लगी हन; या
(v) दूसरी या तीसरी जडग्री का ज्िलन, या पांच प्रजतित से ऄजधक प्रभाजित करने िाले ज्िलन
िाजमल हों; या
(vi) जजसमें संक्रामक िस्ट्तुओं या घातक जिदकरण से प्रमाजणत संक्रमण िाजमल हन;
(यठ) “जडजाआन का देि” से िह देि ऄजभप्रेत है जजसके ऄजधकार क्षेत्र में िायुयान टाआप जडजाआन के
जलए ईिरदायी संगठन अता हन;
(यड) “जिजनमाघता देि” से िह देि ऄजभप्रेत है जजसके ऄजधकार क्षेत्र में िायुयान, दूरस्ट्थ पायलट स्ट्टेिन,
आंजन या प्रनपेलर की फाआनल ऄसेंबली के जलए ईिरदायी संगठन अता हन;
(यढ) “घटना संबंधी देि” से िह देि ऄजभप्रेत है जजसके ऄजधकार क्षेत्र में कनइ दुघघटना या घटना घटी हन;
(यण) “प्रचालक का देि” से िह देि ऄजभप्रेत है जजसमें प्रचालक का मुख्य कारनबार स्ट्थल जस्ट्थत हन या,
यदद ऐसा कनइ कारनबार स्ट्थल न हन तन प्रचालक का स्ट्थाइ जनिास हन;
(यत) “रजजस्ट्री का देि” से िह देि ऄजभप्रेत है जजसके रजजस्ट्टर में िायुयान की प्रजिजष्ट हुइ हन;
स्ट्पष्टीकरण: राष्ट्रीय अधार से जभन्न दकसी ऄंतराघष्ट्रीय संचालन एजेंसी के िायुयान की रजजस्ट्री के मामले
में , एजेंसी कन गरठत करने िाले देि संयुि रूप से और जभन्न –जभन्न रूप से ईन दाजयत्िों का जनिघहन
करेंगे जन ईपाबंध 13 के ऄधीन रजजस्ट्री देि से जुड़े हैं|
(यथ) “देि के सुरक्षा कायघक्रम” से सुरक्षा में सुधार लाने के ईद्देश्य से जिजनयमों और गजतजिजधयों का
एकीकृत सेट ऄजभप्रेत है;

(यद) “यूटीसी” से युजनिसघल टाइम कनऑर्तडनेटेड ऄजभप्रेत है;
(2) ईन िब्दों और पदों के, जन आसमें प्रयुि हैं और पररभाजषत नहीं है दकन्तु भारतीय िायुयान ऄजधजनयम
2024 (2024 का 16) में पररभाजषत हैं, िही ऄथघ होंगे, जन ईनके आस ऄजधजनयम में है।
3.
दुघघटनाओं और घटनाओं के ऄन्िेषण का ईद्देश्य. –– (1) दकसी दुघघटना या घटना के ऄन्िेषण का एकमात्र
ईद्देश्य दुघघटनाओं या घटनाओं की रनकथाम हनगा न दक अरनप या दाजयत्ि कन थनपना |
(2) आन जनयमों के ईपबंधों के ऄनुसार दकया गया कनइ भी ऄन्िेषण अरनप या दाजयत्ि कन थनपने हेतु दकसी
न्याजयक या प्रिासजनक कारघिाइ से पृथक हनगा |
4.
घटना की ऄजधसूचना. –– (1) जहााँ जनयम 1 के ईप–जनयम (2) के ऄधीन अने िाले िायुयान के साथ कनइ
दुघघटना या गंभीर घटना हनती है तन िायुयान का मुख्य पायलट या, यदद िह मृत या ऄक्षम हन चुका हन, तन
िायुयान का स्ट्िामी, प्रचालक, भाड़े पर लेने िाले या दकसी ऄन्य व्यजि जजसकी ओर से मुख्य पायलट
िायुयान का प्रभारी था या कनइ संबद्ध व्यजि, जैसा भी मामला हन, यथािीघ्र औजचत्यपूणघ रूप से
व्यािहाररक हन लेदकन दकसी भी मामले में दुघघटना या घटना के बारे में पता चलने के चौबीस घंटे से ऄजधक
नहीं, –
(क) आसकी सूचना ऄपने पास ईपलब्ध तीव्रतम संचार साधनों द्वारा िायुयान दुघघटना ऄन्िेषण ब्यूरन और
नागर जिमानन महाजनदेिालय कन प्रेजषत करेगा; और
(ख) भारत में घरटत हुइ दकसी दुघघटना या गंभीर घटना के मामले में, ईस दुघघटना ऄथिा गंभीर घटना
तथा ईसके घरटत हनने के स्ट्थान की सूचना सम्बजन्धत क्षेत्र के जजलाधीि और जनकटतम थाने के प्रभारी
कन देगा :
बिते दक मानिरजहत जिमान के मामले में, दूरस्ट्थ मुख्य पायलट ईपयुघि ऄनुसार घटना की सूचना
ऄजधसूजचत करेगा |
(2) ऄजधसूचना सहज भाषा में हनगी और ईसमें जनम्नजलजखत जानकारी में से जजतनी तुरंत ईपलब्ध हन सके
ईतनी जानकारी िाजमल हनगी, ऄथाघत :–
(क) दुघघटनाओं की पहचान के जलए संजक्षप्त ऄक्षर ए.सी.सी.अइ.डी. (ACCID) और घटनाओं के जलए
अइ.एन.सी.अइ.डी. (INCID), गंभीर घटनाओं के जलए एस.अइ.एन.सी.अइ.डी. (SINCID);
(ख) िायुयान के जनमाघता, माडल, राष्ट्रीयता और रजजस्ट्री जचन्ह तथा िायुयान का क्रमांक;
(ग) िायुयान के स्ट्िामी, प्रचालक या ईसे भाड़े पर लेने िाले, यदद कनइ हन, का नाम;
(घ) मुख्य पायलट की यनग्यता और कमीदल तथा याजत्रयों की राष्ट्रीयता;
(ङ) दुघघटना या गंभीर घटना की तारीख और समय स्ट्थानीय समय या यूटीसी में;
(च) प्रस्ट्थान का ऄंजतम सबदु और िायुयान की जनयत लैंसडग स्ट्थल;
(छ) असानी से पररभाजषत दकसी भौगनजलक सबदु और ऄक्षांि और देिांतर की दृजष्ट से िायुयान की
ऄिजस्ट्थजत;
(ज) िायुयान में सिार मृत और गंभीर रूप से घायल कमीदल और याजत्रयों की संख्या, ऄन्य मृत और
गंभीर रूप से घायलों की संख्या;
(झ) दुघघटना या गंभीर घटना का जििरण और जहााँ तक ज्ञात हन िायुयान कन हुइ क्षजत की सीमा;
(ञ) दुघघटना या गंभीर घटना के क्षेत्र की भौगनजलक जििेषताएं और साथ ही स्ट्थल तक पहुाँचने में अने
िाली करठनाआयों या जििेष अिश्यकताओं का कनइ संकेत; और
(ट) िायुयान में ईड़ान के दौरान खतरनाक िस्ट्तुओं की जिद्यमानता और जििरण, दकन्तु पूणघ सूचना के
ऄभाि में ऄजधसूचना में जिलम्ब नहीं दकया जाना चाजहए |
(3) यदद ईप-जनयम (2) में जनर्ददष्ट ब्यौरा या ऄन्य ज्ञात सुसंगत सूचना छूट जाए तन ऐसी सूचना भी
यथासंभि िीघ्र प्रेजषत की जाएगी |

(4) ईप- जनयम (2) के ऄधीन ऄपेजक्षत ऄजधसूचना जनम्न के द्वारा िायुयान दुघघटना ऄन्िेषण ब्यूरन कन भी
प्रस्ट्तुत की जाएगी –
(क) हिाइऄड्डा प्रचालक;
(ख) संबंजधत जिमान यातायात सेिा प्रभारी;
(ग) महाजनदेिक, नागर जिमानन महाजनदेिालय (डीजीसीए), जहााँ कहीं लागू हन |
(5) िायुयान दुघघटना ऄन्िेषण ब्यूरन भारतीय सीमा या भारत की सीमा से परे समुद्री िायु क्षेत्र में दुघघटना
या गंभीर घटना के तथ्यों कन ईप-जनयम (2) में जनर्ददष्ट ऄजधकतम ईपलब्ध जानकारी के ऄजिलम्ब तथा
ईपलब्ध सिाघजधक ईपयुि एिं तीव्रतम साधनों द्वारा जनम्न कन सूजचत करेगा –
(क) रजजस्ट्री देि;
(ख) प्रचालक देि;
(ग) जडजाआन देि;
(घ) जिजनमाघता देि; और
(ङ) ऄंतराघष्ट्रीय नागर जिमानन संगठन (अइसीएओ), जब िायुयान में 2,250 दकग्रा से ऄजधक
ऄजधकतम मास िाजमल है या िह टबोजेट – पिार युि िायुयान है |
(6) िायुयान दुघघटना ऄन्िेषण ब्यूरन ईप- जनयम (5) के ऄनुसरण में सूचना कन ऄजधसूजचत करते समय
जनम्नजलजखत सूचना कन भी जनड़ेगा, ऄथाघत :–
(क) यह संकेत दक िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा दकस सीमा तक जााँच की जाएगी या िायुयान
दुघघटना ऄन्िेषण ब्यूरन द्वारा ऄन्य देि कन प्रत्यायनजजत करना प्रस्ट्ताजित है; और
(ख) मूल प्राजधकरण की पहचान और प्रभारी ऄन्िेषणकताघ या जनयम 12 में जनर्ददष्ट कनटघ से संपकघ करने
का तरीका, जैसा भी मामला हन;
(7) यदद िह देि जहां दुघघटना हुइ है, भारतीय रजजस्ट्री िायुयान या भारतीय प्रचालक द्वारा प्रचजलत
िायुयान के साथ हुए गंभीर घटना या दुघघटना से ऄिगत नहीं है, तन िायुयान दुघघटना ऄन्िेषण ब्यूरन ऐसी
गंभीर घटना या दुघघटना की सूचना की ऄजधसूचना जडजाआन देि, जिजनमाघता देि और घटना िाले देि कन
ऄग्रेजषत करेगा |
5.
ऄन्िेषण करने की बाध्यता. –– (1) भारत के ऄजधकार क्षेत्र में दकसी िायुयान दुघघटना या गंभीर घटना या
घटना की जस्ट्थजत में, आसकी रजजस्ट्री के बािजूद,–
(क) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन ईस दुघघटना की पररजस्ट्थजतयों का ऄन्िेषण अरंभ
करेगा और ऄन्िेषण करने के जलए ईिरदायी हनगा;
(ख) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन ईस गंभीर घटना की पररजस्ट्थजतयों का ऄन्िेषण
अरंभ करेगा जब संबंजधत िायुयान का ऄजधकतम भार 2250 दकलनग्राम से ऄजधक हन या टबो-जेट
जिमान हन|
(ग) महाजनदेिक, नागर जिमानन महाजनदेिालय खंड (ख) के ऄधीन न अने िाले िायुयान से संबंजधत
सभी घटनाओं और गंभीर घटनाओं की पररजस्ट्थजतयों का ऄन्िेषण अरंभ करेगा;
(घ) केन्द्रीय सरकार दकसी भी भारतीय रजजस्ट्री िायुयान की दकसी घटना की पररजस्ट्थजतयों का
औपचाररक ऄन्िेषण कर सकती है, यदद ईन्हें आस प्रकार के ऄन्िेषण करना ईजचत प्रतीत हनता है |
(2) ईप–जनयम (1) के खंड (ग) में ऄंतर्तिष्ट दकसी बात के हनते हुए भी, जहााँ िायुयान ऄन्िेषण ब्यूरन कन
यह प्रतीत हनता है दक ईि खंड (ग) के ऄधीन अने िाली दकसी भी गंभीर घटना की पररजस्ट्थजतयों का
ऄन्िेषण कराना अिश्यक या ईजचत है, तन िह अदेि द्वारा दकसी भी िायुयान की गंभीर घटना की
पररजस्ट्थजतयों का ऄन्िेषण अरंभ कराएगा |

