(ग्रेड 'ख'/ग्रेड- 'I') सीजमत जिभागीय प्रजतयोगी परीक्षा के जनयम, नीचे उजल्लजखत सेिाओं के आिुजलजपक (ग्रेड 'बी'/ग्रेड-I) के जलए चयन सूजचयों में िोड़ने के जलए, संबंजधत मंत्रालयों की सहमजत से, सामान्य II—SEC. 3(i)] श्रेणी VI सिस्त्र बल मुख्यालय आिुजलजपक सेिा का जनिी सजचि श्रेणी VII रेलिे बोडि सजचिालय आिुजलजपक सेिा का ग्रेड ‘ख’/जनिी सजचि ग्रेड श्रेणी IX कमिचारी राज्य बीमा जनगम में जनिी सजचि ग्रेड 1. प्रत्येक ग्रेड/सेिा हेतु चयन सूची में िाजमल करने के जलए चयन दकए िाने िाले व्यजियों की संख्या, आयोग द्वारा िारी दकए गए नोटिस में जनर्ििष्ट दकया िाएगा। जिजभन्न श्रेजणयों के तहत उम्मीििारों का अंजतम चयन और पटरणामों की घोर्णा, अन्य बातों के साथ-साथ कार्मिक एिं प्रजिक्षण जिभाग के दिनांक 12.04.2022 के कायािलय ज्ञापन संख्या 36012/16/2019-स्ट्था.(आरक्षण) के तहत िारी दकए गए दििा-जनिेिों के आधार पर की िाएगी िो जनम्नजलजखत न्यायालयी मामलों के अंजतम जनणिय के अध्यधीन होगीीः- i. भारत के माननीय उच्चतम न्यायालय में िर्ि 2022 की जसजिल अपील संख्या 629 (एसएलपी (सी) सं. 30621/2011 से उत्पन्न) और उससे संबंजधत मामले (िरनैल ससंह बैच के मामले); ii. संबंजधत मामले में कोई अन्य मामले। 2. यह परीक्षा इन जनयमों के पटरजिष्ट में जनधािटरत तरीके के अनुसार संघ लोक सेिा आयोग द्वारा आयोजित की िाएगी। परीक्षा के आयोिन की तारीख और स्ट्थान का जनधािरण, आयोग द्वारा दकया िाएगा और आयोग द्वारा पृथक रूप से सूजचत दकया िाएगा। 3. नीचे कॉलम 1 में उजल्लजखत ग्रेड और सेिाओं के स्ट्थायी अथिा जनयजमत रूप से जनयुि अस्ट्थायी अजधकारी, िो पात्रता की जनणाियक जतजथ (िैसा दक नीचे उजल्लजखत है) को कॉलम 2 में उजल्लजखत सेिा की अिजध और िैजक्षक योग्यता आदि से संबंजधत ितें पूरी करते हैं, िे कॉलम 3 में उजल्लजखत सेिा की संबंजधत श्रेणी के जलए परीक्षा में बैठने हेतु पात्र होंगे। पात्रता जनधािरण हेतु जनणाियक जतजथ 01 िुलाई, 2019 2019 की परीक्षा के जलए 01 िुलाई, 2020 2020 की परीक्षा के जलए 01 िुलाई, 2021 2021 की परीक्षा के जलए टिप्पणीः 1. िर्ि 2019 की परीक्षा के जलए पात्र उम्मीििार (उम्मीििारों), िर्ि 2020 और िर्ि 2021 की परीक्षा के जलए भी पात्र होंगे और िर्ि 2020 की परीक्षा के जलए पात्र उम्मीििार (उम्मीििारों), िर्ि 2021 की परीक्षा हेतु भी पात्र होंगे िो दक सभी अन्य पात्रता ितों को पूरा करने के अध्यधीन होगी और बिते दक उम्मीििार इस प्रकार जिचार करने हेतु जििेर् रूप से यह जिकल्प चुने। कॉलम 1 कॉलम 2 कॉलम 3 केन्रीय सजचिालय आिुजलजपक सेिा के िैयजिक सहायक जनणाियक जतजथ को दकसी मान्यता प्राप्त जिश्वजिद्यालय से स्नातक उपाजध धारक हो तथा जनम्नजलजखत पात्रता ितों को पूरा करता होीः- श्रेणी IV [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (i) सेिा कालीः उसने उस श्रेणी में कम से कम तीन िर्ि की अनुमोदित और जनरंतर सेिा की हो । बिते यदि उसे प्रजतयोजगता परीक्षा जिसमें सीजमत जिभागीय प्रजतयोजगता परीक्षा भी िाजमल है, के पटरणामों के आधार पर केन्रीय सजचिालय आिुजलजपक सेिा के िैयजिक सहायक के जलए जनयुि दकया गया है, तो ऐसी परीक्षा जनणाियक तारीख से कम से कम तीन िर्ि पूिि आयोजित की गई होनी चाजहए और उसने उस श्रेणी में कम से कम िो िर्ि की अनुमोदित और जनरंतर सेिा की हो । (ii) ऐसा िैयजिक सहायक, िो सक्षम प्राजधकारी के अनुमोिन से प्रजतजनयुजि पर काडर बाह्य पिों पर है, परीक्षा में सजम्मजलत होने के जलए पात्र होगा, यदि िह अन्यथा पात्र है। बिते ऐसा िैयजिक सहायक जिसमें काडर बाह्य या अंतरण पर दकसी अन्य सेिा के जलए जनयुि दकया गया है और जिसका िैयजिक सहायक के जलए धारणाजधकार (जलयन) नहीं है, परीक्षा में सजम्मजलत होने का पात्र नहीं होगा। तथाजप, िटरष्ठता कोिा (एसक्यू)/सीजमत जिभागीय प्रजतयोगी परीक्षा (एलडीसीई) कोिा के माध्यम से जनयुि िैयजिक सहायकों को पात्रता ितों में जनम्नजलजखत छूि प्रिान की िाती हैीः- क) चयन सूची िर्ि- 2016, 2017 और 2018 के जलए िटरष्ठता कोिा से संबंजधत िैयजिक सहायकों के संबंध में पीए ग्रेड में जनरंतर सेिा में 1 िर्ि और 6 महीने तक की छूि ख) चयन सूची िर्ि 2016 के एलडीसीई कोिा के पीए को पीएस एलडीसीई िर्ि 2019-2021 में भाग लेने के जलए, जनरंतर सेिा में 02 माह की छूि तथा पीए एलडीसीई परीक्षा की जतजथ से जनणाियक जतजथ के अंतराल में 02 दिनों की छूि िी िाती है भारतीय जििेि सेिा िाखा ‘ख’ के आिुजलजपक संिगि का िैयजिक सहायक ग्रेड आिुजलजपक संिगि के िैयजिक सहायक ग्रेड में अनुमोदित सेिा 5 िर्ि से कम न हो तथा उसने दकसी मान्यता प्राप्त जिश्वजिद्यालय से स्नातक की जडग्री प्राप्त की हो। इसके अजतटरि, उम्मीििार द्वारा ऐसे अजनिायि प्रजिक्षण कायिक्रम(मों) को पूरा दकया होना चाजहए, िो जििेि मंत्रालय द्वारा जनधािटरत हों। पीएस एलडीसीई 2021 में उपजस्ट्थत होने के जलए (मंत्रालय के श्रेणी V 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] दिनांक 06.10.2023 के आिेि सं. क्यू/सीएडी/611/02/2023 के अनुसार) िर्ि 2015 बैच के पीए को पांच िर्ों की अनुमोदित सेिा में एक (01) िर्ि की छूि प्रिान की िाती है। इसके अजतटरि, संबंजधत िर्ों की चयन सूची में उम्मीििारों का समािेिन, भारतीय जििेि सेिा िाखा ‘ख’ के आिुजलजपक संिगि के जनिी सजचि ग्रेड में भती/िटरष्ठता को प्रभाजित करने िाले दकसी भी न्याजयक जनिेि/जनणिय के अधीन होगा। सिस्त्र बल मुख्यालय आिुजलजपक सेिा का ग्रेड ‘ग’ सिस्त्र बल मुख्यालय आिुजलजपक सेिा के ग्रेड-II/ग्रेड ‘ग’ में अनुमोदित तथा जनरंतर सेिा 3 िर्ि से कम न हो। बिते दक यदि उसे दकसी प्रजतयोगी परीक्षा, जिसमें सीजमत जिभागीय प्रजतयोगी परीक्षा भी िाजमल है, के पटरणाम के आधार पर सेिा के ग्रेड-ग में जनयुि दकया गया था, तो ऐसी परीक्षा जनणाियक तारीख से कम से कम 3 िर्ि पहले आयोजित की गई हो और उसने जनणाियक तारीख को उस ग्रेड में कम से कम 2 िर्ि की अनुमोदित एिं जनरंतर सेिा की हो। श्रेणी VI रेलिे बोडि सजचिालय आिुजलजपक सेिा का ग्रेड ‘ग’/िैयजिक सहायक ग्रेड चयन सूची िर्ि 2019 और 2020 के जलएीः (i) सेिा की अिजधीः रेलिे बोडि सजचिालय आिुजलजपक सेिा के ग्रेड-II/ग्रेड ‘ग’/िैयजिक सहायक में अनुमोदित तथा लगातार सेिा 5 िर्ि से कम न हो। “बिते दक यदि उसे दकसी प्रजतयोगी परीक्षा, जिसमें सीजमत जिभागीय प्रजतयोगी परीक्षा भी िाजमल है, के पटरणाम के आधार पर रेलिे बोडि सजचिालय आिुजलजपक सेिा के ग्रेड-‘ग’ में जनयुि दकया गया था, तो ऐसी परीक्षा का पटरणाम जनणाियक जतजथ से कम से कम पांच िर्ि पहले घोजर्त दकया गया हो और उसने उस ग्रेड में कम से कम चार िर्ि की अनुमोदित एिं जनरंतर सेिा की हो।” तथाजप, आिुजलजपक ग्रेड ‘ग’ सीजमत जिभागीय प्रजतयोगी परीक्षा 2014 के माध्यम से पिोन्नत िैयजिक सहायक के मामले में पटरणाम की जतजथ और पात्रता की जनणाियक जतजथ के बीच अपेजक्षत पांच िर्ि के अंतराल के जलए िो महीनें की सीमा तक छूि प्रिान की िाती है तादक िे िर्ि 2019 की परीक्षा में उपजस्ट्थत होने के जलए पात्र हो सकें। इसके अजतटरि, आिुजलजपक ग्रेड ‘ग’ सीजमत जिभागीय प्रजतयोगी परीक्षा 2015 के माध्यम से पिोन्नत िैयजिक सहायकों को पटरणाम की जतजथ और पात्रता की जनणाियक जतजथ के बीच अपेजक्षत पांच श्रेणी VII [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 िर्ों के अंतराल में 11 महीनों की छूि िी िाती है तादक िे िर्ि 2020 की परीक्षा में उपजस्ट्थत होने के जलए पात्र हो सकें। (ii) ग्रेड-ग अजधकारी, िो प्रजतजनयुजि पर बाह्य काडर पिों पर हैं, परीक्षा में सजम्मजलत होने के जलए पात्र होंगे, यदि िे अन्यथा पात्र है। बिते दक यह ग्रेड ‘ग’ के उस अजधकारी पर लागू नहीं होगा जिसे दकसी संिगि-बाह्य पि पर या “स्ट्थानांतरण” पर दकसी अन्य सेिा में जनयुि दकया गया हो और ग्रेड-ग पर धारणाजधकार (जलयन) न हो। चयन सूची िर्ि 2021 के जलएीः (i) सेिा की अिजधीः िैयजिक सहायक ग्रेड में कम से कम 3 िर्ों की अनुमोदित और जनरंतर सेिा हो तथा जनणाियक जतजथ तक दकसी मान्यता प्राप्त जिश्वजिद्यालय से स्नातक उपाजध धारक