L.-33004/99 xxxGIDHxxx xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण् ड (i) PART II—Section 3—Sub-section (i) प्राजधकार से प्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् मसौदा अजधसूचना नई ददल्ली, 3 अप्रैल, 2026 सा.का.जन. 252(अ).—पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3, 6 और 25 द्वारा प्रदत्त िजिर्ों का प्रर्ोग करते हुए, केंद्रीर् सरकार द्वारा पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के तहत िनसाधारण तथा संभाजवत रूप से प्रभाजवत अन्र् जहतधारकों की सूचना के जलए जनम्नजलजखत मसौदा जनर्म बनाए िाते हैं; तथा एतद् द्वारा र्ह सूजचत दकर्ा िाता है दक रािपत्र में जनजहत उि मसौदा अजधसूचना पर जवचार, रािपत्र की प्रजतर्ां िनसाधारण के जलए उपलब्ध कराए िाने की जतजथ से साठ ददनों की अवजध समाप्त होने पर, अथवा उसके बाद दकर्ा िाएगा। र्दद मसौदा अजधसूचना में जनजहत प्रस्ट्तावों पर कोई भी व्यजि आपजत्तर्ााँ र्ा सुझाव प्रस्ट्तुत करने में रुजच रखता हो तो वे जलजखत रूप में केंद्रीर् सरकार के जवचाराथा,उपर्ुाि जनर्दाष्ट अवजध के भीतर, सजचव, पर्ाावरण, वन एवं िलवार्ु पररवतान मंत्रालर्, इंददरा पर्ाावरण भवन, िोर बाग रोड, नई ददल्ली – 110003 को भेि सकते है अथवा उन्हें ई-मेल पते sahnk@cag.gov.in तथा amit.vashishtha@nic.in पर प्रेजित कर सकते है। 1. संजक्षप्त िीिाक और प्रारंभ (i) इन जनर्मों को टार-बॉल्स प्रबंधन जनर्म, 2026 कहा िाएगा। (ii) र्े जनर्म रािपत्र में अंजतम अजधसूचना के प्रकािन की जतजथ से एक विा पश्चात प्रभावी होंगे। सं. 232] नई ददल्ली, िुक्रवार, अप्रैल 3, 2026/ चैत्र 13, 1948 No. 232] NEW DELHI, FRIDAY, APRIL 3, 2026/ CHAITRA 13, 1948 सी.जी.-डी.एल.-अ.-04042026-271565 CG-DL-E-04042026-271565 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. प्रर्ोिन : (i) र्े जनर्म उन सभी व्यजिर्ों पर लागू होंगे िो दकसी भी प्रकार से टार-बॉल्स का उत्पादन, संग्रहण, प्राजप्त, भंडारण, पररवहन, िोधन, जनपटान र्ा प्रबंधन करते हैं; इसमें तेल जनष्किाण एवं अन्वेिण सुजवधाएाँ, िहाज़, तेल टैंकर, तेल प्रजतष्ठान के माजलक अथवा इससे संबंजधत अजधकृत व्यजि सजममजलत हैं। 3. पररभािाएाँ — (1) इन जनर्मों में, िब तक दक संदभा अन्र्था अपेजक्षत न हो, क) “अजधजनर्म" से अजभप्रार् पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) है; ख) “प्राजधकार" से अजभप्रार् उस अनुमजत से है िो जनर्दाष्ट प्राजधकरण द्वारा इन जनर्मों और केंद्रीर् सरकार द्वारा िारी दकसी भी ददिा-जनदेि के अनुसार टार-बॉल्स के संग्रहण, प्राजप्त, भंडारण, पररवहन, िोधन, जनपटान तथा/र्ा दकसी अन्र् प्रकार के प्रबंधन हेतु दी गई अनुमजत है। ग) "अजधकृत व्यजि" से अजभप्रार् उस अजधभोगी र्ा संचालक से है जिसे जनर्दाष्ट प्राजधकरण द्वारा इन जनर्मों और केंद्रीर् सरकार द्वारा िारी दकसी भी ददिा-जनदेि के अनुसार टार-बॉल्स के संग्रहण,प्राजप्त,भंडारण,पररवहन,िोधन,जनपटान तथा/र्ा प्रबंधन हेतु अजधकृत दकर्ा गर्ा हो; घ) "सह-प्रसंस्ट्करण" से अजभप्रार् उन टार-बॉल्स के उपर्ोग से है जिनका ऊष्मीर् मान 1500 दकलो कैलोरी से अजधक हो, जिन्हें कच्चे माल के रूप में अथवा ऊिाा के स्रोत के रूप में अथवा दोनों रूपों में प्राकृजतक खजनि संसाधनों अथवा िीवाश्म ईंधनों के स्ट्थान पर अथवा उनके पूरक के रूप में औद्योजगक प्रदक्रर्ाओं में प्रर्ुि दकर्ा िाता है, जविेिकर ऊिाा-गहन उद्योगों िैसे सीमेंट उत्पादन में; ड़) "उत्पादक" से अजभप्रार् दकसी भी ऐसे संस्ट्थान से है िो तेल अथवा टार-बॉल्स का ररसाव िाने अथवा अनिाने रूप में करता है; इसमें तेल टैंकर, तेल कंपनी, िहाज़, तेल प्रजतष्ठान का स्ट्वामी अथवा कोई पररवहनकताा सजममजलत है; च) "भस्ट्मीकरण" से अजभप्रार् एक अजभर्ांजत्रक प्रदक्रर्ा से है जिसमें अपजिष्ट पदाथों को उच्च तापमान पर िलाने र्ा दहन करने के द्वारा ऊष्मीर् रूप से जवघरटत दकर्ा िाता है; छ) "तेल प्रजतष्ठान के माजलक" से अजभप्रार् उस व्यजि र्ा कंपनी से है िो दकसी प्रजतष्ठान/िहाज़/पोत का माजलक, जनर्ंत्रक अथवा संचालक है, िहााँ तेल (कच्चा र्ा ईंधन अथवा दोनों) का जनष्किाण, अन्वेिण, उपर्ोग, पररवहन र्ा प्रबंधन दकर्ा िाता है; ि) "अजधभोगी" से अजभप्रार् टार-बॉल्स के संबंध में उस व्यजि, एिेंसी अथवा संस्ट्थान से है जिनका टार-बॉल्स पर उसके उत्पन्न होने के बाद और अंजतम जनपटान से पूवा भौजतक और/अथवा प्रिासजनक जनर्ंत्रण हो , िैसा भी मामला हो; झ) "टार-बॉल्स के िोधन, भंडारण और जनपटान सुजवधा का पररचालक" से अजभप्रार् उस व्यजि से है िो पररसंकटमर् अपजिष्ट सजहत टार-बॉल्स के संग्रहण, प्राजप्त, भंडारण, पररवहन, िोधन, जनपटान र्ा प्रबंधन हेतु दकसी सुजवधा का माजलक, जनर्ंत्रक अथवा संचालक है; ञ) "पूवा-प्रसंस्ट्करण" से अजभप्रार् अपजिष्ट प्रवाहों के पूवा-िोधन से है तादक उन्हें भट्ठी में डालने हेतु उपर्ुि/समानरूप बनार्ा िा सके और प्रदक्रर्ा में उतार-चढाव से बचा िा सके; ट) "अनुसूची" से अजभप्रार् उन अनुसूजचर्ों से है िो इन जनर्मों के साथ संलग्न हैं; ठ) "भंडारण" से अजभप्रार् टार-बॉल्स के संग्रहण के बाद और अंजतम जनपटान से पूवा उनके भंडारण से है; ड) "टार-बॉल्स" से अजभप्रार् तेल ररसाव से उत्पन्न अपक्षजर्त उत्पाद है, िो अपतटीर् (तट से दूर) तेल अन्वेिण कार्ाकलापों, तेल टैंकर/िहाज़/पोत दुघाटनाओं, तेल-कूप जवस्ट्फोटों, पाइपलाइन ररसाव, िल, तेल और अन्र् प्रदूिकों के जमश्रण वाले [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 जबल्ज़ के जनष्कासन , िहाज़ों और टैंकरों से औद्योजगक अपजिष्ट तथा प्राकृजतक तेल ररसाव आदद के कारण उत्पन्न होता है, िो सामान्र्तः जवजभन्न भौजतक, रासार्जनक और िैजवक प्रदक्रर्ाओं के माध्र्म से जवकजसत होता है; ढ) "पररवहन" से अजभप्रार् टार-बॉल्स के स्ट्थानांतरण से है, चाहे वे िोजधत हो, आंजिक रूप से िोजधत र्ा अप्रर्ुि हों, जिन्हें एक स्ट्थान से दूसरे स्ट्थान तक पर्ाावरणीर् रूप से सुरजक्षत तरीके से जविेि रूप से जनर्मात और ढके हुए पररवहन प्रणाली द्वारा ले िार्ा िाता है तादक दुगंध, अपजिष्ट फैलाव और अजप्रर् पररजस्ट्थजतर्ों को रोका िा सके; ण) "िोधन" से अजभप्रार् उस जवजध, तकनीक र्ा प्रदक्रर्ा से है जिसे टार-बॉल्स की भौजतक, रासार्जनक र्ा िैजवक जविेिताओं अथवा संरचना को संिोजधत करने के जलए बनार्ा गर्ा है तादक उनके आर्तन को कम दकर्ा िा सके और हाजन पहुाँचाने की संभावना को कम दकर्ा िा सके; त) "टार-बॉल्स के िोधन, भंडारण और जनपटान सुजवधा" से अजभप्रार् दकसी भी ऐसी सुजवधा से है िहााँ पररसंकटमर् अपजिष्ट सजहत टार-बॉल्स का िोधन और जनपटान अथवा ऐसे िोधन अथवा जनपटान से संबंजधत प्रदक्रर्ाएाँ संचाजलत की िाती हैं; अध्र्ार् I टार-बॉल्स का प्रबंधन (जनवारण उपार्) 4. (1) तेल प्रजतष्ठान के माजलक जिन पर वाजणजयर्क पोत पररवहन अजधजनर्म, 2025 तथा उसके अंतगात बनाए गए जनर्म लागू होते हैं, वह तेल ररसाव को रोकने हेतु उि अजधजनर्म और जनर्मों के अंतगात जनधााररत सभी जनवारण उपार्ों को अपनाएगा तथा समर्-समर् पर पत्तन,पोत पररवहन और िलमागा मंत्रालर् द्वारा जनधााररत उपार्ों का पालन करेगा। (2) अपतटीर् तेल अन्वेिण प्रजतष्ठान के माजलक जिन पर तेल क्षेत्र (जवजनर्मन और जवकास) अजधजनर्म, 1948 तथा उसके अंतगात बनाए गए जनर्म लागू होते हैं, वह तेल ररसाव को रोकने हेतु उन जनर्मों में जनधााररत सभी जनवारण उपार्ों तथा समर्-समर् पर पेरोजलर्म और प्राकृजतक गैस मंत्रालर् द्वारा जनधााररत अन्र् उपार्ों का पालन करेगा। (3) तेल प्रजतष्ठान का माजलक भारतीर् तटरक्षक (आईसीिी) द्वारा प्रवर्तात राष्ट्रीर् तेल ररसाव आपदा आकजस्ट्मकता र्ोिना (एनओएसडीसीपी) के अनुसार तेल ररसाव की जनवारण और प्रजतदक्रर्ा संचालन की व्यवस्ट्था का पालन करेगा। (4) उप-जनर्म (1), (2) और (3) के अंतगात िाजमल न होने वाले तेल प्रजतष्ठान के माजलक को तेल ररसाव से बचाव हेतु समर्- समर् पर केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा जनधााररत सभी जनवारण उपार् करने होंगे। अध्र्ार् II टार-बॉल्स के प्रबंधन की प्रदक्रर्ा (5) टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु रायर् सरकारों और जिला प्रिासनों का उत्तरदाजर्त्व । (1) राष्ट्रीर् तेल ररसाव आपदा आकजस्ट्मकता र्ोिना के अंतगात रायर् स्ट्तरीर् संकट प्रबंधन समूह सामान्र् िनसाधारण द्वारा टार-बॉल्स को देखे िाने की सूचना हेतु एक केंद्रीकृत ररपोर्टंग प्रणाली स्ट्थाजपत करेंगे। (2) रायर् सरकारें टार-बॉल्स के संग्रहण तथा तट दकनारे की सफाई सुजनजश्चत करेंगी। (3) जिला प्रिासन जिले की तट दकनारे पर िमा हुए टार-बॉल्स के संग्रहण, प्रबंधन और पररवहन के जलए उत्तरदार्ी होगा तथा र्ह सुजनजश्चत करेगा दक जिला आपदा प्रबंधन र्ोिना में टार-बॉल्स प्रबंधन भी सजममजलत हो। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) रायर् सरकारें तेल ररसाव और टार-बॉल्स बनने की घटनाओं का समर्- बद्ध डेटा संकजलत करेंगी तथा अनुसंधान एवं जवकास संस्ट्थानों के साथ जमलकर गजणतीर् मॉडल जवकजसत करेंगी तादक उन्नत पूवाानुमान, तैर्ारी और बेहतर जनणार् जनधााररत दकए िा सकें। (5) रायर् सरकारें जिला प्रिासन तथा अन्र् संबंजधत रायर् स्ट्तरीर् अथवा जिला स्ट्तरीर् एिेंजसर्ों र्ा दोनों नामत: जिला आपदा प्रबंधन प्राजधकरण, पररवहन जवभाग, तटीर् क्षेत्र प्रबंधन प्राजधकरण, पर्ाावरण एवं वन जवभाग, बंदरगाह/हाबार प्राजधकरण आदद की भागीदारी के माध्र्म से टार-बॉल्स के संग्रहण, भंडारण, सफाई और जनपटान िैसी प्रजतदक्रर्ा कार्ाकलाप करेंगी; और आवश्र्कता होने पर स्ट्थानीर् नागररक समाि समूहों को भी इस प्रदक्रर्ा में सजममजलत दकर्ा िा सकता है। (6) रायर् सरकारें संबंजधत जिला प्रिासन के माध्र्म से टार-बॉल्स का संग्रहण, अस्ट्थार्ी भंडारण और उनका िोधन, भंडारण एवं जनपटान सुजवधा तक पर्ाावरणीर् रूप से सुरजक्षत तरीके से पररवहन सुजनजश्चत करेंगी। (7) रायर् सरकारें भारतीर् तटरक्षक (आईसीिी), उपर्ुि राष्ट्रीर् संस्ट्थानों तथा रायर् आपदा प्रजतदक्रर्ा बल (एसडीआरएफ़) की भागीदारी से टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु प्रजिक्षण कार्ाक्रम आर्ोजित करेंगी। (8) रायर् सरकारें तटीर् क्षेत्र में टार बॉल के कारण होने वाले प्रदूिण को रायर् आपदा के रूप में घोजित करेंगी। (9) रायर् सरकारें आपदा प्रबंधन अजधजनर्म के अंतगात कारावाई करेंगी। 6. टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु रक्षा मंत्रालर् (भारतीर् तटरक्षक) का उत्तरदाजर्त्व (1) भारतीर् तट रक्षक राष्ट्रीर् तेल ररसाव आपदा आकजस्ट्मकता र्ोिना (एनओएस-डीसीपी) को लागू करेगा तादक तेल ररसाव प्रबंधन और टार-बॉल्स के जनमााण का प्रभावी ढंग से प्रबंधन दकर्ा िा सके। (2) भारतीर् तट रक्षक, भारतीर् जवजिष्ट आर्थाक क्षेत्र में तेल ररसाव के जलए जनर्जमत हवाई और सतही जनगरानी करेगा तथा आवश्र्क तैर्ारी और प्रजतदक्रर्ा उपार्ों हेतु संबंजधत जहतधारकों को सूजचत करेगा। (3) र्ह दूर से संचाजलत वाहन (ररमोटली आपरेटोर व्हीकल) (आरओवी), स्ट्वचाजलत िलमग्न वाहन (एर्ूवी) आदद िैसी उन्नत तकनीकों का उपर्ोग करेंगे तादक ररसाव की घटनाओं के दौरान समुद्र के नीचे तेल का फैलाव का पता लगार्ा िा सके और उनका प्रबंधन दकर्ा िा सके। (4) र्ह अपतटीर् तेल ररसाव की घटनाओं/मामलों पर तत्काल आपातकालीन चेतावनी भेिेगा, र्दद कोई हो। (5) भारतीर् तटरक्षक प्रादेजिक समुद्र से बाहर होने वाले तेल ररसाव अथवा ररसाव की घटनाओं की त्रैमाजसक ररपोटा जनकटवती तटीर् रायर् सरकारों सजहत संबंजधत रायर् प्रदूिण जनर्ंत्रण बोडा अथवा प्रदूिण जनर्ंत्रण सजमजतर्ााँ तथा केंद्रीर् प्रदूिण जनर्ंत्रण बोडा को प्रदान करेगा। 7. टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु केंद्रीर् प्रदूिण जनर्ंत्रण बोडा, रायर् प्रदूिण जनर्ंत्रण बोडा और प्रदूिण जनर्ंत्रण सजमजत का उत्तरदाजर्त्व (1) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा (सीपीसीबी) रायर् सरकारों और संघ रायर् क्षेत्रों को इन जनर्मों के दक्रर्ान्वर्न के संबंध में रायर् प्रदूिण जनर्ंत्रण बोडों अथवा प्रदूिण जनर्ंत्रण सजमजतर्ों के माध्र्म से तकनीकी सहार्ता प्रदान करेगा। (2) संबंजधत तटीर् क्षेत्र में रायर् प्रदूिण जनर्ंत्रण बोडा/प्रदूिण जनर्ंत्रण सजमजत केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा जनधााररत प्रारूप के अनुसार रायर्/ संघ रायर् क्षेत्रों में टार-बॉल्स की घटनाओं का एक डेटाबेस बनाएगी, जिसमें टार-बॉल्स से प्रभाजवत क्षेत्र, संग्रजहत एवं संसाजधत दकए गए टार-बॉल्स की मात्रा तथा जनपटान के पररणामों का जववरण सजममजलत होगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (3) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा तथा संबंजधत रायर् प्रदूिण जनर्ंत्रण बोडा/प्रदूिण जनर्ंत्रण सजमजत रायर्/ संघ रायर् क्षेत्र में टार-बॉल्स के अजधकृत जनपटान/िोधन सुजवधाओं की सूची प्रकाजित करेंगे। (4) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा टार-बॉल्स के प्रबंधन हेतु एक मॉडल मानक संचालन प्रदक्रर्ा (एसओपी) तैर्ार करेगा, जिसमें उनका संग्रहण और तट दकनारे की सफाई िाजमल होगी। रायर् सरकारें और संघ रायर् क्षेत्र सीपीसीबी द्वारा तैर्ार मॉडल मानक संचालन प्रदक्रर्ा (एसओपी) को अपनाएगे अथवा स्ट्थानीर् आवश्र्कताओं के अनुसार िैसा भी मामला हो, संिोजधत करेंगे। (5) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा इन जनर्मों के दक्रर्ान्वर्न हेतु एक विा की अवजध के भीतर एक ऑनलाइन प्रणाली जवकजसत करेगा। (6) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा जनर्म 21 के तहत पर्ाावरण क्षजतपूर्ता के माध्र्म से एकजत्रत राजि के उपर्ोग/जवतरण के जलए ददिाजनदेि जवकजसत करेगा। (7) रायर् प्रदूिण जनर्ंत्रण बोडा अपने स्ट्वर्ं के जवत्तपोिण र्ा बिट प्रावधान तथा संबंजधत रायर् सरकार के सहर्ोग से टारबॉल के प्रबंधन हेतु गजतजवजधर्ााँ संचाजलत करेंगे। 8. टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु पत्तन,पोत पररवहन और िलमागा मंत्रालर् तथा नौवहन महाजनदेिालर् का उत्तरदाजर्त्व (1) पत्तन,पोत पररवहन और िलमागा मंत्रालर् अपने अजधकार क्षेत्र में जनर्मात बंदरगाहों, बांध, घाटों तथा अन्र् अवसंरचनाओं पर तथा बंदरगाह प्राजधकरण द्वारा समुद्र तट/तट दकनारे पर टार-बॉल्स की सफाई संबंधी कार्ाकलापों का समन्वर् करेगा। 9. टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु अपनी अपतटीर् प्रजतष्ठानों के माध्र्म से पेरोजलर्म और प्राकृजतक गैस मंत्रालर् का उत्तरदाजर्त्व (1) पेरोजलर्म और प्राकृजतक गैस मंत्रालर् अपनी अपतटीर् प्रजतष्ठानों के माध्र्म से प्रत्र्ेक प्रजतष्ठान (500 मीटर तक) की तेल ररसाव अथवा इसके फैलाव की घटनाओं की त्रैमाजसक ररपोटा भारतीर् तटरक्षक, जनकटवती तटीर् रायर् सरकारों, संबंजधत रायर् प्रदूिण जनर्ंत्रण बोडों र्ा प्रदूिण जनर्ंत्रण सजमजतर्ों तथा केंद्रीर् प्रदूिण जनर्ंत्रण बोडा को प्रदान करेगा। (2) पेरोजलर्म और प्राकृजतक गैस मंत्रालर् अपतटीर् तेल अन्वेिण प्रजतष्ठानों/सुजवधाओं से तेल ररसाव को जनर्ंजत्रत करने हेतु सभी जनवारण कदम उठाएगा। 10. टार-बॉल्स के पर्ाावरणीर् रूप से सुरजक्षत प्रबंधन हेतु राष्ट्रीर् सुदूर संवेदन एिेंसी का उत्तरदाजर्त्व (1) राष्ट्रीर् सुदूर संवेदन एिेंसी उपग्रह, हवाई जनगरानी, ड्रोन, सेंसर-सुसजित बॉर्स अथवा अन्र् दकसी भी माध्र्म से तेल ररसाव की घटनाओं और टार-बॉल्स के हॉट-स्ट्पॉट्स की जनगरानी एवं पहचान करेगी तथा सहर्ोगी एिेंजसर्ों को सहार्ता प्रदान करेगी। 11. टार-बॉल्स के अजधभोगी और पररचालक का उत्तरदाजर्त्व (1) प्रत्र्ेक अजधभोगी और संचालक का र्ह कताव्य होगा दक टार-बॉल्स का प्रबंधन इस प्रकार दकर्ा िाए दक मानव स्ट्वास्ट््र् और पर्ाावरण पर कोई प्रजतकूल प्रभाव न पड़े। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) अजधभोगी और संचालक टार-बॉल्स के सुरजक्षत और पर्ाावरणीर् रूप से सुदृढ प्रबंधन के जलए उत्तरदार्ी होंगे। (3) संग्रजहत टार-बॉल्स को पर्ाावरणीर् रूप से सुरजक्षत तरीके से जनपटान हेतु दकसी अजधकृत व्यजि को भेिा िाएगा। (4) वह अजधभोगी िो अपने टार-बॉल्स का िोधन और जनपटान दकसी िोधन, भंडारण और जनपटान सुजवधा के पररचालक द्वारा कराना चाहता है, वह उस सुजवधा के संचालक को वह जवजिष्ट प्रकार की सूचना प्रदान करेगा िो सुरजक्षत भंडारण और जनपटान के जलए आवश्र्क हैं । (5) ऑपरेटर र्ह सुजनजश्चत करेगा दक टार-बॉल का जनपटान पर्ाावरणीर् अनुकूल तरीके से दकर्ा िाए, जिसमें अपजिष्ट से ऊिाा, सीमेंट संर्ंत्र में सह-भस्ट्मीकरण र्ा िोधन, भंडारण और जनपटान सुजवधा (टीएसडीएफ) में सामान्र् भस्ट्मीकरण िाजमल हो सकता है। (6) अजधभोगी और संचालक टार-बॉल् स का प्रबंधन करते समर् सभी आवश्र्क कदम उठाएंगे िैसे - (क) संदूिकों को जनर्ंजत्रत करना और दुघाटनाओं को रोकना तथा मानव और पर्ाावरण पर उनके प्रभावों को सीजमत करना; और (ख) टार-बॉल् स को संभालने वाले व्यजिर्ों को उनकी सुरक्षा सुजनजश्चत करने के जलए उजचत प्रजिक्षण, उपकरण और आवश्र्क िानकारी प्रदान करें। अध्र्ार्-III टार-बॉल् स के िोधन, भंडारण और जनपटान की सुजवधा 12. टार-बॉल् स के िोधन,भंडारण और जनपटान की सुजवधा.-(1) रायर् सरकार, अजधभोगी , दकसी सुजवधा का पररचालक र्ा अजधभोजगर्ों का कोई संघ व्यजिगत रूप से र्ा संर्ुि रूप से र्ा अलग-अलग रूप से, रायर् में टार-बॉल के िोधन, भंडारण और जनपटान के जलए सुजवधा स्ट्थाजपत करने हेतु स्ट्थलों की पहचान करने के जलए जिममेदार होंगे। (2) सुजवधा का संचालक र्ा कैजटटव सुजवधा का अजधभोगी, समर्-समर् पर केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा इस संबंध में िारी तकनीकी ददिा-जनदेिों के अनुसार उपचार, भंडारण और जनपटान सुजवधा का जडिाइन और उसकी स्ट्थापना करेगा तथा इस संबंध में सीपीसीबी द्वारा जनर्दाष्ट जडिाइन और लेआउट के जलए रायर् प्रदूिण जनर्ंत्रण बोडा से अनुमोदन प्राप्त करेगा। (3) रायर् प्रदूिण जनर्ंत्रण बोडा, सुजवधा र्ा कैजटटव उपचार, भंडारण और जनपटान सुजवधा के संचालन का जनरीक्षण जनर्जमत रूप से त्रैमाजसक आधार पर करेगा। (4) सुजवधा का पररचालक र्ा अबाध सुजवधा का अजधभोगी, समर्-समर् पर सीपीसीबी द्वारा िारी ददिाजनदेिों र्ा मानक संचालन प्रदक्रर्ाओं के अनुसार, सुजवधा के सुरजक्षत और पर्ाावरण अनुकूल संचालन और उसके बंद होने तथा बंद होने के बाद के चरण के जलए जिममेदार होगा। (5) सुजवधा का पररचालक र्ा अबाध सुजवधा का अजधभोगी प्रपत्र 3 के अनुसार संभाले गए टार-बॉल का ररकॉडा रखेगा। (6) सुजवधा का पररचालक र्ा अबाध सुजवधा का अजधभोगी, उस जवत्तीर् विा के बाद, जिसके जलए वह ररटना संबंजधत है, प्रत्र्ेक अगले विा 30 िून को र्ा उससे पहले रायर् प्रदूिण जनर्ंत्रण बोडा को प्रपत्र 4 में वार्िाक ररटना दाजखल करेगा। (7) सुजवधा के अजधभोगी, पररचालक को समर्-समर् पर सीपीसीबी द्वारा िारी दकए गए टार-बॉल के संग्रह, पैकेजिंग, लेबजलंग, पररवहन, भंडारण के जलए मानक संचालन प्रदक्रर्ा और सीमेंट संर्ंत्र में टार-बॉल के पूवा-प्रसंस्ट्करण और सह- प्रसंस्ट्करण के जलए ददिाजनदेिों का पालन करना होगा। (8) पररसंकटमर् अपजिष्ट के जलए मौिूदा उपचार भंडारण और जनपटान सुजवधा, अपनी पररचालन जस्ट्थजतर्ों के अनुसार, टारबॉल के जनपटान के जलए भी उपर्ोग की िा सकती है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 अध्र्ार् IV टार-बॉल् स का संग्रह, पैकेजिंग, लेबजलंग और पररवहन 13. संग्रह: (1) जिला प्रिासन जिला तटरेखा के दकनारे िमा दकए गए टार बॉल्स के संग्रह, हैंडजलंग और पररवहन के जलए जिममेदार होगा। (2) जिला प्रिासन तट पर तार-बॉल के बारे में सूचना जमलने पर तटरेखा की सफाई करने के जलए एक स्ट्थानीर् प्रजतदक्रर्ा दल बनाए रखेगा। (3) सभी तैनात कर्मार्ों को उजचत प्रजिक्षण और व्यजिगत सुरक्षा उपकरण (पीपीई) प्रदान दकए िाएंगे, जिनमें दस्ट्ताने, िूते, फेस मास्ट्क और सुरक्षात्मक वस्त्र िाजमल हैं। (4) सफाई गजतजवजध की देखरेख जिला प्रिासन द्वारा जनर्ुि एक फील्ड अजधकारी द्वारा की िाएगी और (क) संग्रहण की जतजथ और समर्; (ख) स्ट्थान जनदेिांक; (ग) एकजत्रत सामग्री का प्रकार और मात्रा; (घ) तैनात उपकरण और कमी, को प्रलेजखत करने के जलए एक लॉगबुक रखी िाएगी । (5) भारतीर् तटरक्षक बल और जिला आपदा प्रबंधन प्राजधकरण टार-बॉल् स के संग्रह, प्रबंधन, पररवहन और सफाई कार्ाकलापों में जिला प्रिासन को मागादिान और जविेिज्ञ सलाह प्रदान करेंगे। (6) जिला प्रिासन टार बॉल के संग्रह, हैंडजलंग और पररवहन के जलए संबंजधत एसपीसीबी से प्राजधकरण प्राप्त करेगा। (7) जिला प्रिासन र्ह सुजनजश्चत करेगा दक टार बॉल्स के संग्रह के बाद उन्हें आगे की कारावाई िैसे भंडारण, पररवहन, उपचार, जनपटान, सह-प्रसंस्ट्करण के जलए अजधकृत व्यजि को सौंप ददर्ा िाए। (8) जिला प्रिासन सफाई गजतजवजधर्ों, प्रबंजधत मात्राओं और चुनौजतर्ों का जववरण देते हुए संबंजधत एसपीसीबी/पीसीसी को त्रैमाजसक ररपोटा प्रस्ट्तुत करेगा। (9) एक सदक्रर् उपार् के रूप में, जिला प्रिासन टार-बॉल िमाव का िीघ्र पता लगाने और समर् पर ररपोर्टंग करने के जलए, जविेि रूप से मानसून र्ा चक्रवात के बाद की घटनाओं िैसे उच्च िोजखम वाले समर् के दौरान जनर्जमत तटरेखा जनगरानी कर सकता है। 14. पैकेजिंग और लेबजलंग। (1) टार-बॉल संभालने वाला कोई भी अजधभोगी और िोधन, भंडारण और जनपटान सुजवधा के संचालक र्ह सुजनजश्चत करेगें दक टार-बॉल को सुरजक्षत संचालन, भंडारण और पररवहन के जलए उपर्ुि तरीके से पैक दकर्ा िाए। लेबजलंग प्रपत्र 5 के अनुसार की िाएगी। (2) लेबल न धुलने वाला, मौसमरोधी और आसानी से ददखाई देने वाली सामग्री का होगा। 