भारतीय बीमा विनियामक और विकास प्राधिकरण अधिसूचना

भारतीय बीमा विनियामक और विकास प्राधिकरण (भारतीय बीमा कंपनियों का पंजीकरण) (आठवाँ संशोधन) विनियम, 2016

फा. सं. भा.बी.वि.वि.प्रा./विनियम/20/132/2016.—बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 (1999 का 41) की धाराओं 14 और 26 के साथ पठित बीमा अधिनियम, 1938 (1938 का 4) की धारा 114A द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्राधिकरण बीमा सलाहकार समिति के साथ परामर्श करने के बाद, इसके द्वारा निम्नलिखित विनियम बनाता है, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ

• (1) ये विनियम भारतीय बीमा विनियामक और विकास प्राधिकरण (भारतीय बीमा कंपनियों का पंजीकरण) (आठवाँ संशोधन) विनियम, 2016 के नाम से जाने जाएँगे।
• (2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. विनियम 11(1) के बाद निम्नलिखित परंतुक शामिल किया जाएगा, अर्थात् "आगे यह भी शर्त होगी कि खंड (ii) किसी सूचीबद्ध भारतीय बीमा कंपनी के किसी भारतीय प्रवर्तक अथवा भारतीय निवेशक के लिए लागू नहीं होगा जहाँ ऐसा भारतीय प्रवर्तक और / या भारतीय निवेशक भारतीय रिज़र्व बैंक, भारतीय प्रतिभूति और विनिमय बोर्ड और / या राष्ट्रीय आवास बैंक द्वारा विनियमित हों।"

INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION

Hyderabad, the 25th July, 2016

Insurance Regulatory and Development Authority of India (Registration of Indian Insurance Companies) (Eighth Amendment) Regulations, 2016

F. No. IRDAI/Reg/20/132/2016.—In exercise of the powers conferred by Section 114A of the Insurance Act, 1938 (4 of 1938) read with sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority in consultation with the Insurance Advisory Committee, hereby makes the following regulations, namely :-

1. Short title and commencement

• (1) These regulations may be called the Insurance Regulatory and Development Authority of India (Registration of Indian Insurance Companies) (Eighth Amendment), Regulations, 2016
• (2) They shall come into force on the date of their publications in the Official Gazette.

2. After Regulation 11 (1), the following proviso is inserted, namely "Provided further that the clause (ii) shall not be applicable to any Indian promoter or Indian investor of a listed Indian insurance company where such Indian promoter and /or Indian investor are regulated by Reserve Bank of India, Securities and Exchange Board of India and /or National Housing Bank."