(3) िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा दकसी भी घटना का दुघघटना या गंभीर घटना या घटना के रूप
स्ट्पष्टीकरण ऄंजतम और बाध्यकारी हनगा |
(4) यदद भारत में रजजस्ट्रीकृत िायुयान की दकसी ऐसे स्ट्थल पर दुघघटना या गंभीर घटना हन जाती है, जन
दकसी देि का राज्य क्षेत्र नहीं है, तन िायुयान दुघघटना ब्यूरन ईस दुघघटना या गंभीर घटना की पररजस्ट्थजतयों
का ऄन्िेषण कराएगा तथा ऄन्िेषण करिाने के जलए ईिरदायी हनगा|
(5) यदद भारत में रजजस्ट्रीकृत न दकए गए या दकसी भारतीय प्रचालक द्वारा प्रचाजलत न दकए जा रहे दकसी
िायुयान की ऄंतराघष्ट्रीय सामुदद्रक क्षेत्र में दुघघटना हनती है और भारत दुघघटना के स्ट्थल का जनकटतम देि है,
तन िायुयान दुघघटना ऄन्िेषण ब्यूरन रजजस्ट्री के देि कन ऄन्िेषण प्रारंभ करने की सलाह देगा और ऐसी
जस्ट्थजत में िायुयान दुघघटना ऄन्िेषण ब्यूरन यथासंभि सीमा तक सहायता प्रदान कराएगा और आसी प्रकार
रजजस्ट्री के देि द्वारा दकए गए ऄनुरनधों का प्रत्युिर देगा |
6.
ऄन्िेषण में भागीदारी. –– (1) यदद िायुयान दुघघटना ऄन्िेषण ब्यूरन जनयम 5 के ऄनुसार दकसी दुघघटना या
दकसी गंभीर घटना का ऄन्िेषण अरंभ कर चुका है, तन ईन प्रत्याजयत प्रजतजनजधयों कन ऄन्िेषण में भाग लेने
की ऄनुमजत प्रदान की जाएगी, जजनकी जनयुजि जनम्नजलजखत देिों द्वारा की जाती है, ऄथाघत : –
(क) रजजस्ट्री देि;
(ख) प्रचालक देि;
(ग) पररकल्पना देि;
(घ) जिजनमाघता देि;
(2) ईप-जनयम (1) में जनर्ददष्ट देि ऄपने प्रत्याजयत प्रजतजनजधयों की सहायता करने के जलए एक या एक से
ऄजधक सलाहकारों की जनयुजि के भी हकदार होंगे |
(3) ईप-जनयम (1) में जनर्ददष्ट देिों के ईपाबन्ध 13 के ऄधीन ऄनुबद्ध मानकों के ऄनुसार ऄजधकार एिं हक
होंगे |
(4) कनइ देि जन दुघघटना के कारण ऄपने नागररकों के हताहत हनने ऄथिा गंभीर रूप से घायल हनने के
कारण ऄन्िेषण में जििेष रूजच रखता है, िह जििेषज्ञ कन जनयुि करने का हददार हनगा जजसे ईपाबंध 13
के ऄधीन ऄनुबद्ध मानकों के ऄनुसार ऄजधकार एिं हक होंगे|
(5) कनइ ऄन्य देि, जन ईप-जनयम (1) के खंड (क) से (घ) में सूचीबद्ध न हन, ऄनुरनध दकए जाने पर
िायुयान दुघघटना ऄन्िेषण ब्यूरन कन सूचना, सुजिधाएं या जििेषज्ञ ईपलब्ध कराता है, तन िह भी ऄन्िेषण में
भाग लेने हेतु प्रत्याजयत प्रजतजनजध की जनयुजि करने का हकदार हनगा जजसे ईपाबंध 13 के ऄधीन ऄनुबद्ध
मानकों के ऄनुसार ऄजधकार एिं हक होंगे |
(6) िायुयान दुघघटना ऄन्िेषण ब्यूरन दकसी ऄन्य देि के राज्य क्षेत्र में भारतीय रजजस्ट्रीकृत िायुयान की
दकसी दुघघटना या गंभीर घटना की सूचना की ऄजधसूचना प्राप्त हनने पर, ऄन्िेषण में भाग लेने के जलए
प्रत्याजयत प्रजतजनजध और सलाहकार की जनयुजि कर सकेगा और आसकी सूचना घटना िाले देि कन देगा |
(7) यदद िायुयान दुघघटना ऄन्िेषण ब्यूरन के पास दकसी दुघघटना या घटना में िाजमल जिमान के फ्लाआट
ररकॉडघर से संबंजधत कनइ डेटा ईपलब्ध है, तन िह :–
(क) जबना दकसी जिलंब के, ईस डेटा कन ईस देि कन प्रदान करेगा जन जांच का संचालन कर रहा है; और
(ख) ईस डेटा कन तब तक प्रकट नहीं करेगा जब तक दक जांच का संचालन करने िाले देि से स्ट्पष्ट
सहमजत प्राप्त न हन।
7.
साक्ष्य की संरक्षा, क्षजतग्रस्ट्त िायुयान की ऄजभरक्षा, हटाया जाना और परररक्षण. –– (1) दकसी दुघघटना या
गंभीर घटना के मामले में, जजसे जनयम 4 के ऄधीन ऄजधसूजचत दकया जाना ऄपेजक्षत हन, ऄन्िेषण प्रभारी
कन मलबे तथा ईड़ान ररकाडघरों तथा िायुयान यातायात सेिा ररकाडघरों सजहत सभी संबंजधत िस्ट्तुओं और
जानकारी तक जनबाघध पहुाँच की सुजिधा हनगी, तथा आस पर यह सुजनजित करने के जलए ऄजनबंजधत जनयंत्रण
हनगा दक ऄन्िेषण में भाग लेने िाले प्राजधकृत कार्तमकों द्वारा ऄजिलंब जिस्ट्तृत जााँच की जा सके |

स्ट्पष्टीकरण: आस खंड के प्रयनजनों के जलए, दूरस्ट्थ रूप से संचाजलत जिमान प्रणाली के मामले में, ईपजनयम
(1) में ईजल्लजखत प्रासंजगक सामग्री में दूरस्ट्थ रूप से संचाजलत जिमान, आससे जुड़े दूरस्ट्थ पायलट स्ट्टेिन,
अिश्यक सी2 सलक, टाआप जडजाआन में यथाजिजनर्ददष्ट ऄन्य कनइ घटक, और संबंजधत ररकॉर्डडग्स ि दस्ट्तािेज
िाजमल है।
(2) िायुयान या ईसके जहस्ट्सों या ईससे संबंजधत ऄन्तिघस्ट्तुओं कन महाजनदेिक, िायुयान दुघघटना ऄन्िेषण
ब्यूरन के प्राजधकार के ऄधीन दकसी व्यजि के जसिाय हटाया या ऄन्यथा हस्ट्तक्षेप नहीं दकया जा सकेगा |
परन्तु –
(क) जीजित या मृत व्यजिओं या प्राजणयों कन जनकालने, िायुयान और आसकी ऄन्तिघस्ट्तुओं कन अग या
दकसी ऄन्य कारण से जिनष्ट हनने से बचाने या जनता या हिाइ नेजिगेिन या ऄन्य पररिहन कन हनने
िाली दकसी क्षजत या ऄिरनध कन रनकने के प्रयनजन से खनज एिं बचाि कायघ करने के जलए प्राजधकृत
व्यजियों द्वारा िायुयान या ईसके जहस्ट्सों कन या ऄन्तिघस्ट्तुओं कन ईस सीमा तक हटाया या छेड़छाड़ की
जाएगी जजस सीमा तक ऐसा करना अिश्यक हन;
(ख) यदद िायुयान जल में नष्ट हुअ है तन खनज एिं बचाि कायघ करने के जलए प्राजधकृत व्यजियों द्वारा
िायुयान या ईसके जहस्ट्सों कन या ऄन्तिघस्ट्तुओं कन ईस सीमा तक हटाया जा सकेगा जहााँ तक ईन्हें
सुरजक्षत स्ट्थान तक लाने के जलए अिश्यक हन;
(ग) िायुयान से माल कन िायुयान दुघघटना ऄन्िेषण ब्यूरन के ऄजधकारी या महाजनदेिक, िायुयान
दुघघटना ऄन्िेषण ब्यूरन द्वारा प्राजधकृत व्यजि के पयघिेक्षण के ऄधीन और ईनकी सहमजत से हटाया जा
सकेगा |
(घ) याजत्रयों और कमीदल के व्यजिगत सामान कन फनटनग्राफी, िजन अदद करने के बाद पुजलस
ऄजधकारी, मजजस्ट्रेट, िायुयान दुघघटना ऄन्िेषण ब्यूरन के ऄजधकारी या महाजनदेिक, िायुयान दुघघटना
ऄन्िेषण ब्यूरन द्वारा प्राजधकृत व्यजि के पयघिेक्षण के ऄधीन जिमान से हटाया जा सकेगा; और
(ङ) डाक कन फनटनग्राफी के बाद दकसी पुजलस ऄजधकारी, मजजस्ट्रेट, डाक तार जिभाग के ऄजधकारी या
िायुयान दुघघटना ऄन्िेषण ब्यूरन के ऄजधकारी या महाजनदेिक, िायुयान दुघघटना ब्यूरन द्वारा प्राजधकृत
व्यजि के पयघिेक्षण के ऄधीन हटाया जा सकेगा |
(3) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन आन जनयमों के ऄधीन प्रारंजभक ऄन्िेषण सजहत दकसी भी
ऄन्िेषण के प्रयनजनाथघ जनदेि जारी कर सकेगा, दकसी भी व्यजि या व्यजियों कन जनम्नजलजखत कदम ईठाने
के जलए प्राजधकृत कर सकेगा, –
(क) साक्ष्य कन बचाना, जजसमें हटा जलए जाने, प्रभाजित हनने, खन जाने ऄथिा नष्ट हन जाने िाले दकसी
साक्ष्य की फनटनग्राफी ऄथिा ऄन्य तरीके से संरक्षा भी िाजमल हनगी;
(ख) िायुयान या जहस्ट्सों या ऄंतिघस्ट्तु की सुरजक्षत ऄजभरक्षा करना तथा आसमें ऄजधक क्षजतग्रस्ट्त हनने,
दकसी ऄप्राजधकृत व्यजि की पहुाँच, चनरी हनने तथा और ऄजधक ख़राबी से संरक्षण भी िाजमल है;
(ग) िायुयान कन ऐसी ऄिजध तक सुरजक्षत रखना जन दकसी ऄन्िेषण के प्रयनजनाथघ अिश्यक हन;
(घ) एक ईपयुि स्ट्थान की व्यिस्ट्था करना और ऐसे स्ट्थान के जलए मलबे की ढुलाइ के जलए पररिहन
सुजिधा प्रदान करना |
(4) िायुयान का स्ट्िामी या ईसके नामजनदेजित प्रजतजनजध कन ईप –जनयम (1), (2) और (3) के ऄधीन
दकसी भी जााँच या ऄन्य कारघिाइ के दौरान ईपजस्ट्थत रहने का ऄजधकार हनगा;
परन्तु िायुयान दुघघटना ऄन्िेषण ब्यूरन स्ट्िामी या ईसके प्रजतजनजध की ऄनुपजस्ट्थजत के कारण से दकसी भी
ऐसी कारघिाइ कन स्ट्थजगत करने के जलए बाध्य नहीं हनगा जजसे िह आस जनयम के ऄधीन अिश्यक समझे |
(5) यदद िायुयान दुघघटना ऄन्िेषण ब्यूरन कन रजजस्ट्री के देि , प्रचालक देि ,पररकल्पना के देि या
जिजनमाघता देि की ओर से कनइ ऄनुरनध प्राप्त हनता है दक िायुयान, आसकी ऄंतिघस्ट्तुएं और कनइ ऄन्य साक्ष्य
ऄनुरनधकताघ देि के दकसी प्रत्याजयत प्रजतजनजध द्वारा जनरीक्षण लंजबत रहने तक ऄबाजधत रहे, तन िायुयान

दुघघटना ऄन्िेषण ब्यूरन , जहााँ तक औजचत्यपूणघ रूप से व्यिहायघ हन और ऄन्िेषण के ईपयुि संचालन के
संगत हन ,ऐसे ऄनुरनध के ऄनुपालन के जलए ईप- जनयम (1) और (2) के ईपबंधों के ऄध्यधीन सभी
अिश्यक कदम ईठाएगा |
(6) ईप-जनयम (1), (2) और (3) के ईपबंधों के ऄध्यधीन, िायुयान दुघघटना ऄन्िेषण ब्यूरन ऄन्िेषण के
प्रयनजनाथघ ऄपेजक्षत न हनने पर जिदेि में रजजस्ट्रीकृत िायुयान के मामले में िायुयान, आसकी ऄंतिघस्ट्तुएं या
आसके ऄन्य जहस्ट्सों की ऄजभरक्षा, यथािीघ्र ईसके स्ट्िामी या ईसके प्रजतजनजध या रजजस्ट्री के देि या प्रचालक
देि द्वारा सम्यक रूप से नामजनर्ददष्ट व्यजि या व्यजियों कन देगा |
(7) ईप-जनयम (6) के प्रयनजनाथघ, केंद्रीय सरकार ऐसे िायुयान, आसकी ऄंतिघस्ट्तुएं या आसके दकसी भी जहस्ट्से
तक पहुाँच सुगम बनाएगी:
परन्तु , यदद िायुयान, आसकी ऄंतिघस्ट्तुएं या आसके कनइ भी जहस्ट्से यदद ऐसे क्षेत्र में पड़े हन जहााँ िायुयान
दुघघटना ऄन्िेषण ब्यूरन ऐसी पहुाँच प्रदान करना ऄव्यिहायघ पाता है , तन केंद्रीय सरकार ईसे िहां तक
हटाएगी जहााँ तक पहुाँच प्रदान की जा सकती है |
(8) िायुयान दुघघटना ऄन्िेषण ब्यूरन मलबे और ररकाडघरों सजहत ऄन्िेषण के दौरान एकत्र दकए गए साक्ष्यों
की ऄजभरक्षा के संबंध में एकमात्र ऄजभकरण हनगा | दकसी ऄन्य ऄजभकरण द्वारा ऐसे साक्ष्यों तक पहुाँच की
ऄपेक्षा के मामले में महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन, ऐसी पहुाँच की ऄपेक्षा से संतुष्ट हनने के
बाद ईसकी ऄजभरक्षा ऄपने कब्जे में रखते हुए ऐसी पहुाँच की ऄनुमजत दे सकते हैं |
8.
िायुयान दुघघटना ऄन्िेषण ब्यूरन. –– (1) जनयम 5 के ईप-जनयम (1), (2) और (4) में जनर्ददष्ट दुघघटनाओं या
गंभीर घटनाओं या घटनाओं का ऄन्िेषण करने के प्रयनजनाथघ, ऄजधजनयम की धारा 7 के ऄधीन गरठत
िायुयान दुघघटना ऄन्िेषण ब्यूरन पूिोि प्रयनजनों के जलए ब्यूरन हनगा। िायुयान दुघघटना ऄन्िेषण ब्यूरन में
केन्द्रीय सरकार द्वारा जनयुि ऐसे ऄजधकारी जन नागररक िायुयान दुघघटना ऄन्िेषण प्रदक्रयाओं से पररजचत
हों और ऄन्य व्यजि िाजमल होंगे, जैसा दक िह समय समय पर ईजचत समझे |
(2) िायुयान दुघघटना ऄन्िेषण ब्यूरन नागर जिमानन मंत्रालय, भारत सरकार का संबद्ध कायाघलय हनगा|
(3) िायुयान दुघघटना ऄन्िेषण ब्यूरन जनम्नजलजखत कायघ जनष्पाददत करेगा, ऄथाघत : –
(क) जनयम 9 के ईप-जनयम (1) या जनयम 7 के ईप-जनयम (3) के ऄधीन प्राजधकृत दकसी व्यजि या
व्यजियों से जनयम 9 के ऄधीन प्राथजमक ररपनटघ प्राप्त करना;
(ख) घटनाओं का िगीकरण तथा ऄन्िेषण जनधाघररत करना तथा औपचाररक ऄन्िेषण के मामले में आन
जनयमों के ऄधीन केन्द्रीय सरकार कन सहायता प्रदान करना;
(ग) जांच से संबंजधत तथ्यात्मक जानकारी का ईपयुि रूप से समय पर सािघजजनक प्रसार;
(घ) जहााँ तक अिश्यक हन ऄन्िेषण और ऄन्िेषण के प्रिासजनक कायघ कन सुजिधाजनक बनाना;
(ङ) िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा प्राप्त ऄन्िेषण की ररपनटघ कन प्रदक्रयागत करना, जजसमें
जनम्नजलजखत िाजमल है, –
(i) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा ररपनटघ कन स्ट्िीकार करना तथा
महाजनदेिक िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा ईजचत समझी जाने िाली रीजत से आसे
सािघजजनक करना;
(ii) जनयम 14 के ईप-जनयम (2) के ऄधीन केन्द्रीय सरकार द्वारा या िायुयान दुघघटना ऄन्िेषण
ब्यूरन द्वारा सािघजजनक की गइ ऄंजतम ररपनटघ कन ईपाबंध 13 के ऄधीन यथापेजक्षत देिों कन
ऄग्रेजषत करना;
(iii) केन्द्रीय सरकार द्वारा या िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा सािघजजनक की गइ ऄंजतम
ररपनटघ कन अइसीएओ कन ऄग्रेजषत करना, यदद दुघघटना ऄथिा घटना में िाजमल िायुयान का
मास 5,700 दकग्रा से ऄजधक है |

