L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx III—[k.M 4 PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la - 205] ubZ fnYyh] cq/ okj ] ebZ 1 7 ] 201 7 @ oS 'kk[k 2 7 ] 193 9 No. 205] NEW DELHI, WEDNESDAY, MAY 17, 2017/VAISAKHA 27, 1939 भारतीय बीमा विवनयामक और विकास प्रावधकरण ऄवधसूचना हैदराबाद, 5 मइ, 2017 भारतीय बीमा विवनयामक और विकास प्रावधकरण (बीमा सिेक्षक और हावन वनधाारक) (पहला संशोधन) विवनयम, 2017 फा. सं. भा.बी.वि.वि.प्रा./विवनयम/7/144/2017 – बीमा विवनयामक और विकास प्रावधकरण ऄवधवनयम, 1999 (1999 का 41) की धाराओं 14 और 26 के साथ पठित बीमा ऄवधवनयम, 1938 की धाराओं 42डी, 42इ, 64यूएम और 114ए द्वारा प्रदत्त शवियों का प्रयोग करते हुए प्रावधकरण, बीमा सलाहकार सवमवत के साथ परामशा करने के बाद, आसके द्वारा भारतीय बीमा विवनयामक और विकास प्रावधकरण (बीमा सिेक्षक और हावन वनधाारक) विवनयम, 2015 में वनम्नवलवखत संशोधन करता है, ऄथाात्:— 1. संवक्षप्त नाम, और प्रारंभ.— (क) ये विवनयम भारतीय बीमा विवनयामक और विकास प्रावधकरण (बीमा सिेक्षक और हावन वनधाारक) (पहला संशोधन) विवनयम, 2017 के नाम से जाने जाएँगे । (ख) ये विवनयम सरकारी राजपत्र में आनके प्रकाशन की तारीख को प्रिृत्त होंगे। 2. भारतीय बीमा विवनवयमक और विकास प्रावधकरण (बीमा सिेक्षक और हावन वनधाारक) विवनयम, 2015 में क. विवनयम 3(2)(iii) में शब्द "ईपययाि 3(2)(iii) में ईवललवखत परीक्षा पयनः देने से छूट प्राप्त है" से पहले शब्द "विवनयम 3(8)(3) के ऄधीन" रखे जाएँगे। ख. विवनयम 3(8)(2) के बाद एक नया खंड (3) वनम्नानयसार वनविष्ट ककया जाएगाः विवनयम 3(8)(3): लाआसेंस के वलए अिेदन ऄपेक्षाएँ पूरी करने के बाद नामांकन की तारीख से 5 िर्ा की ऄिवध के ऄंदर प्रस्तयत ककया जाएगा। 2 THE GAZETTE OF INDIA EXTRAORDINARY [PART III—SEC. 4] बशते कक आन विवनयमों की ऄवधसूचना की तारीख को प्रावधकरण के पास प्रवशक्षणार्थथयों के रूप में वजनका नामांकन ककया गया हो, िे ऄपेक्षाएँ पूरी करने के बाद ऄवधसूचना की तारीख से एक िर्ा ऄथिा नामांकन की तारीख से 5 िर्ा, जो भी बाद में हो, के ऄंदर लाआसेंस के वलए अिेदन प्रस्तयत करेंगे। ग. विवनयम 6(3)(I)(ङ) को वनम्नानयसार संशोवधत ककया जाएगाः ऄहाता का प्रमाण (नोटरीकृत) ऄथिा कदनांक 30 माचा 2002 के अइअरडीए/अदेश/ एसएलए/30/3/2002 के ऄनयसार ककये गये श्रेणीकरण के ऄनयसार पात्र विभाग बताते हुए प्रावधकरण द्वारा जारी ककया गया श्रेणीकरण पत्र। विवनयम 17(3) को वनम्नानयसार प्रवतस्थावपत ककया जाएगाः लाआसेंसधारी सिेक्षक जो प्रवशक्षण देता है, को वपछले 8 िर्ों से ईस विवशष्ट विभाग में सिेक्षक और हावन वनधाारक के रूप में काया करने के वलए िैध लाआसेंस धाठरत करना चावहए। घ. विवनयम 17(6) को वनम्नानयसार संशोवधत ककया जाएगाः- (6) यकद प्रावधकरण द्वारा पहले से लाआसेंस प्रदान ककया गया कोइ सिेक्षक और हावन वनधाारक ईस विभाग को छोड़कर वजसके वलए ईसे लाआसेंस कदया गया है, साधारण बीमा व्यिसाय के ककसी ऄन्य विभाग में सिेक्षक के रूप में काया करने के वलए ईसी प्रकार का लाआसेंस प्राप्त करने की ऄपेक्षा करता है, तो िह ईस विवशष्ट विभाग में काया करने के वलए वपछले अि िर्ों से िैध लाआसेंस धारण करनेिाले लाआसेंसप्राप्त सिेक्षक और हावन वनधाारक के ऄधीन छह महीने से ऄन्यून ऄिवध के वलए प्रवशक्षण प्राप्त करेगा। ङ. ऄनयसूची-I के ऄनयबंध-1 में वनम्नानयसार संशोधन ककया जाएगाः ऄनयसूची-I ऄनयबंध-1 अइअरडीएअइ (बीमा सिेक्षक और हावन वनधाारक) विवनयम, 2015 सिेक्षकों और हावन वनधाारकों के नामांकन और लाआसेंसीकरण के वलए योग्यता मानदंड (विवनयम 3) क्रम सं. विभाग शैवक्षक/तकनीकी/व्यािसावयक/बीमा योग्यताएँ 1. फायर बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ. ऄथिा ईसकी समकक्ष, सी.