हो। बिते दक यदि उसे रेलिे बोडि सजचिालय आिुजलजपक सेिाओं के िैयजिक सहायक ग्रेड में दकसी प्रजतयोगी परीक्षा, जिसमें सीजमत जिभागीय प्रजतयोगी परीक्षा भी िाजमल है, के पटरणाम के आधार पर जनयुि दकया गया था, तो ऐसी परीक्षा जनणाियक जतजथ से कम से कम तीन िर्ि पहले आयोजित की गई हो और जनणाियक जतजथ तक उसने उस ग्रेड में कम से कम िो िर्ि की अनुमोदित और जनरंतर सेिा की हो। (ii) सक्षम प्राजधकारी के अनुमोिन से संिगि-बाह्य पि पर प्रजतजनयुजि पर कायिरत िैयजिक सहायक, यदि अन्यथा पात्र हों, तो परीक्षा में प्रिेि हेतु पात्र होंगे: बिते दक िह िैयजिक सहायक, जिसे संिगि-बाह्य पि पर या दकसी अन्य सेिा में 'स्ट्थानांतरण' पर जनयुि दकया गया हो और जिसका िैयजिक सहायक ग्रेड में धारणाजधकार (जलयन) न हो, िह परीक्षा में प्रिेि हेतु पात्र नहीं होगा। कमिचारी राज्य बीमा जनगम में िैयजिक सहायक कमिचारी राज्य बीमा जनगम में िैयजिक सहायक ग्रेड में अनुमोदित तथा जनरंतर सेिा 3 िर्ि से कम न हो। श्रेणी IX नोि 1. ऊपर के कॉलम 1 में उजल्लजखत ग्रेडों और सेिाओं के ऐसे स्ट्थायी अथिा जनयजमत रूप में जनयुि अजधकारी, िो सक्षम प्राजधकारी की स्ट्िीकृजत से जनयत अिजध के जलए संिगि-बाह्य पिों पर प्रजतजनयुजि पर हैं, यदि अन्यथा पात्र हों, तो इस परीक्षा में प्रिेि पाने के पात्र होंगे और प्रजतजनयुजि की अिजध के िौरान उनके द्वारा की गई सेिा, कॉलम 2 में उजल्लजखत सेिा अिजध के जलए अहिक होगी। तथाजप, यह कॉलम 1 में उजल्लजखत ग्रेडों तथा सेिाओं के उन अजधकाटरयों पर लागू नहीं होता है जिन्हें उनके संबंजधत ग्रेड तथा सेिाओं संिगि-बाह्य पि पर अथिा अन्य सेिा में “स्ट्थानान्तरण” पर कॉलम 1 (श्रेणी-VII को छोड़कर) में 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उजल्लजखत उनके संबंजधत ग्रेडों तथा सेिाओं में जनयुि दकया गया हो (चाहे िे कोई धारणाजधकार (जलयन) रखते हों या नहीं)। श्रेणी IV के संबंध में, यदि कोई अजधकारी तकनीकी त्यागपत्र िेता है और धारणाजधकार (जलयन) की अिजध के िौरान अपने मूल पि पर पुनीः कायिभार ग्रहण करता है, तो अपना तकनीकी त्यागपत्र िेने के बाि जिस जिभाग में उसने कायिभार ग्रहण दकया था, िहााँ जबताई गई अिजध को पीएस एलडीसीई में उपजस्ट्थत होने के जलए अहिक सेिा में नहीं जगना िाएगा। नोि 2: केंरीय सजचिालय आिुजलजपक सेिा के ऐसे आिुजलजपक, िो भारतीय जििेि सेिा, िाखा 'बी' में प्रजतजनयुजि पर हैं, श्रेणी V की परीक्षा में प्रिेि के जलए पात्र नहीं होंगे। नोि 3: सभी उम्मीििार, िो जनणाियक जतजथ तक ऊपर िी गई अपेजक्षत पात्रता पूरी करने की अपेक्षा रखते हैं, िे परीक्षा के जलए आिेिन कर सकते हैं। 4. कार्मिक एिं प्रजिक्षण जिभाग द्वारा भारत के रािपत्र में परीक्षा के जनयमों की अजधसूचना और आयोग द्वारा परीक्षा की सूचना के प्रकािन के पश्चात, उम्मीििार को आयोग की िेबसाइि पर ऑनलाइन सामान्य आिेिन पत्र (सीएएफ) भरना होगा और उसकी हाडि कॉपी, उम्मीििार द्वारा अपने आिेिन पत्र में िी गई िानकारी का संबंजधत संिगि इकाई द्वारा उसके सेिा टरकॉडि से जिजधित सत्यापन/प्रमाणन के पश्चात, उजचत माध्यम से संबंजधत प्रजतभागी सेिा के संिगि जनयंत्रण प्राजधकारी को उम्मीििार की पात्रता जनधािटरत करने और पात्र उम्मीििार के आिेिन को आयोग को अग्रेजर्त करने के जलए भेिी िाएगी। दकसी उम्मीििार की पात्रता जनधािटरत करने हेतु आिेिन की संिीक्षा, इन जनयमों में जनधािटरत पात्रता ितों के संिभि में, संबंजधत प्रजतभागी सेिा के संिगि जनयंत्रण प्राजधकारी द्वारा की िाएगी। 5. जनयम 4 में दकसी भी बात के जनजहत होने के बाििूि, परीक्षा में प्रिेि के जलए उम्मीििार के आिेिन को स्ट्िीकार करने या न करने के संबंध में आयोग का जनणिय अंजतम होगा। 6. दकसी भी उम्मीििार को परीक्षा में तब तक प्रिेि नहीं दिया िाएगा िब तक दक उसके पास आयोग का प्रिेि प्रमाण-पत्र न हो। 7. िो उम्मीििार आयोग द्वारा जनम्नजलजखत के जलए िोर्ी घोजर्त है या दकया गया है:– (i) दकसी भी प्रकार से अपनी उम्मीििारी के जलए समथिन प्राप्त दकया है, नामत: (क) गैरकानूनी रूप से पटरतोर्ण की पेिकि करना, या (ख) िबाि डालना, या (ग) परीक्षा आयोजित करने से संबंजधत दकसी व्यजि को ब्लैकमेल करना अथिा उसे ब्लैकमेल करने की धमकी िेना, अथिा (ii) प्रजतरूपण, अथिा (iii) दकसी अन्य व्यजि से छद्म रुप से कायि करिाना है, अथिा (iv) िाली प्रमाण-पत्र या ऐसे प्रमाण-पत्र प्रस्ट्तुत करना, जिनमें तथ्यों से छेड-छाड़ की गई हो, अथिा (v) आिेिन फॉमि में िास्ट्तजिक फोिो/हस्ट्ताक्षर के स्ट्थान पर असंगत फोिो अपलोड करना। (vi) गलत या झूठे ििव्य िेना या महत्िपूणि तथ्यों को जछपाना है, अथिा [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (vii) परीक्षा के जलए अपनी उम्मीििारी के संबंध में जनम्नजलजखत साधनों का उपयोग दकया है, नामत: (क) गलत तरीके से प्रश्न-पत्र की प्रजत प्राप्त करना; (ख) परीक्षा से संबंजधत गोपनीय कायि से िुड़े व्यजि के बारे में पूरी िानकारी प्राप्त करना; (ग) परीक्षकों को प्रभाजित करना; अथिा (viii) परीक्षा के िौरान उम्मीििार के पास अनुजचत साधनों का पाया िाना या प्रयोग दकया िाना; अथिा (ix) उत्तर पुजस्ट्तका(ओं) पर भद्दी बातें या भद्दे रेखाजचत्र बनाना अथिा असंगत सामग्री जलखना; अथिा (x) परीक्षा भिन में िुव्यिहार करना, जिसमें उत्तर पुजस्ट्तकाओं को फाड़ना, साथी परीक्षार्थियों को परीक्षा का बजहष्कार करने के जलए उकसाना अथिा अव्यिस्ट्था तथा ऐसी ही अन्य जस्ट्थजत पैिा करना िाजमल है; अथिा (xi) परीक्षा आयोिन के जलए आयोग द्वारा जनयुि कमिचाटरयों को परेिान करना या अन्य प्रकार की िारीटरक क्षजत पहंचाना हो; अथिा (xii) परीक्षा के िौरान मोबाइल फोन (चाहे िह जस्ट्िच ऑफ ही क् यों ना हो), पेिर या दकसी अन्य प्रकार का इलैक्रॉजनक उपकरण या प्रोग्राम दकए िा सकने िाला जडिाइस या पेन ड्राइि, स्ट् मािि िॉच इत्यादि िैसा कोई स्ट्िोरेि मीजडया, या कैमरा या ब्लूिूथ जडिाइस या कोई अन्य उपकरण या संचार यंत्र के रूप में प्रयोग दकए िा सकने िाला कोई अन्य संबंजधत उपकरण, चाहे िह बंि हो या चालू, प्रयोग करते हए या उसके पास पाया िाना; अथिा (xiii) परीक्षा में िाजमल होने की अनुमजत िेते हए उम्मीििार को भेिे गए प्रमाण-पत्रों के साथ िारी अनुिेिों में से दकसी का भी उल्लंघन करना; अथिा (xiv) उपयुि खंडों में उजल्लजखत सभी अथिा दकसी भी कायि के द्वारा, िैसा भी मामला हो, आयोग को अिप्रेटरत करने का प्रयत् न करना, तो िह आपराजधक अजभयोग (दक्रजमनल प्राजसक्यूिन) चलाने के साथ-साथ, जनम्न हेतु उत्तरिायी होगाीः- (क) आयोग द्वारा इन जनयमों के अन्तगित आयोजित परीक्षा, जिसमें िह उम्मीििार है, में बैठने के जलए अयोग्य ठहराना और/अथिा (ख) उसे स्ट्थायी रूप से अथिा जनर्ििष्ट अिजध के जलए- (i) आयोग द्वारा ली िाने िाली दकसी भी परीक्षा अथिा चयन से जििर्िित दकया िाएगा। (ii) केन्रीय सरकार द्वारा उसके अधीन दकसी भी नौकरी से जििर्िित दकया िाएगा। (ग) उसके जिरुद्ध उपयुक् त जनयमों के अधीन अनुिासजनक कारिाई की िा सकती है, बिते दक इस जनयम के अधीन कोई िाजस्ट्त तब तक अजधरोजपत नहीं की िाएगी िब तक: (i) उम्मीििार को इस संबंध में जलजखत अभ्यािेिन, िो िह िेना चाहे, प्रस्ट्तुत करने का अिसर न दिया िाए, और (ii) उम्मीििार द्वारा अनुमत समय में प्रस्ट्तुत अभ्यािेिन, यदि कोई हो, पर जिचार न कर जलया िाए। 