(च) सुरक्षा कन बढाने के जलए नइ प्रौद्यनजगकी कन िाजमल करने सजहत समय समय पर अयनजजत दकए
गए सुरक्षा ऄध्ययनों के अधार पर सुरक्षा जसफाररिें जिरजचत करना;
(छ) िास्ट्तजिक ऄथिा संभाजित सुरक्षा कजमयों पर सूचना के प्रभािी जिश्लेषण के जलए दुघघटना और
गंभीर घटना डेटाबेस बनाना और आसका रखरखाि;
(ज) जिकागन ऄजभसमय के ईपाबंध 13 (आसमें ऄंतरराष्ट्रीय मानकों और ऄनुिंजसत प्रदक्रयाओं से संबंजधत
कनइ भी ईपाबंध िाजमल है) के ऄधीन केन्द्रीय सरकार की बाध्यताओं पर कायघिाही करना;
(झ) ऄन्िेषण ररपनटों और सुरक्षा ऄध्ययनों में की गइ जसफाररिों कन महाजनदेिक, नागर जिमानन
महाजनदेिालय तथा ऄन्य जिजनयामक प्राजधकरणों के ऄनुितघन एिं ऄनुपालन करने हेतु ऄग्रेजषत करना;
(ण) िैजिक सचताओं से सम्बजन्धत सुरक्षा संबंधी जसफाररि कन जारी करने और आसके प्रत्युिर के
तारीखिार संप्रेषण के सम्बन्ध में पत्राचार द्वारा अइसीएओ कन सूजचत करना, चाहे िैजिक सचताओं से
सम्बजन्धत सुरक्षा जसफाररि अइसीएओ कन संबनजधत न हों; और
(ट) आन जनयमों के ऄधीन समय समय पर केन्द्रीय सरकार के जनदेि द्वारा िायुयान दुघघटना ऄन्िेषण
ब्यूरन कन सौंपे जाने िाले कनइ ऄन्य कायघ |
(4) िायुयान दुघघटना ऄन्िेषण ब्यूरन आन जनयमों और ईप- जनयम 3 में जनर्ददष्ट कायों के प्रयनजनों कन पूरा
करने के जलए ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों से ऄसंगत न हनने िाली
कायघजिजधयां बना सकेगा |
(5) जिजिष्टतया और पूिघगामी िजि की व्यापकता पर प्रजतकूल प्रभाि डाले जबना, ऐसी कायघजिजधयों में
जनम्नजलजखत सभी मामलों या आनमें से दकसी मामले के ईपबंध दकए जा सकेंगे, ऄथाघत : –
(क) दुघघटनाओं या घटनाओं कन ऄजधसूजचत करने के जलए ऄपेजक्षत व्यजि;
(ख) ऄंतराघष्ट्रीय नागर जिमानन संगठन कन दुघघटनाओं या गंभीर घटनाओं की ऄजधसूचनाएं और ऄन्िेषण
में भाग लेने के जलए देिों कन ऄजधसूचनाएं;
(ग) िायुयान दुघघटनाओं या गंभीर घटनाओं या घटनाओं का ऄन्िेषण;
(घ) आन जनयमों के ऄधीन संचाजलत ऄन्िेषण के जलए ररपनटघ का प्रारूप;
(ङ) िायुयान दुघघटना, गंभीर घटना या घटना के ऄन्िेषण के जलए ऄन्य समनुषंगी या अनुसंजगक
मामला;
9.
प्रारंजभक ऄन्िेषण. –– (1) िायुयान दुघघटना ऄन्िेषण ब्यूरन का महाजनदेिक, िायुयान दुघघटना ऄन्िेषण
ब्यूरन के दकसी ऄजधकारी सजहत दकसी भी व्यजि कन दुघघटना या गंभीर घटना या घटना का प्रारंजभक
ऄन्िेषण करने तथा िायुयान दुघघटना ऄन्िेषण ब्यूरन कन प्रारंजभक ररपनटघ प्रस्ट्तुत कराने हेतु प्राजधकृत कर
सकेगा तादक घटना के िगीकरण का तथा िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा ईजचत समझे जाने पर
जनयम 11 के ऄधीन जिस्ट्तृत ऄन्िेषण हेतु अिश्यक जििेषज्ञता का मूल्यांकन दकया जा सके|
(2) प्रारंजभक ऄन्िेषण करने िाले प्राजधकृत व्यजि कन, –
(क) जनयम 10 के ऄधीन जिजनर्ददष्ट िजियां और किघव्य प्राप्त होंगे; और
(ख) जनयम 7 के ईप-जनयम (3) के ऄधीन यथा ईपबंजधत िायुयान का पररक्षण या ऄन्यथा व्यिहार
करने के जलए ऄजभगम हनगा |
10.
ऄन्िेषक की िजियां और कतघव्य. –– (1) दुघघटनाओं या गंभीर घटनाओं या घटनाओं के ऄन्िेषण के
प्रयनजनाथघ ऄन्िेषक कन जनम्नजलजखत िजियां प्राप्त होंगी, –
(क) ऄन्िेषण से संगत दकसी गिाह कन बुलाना और ईसका परीक्षण करना; और
(ख) ऐसे गिाह से जानकारी या साक्ष्य पेि या प्रस्ट्तुत करना ऄपेजक्षत करना या ईसके द्वारा ईजचत
समझी गइ दकसी भी पूछताछ का ईिर या जििरण देना;

(ग) ऐसे दकसी गिाह से ईसके द्वारा ददए गए ििव्यों के सत्य हनने से संबंजधत घनषणा पत्र बनिाना और
हस्ट्ताक्षर ऄपेजक्षत करना;
(घ) ऐसी सभी पुस्ट्तकों, काग़ज-पत्र, दस्ट्तािेजन और ऐसी िस्ट्तुओं जैसे दक फ्लाआट डाटा ररकॉडघर,
कॉकजपट िॉयस ररकाडघर तथा िायुयान यातायात सेिा ररकाडों सजहत दकन्तु आन तक सीजमत नहीं, की
प्रस्ट्तुजत ऄपेजक्षत और प्रिर्ततत करना जजन्हें िह ऄन्िेषण के जलए अिश्यक समझे और ऄन्िेषण पूरा हनने
तक ऐसी सभी पुस्ट्तकों, कागज-पत्र, दस्ट्तािेजों और ऐसी िस्ट्तुओं जैसे दक फ्लाआट डाटा ररकाडघर,
कॉकजपट िायस ररकाडघर तथा िायुयान यातायात सेिा ररकाडों सजहत दकन्तु आन तक सीजमत नहीं, कन
प्रजतधाररत करना;
(ड.) दुघघटना या गंभीर घटना या घटना के जिकार दकसी िायुयान तथा ईसके ऄियि, िह स्ट्थल जहााँ
घटना हुइ है या कनइ ऄन्य स्ट्थल जहााँ ऄन्िेषणकताघ कन ऄन्िेषण के प्रयनजन से जाना एिं जााँच करना
अिश्यक प्रतीत हनता हन, तक पहुाँच एिं जााँच करना |
(2) ईपाबंध-13 के संबंजधत सुसंगत मानकों के अधार पर ऄन्िेषणकताघ सत्यपूणघ, जनष्पक्ष और न्यायपूणघ
ऄन्िेषण के जलए ईिरदायी हनगा |
11.
िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा ऄन्िेषण. –– (1) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन
दकसी िायुयान दुघघटना या गंभीर घटना का ऄन्िेषण कराने के जलए प्रभारी ऄन्िेषक तथा एक या एक से
ऄजधक ऄन्िेषणकताघ कन ईसकी सहायता के जलए जनयुि कर सकेगा और ऐसे प्रभारी ऄन्िेषक तथा
ऄन्िेषणकताघओं के पास िहीाँ िजियां होंगी जैसी जनयम 10 के ऄधीन एक ऄन्िेषक के पास हनती हैं |
(2) ऄन्िेषण जनजी रूप से दकया जाएगा |
(3) जब सरकारी ऄजधकारी से जभन्न ऄन्य व्यजि कन ऄन्िेषणकताघ के रूप में महाजनदेिक, िायुयान दुघघटना
ऄन्िेषण ब्यूरन द्वारा जनयुि दकया जाता है, तन ईसे आस प्रकार की फीस और व्यय प्रदान दकए जा सकेंगे जन
िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा जनधाघररत दकए जाएं |
(4) आन जनयमों के ऄधीन गिाह के रूप में प्रभारी ऄन्िेषक द्वारा बुलाए गए प्रत्येक व्यजि कन ऐसे व्यय
ऄनुज्ञेय होंगे जन िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा समय समय पर जनधाघररत दकए जाएं |
(5) प्रभारी ऄन्िेषक ईपाबंध-13 के सुसंगत मानकों पर अधाररत प्ररूप में िायुयान दुघघटना ऄन्िेषण ब्यूरन
कन एक ऄंजतम ररपनटघ प्रस्ट्तुत करेगा |
(6) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन प्रभारी ऄन्िेषक की आस ररपनटघ कन स्ट्िीकार करेंगें और
स्ट्िीकार करने के पिात आसे महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा ईस रीजत में जजसे िह
ईजचत समझे, ईसे सािघजजनक करेंगें |
12.
औपचाररक ऄन्िेषण. –– जहााँ केन्द्रीय सरकार कन यह प्रतीत हनता है दक दकसी दुघघटना का औपचाररक
ऄन्िेषण कराया जाना अिश्यक या समीचीन है ,तन िह अदेि द्वारा, चाहे जनयम 11 के ऄधीन कनइ
ऄन्िेषण दकया गया हन या नहीं , औपचाररक ऄन्िेषण कराए जाने का जनदेि दे सकेगी और ऐसे दकसी भी
औपचाररक ऄन्िेषण के संबंध में जनम्नजलजखत ईपबंध लागू होंगे ऄथाघत : –
(क) केन्द्रीय सरकार ऄन्िेषण करने के जलए एक सक्षम व्यजि (जजसे आसके पिात् “कनटघ” कहा गया है) कन
जनयुि करेगी और एक या एक से ऄजधक व्यजियों कन जजनके पास जिजधक, िैमाजनक, ऄजभयजन्त्रक या
ऄन्य जििेष ज्ञान हन कन मूल्यांकनकताघओं तथा िायुयान दुघघटना ऄन्िेषण ब्यूरन से एक या ऄजधक
ऄन्िेषकों कन एक मूल्यांकनकताघ के रूप में कायघ करने के जलए जनयुि कर सकेगी;
स्ट्पष्टीकरण : आस खंड के प्रयनजनों के जलए, सक्षम व्यजि से िायुयान दुघघटना ऄन्िेषण ब्यूरन का
ऄजधकारी या ऐसा व्यजि ऄजभप्रेत है जजसके पास नागर जिमानन में कायघ करने के ऄनुभि के साथ
जिजधक, िैमाजनक, ऄजभयांजत्रक या ऄन्य जििेष ज्ञान है ।
(ख) जब सरकारी ऄजधकारी से जभन्न ऄन्य व्यजि कन कनटघ या मूल्यांकनकताघ के रूप में जनयुि दकया
जाता है, तन ईसे आस प्रकार की फीस और व्यय प्रदान दकए जा सकेंगे जन केन्द्रीय सरकार द्वारा जनधाघररत
दकए जाएं;

(ग) कनटघ की जनयुजि पर या बाद में, आन जनयमों के ऄधीन अदेजित ऄन्य सभी ऄन्िेषणों कन बंद माना
जाएगा तथा आस जिषय पर सभी सुसंगत सामग्री कन कनटघ कन हस्ट्तांतररत दकया जाएगा;
(घ) कनटघ खुली सभा में ऐसी रीजत और ऐसी जस्ट्थजतयों के ऄधीन ऄन्िेषण करेगा जजन्हें िह दुघघटना के
कारणों और पररजस्ट्थजतयों का मूल्यांकन करने के जलए और आसमें आसके पिात ईजल्लजखत ररपनटघ बनाने
में सक्षम हनने के जलए ईजचत समझे :
परन्तु यह दक जहााँ कनटघ की यह राय हन की ऄन्िेषण कराए जाने से, –
(i) दकसी भी देि के जहतों पर प्रजतकूल प्रभाि पड़ने की संभािना है; या
(ii) दकसी ऐसे व्यजि की व्यजिगत सुरक्षा खतरे में पड़ने की संभािना है जन कनइ ििव्य या
साक्ष्य प्रदान करने का आच्छुक है, तन कनटघ ऄन्िेषण की सभी या अंजिक कायघिाही बंद कमरे में
कर सकेगा;
(ङ) कनटघ कन ऄन्िेषण के प्रयनजनाथघ दीिानी प्रदक्रया संजहता, 1908 (1908 का 5) के ऄधीन एक
दीिानी कनटघ की सभी िजियां प्राप्त होंगी और िजियों पर प्रजतकूल प्रभाि डाले जबना कनटघ –
(i) दकसी भी ऐसे स्ट्थान या भिन में प्रिेि और जनरीक्षण कर सकता है या दकसी भी व्यजि कन
ऐसे स्ट्थान में प्रिेि और जनरीक्षण के जलए प्राजधकृत कर सकता है जजसमें प्रिेि और जनरीक्षण
करना कनटघ कन ऄन्िेषण के प्रयनजनाथघ ऄपेजक्षत प्रतीत हन; और
(ii) गिाहों की ईपजस्ट्थजत कन प्रिृजित कर सकता है और दस्ट्तािेजों एिं भौजतक िस्ट्तुओं की
प्रस्ट्तुजत के जलए बाध्य कर सकता है और कनटघ की ऄपेक्षानुसार कनइ भी सूचना प्रस्ट्तुत दकए जाने
के जलए दकसी भी व्यजि कन भारतीय न्याय संजहता (2023 का 45) की धारा 211 की
पररभाषा के भीतर ऐसा करने के जलए बाध्य माना जाएगा;
(च) मूल्यांकनकताघओं कन प्रिेि और जनरीक्षण के जलए कनटघ जैसी िजियां प्राप्त होंगी;
(छ) कनटघ के समक्ष साक्षी के रूप में ईपजस्ट्थत हनने िाले प्रत्येक व्यजि कन ईन्हीं व्ययों की ऄनुमजत हनगी
जन कनटघ ईजचत समझे;
परन्तु यह दक दुघघटना से संबंजधत दकसी िायुयान के स्ट्िामी या भाड़े पर लेने िाले व्यजि और ईसके
ऄधीन जनयुि दकसी भी व्यजि या दुघघटना से संबंजधत दकसी भी ऄन्य व्यजि के मामले में , ऐसे दकसी भी
व्यय की ऄनुमजत रद्द की जा सकती है यदद कनटघ ऄपने जििेकाजधकार पर ईन कारणों के जलए जन लेखबद्ध
दकए जाए ऐसा जनदेि देता है ;
(ज) कनटघ ईपबंध 13 में यथा-ऄपेजक्षत ऄंजतम मसौदा ररपनटघ पर देिों के साथ परामिघ करने के पिात्,
िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा जिजनर्ददष्ट प्रारूप में केन्द्रीय सरकार कन ऄंजतम ररपनटघ प्रस्ट्तुत
करेगा और जनयम 8 के ईप-जनयम (3) तथा जनयम 14 के ऄनुसार कायघिाही दकए जाने के जलए केन्द्रीय
सरकार द्वारा आस ऄंजतम ररपनटघ कन ईि ब्यूरन कन ऄग्रेजषत दकया जाएगा ;
(झ) मूल्यांकनकताघ, अपजियों के साथ या अपजियों के जबना या तन ररपनटघ पर हस्ट्ताक्षर करेंगे या ररपनटघ
के प्रजत ऄपना ऄसंतनष और ऐसे ऄसंतनष के कारणों कन जलजखत में ईजल्लजखत करेंगे और ऐसी अपजियों
या ऄसंतनष या कारण, यदद कनइ हन, तन ररपनटघ सजहत केन्द्रीय सरकार कन ऄग्रेजषत दकए जाएंगे |
13.
घटना का ऄन्िेषण. –– (1) महाजनदेिक, नागर जिमानन महाजनदेिालय जनयम 5 के ईप- जनयम (1) के
खंड (ग) के ऄधीन सजम्मजलत जिमानों में दकसी प्रकार की घटना या गंभीर घटना के ऄन्िेषण के अदेि दे
सकते हैं , और ऄन्िेषण करने के प्रयनजन से प्रभारी ऄन्िेषक जनयुि कर सकते हैं |
(2) यदद िायुयान दुघघटना ऄन्िेषण ब्यूरन जनयम 5 के ईप-जनयम (2) के ऄधीन घटना या गंभीर घटना का
ऄन्िेषण करने का जिजनिय है तन ईप-जनयम (1) के ऄधीन महाजनदेिक, नागर जिमानन महाजनदेिालय
द्वारा अदेजित ऄन्िेषण कन बंद दकया जाएगा और आस ऄन्िेषण के जलए सभी संगत सामग्री िायुयान
दुघघटना ऄन्िेषण ब्यूरन कन हस्ट्तांतररत की जाएगी |
(3) ईप-जनयम (1) में जनर्ददष्ट ऄन्िेषण जनजी रूप से दकया जाएगा |