ए./अइ.सी.डब्लयू.ए.,ए.अइ.अइ.अइ./ एफअइअइअइ/ अइअइअरएम से बीमा में स्नातकोत्तर वडप्लोमा; 2. मरीन कागो बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ. ऄथिा ईसकी समकक्ष (मरीन आंजीवनयररग)/नौसंरचना)/मान्यताप्राप्त प्रावधकरण द्वारा जारी जहाज के मास्टर के रूप में क्षमता का प्रमाणपत्र ऄथिा प्रथम श्रेणी के मरीन आंजीवनयर की ईपावध/, ककसी मान्यताप्राप्त विश्वविद्यालय ऄथिा संस्थान/ए.अइ.अइ.अइ./एफ.अइ.अइ.अइ./सी.ए./अइ.सी.डब्लयू.ए. की नौ-रचना में ईपावध ऄथिा वडप्लोमा/ अइ.अइ.अर.एम. से बीमा में स्नातकोत्तर वडप्लोमा; 3. मरीन हल बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ. ऄथिा ईसकी समकक्ष (मरीन आंजीवनयररग/नौ-संरचना)/ककसी मान्यताप्राप्त प्रावधकारण द्वारा जारी जहाज के मास्टर के रूप में क्षमता का प्रमाणपत्र ऄथिा प्रथम श्रेणी के मरीन आंजीवनयर की ईपावध; 4. आंजीवनयररग बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ. ऄथिा ईसकी समकक्ष, ककसी मान्यताप्राप्त संस्था से 3 िर्ा की ऄिवध का वडप्लोमा ऄथिा ईसकी समकक्ष योग्यता; 5. मोटर बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ. ऄथिा ईसकी समकक्ष (मेकावनकल/ऑटोमोबाआल); मेकावनकल आंजीवनयररग/ ऑटोमोबाआल आंजीवनयररग में ककसी मान्यताप्राप्त संस्था से 3 िर्ा की ऄिवध का वडप्लोमा ऄथिा ईसकी समकक्ष योग्यता; III 3 6. विविध बी.इ./बी.टेक./बी.एससी.(आंजीवनयररग)/ए.एम.अइ.इ.ऄथिा ईसकी समकक्ष योग्यता; ककसी मान्यताप्राप्त संस्था से 3 िर्ा की ऄिवध का वडप्लोमा ऄथिा ईसकी समकक्ष योग्यता; सी.ए./अइ.सी.डब्लयू.ए.;ए.अइ.अइ.अइ./ एफ.अइ.अइ.अइ./ अइअइअरएम से बीमा में स्नातकोत्तर वडप्लोमा; 7. एलओपी सी.ए./अइ.सी.डब्लयू.ए.; ए.अइ.अइ.अइ/एफ.अइ.अइ.अइ. 8. फसल बीमा ककसी मान्यताप्राप्त विश्वविद्यालय से कृवर् विज्ञान में बी.एससी. ठटप्पणीः 1. नामांकन और लाआसेंसीकरण हेतय ऄहाता प्राप्त करने के वलए अिेदक को वनयवमत छात्र के रूप में पूणाकावलक पाठ्यक्रम में ईपवस्थत होने के बाद ककसी मान्यताप्राप्त संस्थान से स्नातक की ईपावध (वडग्री) ऄथिा वडप्लोमा प्राप्त कर चयका होना चावहए ऄथिा ऄंशकावलक पाठ्यक्रम से संबंवधत संस्थान ऄथिा विश्वविद्यालय द्वारा जारी ककया गया समतयलयता प्रमाणपत्र प्राप्त कर चयका होना चावहए। बशते कक पाठ्यक्रमों ऄथाात् ए.एम.अइ.इ.; सी.ए./अइ.सी.डब्लयू.ए. और ए.अइ.अइ.अइ/ एफ.अइ.अइ.अइ. के मामले में पाठ्यक्रम समापन के प्रमाणपत्र को िैध ऄहाता के रूप में माना जाता है। 2. ईपययाि सभी तकनीकी ईपावध (वडग्री)/वडप्लोमा वनम्नवलवखत से प्राप्त ककये जाएँगे क. एअइसीटीइ द्वारा ऄनयमोकदत संस्थाएँ ऄथिा ख. विश्वविद्यालय ऄनयदान अयोग द्वारा मान्यताप्राप्त विश्वविद्यालय ऄथिा ग. मानि संसाधन विकास विभाग (एमएचअरडी) द्वारा मान्यताप्राप्त राष्ट्रीय महत्ि की संस्थाएँ। छ. विवनयम 21(iv) को वनम्नानयसार संशोवधत ककया जाएगाः छमाही की समावप्त से 45 कदन के ऄंदर आन विवनयमों की ऄनयसूची II के ऄंतगात वनधााठरत वनम्नानयसार फामा- अइअरडीए-19 के ऄनयसार छमाही ठरपोटा ऄनयसूची-II* फामा अइअरडीएअइ–19 विवनयम 21 (iv) 31 माचा__________/ 30 वसतंबर ___________ को समाप्त छमाही के वलए सिेक्षण कायों संबंधी ठरपोटा साधारण बीमाकताा का नामः ठरपोर्टटग तारीख को अंतठरक कमाचारी सिेक्षकों की संख्या क्रम सं. व्यिसाय की श्रेणी सूवचत ककये गये दािों की संख्या ईन दािों की संख्या वजनके वलए एसएलए विवनयमों के ऄनयसार सिेक्षक की वनययवि ऄपेवक्षत थी अंतठरक कमाचारी सिेक्षकों द्वारा ककये गये सिेक्षण अंतठरक कमाचारी सिेक्षकों को छोड़कर ऄन्य के द्वारा ककये गये सिेक्षण िैयविक कॉरपोरेट 1 फायर 2 मरीन कागो 3 मरीन हल 4 आंजीवनयररग 5.क मोटर नकदी रवहत 4 THE GAZETTE OF INDIA EXTRAORDINARY [PART III—SEC. 4] 5ख मोटर नकदी रवहत को छोड़कर ऄन्य 6 एसएलए विवनयमों के ऄनयसार विविध 7 एलओपी (लाभों की हावन) 8 फसल कयलः मैं आसके द्वारा सत्यवनष्ठापूिाक स्िीकार करता/करती हँ कक उपर प्रस्तयत ककया गया वििरण मेरी ऄवधकतम जानकारी के ऄनयसार सही है। प्रावधकृत हस्ताक्षरकताा कदनांकः *फामा अइअरडीएअइ-19 ऄनयसूची-II में वनविष्ट ककया गया है। टी. एस. विजयन, ऄध्यक्ष [विज्ञापन III/4/ऄसा./69/17] INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION Hyderabad, the 5th May, 2017 Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) (First Amendment) Regulations, 2017 F. No. IRDAI/Reg/7/144/2017 - In exercise of the powers conferred by Sections 42D, 42E, 64UM and 114A of the Insurance Act, 1938 read with 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority, in consultation with the Insurance Advisory Committee, hereby makes the following amendments to Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015, namely:— 1. Short title and commencement: - A. These regulations may be called Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) (First Amendment) Regulations, 2017. B. They shall come into force on the date of their publication in the Official Gazette. 2. In the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015 A. In Reg. 3(2)(c), after the words ―is exempt from taking examination once again stated under 3(2)(c) above‖, the words ―subject to Reg.3(8)(c)‖ shall be inserted. B. After Reg.3(8)(b), a new clause (c) shall be inserted as under: Reg. 3 (8)(c): The application for license shall be submitted within a period of 5 years from the date of enrolment after meeting the requirements. Provided that those who have enrolled as trainees with the Authority as on the date of notification of these Regulations, shall apply for license after meeting the requirements within one year from the date of notification or 5 years from the date of enrolment, whichever is later. C. Reg. 6(3) (a)(v) shall be amended as under: Proof of qualification (notarized) or categorization letter issued by the Authority stating the eligible Departments in accordance with the categorization made vide