8. कोई भी व्यजि, िो आयोग द्वारा उक् त खंड (i) से (xiii) में उजल्लजखत कुकृत्यों में से दकसी कुकृत्य को करने में दकसी अन्य उम्मीििार के साथ जमली-भगत का िोर्ी पाया िाता है, उसके जिरुद्ध उक् त खंड (xiv) के प्रािधानों के अनुसार कारिाई की (i) परीक्षा के उपरांत, जनिी सजचि ग्रेड में, उम्मीििारों को तीन िर्ों अथाित् 2019, 2020 और 2021 हेतु उनकी पात्रता के अध्यधीन इनमें से दकसी भी िर्ि की टरजियों के जलए जिचार दकया िाएगा और आयोग द्वारा यथाजनधािटरत परीक्षा के प्रत्येक प्रश् न-पत्र/भाग हेतु अहिक मानकों के अध्यधीन प्रत्येक उम्मीििार को अंजतम तौर पर दिए गए कुल अंकों के माध्यम से यथासूजचत योग्यता क्रम में आयोग द्वारा व्यिजस्ट्थत दकया िाएगा। तथाजप यदि श्रेणी IV, V और VII में दकसी भी िर्ि (अथाित् 2019, 2020 और 2021) में टरजियां भरी नहीं िाती हैं, तो उन्हे अगले िर्ि में अग्रनीत करने के जलए परीक्षा के पटरणाम पृथक रूप से घोजर्त दकए िाएंगे। संबंजधत चयन सूची में िाजमल करने के जलए िर्िार और श्रेणीिार मेटरि सूजचयााँ, टरजियों की संख्या और उम्मीििार द्वारा ििािई गई योग्यता और जिकल्प (िर्ि और श्रेणी की िरीयता, िैसा भी लागू हो) तथा अन्य सभी पात्रता ितों की पूर्ति पर आधाटरत होंगी। आयोग परीक्षा के दकसी भी या सभी चरणों या प्रश्न-पत्रों के जलए न्यूनतम योग्यता मानिंड जनधािटरत करने का अजधकार सुरजक्षत रखता है। यदि कोई उम्मीििार एक से अजधक जिचाराधीन िर्ों में समग्र योग्यता/अंकों के आधार पर अहिता प्राप्त कर लेगा, तो उसे टरजि की जस्ट्थजत और अन्य पात्रता ितों के अध्यधीन एिं उसकी मेटरि के आधार पर उपयुि चयन सूची िर्ि में रखा िाएगा। यदि दकसी िर्ि जििेर् हेतु चयन सूची में दकसी उम्मीििार का नाम िाजमल दकया िाता है तो अन्य सूची (सूजचयों) में उसके नाम को िाजमल करने हेतु जिचार नहीं दकया िाएगा। श्रेणी IV, V, VII और IX में उपयुि/योग्य उम्मीििारों की अनुपलब्धता के कारण दकसी भी िर्ि (2019, 2020 और 2021) में टरजियााँ भरी न िाने की जस्ट्थजत में अगले टरजि िर्ि में अग्रनीत कर िी िाएाँगी। यह प्रािधान श्रेणी VI पर लागू नहीं होगा। श्रेणी IV के जलए उपजस्ट्थत होने िाले उम्मीििारों के मामले में, सीएसएसएस जनयम, 2010 के जनयम 10(1) के परंतुक के अनुसार खाली टरजियों को अग्रनीत दकया िाएगा। श्रेणी V के जलए उपजस्ट्थत होने िाले उम्मीििारों के मामले में, केिल अनुसूजचत िाजत/अनुसूजचत िनिाजत/बेंचमाकि दिव्यांगिन (पीडब्ल्यूबीडी) श्रेणी के उम्मीििारों के जलए आरजक्षत टरजियां, िो चयजनत योग्य उम्मीििारों की अनुपलब्धता के कारण िर्ि में टरि रह गई हों, अगली परीक्षा में अग्रनीत की िाएंगी। (ii) प्रत्येक श्रेणी की चयन सूची में िाजमल दकए िाने हेतु अनुसूजचत िाजत तथा अनुसूजचत िनिाजत के उम्मीििारों सजहत, उम्मीििारों के अंजतम चयन का जनधािरण कार्मिक एिं प्रजिक्षण जिभाग के दिनांक 12.04.2022 के कायािलय ज्ञापन 36012/16/2019-स्ट्था.(आर.) के माध् यम से िारी दििा-जनिेिों के आधार पर, जििेर् अनुमजत याजचका (जसजिल) संख्या 30621/2011 से उत्पन्न जसजिल अपील संख्या 629/2022 के अंजतम जनणिय के अध्यधीन दकया िाएगा। (iii) प्रत् येक श्रेणी के जलए चयन सूची में िाजमल दकए िाने हेतु पीडब् ल् यूबीडी उम् मीििारों के अंजतम चयन का जनणिय, कार्मिक एिं प्रजिक्षण जिभाग के दिनांक 17.05.2022 के का.ज्ञा. 36012/01/2020-स्ट् था.(आरक्षण-।।) के माध् यम से िारी दििा-जनिेिों के आधार पर दकया िाएगा। (iv) पटरणाम जनम्नजलजखत जिजधयों के आधार पर तैयार दकया िाता है: (क) पूणाांकन अंक: उम्मीििारों द्वारा प्राप्त अंकों को परीक्षा के सभी चरणों में, िहााँ भी लागू हो, मानक पूणाांकन जसद्धांत को लागू करते हए, िो ििमलि अंकों तक पूणाांदकत दकया िाएगा। तिनुसार, िाई ब्रेककंग जसद्धांतों को लागू करते समय, सभी िाई संबंधी मामलों का समाधान करने के जलए िो ििमलि अंकों तक पूणाांदकत अंकों पर जिचार दकया िाएगा। (ख) िाई ब्रेककंग जसद्धांत: क) यदि कुल (अंजतम अंक) अंक समान हैं, तो जलजखत परीक्षा के कुल अंकों में अजधक अंक प्राप्त करने िाले उम्मीििार को उच्च रैंक िी िाएगी; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (ख) यदि उपयुि (क) में अंक समान हैं, तो "प्रश्नपत्र -II: भारत सरकार सजचिालय और संबद्ध कायािलयों में प्रदक्रया की पद्धजत और सेिाओं की संगत श्रेजणयों की अपेक्षा को जिजधित ध्यान में रखते हए सामान्य जित्तीय और सेिा जनयम" और "प्रश्नपत्र -III: टिप्पण और प्रारूपण, सार लेखन" को जमलाकर अजधक अंक प्राप्त करने िाले उम्मीििार को उच्च रैंक िी िाएगी; ग) यदि उपयुि (क) और (ख) के अंक भी समान हैं, तो "प्रश्नपत्र III, अथाित्, टिप्पण और प्रारूपण, सार लेखन” में अजधक अंक प्राप्त करने िाले को उच्च रैंक िी िाएगी; घ) यदि उपयुि (क), (ख), (ग) के अंक भी समान हैं, तो कम आयु िाले उम्मीििार को उच्च रैंक िी िाएगी; तथा ङ) ऐसे मामलों में िहां उपयुि िाई ब्रेककंग जसद्धांतों को लागू करने के बाि भी समान जस्ट्थजत (िाई) बनी रहती है, इसे आयोग के जििेकानुसार हल दकया िाएगा। नोि:– उम्मीििारों को यह स्ट्पष्ट रुप से समझ लेना चाजहए दक यह एक प्रजतयोगी परीक्षा है, न दक अहिक परीक्षा। परीक्षा के पटरणाम के आधार पर प्रत्येक चयन सूची में िाजमल दकए िाने िाले व्यजियों की संख्या जनयत करने के जलए सरकार पूरी तरह से सक्षम है। अत: कोई भी उम्मीििार इस परीक्षा में अपने जनष्पािन के आधार पर चयन सूची में िाजमल दकए िाने के जलए अजधकार के रूप में िािा नहीं कर सकेगा। 10. प्रत्येक उम्मीििार को परीक्षा के पटरणाम की सूचना के रूप और रीजत का जनणिय, आयोग द्वारा अपने जििेकानुसार दकया िाएगा और आयोग परीक्षा पटरणाम के बारे में दकसी भी उम्मीििार से पत्राचार नहीं करेगा। 11. परीक्षा में उत् तीणि होने मात्र से चयन का अजधकार तब तक नहीं जमलता िब तक दक सरकार यथािश्यक समझी गई ऐसी िांच के बाि संतुष्ट न हो िाए दक उम्मीििार का सेिा में आचरण िेखते हए िह चयन के जलए हर प्रकार से पात्र और योग्य है: बिते दक आयोग द्वारा चयन के जलए अनुिंजसत दकसी उम्मीििार को चयन के जलए अपात्र मानने के बारे में जनणिय आयोग के साथ परामिि करके जलया िाएगा। 12. यदि कोई उम्मीििार परीक्षा में प्रिेि के जलए आिेिन करने के बाि अथिा परीक्षा में बैठने के बाि अपनी जनयुजि से त्यागपत्र िे िेता है अथिा दकसी और कारण से सेिा छोड़ िेता है अथिा उससे संबन्ध-जिच्छेि कर लेता है, अथिा उसकी सेिा उसके जिभाग द्वारा समाप्त कर िी िाती है अथिा उसे केन्रीय सजचिालय आिुजलजपक सेिा के जनिी सजचि/रेलिे बोडि सजचिालय आिुजलजपक सेिा/सिस्त्र बल मुख्यालय आिुजलजपक सेिा अथिा भारतीय जििेि सेिा, िाखा ‘ख’ आिुजलजपक संिगि में दकसी संिगि बाह्य पि पर अथिा ‘स्ट्थानान्तरण’ पर दकसी अन्य सेिा में जनयुि कर दिया िाता है (चाहे उसके पास धारणाजधकार (जलयन) है अथिा नहीं), तो िह इस परीक्षा के पटरणाम के आधार पर जनयुजि हेतु पात्र नहीं होगा। तथाजप, यह बात उस व्यजि के मामले में लागू नहीं होती है, जिसे सक्षम प्राजधकारी के अनुमोिन से संिगि-बाह्य पि पर प्रजतजनयुजि पर जनयुि दकया गया है। [फा. सं. 4/1/2024/सीएस-II (क)] िे अिोक कुमार, संयुि सजचि 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] पटरजिष्ट परीक्षा जनम्नजलजखत योिना के अनुसार आयोजित की िाएगी :– भाग1 (क) नीचे पैरा 2 में दिए गए जिर्यों में अजधकतम 500 अंकों की जलजखत परीक्षा। (ख) जहन्िी या अंग्रेिी में 100 िब्ि प्रजत जमनि की एक अहिक आिुजलजप परीक्षा। नोि 1 – प्रजतभागी श्रेजणयों हेतु प्रजतयोगी परीक्षा में सजम्मजलत होने िाले सभी उम्मीििारों को आयोग द्वारा यथाजनधािटरत समय पर अहिक आिुजलजप परीक्षा में िाजमल होना होगा। तथाजप, केिल उन्हीं उम्मीििारों के सेिा टरकाडि का मूल्यांकन दकया िाएगा, िो उम्मीििार जलजखत परीक्षा के साथ-साथ आिुजलजप परीक्षा में भी अहिता प्राप्त कर लेते हैं। नोि 2 – उम्मीििारों को आयोग द्वारा परीक्षा केन्र (नई दिल्ली) पर मुहैया कराए गए कम्प्यूिरों (पीसी) पर अपनी आिुजलजप टिप्पजणयों का जलप्यंतरण (रांसक्राइब) करना होगा। भाग II उम्मीििारों के सेिा टरकॉडि का मूल् यांकन दकया िाएगा, जिसके अंतगित अजधकतम अंक 100 होंगे:– (i) जिन्होंने जलजखत परीक्षा तथा आिुजलजप परीक्षा में आयोग द्वारा अपने जििेक से यथाजनधािटरत न्यूनतम अहिक अंक प्राप्त दकए हैं। नोि I: सेिा टरकॉडि के मूल्यांकन (अथाित अपनी बैठक के िौरान मूल्यांकन बोडि को प्राप्त हई अजधकाटरयों की एपीएआर) में अर्िित अंकों की गणना, रैंक जनधािरण हेतु की िाएगी। मूल्यांकन बोडि द्वारा एपीएआर का एक बार मूल्यांकन दकए िाने के उपरांत, एपीएआर ग्रेसडंग आदि में दकसी पटरितिन सजहत दकसी भी पटरजस्ट्थजत में बाि में दकसी भी तारीख को इसके पुनीः मूल्यांकन हेतु दकसी भी अनुरोध पर जिचार नहीं दकया िाएगा। नोि II: सेिा टरकॉडि के मूल्यांकन में न्यूनतम 40% (चालीस प्रजतित) अंक होने चाजहए। इसजलए, सेिा टरकॉडि के मूल्यांकन में 40% (चालीस प्रजतित) से कम अंक प्राप्त करने िाले उम्मीििारों के नामों पर रैंक जनधािरण हेतु जिचार नहीं दकया िाएगा। 