15. टार-बॉल् स का पररवहन। (1) टार-बॉल् स का पररवहन इन जनर्मों और केंद्र सरकार द्वारा मोटर वाहन अजधजनर्म, 1988 के तहत बनाए गए जनर्मों के प्रावधानों के अनुसार होगा। (2) अजधभोगी, रांसपोटार को फॉमा 6 में टार-बॉल की पररसंकटमर् प्रकृजत और आपात जस्ट्थजत में उठाए िाने वाले उपार्ों के संबंध में प्रासंजगक िानकारी प्रदान करेगा और फॉमा 5 के अनुसार टार-बॉल कंटेनरों पर लेबल लगाएगा। (3) टार-बॉल् स को अंजतम जनपटान के जलए उस रायर् के अलावा दकसी अन्र् रायर् में जस्ट्थत सुजवधा में ले िाने की जस्ट्थजत में, िहां इसे उत्पन्न दकर्ा गर्ा है, प्रेिक को दोनों रायर्ों के रायर् प्रदूिण जनर्ंत्रण बोडा से 'अनापजत्त प्रमाण पत्र' प्राप्त करना होगा। 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) सह-प्रसंस्ट्करण सजहत उपर्ोग के जलए टार-बॉल् स के पररवहन के मामले में, प्रेिक टार-बॉल् स को रांसपोटार को सौंपने से पहले रायर् प्रदूिण जनर्ंत्रण बोडों और उपर्ोग/सह-प्रसंस्ट्करण इकाई दोनों को सूजचत करेगा। (5) सह-प्रसंस्ट्करण र्ा जनपटान सजहत उपर्ोग के जलए टार-बॉल् स के उत्पजत्त और गंतव्य रायर्ों के अलावा दकसी अन्र् रायर् से होकर पारगमन के मामले में, प्रेिक टार-बॉल् स के पररवहन के जलए जनर्दाष्ट मागा प्राप्त करेगा, िो आपातकालीन प्रजतदक्रर्ा इकाइर्ों से सुसजित होंगे और पररवहनकताा को अपजिष्ट सौंपने से पहले पारगमन रायर्ों के संबंजधत रायर् प्रदूिण जनर्ंत्रण बोडा को पूवा सूचना देगा। (6) टार-बॉल् स के पररवहन के मामले में, सुरजक्षत पररवहन की जिममेदारी प्रेिक र्ा प्राप्तकताा की होगी, िो भी पररवहन की व्यवस्ट्था करता है और संबंजधत रायर् प्रदूिण जनर्ंत्रण बोडा से पररवहन के जलए आवश्र्क प्राजधकरण प्राप्त करता है। र्ह जिममेदारी स्ट्पष्ट रूप से घोिणापत्र में दिाार्ी िानी चाजहए। (7) पररवहन के जलए प्राजधकरण र्ा तो प्रेिक द्वारा र्ा प्राप्तकताा द्वारा प्राप्त दकर्ा िाएगा जिसकी ओर से पररवहन की व्यवस्ट्था की िा रही है। 16. केवल देि के भीतर उपर्ोग दकए िाने वाले टार-बॉल् स के जलए घोिणापत्र प्रणाली (आवागमन दस्ट्तावेि)। (1) टार- बॉल् स का प्रेिक नीचे दिााए गए रंग कोड से र्ुि प्रपत्र 7 में घोिणापत्र की सात प्रजतर्ां तैर्ार करेगा और सभी सात प्रजतर्ों पर प्रेिक द्वारा हस्ट्ताक्षर दकए िाएंगे: प्रजत संख् र्ा के साथ रंग कोड उद्देश्र् (1) (2) प्रजत 1 (सफेद) सभी सात प्रजतर्ों पर हस्ट्ताक्षर करने के बाद इसे प्रेिक द्वारा रायर् प्रदूिण जनर्ंत्रण बोडा को अग्रेजित दकए िाने के जलए। प्रजत 2 (पीली) हस्ट् ताक्षर लेने के बाद इसे प्रेिक द्वारा रखा िाना है और बाकी पांच हस्ट् ताक्षर की गई प्रजतर्ां वाहक द्वारा ले िाने के जलए। प्रजत 3 (गुलाबी). अपजिष्ट प्राप्त करने के बाद इसे ररसीवर वास्ट्तजवक उपर्ोगकताा र्ा उपचार, भंडारण और जनपटान सुजवधा संचालक द्वारा रखा िाना चाजहए चार प्रजतर्ों पर ररसीवर द्वारा उजचत रूप से हस्ट्ताक्षर दकए िाने चाजहए। प्रजत 4 (नारंगी) अपजिष्ट स्ट्वीकार करने के बाद इसे ररसीवर द्वारा पररवहनकताा को सौंपें िाने के जलए प्रजत 5 (हरा) प्राप्तकताा द्वारा रायर् प्रदूिण जनर्ंत्रण बोडा को भेिे िाने के जलए। प्रजत 6 (नीला) प्राप्तकताा द्वारा प्रेिक को भेिे िाने के जलए। प्रजत 7 (ग्रे) र्दद प्रेिक दकसी अन्र् रायर् में जस्ट्थत है, तो प्राप्तकताा द्वारा इसे प्रेिक के रायर् प्रदूिण जनर्ंत्रण बोडा को भेिे िाने के जलए। (2) प्रेिक प्रजत 1 (सफेद) रायर् प्रदूिण जनर्ंत्रण बोडा को अग्रेजित करेगा, और र्दद टार-बॉल् स को दकसी पारगमन रायर् से होकर ले िार्ा िाना संभव हो, तो प्रेिक अपजिष्ट की आवािाही के बारे में पारगमन रायर्ों के रायर् प्रदूिण जनर्ंत्रण बोडों को सूजचत करेगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (3) कोई भी रांसपोटार प्रेिक से पररवहन के जलए टार बॉल स्ट्वीकार नहीं करेगा िब तक दक उसके साथ घोिणापत्र की हस्ट्ताक्षररत प्रजतर्ां 3 से 7 संलग्न न हों। (4) रांसपोटार टार बॉल खेप के साथ प्राप्तकताा को जतजथ सजहत जवजधवत हस्ट्ताक्षररत घोिणापत्र की प्रजतर्ां 3 से 7 प्रस्ट्तुत करेगा। (5) टार बॉल स्ट्वीकार करने के बाद प्राप्तकताा प्रजत 4 (नारंगी) रांसपोटार को सौंप देगा और प्रजत 5 (हरा) अपने रायर् प्रदूिण जनर्ंत्रण बोडा को भेि देगा तथा प्रजत 6 (नीला) प्रेिक को भेि देगा तथा प्रजत 3 (गुलाबी) प्राप्तकताा द्वारा अपने पास रखी िाएगी। (6) प्रजत 7 (ग्रे) केवल प्रेिक के रायर् प्रदूिण जनर्ंत्रण बोडा को भेिी िाएगी, र्दद प्रेिक दकसी अन्र् रायर् में है। अध्र्ार् V टार- बॉल्स के प्रबंधन के जलए प्राजधकार 17. टार बॉल्स के प्रबंधन के जलए प्राजधकार प्रदान करना. - (1) टार बॉल्स के संचालन, संग्रह, भंडारण, पैकेजिंग, पररवहन, उपर्ोग, िोधन, प्रसंस्ट्करण, पुनचाक्रण, ररकवरी, पूवा-प्रसंस्ट्करण, सह-प्रसंस्ट्करण, उपर्ोग, जबक्री के जलए पेिकि, स्ट्थानांतरण र्ा जनपटान में संलग्न प्रत्र्ेक अजधभोगी द्वारा रायर् प्रदूिण जनर्ंत्रण बोडा को प्रपत्र 1 में आवेदन करना होगा और इन जनर्मों के प्रकािन की जतजथ से साठ ददनों की अवजध के भीतर रायर् प्रदूिण जनर्ंत्रण बोडा से प्राजधकार प्राप्त करना होगा। परंतु प्राजधकार के नवीनीकरण के जलए आवेदन ऐसे प्राजधकरण की समाजप्त से तीन महीने पहले दकर्ा िाए। (2) प्रदूिण जनर्ंत्रण बोडा की प्रदूिण जनर्ंत्रण सजमजत, प्राजधकार हेतु सभी प्रकार से पूणा आवेदन प्राप्त होने पर, आवश्र्क समझी िाने वाली िााँच के बाद, और इस बात से संतुष्ट होने पर दक आवेदक के पास पररसंकटमर् और अन्र् अपजिष्टों के संग्रहण, भंडारण, पैकेजिंग, पररवहन, िोधन, प्रसंस्ट्करण, उपर्ोग, जवध्वंि, पुनचाक्रण, पुनप्रााजप्त, पूवा-प्रसंस्ट्करण, सह- प्रसंस्ट्करण, उपर्ोग, जबक्री के जलए पेिकि, स्ट्थानांतरण र्ा जनपटान के जलए उपर्ुि सुजवधाएाँ हैं, और केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा समर्-समर् पर जनर्दाष्ट मानक संचालन प्रदक्रर्ा र्ा अन्र् ददिा-जनदेिों के अनुरूप तकनीकी क्षमताओं और उपकरणों को सुजनजश्चत करने के बाद, तथा स्ट्थल जनरीक्षण के माध्र्म से, एक सौ बीस ददनों की अवजध के भीतर आवेदक को प्रपत्र 2 में प्राजधकार प्रदान कर सकती है, िो उसमें जनधााररत ितों के अधीन पााँच विों की अवजध के जलए वैध होगा। परंतु प्राजधकार के नवीनीकरण के आवेदन के मामले में, रायर् प्रदूिण जनर्ंत्रण बोडा, ऐसा प्राजधकरण प्रदान करने से पहले, र्ह सुजनजश्चत कर ले दक उसके द्वारा पहले ददए गए प्राजधकार में जनर्दाष्ट ितों का कोई उल्लंघन नहीं हुआ है और इसे जनरीक्षण ररपोटा में दिा दकर्ा िाएगा। (3) उप-जनर्म (2) के तहत रायर् प्रदूिण जनर्ंत्रण बोडा द्वारा प्राजधकार के साथ उस बोडा द्वारा हस्ट्ताक्षररत क्षेत्र जनरीक्षण ररपोटा की एक प्रजत संलग्न होगी, जिसमें पररसंकटमर् और अन्र् अपजिष्टों के संग्रह, भंडारण, पैकेजिंग, पररवहन, िोधन, प्रसंस्ट्करण, उपर्ोग, जवध्वंस, पुनचाक्रण, ररकवरी, पूवा-प्रसंस्ट्करण, सह-प्रसंस्ट्करण, उपर्ोग, जबक्री के जलए पेिकि, स्ट्थानांतरण र्ा जनपटान के जलए सुजवधाओं की पर्ााप्तता और केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा समर्-समर् पर जनर्दाष्ट ददिाजनदेिों र्ा मानक संचालन प्रदक्रर्ाओं के अनुपालन को दिाार्ा गर्ा हो। (4) रायर् प्रदूिण जनर्ंत्रण बोडा, आवेदक को सुनवाई का उजचत अवसर देने के बाद इन जनर्मों के तहत कोई भी प्राजधकार प्रदान करने से इनकार कर सकता है और इसके कारण जलजखत में दिा दकए िाएंगे। 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) इन जनर्मों के तहत प्राजधकृत प्रत्र्ेक अजधभोगी, प्रपत्र 3 में अपने द्वारा प्रबंजधत टार बॉल्स का ररकॉडा रखेगा और को प्रपत्र 4 में जनर्दाष्ट जववरण सजहत वार्िाक जववारजणका जवत्तीर् विा के बाद ददनांक 30 िून को र्ा उससे पहले रायर् प्रदूिण जनर्ंत्रण बोडा प्रस्ट्तुत करेगा। (6) रायर् प्रदूिण जनर्ंत्रण बोडा एक रजिस्ट् टर का रखरखाव करेगा, जिसमें टार बॉल्स के प्रबंधन के जलए इन जनर्मों के तहत लगाई गई ितों का जववरण रखना िाजमल होगा और कोई भी इच्छुक र्ा प्रभाजवत व्यजि कार्ाालर् समर् के दौरान इसका जनरीक्षण कर सकेगा। (7) टार बॉल्स का प्राजधकृत वास्ट्तजवक उपर्ोगकताा को रायर् प्रदूिण जनर्ंत्रण बोडा द्वारा िारी पासबुक में प्राजधकृत पत्र सजहत खरीदे गए टार बॉल्स का ररकॉडा रखना होगा। (8) वास्ट्तजवक उपर्ोगकताा को टार बॉल्स की पासबुक में प्रजवजष्ट करने के बाद ही प्राजधकृत वास्ट्तजवक उपर्ोगकताा को टार बॉल्स सौंपा िाएगा। (9) कोई भी व्यजि र्ा संस्ट्था वैध प्राजधकरण के जबना टार बॉल्स के संग्रह, पररवहन, भंडारण र्ा जनपटान में संलग्न नहीं होगा। 18. प्राजधकार को जनलंजबत र्ा रद्द करने की िजि। (1) र्दद रायर् प्रदूिण जनर्ंत्रण बोडा की रार् में प्राजधकार धारक प्राजधकार की दकसी भी िता र्ा अजधजनर्म के दकसी भी प्रावधान र्ा इन जनर्मों का अनुपालन करने में जवफल रहता है, तो उसे सुनवाई का उजचत अवसर देने के बाद और इसके कारणों को जलजखत में दिा करने के बाद, जनर्म 17 के तहत िारी प्राजधकार को सावािजनक जहत में आवश्र्क समझे िाने वाली अवजध के जलए रद्द र्ा जनलंजबत कर सकता है। (2) रायर् प्रदूिण जनर्ंत्रण बोडा पर, उस व्यजि को टार बॉल्स के सुरजक्षत भंडारण और प्रबंधन के जलए जनदेि दे सकता है, जिसका प्राजधकार जनलंजबत र्ा रद्द दकर्ा गर्ा है, और ऐसे अजधभोगी को ऐसे जनदेिों का पालन करना होगा। 19. टार बॉल्स का उपर्ोग- (1) टार बॉल्स का संसाधन के रूप में र्ा पूवा-प्रसंस्ट्करण के बाद सह-प्रसंस्ट्करण र्ा दकसी अन्र् उपर्ोग के जलए उपर्ोग, केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा प्रदान की गई मानक संचालन प्रदक्रर्ाओं र्ा ददिाजनदेिों के आधार पर रायर् प्रदूिण जनर्ंत्रण बोडा से प्राजधकार प्राप्त करने के बाद ही दकर्ा िाएगा। (2) र्दद जवजिष्ट उपर्ोग के जलए मानक संचालन प्रदक्रर्ाएं र्ा ददिाजनदेि उपलब्ध नहीं हैं, तो केंद्रीर् प्रदूिण जनर्ंत्रण बोडा से अनुमोदन प्राप्त करना होगा, िो प्रार्ोजत्रक संचालन के आधार पर अनुमोदन प्रदान करेगा और उसके बाद, केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा मानक संचालन प्रदक्रर्ाएं र्ा ददिाजनदेि तैर्ार दकए िाएंगे। परंतु, र्दद दकसी जविेि उपर्ोग के संबंध में प्रार्ोजत्रक संचालन कार्ााजन्वत दकर्ा गर्ा हो और पर्ाावरणीर् मानकों का अनुपालन प्रदर्िात दकर्ा गर्ा हो, तो रायर् प्रदूिण जनर्ंत्रण बोडा द्वारा इसके जलए प्राजधकार प्रदान दकर्ा िा सकता है, जिसके जलए केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा अलग से प्रार्ाजत्रक संचालन करने की आवश्र्कता नहीं होगी। केंद्रीर् प्रदूिण जनर्ंत्रण बोडा सभी रायर् प्रदूिण जनर्ंत्रण बोडों को सफल परीक्षणों की सूचना देगा। 3) सीमेंट संर्ंत्रों में टार बॉल्स के सह-प्रसंस्ट्करण के जलए दकसी भी प्रार्ोजत्रक संचालन की आवश्र्कता नहीं होगी, जिनके जलए केंद्रीर् प्रदूिण जनर्ंत्रण बोडा द्वारा ददिाजनदेि पहले से ही उपलब्ध हैं। हालांदक, वास्ट्तजवक उपर्ोगकतााओं को अपजिष्ट के सह-प्रसंस्ट्करण के संबंध में सीमेंट संर्ंत्रों के जलए पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) के तहत अजधसूजचत मानकों का अनुपालन सुजनजश्चत करना होगा। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 20. पूवा-प्रसंस्ट्करण और/र्ा सह-प्रसंस्ट्करण के जलए प्राजधकार: (1) टार-बॉल के संग्रह र्ा भंडारण र्ा पररवहन र्ा प्राजप्त र्ा पुन: उपर्ोग र्ा पुनप्रााजप्त र्ा पूवा-प्रसंस्ट्करण र्ा सह-प्रसंस्ट्करण र्ा उपर्ोग र्ा िोधन र्ा जनपटान के जलए प्राजधकार प्रदान करने /नवीनीकरण हेतु आवेदन प्रपत्र 1 के अनुसार होगा। (2) एसपीसीबी प्रपत्र 2 के अनुसार टार-बॉल के सह-प्रसंस्ट्करण के जलए सीमेंट संर्ंत्रों को प्राजधकार प्रदान कर सकते हैं। इसके अलावा, एसपीसीबी पररसंकटमर् और अन्र् अपजिष्ट ( प्रबंध और सीमापार संचलन) जनर्म, 2016 में सूचीबद्ध नहीं दकए गए दकसी भी अपजिष्ट के सह-प्रसंस्ट्करण के जलए सीमेंट संर्ंत्रों को वार्ु (प्रदूिण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 के तहत सहमजत भी प्रदान कर सकते हैं। (3) ऐसे सभी अपजिष्टों के सह-प्रसंस्ट्करण के दौरान, सीमेंट संर्ंत्रों को अपजिष्टों के सह-प्रसंस्ट्करण के जलए जनधााररत उत्सिान मानकों का अनुपालन करना होगा, िो पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा ददनांक 10.05.2016 के सा.का.जन. संख्र्ा 497 (अ) के माध्र्म से अजधसूजचत दकए गए हैं। (4) पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की ददनांक 23.11.2016 की अजधसूचना संख्र्ा का.आ.3518 (अ) के अनुसार सीमेंट भट्टों में सह-प्रसंस्ट्करण के जलए टार-बॉल को उपर्ोग हेतु पर्ाावरण मंिूरी (ईसी) की आवश्र्कता नहीं है। (5) सीमेंट संर्ंत्र केवल ऐसी अनुमजत प्राप्त करने के बाद ही अपनी कैजटटव प्री-प्रोसेजसंग संर्ंत्रों में टार-बॉल का सह-प्रसंस्ट्करण र्ा पूवा-प्रसंस्ट्करण कर सकते हैं। (6) प्रत्र्ेक टीएसडीएफ र्ा स्ट्टैंडअलोन प्री-प्रोसेजसंग संर्ंत्र र्ा सीमेंट संर्ंत्र िो सह-प्रसंस्ट्करण के जलए अपजिष्टों के पूवा- प्रसंस्ट्करण में संलग्न है, उसके पास सीपीसीबी के ददिाजनदेिों के अनुसार न्र्ूनतम आवश्र्क बुजनर्ादी ढांचा सुजवधाएं और पररचालन जनर्ंत्रण होना चाजहए। अध्र्ार्-6 पर्ाावरणीर् क्षजतपूर्ता 21. पर्ाावरण क्षजतपूर्ता- 1) िहां कोई भी तेल संर्ंत्र माजलक पर्ाावरणीर् अनुकूल तरीके से तेल का प्रबंधन करने में जवफल रहता है और दकसी भी तेल ररसाव का कारण बनता है, जिससे टार बॉल बनने सजहत पर्ाावरण र्ा सावािजनक स्ट्वास्ट््र् को नुकसान, क्षजत र्ा चोट पहुंचती है, तो र्ह पर्ाावरणीर् मुआविे का भुगतान करने के जलए उत्तरदार्ी होगा िो इस तरह के नुकसान, क्षजत र्ा चोट और टार-बॉल के प्रबंधन के जलए जिला प्रिासन द्वारा वहन दकए गए र्ा वहन दकए िाने वाले व्यर् के बराबर हो सकता है। (2) पर्ाावरणीर् अनुकूल तरीके से टार बॉल का प्रबंधन र्ा प्रहस्ट्तन करने में जवफल रहने पर अजधभोगी, रांसपोटार, सह- प्रसंस्ट्करणकताा और संचालक र्ा िोधन केन्द्रों के अजधभोगी पर पर्ाावरणीर् क्षजतपूर्ता भी लगाई िा सकती है। (3) सीपीसीबी टार बॉल के कारण होने वाले नुकसान को पूरा करने के जलए पर्ाावरणीर् क्षजतपूर्ता के भुगतान के जलए एक ददिाजनदेि तैर्ार करेगा, जिसमें इसके प्रहस्ट्तन, तटों की सफाई और ‘प्रदूिक को भुगतान’ जसद्धांत के आधार पर अजतररि िुमााना िाजमल है। (4) इस मामले में सुनवाई के अवसर के जबना इस जनर्म के तहत कोई पर्ाावरणीर् क्षजतपूर्ता नहीं लगाई िाएगी। (5) रायर् प्रदूिण जनर्ंत्रण बोडा (एसपीसीबी) र्ा प्रदूिण जनर्ंत्रण सजमजत (पीसीसी) इन जनर्मों के अनुसार पर्ाावरणीर् क्षजतपूर्ता लगा सकती है। (6) इस जनर्म के तहत पर्ाावरणीर् क्षजतपूर्ता के रूप में संग्रजहत की गई धनराजि को एसपीसीबी र्ा पीसीसी द्वारा एक अलग खाते में रखा िाएगा और इसका उपर्ोग केवल जिला प्रिासन द्वारा टार बॉल के एकत्रण, भंडारण, पररवहन, जनपटान के जलए दकए गए व्यर् को पूरा करने के जलए दकर्ा िाएगा। इसके अलावा, इस प्रकार संग्रजहत की गई धनराजि का उपर्ोग उस व्यर् को पूरा करने के जलए जिला प्रिासन को अनुसंधान और सहार्ता के जलए भी दकर्ा िा सकता है िहां टार बॉल का िेनरेटर ज्ञात नहीं है। 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अध्र्ार् VII जवजवध 22. संचालन सजमजत की स्ट्थापना: (1) केन्द्र सरकार एक संचालन सजमजत का गठन करेगी जिसमें पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, पेरोजलर्म और प्राकृजतक गैस मंत्रालर्, पत्तन, पोत पररवहन और िलमागा मंत्रालर्, रक्षा मंत्रालर् (भारतीर् तटरक्षक बल), पृ्वी जवज्ञान मंत्रालर्, गृह मंत्रालर्, जवज्ञान और प्रौद्योजगकी मंत्रालर् तथा अन्र् जहतधारकों के प्रजतजनजध िाजमल होंगे। रायर् प्रदूिण जनर्ंत्रण बोडा/प्रदूिण जनर्ंत्रण सजमजत का प्रजतजनजधत्व, आवश्र्कतानुसार दकर्ा िाएगा। संचालन सजमजत आवश्र्कता अनुसार दकसी ज्ञान भागीदार र्ा जविर् जविेिज्ञ को सदस्ट्र् के रूप में सह-नाजमत कर सकती है। (2) सजमजत तटीर् रायर्/संघ रायर् क्षेत्र की सरकारों तथा अन्र् जहतधारकों को इन जनर्मों के कार्ाान्वर्न से संबंजधत मामलों के बारे में सलाह देगी। 23. ररकॉडा और जववरजणर्ां.- (1) टारबॉल को संभालने वाला अजधभोगी और जनपटान सुजवधा का संचालक प्ररूप 3 में ऐसे कार्ों का ररकॉडा रखेगा । (2) टार बॉल का हथालन वाले अजधभोगी और जनपटान सुजवधा के संचालक को रायर् प्रदूिण जनर्ंत्रण बोडा को फामा 4 में वार्िाक ररटना भेिना होगा । (3) रायर् प्रदूिण जनर्ंत्रण बोडा, टार-बॉल्स के जनपटान के जलए संर्ंत्र के अजधभोजगर्ों और संचालकों से प्राप्त वार्िाक जववरणी के आधार पर, बनाए गए, ररकवर दकए गए, इस्ट्तेमाल दकए गए, सह-प्रसंस्ट्कृत दकए गए और जनपटान दकए गए टार-बॉल्स की वार्िाक इन्वेंरी तैर्ार करेगा और हर विा 30 जसतंबर तक केंद्रीर् प्रदूिण जनर्ंत्रण बोडा को िमा करेगा। राय र् प्रदूिण जनर्ंत्रण बोडा वास्ट् तजवक अजधभोगी, साझा और कैजटटव जनपटान संर्ंत्रों की भी इन्वेंरी तैर्ार करेगा और हर दो विा में केन्द्रीर् प्रदूिण जनर्ंत्रण बोडा को िानकारी िमा करेगा। (4) केन्द्रीर् प्रदूिण जनर्ंत्रण बोडा टार-बॉल प्रबंधन पर समेदकत समीक्षा ररपोटा तैर्ार करेगा और इसे हर साल 30 ददसंबर से पहले अपनी जसफाररिों के साथ पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को भेिेगा। 24. दुघाटना की ररपोर्टंग – (1) र्दद टार-बॉल हथालन करने वाले अजधभोगी और जनपटान सुजवधा के संचालक के संर्ंत्रों पर र्ा पररवहन के दौरान कोई दुघाटना घरटत होती है, तो अजधभोगी र्ा संचालक र्ा रांसपोटार तुरंत रायर् प्रदूिण जनर्ंत्रण बोडा को टेलीफोन, ई- मेल के माध्र्म से दुघाटना के बारे में सूजचत करेगा और तत्पश्चात प्रपत्र 8 में ररपोटा भेिेगा। 25. इन जनर्मों का उल्लंघन करने पर कारावाई.- कोई भी व्यजि िो इन जनर्मों के प्रावधानों का पालन करने में जवफल रहता है र्ा उल्लंघन करता है, उसके जखलाफ अजधजनर्म की धारा 15 के प्रावधानों के अनुसार कारावाई की िा सकती है। 26. करठनाइर्ों को दूर करने की िजि : संचालन सजमजत इन जवजनर्मों के सुचारू कार्ाान्वर्न में करठनाई पैदा करने वाले मुद्दों की िांच करेगी और ऐसी दकसी करठनाई को दूर करने की िजि रखेगी तथा ऐसे दकसी मुद्दे को, िैसा ठीक समझे, केन्द्रीर् सरकार के जवचार के जलए भेि सकती है। [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 27. सत्र्ापन और संपरीक्षा.- (1) केंद्रीर् प्रदूिण जनर्ंत्रण बोडा स्ट्वर्ं र्ा एसपीसीबी/पीसीसी र्ा पर्ाावरण संपरीक्षा जनर्म, 2025 के तहत पररभाजित पंिीकृत पर्ाावरण संपरीक्षक के माध्र्म से िनरेटर, तेल संर्ंत्र के माजलक, िोधन, भंडारण और जनपटान सुजवधा के संचालक आदद का टार-बॉल के पर्ाावरण के अनुकूल प्रबंधन और इन जनर्मों के अन्र् प्रावधानों के बारे में जनरीक्षण और समर्-समर् पर ऑजडट के माध्र्म से, िैसा उजचत लगे अनुपालन मूल्र्ांकन करेगा, और इन जनर्मों के उल्लंघन के जखलाफ कारावाई करेगा। (2) भारत के जनर्ंत्रक-महालेखा परीक्षक (सी.ए.िी.) द्वारा वार्िाक रूप से समेदकत जनजध खाते तथा पर्ाावरण क्षजतपूर्ता खाते की लेखापरीक्षा की िाएगी। 28. अपील.- (1) रायर् प्रदूिण जनर्ंत्रण बोडा द्वारा पाररत प्राजधकार के जनलंबन, रद्दीकरण र्ा इनकार र्ा नवीकरण के आदेि से व्यजथत कोई भी असंतुष्ट, आदेि की सूचना जमलने की तारीख से तीस ददनों की अवजध के भीतर, अपील प्राजधकार, अथाात् रायर्/संघ रायर् क्षेत्र के पर्ाावरण सजचव को प्रपत्र 9 में अपील कर सकता है। (2) अपील प्राजधकरण तीस ददन की उि अवजध की समाजप्त के पश्चात प्रस्ट्तुत अपील पर जवचार कर सकता है, र्दद वह संतुष्ट है दक अपीलकताा पर्ााप्त कारण से समर् पर अपील दार्र नहीं कर सका। (3) इस जनर्म के अन्तगात दार्र प्रत्र्ेक अपील का जनपटान उसके दार्र होने की जतजथ से साठ ददन की अवजध के भीतर दकर्ा िाएगा। प्रपत्र 1 [जनर्म 17(1), 20(1) देखें] टार-बॉल्स के संग्रहण र्ा भंडारण र्ा पररवहन र्ा प्राजप्त र्ा पुन:उपर्ोग र्ा ररकवरी र्ा पूवा-प्रसंस्ट्करण र्ा सह-प्रसंस्ट्करण र्ा उपर्ोग र्ा िोधन र्ा जनपटान के जलए प्राजधकार प्राप्त करने/नवीकरण करने के जलए अपेजक्षत आवेदन भाग ‘क’: सामान्र् (सभी द्वारा भरा िाना है) 1. (क) इकाई का नाम और पता तथा संर्ंत्र का स्ट्थान: (ख) संर्ंत्र के अजधभोगी र्ा जनपटान संर्ंत्र के संचालक का नाम, पदनाम, दूरभाि, फैक्स तथा ई-मेल सजहत : (ग) जनम्नजलजखत में से दकसके जलए अनुमजत ज़रूरी है (कृपर्ा सही कार्ाकलाप र्ा कार्ाकलापों पर सही का जनिान लगाएं: (i) संग्रहण (ii) भंडारण (iii) पररवहन (iv) प्राजप्त (v) पूवा-प्रसंस्ट्करण (vi) सह-प्रसंस्ट्करण (vii) उपर्ोग (viii) िोधन (ix) जनपटान (x) भस्ट्मीकरण 2. (क) प्रत्र्ेक विा हथालन दकए गए टार-बॉल्स की प्रकृजत और मात्रा (मीररक टन र्ा दकलो लीटर में) (ख) दकसी भी समर् संग्रहीत दकए गए टार-बॉल्स का प्रकृजत और मात्रा (मीररक टन र्ा दकलो लीटर में) 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. आपातकालीन प्रजतदक्रर्ा र्ोिना (ईआरपी) की प्रजत उपलब्ध करवाएाँ, जिसमें आपातकालीन जस्ट्थजत (िैसे स्राव र्ा ररसाव र्ा आग) से जनपटने के तरीके बताए गए हों। ऐसे ईआरपी में जनम्नजलजखत िाजमल होंगे, लेदकन केवल र्हीं तक सीजमत नहीं: a) घटनाओं को रोकना और जनर्ंजत्रत करना तादक प्रभावों को कम दकर्ा िा सके और व्यजिर्ों, पर्ाावरण और संपजत्त के जलए खतरे को सीजमत दकर्ा िा सके; b) व्यजिर्ों और पर्ाावरण की सुरक्षा के जलए आवश्र्क उपार्ों को दक्रर्ाजन्वत करना; c) घटनाओं की जस्ट्थजत को जनर्ंजत्रत करने और उनके पररणामों को कम करने के जलए िो कारावाई की िानी चाजहए, उसका ब्र्ौरा, जिसमें मौिूद सुरक्षा साधन और संसाधनों का ब्र्ौरा भी िाजमल है; d) कमाचाररर्ों को उन कताव्यों के प्रजिक्षण की व्यवस्ट्था करना जिनकी उनसे अपेक्षा की िाती है; e) संबंजधत अजधकाररर्ों और आपातकालीन सेवाओं को सूजचत करने की व्यवस्ट्था; और f) ऑफ-साइट राहत कारावाई में सहार्ता की व्यवस्ट्था करना। 