Sir/Madam,
On the captioned subject, reference is invited to ESIC Hqrs Circular No. U-
25/12/165to169/2024-Medical-V (E-754406)/1 dated 02.01.2026, published on the ESIC
Headquarters website vide Console No. 24046/2026 dated 02.01.2026.
In this connection, it is hereby informed that the above-mentioned circular of even
number stands withdrawn. Accordingly, the purchase of the drug Inj. Cetuximab may be
carried out in strict adherence to Circular No. U-25/12/Action Plan/2021-MedV (e-file)/07
dated 09.01.2026, published vide Console No. 24129/2026 dated 12.01.2026 on the
ESIC Headquarters website.

Cetuximab- 500mg) in DG-ESIC Rate Contract No. 167-reg.
Sir/Madam,
Reference is invited towards the published Rate Contract No. 167 uploaded on ESIC Hqrs
website vide console no. 23712/2025 dated 12.12.2025.
With reference to the captioned subject and in continuation of the above, it is hereby
notified to all concerned procurement authorities that no supply order is to be placed to
the DG ESIC approved Pharmaceutical firm M/s Merck Specialities Private Limited for Item
no. 1812 (Inj. Cetuximab-100mg) & 1813 (Inj. Cetuximab- 500mg) in the valid DG-ESIC RC
167, till further orders.
It has come to the notice of ESIC Hqrs Office that the said item is being procured by ESI
Institutions via Custom Bid from GeM. Therefore, it is advised to procure the above item
(Inj. Cetuximab-100mg) through GeM only and procurement through DG ESIC RC may be
put on hold till further order issued by this office.
This is for information and strictly compliance please.

Subject: Clarification on Procurement of Medicines through GeM and DG-
ESIC Rate Contracts-Reg.
Sir/Madam,
This is in reference to the Video Conference held on 24.12.2025, wherein the issue
related to procurement of medicines was discussed, particularly in cases where
DG-ESIC Rate Contract (RC) medicines are also available on the GeM Portal.
In continuation of the deliberations held during the VC and to ensure uniformity and
compliance with Government procurement procedures, it is informed that:
Before procuring any medicine/item through DG-ESIC Rate Contract, concerned
ESIC institutions shall generate a GeM Non-Availability Report (GeM-NAR),
confirming that the said medicine/item is not available on the GeM Portal.
In cases where the required RC medicine is available on the GeM Portal, the
procurement shall mandatorily be carried out through the GeM Portal only, in
accordance with the prevailing Government of India procurement guidelines.
Any discrepancy, if observed in terms of cost, may be examined and dealt with at
the local level on an item-wise basis, strictly in accordance with the provisions of
the GFR and GeM Guidelines. Further, Government buyers shall ascertain the
reasonableness of prices before placement of orders by using the Business
Analytics (BA) tools available on the GeM Portal, including parameters such as
Last Purchase Price on GeM, the Department's own Last Purchase Price, and
other relevant comparative data.
Incidence to be raised on GeM for abnormally high price of any medicine.
It is the sole responsibility of the Dean/MS/DIMS/D(M)D/D(M)N to ensure
compliance of all instructions mentioned above.
This issues with the approval of the Director General, ESIC for necessary
compliance.