(4) प्रभारी ऄन्िेषक के िही ऄजधकार और दाजयत्ि होंगे जन जनयम 10 के ऄधीन ऄन्िेषक के हैं|
(5) प्रभारी ऄन्िेषक ईपाबंध 13 के सुसंगत मानकों के अधार पर िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा
जिजनर्ददष्ट प्ररूप में महाजनदेिक, नागर जिमानन महाजनदेिालय कन ररपनटघ प्रस्ट्तुत करेगा |
(6) महाजनदेिक, नागर जिमानन महाजनदेिालय ऄन्िेषक प्रभारी की ररपनटघ कन स्ट्िीकार करेगा और आसे
स्ट्िीकार करने के पिात् ईनके द्वारा ईपयुि समझे जाने िाली रीजत से आसे महाजनदेिक, नागर जिमानन
महाजनदेिालय द्वारा सािघजजनक दकया जाएगा |
14.
परामिघ तथा ऄंजतम ररपनटघ. –– (1) ऄन्िेषक प्रभारी या कनटघ जनयम 12 के ईपखंड (ज) के ऄधीन या
जनयम 11 के ईप-जनयम 5 के ऄधीन ऄंजतम मसौदा ररपनटघ की प्रजत जनम्नजलजखत कन ऄग्रेजषत करेगा –
(क) रजजस्ट्री देि;
(ख) प्रचालक देि;
(ग) जडजाआन देि;
(घ) जिजनमाघता देि; और
(ङ) जनयम 6 के ईपजनयम (4) के ऄनुसार ऄन्िेषण में भाग लेने िाले देि, जजसे ररपनटघ पर परामिघ ऄिजध के
दौरान ऄपने महत्िपूणघ तथा िृहत रटप्पजणयााँ प्रस्ट्तुत करने के जलए अमंजत्रत दकया जाएगा।
स्ट्पष्टीकरण : आस खंड के प्रयनजनों के जलए यह स्ट्पष्ट दकया जाता है दक –
(i) सामान्य परामिघ ऄिजध प्रेषण पत्राचार की तारीख से तीस ददन हनगी और परामिघ ऄिजध कन साठ ददन
तक बढाया जाएगा यदद रटप्पणी देने के जलए अमंजत्रत देि ऄजतररि समय की अिश्यकता की सूचना
देता है।
(ii) यदद परामिघ ऄिजध के भीतर कनइ रटप्पणी प्राप्त नहीं हनती है तन ऄंजतम ररपनटघ जारी की जाएगी, जब
तक दक संबंजधत देिों के साथ ईस ऄिजध के अगे जिस्ट्तार की सहमजत न हन गइ हन ।
(2) जनयम 12 के ऄधीन जनयुि कनटघ या प्रभारी ऄन्िेषक परामिघ ऄिजध के भीतर प्राप्त रटप्पजणयों के सार कन
सजम्मजलत करके या देि द्वारा िांजछत हनने पर आन रटप्पजणयों कन जनड़कर ऄंजतम मसौदा ररपनटघ कन
संिनजधत कर सकते हैं और दकसी ऐसी ऄंजतम ररपनटघ तथा अपजियों या ऄसहमजत और कारणों, यदद

(3) केन्द्रीय सरकार या िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा सािघजजनक की गइ ऄंजतम ररपनटघ ईपाबंध 13
के ऄधीन ऐसे देिों कन ऄग्रेजषत की जाएगी जन आसे प्राप्त करने के हकदार हैं और यह ररपनटघ ऄंतराघष्ट्रीय
नागर जिमानन संगठन (अइसीअओ) कन ऄजधमानत: आलेक्रॉजनक प्रारूप में भी ऄग्रेजषत की जाएगी,
यदद दुघघटना या घटना में िाजमल िायुयान का भार 5700 दकलनग्राम से ऄजधक है |
15.
ऄन्िेषण कन पुनः प्रारंभ करना. –– जहााँ िायुयान दुघघटना ऄन्िेषण ब्यूरन या केन्द्रीय सरकार कन यह
प्रतीत हनता है दक यथाजस्ट्थजत जनयम 11 या जनयम 12 के ऄधीन ऄन्िेषण पूरा हनने के बाद कनइ नया
और महत्िपूणघ िस्ट्तुगत साक्ष्य ईपलब्ध हुअ है , तन यह अदेि द्वारा आसकन पुनःप्रारंभ करने का जनदेि दे
सकती है |
16.
कायघिाही में बाधा. –– (1) कनइ भी व्यजि कनटघ या मूल्यांकनकताघ या ऄन्िेषक या कनइ ऄन्य व्यजि जन
आन जनयमों के ऄधीन दकसी भी िजि या दाजयत्ि का प्रयनग करते कायघ करता है में रूकािट या बाधा
नहीं डालेगा |
(2) कनइ भी व्यजि जबना ईजचत कारण के कनटघ, प्रभारी ऄन्िेषक या ऄन्िेषक या ऄन्य कनइ व्यजि जन आन
जनयमों के ऄधीन ऄन्िेषण या जााँच-पड़ताल करता है, के दकसी भी समन या ऄजधयाचना के ऄनुपालन में
जिफल नहीं हनगा |
स्ट्पष्टीकरण : आस जनयम के प्रयनजनाथघ , जब यह प्रश्न ईठे दक क्या दकसी व्यजि के पास ईजचत कारण हैं , तन यह
जसद्ध करने का भार ईसी पर हनगा दक ईसके पास ईजचत कारण हैं |

(3) कनइ भी व्यजि जन कायघिाही कन ऄिरुद्ध या बाजधत करता है, िह ऄनुसूची “ग” में ऄजधकजथत ईपबंध
और ऄजधजनयम की धारा 32 के ईपबंधों के ऄनुसार िाजस्ट्त लगाए जाने के जलए ईिरदायी हनगा|
17.
ऄजभलेखों (ररकार्डसघ) कन प्रकट न दकया जाना. –– (1) जनम्नजलजखत ऄजभलेखों कन दुघघटना या घटना के
ऄन्िेषण के जसिाए प्रयनजनों के जलए प्रकट नहीं दकया जाएगा जसिाय जब केन्द्रीय सरकार यह
ऄिधाररत करती है दक आनका प्रकटीकरण ईस ऄन्िेषण ऄथिा भािी ऄन्िेषणों पर पड़ने िाले प्रजतकूल
घरेलू एिं ऄंतरराष्ट्रीय प्रभािों से ऄजधक महत्ि रखता है, –
(क) ऄन्िेषण प्राजधकाररयों द्वारा ऄपने ऄन्िेषण के दौरान व्यजियों से जलए सभी ििव्य;
(ख) िायुयान के प्रचालन में सजम्मजलत रहे व्यजियों के बीच हुए सभी संप्रेषण;
(ग) दुघघटना या घटना में सजम्मजलत व्यजियों के संबंध में जचदकत्सा संबंधी या जनजी जानकारी;
(घ) कॉकजपट ध्िजन ररकार्डडग और ऐसी ररकार्डडग की प्रजतजलजप;
(ङ) हिाइ यातायात जनयंत्रण आकाआयों से की गइ ररकार्डडग और ररकार्डडग की प्रजतजलजपयााँ;
(च) कॉकजपट एयरबननघ आमेज ररकार्डडग और ऐसी ररकार्डडग का कनइ भाग या प्रजतजलजपयााँ;
(छ) ईड़ान ररकाडघर सूचना सजहत सूचना के जिश्लेषण में ऄजभव्यि मत |
(2) ईप-जनयम (1) में जनर्ददष्ट ररकाडघ कन दकसी ऄंजतम ररपनटघ या ईसके पररजिष्टों या दकसी ऄन्य ररपनटघ में
केिल तभी सजम्मजलत दकया जाएगा जब यह दुघघटना या घटना के जिश्लेषण के जलए संगत हन और
जिश्लेषण से ऄसंबद्ध ररकाडों के भाग ऄंजतम ररपनटघ में सजम्मजलत नहीं दकए जाएंगे |
(3) ऄंजतम ररपनटघ में दुघघटना या घटना में सजम्मजलत व्यजतयों के नाम ईद्घारटत नहीं दकए जाएंगे |
(4) िायुयान दुघघटना ऄन्िेषण ब्यूरन की ऄजभरक्षा या जनयंत्रण िाले ररकाडों के जलए दकसी भी ऄनुरनध पर
जिचार नहीं दकया जाएगा, यदद िह मूल स्रनत, जहााँ ईपलब्ध है, के माध्यम से यह ऄनुरनध नहीं अया है
|
(5) कॉकजपट ध्िजन ररकाडों की श्रव्य सामग्री तथा एयरबननघ आमेज ररकार्डडग की दृश्य एिं श्रव्य सामग्री कन
सािघजजनक रूप से प्रकट नहीं दकया जाएगा |
(6) ऄन्य देिों से प्राप्त ऄंजतम मसौदा ररपनटघ की जिषय िस्ट्तु कन सािघजजनक नहीं दकया जाएगा |
18.
दुघघटना और घटना के डाटाबेस का ऄनुरक्षण. –– िायुयान दुघघटना ऄन्िेषण ब्यूरन दुघघटना और गंभीर
घटना संबंधी डाटाबेस स्ट्थाजपत करेगा और ईसका ऄनुरक्षण करेगा तथा आसे नागर जिमानन
महाजनदेिालय द्वारा ऄनुरक्षण दकए जा रहे सुरक्षा डाटा में सजम्मजलत करने के जलए ईपलब्ध कराएगा|
नागर जिमानन महाजनदेिालय जनयजमत अधार पर ऄपने डाटाबेस का िायुयान दुघघटना ऄन्िेषण ब्यूरन
के साथ अदान –प्रदान करेगा|
19.
व्यािृजि. –– आन जनयमों में कुछ भी, भारतीय िायुयान ऄजधजनयम, 2024 के ऄधीन जारी दकसी
ऄनुज्ञजप्त या प्रमाण-पत्र के रद्द करने, जनलंबन या पुजष्ट के संबंध में, केन्द्रीय सरकार की िजि सीजमत या
ऄन्यथा प्रभाजित नहीं करेगा|
20.
िाजस्ट्त. –– (1) कनइ व्यजि जन आन जनयमों के दकसी भी ईपबंध का ईल्लंघन करता है या ऄनुपालन
करने में जिफल रहता है तन िह आन जनयमों के ऄनुसूची ‘ग’ में जिजनर्ददष्ट सीमा तक और ऄजधजनयम की
धारा 32 के ईपबंधों के ऄनुसार, ईस पर जुमाघना लगाए जाने के जलए ईिरदायी हनगा |
(2) िाजस्ट्त का न्यायजनणघयन, यथाजस्ट्थजत, नामजनर्ददष्ट ऄजधकाररयों ऄथिा ऄपीलीय ऄजधकारी द्वारा ईि
ऄनुसूची के ईपबंधों के ऄनुसार दकया जाएगा |
21.
एएअइबी बुलेरटन. –– (1) महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन भारत के भीतर या भारत की
िायुसीमा में ईड़ रहे िायुयान या भारत में रजजस्ट्रीकृत िायुयान की दुघघटनाओं या गंभीर घटनाओं के
ऄन्िेषण के संबंध में ऄजधजनयम और आन जनयमों से ऄसंगत न हनने िाली सूचना कन एएअइबी बुलेरटन्स
िीषघ से जारी कर सकते हैं|