4. टार-बॉल को संभालते समर् ररसाव, आग लगने र्ा ररसाव की जस्ट्थजत में बैंक गारंटी िमा करने की सीमा सजहत सभी प्रावधानों का पालन करने के जलए वचन र्ा घोिणा प्रदान करें। भाग ख: िोधन, भंडारण और जनपटान संर्ंत्र संचालक, पूवा-प्रसंस्ट्करणकताा र्ा सह-प्रसंस्ट्करणकताा के अलावा टार-बॉल के अजधभोगी द्वारा भरा िाना है। 1. संग्रहण, भंडारण र्ा प्राजप्त के जलए र्े िानकारी उपलब्ध करवाएाँ: (i) लेआउट मैप के साथ भंडारण-स्ट्थल की अवजस्ट्थजत; (ii) भंडारण क्षमता; (iii) टीएसडीएफ तक पररवहन की अवजस्ट्थजत; (iv) अजग्निमन प्रणाजलर्ााँ; (v) टार-बॉल्स के सुरजक्षत जनपटान के जलए ददए गए पर्ाावरणीर् सुरक्षा-जनदेिों और पर्ाावरणीर् सुजवधाओं की िानकारी। पाटा ग: िोधन, भंडारण और जनपटान संर्ंत्र संचालक द्वारा भरा िाना है 1. संर्ंत्र की िानकारी उपलब्ध कराएं, जिसमें जनम्नजलजखत िाजमल हैं: (i) लेआउट मैप के साथ साइट की अवजस्ट्थजत; (ii) टार-बॉल्स का सुरजक्षत भंडारण और भंडारण क्षमता; (iii) िोधन संर्ंत्र और उनकी क्षमताएं; (iv) सुरजक्षत लैंडदफल; (v) भस्ट्मीकरण, र्दद कोई हो; (vi) लीचेट संग्रहण और उपचार प्रणाली; (vii) अजग्निमन प्रणाजलर्ााँ; (viii) पर्ाावरणीर् प्रबंधन र्ोिना जिसमें जनगरानी िाजमल है; और (ix) उद्गम स्ट्थान से टार-बॉल के पररवहन की व्यवस्ट्था [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 पाटा घ: टार-बॉल्स के पूवा-प्रसंस्ट्करणकताा र्ा सह-प्रसंस्ट्करणकताा द्वारा भरा िाना है 1. घरेलू स्रोतों से हर साल जमलने वाले अलग-अलग टार-बॉल की प्रकृजत और मात्रा: 2. जिला उद्योग केंद्र र्ा दकसी दूसरी प्राजधकृत सरकारी एिेंसी से िारी पंिीकरण के अनुसार स्ट्थाजपत क्षमता। प्रजत उपलब्ध करवाएाँ: 3. टार-बॉल के सुरजक्षत भंडारण की िानकारी दें, जिसमें भंडारण क्षमता भी िाजमल हो: 4. उपकरणों का जववरण, आउटपुट (उत्सिान, अपजिष्ट िल आदद) बताने वाली प्रोसेस फ्लो िीट। अलग िीट संलग्न करें: 5. प्रदूिण जनर्ंत्रण प्रणाली िैसे अपजिष्ट िल िोधन संर्ंत्र, स्ट्क्रबर, आदद की िानकारी दें, जिसमें कचरे के जनपटान का तरीका भी िाजमल हो: 6. कार्ा से िुड़े स्ट्वास्ट््र् और सुरक्षा संबंधी उपार्ों की िानकारी दें: 7. क्र्ा र्ह संर्ंत्र केन्द्रीर् प्रदूिण जनर्ंत्रण बोडा के ददिाजनदेिों के अनुसार स्ट्थाजपत दकर्ा गर्ा है? Short title and commencement. (i) These rules may be called the Tar-balls Management Rules, 2026. (ii) They shall come into force after one year from the date of publication of final notification in the Official Gazette. 2. Application: (i) These rules apply to all persons who generate, collect, receive, store, transport, treat, dispose or handle Tar-balls in any manner, including oil extraction and exploration facilities, ships, oil tanker, oil facility owner, or authorized person in this behalf. 3. Definition.— (1) In these rules, unless the context otherwise requires, - a) “Act” means the Environment (Protection) Act, 1986 (29 of 1986); b) “Authorisation” means permission granted by the prescribed authority for the collection, reception, storage, transportation, treatment, disposal and/or any other form of handling of Tar-balls in accordance with these rules and any guidelines issued by the Central Government; c) “Authorized person” means an occupier or operator authorized by the prescribed authority to collect, receive, store, transport, treat, dispose and/or handle Tar-balls in accordance with these rules and any guidelines issued by the Central Government; d) “Co-processing” means use of tar-balls having calorific value exceeding 1500 kcal as raw material or as a source of energy or both to replace or supplement the natural mineral resources or fossil fuels in industrial processes, mainly in energy intensive industries like cement production; e) “Generator” means any institution causing spillage of oil or spillage of Tar-balls intentionally or unintentionally, which includes an oil tanker, oil company, ships or oil facility owner or any transporter; f) “Incineration” means an engineered process involving burning or combustion of waste to thermally degrade waste materials at high temperatures; [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 21 g) “Oil facility owner” means a person or company who owns or controls or operates a facility/ship/vessel where oil (crude or fuel or both ) is extracted, explored, used, transport or handle as the case may be; h) “Occupier” in relation to tar balls, means a person, agency or institution who has, physical and/or administrative control over tar balls as the case may be, after its generation and before its final disposal; i) “Operator of Treatment, Storage and Disposal Facility for Tar-balls” means a person who owns or controls or operates a facility for the collection, reception, storage, transport, treatment, disposal or handling of Hazardous waste including tar-balls; j) “Pre-processing” is defined as pre-treatment of waste streams to make it suitable/homogenized for feeding into the kiln system to avoid process fluctuations; k) “Schedule" means the Schedule appended to these rules; l) “Storage” means storing of tar balls after collection and before its final disposal; m) “Tar-balls” means a weathered product of oil spills due to offshore oil exploration activities, oil tanker/ship/vessel accidents, oil-well blowouts, pipeline leakages, release of bilge containing mixture of water oil and other contaminants, industrial effluent from ships and tankers as well as from natural oil seepage etc., which usually develops through various physical, chemical, and biological processes; n) "transportation" means conveyance of tar-ball, either treated, partly treated or untreated from a location to another location in an environmentally sound manner through specially designed and covered transport system so as to prevent the foul odour, littering and unsightly conditions; o) “treatment” means the method, technique or process designed to modify physical, chemical or biological characteristics or composition of tar balls so as to reduce its volume and potential to cause harm; p) “Treatment, Storage and Disposal Facility for Tar-balls”: means any facility wherein treatment & disposal of hazardous waste including tar-balls or processes incidental to such treatment or disposal is carried out; CHAPTER I MANAGEMENT OF TAR-BALLS (PREVENTIVE MEASURE) 4. (1) The owner of an oil facility to whom the Merchant Shipping Act, 2025 and the rules made thereunder apply shall take all preventive measures as prescribed under the said Act and rules made thereunder and as prescribed by Ministry of Port, Shipping and Waterways from time to time to prevent oil spills. (2) The owner of an oil facility for offshore oil exploration to whom the Oilfields (Regulation and Development) Act, 1948 and the rules made thereunder apply shall take all preventive measures as 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] prescribed under the said rules and other measures as prescribed by Ministry of Petroleum and Natural Gas from time to time to prevent oil spills. (3) The owner of an oil facility shall follow the mechanism for prevention of oil spills and response operation as per National Oil Spill Disaster Contingency Plan (NOSDCP) promulgated by Indian Coast Guard (ICG). (4) The owner of an oil facility not covered under sub rule (1), (2) and (3) above shall take all preventive measure to avoid oil spill as prescribed by the Central Pollution Control Board from time to time. CHAPTER II PROCEDURE FOR MANAGEMENT OF TAR-BALLS 5. Responsibilities of State Governments and District Administration for environmentally sound management of Tar-balls. – (1) State Level Crisis Management Groups under the NOSDCP shall establish centralised reporting system for reporting of tar-balls sighting by the general public. (2) The State Governments shall ensure the collection of tar-balls and the cleaning of the shoreline. (3) The District Administration shall be responsible for the collection, handling, and transportation of tar balls deposited along the district shoreline and ensure that the District Disaster Management Plan may also include tar-ball management. (4) The State Governments shall undertake the compilation of time-series data of oil spills and tar-balls formation events and tie up with R&D institutes to develop mathematical models to make advanced predictions, preparations, and to have a better decision-making. (5) The State Governments shall undertake response activities including collection, storage, cleaning, and disposal of Tar balls, through involvement of District Administration and other relevant state level or district level or both, agencies viz. District Disaster Management Authority, Transport Department, Coastal Zone Management Authority, Environment and Forest Department, Port/Harbour Authorities, and if required, Local Civil Society Groups may be engaged in the process. (6) The State Governments shall ensure the collection, temporary storage and transportation of tar ball to the Treatment, Storage and Disposal Facility (TSDF) in an environmentally sound manner through concerned district administration. (7) The State Government shall conduct a training program with the involvement of the Indian Coast Guard (ICG), suitable National Institutes and the State Disaster Response Force (SDRF) for the environmentally sound management of tar balls. (8) The State Governments shall declare the pollution due to Tar Ball in the coastal area as State disaster. (9) The State Governments shall take action under the Disaster Management Act. Responsibilities of Ministry of Defence (Indian Coast Guard) for environmentally sound management of Tar-balls. – (1) The Indian Coast Guard shall implement National Oil Spill Disaster Contingency Plan (NOS-DCP) to effectively manage oil spill management and tar-balls formation. (2) The Indian Coast Guard shall undertake regular aerial and surface surveillance for oil spill in Indian EEZ and inform relevant stakeholders for necessary preparedness and response measures. (3) It may utilise advanced technologies, such as remotely operated vehicles (ROV), automated underwater vehicles (AUV) etc. for the detection and management of underwater oil plumes during spill events. (4) It will send immediate emergency alerts on offshore oil spill events/cases, if any. (5) Indian Coast Guard shall provide quarterly oil leakage or spill incident reports beyond territorial water to nearby Coastal State Governments, including the concerned State Pollution Control Boards or Pollution Control Committees and Central Pollution Control Board. 