भारतीय बीमा विनियामक और विकास प्राधिकरण (जीवन बीमा व्यवसाय के लिए बीमांकिक रिपोर्ट और सारांश) (संशोधन) विनियम, 2022

फा. सं. भा.बी.वि.वि.प्रा./विनि./6/185/2022.—बीमा अधिनियम, 1938 (1938 का 4) की धाराओं 13, 64वी और 64वीए तथा बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 (1999 का 41) की धारा 26 के साथ पठित बीमा अधिनियम, 1938 (1938 का 4) की धारा 114ए की उप-धारा (2) के खंड (जी), (वाई), (जेड) और (जेडए) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्राधिकरण बीमा सलाहकार समिति के साथ परामर्श करने के बाद, इसके द्वारा भारतीय बीमा विनियामक और विकास प्राधिकरण (जीवन बीमा व्यवसाय के लिए बीमांकिक रिपोर्ट और सारांश) विनियम, 2016 का संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ

• क. ये विनियम भारतीय बीमा विनियामक और विकास प्राधिकरण (जीवन बीमा व्यवसाय के लिए बीमांकिक रिपोर्ट और सारांश) (संशोधन) विनियम, 2022 कहलाएंगे।
• ख. ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. भारतीय बीमा विनियामक और विकास प्राधिकरण (जीवन बीमा व्यवसाय के लिए बीमांकिक रिपोर्ट और सारांश) विनियम, 2016 में, उपर्युक्त विनियमों के विनियम 4(2)(ख)(घ) के अनुसार फार्म केटी-1 का भाग बनने वाली अपेक्षित शोधन-क्षमता मार्जिन (आरएसएम) कारक सारणी का निम्नानुसार संशोधन किया जाएगाः

• क. “पंक्ति 1.1.2.1.ग निधि आधारित लाभरहित” के बाद निम्नलिखित पंक्ति निविष्ट की जाएगी:

• ख. निम्नलिखित पंक्तियों में, 'पहला कारक' को “0.8%” के स्थान पर “0.6%” से प्रतिस्थापित किया जाएगा:
• (i) 1.2.1.1.ख. गारंटियों के बिना
• (ii) 1.2.1.2.ख. गारंटियों के बिना
• (iii) 1.2.1.3.ख. गारंटियों के बिना
• (iv) 1.2.1.4.ख. गारंटियों के बिना
• (v) 1.2.2.1.ख. गारंटियों के बिना
• (vi) 1.2.2.2.ख. गारंटियों के बिना
• (vii) 1.2.2.3.ख. गारंटियों के बिना
• (viii) 1.2.2.4.ख. गारंटियों के बिना
• (ix) 2.2.1.1.ख. गारंटियों के बिना
• (x) 2.2.1.2.ख. गारंटियों के बिना
• (xi) 2.2.1.3.ख. गारंटियों के बिना
• (xii) 2.2.1.4.ख. गारंटियों के बिना
• (xiii) 2.2.2.1.ख. गारंटियों के बिना
• (xiv) 2.2.2.2.ख. गारंटियों के बिना
• (xv) 2.2.2.3.ख. गारंटियों के बिना

INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA

NOTIFICATION

Hyderabad, the 5th December, 2022

Insurance Regulatory and Development Authority of India (Actuarial Report and Abstract for Life Insurance Business) (Amendment) Regulations, 2022.

F No. IRDAI/Reg/6/185/2022.—In exercise of the powers conferred by clauses (g), (y), (z) and (za) of subsection (2) of Section 114A read with sections 13, 64V and 64VA of the Insurance Act, 1938 (4 of 1938) and section 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority, in consultation with the Insurance Advisory Committee, hereby makes the following regulations to amend Insurance Regulatory and Development Authority of India (Actuarial Report and Abstract for Life Insurance Business) Regulations, 2016 namely: -

1. Short title and commencement

• a. These regulations may be called the Insurance Regulatory and Development Authority of India (Actuarial Report and Abstract for Life Insurance Business) (Amendment) Regulations, 2022.
• b. These regulations shall come into force on the date of their publication in the Official Gazette.

2. In the Insurance Regulatory and Development Authority of India (Actuarial Report and Abstract for Life Insurance Business) Regulations, 2016, the Required Solvency Margin (RSM) factors table forming part of Form KT-1 as per Regulation 4(2)(B)(d) of the said Regulations shall be amended as follows:

• a. The following row shall be inserted after “row 1.1.2.1.c Fund Based Non Participating”:

• b. In the following rows, the ‘First Factor’ shall be substituted by “0.6%” in the place of “0.8%”:
• (i) 1.2.1.1. b. without guarantees
• (ii) 1.2.1.2. b. without guarantees
• (iii) 1.2.1.3.b. without guarantees
• (iv) 1.2.1.4.b. without guarantees
• (v) 1.2.2.1.b. without guarantees
• (vi) 1.2.2.2. b. without guarantees
• (vii) 1.2.2.3.b. without guarantees
• (viii) 1.2.2.4. b. without guarantees
• (ix) 2.2.1.1.b. without guarantees
• (x) 2.2.1.2.b. without guarantees
• (xi) 2.2.1.3.b. without guarantees
• (xii) 2.2.1.4.b. without guarantees
• (xiii) 2.2.2.1.b. without guarantees
• (xiv) 2.2.2.2.b. without guarantees
• (xv) 2.2.2.3.b. without guarantees