गंभीर घटनाएाँ
जनम्न सूचीबद्ध घटनाएं ईन घटनाओं के जिजिष्ट ईदाहरण हैं जजनके गंभीर घटनाएं हनने की संभािना हनती है और यह
सूची संपूणघ नहीं है तथा यह गंभीर घटनाओं की पररभाषा के जलए केिल एक मागघदर्तिका का काम करती है, –
(क) लगभग टक्कर हनने की घटना जजसमें दकसी टक्कर या दकसी ऄसुरजक्षत जस्ट्थजत से बचने के जलए बचािात्मक युजि
ऄपेजक्षत हन या जब कनइ बचािात्मक कारघिाइ ईपयुि हन ;
रटप्पण: अइसीएओ दस्ट्तािेज 4444 में टक्कर के जनजखम और सुरक्षा सुजनजित नहीं ––की गंभीरता में िगीकृत
लगभग टक्कर कन गंभीर घटना के रूप में िगीकृत दकया जाएगा |
(ख) टक्कर जजन्हें दुघघटनाओं के रूप में िगीकृत नहीं दकया गया है;
(ग) भू-भाग में जनयंजत्रत ईड़ान जन थनड़े ऄंतर से बची हन;
(घ) दकसी बंद या व्यस्ट्त रनिे, या दकसी टेक्सीिे (हेलीकॉप्टरों द्वारा प्राजधकृत प्रचालनों कन छनड़कर) या
ऄसमनुदेजित रनिे से जनरस्ट्त टेक-ऑफ़;
(ङ) दकसी बंद या व्यस्ट्त रनिे या दकसी टेक्सीिे (हेलीकॉप्टरों द्वारा प्राजधकृत प्रचालनों कन छनड़कर) या ऄसमनुदेजित
रनिे से टेकऑफ़;
(च) दकसी बंद या व्यस्ट्त रनिे पर, दकसी टेक्सीिे, ऄसमनुदेजित रनिे या सड़कमागघ जैसे ऄनपेजक्षत लैंसडग स्ट्थानों पर
लैंसडग या लैंसडग का प्रयास;
(छ) टेकऑफ़ या प्रारंजभक ईड़ान भरने के दौरान ऄनुमाजनत कायघ-जनष्पादन हाजसल करने में भारी जिफलताएं;
(ज) कॉकजपट में, यात्री कम्पाटघमेंट में, कागो कम्पाटघमेंट में अग या धुअं या आंजन में अग, भले ही ऐसी अग कन अग
बुझाने िाले कारकों के ईपयनग से बुझा ददया गया हन;
(झ) ईड़ान कमीदल द्वारा ऑक्सीजन के अपातकालीन ईपयनग की अिश्यकता िाली घटनाएाँ;
(ञ) िायुयान की संरचनागत जिफलताएं या आंजन का जिघटन, जजसमें ऄसजम्मजलत टबाघआन आंजन जिफलताएं िाजमल
हैं, जन दुघघटना के रूप में िगीकृत न हों;
(ट) एक या ऄजधक िायुयान प्रणाजलयों का एकाजधक जस्ट्थजतयों में ठीक से कायघ न करना जजससे िायुयान का प्रचालन
गंभीर रूप से प्रभाजित हनता हन;
(ठ) ईड़ान में ईड़ान कमीदल की ऄक्षमता,–
(i) दूरस्ट्थ पायलट सजहत एकल पायलट प्रचालनों के जलए;
(ii) बहु-पायलट प्रचालन के जलए, जजसके जलए फ्लाआट की सुरक्षा कन िेष कमीदल के जलए कायघभार में
ऄत्यजधक बढनतरी के कारण जनजखम में डाला गया |
(ड) ईंधन स्ट्तर या जितरण संबंधी पररजस्ट्थजतयााँ जजनमें पायलट कन अपातकाल घनजषत करना पड़ा हन जैसे ऄपयाघप्त
ईंधन, ईंधन समाप्त हनने, ईंधन प्राप्त न हन पाने या िायुयान में ईपलब्ध सारा ईंधन प्रयनग करने में ऄसमथघता;
(ढ) रनिे ऄजतक्रमण जजन्हें जजन्हें गंभीरता स्ट्तर ‘क’ में िगीकृत दकया गया हन | रनिे ऄजतक्रमणों की रनकथाम पर
जनयमािली (डीओसी 9870) में गंभीरता िगीकरणों पर जानकारी सजम्मजलत है;
(ण) ईड़ान भरने या लैंसडग की घटनाएाँ जैसे ऄंडर–िूरटग, ओिररसनग या रनिे की साआड से रसनग-ऑफ़ हन जाना;
(त) प्रणाली जिफलताएाँ जजसमें पॉिर या थ्रस्ट्ट का खनना, मौसम संबंधी घटनाएं, स्ट्िीकृत ईड़ान सीमा से बाहर
प्रचालन या ऄन्य घटनाएं सजम्मजलत है, जजनके कारण जिमान जनयंत्रण में करठनाइ ईत्पन्न हुइ या हन सकती थी;
(थ) ईड़ान मागघदिघन और नेजिगेिन के जलए ऄजनिायघ रेडंडेंसी जसस्ट्टम में एक से ऄजधक प्रणाजलयों की जिफलता;

(द) ऄनजाने में या अपात ईपाय के तौर पर िायुयान के स्ट्लंग भार या िायुयान में ले जाए जा रहे ऄन्य दकसी भार
कन आरादन छनड़ना;
(ध) लैंसडग जगयर लेग का स्ट्ितः भीतर सखचना या लहील्स-ऄप लैंसडग जजसे दुघघटना के रूप में िगीकृत नहीं दकया है;
(न) दकसी सिग टीप, आंजन पनड या िायुयान के ऄन्य दकसी भाग की लैंसडग के दौरान ड्रेसगग, जन दुघघटना के रूप में
िगीकृत नहीं हन, और
(प) मानि रजहत जिमान के मामले में यह जिचार दकया जाएगा दक यदद घटना दकसी दुघघटना में बदल जाती, तन क्या
सबसे संभाजित पररणाम दकसी व्यजि के घातक या गंभीर रूप से घायल हनने का हन सकता था।

िायुयान की क्षजत के ऄिधारण हेतु मागघदिघन
(क)
यदद आंजन िायुयान से ऄलग हन जाता है तन आस घटना कन दुघघटना के रूप में िगीकृत दकया जाता है, भले ही क्षजत
आंजन तक ही सीजमत हन |
(ख)
आंजन काईल (पंखे या कनर) या ररिसघर घटकों का नुकसान जजसके पररणामस्ट्िरूप जिमान कन और नुकसान नहीं हनता
है, कन दुघघटना नहीं माना जाएगा |
(ग)
ऐसी घटनाएं जहााँ कंप्रेसर या टरबाइन ब्लेड या आंजन के ऄन्य अंतररक पुजे आंजन के टेल पाआप के जररए बाहर जनकल
जाते हैं, कन दुघघटना नहीं माना जाएगा |
(घ)
टूटे हुए या गुम रेडनम कन दुघघटना नहीं माना जाएगा जब तक ऄन्य संरचनाओं या प्रणाजलयों में संबंजधत पयाघप्त
नुकसान न हन |
(ङ)
गुम हुए फ्लैप, स्ट्लैट या ऄन्य जलफ्ट बढाने िाले ईपकरण, सिगलेटस अदद जजन्हें कंदफगरेिन डेजिएिन जलस्ट्ट
(सीडीएल) के ऄधीन भेजे जाने की ऄनुमजत है, कन दुघघटना नहीं माना जाएगा |
(च)
लैंसडग जगयर लेग का स्ट्ितः भीतर सखचना या लहील्स-ऄप लैंसडग जजसका पररणाम केिल बाहरी सतह पर जघसाि
हनता है और यदद िायुयान कन मामूली मरम्मत या पैसचग के बाद सुरजक्षत रूप से भेजा जा सकता है और बाद में एक
स्ट्थायी मरम्मत हेतु आसे ऄजधक व्यापक कायघ से गुजरना पड़ता है, तन घटना कन दुघघटना के रूप में िगीकृत नहीं दकया
जाएगा|
(छ)
यदद संरचनागत क्षजत ऐसी है दक िायुयान जडप्रेिराआज हन जाता है या आसे प्रैिराआज नहीं दकया जा सकता तन आस
घटना कन दुघघटना के रूप में िगीकृत दकया जाएगा |
(ज)
दकसी घटना के बाद जनरीक्षण के जलए घटकों कन हटाना, जैसे लन–स्ट्पीड रनिे से बाहर जनकलने पर ऄंडरकैररज लेग
कन एहजतयाती तौर पर हटाया जाना, जबदक आसमें काफी काम िाजमल हनता है, आसे तब तक दुघघटना नहीं माना
जाएगा जब तक दक महत्िपूणघ क्षजत नहीं पाइ जाती |
(झ)
ऐसी घटनाएं कन दुघघटना नहीं माना जाएगा जजनमें अपातकालीन जनकासी सजम्मजलत है जब तक दकसी कन गंभीर
चनटें न अइ हों या िायुयान कन ऄन्यथा पयाघप्त क्षजत न हुइ हन |
स्ट्पष्टीकरण: संदेहों के जनिारण हेतु यह स्ट्पष्ट दकया जाता है दक –
(1) जहााँ तक िायुयान कन हुइ ऐसी क्षजत का संबंध है जन संरचनागत मजबूती, कायघ –जनष्पादन या ईड़ान की जिजिष्टताएं
कन प्रजतकूल रूप से प्रभाजित करती है, िायुयान सुरजक्षत ईतर सकता है दकन्तु जबना मरम्मत के ऄगले सेक्टर के जलए
सुरजक्षत रिाना नहीं दकया जा सकता /
(2)यदद िायुयान कन मामूली मरम्मत के बाद सुरजक्षत रूप से रिाना दकया जा सकता है और बाद में स्ट्थाइ मरम्मत हेतु
और व्यापक कायघ दकया जाता है, तन आस घटना कन दुघघटना के रूप में िगीकृत नहीं दकया जाएगा; आसी तरह; यदद जिमान
कन प्रभाजित भागों कन हटाकर, गायब हनने या जनजष्क्रय हनने पर सीडीएल के ऄधीन रिाना दकया जा सकता है तन ऐसी
मरम्मतकन बड़ी मरम्मत नहीं माना जाएगा और पररणामस्ट्िरूप घटना कन दुघघटना नहीं माना जाएगा /

(3) मरम्मत या ऄनुमाजनत हाजन की लागत, जैसा बीमा कंपजनयों द्वारा मुहैया कराइ जा रही िाजहत क्षजत का संकेत
मुहैया करा सकती है, दकन्तु आसे आस अिय से एकमात्र मागघ संदर्तिका के रूप में प्रयुि नहीं दकया जाना चाजहए दक यह
क्षजत ईस घटना कन दुघघटना के रूप में माने जाने के जलए पयाघप्त है या नहीं/ आस प्रकार दकसी िायुयान कन ‘हल लास’ माना
जा सकता है क्योंदक िहन की गइ ईल्लेखनीय क्षजत कन दुघघटना के रूप में िगीकृत दकए जबना आसकी मरम्मत दकया जाना
गैर-दकफायती है|

प्राजधकृत व्यजियों द्वारा िायुयान या ईसके पुजों कन
या ऄन्तिघस्ट्तुओं से ईस सीमा तक छेड़छाड़ की जाएगी
जजस सीमा तक ऐसा करना अिश्यक हन; जजला
प्रिासन और हिाइ ऄड्डा प्रबंधन यह सुजनजित करेंगे
दक खनज और बचाि कायघ के औपचाररक रूप से पूणघ
हन जाने के तथा िायु ददक्चालन ऄनापजि के पिात
जिमान के दकसी भाग कन स्ट्थानांतररत नहीं दकया
जाएगा और न ही मलबे कन दकसी प्रकार से छेड़ा
जाएगा।
(ii)
िायुयान जल में नष्ट हुअ है तन खनज एिं
बचाि कायघ करने के जलए प्राजधकृत व्यजियों द्वारा
िायुयान या ईसके पुजों कन या ऄन्तिघस्ट्तुओं कन ईस
सीमा तक हटाया जाएगा जहााँ तक ईन्हें सुरजक्षत
स्ट्थान तक लाने के जलए अिश्यक हन । एक बार जब
एएअइबी का प्रजतजनजध स्ट्थल पर पहुंच जाता है, तन
कायघ ईसकी जनगरानी में दकया जाएगा।

ऄजधकारी या महाजनदेिक, िायुयान दुघघटना ब्यूरन
द्वारा प्राजधकृत व्यजि के पयघिेक्षण के ऄधीन हटाया
जा सकता है|

3. नामजनर्ददष्ट ऄजधकाररयों द्वारा िाजस्ट्त जनधाघरण की प्रदक्रया: ––––
(क) यदद नामजनर्ददष्ट ऄजधकारी आस बात से संतुष्ट हनता है दक दकसी व्यजि द्वारा उपर के पैरा 2 में ईजल्लजखत सारणी 2 में
जिजनर्ददष्ट दकसी भी जनयम का ईल्लंघन दकया गया है, तन िह ऐसे व्यजि कन सुनिाइ का युजियुि ऄिसर देने के बाद,
जलजखत अदेि के माध्यम से, ईि व्यजि पर पैरा 1 एिं 2 के ऄधीन सारणी 1 और सारणी 2 के ऄनुसार िाजस्ट्त लगा
सकता है जजसमें, ईल्लंघन की प्रकृजत, ईल्लंजघत जनयमों का प्रािधान, ऐसा िाजस्ट्त ऄजधरनजपत करनें के कारणों के साथ एक
मांग ननरटस का ईल्लेख दकया जाएगा;
(ख) नामजनर्ददष्ट ऄजधकारी द्वारा पाररत िाजस्ट्त के अदेि की एक प्रजत मांग पत्र सजहत मान्य सेिा पद्धजत से ऐसे व्यजि कन
दी जाएगी;
(ग) खंड (क) के ऄधीन जारी अदेि से व्यजथत व्यजि, महाजनदेिक ,िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा जनधाघररत जिजध
के ऄनुसार, प्रपत्र 'क' में एक हजार रुपये िुल्क के साथ नामजनर्ददष्ट ऄजधकारी द्वारा जारी अदेि की प्रजत प्राप्त हनने की
जतजथ से तीस ददनों की ऄिजध के भीतर ऄपील दायर कर सकता है;
(घ) प्रथम ऄपीलीय ऄजधकारी, ऄपीलकताघ कन सुनिाइ का ऄिसर प्रदान करने के बाद, एक स्ट्पीककग ऑडघर जारी कर
सकता है जजसमें नामजनर्ददष्ट ऄजधकारी द्वारा जारी अदेि कन पुष्ट, संिनजधत या जनरस्ट्त दकया जा सकता है;
(ड:) ऄपीलीय ऄजधकारी द्वारा जारी ऄपीलीय अदेि की प्रजत ऄपीलकताघ एिं संबंजधत नामजनर्ददष्ट ऄजधकारी कन ईपलब्ध
कराइ जाएगी;
(च) प्रथम ऄपीलीय प्राजधकारी द्वारा जारी दकसी अदेि से प्रभाजित व्यजि, जिषय में क्षेत्राजधकार रखने िाले तथा प्रथम
ऄपीलीय प्राजधकारी से ऄगले ईच्च पद पर स्ट्थाजपत जद्वतीय ऄपीलीय प्राजधकारी के समक्ष ऄपील प्रस्ट्तुत कर सकता है और
जद्वतीय ऄपीलीय प्राजधकारी, पक्षकारों कन सुनिाइ का ऄिसर देने के ईपरान्त, ऐसा कनइ अदेि जारी कर सकता है, जैसा
िह ईजचत समझे, जजसमे प्रथम ऄपीलीय प्राजधकारी द्वारा जारी अदेि की पुजष्ट, संिनधन या ईसे जनरस्ट्त दकया जा सकता
है, बिते दक जद्वतीय ऄपील के मामले में भी िही समय-सीमा और प्रदक्रयाएाँ ऄपनाइ जाएाँगी जन प्रथम ऄपील के मामले में
ऄपनाइ जाती हैं;
(छ) प्रथम ऄपीलीय ऄजधकारी या जद्वतीय ऄपीलीय प्राजधकारी द्वारा जारी ऐसे अदेि की प्राजप्त की तारीख से तीस ददनों के
भीतर, नामजनर्ददष्ट ऄजधकारी ईस व्यजि कन, जजसके जिरुद्ध अदेि जारी दकया गया है, अदेि में लगाए गए िाजस्ट्त की
राजि के जलए एक संिनजधत मांग ननरटस जारी करके अदेि कन प्रभािी करेगा;
(ज) आस प्रकार लगाए गए दंड का भुगतान महाजनदेिक, िायुयान दुघघटना ऄन्िेषण ब्यूरन द्वारा जनधाघररत तरीके से, ऐसे
व्यजि द्वारा ईस व्यजि कन मांग ननरटस की तामीली के तीस ददनों के भीतर दकया जाएगा; और
(झ) यदद िह व्यजि जजस पर जुमाघना लगाया जाता है, मांग ननरटस में जनधाघररत समय के भीतर दंड की राजि का भुगतान
करने में जिफल रहता है, तन दकसी भी ऄनुज्ञजप्त, प्रमाण पत्र, प्राजधकरण, ऄनुज्ञापत्र या ऄनुमनदन कन रद्द करने या जनलंजबत
करने की कायघिाही, जैसा भी मामला हन, प्रचजलत जनयमों के तहत नागर जिमानन मंत्रालय द्वारा िुरू की जा सकती है।

