सं. भा.बी.िव.िव.ᮧा./िविनयम/1/138/2017.—बीमा िविनयामक और िवकास ᮧािधकरण अिधिनयम, 1999 (1999 का 41) कᳱ धाराᲐ 14 और 26 तथा समय-समय पर यथासंशोिधत बीमा अिधिनयम, 1938 कᳱ धाराᲐ 42डी और 42ई के साथ पᳯठत समय-समय पर यथासंशोिधत बीमा अिधिनयम, 1938 (1938 का 4) कᳱ धारा 114ए ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, ᮧािधकरण बीमा सलाहकार सिमित के साथ परामशᭅ करने के बाद इसके ᳇ारा भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण) िविनयम, 2015 मᱶ िन᳜िलिखत संशोधन करता है, अथाᭅत् :- 1. संिᭃ᳙ नाम और ᮧारंभ : 1.1 . ये िविनयम भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण) (पहला संशोधन) िविनयम, 2016 कहलाएँगे । 1.2. ये िविनयम सरकारी राजपᮢ मᱶ इनके ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे। 2. भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण) िविनयम, 2015 मᱶ (क) िविनयम 3(क) और िविनयम 11.1 मᱶ "के बीमा उ᭜पादᲂ….." श᭣दᲂ के पहले "के अिधकतम" श᭣द अंत:᭭थािपत ᳰकये जाएँगे 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) िविनयम (3) मᱶ िन᳜िलिखत खंड अंत:᭭थािपत ᳰकया जाएगाः (घ) बीमा िवपणन फमᭅ (आईएमएफ) िन᳜िलिखत के अधीन बीमा उ᭜पादᲂ के दूर᭭थ िवपणन के संबंध मᱶ समय- समय पर ᮧािधकरण ᳇ारा जारी ᳰकये गये ᳰदशािनदᱷशᲂ/ िविनयमᲂ/ पᳯरपᮢᲂ का पालन करेगाः दूर᭭थ िवपणन i. बीमा िवपणन फमᭅ (आईएमएफ) ᳇ारा दूर-िवपणनकताᭅ(Ა) को िनयुᲦ ᳰकये िबना ᳰकया जाएगा। ii. ᮧािधकरण से पूवᭅ अनुमोदन ᮧा᳙ करने के बाद ᳰकया जाएगा। iii. केवल बीमा िवᮓेताᲐ (आईएसपी) के मा᭟यम से ᳰकया जाएगा। iv. केवल उ᭠हᱭ बीमाकताᭅ(Ა) कᳱ ओर से ᳰकया जाएगा िजनके साथ अनुसूची V के भाग I मᱶ िविन᳸द᳥ ᱨप मᱶ बीमा ᳞ वसाय कायᭅकलाप करने के िलए बीमा िवपणन फमᭅ ᳇ारा करार ᳰकये गये हᲂ। (ग) िविनयम 4.1 मᱶ िन᳜िलिखत खंड ज अंत:᭭थािपत ᳰकया जाएगाः (ज) यह वᲦ᳞ देते ᱟए एक वचनपᮢ ᮧ᭭तुत करेगा ᳰक बीमा ᳞ वसाय कᳱ अपेᭃा / अᮕता उ᭜पादन के िलए दूर िवपणनकताᭅ(Ა) को िनयुᲦ नहᱭ ᳰकया जाएगा। (घ) िविनयम 5.2 (vi) को िन᳜िलिखत से ᮧित᭭थािपत ᳰकया जाएगाः "᭍या आवेदक के नाम मᱶ श᭣द "बीमा िवपणन" अथवा "आईएमएफ" है। (ङ) िविनयम 14.2 मᱶ िन᳜िलिखत खंड अंत: ᭭थािपत ᳰकया जाएगाः (क) यह वᲦ᳞ देते ᱟए एक वचनपᮢ ᮧ᭭तुत करेगा ᳰक बीमा ᳞ वसाय कᳱ अपेᭃा / अᮕता उ᭜पादन के िलए दूर िवपणनकताᭅ िनयुᲦ नहᱭ ᳰकया जाएगा/ नहᱭ ᳰकये जाएँगे। (च) अनुसूची-III (1) (सामा᭠य) को िन᳜िलिखत ᱨप मᱶ ᮧित᭭थािपत ᳰकया जाएगा "1. सामा᭠यः ᮧधान अिधकारी और आईएसपी के िलए ᮧिशᭃण समय-समय पर ᮧािधकरण ᳇ारा िनणᱮत ᱨप मᱶ अनुमोᳰदत सं᭭था ᳇ारा और अनुमोᳰदत तरीके से ऑन- लाइन संचािलत ᳰकया जाएगा"। (छ) अनुसूची IV भाग III (2) को िन᳜ानुसार ᮧित᭭थािपत ᳰकया जाता है "ᭃेᮢ" को एक ऐसे िजले के ᱨप मᱶ पᳯरभािषत ᳰकया गया है िजसके िलए बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण वैध हो। तथािप, यᳰद आवेदक ᳇ारा अनुरोध ᳰकया जाता है तो ᳰकसी रा᭔य के राजधानी नगर मᱶ पंजीकृत बीमा िवपणन फमᭅ (आईएमएफ) के मामले मᱶ ऐसे नगर कᳱ नगरपािलका / नगर िनगम के अंतगᭅत पᳯरभािषत ᭃेᮢ पᳯरचालन के ᭃेᮢ के ᱨप मᱶ माना जाएगा। (ज) अनुसूची V भाग-II (ङ) को िन᳜ानुसार ᮧित᭭थािपत ᳰकया जाता है "अपने कायᭅ᭭थल पर/ कायाᭅलय मᱶ ᮧािधकरण ᳇ारा जारी ᳰकये गये अपने रिज᭭ᮝीकरण का िववरण ᮧदᳶशत करेगा जैसे पंजीकरण के िनगᭅम कᳱ तारीख और उसकᳱ वैधता, और संबंिधत िविनयमनकताᭅᲐ ᳇ारा जारी ᳰकये गये ᮧमाणपᮢᲂ के साथ िवपणन ᳰकये जानेवाले अ᭠य िवᱫीय उ᭜पादᲂ कᳱ सूची, िशकायत िनवारण ᮧᳰᮓया, लोकपालᲂ कᳱ सूची तथा अ᭠य ᮧयो᭔य संिविध(यᲂ) के अंतगᭅत बीमा िविनयामक और िवकास ᮧािधकरण के िलए और उनकᳱ ओर से अनुबंध-2 भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण) िविनयम, 2015 फामᭅ सी [िविनयम 17 देखᱶ] रिज᭭ᮝीकरण ᮧमाणपᮢ कᳱ अनुिलिप (डूि᭡लकेट) समय-समय पर यथासंशोिधत बीमा अिधिनयम, 1938 (1938 का 4) कᳱ धारा 42डी कᳱ उप-धारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए ᮧािधकरण इसके ᳇ारा उपयुᭅᲦ अिधिनयम के अधीन "_____________________________________________" को बीमा िवपणन फमᭅ के ᱨप मᱶ कायᭅ करने के िलए रिज᭭ᮝीकरण ᮧदान करता है। 1. उᲦ बीमा िवपणन फमᭅ (आईएमएफ) को _________________ रा᭔य के __________________ िजला/ नगरपािलका/ नगर िनगम के ᭃेᮢ मᱶ पᳯरचालन करने कᳱ अनुमित दी जाएगी। 