2. सेिा की जिजभन्न श्रेजणयों के प्रजतयोगी उम्मीििारों को जनम्नजलजखत जिर्यों की जलजखत परीक्षा में िाजमल होना होगा:– प्रश् न पत्र सं. जिर्य प्रश् न पत्र का भारत का रािपत्र : असाधारण 11 3. टिप्पण एिं प्रारूपण, सार लेखन जिर्यपरक 200 3 घंिे सेिा टरकॉडों का मूल्यांकन 100 कुल अंक 600 3. गलत उत्तरों के जलए पेनल् िी (िस्ट्तुजनष्ठ प्रकार के प्रश्न पत्रों में) िस्ट्तुजनष्ठ प्रकार के प्रश्न पत्रों में उम्मीििार द्वारा अंदकत दकए गए गलत उत्तरों के जलए पेनल् िी (ऋणात्मक अंकन) लगाई िाएगी। (i) प्रत्येक प्रश्न के उत्तर के जलए चार जिकल्प होंगे। उम्मीििार द्वारा प्रत्येक प्रश्न के जलए गलत उत्तर दिए िाने पर उस प्रश्न के जलए जनर्ििष्ट अंकों में से पेनल् िी के रूप में एक जतहाई अंकों की किौती की िाएगी। (ii) यदि कोई उम्मीििार दकसी प्रश्न के एक से ज्यािा उत्तर िेता है, तो इसे गलत उत्तर माना िाएगा, चाहे दिए गए उत्तरों मे से एक सही भी हो तथा उस प्रश्न के जलए भी उपयुि के समान पेनल् िी होगी । (iii) यदि दकसी प्रश्न को खाली छोड़ दिया िाता है, अथाित् उम्मीििार द्वारा कोई उत्तर नहीं दिया िाता है तो उस प्रश्न के जलए कोई पेनल् िी नहीं लगाई िाएगी। 4. परीक्षा के जलए पाठ्यक्रम, अनुसूची में ििािए गए अनुसार होगा। 5. उम्मीििारों को टिप्पण एिं प्रारूपण और सार लेखन प्रश् न-पत्र के उत्तर, सहंिी (िेिनागरी) या अंग्रेिी में िेने का जिकल्प होगा। तीनों प्रश्नपत्र/परीक्षा पुजस्ट्तकाएं अंग्रेिी तथा सहंिी, िोनों में होंगी। नोि 1:– टिप्पण एि प्रारूपण तथा सार लेखन प्रश् न-पत्र के उत्तर जहन्िी (िेिनागरी) में िेने के जिकल्प का उपयोग करने िाले उम्मीििारों को अपनी इस इच् छा का उल्लेख ऑनलाइन आिेिन के संगत कालम में करना चाजहए; अन् यथा यह समझा िाएगा दक िे उपयुि प्रश्न पत्रों के उत्तर अंग्रेिी में ही िेंगे। एक बार दिया गया जिकल्प अंजतम माना िाएगा और उि कालम में पटरितिन करने के जलए दकसी भी अनुरोध पर जिचार नहीं दकया िाएगा। नोि 2:– प्रश्न पत्र के उत्तर जहन्िी (िेिनागरी) में जलखने िाले उम्मीििार, यदि चाहें तो, जहन्िी की िब्िािली के साथ तकनीकी िब्िों के अंग्रेिी पयािय, यदि कोई हो, भी कोष्ठक में िे सकते हैं। नोि 3:– यदि उम्मीििार द्वारा आिेिन प्रपत्र में जनर्ििष्ट दकए गए माध्यम से इतर माध्यम का परीक्षा में उत्तर जलखने में प्रयोग दकया िाता है तो ऐसे उम्मीििारों के प्रश्न पत्र का मूल्यांकन नहीं दकया िाएगा। 6. अंग्रेिी/जहन्िी की आिुजलजप परीक्षा में 100 िब्ि प्रजत जमनि की गजत से िस जमनि का श्रुतलेख िाजमल होगा, जिसे उम्मीििारों को 40/55 जमनि में जलप्यंतरण (रांसक्राइब) करना होगा। 7. (i) उम्मीििारों को प्रश्नों के उत्तर स्ट्ियं जलखने होंगे। दकसी भी पटरजस्ट्थजत में उन्हें उत्तर जलखने के जलए स्ट्क्राइब की सहायता लेने की अनुमजत नहीं िी िाएगी। िृजष्टहीन, (लोकोमोिर) दिव्यांगता (िोनों भुिाएं प्रभाजित - बीए) तथा प्रमजस्ट्तष्कीय पक्षाघात श्रेजणयों के अंतगित बेंचमाकि दिव्यांग व्यजियों को स्ट्क्राइब की सुजिधा, मांग दकए िाने पर प्रिान की िाएगी। आरपीडब्ल्यूडी अजधजनयम, 2016 की धारा 2 (आर) के अंतगित यथापटरभाजर्त बेंचमाकि दिव्यांगताओं की अन्य 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] श्रेजणयों िाले व्यजियों को संलग् नक-I पर दिए गए प्रपत्र के अनुसार दकसी सरकारी स्ट्िास्ट्थ्य पटरचयाि संस्ट्था के मुख्य जचदकत्सा अजधकारी/जसजिल सििन/जचदकत्सा अधीक्षक द्वारा िारी इस आिय का प्रमाण पत्र प्रस्ट्तुत दकए िाने पर दक संबंजधत व्यजि जलखने में िारीटरक रूप से अक्षम है तथा उसकी ओर से परीक्षा जलखने के जलए स्ट्क्राइब की सेिाएं लेना अजनिायि है, स्ट्क्राइब की सुजिधा प्रिान की िाएगी। इसके अजतटरि, जिजिष्ट दिव्यांगता िाले उन व्यजियों, िो आरपीडब्ल्यूडी अजधजनयम, 2016 की धारा 2(एस) की पटरभार्ा के अंतगित िाजमल हैं परंतु उि अजधजनयम की धारा 2(आर) की पटरभार्ा के अंतगित िाजमल नहीं हैं अथाित् 40% से कम दिव्यांगता िाले व्यजियों तथा जिन्हें जलखने में कटठनाई होती है, को संलग् नक III में दिए गए प्रपत्र के अनुसार सरकारी स्ट्िास्ट्थ्य पटरचयाि संस्ट्था के सक्षम जचदकत्सा प्राजधकारी से प्राप्त इस आिय का प्रमाण-पत्र, दक संबंजधत व्यजि की लेखन क्षमता प्रभाजित है तथा इनके परीक्षा जलखने के जलए स्ट्क्राइब अजनिायि है, प्रस्ट्तुत करने के अध्यधीन, स्ट्क्राइब की सुजिधा प्रिान की िाएगी। (ii) उम्मीििार को अपना स्ट्क्राइब लाने या आयोग को इसके जलए अनुरोध करने का जििेकाजधकार है। ऑनलाइन आिेिन करते समय संलग् नक–II (जिन उम्मीििारों की दिव्यांगता 40% या अजधक है) तथा संलग् नक-IV (जिन उम्मीििारों की दिव्यांगता 40% से कम है एिं जलखने में कटठनाई होती है) के प्रपत्र के अनुसार स्ट्क्राइब का जििरण अथाित् अपना या आयोग का और यदि उम्मीििार अपना स्ट्क्राइब लाना चाहते हैं, तो उस स्ट्क्राइब का जििरण मांगा िाएगा। (iii) आयोग द्वारा उपलब्ध कराए गए स्ट्क्राइब के साथ-साथ स्ट्ियं के स्ट्क्राइब की योग्यता, परीक्षा के जलए जनधािटरत न्यूनतम योग्यता मानिंड से अजधक नहीं होगी। तथाजप, स्ट्क्राइब की योग्यता सिैि मैटरक अथिा इससे अजधक होनी चाजहए। (iv) िृजष्टहीनता, लोकोमोिर दिव्यांगता (िोनों भुिाएं प्रभाजित - बीए) और प्रमजस्ट्तष्कीय पक्षाघात श्रेजणयों के अंतगित बेंचमाकि दिव्यांग उम्मीििारों को परीक्षा के प्रत्येक घंिे हेतु बीस (20) जमनि प्रजतपूरक समय प्रिान दकया िाएगा। बेंचमाकि दिव्यांगता की अन्य श्रेजणयों के उम्मीििारों को संलग् नक-I में दिए गए प्रपत्र के अनुसार, दकसी सरकारी स्ट्िास्ट्थ्य पटरचयाि संस्ट्था के मुख्य जचदकत्सा अजधकारी/जसजिल सििन/जचदकत्सा अधीक्षक द्वारा िारी इस आिय का प्रमाण-पत्र दक संबंजधत उम्मीििार जलखने में िारीटरक रूप से अक्षम है, प्रस्ट्तुत दकए िाने पर यह सुजिधा प्रिान की िाएगी। इसके अजतटरि, जिजिष्ट दिव्यांगता िाले उन व्यजियों िो आरपीडब्ल्यूडी अजधजनयम, 2016 की धारा 2(एस) की पटरभार्ा के अंतगित िाजमल हैं परंतु उि अजधजनयम की धारा 2(आर) की पटरभार्ा के अंतगित िाजमल नहीं हैं अथाित् 40% से कम दिव्यांगता िाले व्यजियों तथा जिन्हें जलखने में कटठनाई होती है, को संलग् नक-III पर दिए गए प्रपत्र के अनुसार सरकारी स्ट्िास्ट्थ्य पटरचयाि संस्ट्थान के सक्षम जचदकत्सा प्राजधकारी से प्राप्त इस आिय का प्रमाण-पत्र, दक संबंजधत व्यजि को जलखने में बाधा आती है, प्रस्ट्तुत करने के अध्यधीन, प्रजतपूरक समय प्रिान दकया िाएगा। (v) पात्र उम्मीििार को स्ट्क्राइब की सुजिधा और/अथिा प्रजतपूरक समय उनके द्वारा मांग दकए िाने पर केिल जलजखत परीक्षा के जलए ही प्रिान दकया िाएगा। नोि (1): दकसी स्ट्क्राइब की पात्रता की ितें तथा परीक्षा हॉल के अंिर स्ट्क्राइब का आचरण तथा आिुजलजपक (समूह ख/ग्रेड I) सीजमत जिभागीय प्रजतयोगी परीक्षा (एलडीसीई) में उत्तर जलखने में बेंचमाकि दिव्यांग उम्मीििार की सहायता कर सकने की रीजत और सीमा का जनयमन, संघ लोक सेिा आयोग द्वारा इस संबंध में िारी अनुिेिों के अनुसार दकया िाएगा। इन सभी या इनमें से दकसी एक अनुिेि का उल्लंघन होने पर संघ लोक सेिा आयोग बेंचमाकि दिव्यांगता िाले उम्मीििार की उम्मीििारी रद्द करने के साथ-साथ स्ट्क्राइब के जिरूद्ध अन्य कारिाई भी कर सकता है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 नोि (2): िृजष्ट बाधा का प्रजतित जनधािटरत करने के जलए मानिंड जनम्नानुसार होंगेीः- आंख और बेहतर करना आंख उत् तम तरीके से ठीक करना दिव्यांगता प्रजतित दिव्यांगता श्रेणी 1 2 3 4 6/6 से 6/18 6/6 से 6/18 0% 0 6/24 से 6/60 10% 0 6/60 से कम से लेकर 3/60 तक 20% I 3/60 से कम कोई प्रकाि अिबोधन नहीं 30% II (एक आंख िाला व्यजि) 6/24 से 6/60 अथिा जनधािरण (दफक् सेिन) के केन् र के चारों तरफ िृश् य क्षेत्र 40 से कम से लेकर 20 जडग्री तक अथिा मैक् युला सजहत होजमनाओजपया 6/24 से 6/60 40% IIIक (अल्प िृजष्ट) 6/60 से कम से लेकर 3/60 तक 50% III ख (अल्प िृजष्ट) 3/60 से कम से लेकर कोई प्रकाि अिबोधन नहीं तक 60% III ग (अल्प िृजष्ट) 6/60 से कम से लेकर 3/60 तक अथिा जनधािरण (दफक् सेिन) के केन् र के चारों ओर िृश्य क्षेत्र 20 से कम से लेकर 10 जडग्री तक 6/60 से कम से लेकर 3/60 तक 70% III घ (अल्प िृजष्ट) 3/60 से कम से लेकर कोई प्रकाि अिबोधन नहीं तक 80% III ड. Category IV Private Secretary Grade of the Central Secretariat Stenographers’ Service. Category V Private Secretary Grade of the Stenographers’ Cadre of the Indian Foreign Service, Branch ‘B’ [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 Category VI Private Secretary of the Armed Forces Headquarters Stenographers’ Service. Category VII Grade ‘B’/Private Secretary Grade of the Railway Board Secretariat Stenographers’ Service. Category IX Private Secretary Grade in Employees’ State Insurance Corporation 1. The number of persons to be selected for inclusion in the Select List for each grade/service will be specified in the Notice issued by the Commission. Final Selection of the candidates under different categories shall be decided and results will be declared inter alia based on the guidelines issued by the Department of Personnel & Training vide O.M. No. 36012/16/2019-Estt (Res.) dated 12.04.2022 subject to the final outcome of the following court cases:- I. Length of Service: He/she should have rendered not less than three years' of approved and continuous service in the grade mentioned in Column 1: Provided that if he/she had been appointed to the Personal Assistant of the Central Secretariat Stenographers' Service on the results of the competitive examination including a Limited Departmental Competitive Examination, such an examination should have been held not less than three years before the crucial date and he/she should have rendered not less than two years approved and continuous service in that grade. ii. Personal Assistants who are on deputation to ex-cadre posts with the approval of the competent authority shall be eligible to be admitted to the examination, if otherwise eligible: Provided that the Personal Assistant who has been appointed to an ex-cadre post or to another service on 'transfer' and does not have a lien in Personal Assistant shall not be eligible to be Category IV 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] admitted to the examination. However, following relaxations in eligibility conditions are granted to Personal Assistants appointed through Seniority Quota (SQ) / Limited Departmental Competitive Examination (LDCE) Quota:- a. Relaxation in continuous service in PA Grade upto1 year and 6 months in respect of PAs belonging to SQ for SLY- 2016, 2017 and 2018. b. Relaxation in continuous service of 02 months and 02 days shortfall in duration between conduct of LDCE examination and the crucial date of eligibility in respect of PAs belonging to LDCE Quota for the SLY 2016. Personal Assistant Grade of the Stenographers’ Cadre of the Indian Foreign Service Branch ‘B’ Not less than 5 years approved service in the Personal Assistant Grade of the Stenographers’ Cadre and shall possess a Bachelor Degree of a recognized University. Further, candidates should have completed such mandatory training programme(s) as may be prescribed by the Ministry of External Affairs. Relaxation of one (01) year in the 5 years approved service is granted to PAs of 2015 batch for appearing in PS LDCE 2021 (as per Ministry Order No. Q/CAD/611/02/2023 dated 06.10.2023) Further, the inclusion of candidates in the select list of respective years will be subject to any judicial directive/judgement having a bearing upon the recruitment/seniority in the Private Secretary Grade of the Stenographers Cadre of IFS Branch 'B'. Category V Grade C of Armed Forces Headquarters Stenographer’s service Not less than 3 years’ approved and continuous service in Grade II/Grade C of the Armed Forces Headquarters Stenographers' Service. Provided that if he/she had been appointed to Grade C of the service on the result of a Competitive Examination including a Limited Departmental Competitive Examination, such an examination should have been held not less than 3 years before the crucial date and he/she should have rendered not less than 2 years approved and continuous service in that grade on the crucial date. Category VI Grade C/Personal Assistants Grade of the Railway Board Secretariat Stenographer’ Service For Select List Year 2019 and 2020: (i) Length of Service: Not less than 5 years’ approved and continuous service in Grade II/ Grade C /Personal Assistant of the Railway Board Secretariat Stenographers’ Service. "Provided that if he/she had been appointed to Grade ‘C’ of Railway Board Secretariat Stenographers' Service on the results of a competitive examination, including a Limited Departmental Competitive Examination, the results of such examination should have been announced not less than five years before the crucial date and he/she should have rendered not less than four years approved and continuous service in the grade.” However, relaxation to the extent of 2 months to the requisite 5 years gap between the date of result and crucial date of eligibility is granted in respect of Personal Assistants promoted through Stenographer Grade C' Limited Departmental Competitive Examination 2014 to make them eligible for appearing in the examination for the year 2019. Further, relaxation of 11 months to the requisite 5 years gap between the date of results and crucial date of eligibility is granted in respect of Personal Assistants promoted through Stenographers Grade 'C' Limited Departmental Competitive Examination 2015 to make them eligible for appearing in the examination for the year 2020. Category VII [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 21 (ii) Grade C officers who are on deputation to ex-cadre post shall be eligible to be admitted to the examination if they are otherwise eligible. Provided that it shall not apply to a Grade C officer who has been appointed to an ex-cadre post or to another service on “transfer” and does not have lien to Grade C. For Select List Year 2021: (i) Length of Service: Not less than 3 years' approved and continuous service in Personal Assistants' Grade and shall possess a Bachelor's Degree from a recognized University, on the crucial date. Provided that if he/she had been appointed to the Personal Assistant Grade of the Railway Board Secretariat Stenographers' Service on the results of a competitive examination, including a Limited Departmental Competitive Examination, such an examination should have been held not less than three years before the