NOTIFICATION
New Delhi, the 07th November, 2025
G.S.R. 829(E).─ Whereas, the draft of the Aircraft (Investigation of Accidents and Incidents)
Rules, 2025 was published, as required by section 34 of the Bharatiya Vayuyan Adhiniyam, 2024 (16 of
2024), in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 14th May, 2025,
vide notification of the Government of India in the Ministry of Civil Aviation, number G.S.R. 310(E), for
inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the
period of thirty days from the date on which the copies of the Official Gazette containing the said
notification were made available to the public;
And whereas, the said draft rules were made available to the public on the 14th May, 2025;
And whereas, the objections and suggestions received from the public on the said draft rules within the
period specified have been taken into consideration;
Now, therefore, in exercise of the powers conferred by sections 11, 12, 19, 30, 32 and 33 of the Bharatiya
Vayuyan Adhiniyam, 2024 (16 of 2024) the Central Government hereby makes the following rules,
namely: -
1. Short title, extent, application and commencement. ─ (1) These rules may be called the Aircraft
(Investigation of Accidents and Incidents) Rules, 2025.
(2) These rules shall extend, to the whole of India and apply to –
(a) citizens of India wherever they may be;
(b) the aircraft, and the persons on aircraft, registered in India wherever they may be;
(c)
the aircraft, and the persons on aircraft registered outside India but for the time being in or over
India; and
(d) an aircraft operated by a person who is not a citizen of India but has his principal place of
business or permanent residence in India.
(3) These rules shall come into force on the date of their publication in the Official Gazette.
2. Definitions. — (1) In these rules, unless the context otherwise requires –
(a) ―Accident‖ means an occurrence associated with the operation of an aircraft which, –
(i)
in the case of a manned aircraft, takes place between the time any person boards the aircraft with
the intention of flight until such time as all such persons have disembarked; or
(ii) in the case of an unmanned aircraft, takes place between the time the aircraft is ready to move
with the purpose of flight until such time as it comes to rest at the end of the flight and the
primary propulsion system is shut down, in which -
(a)
a person is fatally or seriously injured as a result of,
(i)
being in the aircraft; or

(ii) direct contact with any part of the aircraft, including parts which have become detached from
the aircraft; or
(iii) direct exposure to jet blast,
except when the injuries are from natural causes, self-inflicted or inflicted by other persons, or when the
injuries are to stowaways hiding outside the areas normally available to the passengers and crew; or
(b) the aircraft sustains damage or structural failure which –
(i)
adversely affects the structural strength, performance or flight characteristics of the
aircraft; and
(ii)
would normally require major repair or replacement of the affected component, except for
engine failure or damage, when the damage is limited to a single engine, (including its cowlings or
accessories), to propellers, wingtips, antennas, probes, vanes, tires, brakes, wheels, fairings, panels,
landing gear doors, wind screens, the aircraft skin (such as small dents or puncture holes), or for minor
damages to main rotor blades, tail rotor blades, landing gear, and those resulting from hail or bird
strike (including holes in the redone);or
(c)
the aircraft is missing or is completely inaccessible.
Explanation: For the purposes of this clause, it is clarified that –
(1) the guidance for the determination of aircraft damage is appended at Schedule B.
(2) only unmanned aircraft which have design or operational approval given by a State to be
considered.
(3) an aircraft shall be considered as missing when the official search has been terminated and the
wreckage has not been located.
(b) ―Accident investigation authority‖ means the authority designated by a State responsible for
aircraft accident and incident investigations within the context of annex 13 of International Civil
Aviation Organisation;
(c)
―Accredited representative‖ means a person designated by a State, on the basis of his or her
qualifications, for the purposes of participating in an investigation conducted by another State, and
the accredited representative would normally be from the State’s accident investigation authority;
(d) ―Adhiniyam‖ means the Bharatiya Vayuyan Adhiniyam, 2024 (16 of 2024);
(e)
―Adviser‖ means a person appointed by a State, on the basis of his or her qualifications, for the
purpose of assisting its accredited representative in an investigation;
(f)
―Aircraft‖ means any machine that can derive support in the atmosphere from the reactions of
the air other than the reactions of the air against the earth’s surface;
(g) ―Aircraft Accident Investigation Bureau or AAIB‖ means the Accident investigation
Authority constituted by the Central Government as per section 7 of the Adhiniyam;
(h) ―Annex 13‖ means annex 13 to the Convention relating to International Civil Aviation signed at
Chicago on the 7th day of December, 1944;
(i) ―Appellate Officer" means an officer of AAIB authorised to review the decisions made by the
designated officer;

(j) ―Causes‖ means actions, omissions, events, conditions, or a combination thereof, which led to the
accident or incident but does not amount to assigning fault or determination of administrative, civil or
criminal liability;
(k) “C2 Link.” means the data linked between the remotely piloted aircraft and the remote pilot
station for the purpose of managing the flight;
(l) ―Chicago Convention‖ means the Convention relating to International Civil Aviation signed at
Chicago on the 7th day of December, 1944;
(m) ―Contributing factors‖ mean actions, omissions, events, conditions, or a combination thereof,
which, if eliminated, avoided or absent, would have reduced the probability of the accident or
incident occurring, or mitigated the severity of the consequences of the accident or incident and the
identification of the contributing factors does not imply the assignment of fault or determination of
administrative, civil or criminal liability’.
(n)―Designated Officer" means an officer of AAIB authorised to take appropriate action against an
individual or organisation depending on the severity level of the contravention to these rules as
specified in Table 1 and Table 2 of Schedule C;
(o) ―DG, DGCA‖ means the Director General who shall be the head of the Directorate General of
Civil Aviation;
(p) ―DG, AAIB‖ means the Director General who shall be the head of the Aircraft Accident
Investigation Bureau;
(q) ―Draft final Report‖ means the Report submitted by the investigators appointed under rule 11 or
rule 12, for forwarding to the States for consultation under sub-rule (1) of rule 14;
(r) ―Fatal injury‖ means an injury which is sustained by a person in an accident and which results in
his or her death within thirty days of the date of the accident;
(s) ―Flight recorder‖ means any type of recorder installed in the aircraft for the purpose of
complementing accident or incident investigation;
(t) ―ICAO‖ means the International Civil Aviation Organisation created under the Convention
relating to International Civil Aviation signed at Chicago on the 7th day of December, 1944;
(u) ―Incident‖ means an occurrence, other than an accident, associated with the operation of an
aircraft which affects or could affect the safety of operation;
(v) ―Investigation‖ means a process conducted for the purpose of prevention of accident which
includes the gathering and analysis of information, the drawing of conclusions, including the
determination of causes, contributing factors and, when appropriate, the making of safety
recommendations in the form of a Report;
(w) ―Investigator‖ means a person appointed by the Aircraft Accident Investigation Bureau to
investigate an accident or a serious incident as Investigator-in-Charge under rule 11, or by the Central
Government for formal investigation under rule 12, or authorised by Bureau to conduct preliminary
investigation under sub-rule (1) of rule 9 or sub-rule (2) of rule 7; or an Investigator-in-Charge
appointed by DG, DGCA under rule 13;
(x) ―Investigator-in-charge‖ means a person charged, on the basis of his qualifications, with the
responsibility for the organisation, conduct and control of an investigation;
Provided that nothing in this clause shall preclude the functions of an investigator-in-charge being
assigned to the court referred to in rule 12 or other body.
(y) ―Maximum mass‖ means maximum certificated take-off mass;
(z) ―Missing aircraft‖ means when the official search has been terminated and the wreckage of the
aircraft has not been located;

(za) ―Occurrence‖ means any safety-related event which endangers or which, if not corrected or
addressed, could endanger an aircraft, its occupants or any other persons and it includes incident,
serious incident and accident;
(zb) ―Operator‖ means a person, organisation or enterprise engaged in or offering to engage in an
aircraft operation;
(zc) ―Preliminary Report‖ means the communication used for the prompt dissemination of data
obtained during the early stages of the investigation;
(zd) ―Remote pilot station‖ means the component of the remotely piloted aircraft system containing
the equipment used to pilot the remotely piloted aircraft;
(ze) ―Remotely piloted aircraft‖ means an unmanned aircraft that is piloted from a remote pilot
station;
(zf) ―Remotely piloted aircraft systems‖ means a remotely piloted aircraft, its associated remote
pilot station, the required C2 link and any other components as specified in the type design;
(zg) ―Safety recommendation‖ means, –
(i)
a proposal of an accident investigation authority based on information derived from an
investigation, made with the intention of preventing accidents or incidents and which in no case
has the purpose of creating a presumption of blame or liability for an accident or incident; or
(ii) recommendations resulting from diverse sources and safety studies;
(zh) ―Safety recommendation of global concern‖ means a safety recommendation regarding a
systemic deficiency having a probability of recurrence, with significant consequences at a global
level, and requiring timely action to improve safety;
(zi) ―Schedule‖ means a Schedule appended to these rules;
(zj) ―Serious incident‖ means an incident involving circumstances indicating that there was a high
probability of an accident and associated with the operation of an aircraft which, -
(i) in the case of a manned aircraft, takes place between the time any person boards the aircraft
with the intention of flight until such time as all such persons have disembarked; or
(ii) in the case of an unmanned aircraft, takes place between the time the aircraft is ready to move
with the purpose of flight until such time as it comes to rest at the end of the flight and the
primary propulsion system is shut down;
Explanation: For the removal of doubts, it is clarified that the examples of serious incidents are as
specified in Schedule A.
(zk) ―Serious injury‖ means an injury which is sustained by a person in an occurrence and which –
(i)
requires hospitalization for more than forty-eight hours, commencing within seven days from
the date the injury was received; or
(ii) results in a fracture of any bone (except simple fractures of fingers, toes or nose); or
(iii) involves lacerations which cause severe hemorrhage, nerve, muscle or tendon damage; or
(iv) involves injury to any internal organ; or
(v) involves second- or third-degree burns, or any burns affecting more than five per cent; or
(vi) involves verified exposure to infectious substances or injurious radiation.
(zl) ―State of Design‖ means the State having jurisdiction over the organisation responsible for the
type design of the aircraft;
(zm) ―State of Manufacture‖ means the State having jurisdiction over the organisation responsible
for the final assembly of the aircraft, remote pilot station, engine or propeller;
(zn) ―State of Occurrence‖ means the State in the territory of which an accident or incident occurs;

(zo) ―State of the Operator‖ means the State in which the principal place of business of the operator
is located or, if there is no such place of business, the permanent residence of the operator;
(zp) ―State of Registry‖ means the State on whose register the aircraft is entered;
Explanation: In the case of the registration of aircraft of an international operating agency other than
on a national basis, the States constituting the agency shall jointly and severally discharge the
obligations which attach to a State of Registry under annex 13.
(zq) ―State Safety Program‖ means an integrated set of regulations and activities aimed at
improving safety;
(zr) ―UTC‖ means Universal Time Co-ordinated;
(2) The words and expressions used herein but not defined, and defined in the Bharatiya Vayuyan
Adhiniyam, 2024 (16 of 2024) shall have the same meaning as assigned to them in the said Act.
3.
Objective of investigation of accidents and incidents. –– (1) The sole objective of the investigation
of an accident or incident shall be prevention of accidents and incidents and not to apportion blame or
liability.
(2) Any investigation conducted in accordance with the provisions of these rules shall be separate
from any judicial or administrative proceedings to apportion blame or liability.
4.
Notification of occurrence. — (1) Where an accident or incident occurs to an aircraft covered under
sub-rule (2) of rule 1, then the pilot-in-command of the aircraft or, if he be killed or incapacitated, the
owner, the operator, the hirer or other person on whose behalf he was in command of the aircraft, or any
relevant person, as the case may be, shall, as soon as is reasonably practicable but in any case not later than
twenty-four hours after he becomes aware of the accident or the incident, –
(a) send notice thereof to Aircraft Accident Investigation Bureau and Directorate General of Civil
Aviation by the quickest means of communication available; and
(b) in the case of an accident or serious incident occurring in India, give information to the District
Magistrate and the Officer-in-charge of the nearest Police Station of the accident or serious
incident and of the place where it occurred:
Provided that in case of an unmanned aircraft, the remote pilot-in-command shall notify
information of the occurrence as stipulated above.
(2) The notification shall be in plain language and contain as much of the following information as is
readily available, namely: –
(a)
for accidents the identifying abbreviation ACCID, for incidents INCID, for serious incidents
SINCID;
(b) manufacturer, model, nationality and registration marks, and serial number of the aircraft;
(c)
name of owner, operator, and hirer, if any, of the aircraft;
(d) qualification of the pilot-in-command, and nationality of crew and passengers;
(e)
date and time in local time or UTC of the accident or incident;
(f)
last point of departure and point of intended landing of the aircraft;

(g) position of the aircraft with reference to some easily defined geographical point and latitude and
longitude;
(h) number of crew and passengers; aboard, killed and seriously injured; others, killed and seriously
injured;
(i)
description of the accident or incident and the extent of damage to the aircraft so far as is known;
(j)
physical characteristics of the accident or incident area, as well as an indication of access
difficulties or special requirements to reach the site; and
(k) presence and description of dangerous goods on board the aircraft, but notification shall not be
delayed due to the lack of complete information.
(3) If the details or, other known relevant information referred in sub-rule (2) are omitted, such information
shall also be dispatched as soon as it is possible.
(4) The notification as required in sub-rule (2) shall also be submitted to the Aircraft Accident Investigation
Bureau by –
(a)
aerodrome operator;
(b) air traffic services in-charge concerned;
(c)
DG, DGCA, wherever applicable.
(5) The Aircraft Accident Investigation Bureau shall notify the facts of the accident or serious incident in
the territory of India or in the assigned oceanic airspace beyond the territory of India, containing as much
of the information referred to in sub-rule (2), as may be available with a minimum of delay and by the most
suitable and quickest means available, to –
(a)
the State of Registry;
(b) the State of Operator;
(c)
the State of Design;
(d) the State of Manufacture; and
(e)
ICAO when the aircraft involved is of a maximum mass of over 2,250 kilograms or is a turbojet
powered aeroplane.
(6) The Aircraft Accident Investigation Bureau while notifying information in accordance with sub-rule (5)
shall also add the following information, namely:–
(a) an indication to what extent the investigation will be conducted by the Aircraft Accident
Investigation Bureau or is proposed to be delegated by the Aircraft Accident Investigation
Bureau to another State; and
(b) identification of the originating authority and means to contact the Investigator-in-Charge or
Court referred to in rule 12, as the case may be.
(7) If the State of Occurrence is not aware of a serious incident or accident to an aircraft registered in India
or an aircraft operated by the Indian operator, the Aircraft Accident Investigation Bureau shall forward a
notification of information of such a serious incident or accident to the State of Design, the State of
Manufacturer and the State of Occurrence.

