सा.का.जि. 630(अ).— केन्द्रीय सरकार, मािव अंग और ऊतक प्रजतरोपण अजधजियम, 1994 (1994 का 42) की धारा 24 द्वारा प्रित्त िजियों का प्रयोग करते हुए, मािव अंग और ऊतक प्रजतरोपण जियम, 2014 में और संिोधि करिे के जलए जिम्नजलजखत जियम बिाती है, अर्ाात्:-

1. (1) इि जियमों का संजिप्त िाम मािव अंग और ऊतक प्रजतरोपण (जद्वतीय संिोधि) जियम, 2026 है। (2) ये रािपत्र में इिके प्रकािि की तारीख को प्रवृत्त होंगे।

2. मािव अंग और ऊतक प्रत्यारोपण जियम, 2014 के जियम 33 के उप-जियम (1) के स्ट्र्ाि पर जिम्नजलजखत उप-जियम रखा िाएगा, अर्ाात्: -

“(1)(क) अगर कोई व्यजि इस अजधजियम की धारा 9 की उप-धारा (6) के अधीि प्राजधकार सजमजत के दकसी आिेि से व्यजर्त है, तो वह आिेि प्राप्त होिे की तारीख से तीस दििों के भीतर संबंजधत राज्य सरकार, राज्यों के मामले में और संबंजधत सरकार अर्वा प्रिासक, संघ राज्य िेत्रों के मामले में, के पास अपील कर सकेगा। (ख) अगर कोई व्यजि इस अजधजियम की धारा 15 की उप-धारा (2) या धारा 16 की उप-धारा (2) के अधीि समुजित प्राजधकारी के दकसी आिेि से व्यजर्त है, तो वह आिेि प्राप्त होिे की तारीख से तीस दििों के भीतर संघ राज्य िेत्रों के मामले में केन्द्रीय सरकार के और राज्यों के मामले में संबंजधत राज्य सरकार के पास अपील कर सकता है।"

MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 15th July, 2026

G.S.R. 630(E).— In exercise of the powers conferred by section 24 of the Transplantation of Human Organs and Tissues Act, 1994 (42 of 1994), the Central Government hereby makes the following rules further to amend the Transplantation of Human Organs and Tissues Rules, 2014, namely:─

1. (1) These rules may be called the Transplantation of Human Organs and Tissues (Second Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Transplantation of Human Organs and Tissues Rules, 2014, in rule 33, for sub-rule (1), the following sub-rule shall be substituted, namely: -

“(1)(a) Any person aggrieved by an order of the Authorisation Committee under sub-section (6) of section 9 of the Act, may, within a period of thirty days from the date of receipt of the order, prefer an appeal to the respective State Government in the case of States and respective Government or Administrator in the case of Union territories. (b) Any person aggrieved by an order of the Appropriate Authority under sub-section (2) of section 15 or sub-section (2) of section 16 of the Act, may, within a period of thirty days from the date of receipt of the order, prefer an appeal to the Central Government in the case of the Union territories and the respective State Government in the case of States.”