crucial date and he/she should have rendered not less than two years approved and continuous in that grade on the crucial date. (ii) Personal Assistants who are on deputation to ex-cadre post with the approval of the competent authority shall be eligible to be admitted to the examination if otherwise eligible: Provided that the Personal Assistant who has been appointed to an ex- cadre post or to another service on ‘transfer’ and does not have a lien in Personal Assistant grade shall not be eligible to be admitted to the examination. Personal Assistants in Employees’ State Insurance Corporation Not less than 3 years’ approved and continuous service in Personal Assistants Grade in Employees’ State Insurance Corporation Category IX Note 1 - Permanent or regularly appointed officers of the Grades and Services mentioned in Column 1 above who are on deputation to ex-cadre posts for a specified period with the approval of the competent authority will be eligible to be admitted to the examination, if otherwise eligible and the service rendered by them during the period of deputation will qualify towards the length of service mentioned in column 2. This, however, does not apply to the officers of the Grades and Services mentioned in Column 1 above who have been appointed to ex-cadre posts or to another Service on “transfer” (whether they have a lien or not) in their respective Grades and Services referred to in Column 1(except Category-VII). In respect of Category IV, if an official tenders technical resignation and rejoins his/her substantive post during the lien period, the period spent in another Department which he/she had joined after submitting his/her technical resignation will not count for qualifying service for appearing in PS LDCE. Note 2 - Stenographers of the Central Secretariat Stenographers’ Service who are on deputation to the Indian Foreign Service, Branch ‘B’ shall not be eligible for admission to the examination for Category V. Note 3- All the candidates expecting completing requisite eligibility given above on crucial date can apply for the examination. 4. After the notification of the rules of the examination in the Gazette of India by the Department of Personnel & Training and publication of Notice of Examination by the Commission, a candidate shall have to fill in the Application Form on-line on the website of the Commission and the hard copy of the same be routed, through proper channel, after due verification/authentication of the information furnished by the candidate in his/her application form from his/her service records by the cadre unit concerned, to the Cadre Controlling Authority of the participating service concerned for determination of the eligibility of the candidate and 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] onward transmission of the application of the eligible candidate to the Commission. The Scrutiny of the application for determining eligibility of a candidate, with reference to the eligibility conditions stipulated in these rules, shall be done by the Cadre Controlling Authority of the participating service concerned. 5. Notwithstanding anything contained in rule 4, the decision of the Commission with regard to acceptance, or otherwise, of the application of a candidate, for admission to the Examination, shall be final. 6. No candidate will be admitted to the examination unless he/she holds certificate of admission from the Commission. 7. A candidate who is or has been declared by the Commission to be guilty of:- (i) Obtaining support for his candidature by the following means, namely:- a. Offering illegal gratification to; or b. Applying pressure on; or c. Blackmailing, or threatening to blackmail any person connected with the conduct of the examination; or (ii) impersonation, or (iii) procuring impersonation by any person, or (iv) submitting fabricated document or documents which have been tampered with, or (v) uploading irrelevant photos in the application form in place of actual photo/signature. (vi) making statements which are incorrect or false or suppressing material information, or (vii) resorting to the following means in connection with his candidature for the examination, namely:- (a) obtaining copy of question paper through improper means; (b) finding out the particulars of the persons connected with secret work relating to the examination; (c) influence the examiners; or (viii) being in possession of or using unfair means during examination, or (ix) writing obscene matter or drawing obscene sketches or irrelevant matter in the script(s), or (x) misbehaving in the examination hall including tearing of the scripts, provoking fellow examinees to boycott examination, creating a disorderly scene and the like; or (xi) harassing or doing bodily harm to the staff employed by the commission for the conduct of their examination, or (xii) being in possession of or using any mobile phone, (even in switched off mode), pager or any electronic equipment or programmable device or storage media like pen drive, smart watches etc. or camera or Bluetooth devices or any other equipment or related accessories either in working or switched off mode capable of being used as a communication device during the examination; or (xiii) violating any of the instructions issued to candidates along with their Admission Certificates permitting them to take the examination, or (xiv) attempting to commit or, as the case may be, abetting the Commission of all or any of the acts specified in the foregoing clauses; may, in addition to rendering himself liable to criminal prosecution, be liable :- (a) to be disqualified by the Commission from the Examination held under this Rules for which he/she is a candidate, and/or (b) to be debarred either permanently or for a specified period- (i) by the Commission from any examination or selection held by them ; (ii) by the Central Government from any employment under them; and (c) to disciplinary action under the appropriate rules. Provided that no penalty under this rule shall be imposed except after- i. giving the candidate an opportunity of making such representation in writing as he may wish to make in that behalf ; and ii. taking the representation, if any submitted by the candidate within the period allowed to him, into consideration. 