2. कायᭅकलापᲂ का िव᭭तारः बीमा उ᭜पादᲂ कᳱ अपेᭃा करना अथवा उ᭠हᱶ ᮧा᳙ करना हाँ/नहᱭ बीमा संबंधी सेवा कायᭅ क) बीमाकताᭅᲐ के बैक ऑᳰफ़स कायᭅ करना ख) ᳇ारा भारतीय बीमा िविनयामक और िवकास ᮧािधकरण (बीमा िवपणन फमᭅ का रिज᭭ᮝीकरण) िविनयम, 2015 के िविनयम 14 तथा बीमा िविनयामक और िवकास ᮧािधकरण अिधिनयम, 1999 (1999 का 41) के अधीन ᳰदनांकः आदेशानुसार, भारतीय बीमा िविनयामक और िवकास ᮧािधकरण के िलए और उनकᳱ ओर से INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA NOTIFICATION Hyderabad, the 17th January, 2017 Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) (First Amendment) Regulations, 2016 F. No. IRDAI/Reg/1/138/2017.—In exercise of the powers conferred by Section 114A of the Insurance Act, 1938 (4 of 1938), as amended from time to time, read with sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999) and sections 42D and 42E of Insurance Act, 1938, as amended from time to time, the Authority in consultation with the Insurance Advisory Committee, hereby makes the following amendments to Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm), Regulations 2015, namely: 1. Short title and commencement: 1.1 These regulations may be called Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) (First Amendment) Regulations, 2016 1.2 They shall come into force on the date of their publication in the Official Gazette. 2. In the Insurance Regulatory and Development Authority of India (Registration of Insurance Marketing Firm) Regulations, 2015 (A) Insert the words “maximum of” after the words “… Insurance Products of” in Reg. 3(a) and Reg.11.1 (B) In regulation (3) following clause d shall be inserted: (d) An IMF shall abide by the guidelines /regulations/circulars issued by the Authority from time to time on Distance Marketing of Insurance Products subject to the following: Distance Marketing shall be i. undertaken by the IMF without engaging tele-marketer(s). ii. undertaken after obtaining prior approval from the Authority. iii. carried out only through ISPs. iv. on behalf of those Insurer(s) with whom agreements are entered by IMF for carrying out insurance business activity as specified in Part I of Schedule V. (C) In regulation 4.1 the following clause h shall be inserted: (h) Submit an undertaking stating that a tele marketer(s) shall not be engaged for solicitation/lead generation of insurance business. (D) Regulation 5.2 (vi) shall be substituted with the following: “Whether the Applicant has in its name the words “Insurance Marketing” or “IMF” ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7 (E) In regulation 14.2 following clause shall be inserted: (a) Submit an undertaking stating that a tele marketer(s) shall not be engaged for solicitation/lead generation of insurance business. (F) SCHEDULE-III (1) (General) is replaced as “1. General: The training for Principal Officer and ISP shall be conducted on-line by an approved institution, and in the manner, as decided by the Authority from time to time”. (G) Schedule IV Part III (2) is replaced as The “Area” is defined as a district for which the registration of the Insurance Marketing Firm is valid. However, if requested by an applicant, in case of IMFs registered in capital city of any State, the area defined under Municipality/ Municipal Corporation of such city shall be considered as area of operation. (H) Schedule V Part-II (e) is replaced as “display at their place of work/office, details of their registration issued by the Authority such as, date of issue of registration and its validity, and list of other financial products marketed along with the certificates issued by respective regulators, grievance handling process, list of ombudsman and such other relevant information as may be required under applicable statute(s).” (I) In schedule X(3) following sentence shall be inserted after the words “…insurance marketing firm in the business.” “The ratio of AOA:AOY shall be 1:1.” (J) The following words in the table are deleted in Form B, C and D and the revised forms are placed as Annexure 1, 2 and 3 respectively. Registration Code for the Insurance Marketing Firm is ____________________ 1. The IMF shall be allowed to operate in _____________________district/ Municipality/ Municipal Corporation area of __________________state. 2.