5.
Obligation to investigate. — (1) In case of an accident or serious incident or incident to an aircraft in
the territory of India, notwithstanding its registration,–
(a)
the DG, AAIB shall institute an investigation into the circumstances of the accident, and shall be
responsible for conducting the investigation;
(b)
the DG, AAIB shall institute an investigation into the circumstances of the serious incident
when the aircraft involved is of maximum mass of over 2250 kilograms. or is a turbojet airplane.
(c)
the DG, DGCA shall institute an investigation into the circumstances of all incidents and serious
incidents to aircraft not covered by clause (b).
(d)
the Central Government may institute a formal investigation into circumstances of any occurrence
to an aircraft registered in India, if it appears that it is expedient to hold such investigation.
(2) Notwithstanding anything contained in clause (c) of sub-rule (1), where it appears to the Aircraft
Accident Investigation Bureau that it is necessary or expedient to hold an investigation into circumstances
of any serious incident covered under said clause (c), it may, by order, institute an investigation into
circumstances of a serious incident to any aircraft.
(3) The classification by the Aircraft Accident Investigation Bureau of an occurrence as accident or serious
incident or incident shall be final and binding.
(4) In case an accident or a serious incident to an aircraft registered in India occurs at a location not being a
territory of any State, then the Aircraft Accident Investigation Bureau shall institute an investigation into
the circumstances of the accident or serious incident and shall be responsible for conducting the
investigation.
(5) In case India is the nearest State to the scene of an accident in international waters to an aircraft not
registered in India or not operated by an Indian operator, then the Aircraft Accident Investigation Bureau
shall advise the State of Registry to institute an investigation and the Aircraft Accident Investigation
Bureau in such a case shall provide assistance to the extent it is able to and shall, likewise, respond to
requests by the State of Registry.
6. Participation in investigation. — (1) In case the Aircraft Accident Investigation Bureau has instituted
an investigation of an accident or a serious incident in accordance with rule 5, then the accredited
representatives, who are appointed by the following States, namely: –
(a) the State of Registry;
(b) the State of the Operator;
(c) the State of Design; and
(d) the State of Manufacture;
shall be permitted to participate in the investigation
(2) The States referred to in sub-rule (1) shall also be entitled to appoint one or more advisers to assist their
accredited representatives.
(3) The States referred to in sub-rule (1) shall have the rights and entitlements in accordance with the
standards stipulated under annex13.

(4) A State which has a special interest in an accident by virtue of fatalities or serious injuries to its citizens
shall be entitled to appoint an expert who shall have rights and entitlements in accordance with standards
stipulated under annex 13.
(5) Any other State which is not enumerated in causes (a) to (d) of sub-rule (1) on request provides
information, facilities or experts to Aircraft Accident Investigation Bureau shall also be entitled to appoint
an accredited representative to participate in the investigation who shall have the rights and entitlements in
accordance with the standards stipulated under annex 13.
(6) The Aircraft Accident Investigation Bureau on receipt of a notification of information of an accident or
a serious incident to an aircraft registered in India in the territory of another State, may appoint accredited
representative and advisers to participate in the investigation and intimate it to the State of Occurrence.
(7) If Aircraft Accident Investigation Bureau has any data available from a flight recorder of an aircraft
involved in an accident or incident, it shall, –
(a) without delay, provide the State conducting the investigation with all such data which is available;
and
(b) not divulge such data without the express consent of the State conducting the investigation.
7.
Protection of evidence, custody, removal and preservation of damaged aircraft. — (1) In the
case of an accident or a serious incident, which is required to be notified under rule 4, the Investigator-in-
Charge shall have unhampered access to the wreckage and all relevant material and information, including
flight recorders and Air Traffic Services records, and shall have unrestricted control over it to ensure that a
detailed examination can be made without delay by authorised personnel participating in the investigation.
Explanation: For the purposes of this clause, in case of a remotely piloted aircraft system, relevant
material in sub-rule (1) includes the remotely piloted aircraft, its associated remotely pilot station, the
required C2 Link, any other components as specified in the type design and any associated recordings and
documents.
(2) The aircraft or any parts, or its contents thereof shall not, except by a person under the authority of the
DG, AAIB, be removed or otherwise interfered with:
Provided that –
(a) the aircraft or any parts or contents thereof may be removed or interfered with so far as may be
necessary by persons authorised to conduct search and rescue operations for the purpose of
extricating persons or animals dead or alive, or preventing the destruction of the aircraft and its
contents by fire or other cause, or preventing any damage or obstruction to the public or to air
navigation or to other transport;
(b) if the aircraft is wrecked on water, the aircraft or any parts or contents thereof may be removed to
such extent as may be necessary for bringing it or them to a place of safety by persons authorised
to conduct search and rescue operations;
(c) goods may be removed from the aircraft under the supervision and with the concurrence of an
officer of the Aircraft Accident Investigation Bureau or a person authorised by the DG, AAIB;
(d) personal luggage of passengers and crew after photography, weighing, etc. may be removed from
the aircraft under the supervision of a police officer, a Magistrate, an officer of the Aircraft
Accident Investigation Bureau or a person authorised by DG, AAIB; and

(e) mails after photography, weighing etc. may be removed under the supervision of a police officer,
a Magistrate, an officer of the Department of Posts and Telegraphs or an officer of the Aircraft
Accident Investigation Bureau or a person authorised by DG, AAIB.
(3) The DG, AAIB may, for the purposes of any investigation including preliminary investigation under
these rules, issue directions, authorise any person or persons to take measures, –
(a) to protect the evidence and shall include the preservation, by photographic or other means, of any
evidence which might be removed, effaced, lost or destroyed;
(b) to maintain safe custody of the aircraft or any parts or its contents and it shall include protection
against further damage, access by unauthorised persons, pilfering and deterioration;
(c) for preservation of the aircraft for such a period as may be necessary for the purposes of an
investigation;
(d) for arranging a suitable place and facilitation of transportation of wreckage to such a place.
(4) The owner of the aircraft or his nominated representative shall have the right to be present during any
examination or other action taken under sub-rules (1), (2) and (3):
Provided that the Aircraft Accident Investigation Bureau shall not be bound to postpone any action which it
may consider necessary under this rule by reason of the absence of the owner or his representative.
(5) If a request is received from the State of Registry, the State of the Operator, the State of Design or the
State of Manufacture that the aircraft, its contents, and any other evidence remain undisturbed pending
inspection by an accredited representative of the requesting State, the Aircraft Accident Investigation
Bureau shall take all necessary steps to comply with such request, so far as this is reasonably practicable
and compatible with the proper conduct of the investigation subject to the provisions of sub-rules (1) and
(2).
(6) Subject to the provisions of sub-rules (1), (2) and (3), the Aircraft Accident Investigation Bureau shall
release custody of the aircraft, its contents or any parts thereof as soon as they are no longer required for
investigation, to owner or operator or his representative, or any person or persons duly designated by the
State of Registry or the State of the Operator, in case of foreign registered aircraft.
(7) For the purpose of sub-rule (6), the Central Government shall facilitate access to such aircraft, its
contents or any parts thereof:
Provided that, if the aircraft or its contents, or any parts thereof lie in an area within which the Aircraft
Accident Investigation Bureau finds it impracticable to grant such access, the Central Government shall
effect removal to a point where access can be given.
(8)
The Aircraft Accident Investigation Bureau shall be the sole agency regarding the custody of the
evidence collected during the investigation including the wreckage and recorders, and in case of
requirement of access to such evidence by any other agency, DG, AAIB after being satisfied for
requirement of such access may facilitate such access while retaining the custody thereof.
8.
Aircraft Accident Investigation Bureau. –– (1) For the purposes of carrying out investigation into
accidents or serious incidents or incidents referred to in sub- rules (1), (2) and (4) of rule 5, the Aircraft
Accident Investigation Bureau, constituted under section 7 of the Adhiniyam, shall be the Bureau for the
aforesaid purposes. Aircraft Accident Investigation Bureau shall consist of such number of officers,

appointed by the Central Government, who are familiar with civil aircraft accident investigation procedures
and other persons, as it deems fit from time to time.
(2) The Aircraft Accident Investigation Bureau shall be an attached office of Ministry of Civil Aviation,
Government of India.
(3) The Aircraft Accident Investigation Bureau shall discharge the following functions, namely: –
(a) obtaining preliminary Report under rule 9 from any person or persons authorised either under
sub-rule (1) of rule 9 or under sub-rule (3) of rule 7;
(b) classification of occurrence and setting up investigation and in case of formal investigation,
assisting the Central Government, under these rules;
(c) to timely public dissemination of factual information of an investigation as appropriate;
(d) to facilitate the investigation and administrative work of the investigation whenever necessary;
(e) processing of the Reports of investigation received by the Aircraft Accident Investigation
Bureau, which includes, –
(i) acceptance of Report by DG, AAIB and making it public by DG, AAIB in a manner it
deems fit;
(ii) forwarding of the final Report, made public by the Central Government under sub-rule (2)
of rule 14 or by the Aircraft Accident Investigation Bureau, to the States as required under
annex 13;
(iii) forwarding of the final Report, made public by the Central Government or Aircraft
Accident Investigation Bureau, to ICAO, if the mass of the aircraft involved in accident or
incident is more than 5,700 kilograms.
(f) to formulate safety recommendations on the basis of safety studies, including induction of new
technology to enhance safety, conducted from time to time;
(g) to establish and maintain an accident and serious incident database for effective analysis of
information on actual or potential safety deficiencies;
(h) to process obligations of the Central Government under annex 13 to the Chicago Convention
(including any annex thereto relating to international standards and recommended practices);
(i) to forward the recommendations made in investigation Reports and safety studies to DG, DGCA
and other regulatory authorities for their follow up and to obtain compliance of the same;
(j) to inform ICAO of the issuance of a Safety Recommendation of Global Concern and its
responses in dated transmittal correspondence, even when the Safety Recommendation of
Global Concern is not addressed to ICAO; and
(k) any other functions, which the Central Government may direct the Aircraft Accident
Investigation Bureau to perform from time to time under these rules;

(4) The Aircraft Accident Investigation Bureau may make procedures, not inconsistent with the
provisions of the Adhiniyam and the rules made thereunder to carry out the purposes of these rules
and the functions referred to in sub-rule (3).
(5) In particular, and without prejudice to the generality of the foregoing power, such procedures may
provide for all or any of the following matters, namely: –
(a)
the persons required to notify the accidents or incidents;
(b) the notifications of accidents or serious incidents to International Civil Aviation Organisation
and the States for participation in the investigation;
(c)
the investigation of aircraft accidents or serious incidents or incidents;
(d) the format of Report for investigation conducted under these rules;
(e)
any other matter subsidiary or incidental to aircraft accident, serious incident or incident
investigation.
9.
Preliminary investigation. - (1) The DG, AAIB may authorise any person including an officer of the
Aircraft Accident Investigation Bureau to conduct a preliminary investigation into an accident or serious
incident or incident and to submit a preliminary Report to the Aircraft Accident Investigation Bureau to assess
the classification of the occurrence and the expertise needed for detailed investigation under rule 11, if
considered expedient by the Aircraft Accident Investigation Bureau.
(2) The person authorised to conduct the preliminary investigation shall, –
(a) have the powers and duties specified under rule 10; and
(b) have access to examine or otherwise deal with the aircraft as provided under sub-rule
(3) of rule 7.
10.
Powers and duties of Investigator. –– (1) For the purposes of investigation of accidents or serious
incidents or incidents an Investigator shall have power,–
(a) to call and examine any witness relevant to the investigation; and
(b) to require such witness to furnish or produce information or evidence or to answer or return to
any inquiries he thinks fit to make;
(c) to require any such witness to make and to sign a declaration regarding the true nature of the
statements made by him;
(d) to require and enforce the production of all books, paper, documents and any articles including but
not limited to Flight Data Recorder, Cockpit Voice Recorder and Air Traffic Services Records, which
he may consider necessary for the investigation, and to retain any such books, papers, documents and
any articles including but not limited to Flight Data Recorder, Cockpit Voice Recorder and Air
Traffic Services Records for examination until completion of the investigation;
(e) to have access to and examine any aircraft and its components involved in the accident or serious
incident or incident, the place where the event occurred or any other place, the entry upon and
examination of which appears to the Investigator necessary for the purpose of the investigation.