8. Any person who is found by the Commission to be guilty of colluding with a candidate(s) in committing or abetting the commission of any of the misdeeds listed at the clauses (i) to (xiii) above render himself liable to action in terms of the clause (xiv). [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 23 9. (i) After the examination, candidates shall be considered for vacancies for three years i.e. 2019, 2020 and 2021 in Private Secretary Grade subject to their eligibility for the any of the years and will be arranged by the Commission in the order of merit as disclosed by the aggregate marks finally awarded to each candidate subject to qualifying standards for each paper/part of the examination as decided by the Commission. However, the results shall be declared separately to ensure that if vacancies remain unfilled in any of the years (i.e. 2019, 2020 and 2021), the same are carried forward to next vacancy year for Category IV, V and VII. Year wise and Category wise merit lists for inclusion in the respective Select List will be based on the number of vacancies and candidate’s merit and choice (preference of year and category, as applicable) as indicated by the candidate and fulfilment of all other eligibility conditions. The Commission reserves the right to fix minimum qualifying standards for any or all stage(s) or paper(s) of the Examination. Where a candidate would have otherwise qualified on the basis of aggregate merit/marks in more than one year of consideration, he will be placed in the appropriate Select List Year on the basis of his/her merit and subject to vacancy position and other eligibility conditions. If a candidate's name is included in the Select List for a particular year, his/her name will not be considered for inclusion in other list(s). Vacancies remaining unfilled in any of the years (2019, 2020 and 2021) due to non-availability of suitable/qualified candidates, will be carried forward to the next Vacancy year for Category IV, V, VII, and IX. This provision will not be applicable for Category VI. In the case of candidates appearing for Category IV, the unfilled vacancies will be carried forward in terms of Proviso to Rule 10(1) of CSSS Rules, 2010. In case of candidates appearing for category V, only vacancies reserved for SC/ST/Persons with Benchmark Disability (PwBD) Category candidates remaining unfilled in the year due to non-availability of selected /qualified candidates will be carried forward to the next examination. (ii) The final selection of the candidates including candidates belonging to the Scheduled Castes and the Scheduled Tribes for inclusion in the Select List for each category will be decided based on the guidelines issued by the Department of Personnel & Training vide OM 36012/16/2019-Estt. (Res.) dated 12.04.2022 subject to the final outcome of the Civil Appeal No. 629 of 2022 arising out of SLP(C) No. 30621/2011. iii) The final selection of the PwBD candidates for inclusion in the Select List for each category will be decided based on the guidelines issued by the Department of Personnel & Training vide OM 36012/01/2020-Estt. (Res.-II) dated 17.05.2022 (iv) The result is prepared on the basis of the following methods: (A) Rounding Off Marks: Marks obtained by the candidates shall be rounded off up to two decimal digits, at all stage(s) of the examination, by applying the standard rounding off principle, wherever applicable. Accordingly, while applying the Tie Breaking Principles, the rounded off marks up to two decimal digits shall be considered for resolving all tie cases. (B) Tie Breaking Principles: (a) If the marks in the aggregate (Final Marks) are equal, the candidate securing more marks in the written total will be ranked higher; (b) If the marks at (a) above are equal, the candidate securing more marks in “Paper-II : Procedure of Practice in the Govt. of India Secretariat and attached Offices and General Financial and Service Rules duly taking into account the requirement of relevant categories of services” and “Paper-III : Noting and Drafting, Precis Writing” put together will be ranked higher; (c) If the marks at (a) and (b) above are also equal, then the candidate securing more marks in “Paper-III, i.e., Noting & Drafting, Precis Writing” will be ranked higher. (d) If the marks at (a), (b), (c) above are also equal, then the candidate younger in age will be ranked higher; and (e) In cases where a tie persists even after applying the above tie breaking principles, it will be resolved at the discretion of the Commission. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Note: - Candidate should clearly understand that this is a competitive and not a qualifying examination. The number of persons to be included in each Select List on the result of the examination is entirely within the competence of Government to decide. No candidate will therefore have any claim for inclusion in the Select List on the basis of his performance in this Examination as a matter of right. 10. The form and manner of communication of the result of the examination to individual candidates shall be decided by the Commission in their discretion and the Commission will not enter into correspondence with them regarding the result. 11. Success in the examination confers no right to selection unless Government is satisfied after such enquiry as may be considered necessary, that the candidate, having regard to his conduct in service, is eligible and suitable in all respects for selection: Provided that the decision as to ineligibility for selection in the case of any candidate recommended for selection by the Commission shall be taken in consultation with the Commission. 12. A candidate who after applying for admission to the examination or after appearing at it, resigns his appointment or otherwise quits the service or severs his connection with it or whose services are terminated by his Department or who is appointed to an ex-cadre post or to another Service on ‘transfer’ (whether they have a lien or not) in the Personal Assistant of the Central Secretariat Stenographers’ Service/Railway Board Secretariat Stenographers’ Service/Stenographers’ Cadre of the Indian Foreign Service Branch ‘B’/ Armed Forces Headquarters Stenographers’ Service will not be eligible for appointment on the result of this examination. APPENDIX The examination shall be conducted according to the following plan:- Part I (a) Written examination carrying maximum of 500 marks in the subjects as shown in para 2 below. (b) A qualifying Shorthand test in Hindi or English at 100 w.p.m. Note 1: All the candidates competing for participating Categories will be required to take qualifying shorthand test at the time as may be decided by the Commission. However, evaluation of record of service will be done of only those candidates who qualify both in the written examination as well as in the Shorthand Test. Note 2: Candidates will be required to transcribe their shorthand notes on Computers (PCs) which will be provided at the Examination centre (New Delhi) by the Commission. Part II Evaluation of record of service carrying a maximum of 100 marks of candidates:- (i) who