7. Responsibilities of Central Pollution Control Board, State Pollution Control Board and Pollution Control Committee for environmentally sound management of Tar-balls: (1) The Central Pollution Control Board (CPCB) shall render technical assistance to State Government and Union Territories through the State Pollution Control Boards or Pollution Control Committees with regard to implementation of these rules. (2) The State Pollution Control Board/Pollution Control Committee in the concerned coastal region shall maintain a database on tar-ball incidents in the State/Union Territory, including data on, the area affected by tar balls, quantity of tar balls collected & processed and disposal outcomes as per format prescribed by the Central Pollution Control Board. (3) The Central Pollution Control Board and the concerned State Pollution Control Board/Pollution Control Committee shall publish the list of authorized disposal/treatment facilities for tar balls in the State/Union Territory. (4) The Central Pollution Control Board shall prepare a model Standard Operating Procedures (SOPs) for management of tar-balls including its collection and cleaning of shoreline. The State Government and Union Territory may adopt the model Standard Operating Procedures (SOPs) prepared by CPCB or may modify the same as per its local requirement, as the case may be. (5) The Central Pollution Control Board shall develop an online system within a period of one year, for the implementation of these rules. (6) The Central Pollution Control Board shall develop guidelines for the utilization/disbursement of the amount collected through environment compensation under Rule 21. (7) The State Pollution Control Boards shall undertake activities for the management of Tarball through its own funding or budget line and support from the concerned State Government. 8. Responsibilities of Ministry of Ports, Shipping and Waterways and Directorate General of Shipping for environmentally sound management of Tar-balls. – (1) The Ministry of Ports, Shipping and Waterways shall coordinate tar ball clean-up activities at ports, jetties, wharves, and other structures constructed within their jurisdiction, and at beach/ shoreline owned by the port authority. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 9. Responsibilities of Ministry of Petroleum and Natural Gas through its offshore installations for environmentally sound management of Tar-balls. – (1) Ministry of Petroleum and Natural Gas through its offshore installations shall provide quarterly oil leakage or spill incident reports of every installation (up to 500 meters) to Indian Coast Guard, nearby Coastal State Governments, including the concerned State Pollution Control Boards or Pollution Control Committees and Central Pollution Control Board. (2) Ministry of Petroleum and Natural Gas shall take all preventive steps to control oil spill from offshore oil exploration installations/facilities. 10. Responsibilities of National Remote Sensing Agency for environmentally sound management of Tar-balls. – (1) National Remote Sensing Agency shall conduct Surveillance and Detection of oil-spills incidences and tar-balls hot-spots through satellite, aerial, drones, sensor-equipped buoys, or by any other means and shall support the combat agencies. 11. Responsibilities of the occupier and operator of Tar-balls - (1) It shall be the duty of every occupier and operator handling tar ball to take all the steps to ensure that tar-balls is handled without any adverse effect on human health and the environment. (2) The occupier and operator shall be responsible for safe and environmentally sound management of Tar- balls. (3) The Tar-balls collected shall be sent to an authorized person for disposal in an environmentally sound manner. (4) The occupier who intends to get its tar-ball treated and disposed of by the operator of a treatment, storage and disposal facility shall give to the operator of that facility, such specific information as may be needed for safe storage and disposal. (5) The operator shall ensure disposal of tar-balls in an environmentally sound manner, which may include through waste to energy, co-incineration in a cement plant or common incineration in the Treatment, Storage, and Disposal Facility (TSDF). (6) The occupier and operator shall take all the steps while managing Tar-balls to- (a) Contain contaminants and prevent accidents and limit their consequences on human beings and the environment; and (b) Provide persons handling the tar ball with appropriate training, equipment and the information necessary to ensure their safety. [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 25 CHAPTER - III TREATMENT, STORAGE AND DISPOSAL FACILITY FOR TAR-BALLS 12. Treatment, Storage and Disposal Facility for Tar-balls. - (1) The State Government, occupier, operator of a facility or any association of occupiers shall individually or jointly or severally be responsible for identification of sites for establishing the facility for treatment, storage and disposal of the Tar-balls in the State. (2) The operator of facility or occupier of a captive facility, shall design and set up the treatment, storage and disposal facility as per technical guidelines issued by the Central Pollution Control Board in this regard from time to time and shall obtain approval from the State Pollution Control Board for design and layout as specified by CPCB in this regard. (3) The State Pollution Control Board shall inspect the operation of the facility or captive treatment, storage and disposal facility, regularly on quarterly basis. (4) The operator of facility or occupier of a captive facility shall be responsible for safe and environmentally sound operation of the facility and its closure and post closure phase, as per guidelines or standard operating procedures issued by CPCB from time to time. (5) The operator of facility or occupier of a captive facility shall maintain records of Tar-balls handled as per Form 3. (6) The operator of facility or occupier of a captive facility shall file an annual return in Form 4 to the State Pollution Control Board on or before the 30th day of June, every year, following the financial year to which that return relates. (7) The occupier, operator of a facility shall follow the Standard Operating Procedure for collection, packaging, labelling, transportation, storage of tar-ball and guidelines for pre-processing and co-processing of tar-ball in Cement Plant issued by CPCB from time to time. (8) The existing Treatment Storage and Disposal Facility, subject to its operating conditions, for Hazardous Waste may also be utilised for the disposal of Tarballs. CHAPTER - IV COLLECTION, PACKAGING, LABELLING AND TRANSPORT OF TAR-BALLS 13. Collection: (1) The District Administration shall be responsible for collection, handling, and transportation of tar balls deposited along the district shoreline. (2) The District Administration shall maintain a local response team to undertake shoreline clean-up when intimated about the tar-balls on shore. (3) All deployed personnel shall be provided with appropriate training and Personal Protective Equipment (PPE), including gloves, boots, face masks, and protective clothing. (4) The clean-up activity shall be overseen by a field officer engaged by District Administration and a logbook shall be maintained for documenting (a) Date and time of collection; (b) Location coordinates; (c) Type and volume of material collected; (d) Equipment and personnel deployed. 