(2) The Investigator shall be responsible for fair, impartial and judicious conduct of investigation based
on relevant standard of annex 13.
11.
Investigation by Aircraft Accident Investigation Bureau. –– (1) The DG, AAIB may appoint an
Investigator-in-Charge and one or more Investigators to assist him, to hold an investigation into an aircraft
accident or a serious incident and such Investigator-in-Charge and Investigators shall have the same powers
and duties as an Investigator has under rule 10.
(2) The investigation shall be held in private.
(3) When a person other than an officer of the Government is appointed as Investigator by the DG,
AAIB, he may be granted such fee and expenses as may be determined by the Aircraft Accident
Investigation Bureau.
(4) Every person summoned by the Investigator-in-Charge as a witness under these rules shall be
allowed such expenses as the Aircraft Accident Investigation Bureau may, from time to time
determine.
(5) The Investigator-in-Charge shall submit a final Report to the Aircraft Accident Investigation
Bureau in the format based on relevant standards of annex 13.
(6) The DG, AAIB shall accept the Report of the Investigator-in-Charge and after acceptance, the
same shall be made public by the DG, AAIB in a manner he deems fit.
12.
Formal investigation. — Where it appears to the Central Government that it is necessary or
expedient to hold a formal investigation of an accident, it may, whether or not an investigation has been
made under rule 11, by order, direct a formal investigation to be held and with respect to any such formal
investigation, the following provisions shall apply, namely: –
(a) the Central Government shall appoint a competent person (hereinafter referred to as "the Court"),
to hold the investigation, and may appoint one or more persons possessing legal, aeronautical,
engineering, or other special knowledge to act as assessors, and one or more Investigators shall be
appointed from Aircraft Accident Investigation Bureau as an assessor;
Explanation: For the purposes of this clause, competent person means an officer of Aircraft Accident
Investigation Bureau or a person possessing legal, aeronautical, engineering or other special
knowledge including experience of working in civil aviation.
(b) when a person other than an officer of the Government is appointed as a Court or assessor, he
may be granted such fee and expenses as may be determined by the Central Government;
(c) on or after the appointment of the Court, all other investigations ordered under these rules shall be
treated as closed and all relevant material on the subject shall be transferred to the Court;
(d) the Court shall hold the investigation in open court in such manner and under such conditions as
the Court may think fit for ascertaining the causes and circumstances of the accident and for
enabling it to make the Report hereinafter mentioned:
Provided that where the Court is of opinion that holding the investigation is likely, –
(i)
to be prejudicial to the interests of any country; or

(ii) to jeopardize the personal safety of a person who is willing to make any statement or give
evidence, the Court may, hold the proceedings in camera, the whole or part of such investigation.
(e) the Court shall have, for the purposes of the investigation, all the powers of a Civil Court under the
Code of Civil Procedure, 1908 (5 of 1908) and without prejudice to these powers, the Court may, –
(i) enter and inspect, or authorise any person to enter and inspect, any place or building, the entry
or inspection whereof appears to the Court requisite for the purposes of the investigation; and
(ii) enforce the attendance of witnesses and compel the production of documents and material
objects; and every person required by the Court to furnish any information shall be deemed to
be legally bound to do so within the meaning of section 211 of the Bharatiya Nyaya Sanhita
(45 of 2023);
(f) the assessors shall have the same powers of entry and inspection as the Court;
(g) every person attending as a witness before the Court shall be allowed such expenses as the Court
may consider reasonable:
Provided that, in the case of the owner or hirer of any aircraft concerned in the accident and of
any person in his employment or of any other person concerned in the accident, any such
expenses may be disallowed if the Court, in its discretion, so directs for reasons to be recorded in
writing;
(h) the Court after holding consultation on draft final Report with the States as required in annex 13,
shall submit the final Report to the Central Government in the format specified by Aircraft
Accident Investigation Bureau and such final Report shall be forwarded to the said Bureau by the
Central Government for processing as per sub-rule (3) of rule 8 and rule 14;
(i)
the assessors shall either sign the said Report, with or without reservations, or state in writing their
dissent there from and their reasons for such dissent, and such reservations or dissent and reasons,
if any, shall be forwarded to the Central Government with the Report.
13.
Investigation of incident. –– (1) The DG, DGCA may order an investigation of any incident or a
serious incident involving an aircraft covered under clause (c) sub-rule (1) of rule 5 and may appoint an
Investigator-in-Charge for the purpose of carrying out the investigation.
(2) In case the Aircraft Accident Investigation Bureau decides to investigate the incident or serious
incident under sub-rule (2) of rule 5, the investigation ordered by DG, DGCA under sub-rule (1)
shall be closed and all relevant material shall be transferred to the Aircraft Accident Investigation
Bureau for its investigation.
(3) The investigation referred to in sub-rule (1) shall be held in private.
(4) The Investigator-in-Charge shall have the same powers and duties as an investigator under rule 10.
(5) The Investigator-in-Charge shall make a Report to the DG, DGCA in the format specified by the
Aircraft Accident Investigation Bureau based on relevant standards of annex 13.
(6) The DG, DGCA, shall accept the Report of the Investigator-in-Charge and after acceptance, the same
shall be made public by the DG, DGCA in a manner he deems fit.

14. Consultation and final Report. –– (1) The Investigator-in-Charge or the Court shall forward a copy of
the draft final Report under sub-rule (5) of rule 11 or under clause (h) of rule 12 to –
(a) the State of Registry;
(b) the State of operators;
(c) the State of design;
(d) the State of manufacturers, and
(e) the State that participated in the investigation in accordance with sub-rule (4) of rule 6, inviting
their significant and substantiated comments on the Report within the consultation period.
Explanation: For the purposes of this clause, it is clarified that –
(i) the usual consultation period shall be thirty days from the date of the transmittal correspondence and the
consultation period shall be extended to sixty days, if the State invited to comment notifies the need for
additional time.
(ii) if no comments within the consultation period, the final Report shall be issued, unless further extension
of that period has been agreed with the States concerned.
(2) The Court appointed under rule 12 or the Investigator-in-Charge may amend the draft final Report
either by inclusion of the substance of the comments received within the consultation period or by
appending the comments thereto if so desired by the State and cause any such final Report and reservation
or dissent and reasons, if any, to be made public, in such manner as deemed fit by the Central Government
based on relevant standards of annex 13.
(3) The final Report made public by the Central Government or the Aircraft Accident Investigation Bureau,
shall be forwarded to the States entitled to receive such Report under annex 13 and the Report shall also be
forwarded to ICAO preferably prepared in an electronic format, if the mass of the aircraft involved in the
accident or incident is more than 5,700 kilograms.
15. Reopening of investigation. –– Where it appears to the Aircraft Accident Investigation Bureau or the
Central Government that any new and significant material evidence has become available after completion
of the investigation under rule 11 or rule 12, as the case may be, it may, by order, direct the reopening of
the same.
16. Obstruction of proceedings. –– (1) No person shall obstruct or impede the Court or Assessors or
Investigator or any other person acting in the exercise of any powers or duties under these rules.
(2) No person shall without reasonable excuse fail to comply with any summons or requisition of a Court
or an Investigator- in-Charge or an Investigator or any other person holding an investigation or an inquiry
under these rules.
Explanation: For the purposes of this rule, when a question arises as to whether a person has a reasonable
excuse, the burden of proving that he has a reasonable excuse shall be upon him.
(3) Any person who obstructs or impedes the proceedings, shall be liable for imposition of penalty in
accordance with the provision laid down in Schedule C and in accordance with the provisions of section 32
of the Adhiniyam.

17. Non-disclosure of records. — (1) The following records shall not be disclosed for purposes other than
the investigation of the accident or incident, except when the Central Government determines that their
disclosure outweighs the adverse domestic and international impact such action may have on that
investigation or any future investigations, –
(a) all statements taken from persons by the investigation authorities in the course of their
investigation;
(b) all communications between persons having been involved in the operation of the aircraft;
(c) medical or private information regarding persons involved in the accident or incident;
(d) cockpit voice recordings and transcripts from such recordings;
(e) recordings and transcriptions of recordings from air traffic control units;
(f) cockpit airborne image recordings and any part or transcripts from such recordings;
(g) opinion expressed in the analysis of information, including flight recorder information.
(2) A record referred to in sub-rule (1) shall be included in a final Report or its appendices or in any other
Report only when it is relevant to the analysis of the accident or incident and parts of the records not
relevant to the analysis shall not be included in the final Report.
(3) The final Report shall not disclose the names of the persons involved in the accident or incident.
(4) Any request for records in the custody or control of Aircraft Accident Investigation Bureau shall not be
entertained if not routed through the original source, where available.
(5) The audio content of cockpit voice recordings as well as image and audio content of airborne image
recordings shall not be disclosed to the public.
(6) The content of draft final Report received from other States shall not be disclosed to public.
18. Maintenance of accident and incident database. — The Aircraft Accident Investigation Bureau shall
establish and maintain an accident and serious incident database and provide the same for inclusion in
safety data being maintained by the Directorate General of Civil Aviation and the Directorate General of
Civil Aviation shall exchange their database with Aircraft Accident Investigation Bureau on regular basis.
19. Saving. — Nothing in these rules shall limit or otherwise affect the power of the Central Government
with regard to the cancellation, suspension or endorsement of any licence or certificate issued under the
Bharatiya Vayuyan Adhiniyam, 2024.
20. Penalties. – (1) Any person who contravenes, or fails to comply with, any provisions of these rules,
shall be liable for imposition of penalty to the extent as laid down in Schedule C of these rules and in
accordance with the provisions of section 32 of the Adhiniyam.
(2) The penalty shall be adjudicated by the designated officers or the appellate officer, as the case may be,
in accordance with the provisions as provided in the said Schedule.
21. AAIB Bulletins. –– (1) The DG, AAIB may, through publication entitled AAIB Bulletins, issue
information not inconsistent with the Adhiniyam, and these rules, relating to the investigation of accidents or
serious incidents of aircraft flying in or over India or of aircraft registered in India.

SERIOUS INCIDENTS
The incidents listed are typical examples of incidents that are likely to be serious incidents and the list is not
exhaustive and only serves as guidance to the definition of serious incident, –
(a) near collisions requiring an avoidance maneuver to avoid a collision or an unsafe situation or when an
avoidance action would have been appropriate;
Note: Near collision classified with severity ―Risk of Collision and Safety not assured as in ICAO Doc
4444 shall be classified as serious incident.
(b) collisions not classified as accidents;
(c) controlled flight into terrain only marginally avoided;
(d) aborted take-offs on a closed or engaged runway, on a taxiway (excluding authorised operations by
helicopters) or unassigned runway;
(e) take-offs from a closed or engaged runway, from a taxiway (excluding authorised operations by
helicopters) or unassigned runway;
(f) landings or attempted landings on a closed or engaged runway, on a taxiway, unassigned runway or
unintended landing locations such as roadways;
(g) gross failures to achieve predicted performance during take-off or initial climb;
(h) fires or smoke in the cockpit, in the passenger compartment, in cargo compartments or engine fires, even
though such fires were extinguished by the use of extinguishing agents;
(i) events requiring the emergency use of oxygen by the flight crew;
(j) aircraft structural failures or engine disintegrations, including uncontained turbine engine failures, not
classified as an accident;
(k) multiple malfunctions of one or more aircraft systems seriously affecting the operation of the aircraft;
(l) flight crew incapacitation in flight, –
(i) for single pilot operations including remote pilot;
(ii) for multi-pilot operations for which flight safety was compromised because of a significant increase in
workload for the remaining crew.
(m) fuel quantity level or distribution situations requiring the declaration of an emergency by the pilot, such
as insufficient fuel, fuel exhaustion, fuel starvation, or inability to use all usable fuel on board;
(n) runway incursions classified with severity A. The Manual on the Prevention of Runway Incursions
(Doc 9870) contains information on the severity classifications;

(o) take-off or landing incidents and incidents such as under-shooting, overrunning or running off the side
of runways;
(p) system failures including loss of power or thrust, weather phenomena, operations outside the approved
flight envelope or other occurrences which caused or could have caused difficulties controlling the
aircraft;
(q) failures of more than one system in a redundancy system mandatory for flight guidance and navigation;
(r)
the unintentional or, as an emergency measure, the intentional release of a slung load or any other load
carried external to the aircraft;
(s)
retraction of a landing gear leg or wheels-up landing not classified as an accident;
(t)
dragging during landing of a wing tip, an engine pod or any other part of the aircraft, when not
classified as an accident; and
(u) in the case of unmanned aircraft, consider whether the most credible outcome, had the incident
escalated into an accident, could have resulted in a person being fatally or seriously injured.
Schedule B

GUIDANCE FOR DETERMINATION OF AIRCRAFT DAMAGE
(a) If an engine separates from an aircraft, the event is categorised as an accident even if damage is
confined to the engine.
(b) A loss of engine cowls (fan or core) or reverser components which does not result in further damage
to the aircraft is not considered an accident.
(c) Occurrences where compressor or turbine blades or other engine internal components are ejected
through the engine tail pipe are not considered an accident.
(d) A collapsed or missing radome is not considered an accident unless there is related substantial
damage in other structures or systems.
(e) Missing flap, slat and other lift augmenting devices, winglets, etc., that are permitted for dispatch
under the Configuration Deviation List (CDL) are not considered to be an accident.
(f) Retraction of a landing gear leg, or wheels-up landing, resulting in skin abrasion only, and if the
aircraft can be safely dispatched after minor repairs, or patching, and subsequently undergoes more
extensive work to effect a permanent repair, then the occurrence would not be classified as an
accident.
(g) If the structural damage is such that the aircraft depressurizes, cannot be pressurized, the occurrence
is categorized as an accident.

(h) The removal of components for inspection following an occurrence, such as the precautionary
removal of an undercarriage leg following a low-speed runway excursion, while involving
considerable work, is not considered an accident unless significant damage is found.
(i) Occurrences that involve an emergency evacuation are not counted as an accident unless someone
receives serious injuries or the aircraft has otherwise sustained significant damage.
Explanation: For the removal of doubts, it is clarified that -
(1) Regarding aircraft damage which adversely affects the structural strength, performance or flight
characteristics, the aircraft may have landed safely, but cannot be safely dispatched on a further sector
without repair.
(2) If the aircraft can be safely dispatched after minor repairs and subsequently undergoes more extensive
work to effect a permanent repair, then the occurrence would not be classified as an accident; likewise, if
the aircraft can be dispatched under the CDL with the affected component removed, missing or inoperative,
the repair would not be considered as a major repair and consequently the occurrence would not be
considered an accident.
(3) The cost of repairs, or estimated loss, such as provided by insurance companies may provide an indication
of the damage sustained but should not be used as the sole guide as to whether the damage is sufficient to
count the occurrence as an accident; likewise, an aircraft may be considered a “hull loss” because it is
uneconomic to repair, without it having incurred sufficient damage to be classified as an accident.

3. Procedure for adjudication of penalty by designated officers: — (a) The designated officer upon his
satisfaction that a person has contravened any of the rule as specified in the Table 2 under paragraph 2
above, he may, after giving a reasonable opportunity of being heard to such person, by an order in writing,
impose penalty in accordance with Tables 1 and 2 under paragraphs 1 and 2 respectively, upon such
person, stating the nature of contravention, the provision of rules which have been contravened and the
reasons for imposing such penalty along with the demand notice;

(b) A copy of penalty order passed along with the demand notice by the designated officer shall be served
upon such person by a recognised mode of service;
(c) The person aggrieved by the order issued under clause (a), may prefer an appeal in the Form-A along
with the fee of one thousand rupees in the manner as laid down by the Director-General, Aircraft Accident
Investigation Bureau within thirty days from the date on which the copy of order issued by the designated
officer is received by such person;
(d) The first appellate officer may, after giving an opportunity of being heard to the appellant, pass a
speaking order, confirming, modifying or setting aside the order issued by the designated officer;
(e) The copy of appellate order passed by Appellate Officer shall be provided to the appellant and the
concerned designated officer;
(f) The person aggrieved by any order passed by the First Appellate Officer: may prefer an appeal to the
Second Appellate Officer having jurisdiction in the matter who is next higher in rank to the First Appellate
Officer and the Second Appellate Officer may, after giving an opportunity of being heard to the parties,
pass such order as he thinks fit, confirming, modifying or setting aside the order passed by the First
Appellate Officer provided that the same timelines or procedures as in case of first appeal shall be followed
for the second appeal also;
(g) The designated officer, within thirty days from the date of the receipt of such order passed by the First
appellate officer, or the Second Appellate Officer, shall grant the effect to the order by issuing a revised
demand notice to the person against whom the order has been passed for the amount of penalty imposed in
the order;
(h) The penalty thus imposed shall be paid by such person in the manner as laid down by the Director-
General, Aircraft Accident Investigation Bureau within thirty days of the service of demand notice upon
the person; and
(i) In case the person on whom the penalty is imposed fails to pay such amount of penalty within the time
as stipulated in demand notice, then, the proceeding for cancellation or suspension of any licence,
certificate, authorisation, permit or approval, as the case may be, may be initiated through Ministry of Civil
Aviation under the prevalent rules.