obtain such minimum qualifying marks in the written examination and the shorthand test as may be fixed by the Commission in their discretion. Note 1: Marks obtained in evaluation of record of service (i.e. APARs of the officers available to the Assessment Board at the time of its meeting) will be counted for ranking. Once the APARs have been evaluated by the Assessment Boards, no request for its reassessment will be entertained under any circumstances including a change in APAR grading, etc. at a subsequent date. Note 2: There shall be a minimum of 40% (forty percent) marks in the evaluation of record of service. Therefore, such candidates who obtain less than 40% (forty percent) marks in the evaluation of record of service will not be considered for ranking. Penalty for wrong answers (in Objective Type Papers) THERE WILL BE PENALTY (NEGATIVE MARKING) FOR WRONG ANSWERS MARKED BY A CANDIDATE IN THE OBJECTIVE TYPE QUESTION PAPERS. (i) There are four alternatives for the answer to every question. For each question for which a wrong answer has been given by the candidate, one third of the marks assigned to that question will be deducted as penalty. (ii) If a candidate gives more than one answer, it will be treated as a wrong answer even if one of the given answers happens to be correct and there will be same penalty as above for that question. (iii) If a question is left blank, i.e., no answer is given by the candidate, there will be no penalty for that question. 4. Syllabi for the Examination will be as shown in the schedule. 5. Candidates are allowed the option to answer the Noting and Drafting, Precis Writing paper either in Hindi (Devanagari) or in English. All the three question papers/test booklets will be set both in Hindi and English. Note 1: Candidates desirous of exercising the option to answer the Noting and Drafting, Precis Writing paper in Hindi (Devanagari) should indicate their intention to do so in relevant column of on-line Application Form; otherwise it would be assumed that they would answer the aforesaid paper in English. The option once exercised shall be treated as final and no request for alteration in the said column shall be entertained. Note 2: Candidates exercising the option to answer the paper in Hindi (Devanagari) may, if they so desire, give English version within brackets of the description of the technical terms, if any, in addition to the Hindi version. Note 3: If a medium other than the one indicated by the candidate in the application form is used to write the answer in the examination, the paper of such candidates will not be evaluated. 6. The shorthand test in English/Hindi would comprise dictation test at the speed of 100 words per minute of ten minutes which the candidate will be required to transcribe in 40/55 minutes. 7. (i) Candidates must write the papers in their own hand. In no circumstances will they be allowed the help of a scribe to write the answers for them. The Persons with Benchmark Disabilities in the categories of blindness, locomotor disability (both arm affected – BA) and cerebral palsy will be provided the facility of scribe, if desired by the person. In case of other category of Persons with Benchmark Disabilities as defined under section 2 (r) of the RPWD Act, 2016, the facility of scribe will be allowed to such candidates on production of a certificate to the effect that the person concerned has physical limitation to write, and scribe is essential to write examination on behalf, from the Chief Medical Officer/Civil Surgeon/Medical Superintendent of a Government Health Care institution as per proforma at Annexure-I. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Further, for persons with specified disabilities covered under the definition of Section2(s) of the RPwD Act, 2016 but not covered under the definition of Section2(r) of the said Act, i.e. persons having less than 40% disability and having difficulty in writing will be provided the facility of scribe subject to production of a certificate to the effect that person concerned has limitation to write and that scribe is essential to write examination on his/her behalf from the competent medical authority of a Government healthcare institution as per proforma at Annexure – III. (ii) The candidates have discretion of opting for their own scribe or request the Commission for the same. The details of scribe i.e. whether own or the Commission’s and the details of scribe in case candidates are bringing their own scribe, will be sought at the time of filling up the application form online as per proforma at Annexure-II (for candidates having 40% disability or more) and Annexure-IV (for candidates having less than 40% disability and having difficulty in writing). (iii) The qualification of the Commission’s scribe as well as own scribe will not be more than the minimum qualification criteria of the examination. However, the qualification of the scribe should always be matriculate or above. (iv) The Persons with Benchmark Disabilities in the category of blindness, locomotor disability (both arms affected- BA) and cerebral palsy will be allowed Compensatory Time of twenty minutes per hour of the examination. In case of other categories of Persons with Benchmark Disabilities, this facility will be provided on production of a certificate to the effect that the person concerned has physical limitation to write from the Chief Medical Officer/Civil Surgeon/Medical Superintendent of a Government Health Care institution as per proforma at Annexure-I. Further, for persons with specified disabilities covered under the definition of Section 2(s) of the RPwD Act, 2016 but not covered under the definition of Section 2(r) of the said Act, i.e. persons having less than 40% disability and having difficulty in writing will be provided compensatory time subject to production of a certificate to the effect that person concerned has limitation to write from the competent medical authority of a Government healthcare institution as per proforma at Annexure-III. (v) Facility of Scribe and/or Compensatory time to eligible candidates will be provided for written exam only, if desired by them. Note (1): The eligibility conditions of a scribe and the conduct of scribe inside the examination hall and the manner in which and extent to which the scribe can help the Persons with Benchmark Disabilities (PwBD) candidate in writing the Stenographers’ (Gr.B/Gr.I) LDCE shall be governed by the instructions issued by the UPSC in this regard. Violation of all or any of the said instructions shall entail the cancellation of the candidature of the Persons with Benchmark Disabilities (PwBD) candidate in addition to any other action that the UPSC may take against the scribe.