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) The Indian Coast Guard and District Disaster Management Authority shall provide guidance and expert advice to District Administration in collection, handling, transportation, and clean-up activities. (6) The District Administration shall obtain the authorisation from the concerned SPCB for collection, handling, and transportation of tar balls. (7) The District Administration shall ensure that after collection of tar balls the same may be handed over to authorized person for further action viz. storage, transportation, treatment, disposal, co-processing. (8) The District Administration shall submit the quarterly reports to the concerned SPCB/PCC outlining clean-up activities, quantities managed, and challenges faced. (9) As a proactive measure, District Administration may conduct regular shoreline monitoring to enable early detection and timely reporting of tar-ball deposition, especially during high-risk periods like monsoon or post-cyclonic events. 14. Packaging and Labelling. - (1) Any occupier handling Tar-balls and operator of the treatment, storage and disposal facility shall ensure that the Tar-balls are packaged in a manner suitable for safe handling, storage and transport. The labelling shall be done as per Form 5. (2) The label shall be of non-washable material, weather proof and easily visible. 15. Transportation of Tar-balls. - (1) The transport of the tar-balls shall be in accordance with the provisions of these rules and the rules made by the Central Government under the Motor Vehicles Act, 1988. (2) The occupier shall provide the transporter with the relevant information in Form 6, regarding the hazardous nature of the tar-balls and measures to be taken in case of an emergency and shall label the tar- balls containers as per Form 5. (3) In case of transportation of Tar-balls for final disposal to a facility existing in a State other than the State where it is generated, the sender shall obtain ‘No Objection Certificate’ from the State Pollution Control Board of both the States. (4) In case of transportation of tar-balls for utilisation including co-processing, the sender shall intimate both the State Pollution Control Boards and utilising/co-processing unit before handing over the tar-balls to the transporter. (5) In case of transit of tar-balls for utilization including co- processing or disposal through a State other than the States of origin and destination, the sender shall obtain specified routes for transporting tar ball, equipped with emergency response units and shall give prior intimation to the concerned State Pollution Control Board of the States of transit before handing over the wastes to the transporter. (6) In case of transportation of tar-balls, the responsibility of safe transport shall be either of the sender or the receiver whosoever arranges the transport and has the necessary authorisation for transport from the concerned State Pollution Control Board. This responsibility should be clearly indicated in the manifest. (7) The authorisation for transport shall be obtained either by the sender or the receiver on whose behalf the transport is being arranged. 16. Manifest system (Movement Document) for Tar-balls to be used within the country only. - (1) The sender of the tar-balls shall prepare seven copies of the manifest in Form 7 comprising of colour code indicated below and all seven copies shall be signed by the sender: [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 27 Copy number with colour code Purpose (1) (2) Copy 1 (White) To be forwarded by the sender to the State Pollution Control Board after signing all the seven copies. Copy 3 (Pink) To be retained by the receiver (actual user or treatment storage and disposal facility operator) after receiving the waste and the remaining four copies are to be duly signed by the receiver. Copy 4 (Orange) To be handed over to the transporter by the receiver after accepting waste Copy 5 (Green) To be sent by the receiver to the State Pollution Control Board. Copy 6 (Blue) To be sent by the receiver to the sender. Copy 7 (Grey) To be sent by the receiver to the State Pollution Control Board of the sender in case the sender is in another State. (2) The sender shall forward copy 1 (white) to the State Pollution Control Board, and in case the tar-balls is likely to be transported through any transit State, the sender shall intimate State Pollution Control Boards of transit States about the movement of the waste. (3) No transporter shall accept tar ball from the sender for transport unless it is accompanied by signed copies 3 to 7 of the manifest. (4) The transporter shall submit copies 3 to 7 of the manifest duly signed with date to the receiver along with the tar ball consignment. (5) The receiver after acceptance of the tar ball shall hand over copy 4 (orange) to the transporter and send copy 5 (green) to his State Pollution Control Board and send copy 6 (blue) to the sender and the copy 3 (pink) shall be retained by the receiver. (6) The copy 7 (grey) shall only be sent to the State Pollution Control Board of the sender, if the sender is in another State. CHAPTER-V AUTHORIZATION FOR MANAGEMENT OF TAR-BALLS 17. Grant of authorisation for managing tar ball. - (1) Every occupier who is engaged in handling, collection, storage, packaging, transportation, use, treatment, processing, recycling, recovery, pre- processing, co-processing, utilisation, offering for sale, transfer or disposal of the tar balls shall be required to make an application in Form 1 to the State Pollution Control Board and obtain an authorisation from the State Pollution Control Board within a period of sixty days from the date of publication of these rules. Provided that an application for renewal of authorisation may be made three months before the expiry of such authorisation. (2) On receipt of an application complete in all respects for the authorisation, the Pollution Control Board/ Pollution Control Committee may, after such inquiry as it considers necessary, and on being satisfied that the applicant possesses appropriate facilities for collection, storage, packaging, transportation, treatment, processing, use, destruction, recycling, recovery, pre-processing, co-processing, utilisation, offering for sale, transfer or disposal of the hazardous and other waste, as the case may be, and after ensuring technical capabilities and equipment complying with the standard operating procedure or other guidelines specified 28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] by the Central Pollution Control Board from time to time and through site inspection, grant within a period of one hundred and twenty days, an authorisation in Form 2 to the applicant, which shall be valid for a period of five years subject to such conditions as may be laid down therein. Provided that in the case of an application for renewal of authorisation, the State Pollution Control Board may, before granting such authorisation, satisfy itself that there has been no violation of the conditions specified in the authorisation earlier granted by it and same shall be recorded in the inspection report. (3) The authorisation granted by the State Pollution Control Board under sub-rule (2) shall be accompanied by a copy of the field inspection report signed by that Board indicating the adequacy of facilities for collection, storage, packaging, transportation, treatment, processing, use, destruction, recycling, recovery, pre-processing, co-processing, utilisation, offering for sale, transfer or disposal of the hazardous and other wastes and compliance to the guidelines or standard operating procedures specified by the Central Pollution Control Board from time to time. (4) The State Pollution Control Board may, for the reasons to be recorded in writing and after giving reasonable opportunity of being heard to the applicant, refuse to grant any authorisation under these rules. (5) Every occupier authorised under these rules, shall maintain a record of Tar Balls managed by him in Form 3 and prepare and submit to the State Pollution Control Board, an annual return containing the details specified in Form 4 on or before the 30th day of June following the financial year to which that return relates. (6) The State Pollution Control Board shall maintain a register containing particulars of the conditions imposed under these rules for management of Tar Balls and it shall be open for inspection during office hours to any interested or affected person. (7) The authorised actual user of Tar Balls shall maintain records of Tar Balls purchased in a passbook issued by the State Pollution Control Board along with the authorisation. (8) Handing over of the Tar Balls to the authorised actual user shall be only after making the entry into the passbook of the actual user. (9) No person or entity shall engage in the collection, transportation, storage, or disposal of tar balls without valid authorisation. 18. Power to suspend or cancel an authorisation. - (1) The State Pollution Control Board, may, if in its opinion the holder of the authorisation has failed to comply with any of the conditions of the authorisation or with any provisions of the Act or these rules and after giving him a reasonable opportunity of being heard and after recording reasons thereof in writing cancel or suspend the authorisation issued under Rule 17 for such period as it considers necessary in the public interest. (2) Upon suspension or cancellation of the authorisation, the State Pollution Control Board may give directions to the person whose authorisation has been suspended or cancelled for the safe storage and management of the Tar Balls, and such occupier shall comply with such directions. 