IRDA/Order/SLA/30/3/2002 dated 30th March, 2002. D. Reg. 17(3) shall be substituted as under: III 5 The licensed surveyor who provides training should have held a valid license to act as Surveyor and Loss Assessor in that particular department for the last 8 years. E. Reg. 17(6) shall be amended as under: (6) If a Surveyor and Loss Assessor already licensed by the Authority seeks to obtain a similar license for acting as a surveyor in a department of general insurance business other than for which he has been licensed, he shall undergo a period of training of not less than six months under a licensed Surveyor and Loss Assessor holding a valid license to act in that particular Department for the last 8 years. F. Annexure-1 to Schedule I shall be amended as under: SCHEDULE–I Annexure-1 IRDAI (Insurance Surveyors and Loss Assessors) Regulations, 2015 Qualification Criteria for Enrolment and Licensing of Surveyors and Loss Assessors (Regulation 3) S.No Department Academic/technical/Professional/Insurance Qualifications 1. (Engg.)/ A.M.I.E. or its equivalent thereof (Marine Engineering/ Naval Architecture),/ certificate of competency as Master of Ship or as First Class Marine Engineer issued by a recognized authority, Degree or diploma in Naval Architecture of a recognized University or Institute./ A.I.I.I./ F.I.I.I./ C.A./I.C.W.A /Post Graduate Diploma in Insurance from IIRM; 3. Marine Hull B.E./ B.Tech./ B.Sc. (Engg.)/ A.M.I.E. or its equivalent thereof (Marine Engineering/ Naval Architecture)/ certificate of competency as Master of Ship or as First Class Marine Engineer issued by a recognized authority, 4. Engg. B.E./ B.Tech./ B.Sc. (Engg.)/ A.M.I.E. or its equivalent , Diploma of 3 years duration from a recognised institution or its equivalent thereof 5. Motor B.E./ B.Tech./ B.Sc. (Engg.)/ A.M.I.E. or its equivalent; Diploma of 3 years duration from a recognised institution or its equivalent; C.A./ I.C.W.A.; A.I.I.I./ F.I.I.I./ Post Graduate Diploma in Insurance from IIRM; 7. LOP C.A./ I.C.W.A; A.I.I.I./ F.I.I.I 8. Crop Insurance B. Sc. in Agricultural Science from a recognised University Note: 1. In order to qualify for enrolment and licensing, an applicant should have secured a degree or diploma of a recognized Institute after attending full time course as a regular student or part time course with equivalency certificate issued by the respective Institute/University. Provided in case of courses viz. A.M.I.E; C.A./ I.C.W.A and A.I.I.I./F.I.I.I., course completion certificate is treated as valid qualification. 2. All technical Degree/Diploma stated above shall be obtained from a. AICTE approved Institutions or b. Universities recognized by University Grants Commission or c. institutions of national importance recognized by Ministry of Human Resources Development (MHRD). G.