19. Utilisation of Tar Balls - (1) The utilisation of Tar Balls as a resource or after pre-processing either for co-processing or for any other use, shall be carried out only after obtaining authorisation from the State Pollution Control Board on the basis of standard operating procedures or guidelines provided by the Central Pollution Control Board. (2) Where standard operating procedures or guidelines are not available for specific utilisation, the approval has to be sought from Central Pollution Control Board which shall grant approval on the basis of trial runs [भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 29 and thereafter, standard operating procedures or guidelines shall be prepared by Central Pollution Control Board: Provided, if trial run has been conducted with respect to particular utilisation and compliance to the environmental standards has been demonstrated, authorisation may be granted by the State Pollution Control Board with respect to the same, without need of separate trial run by Central Pollution Control Board. Central Pollution Control Board shall intimate all the State Pollution Control Board regarding the successful trial runs. (3) No trial runs shall be required for co-processing of Tar Balls in cement plants for which guidelines by the Central Pollution Control Board are already available. However, the actual users shall ensure compliance to the standards notified under the Environment (Protection) Act, 1986 (29 of 1986), for cement plant with respect to co-processing of waste; 20. Authorization for pre-processing and/or co-processing: (1) Application for grant/renewal of authorisation for collection or storage or transport or reception or reuse or recovery or pre-processing or co-processing or utilisation or treatment or disposal of Tar-balls shall be as per Form 1. (2) SPCBs may grant authorization to cement plants for co-processing of tar-balls as per Form 2. Further, SPCBs may also grant consent to the cement plants under Air (Prevention & Control) Act, 1981 for co- processing of any wastes not listed in Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. (3) While co-processing all such wastes, cements plants shall comply with the emission standards prescribed for co-processing of wastes notified by MoEF&CC vide G.S.R No. 497 (E) dated 10.05.2016. (4) Use of tar-balls for co-processing in cement kilns does not warrant the requirement of Environment Clearance (EC) as per MoEF&CC Notification No. S.O.3518 (E) dated 23.11.2016. (5) Cement plants may co-process or pre-process the tar-balls in their captive pre-processing facilities only after obtaining such authorization. (6) Every TSDF or standalone pre-processing facility or cement plant who is engaged in pre-processing of wastes for co-processing shall have minimal requisite infrastructure facilities & operational controls as per the CPCB’s guidelines. CHAPTER-VI ENVIRONMENTAL COMPENSATION 21. Environment Compensation. - (1) Where any oil facility owner fails to manage oil in an environmentally sound manner and lead to any oil spill thereby causing loss, damage or injury to environment or public health including formation of tar balls, it shall be liable to pay environmental compensation which may be equal to such loss, damage or injury and expenditure incurred or to be incurred by District Administration towards management of tar-balls. (2) Environmental compensation may also be levied on occupier, transporter, co-processor and operator or occupier of treatment facilities if they fail to manage or handle the tar balls in an environmentally sound manner. (3) CPCB shall formulate a guideline for payment of environmental compensation toward meeting the damage caused by tar balls including the expenditure incurred towards its handling, cleaning of shores and additional penalty based on polluter pay principle. 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (4) No environmental compensation shall be imposed under this rule without an opportunity of being heard in this matter. (5) The State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) may impose the environmental compensation in accordance with these rules. (6) The fund collected as environmental compensation under this rule shall be kept by SPCB or PCC in a separate account and shall be utilised only for meeting the expenditure incurred towards collection, storage, transportation, disposal of tar balls by the District Administration. In addition to this, fund so collected may also be utilised for research and assistance to District Administration for meeting the expenditure where the generator of tar ball in not known. CHAPTER VII MISCELLANEOUS 22. Establishment of a Steering Committee: (1) The Central Government shall constitute a steering committee comprising representative from Ministry of Environment, Forest and Climate Change (MoEF&CC), Ministry of Petroleum and Natural Gas (MoPNG), Ministry of Ports, Shipping, and Waterways (MoPSW), Ministry of Defence (Indian Coast Guard), Ministry of Earth Sciences (MoES), Ministry of Home Affairs, Ministry of Science and Technology and Other stakeholders. The State Pollution Control Board/Pollution Control Committee shall be represented, as and when required. The Steering Committee may co-opt a knowledge partner or subject matter expert as a member, as and when required. (2) The committee shall advise the Government of the coastal State/Union Territory and the other stakeholders about matters related to the implementation of these rules. 23. Records and returns. - (1) The occupier handling Tar-balls and operator of disposal facility shall maintain records of such operations in Form 3. (2) The occupier handling tar-balls and operator of disposal facility shall send annual returns to the State Pollution Control Board in Form 4. (3) The State Pollution Control Board based on the annual returns received from the occupiers and the operators of the facilities for disposal of tar-balls shall prepare an annual inventory of the tar-balls generated, recovered, utilised including co-processed and disposed and submit to the Central Pollution Control Board by the 30th day of September every year. The State Pollution Control Board shall also prepare the inventory of actual occupiers, common and captive disposal facilities and shall submit the information to Central Pollution Control Board every two years. (4) The Central Pollution Control Board shall prepare the consolidated review report on management of tar-balls and forward it to the Ministry of Environment, Forest and Climate Change, along with its recommendations before the 30th day of December every year. 24. Accident reporting. – (1) Where an accident occurs at the facility of the occupier handling Tar-ball and operator of the disposal facility or during transportation, the occupier or the operator or the transporter shall immediately intimate the State Pollution Control Board through telephone, e-mail about the accident and subsequently send a report in Form 8. Action for contravention of these rules.- Any person who fails to comply or contravenes the provision of these rules may be liable to be proceeded with in accordance with the provisions of section 15 of the Act. 26. Power to remove difficulties: The Steering Committee shall examine issues leading to difficulty in the smooth implementation of these regulations and have the power to remove any such difficulty, and may refer any such issues, as deemed fit, for consideration of the Central Government. 27. Verification and audit.- (1) The Central Pollution Control Board by itself or through SPCBs/PCCs or Registered Environment Auditor as defined under Environment Audit Rules, 2025, shall undertake the compliance assessment of entities viz. Generator , Oil facility owner, Occupier, Operator of Treatment, Storage and Disposal Facility etc. regarding environmentally sound management of the tar-balls and other provisions of these rules through inspection and periodic audit, as deemed appropriate, and take actions against violations under rules of these rules. (2) The corpus fund account and environmental compensation account shall be audited, annually, by the Comptroller and Auditor General of India (CAG). 28. Appeal. - (1) Any person aggrieved by an order of suspension or cancellation or refusal of authorisation or its renewal passed by the State Pollution Control Board may, within a period of thirty days from the date on which the order is communicated to him, prefer an appeal in Form 9 to the Appellate Authority, namely, the Environment Secretary of the State/ Union Territory. (2) The Appellate Authority may entertain the appeal submitted after the expiry of the said period of thirty days, if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. (3) Every appeal filed under this rule shall be disposed of within a period of sixty days from the date of its filing.
